A company’s trademark is the symbol that allows consumers to know that they are dealing with a particular company. This article addresses the extent to which some companies will go to obtain and protect a trademark. Specifically, it will address the fight between Cisco and Apple over the iPhone trademark, as both companies took (...) questionable steps in the United States and abroad to obtain rights to the iPhone mark. Criticisms of patent laws for technological innovations in the United States reveal a multifaceted milieu of problems centered around the protection of short-term economic gain and individual property rights. In this article, we consider this a conflict between current patent laws and the innovation capabilities of organizations. We propose a solution that enables the company to assure its long-term survival in the face of these restrictions. This presumes that the firm will at least maintain its innovation capacities while preserving the (...) company's ethical values and those of its social environment. We offer a theoretical model that is designed to help managers and policymakers reorient their governance strategies for managing the innovation process, using the “ethics of responsibility,” which establishes the link to individual moral values at the beginning of a governance process as well as the consequences of a decision. Our integrated causal model of ethical innovation for patents is presented and implications for global organizations and possible solutions for patent law process failure are offered. (shrink)

Tuberculosis (TB) is a potentially fatal infectious disease that, in Aotearoa New Zealand (NZ), inequitably affects Asian, Pacific, Middle Eastern, Latin American, and African (MELAA), and Māori people. Medical research involving genome sequencing of TB samples enables more nuanced understanding of disease strains and their transmission. This could inform highly specific health interventions. However, the collection and management of TB isolate samples for research are currently informed by monocultural biomedical models often lacking key ethical considerations. Drawing on a qualitative kaupapa (...) Māori–consistent study, this paper reports on preliminary discussions with groups of Māori, Pacific, and Afghan people in NZ, whose communities have been harmed by TB and TB stigma. Participants’ discussions highlight key concerns and meanings that ought to inform the development of guidelines and a more robust consultative process for the governance of how TB isolate samples are collected and used both retrospectively and in future research. We argue for ethical processes to be culturally nuanced and community-generated, flexible and meaningful, and situated in relation to the physical and symbolic effects of TB. We discuss the significance of Indigenous data sovereignty, rights, and kāwanatanga (governorship) in shaping a multicultural data sovereignty model. (shrink)

Since Darwin, there has been a long and arduous struggle to understand the source and maintenance of natural genetic variation and its relationship to phenotype. The reason that this task is so difficult is that it requires integration of detailed, and as yet incomplete, knowledge from several biological disciplines, including evolutionary, population, and developmental genetics. In this ‘post‐genomic’ era, it is relatively easy to identify differences in the DNA sequence between individuals. However, the task remains to delineate how this abundant (...) genetic diversity actually contributes to phenotypic diversity. This necessitates tackling the problem of hidden genetic variation. Genetic polymorphisms can be conditionally cryptic, but have the potential to contribute to phenotypic variation in particular genetic backgrounds or under specific environmental conditions. A recent paper by Lauter and Doebley highlights the contribution of hidden genetic variation to traits characterizing the morphological evolution of modern maize from its wild grass‐like progenitor teosinte.1 This work is the first to demonstrate hidden variance for selected (agronomically ‘adaptive’) traits in a well‐characterized model for morphological evolution. The architects of punctuated equilibrium and species selection as well as more recent workers (Vrba) have narrowed the original formulation of species selection and made it dependent upon so-called emergent characters. One criticism of this narrow version is the dearth of emergent characters with a consequent diminution in the robustness of species selection as an important evolutionary process. We argue that monomorphic species characters may at times be the focus of selection and that under these circumstances selection at the organism (...) level is by-passed due to the absence of critical variance. Selection therefore shifts to the species level where variability reemerges in a clade. The absence of critical variance among organisms prevents effect macroevolution from operating. If species-wide properties are important in macroevolutionary processes, as we contend, systematists should pay more attention to their elucidation. (shrink)

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

