There is a growing interest in how people conceptualise the legal domain for the purpose of legal knowledge systems. In this paper we discuss four such conceptualisations (referred to as ontologies): McCarty's language for legal discourse, Stamper's norma formalism, Valente's functional ontology of law, and the ontology of Van Kralingen and Visser. We present criteria for a comparison of the ontologies and discuss the strengths and weaknesses of the ontologies in relation to these criteria. Moreover, we critically review the criteria.

With an increasing use of artificial intelligence (AI) systems, theorists have analyzed and argued for the promotion of trust in AI and trustworthy AI. Critics have objected that AI does not have the characteristics to be an appropriate subject for trust. However, this argumentation is open to counterarguments. Firstly, rejecting trust in AI denies the trust attitudes that some people experience. Secondly, we can trust other non‐human entities, such as animals and institutions, so why can we not trust AI systems? (...) Finally, human–AI trust is criticized based on a conception of human–human trust, which does not recognize the distinctiveness of the human–AI relationship. This article aims to refute these counterarguments based on the genealogical analyses of ‘trust’ and ‘trustworthiness’ of Karen Jones and Thomas Simpson, who show that trust and trustworthiness help to overcome vulnerabilities. This function of trust gives reason to use human–human trust as a standard. For this function, it is important that trustees are responsive to trust. While animals and institutions could be responsive, narrow AI systems are unable to be responsive to trust. Therefore, we should not apply trust to AI and instead direct our trust to those who can be responsive to and held responsible for our trust. (shrink)

The Dutch Republic holds a marginal position in the debate on the transition from feudalism to capitalism, despite its significance in the early stage of the development of global capitalism. While the positions of those Marxists who did consider the Dutch case range from seeing it as the first capitalist country to rejecting it as an essentially non-capitalist commercial society, all involved basically accept an image of Dutch development as being driven by commerce rather than real advances in the sphere (...) of production. Their shared interpretation of the Dutch ‘Golden Age’, however, rests on an interpretation of Dutch economic history that does not match the current state of historical knowledge. Rereading the debate on the Dutch trajectory towards capitalism in the light of recent economic historiography seriously challenges established views, and questions both major strands in the transition-debate. This paper articulates dignity as relational engagement in concrete care situations. Dignity is often understood as an abstract principle that represents inherent worth of all human beings. In actual care practices, this principle has to be substantiated in order to gain meaning and inform care activities. We describe three exemplary substantiations of the principle of dignity in care: as a state or characteristic of a situation; as a way to differentiate between socio-cultural positions; or as personal meaning. We continue our (...) analysis by presenting cases on dignity in care related to us in focus groups with medical professionals. Our empirical ethical lens is in this paper is to analyse, not the meaning of dignity, but the way in which it emerges in practices where it is pursued, within relationships between people, technologies, places, regulations, and the values cherished by or embedded in them. We show that professional caregivers recognize in the dignity of the person they care for their own dignity; giving up on the one implies no less than giving up on the other. This ‘mirrored experience’ of dignity expresses itself in professional’s engagement with the situation. The value of this engagement, we argue, lies not primarily in realizing the particular content of the values at stake. We point to the importance of engagement itself, even if the values engaged with cannot be realized to the full, and even if competing versions of dignity are at stake simultaneously. In this way the caregivers provide us with interesting examples of moral actorship in situations of conflicting values. (shrink)

In response to the chronic overuse and misuse of pesticides in agriculture, governments in Southeast Asia have sought to improve food safety by introducing public standards of good agricultural practices (GAP). Using quantitative farm-level data from an intensive horticultural production system in northern Thailand, we test if fruit and vegetable producers who follow the public GAP standard use fewer and less hazardous pesticides than producers who do not adhere to the standard. The results show that this is not the case. (...) By drawing on qualitative data from expert interviews and an action research project with local litchi (“lychee”) producers we explain the underlying reasons for the absence of significant differences. The qualitative evidence points at poor implementation of farm auditing related to a program expansion that was too rapid, at a lack of understanding among farmers about the logic of the control points in the standard, and at a lack of alternatives given to farmers to manage their pest problems. We argue that by focusing on the testing of farm produce for pesticide residues, the public GAP program is paying too much attention to the consequences rather than the root cause of the pesticide problem; it needs to balance this by making a greater effort to change on-farm practices. Johannes Versor († after 1482) was a prominent philosopher in the late fifteenth century, whose works were