This paper offers a critical analysis of two central issues in Luigi Ferrajoli’s Principia iuris , and more generally of his theory of rights. One is the way in which ‘expectations’ play a crucial role in his deontic theory by establishing the logical basis for his guarantee-based conception of law and rights. The axiomatic way in which Ferrajoli arrives at his conception of fundamental rights is questioned, for it fails to give a full account of the nature of subjective rights. (...) The other issues discussed here is Ferrajoli’s own defence of the universality of fundamental rights, and how this is made to depend on a ‘normative technique’ that one can associate with legal discourse and modern law in Western societies. This, however, poses the problem of how this formal universalism can be reconciled with the intercultural dialogue that Ferrajoli also advocates. (shrink)

The title of the following essay echoes one of Bobbio’s most famous books, and emphasizes one of its main issues: that of providing a “foundation” for the idea of rights. This essay summarizes what Bobbio means by “the age of rights” and presents his principal criticisms of any supposedly “absolute foundation” for rights. In exploring the notion of an age of rights without foundations Bobbio raised a number of crucial issues that effectively anticipated the contemporary debate around problems concerning the (...) historical transformation of rights and the origin of these rights in specific social processes, the deontological status of rights and the connection between rights and duties, the contrast between universalism and relativism, the relationship between different “generations of rights” and social rights, and the international protection of rights in relation to the idea of “institutional pacificism.” To pursue further reflection and enquiry along these lines would be a way of remaining faithful to the spirit of Bobbio’s teaching. But in order to do so it would also be necessary to question some of the methodological assumptions of Bobbio’s work: normativism in the area of jurisprudence, neopositivism in the field of epistemology, and the analytical approach in the history of ideas. We reexamine some of the classic problems connected with the use of cardinal utility functions in decision theory, and discuss Patrick Suppes's contributions to this field in light of a reinterpretation we propose for these problems. We analytically decompose the doctrine of ordinalism, which only accepts ordinal utility functions, and distinguish between several doctrines of cardinalism, depending on what components of ordinalism they specifically reject. We identify Suppes's doctrine with the major deviation from ordinalism that conceives of utility functions as (...) representing preference differences, while being non- etheless empirically related to choices. We highlight the originality, promises and limits of this choice-based cardinalism. (shrink)

Consider a subjective expected utility preference relation. It is usually held that the representations which this relation admits differ only in one respect, namely, the possible scales for the measurement of utility. In this paper, I discuss the fact that there are, metaphorically speaking, two additional dimensions along which infinitely many more admissible representations can be found. The first additional dimension is that of state-dependence. The second—and, in this context, much lesser-known—additional dimension is that of act-dependence. The simplest implication of (...) their usually neglected existence is that the standard axiomatizations of subjective expected utility fail to provide the measurement of subjective probability with satisfactory behavioral foundations. Supra-Bayesianism is the Bayesian response to learning the opinions of others. Probability pooling constitutes an alternative response. One natural question is whether there are cases where probability pooling gives the supra-Bayesian result. This has been called the problem of Bayes-compatibility for pooling functions. It is known that in a common prior setting, under standard assumptions, linear pooling cannot be nontrivially Bayes-compatible. We show by contrast that geometric pooling can be nontrivially Bayes-compatible. Indeed, we show that, under certain assumptions, geometric and (...) Bayes-compatible pooling are equivalent. Granting supra-Bayesianism its usual normative status, one upshot of our study is thus that, in a certain class of epistemic contexts, geometric pooling enjoys a normative advantage over linear pooling as a social learning mechanism. We discuss the philosophical ramifications of this advantage, which we show to be robust to variations in our statement of the Bayes-compatibility problem. (shrink)

I examine the once popular claim according to which interpersonal comparisons of welfare are necessary for social choice. I side with current social choice theorists in emphasizing that, on a narrow construal, this necessity claim is refuted beyond appeal. However, I depart from the opinion presently prevailing in social choice theory in highlighting that on a broader construal, this claim proves not only compatible with, but even comforted by, the current state of the field. I submit that all in all, (...) the most accurate philosophical assessment consists not in flatly rejecting this necessity claim, but in accepting it in a suitably revised form. (shrink)

