The critics of rational choice theory (RCT) frequently build on the contrast between so-called thick and thin applications of RCT to argue that thin RCT lacks the potential to explain the choices of real-world agents. In this paper, I draw on often-cited RCT applications in several decision sciences to demonstrate that despite this prominent critique there are at least two different senses in which thin RCT can explain real-world agents’ choices. I then defend this thesis against (...) the most influential objections put forward by the critics of RCT. In doing so, I explicate the implications of my thesis for the ongoing philosophical debate concerning the explanatory potential of RCT and the comparative merits of widely endorsed accounts of explanation. This article explores a variety of techniques for “cutting through the clutter” in an era of information glut: body language, neuromarketing, and data mining. It traces connections between these different strategies by arguing that they converge on an understanding of the social, political, and economic roles of information, which challenge the empowering promise of the digital information revolution. The attempt to short-circuit the discursive content of communication in order to get straight at the underlying sentiment is symptomatic of an impasse (...) that Slavoj Zizek describes in terms of the demise of symbolic efficiency. The promise of direct access to emotional truths modeled, for example by deception detection experts on the show Lie to Me compensates for what might be described as a vernacular postmodernism in which representations are understood to be not only subject to contrivance, but completely reducible to it. The result, this article argues, is a shift in the relationship of information to power, and thus in strategies for challenging or resisting it. (shrink)

This paper analyses some current jurisprudential and conceptual issues in evidence and procedure from the perspective of a computational legal theory. It introduces a specific investigative device, Trojans operated by police during crime investigation, and analyses whether current formal approaches to legal reasoning can be modified in such a way that the software code underlying this device can represent the relevant legal constraints that should govern its operation. We will argue that traditional formalist theories of legal reasoning are typically (...) restricted to reasoning within a system, and incapable therefore of making the notion of “legal system” sufficiently explicit. We discuss possibilities to expand on these approaches and identify the necessary elements of a computational theory of legal reasoning in an age of porous borders.Resumen:En este ensayo se analizan algunos tópicos conceptuales y filosóficos de actualidad sobre el procedimiento y las pruebas desde la óptica de una teoría del derecho computacional. En él se presenta un mecanismo específico de investigación, relativo a los “troyanos” operados por la policía durante la investigación de delitos, y analiza si los enfoques formales contemporáneos sobre el razonamiento jurídico pueden ser modificados de tal modo que el código de sofware que subyace a este mecanismo puede representar las limitaciones jurídicas relevantes que deberían regir su operación. Los autores sostienen que las teorías formalistas tradicionales del razonamiento jurídico se limitan por lo general al razonamiento dentro de un sistema y, por lo tanto, son incapaces de hacer la noción de “sistema jurídico” suficientemente explícita. Asimismo, se discuten las posibilidades de ampliar estos enfoques e identificar los elementos necesarios de una teoría computacional del razonamiento jurídico en una era de fronteras porosas. Are there objects that are “thin” in the sense that their existence does not make a substantial demand on the world? Frege famously thought so. He claimed that the equinumerosity of the knives and the forks suffices for there to be objects such as the number of knives and the number of forks, and for these objects to be identical. The idea of thin objects holds great philosophical promise but has proved hard to explicate. This book attempts to (...) develop the needed explanations by drawing on some Fregean ideas. First, to be an object is to be a possible referent of a singular term. Second, singular reference can be achieved by providing a criterion of identity for the would-be referent. The second idea enables a form of easy reference and thus, via the first idea, also a form of easy being. Paradox is avoided by imposing a predicativity restriction on the criteria of identity. But the abstraction based on a criterion of identity may result in an expanded domain. By iterating such expansions, a powerful account of dynamic abstraction is developed. (shrink)

According to a standard interpretation of Hannah Arendt’s remarks about evil, she had a psychologically thin conception of evil action. This paper has two aims. First, I argue that the distinction between psychological thinness and thickness is poorly conceived, at least as it commonly applies to theories of evil action. And second, I argue that, according to a better conception of the thin-thick distinction, Arendt is being misinterpreted.