widely diffused. In recent scholarship, Versor has been associated with two schools of thought: Thomism and Albertism. These, however, were rivals—especially in Cologne, where Versor's works were printed repeatedly. Given this historical context, how should Versor's position amidst the quarrels of the schools be interpreted? Although he evidently used the works of both Albert and Thomas, there is no evidence that Versor ever committed (...) himself to either Albertism or Thomism. In addition, the Cologne printings of his works suggest that Versor's contemporaries considered him an independent authority. Therefore, Versor cannot be rated among the members of either school. This paper describes the approach of empirical ethics, a form of ethics that integrates non-positivist ethnographic empirical research and philosophy. Empirical ethics as it is discussed here builds on the ‘empirical turn’ in epistemology. It radicalizes the relational approach that care ethics introduced to think about care between people by drawing in relations between people and technologies as things people relate to. Empirical ethics studies care practices by analysing their intra-normativity, or the ways of living together the actors within these (...) practices strive for or bring about as good practices. Different from care ethics, what care is and if it is good is not defined beforehand. A care practice may be contested by comparing it to alternative practices with different notions of good care. By contrasting practices as different ways of living together that are normatively oriented, suggestions for the best possible care may be argued for. Whether these suggestions will actually be put to practice is, however, again a relational question; new actors need to re-localize suggestions, to make them work in new practices and fit them in with local intra-normativities with their particular routines, material infrastructures, know-how and strivings. There has been much talk of the need to build intermediate models of the expertise required preparatory to constructing a knowledge-based system in the legal domain. Such models offer advantages for verification, validation, maintenance and reuse. As yet, however, few such models have been reported at a useful level of detail. In this paper we describe a method for conceptualising legal domains as well as its application to a substantial fragment of the Dutch Unemployment Benefits Act (DUBA).We first discuss the (...) intermediate models (called expertise models), then present a three-stage method for their construction, drawing on the CommonKADS work in knowledge acquisition, conceptual models of statute law, and the KANT method of knowledge analysis. Subsequently, we describe how these techniques were applied to the DUBA, and provide detailed examples of the resulting model. Finally, conclusions on the framework and guidelines are given as well as means of recording and presenting the various design choices. (shrink)

Community engagement is increasingly defended as an ethical requirement for biomedical research. Some forms of community engagement involve asking the consent of community leaders prior to seeking informed consent from community members. Although community consent does not replace individual consent, it could problematically restrict the autonomy of community members by precluding them from research when community leaders withhold their permission. Community consent is therefore at odds with one of the central principles of bioethics: respecting autonomy. This raises the question as (...) to how community consent can be justified or even required. This paper aims to provide an answer to this question by arguing, based on the work of Taylor and Kymlicka, that community practices are important for the identity and autonomy of community members. When these practices are incompatible with a solitary focus on individual informed consent, they need to be protected by making these decision‐making practices (including asking permission to community authorities) part of the consent process. Since these decision‐making practices are important for the autonomy of community members, community consent with the goal of protecting these practices is not necessarily in conflict with autonomy. The core theme of the special issue in which this article appears is the inherent impossibility of confining the knowledge required to build and sustain the instruments of travel to a single space or institution. This is certainly true for the ships that built empires – the large sailing and later steam ships produced by navies and companies in the process of European expansion. Ships traveled between polities and required repairs overseas, taking the construction knowledge and practices with them. Skilled (...) laborers – experienced shipwrights and increasingly also trained engineers – helped to transfer shipbuilding practices across oceans, and to adapt these practices to local conditions based on forms of “blended know-how.” This article explores how the circulation of shipbuilding knowledge and practices within and between maritime empires changed with the increasing pace of industrialization. It does so on the basis of three moments: the Dutch East India Company’s shipbuilding activities in Asia in the seventeenth and eighteenth centuries; the interaction between private industry and the Dutch state in advancing machine-manufacturing in both the Netherlands and on Java in the 1830s and 1840s; and the aid provided by Dutch engineers in laying the groundwork for Japanese industrial warship-construction in the second half of the nineteenth century. Such transfers put high demands on the capacities of states and naval administrators in controlling the flows of necessary resources and skilled labor, requiring complex arrangements