Chief Justice Rehnquist authored an opinion of the Oourt (of the highest precedential value) which was joined by Justices White, Kennedy, Scalia, and O'Connor. The majority found the lower courts to be in error in striking down as unconstitutional the preamble to a Missouri statute which asserted that "the life -0f each human being begins at conception." The opinion of the Court also found that Missouri could constitutionally prohibit the use of public employees and facilities in the performance of abortions not necessary to save the mother's life. Because they believed such restrictions to be in tension with Roe's trimester system, the plurality decided to abandon that system, along with its stipulation that the state's interest in unborn life became compelling only at viability. The plurality contended, however, that Webster presented no occasion for reconsidering Roe's holding, which deemed unconstitutional a statute prohibiting all abortions except those necessary to save the life of the mother. In a concurring opinion, Justice Scalia went further, arguing that the Court should explicitly overrule Roe v. Wade. On the other hand, Justice O'Connor, 848 344 M. The topic of abortion was in the limelight again in Dobbs v Jackson, where the US Supreme Court overturned the decision of Roe v Wade, ‘which guaranteed women and pregnant people a constitutional right to abortion’. While not bound by the judgment, this gives us an opportunity to reflect on the current law in South Africa which regulates the termination of pregnancy. The primary piece of legislation which governs abortion is the Choice on Termination of Pregnancy Act. Section 2 (...) of the Act lists the grounds under which one may lawfully terminate a pregnancy. One of those grounds relates to the period of the 13th up until the 20th week of the gestation period, and states that if a medical practitioner, after consultation with the pregnant woman, is of the opinion that the continued pregnancy would significantly affect the social or economic circumstances of the woman, then the pregnancy may be lawfully terminated. The question is: What exactly is meant by ‘social grounds’? This article considers this aspect from a legal perspective and attempts to provide clarity on the issue, in the hope that this will be of assistance to medical practitioners who are concerned about the outcome of their actions, when assisting persons in this position. This edition, providing the only available English language access to Collin de Plancy's long-forgotten Dictionnaire infernal, is directed to the reader who likes the reinforcement of being able to get through a whole book in an hour or so, whizzing through clean pages at incredible speeds. Perhaps the most misleading aspect of this flashy volume is the fact that the publishers never mention that it is abbreviated at all; it contains 177 truncated versions of Collin de Plancy's 2,400 plus entries, (...) which filled in the 1825-1826 edition of four volumes of text and one of plates. Wade Baskin, a master of condensation, does cover a lot of ground in his two and one-half page introduction. This, unfortunately, serves as little but a teaser to the reader interested in more than a mere mention of Collin de Plancy's colorful, success-oriented career, his filiations with spiritual brothers like Nodier, and his influence on other writers of the Romantic period. One can begrudge this sort of holding back with good reason, for Collin de Plancy is a name unfamiliar today even to French scholars. Baskin's translation is, as usual, excellent.—C. M. R. (shrink)

John Rawls has held up as a model of public reason the U.S. Supreme Court. I argue that the Dobbs Court is justifiably criticized for failing to respect public reason. First, the entire opinion is governed by an originalist ideological logic almost entirely incongruent with public reason in a liberal, pluralistic, democratic society. Second, Alito’s emphasis on “ordered liberty” seems completely at odds with the “disordered liberty” regarding abortion already evident among the states. Third, describing the embryo/fetus from conception until (...) birth as an “unborn human being” begs the question of the legal status of the embryo/fetus, as if an obiter dictum settled the matter. Fourth, Alito accuses the Roe court of failing to exercise judicial restraint, although Alito argued to overturn Roe in its entirety. In brief, the Dobbs opinion is an illiberal, disingenuous, ideological swamp that swallows up public reason and the reproductive rights of women. (shrink)

The relationship of consciousness to brain, which Schopenhauer grandly referred to as the "world knot," remains an unsolved problem within both philosophy and science. The central focus in what follows is the relevance of science---from psychoanalysis to neurophysiology and quantum physics-to the mind-brain puzzle. Many would argue that we have advanced little since the age of the Greek philosophers, and that the extraordinary accumulation of neuroscientific knowledge in this century has helped not at all. My dissertation philosophically analyzes experiments in evolutionary biology, an area of science where experimental approaches have tended to supplement, rather than supercede more traditional approaches, such as field observations. I conduct the analysis on the basis of three case studies of famous episodes in the history of selection experiments: H. B. D. Kettlewell's investigations of industrial melanism in the Peppered Moth, Biston betularia; two of Th. Dobzhansky's studies of adaptive radiation in the fruit fly, Drosophila pseudoobscura; and M. Wade's (...) studies of group selection in the flour beetle, Tribolium castaneum. The case studies analyze the arguments and evidence these investigators used to identify the respective roles of experiments and other forms of inquiry in their investigations. I discuss three philosophical issues. ;First, the analysis considers whether these