The future of health research will be characterised by three continuing trends: rising demand for health data; increasing impracticability of obtaining specific consent for secondary research; and decreasing capacity to effectively anonymise data. In this context, governments, clinicians and the research community must demonstrate that they can be responsible stewards of health data. IRBs and RECs sit at heart of this process because in many jurisdictions they have the capacity to grant consent waivers when research is judged to be of (...) particular value. However, several different terms are used to refer to this value, indicating a lack of conceptual clarity regarding the appropriate test for access to health data for research without consent. In this paper we do three things. First we describe the current confusion and instability in terminology relating to public interest in the context of consent waivers. Second we argue for harmonisation of terminology on the grounds of clarity, transparency and consistency. Third we argue that the term ‘public interest’ best reflects the normative work required to justify consent waivers because it is the broadest of the competing terms. ‘Public interest’ contains within its scope positive and negative implications of a study, as well as welfare, justice and rights considerations. In making this argument, we explain the normative basis for consent waivers, and provide a starting place for further discussion about the precise conditions in which a given study can be said to advance the public interest. The COVID-19 pandemic has both exposed and created deep rifts in society. It has thrust us into deep ethical thinking to help justify the difficult decisions many will be called upon to make and to protect from decisions that lack ethical underpinnings. This paper aims to highlight ethical issues in six different areas of life highlighting the enormity of the task we are faced with globally. In the context of COVID-19, we consider health inequity, dilemmas in triage and allocation of (...) scarce resources, ethical issues associated with research, ethical considerations relating to tracing apps, and exit strategies such as immunity passports and COVID-19 vaccines. Finally, we consider environmental issues in light of COVID-19. The paper also offers some ethical reflection on these areas as many parts of the world contemplate the recovery phase. (shrink)

Introduction. The book is a study in Adam Smith's system of ideas; its aim is to reconstruct the peculiar framework that Adam Smith’s work provided for the shaping of a semi-autonomous new discipline, political economy; the approach adopted lies somewhere in-between the history of ideas and the history of economic analysis. My two claims are: i) The Wealth of Nations has a twofold structure, including a `natural history' of opulence and an `imaginary machine' of wealth. The imaginary machine is a (...) kind of Newtonian theory, whose connecting links are principles; provided either by `partial' characteristics of human nature or by analoga of physical mechanisms transferred to the social world; ii) a domain of the economic, understood as a self-standing social sub-system, was discovered first by Adam Smith. His `discovery' of the new continent of the economic was an `unintended result' of a deviation in his voyage to the never-found archipelago of natural jurisprudence. -/- 1. Imaginary machines and invisible chains: natural philosophy and method. The first chapter reconstructs Smith's views on the method in natural philosophy, presented primarily in the History of Astronomy (HA). The peculiar kind of semi-sceptical Newtonianism which permeates the essay is highlighted. Its reconstruction of the history of one natural science is shown to be based on the assumptions of Hume’s epistemology, and to lead to a self-aware deadlock. Smith's dilemma is between an essentialist realism and sceptical instrumentalism; the Cartesian presuppositions he shares with Hume and with the 18th century as a whole make it impossible for him to overcome his dilemma. The following chapters will show how, on the one hand, Smith's skeptical methodology encourages him in the enterprise to `carve off' a new self-contained discipline and how, on the other hand, his epistemological dilemma is reflected in the inner tensions of his moral and political theory as well as in a number of basic oscillations concerning the status of the new discipline. -/- 2. Chessboards and clocks: moral philosophy and method. -/- The second chapter reconstructs Smith's views on the method in the parallel field of moral philosophy, including the theory of moral sentiments and natural jurisprudence. I argue that The Theory of Moral Sentiments, when considered together with with the Lectures on Jurisprudence, where Smith's peculiar version of a `weaker' form of natural law is presented, wins special interest, not only for the history of ethics but even more for the history of political theory and the social sciences. The two most striking features of Smith's work in this area are highlighted. First, his effort at reformulating the `practical science' is a methodologically self-aware attempt at applying the Newtonian method to moral subjects. Secondly, this attempt ends in a stalemate as two distinguished kinds of normative order are introduced: one ultimate order of Reason, ultimately justifiable but inaccessible, and one weaker order of our `natural sentiments', to which we have empirical access, but which is so variable as to lack any ultimate value as a basis for grounding our normative claims. These two parallel conundrums may arguably account for the author's inability to publish during his lifetime both The History of Astronomy and the projected history and theory of law and government. -/- 3. Wheels, dams, and gravitation: the structure of scientific argument in The Wealth of Nations. -/- The third chapter provides the core of the book, dealing with the structure of the argument in WN. I argue that the main presupposition that makes the shift possible from a `natural history' to a `system' approach is the Newtonian contrast of `mathematical' with `physical' explanation; that is, Smith drops any discussion of the "original qualities" of human nature that could account for economic behaviour, while introducing, as `principles' for the system, a set of `hypothetical' statements of `observed' regularities in human behaviour and of `observed' super-individual self-regulating mechanisms. In bringing this presupposition to light, the coexistence of a teleological with a mechanistic approach is clarified; fresh light is shed on the notion of the invisible hand by a comparison of its occurrence in Smith with the occurrence of the same expression (until now overlooked) in the correspondence between Newton and Cotes. Finally, the peculiar semi-prescriptive and semi-descriptive character of political economy are highlighted, and the consistency of Smith's `impure' semi-prescriptive social science, when understood in his own terms, is defended against familiar charges with inconsistency and against even more familiar strained modernizations. -/- 4. Apples, deer, and frivolous trinkets: the construction of the economic. -/- The fourth chapter draws consequences from the third, examining how Smith's achievement in political economy, marking its transition to scientific status, carried a re-description of the phenomena, creating the comparatively independent and unified field of the economic. Smith's achievement is interpreted not as the `discovery' of an autonomous character already possessed by the economy out there, so much as a Gestalt-switch by which our perception of social phenomena is modified making us `see' the partial order of the economy as an isolated system. To sum up, the autonomy of the economic in social reality and the autonomy of the economic in social consciousness are shown to be two sides of one process. -/- 5. Concluding considerations: Political economy and the Enlightenment halved. -/- A few suggestions on the status of economic theory two centuries after The Wealth of Nations in its relationship to ‘practical philosophy’ are illustrated. The purpose of this paper is to provide a new system of logic for existence and essence, in which the traditional distinctions between essential and accidental properties, abstract and concrete objects, and actually existent and possibly existent objects are described and related in a suitable way. In order to accomplish this task, a primitive relation of essential identity between different objects is introduced and connected to a first order existence property and a first order abstractness property. The basic idea is (...) that possibly existent objects are completely determinate and that essentially identical objects are just different individuations of the same individual essence. Accordingly, essential properties are defined as properties that are invariant with respect to this kind of identity, while abstract objects are determined by being characterized by essential properties only. Once such ideas are implemented, a number of classical intuitions about objects, their essence, and their way of existence can be consistently interpreted. (shrink)

