Take the strong rhetoric! This expression comes to mind as we set in order the ideas and impressions prompted by Sandra Harding’s “An Organic Logic of Research: A Response to Posey and Navarro”.

Sandra Harding’s Objectivity and Diversity deals with the epistemic and political limitations of a conception of scientific objectivity that, according to the author, is still in force in our societies. However, in this conception of objectivity, diversity (e.g., of individuals and communities of knowledge, but also, and especially, agendas, models of participation and even styles of reasoning in decision making) still plays a limited and undeserved role.

We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. Although high-performance human resource practices do not directly affect corporate social performance strengths, they do positively affect CSP strengths in companies that are highly innovative or have high levels of slack. High-performance human resource management practices also directly and negatively affect CSP concerns. Drawing on the resource-based view and using secondary data from an objective, third-party database, the authors develop and test hypotheses about how high-performance HRM affects a company’s CSP strengths and concerns. Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

Este trabajo analiza el lenguaje subjetivo empleado por el intelectual y político andalusí Lisān al-Dīn Ibn al-Ḫaṭīb (m. 1375) en su obra de exilio Nufāḍat al-ǧirāb. El objetivo es explorar la utilidad de un enfoque lingüístico en la comprensión del lugar que ocupa este texto dentro del proceso de transición cultural del Occidente islámico hacia el paradigma moderno europeo. El estudio se divide en tres partes: en la primera, se hace una breve introducción al autor, a su contexto socio-político y (...) al contenido de la obra; en la segunda, se plantea una metodología cuantitativo-cualitativa a través de la cual se estructura el texto misceláneo digitalizado en función de sus géneros y se especifica un esquema de anotación que permite extraer las instancias de los fenómenos lingüísticos más destacados; y en la tercera, se procede al análisis de los datos obtenidos en torno a la acción, la emoción y la evaluación. El análisis muestra una compleja codificación de la subjetividad en la Nufāḍa donde, a diferencia del Taʿrīf de Ibn Ḫaldūn, las marcas de expresión en primera persona, aunque significativas, son escasas. Sin embargo, se identifica un abundante uso de adjetivos evaluativos a lo largo de la obra, con una riqueza léxica que permite revelar de forma explícita el punto de vista del sujeto autor. Este hallazgo demuestra la utilidad de una metodología híbrida en la aproximación a textos histórico-literarios premodernos, así como la necesidad de incorporar el análisis lingüístico, empírico y comparativo al estudio de la transición epistemológica señalada. Astrology, its legitimacy, and the limits of its acceptable practice were debated in sixteenth- and seventeenth-century Europe. Many of the related arguments were mediated by the work of Giovanni Pico della Mirandola and the responses to it. Acknowledging the complexities of the relationship between astrological ideas and Christian teachings, this paper focuses on the Catholic debates by specifically considering the decisions about astrology taken by the Spanish Inquisition. The trials of astrologers are examined with the aim of understanding the role (...) of experts in astrology in early modern Spain. This study brings into view the specific nature of the debate on astrology in Spain, the consequences of the actions of the Inquisition and the social control it exerted. The historical events discussed comprise a particular case and also mirror the general debates about astrology taking place in early modern Europe. The experts’ opinions expressed in trials and in reports about the discipline received by the Inquisition reveal two key traits of the debate: the dispute about who had the authority to decide on the legitimacy of astrology and the disagreement about what constituted natural and judicial astrological practices. These led to different opinions about what was to be done with each defendant and about what content in their books ought to be forbidden. (shrink)