The thin red line ( TRL ) is a theory about the semantics of future-contingents. The central idea is that there is such a thing as the ‘actual future’, even in the presence of indeterminism. It is inspired by a famous solution to the problem of divine foreknowledge associated with William of Ockham, in which the freedom of agents is argued to be compatible with God’s omniscience. In the modern branching time setting, the theory of the TRL (...) is widely regarded to suffer from several fundamental problems. In this paper we propose several new TRL semantics, each with differing degrees of success. This leads up to our final semantics, which is a cross between the TRL and supervaluationism. We discuss the notions of truth, validity and semantic consequence which result from our final semantics, and demonstrate some of its pleasing results. This account, we believe, answers the main objection in the literature, and thus places the TRL on the same level as any other competing semantics for future contingents. (shrink)

It is shown that no maximal set can have rank one in any Π01 class, while there exist maximal sets of rank 2. The connection between Π01 classes, propositional theories and recursive Boolean algebras is explored, producing several corollaries to the results on Π01 classes. There seems to be a minimal core that every theory wishing to accommodate the intuition that the future is open must contain: a denial of physical determinism (i.e. the thesis that what future states the universe will be in is implied by what states it has been in), and a denial of strong fatalism (i.e. the thesis that, at every time, what will subsequently be the case is metaphysically necessary).1 Those two requirements are often associated with the idea of (...) an objective temporal flow and the non-reality of the future. However, at least certain ways to frame the “openness” intuition do not rely on any of these. Branching Time Theory (BTT) is one such: it is compatible with the denial that time flow is objective and it is couched in a language with a (prima facie) commitment to an eternalist ontology. BTT, though, urges us to resist certain intuitions about the determinacy of future claims, which arguably do not lead either to physical determinism or to fatalism. Against BTT, supporters of the Thin Red Line Theory (TRL) argue that their position avoids determinism and fatalism, while also representing the fact that there is a future which is “special” because it is the one that will be the case. But starting with Belnap and Green 1994, some have objected to the tenability of TRL, mainly on metaphysical grounds. In particular, those argue that “positing a thin red line amounts to giving up objective indeterminism,”2 and that “has unacceptable consequences, ranging from a mistreatment of actuality to an inability to talk coherently about what would have happened had what is going to happen not taken place.”3 In this paper, we wish to reframe the.. Linnebo in 2018 argues that abstract objects like numbers are “thin” because they are only required to be referents of singular terms in abstraction principles, such as Hume's principle. As the specification of existence claims made by analytic truths (the abstraction principles), their existence does not make any substantial demands of the world; however, as Linnebo notes, there is a potential counter-argument concerning infinite regress against introducing objects this way. Against this, he argues that vicious regress is avoided in (...) the account of arithmetic based on Hume's principle because we are specifying numbers in terms of the concept of equinumerosity, or its ordinal equivalent. But far from being only a matter for philosophy, this implies a distinct empirical prediction: in cognitive development, the principle of equinumerosity is primary to number concepts. However, by analysing and expanding on the bootstrapping theory of Carey in 2009, I argue in this paper that there are good reasons to think that the development could be the other way around: possessing numerosity concepts may precede grasping the principle of equinumerosity. I propose that this analysis of early numerical cognition can also help us understand what numbers as thin objects are like, moving away from Platonist interpretations. (shrink)