between states and private capital. Industrialization did not change this basic fact, but it did change the nature of these arrangements. Although shipbuilding knowledge always remained practice-driven, highly mobile and susceptible to local adaptation, the increasing technological demands created by the transition from sail to steam and wood to iron, combined with the extension of the power of states and transnationally operating manufacturing companies, considerably changed the institutional embeddings and societal consequences of its circulation. Many contemporary thinkers of the Anthropocene, who attempt to articulate a non-modern and relational ontology, all too readily dismiss critical theory inherited from the Frankfurt School for being anthropocentric, failing to acknowledge certain basic similarities. Instead, this article argues that the scaffolding of Anthropocene thinking—the recognition of the origins of the contemporary condition of ‘loss of world’ and the hope of ‘living on in the ruins’—share much with earlier critical theorists’ recognition that the Holocaust necessitated a fundamental break with the (...) past. In reading these two sets of literatures together, we suggest we can get a better grasp of the stakes involved in the contemporary crisis of critique, and in the speculative framings enabling alternative futures to come into being. Nurses and ethicists worry that the implementation of care at a distance or telecare will impoverish patient care by taking out ‘the heart’ of the clinical work. This means that telecare is feared to induce the neglect of patients, and to possibly hinder the development of a personal relation between nurse and patient. This study aims to analyse whether these worries are warranted by analysing Dutch care practices using telemonitoring in care for chronic patients in the Netherlands. How do clinical (...) practices of nursing change when telecare devices are introduced and what this means for notions and norms of good nursing? The paper concludes that at this point the practices studied do not warrant the fear of negligence and compromised relations. Quite the contrary; in the practices studied, telecare lead to more frequent and more specialised contacts between nurses and patients. The problem of the time of a killing is often cited as providing grounds for rejecting the action identification thesis favoured by Anscombe and Davidson. In this paper I make three claims. First, I claim that this problem is a threat to the action identification thesis because of two assumptions the thesis makes: since the thesis takes actions to be a kind of doings, it has to assume that agents’ doings last as long as their actions and vice versa. Second, (...) I claim that not making both of these assumptions necessarily leads to another problem, the problem of the acting dead. This means that any theory of action has to choose its poison and face either one of these unresolved problems. Third, I claim that the solution to the problem of the time of a killing can be found by heeding linguistic arguments that ‘kill’ cannot mean ‘cause to die,’ as is commonly assumed, but instead has to have a more complex meaning. I discuss an alternative, more complex proposal and show how it allows us to keep the action identification thesis, fits colloquial usage of ‘kill’ and deals with the problem of the time of a killing. Artefacts can influence our actions in several ways. They can be instruments, enabling and facilitating actions, where their presence affects the number and quality of the options for action available to us. They can also influence our actions in a morally more salient way, where their presence changes the likelihood that we will actually perform certain actions. Both kinds of influences are closely related, yet accounts of how they work have been developed largely independently, within different conceptual frameworks and for (...) different purposes. In this paper I account for both kinds of influences within a single framework. Specifically, I develop a descriptive account of how the presence of artefacts affects what we actually do, which is based on a framework commonly used for normative investigations into how the presence of artefacts affects what we can do. This account describes the influence of artefacts on what we actually do in terms of the way facts about those artefacts alter our reasons for action. In developing this account, I will build on Dancy’s (2000a) account of practical reasoning. I will compare my account with two alternatives, those of Latour and Verbeek, and show how my account suggests a specification of their respective key concepts of prescription and invitation. Furthermore, I argue that my account helps us in analysing why the presence of artefacts sometimes fails to influence our actions, contrary to designer expectations or intentions. (shrink)

This paper starts out with a theoretical argument, based on panel data, that public mood in general and societal pessimism in particular should be measured from an explicitly temporal perspective. Next, based on a survey among more than 200 Japanese students and a wide array of existing data sources in three different languages and covering several decades it is shown that public mood in three quite different countries – first and foremost Japan, but also the United States and The Netherlands (...) – is quite apprehensive. In all these three countries societal pessimism can be observed during the past quarter century. I intend to share my thoughts in three parts: to recall some of the great contemporary philosophers of religion and culture; to indicate a new vision of the culture that was born at the Second Vatican Council; focus on some issues in the field of faith and culture on our common path to the third millennium.