While e-commerce has witnessed extensive growth in recent years, so has consumers' concerns regarding ethical issues surrounding online shopping. The vast majority of earlier research on this area is conceptual in nature, and limited in scope by focusing on consumers' privacy issues. This study develops a reliable and valid scale to measure consumers' perceptions regarding the ethics of online retailers. Findings indicate that the four factors of the scale - security, privacy, non-deception and fulfillment/reliability - are strongly predictive of online (...) consumers' satisfaction and trust. The results offer important implications for e-retailers and are likely to stimulate further research in the area of e-ethics from the consumers' perspective. (shrink)

A strength of liberal political institutions is their ability to accommodate pluralism, both allowing divergent comprehensive doctrines as well as constructing the common ground necessary for diverse people to live together. A pressing question is how far such pluralism extends. Which comprehensive doctrines are simply beyond the pale and need not be accommodated by a political consensus? Rawls attempted to keep the boundaries of reasonable disagreement quite broad by infamously denying that political liberalism need make reference to the concept of (...) truth, a claim that has been criticized by Joseph Raz, Joshua Cohen, and David Estlund. In this paper, we argue that these criticisms fail due to the fact that political liberalism can remain non-committal on the nature of truth, leaving the concept of truth in the domain of comprehensive doctrines while still avoiding the issues raised by Raz, Cohen, and Estlund. Further substantiating this point is the fact that Rawls would, and should, include parties in the overlapping consensus whose views on truth may be incoherent. Once it is seen that political liberalism allows such incoherence to reasonable parties, it is clear that the inclusion of truth and the requirement of coherence urged by Raz, Cohen, and Estlund requires more of reasonable people than is necessary for a political consensus. We show the first examples of recursively enumerable (even decidable) two-dimensional products of finitely axiomatisable modal logics that are not finitely axiomatisable. In particular, we show that any axiomatisation of some bimodal logics that are determined by classes of product frames with linearly ordered first components must be infinite in two senses: It should contain infinitely many propositional variables, and formulas of arbitrarily large modal nesting-depth.