This article explores distinctively visual presentations and performances of alterity from the perspective of art theory and practice. It gives particular attention to Marcel Duchamp's notion and practice of the infra-mince. The ‘infra-thin’ is not usually related to postcolonial questions. However, numerous evocations of alterity in contemporary art, this article argues, resonate with Duchamp's infra-thin — not only in their practices but also in the ways in which they present the relationship between different cultures and views of (...) ‘difference’. Focusing on artwork responding to the ‘Arab Springs’ as a striking instance of wider aesthetics of resistance, this article shows how such art can be seen to adapt the infra-thin for the purposes of a multidirectional critique. Much controversy has emerged on the demarcation between legal positivism and non-legal positivism with some authors calling for a ban on the -as they see it- nonsensical labelling of legal philosophical debates. We agree with these critics; simplistic labelling cannot replace the work of sophisticated and sound argumentation. In this paper we do not use the term ‘legal positivism’ as a simplistic label but identify a specific position which we consider to be the most appealing and plausible view on legal (...) positivism. This is the view advocated by Gardner in his paper 'Legal Positivism: 5½ Myths’, where he carefully scrutinises the most convincing and unifying postulates of legal positivism, which he calls “the thin view”. The study shows that this thin view presupposes an empirical conception of action that is untenable and implausible since it makes acts of engagement with the law unintelligible to an observer of such acts. The fundamental standard of health care is health. Theories of health affect how we conceive of good health, ill health, Good patients, and Good providers. They also profoundly affect how we go about attempting to solve health problems once we’ve identified them. In this chapter, I argue that the way health care providers, bioethicists, and public health experts approach health relies on ideal theory despite the heavy knowledge that this world will never be ideal. We need a conception of (...) health that accounts for this. I outline the weakness of ideal theory in general and with respect to theories of health, and argue in favor of a nonideal approach to health that is rooted in intersubjectivity, empiricism, inclusivity, contextual specificity, and reflexivity which are not entrusted to any one set of knowers. Throughout, I use the example of how we approach fatness, and medicalize obesity, to illustrate where we’ve gone wrong and to chart a path toward how we can go right. (shrink)

We only need to think for a moment about surfaces and other interfaces to realise their enormous importance in everydaylife. There are numerous branches of physics, chemistry, biology, and materials science concerned wholly or largely with surfaces, and one sometimes comes across the expression ‘surface science’ Among the natural phenomena connected with surfaces which have aroused scientific interest are surface tension, surface waves, photoelectric emission, reflection, refraction, evaporation, adsorption, adhesion, thin films, detergents, catalysts, cell membranes, skin. All of these (...) phenomena are complex, interesting, and some of them are still far from completely understood. Are surfaces important for philosophy? An epistemologist might well answer affirmatively, thinking of Quine’s "surface irritations" as the basis of our knowledge of the physical world, or Berkeley’s theory of vision, or the view that we perceive a material object in virtue of suitable causal interaction with its surfaces. But at first sight it seems that there is not much of interest for an ontologist. In his work on surfaces, especially in the book of that name, Avrum Stroll has shown to the contrary that there is much ontological interest in surfaces} Every ontologist delights in a newly discovered or hitherto neglected member of the ontological zoo: surfaces are not exactly new, but they have been neglected, and we can be grateful to Stroll for bringing them to greater prominence. Non-Humean accounts of the metaphysics of nature posit either laws or powers in order to account for natural necessity and world-order. We argue that such monistic views face fundamental problems. On the one hand, neo-Aristotelians cannot give unproblematic power-based accounts of the functional laws among quantities offered by physical theories, as well as of the place of conservation laws and symmetries in a lawless ontology; in order to capture these characteristics, commitment to governing laws is indispensable. On the other hand, (...) ontologies that entirely exclude some kind of power ascription to worldly entities face what we call the Governing Problem: such ontologies do not have the resources to give an adequate account of how laws play their governing role. We propose a novel dualist model, which, we argue, has the resources to solve the difficulties encountered by its two dominant competitors, without inheriting the problems of either view. According to the dualist model, both laws and powers are equally fundamental and irreducible to each other, and both are needed in order to give a satisfactory account of the nomological structure of the world. The dualist model constitutes thus a promising alternative to current monistic views in the metaphysics of science. (shrink)