selection experiments fit models of experimentation developed in the context of micro-and high energy physics by Allan Franklin and Peter Galison . My analysis documents that the methods used in the case studies can be accommodated on both Franklin and Galison's views. I conclude the case studies do not support claims regarding the relative autonomy of biology. ;Second, the analysis documents a number of important roles for life history data acquired by strictly observational means in the process of experimentation, from identification of research problems and development of experimental designs to interpretation of results. Divorced from this context experiments in biology make no sense. Thus, in principle, experimental approaches cannot replace more traditional methods. ;Third, the analysis examines a superficial tension between the use of experiments, which I characterize by the presence of artificial intervention, and the stated goal of most investigations in evolutionary biology, that of understanding how systems behave in the absence of intervention. Experiments involve trade-offs between the control one has over the circumstances of the study and how informative the study is with regard to questions of interest to biologists regarding specific, actual systems in nature. Experimental simulations of natural phenomena in other historical sciences involve similar trade-offs, but there are reasons for believing this tension is more prominent in biology. (shrink)

Bioethics and the law have weaved back and forth over time influencing each field. Sometimes ethics leads the debate on problematical issues; for example, the Recombinant DNA Advisory Committee at the National Institutes of Health established regulations prior to initiating human (...) gene therapy. At other times, law takes over; Roe v. Wade, for example, has polarized and closed public discussion on abortion. Most frequently, however, scientific developments initiate discussion in both fields, as when the announcement of the birth of Dolly—the first cloned mammal—sparked President Clinton to ask the National Bioethics Advisory Commission for a report on cloning.A back-and-forth pattern also exists within the law itself, this time between legislator and judge. Legislators enact statutes, which apply universally to regulate conduct in society. Judges, on the other hand, interpret statutes and apply them to particular cases to resolve disputes between parties. Case law, as judge-made law is called, that grows in the absence of legislation becomes the common law. Legislatures can change the course of common law development by enacting more law, usually as amendments, but sometimes as repeals. A judge who sees the facts of a case or the law differently may also change the common law. And so the counterpoint between legislator and judge goes.A legal case becomes a landmark in bioethics because of its historical or precedential value to the field. Historical cases reflect judicial reasoning or rationalization that lays the conceptual foundation for a bioethical principle. Perhaps the best known example of this is the focus on the right to self-determination in Schloendorff that led to the development of informed consent. The principle of autonomy in bioethics derives its legal impetus from this line of cases.A case that acquires landmark status because of its precedential value does so for one of two reasons based on legal precedents. First, the case may be one of “first impression.” In the legal sense, that means that the particular case with its [End Page 191] facts or issues is the first one that a particular court has confronted within that court’s jurisdiction or area of decision-making authority. To be a landmark in bioethics, however, the ordinary sense of “first impression” applies. The first time that a particular bioethical topic has appeared in court for legal resolution makes a case one of “first impression” for bioethics. The case of Baby M on surrogacy contracts illustrates this.The second way in which a case can achieve landmark status based on precedents involves legal precedent and the jurisdictional basis of the court system. Under the common law system, a preceding case that involves the same or similar facts or issues as a current case must be followed by lower—i.e., less authoritative—courts in the same jurisdiction. That judicial rule of decision making is called stare decisis. It must be admitted that there are some of us who “teach” Virginia Woolf and yet seem unable to learn from her. The secret of Virginia’s eminently readable prose style remains hidden from us. It is for this reason that I find it impossibly hard to read everything that Professor Marcus and some of her colleagues produce in such astounding abundance, and that, she may retort, is why she has found it impossible to read my biography of Virginia Woolf. In (...) a sense, she does not need to; she can imagine it and, thus, credit me with the statement that I considered my aunt “a minor British novelist, ranked somewhere below E. M. Forster as a writer of fiction” . Seeing that I made it clear from the outset of that biography that I would not attempt to assess the work of Virginia Woolf, seeing that I have been blamed for this abstention , and seeing that I have said absolutely nothing at any time that could possibly be construed in this sense, I think that we may well call this a master-stroke of the imagination.Also it is irrelevant. I accuse her of inaccuracy; she “replies” by asserting that I have bad taste. It seems a rather unconvincing form of defence. In