Sets are central to mathematics and its foundations, but what are they? In this book Luca Incurvati provides a detailed examination of all the major conceptions of set and discusses their virtues and shortcomings, as well as introducing the fundamentals of the alternative set theories with which these conceptions are associated. He shows that the conceptual landscape includes not only the naïve and iterative conceptions but also the limitation of size conception, the definite conception, the stratified conception and the (...) graph conception. In addition, he presents a novel, minimalist account of the iterative conception which does not require the existence of a relation of metaphysical dependence between a set and its members. His book will be of interest to researchers and advanced students in logic and the philosophy of mathematics. (shrink)

This paper examines the preference-based approach to the identification of beliefs. It focuses on the main problem to which this approach is exposed, namely that of state-dependent utility. First, the problem is illustrated in full detail. Four types of state-dependent utility issues are distinguished. Second, a comprehensive strategy for identifying beliefs under state-dependent utility is presented and discussed. For the problem to be solved following this strategy, however, preferences need to extend beyond choices. We claim that this a necessary feature (...) of any complete solution to the problem of state-dependent utility. We also argue that this is the main conceptual lesson to draw from it. We show that this lesson is of interest to both economists and philosophers. (shrink)

The representational theory of measurement has long been the central paradigm in the philosophy of measurement. Such is not the case anymore, partly under the influence of the critique according to which RTM offers too poor descriptions of the measurement procedures actually followed in science. This can be called the metrological critique of RTM. I claim that the critique is partly irrelevant. This is because, in general, RTM is not in the business of describing measurement procedures, be it in idealized (...) form. To support this claim, I present various cases where RTM can be said to investigate measurement without providing any measurement procedure. Such limit cases lead to a better understanding of the RTM project. They also illustrate some of the questions which the philosophy of measurement can explore, when it is ready to go beyond the metrological viewpoint. (shrink)

Translation of passages of Aristotle's De Anima into Portuguese. The passages are these: I.1, I.4 (the 'Rylean passage'); II.1-6; III.1-8. The translation is preliminary.

The basic axioms or formal conditions of decision theory, especially the ordering condition put on preferences and the axioms underlying the expected utility formula, are subject to a number of counter-examples, some of which can be endowed with normative value and thus fall within the ambit of a philosophical reflection on practical rationality. Against such counter-examples, a defensive strategy has been developed which consists in redescribing the outcomes of the available options in such a way that the threatened axioms or (...) conditions continue to hold. We examine how this strategy performs in three major cases: Sen's counterexamples to the binariness property of preferences, the Allais paradox of EU theory under risk, and the Ellsberg paradox of EU theory under uncertainty. We find that the strategy typically proves to be lacking in several major respects, suffering from logical triviality, incompleteness, and theoretical insularity. To give the strategy more structure, philosophers have developed “principles of individuation”; but we observe that these do not address the aforementioned defects. Instead, we propose the method of checking whether the strategy can overcome its typical defects once it is given a proper theoretical expansion. We find that the strategy passes the test imperfectly in Sen's case and not at all in Allais's. In Ellsberg's case, however, it comes close to meeting our requirement. But even the analysis of this more promising application suggests that the strategy ought to address the decision problem as a whole, rather than just the outcomes, and that it should extend its revision process to the very statements it is meant to protect. Thus, by and large, the same cautionary tale against redescription practices runs through the analysis of all three cases. A more general lesson, simply put, is that there is no easy way out from the paradoxes of decision theory. (shrink)

The Sure-Thing Principle famously appears in Savage’s axiomatization of Subjective Expected Utility. Yet Savage introduces it only as an informal, overarching dominance condition motivating his separability postulate P2 and his state-independence postulate P3. Once these axioms are introduced, by and large, he does not discuss the principle any more. In this note, we pick up the analysis of the Sure-Thing Principle where Savage left it. In particular, we show that each of P2 and P3 is equivalent to a dominance condition; (...) that they strengthen in different directions a common, basic dominance axiom; and that they can be explicitly combined in a unified dominance condition that is a candidate formal statement for the Sure-Thing Principle. Based on elementary proofs, our results shed light on some of the most fundamental properties of rational choice under uncertainty. In particular they imply, as corollaries, potential simplifications for Savage’s and the Anscombe- Aumann axiomatizations of Subjective Expected Utility. Most surprisingly perhaps, they reveal that in Savage’s axiomatization, P3 can be weakened to a natural strengthening of so-called Obvious Dominance. (shrink)

