Do doctors fix patients? Or do they heal them? For all of modern medicine’s many successes, discontent with the quality of patient care has combined with a host of new developments, from aging populations to the resurgence of infectious diseases, which challenge medicine’s overreliance on narrowly mechanistic and technical methods of explanation and intervention, or “fixing’ patients. The need for a better balance, for more humane “healing” rationales and practices that attend to the social and environmental aspects of health and (...) illness and the experiencing person, is more urgent than ever. Yet, in public health and bioethics, the fields best positioned to offer countervailing values and orientations, the dominant approaches largely extend and reinforce the reductionism and individualism of biomedicine. The collected essays in To Fix or To Heal do more than document the persistence of reductionist approaches and the attendant extension of medicalization to more and more aspects of our lives. The contributors also shed valuable light on why reductionism has persisted and why more holistic models, incorporating social and environmental factors, have gained so little traction. The contributors examine the moral appeal of reductionism, the larger rationalist dream of technological mastery, the growing valuation of health, and the enshrining of individual responsibility as the seemingly non-coercive means of intervention and control. This paradigm-challenging volume advances new lines of criticism of our dominant medical regime, even while proposing ways of bringing medical practice, bioethics, and public health more closely into line with their original goals. Precisely because of the centrality of the biomedical approach to our society, the contributors argue, challenging the reductionist model and its ever-widening effects is perhaps the best way to press for a much-needed renewal of our ethical and political discourse. After introducing the new field of cultural evolution, we review a growing body of empirical evidence suggesting that culture shapes what people attend to, perceive and remember as well as how they think, feel and reason. Focusing on perception, spatial navigation, mentalizing, thinking styles, reasoning (epistemic norms) and language, we discuss not only important variation in these domains, but emphasize that most researchers (including philosophers) and research participants are psychologically peculiar within a global and historical context. This rising tide of (...) evidence recommends caution in relying on one’s intuitions or even in generalizing from reliable psychological findings to the species, Homo sapiens. Our evolutionary approach suggests that humans have evolved a suite of reliably developing cognitive abilities that adapt our minds, information-processing abilities and emotions ontogenetically to the diverse culturally-constructed worlds we confront. Recent empirical work has offered strong support for ‘biased pluralism’ and ‘economic elite’ accounts of political power in the United States, according a central role to ‘business interest groups’ as a mechanism through which corporate influence is exerted. Here, we propose an additional channel of influence for corporate interests: the ‘policy-planning network,’ consisting of corporate-dominated foundations, think tanks, and elite policy-discussion groups. To evaluate this assertion, we consider one key policy-discussion group, the Council on Foreign Relations. We first briefly review (...) the origins of this organization and then review earlier findings on its influence. We then code CFR policy preferences on 295 foreign policy issues during the 1981–2002 period. In logistic regression analyses, we find that the preferences of more affluent citizens and the CFR were positive, statistically significant predictors of foreign policy outcomes while business interest group preferences were not. These findings are discussed with a consideration of the patterns of CFR ‘successes’ and ‘failures’ for the issues in our dataset. Although a full demonstration of a causal connection between corporate interests, the policy-planning network and policy outcomes requires further research, we conclude that this has been shown to be a plausible mechanism through which corporate interests are represented and that ‘biased pluralism’ researchers should include it in their future investigations. We contend that if efficiency and reliability are important factors in neural information processing then distributed, not localist, representations are “evolution's best bet.” We note that distributed codes are the most efficient method for representing information, and that this efficiency minimizes metabolic costs, providing adaptive advantage to an organism.