En el presente artículo se analiza el relato sobre la supuesta correspondencia mantenida por Jesús y el rey Abgar V de Edesa, presente en la obra Historia Eclesiástica de Eusebio de Cesarea. Desde sus inicios, la leyenda gozó de mucha fama debido a la consideración de los fieles de que se trataba de uno de los pocos testimonios existentes sobre un texto escrito por el mismísimo Jesús. Este hecho provocó que esta tradición se tradujese a numerosas lenguas y recibiera varias (...) influencias distintas, lo que sin duda favoreció su desarrollo y su pervivencia en el tiempo. A pesar de los numerosos estudios sobre su popularidad y sobre las distintas versiones existentes, el origen de esta leyenda sigue sin estar claro y está lejos de llegar a un consenso académico. Por tanto, en este trabajo se estudian las distintas perspectivas sobre el inicio de esta tradición, analizando aquellas teorías que se centran en sugerir que la obra se trata de una invención del autor, pero también buscando algún matiz histórico que pudo servir como fuente de inspiración para Eusebio de Cesarea. This chapter provides a brief overview of the history of behavioral neurology, dividing it roughly into six eras. In the ancient and classical eras, emphasis is placed on two transitions: firstly, from descriptions of head trauma and attempted neurosurgical treatments to the exploratory dissections during the Hellenistic period and the replacement of cardiocentrism; and secondly, to the more systematic investigations of Galenus and the rise of pneumatic ventricular theory. In the medieval through post-Renaissance eras, the scholastic consolidation of knowledge and (...) the role of compendia are emphasized, along with the use of new methods from within a mechanistic framework. With the discovery of electrical conductance and the rise of experimentalism, we frame the modern era as period of intense debate over localization, decomposition, and other mechanistic principles, and marked by rapid discovery about the brain. The chapter ends with a discussion of the contemporary era, focusing on the establishment of behavioral neurology research on aphasia, apraxia, and neuropsychiatric conditions. (shrink)

Ethical concerns of Internet users continue to rise. Accordingly, several scholars have called for systematic empirical research to address these issues. This study examines the conceptualization and measurement of consumers' perceptions regarding the ethics of online retailers. Also, this research represents a first step into the analysis of the relationship between CPEOR, consumers' general Internet expertise and reported positive word of mouth. Results, from a convenience sample of 357 online shoppers, suggest that CPEOR can be operationalized as a second-order construct (...) composed of four dimensions: security, privacy, fulfillment, and non-deception. Our findings also indicate that consumers' general Internet expertise significantly improves CPEOR and CPEOR are strongly predictive of consumers' WOM. The right to withdraw from participation in research is recognized in virtually all national and international guidelines for research on human subjects. It is therefore surprising that there has been little justification for that right in the literature. We argue that the right to withdraw should protect research participants from information imbalance, inability to hedge, inherent uncertainty, and untoward bodily invasion, and it serves to bolster public trust in the research enterprise. Sobre ello, las interpretaciones canónicas se han circunscrito a la terapéutica cartesiana para las enfermedades, obviando otras dimensiones a las que el proyecto médico cartesiano también se dirigió. De ese modo, el presente artículo aborda un segundo sentido de conservación de la salud entendido como “preservación de la salud”, dirigiéndose, para ello, a un análisis de la (...) dieta cartesiana, cuyo empleo evita, según Descartes, la contracción de distintas afecciones. Dicho examen trata de mostrar en qué sentido la dieta posibilita la preservación de la salud, y cómo ésta se justifica apelando a la propia fisiología cartesiana. (shrink)

The Mexican cult around the image of the Virgin of Tepeyac is commonly addressed in relation with creole nationalism, but that emphasis ignores the survival of its cult until today. Given that construction of identity through ‘miraculous’ images persists through technologies of iconic deployment, it is necessary to examine the original functions of its technologies. I investigate these problems by considering the construction of a newexhibition site for the Virgin of Tepeyac, and the modalities of reproducing the image until today. (...) The historical comparison of these contemporary techniques with those of the seventeenth century enables to appreciate the coherence of this visual tradition and its importance to the construction of social processes in Mexico. This paper discusses historical-critical thought to address the problems of restoration and preservation of tape music, proposing viable solutions to the matter of digitizing the historically valuable data that exists on and is represented by magnetic tapes. A detailed program of research and restoration and some software for helping in creation of critical editions of the musical works are proposed. We also present some of the issues and controversies that must be considered and approaches we have applied in the preservation (...) of tape music, highlighting how these interpretations can impact later performances of these tape documents. Fundamentally, we argue that the act of tape music restoration has a parallel with the interpretation of the “Urtext score” in the performance of music from the Common Practice Era. (shrink)