The ‘reinvention’ of nationhood in theory and the reform of British naturalization rules in praxis have been unable to address satisfactorily the issue of unjust exclusion and to make naturalization law and citizenship more compatible with democratic ideals. This has much to do with the fact that the discourse of new patriotism and the reconfiguration of national citizenship have inbuilt limits. In examining the ‘new’ discourse of patriotism in its various shades, I argue that it is inconsistent and unpersuasive. (...) Neither the rehabilitation of civic nationalism under ‘republican patriotism’, nor ‘constitutional patriotism’, nor ‘rooted patriotism’ succeed in transforming the nationality model of citizenship in order to render it more compatible with contemporary developments and with cultural pluralism. Similarly, the three models of citizenship developed by the literature, namely, postnational, transnational and multicultural citizenship remain rooted within the civic nationalist trajectory. Instead of arguing for the liberalization of naturalization requirements and the ensuing pluralization of citizenship, I put forward an argument as to how the nationality model of citizenship might be transcended by developing a model of civic registration. By contrasting this model with the Labour Government’s reforms in the fields of naturalization and citizenship, I argue that the Nationality, Immigration and Asylum Act 2002 places too much emphasis on social cohesion, thereby overlooking that a sense of belonging to community develops with inclusion in society and politics rather than as a result of citizenship ceremonies and language proficiency tests. Political institutions in a diverse social landscape struggle with what I call the ‘initial problem’ of securing universal agreement across a domain. This has led to interest in polycentric models, which devolve a polity’s governmental authority into smaller jurisdictions, eliminating the need for agreement across the polity. The three most developed polycentric models in political philosophy mistakenly assume that there will not be disagreement between jurisdictions. When such disagreement does occur—a natural byproduct of diversity—the initial problem returns when adjudicating the (...) dispute. I propose a solution to adjudicating disputes that avoids the continual return to the initial problem. (shrink)

One of the problems that Bayesian regularity, the thesis that all contingent propositions should be given probabilities strictly between zero and one, faces is the possibility of random processes that randomly and uniformly choose a number between zero and one. According to classical probability theory, the probability that such a process picks a particular number in the range is zero, but of course any number in the range can indeed be picked. There is a solution to this particular problem (...) on the books: a measure that assigns the same infinitesimal probability to each number between zero and one. I will show that such a measure, while mathematically interesting, is pathological for use in confirmation theory, for the same reason that a measure that assigns an infinitesimal probability to each possible outcome in a countably infinite lottery is pathological. The pathology is that one can force someone to assign a probability within an infinitesimal of one to an unlikely event. (shrink)