Eleven years after Kosovo’s unilateral declaration of independence, Spain’s position vis-à-vis Kosovo has not only not varied, but it has become stronger, turning Madrid into the leader of the Kosovo non recognizers club within the EU. This paper analyses Kosovo-Spain relations in the last eleven years. More specifically, the paper examines the reasons behind the non-recognition of Kosovo and the approach of the Spanish governments toward Kosovo’s statehood. This is followed by a thorough analysis on how Kosovo’s path for self-determination (...) played a major role in Catalonia’s quest for independence in 2017. The empirical research demonstrates that Spain’s main reason not to recognise Kosovo is based on the country’s internal dynamics; namely, Catalonia and the Basque country. Likewise, the paper argues that the Spanish governments throughout the last eleven years have created an analogy between Kosovo and Catalonia; not in their political statements, but in their political decisions, by worsening the almost inexistent diplomatic relations with Kosovo, when the Catalan path for independence was at its highest peak. By the same token, the paper reveals that this position was enhanced and driven by Catalan separatism, that continuously used Kosovo’s unilateral declaration of independence as a model to further their own path for self-determination. The data provided and analysed in this paper as well as the statements made are based on desk research and seven semi-structured interviews conducted in Prishtina, Brussels, Madrid and Barcelona in 2018. After a contrast of the the prima facie complexity of the causality of the rational agent with the received scientific doctrine of causality, it is noticed that the prima facie causal authority of rational action belongs to a macroscopic domain in which all science and philosophy takes place and in which the formal/telic nature of that causality must be taken for granted. Any philosophical justification or philosophical criticism of the status of that macroscopic arena must therefore take place within that (...) same arena. It is then argued that a justification of the ontological status of that arena is possible by an exploitation of the reflexive resource of the rational awareness we exercise within that arena. It is claimed that this resource can be fairly described as the justification of our direct knowing of real beings/entities other than the knower and that such realistic knowing is at the same time an exemplary mode of causality having a complexity that is both formal/telic and hierarchical . Certification for biofuels has been developed to ensure that biofuel production methods adhere to social and environmental sustainability standards. As such, requiring biofuel production to be certified has become part of EU policy through the 2009 renewable energy directive, that aims to promote energy security, reduce emissions and promote rural development. According to the EU RED, in 2020 10 % of our transport energy should come from renewable sources, most of which are expected to be biofuels. In this paper I (...) examine what biofuel certificates are, what they can achieve and what their limitations are. Methodologically, I will evaluate them using the standards of instrumental, practical and communicative rationality. With regard to instrumental rationality, I conclude that the EU RED makes an important but unjustified assumption in demanding certified biofuels for its target: that if biofuel production is sustainable, then biofuel use is too. I also argue that, where the EU assumes that biofuel certification is a sufficient means to achieve the EU RED’s goals, it is at best an insufficient means and at worst not a means at all towards achieving these goals. With regard to practical rationality, I argue that more attention needs to be paid to trade-offs between different goals in the EU RED, particularly with regard to providing investor security and not capping transport energy consumption. With regard to communicative rationality, I argue that the policy-making process of the EU RED has been seriously flawed, and that certification development processes also can improve significantly. FOR THE GREATER part of this century a certain dogmatic complex of analytic-linguistic philosophy has prevented philosophers of that persuasion from acknowledging the real foundation question. It has been taken for granted instead that the foundation question begins and ends with the fate of what has come to be called, in the last two decades, foundationalism. If the thesis of this essay should prove persuasive, it will reinforce the dominant conviction that foundationalism is unacceptable. But that is only incidental to (...) my purpose. It is, however, essential to my purpose that two component dogmas of the complex are also principles of foundationalism. It will therefore be convenient to have before us the principles that appear to be common to the various versions of foundationalism: knowledge is a matter of justified true belief; knowledge consists of a system of propositions, and it is therefore these in which the knower has justified true belief; the justification of some of the propositions is direct, or immediate, and these are the foundational ones; the justification of the rest of the propositions is mediated by the foundational ones and so is indirect.