En este trabajo me propongo desarrollar un estudio crítico de la concepción mecanicista de la explicación científica. En primer lugar, argumento que la caracterización mecanicista de los modelos fenoménicos (no explicativos) es inadecuada, pues no ofrece un análisis aceptable de los conceptos de modelo científico y similitud, que son fundamentales para la propuesta. En segundo lugar, sostengo que la caracterización de los modelos mecanicistas (explicativos) es igualmente inadecuada, pues los análisis disponibles de la relación explicativa de relevancia constitutiva implican una (...) tesis metafísica que es rechazada por los mismos mecanicistas. Concluyo que el mecanicismo no ofrece todavía una elucidación aceptable de la explicación científica. In this paper, I offer a critical assessment of the mechanicist approach to scientific explanation. Firstly, I argue that the mechanicist characterization of (non explanatory) phenomenological models is inadequate, since it does not develop an explication of the concepts of scientific model and similarity, which are indispensable to the approach. Secondly, I claim that the mechanicist conception of (explanatory) mechanicist models is inadequate as well, since all the available analices of the explanatory relation of constitutive relevance imply a metaphysical thesis that is rejected by the mechanicists themselves. I conclude that mechanicism needs to be emended if it aims to be considered as a genuinely illuminating approach to scientific explanation. (shrink)

I argue that Malthus’s Essay on Population is more a treatise in applied ethics than the first treatise in demography. I argue also that, as an ethical work, it is a highly innovative one. The substitution of procreation for sex as the focus makes for a drastic change in the agenda. What had been basically lacking in the discussion up to Malthus’s time was a consideration of human beings’ own responsibility in the decision of procreating. This makes for a remarkable (...) change also in the approach, namely, the discussion becomes an examination of a well-identified issue, taking cause-effect relationships into account in order to assess possible lines of conduct in the light of some, widely shared and comparatively minimal, value judgements. This is more or less the approach of what is now called applied ethics, at least according to one of its accounts, or perhaps to the account shared by a vast majority of its practitioners. In a sense, both the subject matter, sexuality, was substituted with a more restricted issue, namely reproduction, and the traditional approach, moral doctrine, was substituted with a more modest approach, in Malthus’s own words, the ‘moral and political science’. Such a drastic transformation brought about a viable framework, for a discussion of ethical issues that were still unforeseen by Malthus, namely those having to do first with the technical feasibility of eugenics programs and secondly with the scientific discovery of genetics as a field of study but also of possible intervention. Malthus’s ethics had obviously enough nothing to say on those unforeseen issues in so far as it was meant to treat just the ‘quantitative’ dimension of procreation, that is, ‘how many’. Later discussions and controversies will arise around different dimensions, that is, not just ‘how many’ but also ‘how healthy, how strong, how far empowered’. Yet, what Malthus’s lesson can still teach to proponents of opposite views is that the mentioned questions can be construed in such a way as to avoid unending controversy. (shrink)

En este artículo sostenemos que, en aquellos casos en los cuales la capacidad _ explanandum _ de un análisis sistémico o mecanicista constituye una función biológica, globalmente, la función explica la estructura y no a la inversa, a pesar de que en algunos casos particulares, el orden en que se determinan los conceptos participantes en la explicación no coincide con el orden de la explicación. Para defender esta tesis, adoptaremos una concepción mínima de explicación basada en la idea de subsunción (...) ampliativa del estructuralismo e ilustraremos las diferencias entre el orden de la explicación y el orden de determinación de los conceptos mediante un estudio de caso tomado de la afasiología moderna. La percepción clara y distinta es el elemento sobre el que se asienta la certeza metafísica de Descartes. Con todo, el planteamiento de los argumentos escépticos referidos a la duda metódica cartesiana ha evidenciado la necesidad de hallar una justificación al propio criterio de la percepción clara y distinta. Frente a los intentos basados en la indubitabilidad de la percepción o en la garantía surgida de la bondad divina, se defenderá una justificación alternativa pragmatista.

What role should legislation or policy play in avoiding the complications of in-vitro fertilization? In this article, we focus on single versus double embryo transfer, and assess three arguments in favour of mandatory single embryo transfer: risks to the mother, risks to resultant children, and costs to society. We highlight significant ethical concerns about each of these. Reproductive autonomy and non-paternalism are strong enough to outweigh the health concerns for the woman. Complications due to non-identity cast doubt on the extent (...) to which children are harmed. Twinning may offer an overall benefit rather than burden to society. Finally, including the future health costs for children in reproductive policy is inconsistent with other decisions. We conclude that mandatory single embryo transfer is not justified and that a number of countries should reconsider their current embryo transfer policy. (shrink)