Black Americans are underrepresented members of the US accounting academy (Brown-Liburd and Joe 2020). By interviewing Black accounting faculty about their experiences during their doctoral education and institutional hiring and promotion processes, we discover stories of degradation, stereotyping, and exclusion (i.e., microaggressions) that participants report negatively impact their views of the academic accounting profession and increase their turnover intentions. Microaggressions committed against Black accounting faculty may contribute to underrepresentation that can be addressed through enlightenment, education, and interaction. Our findings are (...) important as they fill gaps in related extant literature concerning the existence and impacts of microaggressions, and they may help improve diversity and equity in the accounting academy. The purpose of the study was to assess medical journals’ conflicts of interest in the publication of book reviews. We examined book reviews published in 1999, 2000, and 2001 in five leading medical journals: Annals of Internal Medicine, British Medical Journal, Journal of the American Medical Association, Lancet, and New England Journal of Medicine. The main outcome measure was journal publication of reviews of books that had been published by the journal’s own publisher, that had been edited or authored by (...) a lead editor of the journal, or that posed another conflict of interest. We also surveyed the editors-in-chief of the five journals about their policies on these conflicts of interests. During the study period, four of the five journals published 30 book reviews presenting a conflict of interest: nineteen by the BMJ, five by the Annals, four by JAMA, and two by the Lancet. These reviews represent 5.8%, 2.7%, 0.7%, and 0.7%, respectively, of all book reviews published by the journals. These four journals, respectively, published reviews of 11.9%, 25.0%, 0.9%, and 1.0% of all medical books published by the journals’ publishers. Only one of the 30 book reviews included a disclosure statement addressing the conflict of interest. None of the journals had a written policy pertaining to the conflicts of interest assessed in this study, although four reported having unwritten policies. We recommend that scientific journals and associations representing journal editors develop policies on conflicts of interest pertaining to book reviews. (shrink)

The ArgumentBetween 1550 and 1650, the intellectual elite of Ashkenazic (German-and Yiddish-speaking) Jews, including rabbis such as Yom Tov Lipmann Heller (1578–1654), showed a marked interest in astronomy, and to a lesser degree in the natural sciences generally. This is one aspect of the assimilation of medieval Jewish rationalism by that group. Passages from Heller‘s writings show his familiarity with medieval and early modern Hebrew astronomical texts, and his belief that astronomy should be studied by all Jewish schoolboys. Heller‘s astronomical (...) views were then influenced by the discoveries and debates of his period. Between 1614 and the 1630‘s, Heller moved from an Aristotelian to a Tychonic view of the nature of the celestial bodies. Inspired, furthermore, by the notion of a natural order subject to change, and basing himself on the exegesis of ancient rabbinic texts, Heller offered what we have termed” midrashic natural histories”: namely, a hypothesis concerning the development of a certain type of animal, and another concerning the dimming of the moon and its movement into a lower orbit. BackgroundThe U.S. Food and Drug Administration traditionally has kept confidential significant amounts of information relevant to the approval or non-approval of specific drugs, devices, and biologics and about the regulatory status of such medical products in FDA’s pipeline.ObjectiveTo develop practical recommendations for FDA to improve its transparency to the public that FDA could implement by rulemaking or other regulatory processes without further congressional authorization. These recommendations would build on the work of FDA’s Transparency Task Force in 2010.MethodsIn 2016-2017, we convened (...) a team of academic faculty from Harvard Medical School, Brigham and Women’s Hospital, Yale Medical School, Yale Law School, and Johns Hopkins Bloomberg School of Public Health to develop recommendations through an iterative process of reviewing FDA’s practices, considering the legal and policy constraints on FDA in expanding transparency, and obtaining insights from independent observers of FDA.ResultsThe team developed 18 specific recommendations for improving FDA’s transparency to the public. FDA could adopt all these recommendations without further congressional action.FundingThe development of the Blueprint for Transparency at the U.S. Food and Drug Administration was funded by the Laura and John Arnold Foundation. Late in 1990, the Center for the Study of Ethics in the Professions at Illinois Institute of Technology (lIT) received a grant of more than $200,000 from the National Science Foundation to try a campus-wide approach to integrating professional ethics into its technical curriculum.! Enough has now been accomplished to draw some tentative conclusions. I am the grant's principal investigator. In this paper, I shall describe what we at lIT did, what we learned, and what others, especially philosophers, can learn (...) from us. This paper is a commentary comparing the evolutionary perspectives of Denis Dutton’s The Art Instinct (2009) and Stephen Davies’s The Artful Species (2012). Their topics thus necessarily overlap, but their books have different purposes and a different feel. Davies’s book is an academic exercise. He has no real arguments or claims of his own. Dutton wishes to demonstrate that evolutionary psychology can provide a satisfying naturalistic explanation of aesthetic experience. Neither Davies nor Dutton fully succeeds in his ambition. Davies extends (...) his scepticism well beyond a sensible account of the state of current knowledge about human evolution, and Dutton fails to recognize underlying theoretical differences in his main sources of theoretical inspiration. The limitations in these two works do not define the boundaries of current knowledge in evolutionary aesthetics. The most advanced and adequate concept in the evolutionary humanities is the idea that humans evolved the capacity to create imaginative virtual worlds and use those worlds to guide human behaviour. Both books being considered in this essay approach the idea of imaginative virtual worlds and almost grasp it. Before taking up that topic, the paper shall discuss two subsidiary issues: Dutton’s effort to incorporate sexual selection, and Davies’s sceptical negations about all evolutionary knowledge. Kevin Corcoran offers an account of how one can be a physicalist about human persons, deny temporal gaps in the existence of persons, and hold that there is an afterlife. I argue that Corcoran's account both violates the necessity of metaphysical identity and implausibly makes an individual's existence dependent on factors wholly extrinsic to the individual. Corcoran's defence is considered, as well as Stephen Davis's suggestions on how an account like Corcoran's can defend itself against these concerns. It is (...) shown, however, that the difficulties remain in full force and, therefore, that Corcoran's account fails to reconcile physicalism, no gappy existence, and an afterlife. (shrink)

Crises, defined as a period of acute stress on social systems of all kinds, are a recurrent feature of history. As such, they are best approached and understood from a comparative historical perspective. We can distinguish between those caused or precipitated by an exogenous shock and those that derive from an endogenous process that culminates in the crisis. Crises can be of short or long duration and range from local to global. The most severe are ones that lead to a (...) civilizational collapse or radical simplification process. Historically, severe crises have been localized to specific parts of the planet, even when several occur simultaneously because of global natural phenomena, but in the modern world we have truly global crises. Evidence suggests that such a global crisis is imminent or has already commenced. This raises practical and normative pressing issues. (shrink)

This paper describes one possible origin point for fraudulent behavior within the American pharmaceutical industry. We argue that during the late nineteenth century therapeutic reformers sought to promote both laboratory science and increasingly systematized forms of clinical experiment as a new basis for therapeutic knowledge. This process was intertwined with a transformation in the ethical framework in which medical science took place, one in which monopoly status was replaced by clinical utility as the primary arbiter of pharmaceutical legitimacy. This new (...) framework fundamentally altered the set of epistemic virtues—a phrase we draw from the philosophical field of virtue epistemology—considered necessary to conduct reliable scientific inquiry regarding drugs. In doing so, it also made possible new forms of fraud in which newly emergent epistemic virtues were violated. To make this argument, we focus on the efforts of Francis E. Stewart and George S. Davis of Parke, Davis & Company. Therapeutic reformers within the pharmaceutical industry, such as Stewart and Davis, were an important part of the broader normative and epistemic transformation we describe in that they sought to promote laboratory science and systematized clinical trials toward the twin goals of improving pharmaceutical science and promoting their own commercial interests. Yet, as we suggest, Parke, Davis & Company also serves as an example of a company that violated the very norms that Stewart and Davis helped introduce. We thus seek to describe one possible origin point for the widespread fraudulent practices that now characterize the pharmaceutical industry. We also seek to describe an origin point for why we conceptualize such practices as fraudulent in the first place. (shrink)

At the intersection of meta-ethics and philosophy of science, Nicholas Sturgeon’s “Moral Explanation” ([1985] 1988), Richard Boyd’s “How to be a Moral Realist” (1988), and David Brink’s Moral Realism and the Foundations of Ethics (1989) inaugurated a sustained argument for the claim that moral kinds like right action and virtuous agent are scientifically investigable natural kinds. The corresponding position is called “non-reductive ethical naturalism,” or “NEN.” Ethical nonnaturalists, by contrast, argue that moral kinds are genuine and objective, but not natural. (...) This dissertation is largely a challenge to non-reductive ethical naturalism from the viewpoint of ethical nonnaturalism. An introduction, four fairly independent chapters, and a conclusion comprise this dissertation. The introduction (chapter one) situates and summarizes the arguments in the four chapters that immediately follow, and the concluding chapter (chapter