In this paper, I examine the decision-theoretic status of risk attitudes. I start by providing evidence showing that the risk attitude concepts do not play a major role in the axiomatic analysis of the classic models of decision-making under risk. This can be interpreted as reflecting the neutrality of these models between the possible risk attitudes. My central claim, however, is that such neutrality needs to be qualified and the axiomatic relevance of risk attitudes needs to be re-evaluated accordingly. Specifically, (...) I highlight the importance of the conditional variation and the strengthening of risk attitudes, and I explain why they establish the axiomatic significance of the risk attitude concepts. I also present several questions for future research regarding the strengthening of risk attitudes. (shrink)

Translation of Aristotle's Posterior Analytics I into Portuguese, with a few notes, experimental glossary and introduction. The translation, which was made at 2003/4, was preliminary and its publication was intended to provide a didactic tool for courses as well as a provisional resource in research seminars. It needs some revision. I am currently working (slowly...) on the revision of the translation and a new revised one will surely appear at some point.

Crispin Wright maintains that the architecture of perceptual justification is such that we can acquire justification for our perceptual beliefs only if we have antecedent justification for ruling out any sceptical alternative. Wright contends that this principle doesn’t elicit scepticism, for we are non-evidentially entitled to accept the negation of any sceptical alternative. Sebastiano Moruzzi has challenged Wright’s contention by arguing that since our non-evidential entitlements don’t remove the epistemic risk of our perceptual beliefs, they don’t actually enable us to (...) acquire justification for these beliefs. In this paper I show that Wright’s responses to Moruzzi are ineffective and that Moruzzi’s argument is validated by probabilistic reasoning. I also suggest that Wright cannot answer Moruzzi’s challenge without weakening the support available for his conception of the architecture of perceptual justification. (shrink)

State-dependent utility is a problem for the behavioural branch of decision theory under uncertainty. It questions the very possibility that beliefs be revealed by choice data. According to the current literature, all models of beliefs are equally exposed to the problem. Moreover, the problem is solvable only when the decision-maker can influence the resolution of uncertainty. This article gives grounds to reject these two views. The various models of beliefs can be shown to be unequally exposed to the problem of (...) state-dependent utility. The problem can be argued to be solved even when the decision-maker has no influence over the resolution of uncertainty. The implications of such reappraisal for a philosophical appreciation of the revealed preference methodology are discussed. (shrink)

In Posterior Analytics 71b9 12, we find Aristotle’s definition of scientific knowledge. The definiens is taken to have only two informative parts: scientific knowledge must be knowledge of the cause and its object must be necessary. However, there is also a contrast between the definiendum and a sophistic way of knowing, which is marked by the expression “kata sumbebekos”. Not much attention has been paid to this contrast. In this paper, I discuss Aristotle’s definition paying due attention to this contrast (...) and to the way it interacts with the two conditions presented in the definiens. I claim that the “necessity” condition ammounts to explanatory appropriateness of the cause. (shrink)