Some relativists deny that moral discourse is factual. According to them, our ethical commitments are to be explained by appealing to noncognitive mental states like desires, rather than to beliefs in some independent moral facts. Indeed, the package antirealism (there are no moral properties) & noncognitivism (the source of moral commitments is noncognitive) seems to be implicit in Lewis’s and Harman’s relativism. But to many philosophers this package seems to be unattractive. Our task in this paper is to construe and (...) defend a less committal and hence more attractive version of relativism. Our thesis has two elements. First, we shall present a version of relativism that combines, on the one hand, realism with regard to thick ethical properties, and, on the other, antirealism with regard to thin ethical properties. Secondly, we shall argue that this version of relativism can be defended through the skeptical theory of meaning Kripke attributes to the later Wittgenstein. The paper comprises three parts: the first sketches in very broad lines a version of standard moral relativism. In the second part we construe an alternative version that we call ‘cultural relativism.’ By appealing to the thick-thin distinction, cultural relativists explain what it means to say of forms of life that they are in conflict. In the third part we shall elaborate an argument whose conclusion is that in ranking conflicting ethical outlooks, people make an error, that is, they attribute to these outlooks moral properties that do not exist. I adapt Robert Sinnerbrink's notion of cinematic poesis by arguing that Terrence Malick's The Thin Red Line constitutes an example of ecological cinematic poesis: a style of filmmaking that works in concert with the limits and potentialities of the filmmaking as a medium. This cinematic bearing emerges in a new way following Malick's return to Hollywood, where a combination of factors spur the emergence of a radical Emersonian practice of cinematic receptivity. I draw on oral histories, and the film (...) itself, to demonstrate how Malick's creative process consistently tends towards an ethos of poverty. To further pattern and illuminate the ecological stakes of this Emersonian stance, I draw on the complementary framework of second-order systems theory, and in particular, on Niklas Luhmann's concept of simultaneity. In so doing, I outline the layered nature of Malick's cinematic praxis – a doubled Emersonian receptivity which not only invites defamiliarizing depictions of warfare and the nonhuman, but also welcomes, and toys with, the otherness haunting technical images and human cognition. As such, The Thin Red Line, and its immediate counterparts, perform the ecological work of reframing the conditions of wonder, asking us to marvel not at what we have seen, but what we haven’t. In this paper we will put forward a novel semantics for future contingents. The idea behind the semantics is to be a compromise position between the ‘Ockhamist’ semantics, first put forward by Prior [1966], Thomason [1970] etc., and a version of the Thin Red Line semantics recently proposed by Malpass and Wawer [2012]. The new position is able to represent alternative possibilities in two different ways, as actual or counterfactual, which corresponds to a similar distinction in two-dimensional semantics between (...) the primary and secondary intension. We prove a theorem about the notion of validity that results from the new definition, which in the context of the literature about TRL-theories and Ockhamism has some significance. (shrink)

In this paper, I examine Azzouni's tracking requirement and its use as a normative constraint on theories about objects which we take as real. I focus on what he calls ‘thick epistemic access’ and argue that there is a logical–conceptual sense in which thick access to the real presupposes thin access to it. Then, I move on to advance an alternative—Sellarsian—way to ontic commitment and show that (a) it is better than Azzouni's, and (b) it can accommodate thick epistemic (...) access as a bonus. Finally, I try to defend the Quinean theoretical virtues against some of Azzouni's objections. This essay examines narratives about cadaver dissection through the lens of psychoanalytic theory in order to better understand the nature of medical students’ socialization into medicine and its implications for physician-patient communication. The theoretical framework provided by Julia Kristeva focuses attention on the nature of subject-formation in relation to abjection – that which reveals the contingent nature of the speaking self. Analysis of memoirs and other narratives by medical students demonstrates that students encounter the abject in the process of (...) dissecting a corpse, but are rigorously trained to map over this experience using the technical tools of biomedicine. Other students rely on dark and morbid forms of humor to develop a sense of emotional distance from their cadaver. This analysis reveals new insights about the nature of the gap between physicians and their patients. In particular, it indicates that this gap is not fixed or static but fluid and malleable. Physicians are always shifting between the symbolic realm of biomedicine and the affective, semiotic mode of encountering the abject. This malleability provides the key to training and educating medical students, socializing them in such a way that they are reflexive about this process of oscillation. How physicians handle the reality of their fluctuation between the semiotic and the symbolic is what will determine their ability to engage with patients. (shrink)

With the rise of ‘globesity’, fat activism and Fat Studies have become political players in countering negative stereotypes and the devaluation of fat bodies. Both groups are diverse, yet share a common goal to celebrate and/or accept fatness, and challenge practices and discourses that reinforce ‘normal’ bodies (such as diets, ‘fat talk’ and medicalisation). In this article, we reflect on our engagement with a Fat Studies conference, and critically interrogate the assumptions that underlie this particular space. It is not surprising (...) that fat activists and Fat Studies scholars bring different ideologies to the table, yet the differences between them have not been adequately scrutinised or theorised. Drawing upon Linda Alcoff’s feminist philosophy, we examine how identity politics and intersectional perspectives are both used in fat activism, yet have the effect of creating unresolved tensions between singular and multiple embodied identities. We argue that an identity politics approach (exemplified through embodied visibility and declarations of ‘thin privilege’) has the potential to create boundaries for policing and exclusion, and is thus at odds with the much broader axes identified by intersectorial approaches. Rather than dismiss the power of identity politics, we argue for a careful reframing of the relationship between identity politics and intersectionality in fat activism and Fat Studies. We suggest that unexamined contradictions that arise from this mismatch may be counterproductive to the important subversive aims of the movement. (shrink)