Este trabajo analiza la posición de la educación y el Estado en la filosofía práctica de Immanuel Kant, paraquien la educación se establece como la tarea esencial de la humanidad, no en vano señaló que, “el hombre puedeconsiderar cómo los descubrimientos más difíciles, el arte del gobierno y el arte de la educación”, que es con lacual inicia el proceso por el cual el ser humano se hace humano a saber; el de la civilización y la cultura, elementosintrínsecos en la (...) esfera de la educación que es la base del desarrollo de las personas en particular, y de la humanidaden general, por lo cual las tesis sobre educación en el texto de la pedagogía deben ser revisadas, sugiriendo que elproyecto educativo cosmopolita es la mejor vía para propiciar una educación que tienda al bien universal.Sin embargo, para que la propuesta kantiana sea impulsada desde las instituciones educativas, se requierereplantear la tarea y función no solo de los padres, sino también del Estado en la esfera educativa y orientarla segúnlos parámetros del cosmopolitismo, una filosofía que se ofrece como un deber ineludible y como una necesidadsocial generalizada. Este texto presenta las claves fundamentales del pensamiento de Fernando Rielo (1923-2004). Destaca, de forma general, su optimismo epistemológico frente al quehacer filosófico, junto con su afán pedagógico en la transmisión de su filosofía y sus propuestas metafísicas. No obstante, el lenguaje rieliano es de especial interés y suscita algunos debates interesantes que serán abordados en profundidad.

El presente artículo tiene como propósito criticar y reformular la teoría de valores del autor y filósofo argentino Risieri Frondizi. Para ello, se someterán a falsacionismo las tesis según las cuales la cualidad estructural es, primero, estructuralista y no analítica y, segundo, empírica, de acuerdo con la metodología holista de la ciencia. La crítica, así, se desarrollará a partir de los siguientes interrogantes. Inicialmente, ¿el autor acude al holismo o al reduccionismo como enfoques metodológicos de desarrollo? Online gambling companies claim that they are ethical providers. They seem committed to corporate social responsibility (CSR) practices that are aimed at preventing or minimising the harm associated with their activities. Our empirical research employed a sample of 209 university student online gamblers, who took part in an online survey. Our findings suggest that the extent of online problem gambling is substantial and that it adversely impacts on the gambler's mental and physical health, social relationships and academic performance. Online problem (...) gambling seems to be related to the time spent on the Internet and gambling online, parental/peer gambling and binge drinking. As our findings show that there are harmful repercussions associated with online gambling, we argue that companies in this controversial sector cannot reach the higher level of CSR achieved by other industries. Nevertheless, they can gain legitimacy on the basis of their CSR engagement at a transactional level, and so, by meeting their legal and ethical commitments and behaving with transparency and fairness, the integrity of the company can be ensured. We also argue that current failures in the implementation and control of CSR policies, the reliance on revenue from problem gamblers' losses, and controversial marketing activities appear to constitute the main obstacles in the prevention or minimisation of harm related to online gambling. As online gambling companies must be responsible for the harm related to their activities, we suggest that CSR policies should be fully implemented, monitored and clearly reported; all forms of advertising should be reduced substantially; and unfair or misleading promotional techniques should be banned. The industry should not rely on revenue from problem gamblers, nor should their behaviour be reinforced by marketing activities (i.e. rewards). We realise, however, that it is unrealistic to expect the online gambling industry to prioritise harm prevention over revenue maximisation. Policy makers and regulators, therefore, would need to become involved if the actions suggested above are to be undertaken. CSR is paramount to minimise harm and provide a healthier user experience in this business sector, but it also poses marketing dilemmas. We support a global collaborative approach for the online gambling industry, as harm related to gambling is a public health issue. (shrink)

The world is complex, but acknowledging its complexity requires an appreciation for the many roles context plays in shaping natural phenomena. In _Unsimple Truths, _Sandra Mitchell argues that the long-standing scientific and philosophical deference to reductive explanations founded on simple universal laws, linear causal models, and predict-and-act strategies fails to accommodate the kinds of knowledge that many contemporary sciences are providing about the world. She advocates, instead, for a new understanding that represents the rich, variegated, interdependent fabric of many levels (...) and kinds of explanation that are integrated with one another to ground effective prediction and action. Mitchell draws from diverse fields including psychiatry, social insect biology, and studies of climate change to defend “integrative pluralism”—a theory of scientific practices that makes sense of how many natural and social sciences represent the multi-level, multi-component, dynamic structures they study. She explains how we must, in light of the now-acknowledged complexity and contingency of biological and social systems, revise how we conceptualize the world, how we investigate the world, and how we act in the world. Ultimately _Unsimple Truths _argues that the very idea of what should count as legitimate science itself should change. (shrink)