In this paper, we develop an impure somatic theory of emotion, according to which emotions are constituted by the integration of bodily perceptions with representations of external objects, events, or states of affairs. We put forward our theory by contrasting it with Prinz's pure somatic theory, according to which emotions are entirely constituted by bodily perceptions. After illustrating Prinz's theory and discussing the evidence in its favor, we show that it is beset by serious problems—i.e., it gets the neural correlates (...) of emotion wrong, it isn't able to distinguish emotions from bodily perceptions that aren't emotions, it cannot account for emotions being directed towards particular objects, and it mischaracterizes emotion phenomenology. We argue that our theory accounts for the empirical evidence considered by Prinz and solves the problems faced by his theory. In particular, we maintain that our theory gives a unified and principled account of the relation between emotions and bodily perceptions, the intentionality of emotions, and emotion phenomenology. In Richard Bradley’s book, Decision Theory with a Human Face, we have selected two themes for discussion. The first is the Bolker-Jeffrey theory of decision, which the book uses throughout as a tool to reorganize the whole field of decision theory, and in particular to evaluate the extent to which expected utility theories may be normatively too demanding. The second theme is the redefinition strategy that can be used to defend EU theories against the Allais and Ellsberg paradoxes, a strategy (...) that the book by and large endorses, and even develops in an original way concerning the Ellsberg paradox. We argue that the BJ theory is too specific to fulfil Bradley’s foundational project and that the redefinition strategy fails in both the Allais and Ellsberg cases. Although we share Bradley’s conclusion that EU theories do not state universal rationality requirements, we reach it not by a comparison with BJ theory, but by a comparison with the non-EU theories that the paradoxes have heuristically suggested. We investigate risk attitudes when the underlying domain of payoffs is finite and the payoffs are, in general, not numerical. In such cases, the traditional notions of absolute risk attitudes, that are designed for convex domains of numerical payoffs, are not applicable. We introduce comparative notions of weak and strong risk attitudes that remain applicable. We examine how they are characterized within the rank-dependent utility model, thus including expected utility as a special case. In particular, we characterize strong comparative risk (...) aversion under rank-dependent utility. This is our main result. From this and other findings, we draw two novel conclusions. First, under expected utility, weak and strong comparative risk aversion are characterized by the same condition over finite domains. By contrast, such is not the case under non-expected utility. Second, under expected utility, weak comparative risk aversion is characterized by the same condition when the utility functions have finite range and when they have convex range. By contrast, such is not the case under non-expected utility. Thus, considering comparative risk aversion over finite domains leads to a better understanding of the divide between expected and non-expected utility, more generally, the structural properties of the main models of decision-making under risk. Translation of Aristotle's Physics I-II into Portuguese, with commentaries. Tradução para o português dos livros I e II da Física de Aristóteles, com comentários.

It is widely held that under ordinal utility, utility differences are ill-defined. Allegedly, for these to be well-defined (without turning to choice under risk or the like), one should adopt as a new kind of primitive quaternary relations, instead of the traditional binary relations underlying ordinal utility functions. Correlatively, it is also widely held that the key structural properties of quaternary relations are entirely arbitrary from an ordinal point of view. These properties would be, in a nutshell, the hallmark of (...) cardinal utility. While much is obviously true in these two tenets, this note explains why, as stated, they should be abandoned. Any ordinal utility function induces a rich quaternary relation. There is such a thing as ordinal utility differences. Furthermore, this induced quaternary relation respects, apart from completeness, the most standard structural properties of quaternary relations. These properties are, from an ordinal point of view, anything but arbitrary; from a quaternary perspective only completeness should be considered the hallmark—if any—of cardinal utility. These facts are explained to be especially relevant to the critical appreciation of the ordinalist methodology. (shrink)

I discuss what Aristotle means when he say that scientific demonstration must proceed from necessary principles. I argue that, for Aristotle, scientific demonstration should not be reduced to sound deduction with necessary premises. Scientific demonstration ultimately depends on the fully appropriate explanatory factor for a given explanandum. This explanatory factor is what makes the explanandum what it is. Consequently, this factor is also unique. When Aristotle says that demonstration must proceed from necessary principles, he means that each demonstration requires the (...) principle that is the necessary one for the fully appropriate explanation of its explanandum. This picture also provides a key to understand Aristotle's thesis that scientific explanation depends on essences: it is the essence of the attribute to be explained that should be stated as the fully appropriate explanatory factor. Experiences like pains, pleasures, and emotions have affective phenomenal character: they feel pleasant or unpleasant. Imperativism proposes to explain affective phenomenal character by appeal to imperative content, a kind of intentional content that directs rather than describes. We argue that imperativism is on the right track, but has been developed in the wrong way. There are two varieties of imperativism on the market: first-order and higher-order. We show that neither is successful, and offer in their place a new theory: reflexive (...) imperativism. Our proposal is that an experience P feels pleasant in virtue of being constituted by a Command with reflexive imperative content, while an experience U feels unpleasant in virtue of being constituted by a Command with reflexive imperative content : More of P!Less of U! In this paper, I investigate the betting behavior of a decision-maker who can influence the likelihood of the events upon which she is betting. In decision theory, this is best known as a situation of moral hazard. Focusing on a particularly simple case, I sketch the first systematic analysis of moral hazard in the canonical Savage framework. From the results of this analysis, I draw two philosophical conclusions. First, from an observational and a descriptive point of view, there need to (...) be no incompatibility between moral hazard and the Savage framework. This qualifies the incompatibility view, that is ubiquitous in decision theory. Second, in general, moral hazard is not sufficient to overcome the challenges posed by state-dependent utility to the behavioral identification of beliefs. This qualifies the sufficiency view, that is influential in decision theory. These two philosophical conclusions are the main contributions of my paper. (shrink)