La resolución 466 de 2007, promulgada por el Ministerio de Educación Nacional, representa un avatar sin precedentes en la institucionalización de la Ciencia Política en Colombia. Aunque avanza en la definición de las características específicas de calidad y desarrollo de los programas en materia de metodología, sin embargo no logra establecer una diferenciación clara entre los programas de ciencias sociales. Por esta razón, el presente artículo indaga por la especificidad disciplinar de la Ciencia Política, a partir de la revisión de (...) los métodos de investigación, en los programas de pregrado de las universidades de Bogotá. Para este efecto, está dividido en dos partes: primero, una revisión de la discusión epistemológica sobre los métodos de la disciplina en Francia e Inglaterra; y segundo, una revisión de los contenidos y la bibliografía de los syllabus de metodología de los programas de ciencias sociales de las universidades de Bogotá. Al final, se espera demostrar que no existen métodos específicos de Ciencia Política sino métodos genéricos para las ciencias sociales. (shrink)

The determining role that tool development plays in neuroscientific progress poses special challenges to the Kuhnian-rooted philosophy of scientific change. Some philosophers of neuroscience argue that revolutions in neuroscience do not involve paradigm shifts, but instead depend exclusively on technical or experimental innovation. By studying the historical episode of the discovery of the neuron (1873-1909), I argue that revolutions in neuroscience, like many other laboratory revolutions, are frequently driven by the intertwining of technical innovations and conceptual change.

The objective of this paper is to identify, from a historical perspective, the presence of elements of the protagorean thought in the Herodotus’ Histories. I realize an analysis of the passages in which Herodotus refers to νόμος and φύσις, which constitute a conceptual antithesis within the framework of the fifth century a.C. From this analysis I will try to show that Herodotus retakes the intellectual discussions of the fifth century BC, but makes a controversial reception of these concepts highlighting the (...) climate of conflict on the level of the symbolic. Este artículo presenta las principales constataciones del informe "La situación social de los inmigrantes acompañados por Cáritas", trabajo de investigación elaborado por el Observatorio de la Realidad Social de Cáritas, con la información recibida de las 54 Cáritas Diocesanas (CCDD) que participaron en el estudio y que representan un 80 % de la Confederación de Cáritas Española.

El renovado interés que ha adquirido el pensamiento político desde la segunda mitad del siglo veinte ha dado lugar a nuevas perspectivas para su estudio. Sin embargo, el desarrollo teórico de las ciencias sociales no ha tenido una interacción fluida entre las disciplinas que la componen. En este trabajo argumentaré que los desarrollos metodológicos sobre la posibilidad histórica de la teoría política deberían estar interconectados con los desarrollos en el campo de la historiografía. Para sostener mi posición me propongo realizar (...) una aproximación problemática en torno a la posibilidad de construir un conocimiento histórico-científico de la teoría política, a partir de los siguientes tópicos: la temporalidad histórica; el vínculo entre temporalidad y pensamiento, y la politización del pensamiento. En Representaciones mentales, Liza Skidelsky se propone poner de manifiesto la completa escisión que existe entre los fenómenos de la intencionalidad de los estados mentales y el contenido de las representaciones mentales. Por un lado, la autora defiende una elucidación internista del contenido de las representaciones mentales postuladas por la ciencia cognitiva. Por otro lado, nos propone concebir la intencionalidad como un fenómeno vinculado al lenguaje y a las prácticas comunicativas. Esta reformulación permitiría establecer los cimientos para un proyecto naturalista (...) ampliado, según el cual las ciencias humanas y sociales ofrecerían el marco interdisciplinario adecuado para la explicación de la intencionalidad. En esta nota crítica, sostengo que el proyecto naturalista cientificista todavía cuenta con algunos recursos conceptuales, provenientes de la neurociencia cognitiva y de la neurociencia computacional, que pueden eventualmente saldar la brecha entre la representación y la intencionalidad. Like Einstein's general theory of relativity is concerned with explaining the basics of an observable experience – i.e., gravity – most people take for granted that Chomsky's theory of generative grammar (GG) is concerned with the basic nature of language. This chapter highlights a mere subset of central constructs in GG, showing how they have featured prominently and thus shaped formal linguistic studies in multilingualism. Because multilingualism includes a wide range of nonmonolingual populations, the constructs are divided across child bilingualism (...) and adult third language for greater coverage. In the case of the former, the chapter examines how poverty of the stimulus has been investigated. Using the nascent field of L3/Ln acquisition as the backdrop, it discusses how the GG constructs of I‐language versus E‐language sit at the core of debates regarding the very notion of what linguistic transfer and mental representations should be taken to be.