This critical review accomplished two main tasks: first, the article provides scope for identifying the most common conceptions of moral competence in the scientific literature, as well as the different ways to measure this type of competence. Having moral judgment is the most popular element of moral competence, but the literature introduces many other elements. The review also shows there is a plethora of ways to measure moral competence, either in standardized tests providing scores or other non-standardized tests. As a (...) second task, the article reflects critically on the general use of the idea of moral competence. Results suggest that this idea functions as what philosopher Bernard Williams would have called a thin ethical concept. Thin concepts are not problematic in and of themselves if they are used as linguistic shorthand, however, there may be shortcomings in the literature on moral competence because the idea is not rooted in more substantive views or theories in a way that is both clear and coherent. Is our experience of the world 'rich' or 'thin'? In other words, are we aware of unattended sensory stimuli, or are the contents of our consciousness constrained by what we attend to? A recent, ingenious, attempt to address this issue offers us a seemingly unavailable, 'moderate' option; our experience is somewhere between the two. But before we make our minds up about this conclusion, we should see that it resulted from conflating two ways of construing the relevant concepts. I (...) claim that, one way of reading 'rich' vs. 'thin', echoes the psychologists' distinction between 'early' vs. 'late' accounts of selective attention, and I argue that 'perceptual load theory', a recent response to this empirical issue, offers us a satisfying solution to our philosophical problem. Ultimately, we are only aware of what we attend to, so we can conclude that our experience of the world is philosophically 'thin'. Nonetheless, the second way of reading 'rich' vs. 'thin' relates to the range of sensory stimuli that we can be aware of. I claim that this range depends upon the attentional load that our sensory systems are placed under. The 'moderate' position, then, merely marks out one possible degree of sensory awareness on a continuum that runs from 'rich' to 'thin'. (shrink)