Analyzing geometric properties of high-dimensional loss functions, such as local curvature and the existence of other optima around a certain point in loss space, can help provide a better understanding of the interplay between neural network structure, implementation attributes, and learning performance. In this work, we combine concepts from high-dimensional probability and differential geometry to study how curvature properties in lower-dimensional loss representations depend on those in the original loss space. We show that saddle points in the original space are (...) rarely correctly identified as such in expected lower-dimensional representations if random projections are used. The principal curvature in the expected lower-dimensional representation is proportional to the mean curvature in the original loss space. Hence, the mean curvature in the original loss space determines if saddle points appear, on average, as either minima, maxima, or almost flat regions. We use the connection between expected curvature in random projections and mean curvature in the original space (i.e., the normalized Hessian trace) to compute Hutchinson-type trace estimates without calculating Hessian-vector products as in the original Hutchinson method. Because random projections are not suitable to correctly identify saddle information, we propose to study projections along dominant Hessian directions that are associated with the largest and smallest principal curvatures. We connect our findings to the ongoing debate on loss landscape flatness and generalizability. Finally, for different common image classifiers and a function approximator, we show and compare random and Hessian projections of loss landscapes with up to about 7×10^6 parameters. (shrink)

Aristotle contrasts episteme and doxa through the key notions of universal and necessary. These notions have played a central role in Aristotle’s characterization of scientific knowledge in the previous chapters of APo. They are not spelled out in APo I.33, but work as a sort of reminder that packs an adequate characterization of scientific knowledge and thereby gives a highly specified context for Aristotle’s contrast between episteme and doxa. I will try to show that this context introduces a contrast in (...) terms of explanatory claims: on the one hand, episteme covers those claims which capture explanatory connections that are universal and necessary and thereby deliver scientific understanding; on the other hand, doxa covers the explanatory attempts that fail at doing so. I examine Aristotle’s definition of scientific knowledge in Posterior Analytics 71b 9-12 and try to understand how it relates to the sophistical way of knowing and to "kata sumbebekos knowledge". I claim that scientific knowledge of p requires knowing p by its appropriate cause, and that this appropriate cause is a universal (katholou) in the restricted sense Aristotle proposes in 73b 26-27 ff., i.e., an attribute coextensive with the subject (an extensional feature) and predicated of the subject in itself (an (...) intensional feature). Kata sumbebekos knowledge, on the other hand, can occur even when the predicate of a conclusion is coextensive with its subject and is proved by a convertible meson which is not the most appropriate from an explanatory standpoint. I discuss the exact meaning of the thesis according to which the object of scientific knowledge is necessary. The thesis is expressed by Aristotle in the Posterior Analytics, in his definition of scientific knowledge. The traditional interpretation understands this definition as depending on two parallel and independent requirements, the causality requirement and the necessity requirement. Against this interpretation, I try to show, through the examination of several passages that refer to the definition of scientific knowledge, that the necessity requirement specifies (...) more exactly the causality requirement: what cannot be otherwise is the explanatory relation between the explanandum and the cause by which it is what it is. This book uses mathematical models of language to explain why there are certain gaps in language: things that we might expect to be able to say but can't. For instance, why can we say I ran for five minutes but not *I ran to the store for five minutes? Why is five pounds of books acceptable, but *five pounds of book not acceptable? What prevents us from saying *sixty degrees of water to express the temperature of the water in a (...) swimming pool when sixty inches of water can express its depth? And why can we not say *all the ants in my kitchen are numerous? The constraints on these constructions involve concepts that are generally studied separately: aspect, plural and mass reference, measurement, and distributivity. In this book, Lucas Champollion provides a unified perspective on these domains, connects them formally within the framework of algebraic semantics and mereology, and uses this connection to transfer insights across unrelated bodies of literature and formulate a single constraint that explains each of the judgments above. I focus on a key argument for global external world scepticism resting on the underdetermination thesis: the argument according to which we cannot know any proposition about our physical environment because sense evidence for it equally justifies some sceptical alternative (e.g. the Cartesian demon conjecture). I contend that the underdetermination argument can go through only if the controversial thesis that conceivability is per se a source of evidence for metaphysical possibility is true. I also suggest a reason to doubt that (...) conceivability is per se a source of evidence for metaphysical possibility, and thus to doubt the underdetermination argument. (shrink)