The expressivist account of knowledge attributions, while claiming that these attributions are nonfactual, also typically holds that they retain a factual component. This factual component involves the attribution of a belief. The aim of this work is to show that considerations analogous to those motivating an expressivist account of knowledge attributions can be applied to belief attributions. As a consequence, we claim that expressivists should not treat the so-called factual component as such. The phenomenon we focus on to claim that (...) belief attributions are non-factual is that of normative doxastic disagreement. We show through several examples that this kind of disagreement is analogous to that of the epistemic kind. The result will be a doxastic expressivism. Finally, we answer some objections that our doxastic expressivism could seem to face. (shrink)

It is urgent to rethink this concept to fit it to the historical reality of the 98, to enrich it with other contemporary contributions. This paper wants to elaborate a complete concept of that year (1898), that could include the collected papers in this Anuario Filosófico.

This fine collection of essays by a leading philosopher of science presents a defence of integrative pluralism as the best description for the complexity of scientific inquiry today. The tendency of some scientists to unify science by reducing all theories to a few fundamental laws of the most basic particles that populate our universe is ill-suited to the biological sciences, which study multi-component, multi-level, evolved complex systems. This integrative pluralism is the most efficient way to understand the different and complex (...) processes - historical and interactive - that generate biological phenomena. A popular accusation against moral relativism is that it goes too far in its vindication of tolerance. The idea behind accusations like this can be summarized in the slogan, frequently attributed to relativism, that “anything goes”. The aim of this paper is to defend moral relativism from the accusation that it is an “anything goes” view; from the accusation that it forces us to suspend our judgment in cases in which we do not think we should even be allowed to. (...) In the end, relativism is not an “anything goes” view because it is not a view about what goes, but about the way things go—about what goes on when we say that something is morally right or wrong. There is indeed a view, sometimes called “relativism”, that forces us to suspend our judgment about practices that do not allow for such comfort, but it is not so much moral relativism as moral contextualism. Apparently, though, the most salient alternative to “anything goes” views such as contextualism is not moral relativism. It is moral objectivism, according to which there is a fact of the matter about moral issues. However, I show that moral objectivism too ends up being an “anything goes” view unless the objectivist takes herself to be endowed with “God’s point of view”, which I prove troublesome. (shrink)

Error related potentials, which are elicited in the EEG in response to a perceived error, have been used for error correction and adaption in the event related potential -based brain computer interfaces designed for typing. In these typing interfaces, ERP evidence is collected in response to a sequence of stimuli presented usually in the visual form and the intended user stimulus is probabilistically inferred and presented to the user as the decision. If the inferred stimulus is incorrect, ErrP is expected (...) to be elicited in the EEG. Early approaches to use ErrP in the design of typing interfaces attempt to make hard decisions on the perceived error such that the perceived error is corrected and either the sequence of stimuli are repeated to obtain further ERP evidence, or without further repetition the stimulus with the second highest probability is presented to the user as the decision of the system. Moreover, none of the existing approaches use a language model to increase the performance of typing. In this work, unlike the existing approaches, we study the potential benefits of fusing feedback related potentials, a form of ErrP, with ERP and context information in a Bayesian fashion to detect the user intent. We present experimental results based on data from 12 healthy participants using RSVP Keyboard™ to complete a copy-phrase-task. Three paradigms are compared: [P1] uses only ERP/LM Bayesian fusion; [P2] each RSVP sequence is appended with the top candidate in the alphabet according to posterior after ERP evidence fusion; corresponding FRP is then incorporated; and [P3] the top candidate is shown as a prospect to generate FRP evidence only if its posterior exceeds a threshold. Analyses indicate that ERP/LM/FRP evidence fusion during decision making yields significant speed-accuracy benefits for the user. (shrink)