The scientific realist wants to read the metaphysical picture of reality through our best fundamental physical theories. The traditional way of doing so is in terms of objects, properties, and laws of nature. For instance, there are families of fundamental particles individuated by their properties of mass and charge, which determine how they move around. One could call this view an object-oriented metaphysics grounded on properties. In this paper, I wish to present an alternative view that one can dub a (...) thin object oriented metaphysics grounded on structure: there are fundamental entities with no fundamental properties other than the one(s) needed to specify their nature. I argue that my view has several advantages over the received one. In particular, I compare my proposal to the traditional view in the quantum domain and I argue that my view provides a better fit for both approaches to quantum metaphysics, namely the primitive ontology programme and wave-function realism. Meta‐synthesis of qualitative research can be an important way to consolidate and grow nursing knowledge and theory. However, from recent readings of such works in the nursing literature, one can observe that there is increasing use of meta‐synthesis being used as a way to simply aggregate qualitative research findings in a manner claimed to be similar to quantitative meta‐research while also remaining compatible with the qualitative research tradition. The aim of this paper is to discuss whether this meta‐aggregation form (...) of research has a sound epistemological foundation and should be considered a viable form of meta‐synthesis. The conclusion drawn is that meta‐aggregation falls short of being a sound method and is not compatible with the qualitative research philosophy. It is also concluded that meta‐aggregation should not be seen as a form of qualitative meta‐synthesis. Meta‐synthesis is best understood as a way to re‐interpret, compare and translate disparate qualitative studies using different conceptual apparatus into a consolidated knowledge of fundamental importance to nursing care practitioners. To conclude, aggregating qualitative research tends to turn rich descriptions into thin abstractions that are of little use to nursing practice knowledge and does not advance nursing science. According to the philosophical tradition, translation is successful when one has substituted words and sentences from one language with those from another by cross-linguistic synonymy. Moreover, according to the orthodox view, the meaning of expressions and sentences of languages are determined by their basic or systematic role in a language. This makes translating normative and evaluative discourse puzzling for two reasons. First, as languages are syntactically and semantically different because of their peculiar cultural and historical influences, and as values and (...) norms differ across cultures, it is unlikely that languages will have synonymous evaluative and normative expressions. If translation is only successful by cross-linguistic synonymy, it would seem that we will not be able to translate the value theoretic claims of persons from radically different cultures. But it is with such persons that dialogue on evaluative matters is imperative, to resolve ethical and axiological differences that could be the root of conflict. Second, as the orthodox account of meaning renders it linguistically relative, it is unlikely that expressions across languages will be cross-linguistically synonymous. Thus, on the Orthodox account of translation, translation is indeterminate (as W.V.O. Quine has argued) or impossible (as Jacques Derrida has argued). In this dissertation I argue for a novel theory of meaning and translation based on innovations in the translation studies literature and my prior work in cross cultural research, which I call Text-Type Semantics or TTS. TTS explains how translation is successful while affirming radical cultural and linguistic diversity. It treats disciplinary concerns as the neutral criteria to calibrate translation. On the basis of TTS I argue that we need what I call the “Quasi-Indexical” account of thick and thin concepts (or QI) to translate normative and evaluative discourse. I argue that QI and TTS succeed where competing accounts in the moral semantics literature (such as Non-Analytic Naturalism and Expressivism) fail. The argument also shows that the relativization of truth (in philosophy and beyond) to languages and cultures is mistaken. (shrink)

Terrence Malick’s The Thin Red Line is an anti-war film which can be read as an Orphic narrative meditating on the relationship between humans and “nature.” Many scholarly readings of the film have been attracted by analyzes that explore the influences of Cavell and Heidegger on Malick. Kaja Silverman’s recent opus, Flesh of My Flesh, contains a chapter titled “All Things Shining.” She elegantly examines how Malick’s film explores the theme of “finitude.” She argues that, ontologically speaking, human existence (...) gains a more intense “glow” when humans are made aware of their mortality. The present becomes paramount. But like Orpheus, the present seeks to make amends with the past. Taking Silverman’s analysis one step further involves exploring finitude through the film’s many animal, arboreal and geological images. Nature can be read as a “margin” that more fully enhances the film’s exploration of connection and finitude. To this end, the opening chapter of Jacques Derrida’s Margins of Philosophy is invaluable. Entitled “Tympan,” Derrida’s introductory essay introduces a wealth of ecological metaphors. These stimulate an interaction between Silverman’s model of finitude, Derrida’s surprising ecologies at the margin and Malick’s quest for what shines in all beings. (shrink)