fact, in her “reply,” which must be about as long as the article by which it was engendered, Professor Marcus can find so little in the way of evidence or argument with which to support those contentions which I have criticized that the reader must wade through page after page of completely otiose matter before coming to anything which seems to bear on the matter at hand. At last Professor Marcus tells us that she has written “two long essays in which I did at length and in detail exactly what he does here”; here, then, we come to her answer . I maintain that Professor Marcus has neglected to notice that Margaret Llewelyn Davis was primarily Leonard Woolf’s friend rather than Virginia’s, that her relationship with Virginia was at times very uneasy, that Virginia was out of sympathy with politically minded women, and that Professor Marcus neglects to notice any of this because she fails to use the evidence of the diaries and the letters. When she does quote from a letter, she completely misunderstands it, just as she fails to understand Virginia’s use of the term “the woman’s republic” . Each part begins with a historical overview that provides important contextual information for the philosophical systems it examines (a feature added since the third edition).Part 1, concerning India, gives detailed summaries of the Vedas and Upanishads, Jainism, the Bhagavad Gita, Samkhya-Yoga, Nyaya-Vaisheshika, Mimamsa and Vedanta (a section expanded since the last edition), and Theism. This section also includes chapters on Islamic thought and modern Indian philosophy. Koller does not simply give a bare-bones overview of these traditions; rather, he takes great care to quote from and analyze the primary sources of the traditions examined.Part 2, on India, contains chapters that focus on Siddhartha Gautama's life and thought, the doctrine of pratitya samutpada, Sarvastivada (with new material added since the third edition), Mahayana (a new chapter), Madhyamaka and Nagarjuna (also with new material), and Yogacara. A final chapter on Zen Buddhism is included in this section, although no other schools of Japanese Buddhism are discussed.Part 3, on Chinese thought, contains chapters on Confucianism, Taoism, and Neo-Confucianism, with a final chapter that examines modern Chinese philosophy (Koller uses Wade-Giles romanization for Chinese terms throughout the text).Asian Philosophiesalso contains many helpful appendixes: maps; pronunciation guides for Sanskrit, Chinese, and Japanese terms; a brief glossary; a detailed bibliography and suggestions for further reading; and timelines for each tradition (added since the third edition).Koller's book offers a clearly written and well-organized summary of the thought of most of the major Asian traditions. It is accessible to undergraduates, but rich enough to serve as a reference for graduate students studying Asian or comparative philosophy. It would provide a clear, concise introduction to Eastern thought for upper-level undergraduate philosophy courses. Meslin and Harold T. Shapiro On 3 October 2001, Executive Order 12975 expired, and with it so too did the National Bioethics Advisory Commission (NBAC). Established by President Bill Clinton in 1995, NBAC was the fifth national committee since 1974 created to advise the U.S. government (...) on bioethics policy. In the long political tradition in this country that national bioethics policy advice should use temporary rather than permanent bodies, NBAC followed in the footsteps of the National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research (1974-78); the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research (1980-83); the Ethics Advisory Board (1978-80); and the Biomedical Ethics Advisory Committee (1988-89). Arguably, other distinguished panels could lay claim to recognition as a "national bioethics committee" including the Advisory Committee on Human Radiation Experiments (ACHRE) (1994-95); the Fetal Tissue Transplantation Research Panel (1988); the Human Embryo Research Panel (1994); and the National Institutes of Health (NIH) Recombinant DNA Advisory Committee (RAC), which continues to function.These committees and commissions form a kind of a continuum, albeit occasionally interrupted by periods during which no such bodies existed. Each arose from a particular confluence of events and circumstances. NBAC was no different; its history can be traced both to a series of discussions within the White House Office of Science and Technology Policy beginning in 1993 (NBAC 1998a, p. 3), and to a specific recommendation from ACHRE that called for a national committee to address ethical issues in human subjects research (ACHRE 1995, p. 817). Nbac's Impact In his useful comparison of the accomplishments of the National Commission and the President's Commission, Brad Gray concluded that seven lessons were learned, the sixth of which was that "nothing substitutes for having a perceptible impact on either policy or practice" (Gray 1995, p. 304). Assessing NBAC's [End Page 95] impact on "policy or practice" is difficult, particularly given the fact that it so recently completed its work. More time may be needed before a full assessment can be undertaken of the impact of its six reports (and their total of 120 recommendations). Instead, in this essay we offer some reflections on NBAC's initial impact, using some specific examples of how bioethics gets done Inside the Beltway. Eliciting Reaction If immediate reaction by the White House is any measure of impact, then Cloning Human Beings (NBAC 1997) had a significant one. The