Drawing on everyday telephone and video interactions, this book surveys how English speakers use grammar to formulate responses in ordinary conversation. The authors show that speakers build their responses in a variety of ways: the responses can be longer or shorter, repetitive or not, and can be uttered with different intonational 'melodies'. Focusing on four sequence types: responses to questions, responses to informings, responses to assessments, and responses to requests, they argue that an interactional approach holds the key to explaining (...) why some types of utterances in English conversation seem to have something 'missing' and others seem overly wordy. Increased concern for the environment has increased the number of investment opportunities in mutual funds specialized in promoting responsible environmental attitudes. This article examines the performance and risk sensitivities of US green mutual funds vis-à-vis their conventional peers. We also analyze and compare this performance relative to other socially responsible investing (SRI) mutual funds. In order to implement this analysis, we apply a CAPM-based methodology and find that in the 1987–2009 period, environ- mental funds had lower performance than conventional funds (...) with similar characteristics. However, if we focus on a more recent period (2001–2009), green funds achieved adjusted returns not significantly different from the rest of SRI and conventional mutual funds. (shrink)

ABSTRACT Recently, children’s books have used augmented reality as a resource, being called 4D books. Augmented reality allows the user to see through the world while interacting in real-time with images produced digitally, resulting in interactivity. The present study aims to introduce the results of a brief reflection on the illustrated book O reino encantado do pôneis 4D under the approach of the semiotics of culture, departing from the notion of semiosis and semiosphere. The semiosphere, drawn by Lotman (1990), in (...) analogy with the biosphere, can help understand the topology of the real and virtual worlds, referred to as the real subsemiosphere and virtual subsemiosphere, located in the interior of the broader semiosphere of the Brazilian culture. In 4D/Augmented reality books, the elements from the virtual subsemiosphere are placed into the real subsemiosphere, crossing their borders. (shrink)

The aim of this paper is to defend moral relativism from the accusation that it would make it irrational to classify past changes in public opinion as instances of moral progress, for they would constitute an improvement only from our current point of view. The argument is this. For our assessment of a change in public opinion as an instance of moral progress to be rational, we need to take the moral claims made before the change to be false simpliciter (...) while being open to the possibility that we ourselves change our minds at some point. These two things can be made compatible if we construe moral relativism as taking the truth of moral claims to be relative to the context of assessment. Thus understood, moral relativism is in fact the only view that makes room for talk of moral progress, as the rest of candidate positions make it irrational. (shrink)

Nous proposons dans ce volume une approche pluridisciplinaire du sens commun. Fruit d'un travail collectif organisé au CURAPP et dans le cadre du programme scientifique ASC, les articles ici présentés, par la diversité de leurs orientations théoriques et disciplinaires, contribuent à faire un état des lieux de la question. L'idée de sens commun est fréquemment utilisée et citée en sociologie, philosophie, linguistique, psychologie, sans qu'il en soit toujours proposé de définition ou d'analyse critique. Elle demandait un travail de définition et (...) de requalification historique et théorique, et de mise en rapport à des corrélats : la norme, le sens moral, le sens social, le sens critique. L'ouvrage vise donc la description, aussi précise que possible des formes et des normes du sens commun en tant qu'elles enveloppent des dimensions cognitives, perceptives, linguistiques, sociales et morales. Il apparaît vite que cette notion résiste à la simple analyse et que seule la superposition de différents points de vue permet d'en percevoir quelques contours. On ne sera pas étonné de la diversité des figures convoquées et de la variété des objets à partir desquels elle est manifestée et interprétée. L'intérêt du sens commun comme objet d'investigation philosophique est alors d'apparaître comme ce qui permet de reprendre de manière oblique certains questionnements classiques qu'il déplace. Ainsi de la question topique des formes affectives, linguistiques et sociales d'expression du sentiment, de l'ancrage de la moralité dans une nature humaine et dans une sensibilité partagée ou encore de la manière dont le sens commun permet de réinterpréter, dans l'histoire des sciences sociales, la question des liens entre action et critique.