Mindreading (or folk psychology, Theory of Mind, mentalizing) is the capacity to represent and reason about others’ mental states. The Simulation Theory (ST) is one of the main approaches to mindreading. ST draws on the common-sense idea that we represent and reason about others’ mental states by putting ourselves in their shoes. More precisely, we typically arrive at representing others’ mental states by simulating their mental states in our own mind. This entry offers a detailed analysis of ST, considers theoretical (...) arguments and empirical data in favour of and against it, discusses its philosophical implications, and illustrates some alternatives to it. A subject S's belief that Q is well-grounded if and only if it is based on a reason of S that gives S propositional justification for Q. Depending on the nature of S's reason, the process whereby S bases her belief that Q on it can vary. If S's reason is non-doxastic––like an experience that Q or a testimony that Q––S will need to form the belief that Q as a spontaneous and immediate response to that reason. If S's reason (...) is doxastic––like a belief that P––S will need to infer her belief that Q from it. The distinction between these two ways in which S's beliefs can be based on S's reasons is widely presupposed in current epistemology but––we argue in this paper––is not exhaustive. We give examples of quite ordinary situations in which a well-grounded belief of S appears to be based on S's reasons in neither of the ways described above. To accommodate these recalcitrant cases, we introduce the notion of enthymematic inference and defend the thesis that S can base a belief that Q on doxastic reasons P1, P2, …, Pn via inferring enthymematically Q from P1, P2, …, Pn. I discuss the methodological passage in the begin- ning of Ethica Eudemia I.6 (1216b26-35), which has received attention in connection with Aristotle’s notion of dialectic and his methodology in Ethics. My central focus is not to discuss whether Aristotle is prescribing and using what has been called the method of endoxa. I will focus on how this passage coheres with the remaining parts of the same chapter, which also are advancing methodological remarks. My claim is that the meth- od of (...) Ethica Eudemia I.6 is in agreement with many features of Aristotle’s theory of explanation as presented in the Posterior Analytics: Aristotle’s main concern is a warning against misuses of explanatory arguments. This paper examines Aristotle’s notion of priority with the specific aim of capturing the sort of priority that characterizes the primacy of substances in his metaphysics. I reject the traditional interpretation, which understands the ontological priority of substances in terms of independent existence. But there are rather two sorts of priority: the ontological priority of substances should be understood in terms of completeness, whereas the ontological priority of “substances-of-something” (the essences) is a causal-explanatory priority. Furthermore, an important piece of Aristotle’s (...) argument against Platonism is that these two sorts of priority – namely, the completeness priority and the causal-explanatory priority – should be kept distinct. An obituary of Philippe Mongin (1950-2020).

This is an introductory handbook for some of the main themes around the notion of predication in Aristotle. It does not aim at being exhaustive, but only sketches some important lines about the subject; it contains an introductory essay, besides the translation (into Portuguese) and commentary of basic texts (such as Posterior Analytics I-22, Categories 1-5, Interpretation 1-6 etc.).

This paper discusses some issues concerning the definition of moral virtue in Nicomachean Ethics 1106b 36- 1107a 2. It is reasonable to expect from a definition the complete enumeration of the relevant features of its definiendum, but the definition of moral virtue seems to fail in doing this task. One might be tempted to infer that this definition is intended by Aristotle as a mere preliminary account that should be replaced by a more precise one. The context of the argument (...) Aristotle develops in Book II of his NE give us some help. I argue that the definition of moral virtue, once considered in the light of its context, is far from being an incomplete and provisional account: it rather introduces coherently the same notion of moral virtue that Aristotle employs in other texts (as in Nicomachean Ethics VI 13). My main proposal is that the way in which "hexis" is understood in the context of previous chapters allows Aristotle to encode in it the notion of an ability to do the right things regularly.