day after he received this report in a Rose Garden ceremony, President Clinton submitted a bill to Congress that would have extended the moratorium on federal funding to create a child using somatic cell nuclear transfer. This bill never passed, nor has any other bill emerged that has enjoyed the support of the House and the Senate. Five states have enacted legislation to date, but these vary in their permissibility from bans on all forms of cloning to bans similar to the one proposed by NBAC, which recommended a time-limited prohibition only on somatic cell transfer to create a child (reproductive cloning).If the Cloning report elicited speedy action from the White House, this paled in comparison to the reaction that led to and, in turn, was created by Ethical Issues in Human Stem Cell Research (NBAC 1999a). Those who believe that government moves slowly need only be reminded of the events of 8-14 November 1998 (and, as we shall mention below, the further events of 14 July 1999). Some will recall that early in the second week of November 1998, James Thomson and his colleagues published in Nature and John Gearhart and his colleagues published in the Proceedings of the National Academy of Sciences that they had isolated and cultured human primordial stem cells and germ cells respectively. In this paper I contrast two causal explanations of the outcome of a set of laboratory experiments in population ecology conducted by Thomas Park in the 1940s and 1950s. These experiments shed light on the problem of adducing evidence for the operation of competition (see Lloyd 1987 for a recent philosophical discussion) and are central to the group selection controversy because they form the empirical base for experimental studies of group selection conducted over the last 12 years (see Griesemer and (...) Wade 1988 for an analysis).The experiments investigated competition in laboratory populations of two flour beetle species, Tribolium confusum and Tribolium castaneum, but the results were more complex and interesting than expected; in addition to demonstrating competition in a laboratory system, they exhibited what Park called “competitive indeterminacy.” This phenomenon was of great interest to statisticians, who devised stochastic models to describe its demographic basis (e.g., M.S. Bartlett, P.H. Leslie, and J. Neyman; see Mertz 1972 for references). (shrink)

Kant's Critique of Pure Reason, his main work of theoretical philosophy, frequently uses metaphors from law. In this first book-length study in English of Kant's legal metaphors and their role in the first Critique, Sofie Møller shows that they are central to Kant's account of reason. Through an analysis of the legal metaphors in their entirety, she demonstrates that Kant conceives of reason as having a structure mirroring that of a legal system in a natural right framework. Her study shows (...) that Kant's aim is to make cognisers become similar to authorized judges within such a system, by proving the legitimacy of the laws and the conditions under which valid judgments can be pronounced. Just how is obscure. The logic of discovery is elusive; and it is harder to explain how we have come to see matters rightly than to recognize that we do, in fact, see them rightly. What counts as a theory, moreover, calls for explication as much as does a theory's emergence. (...) When we have in mind a theory that shapes our social vision, there is a progression from a central set of propositions, keyed to a range of paradigm cases and seen as a logical structure, to a " way of thinking " widely enough embraced to have political significance, at least for a given oommunity. In this essay I want to explore some fundamental questions raised by Germain Grisez's theory of natural law ethics.1 These questions are chiefly conceptual. But neither they nor Grisez's theory should be seen in a vacuum. Rather, I would begin by suggesting that the importance of his work, its emergence in some Catholic circles, is linked with two specific moral and political problems. HANINK As a point of chronology, Grisez's early study of rubortion was the context for one of the first formulations of his natural law ethics.2 But why should this have been so? And why should abortion so engage Catholic thinkers, some of whom had felt a distance from explicitly Catholic positions, that Grisez's work should become pivotal? Answers to such questions must be tentative, but they include the following considerations. In a brief period, no more than a decade, legal abortion in the West became entrenched social policy.8 It was a policy, too, supported by dominant intellectual forces. But the new policy, defended in terms of individual freedom and a right to privacy, struck many Catholicsand non-Catholics-as vicious and tragic. It was vicious in that it made expendable the weakest and most vulnerable human beings. Human rights somehow became restricted to the strong and self-sufficient. The policy was tragic in its denial of human community. We are not, however much radical individualism supposes, merely a collection of separate egos. l/Ve are, rather, a community tied to a past and pledged to a future, so pledged, in part, by the children we bear and nurture.4 For in hearing and nurturing children we carry on the love of parents who have done as much for us; and we carry ourselves into a future where we hope our own love will be thus extended. But abortion, and surely unrestricted abortion, betrays this community of trust. Still, a policy so vicious and tragic can make us look for a fresh moral vision.