In this paper, I criticize the pairing of irreducible thickness with the traditional view of evaluation which says evaluation is a matter of encoding good or bad in some way. To do this, I first explicate the determination view, which holds that irreducibly thick concepts are to thin concepts as determinates are to determinables. I then show that, even if the determination view did establish irreducible thickness, it would not have proven that the evaluative is well understood as being (...) an instance of the determination relation; in order to do that, the determination view needs to show how the evaluative fit a general analysis of the determination relation. However, when the determination view attempts to fill in the analysis, we get implausible results—so implausible, I claim, that we should see the results as a reductio to the view. To generalize the criticism to any view like the determination view, I show that the same results ensue when we model the evaluative on mereology. Finally, I diagnose the general failure by claiming that the evaluative domain, as conceived by the defender of irreducible thickness, just does not have the structure to secure the tight connection between thick and thin concepts while also carving up our conceptual economy in a plausible way. This article explores how the notion of obesity as health problem (1) functions to obscure or justify global inequities related to food production and access and (2) indicates still deeper problems of injustice and the neglected role of embodiment in analyses of justice and injustice, and notions of political subjecthood. Food, the need to eat, and the food system shape social existence profoundly yet are underexplored in philosophy, especially political philosophy. Drawing on disability theory and food studies, this article (...) uses the crisis of body weight to explore relationships between neoliberalism, transnational capitalism, the industrialized agro-food system, and world health. Obesity discourse spotlights lifestyle choices of individuals, casting women especially as making irresponsible decisions for their families. A politically informed (and more medically sophisticated) perspective suggests that the real crisis is a social pact, which I term the ThinContract, predicating personhood and full social inclusion on body type. The meaning of an utterance is often enriched by the pragmatic context in which it is uttered. This is because in ordinary conversations we routinely and uncontroversially compress what we say, safe in the knowledge that those interpreting us will ‘add in’ the content we intend to communicate. Does the same thing hold true in the case of legal utterances like ‘This constitution protects the personal rights of the citizen’ or ‘the parliament shall have the power to lay and collect (...) taxes’? This article addresses this question from the perspective of the constitutional originalist—the person who holds that the meaning of a constitutional text is fixed at some historical moment. In doing so, it advances four theses. First, it argues that every originalist theory is committed to some degree of pragmatic enrichment, the debate is about how much. Second, that in determining which content gets ‘added in’, originalists typically hold to a common knowledge standard for enrichment, protestations... (shrink)

By combining and augmenting recent arguments that have appeared in the literature, I show how a modified Rawlsian theory of justice generates a strong environmental and animal rights ethic. These modifications include significant changes in the conditions of the contract situation vis-a-vis A Theory of Justice, but I argue that these modifications are in fact more consistent with Rawls’ basic assumptions about the functions of a veil of ignorance and a thin theory of the good.

This article attempts to assess Jon Elster's contribution to rational choice in Ulysses and the Sirens and Sour Grapes. After reviewing Elster's analysis of functional versus intentional explanations, the essay moves on to the crucial distinction between the thin and broad theories of rationality. The former elabo rates on the traditional economist's preference / feasible set apparatus; the latter is the more demanding theory which inquires into the rationality of beliefs and preferences. Elster's approach to the broad (...) class='Hi'>theory normally consists in using the thin theory as a reference point and in making purposefully limited departures from it. The essay illustrates the method while commenting on Elster's discus sion of autonomous preferences in Sour Grapes. It goes on to stress some impor tant analogies between Elster's use of the thin and broad theories, on one hand, and Weber's ideal-typical method, on the other. The final assessment is phrased in terms of these analogies; it is suggested that Elster is at his best when the ideal-typical method and his own separate from each other, that is, when he comes to grips with the broad theory in its own terms. The aim of this paper is to offer a concise and faithful account of Rawls’ theory of international justice, in an effort, first, to elucidate the structure of the argument that is advanced in that theory and, second, to present a critical assessment of it. The critical assessment section attempts, on the one side, to cope with crucial methodological issues, which have a more general bearing upon Rawls’ overall political philosophical position, including the constructivist perspective of theory (...) making and the division between a political conception and a comprehensive doctrine; on the other side, to weigh up a set of substantive claims made in the Rawlsian theory of international justice, including the recognition of peoples as the fundamental subjects of international law, the toleration of the so-called decent peoples and the considerably thin construal of human rights encompassed in The Law of Peoples. The paper attempts to provide a series of reasons that could be well-suited to explicate its author’s doubts about the soundness of the Rawlsian theoretical perspective with regard to both its formal methodological features and its more content-oriented convictions. This paper establishes two facts. The first is that a recently presented problem for supervaluationism applies equally to the branching-time cousin of the theory. The second fact is that a new version of branching-time supervaluationism avoids this and related problems.