six) describes future work related to the arguments in this dissertation. I now turn to chapters two through five. In chapter two, I shore up what I believe are weakness in Derek Parfit’s Triviality Objection to reductive ethical naturalism and then present a challenge to the NEN theorist, which, I argue, the NEN theorist must but ultimately cannot meet. The challenge is to sketch an empirical experiment whereby we can adjudicate between competing moral hypotheses. I explain in terms of experimental design and evaluation why the challenge cannot be met. Chapters three and four focus on the semantics and reference relations of kind terms. In chapter three, I defend the Causal Externalist (CE) theory of semantics and reference against an objection distilled from two articles by Åsa Marie Wikforss. The objection is that CE implies a paradox, escape from which forces the CE theorist upon the horns of a dilemma. I show how the CE theorist can avoid the dilemma by allowing that the intensions of some artificial-kind terms (e.g., ‘jade’) are not given by descriptions associated with the terms. One consequence of this move, however, is that it casts doubt upon the coherence of the claim that moral-kind terms (e.g., ‘morally required action’) are natural-kind terms. In chapter four, I defend Terence Horgan and Mark Timmons’s Moral-Twin Earth argument from three critical responses put forward in recent paper by David Merli. NEN theorists claim that CE can account for the semantics and reference of moral-kind terms. As per Horgan and Timmons (H&T), however, our responses to the Moral-Twin Earth thought experiment give us reason to doubt the NEN theorists’ claim. Against H&T’s argument, however, Merli presents three independent, critical responses, and in this chapter I defend H&T’s argument in a way that is friendly to the ethical nonnaturalist. One upshot is, I contend, that the ethical nonnaturalist can and indeed should co-opt H&T’s argument for his own use. In chapter five, I return to kinds themselves, specifically those in biology. I first point out that ethical nonnaturalism appeals to a metaphysical thesis about nonnatural value, which need not be limited to the moral domain. Then, I argue that biological naturalism alone cannot give a satisfying realist account of biological kinds like HEART and NEURON. Finally, I show that by conjoining the concept of Cummins functions as recently defended by Paul Davies, a thesis about nonnatural value, and Ned Block’s Disney Principle regarding structural properties, the nonnaturalist, unlike the naturalist, can offer a satisfying realist account of biological kinds. Combining the philosophy and musicology of T.W. Adorno, Walter Benjamin, and Gilles Deleuze, Joseph Weiss makes an original contribution to the field of aesthetics and critical theory. Highlighting previously hidden connections between these philosophers' work brings into focus a new perspective on the dynamic relationship between music, nature, history, and technology. Musical expression in this study is presented as one of the core ways in which human beings are able to escape their more base natures and instincts. The complex (...) ways in which song is taken up across time and place is viewed through the prism of different technologies and histories. This historical process, which Weiss refers to as the 'instrumentalization of the voice', following Deleuze, is illuminated though a wide-ranging analysis encompassing lullaby, jazz, classical music, and the electroacoustic avant-garde. Deepening the aesthetic analysis of music in relation to the conceptual problems of continental philosophy, Weiss reveals enlightening theoretical consequences. By engaging with an eclectic range of 20th century theorists, including Primo Levi, James Baldwin, Édouard Glissant, Fred Moten, and Angela Davis, Weiss makes the argument that advanced music remains a refuge for political hopes that are as yet blocked from realization. Speaking to contemporary debates on post-humanism, memory, and the threat of neo-fascist social relations, the author outlines a bold new aesthetics of music. (shrink)

Ralph Waldo Emerson is often seen as the early American prophet of autonomy. This essay suggests a perhaps surprising fellow traveler in this prophetic call: Joseph Smith. Smith opposed religious creeds for the same reason that Emerson denounced them, namely that creeds represent a threat to the autonomy of a person's beliefs. Smith and Emerson also forward similar defenses of individual autonomy in action. Furthermore, they encounter a shared problem: how can autonomy be possible in a society where other (...) individuals hold some kind of authority? I propose that each thinker resolves this tension through an insight with a Kantian echo. A suitably qualified version of authority can sometimes count as an expression of, rather than hindrance to, autonomy. I describe the overlap in Emerson and Smith as a “frontier” version of Kantianism. They favor determining one's own beliefs and actions in a way that looks forward to an open future of possibility. FINS:First, let me thank you and the Pellegrino Center for the honor of giving the John Harvey Collins Lecture in such an interactive manner. The forefront of neurological care—and the neuroethical issues and methods focal to such practice—wasn’t what I initially intended to do professionally, but I think that therein is a good lesson for young people’s career aspirations. Simply put, one doesn’t always know where they’ll end up at the beginning of the journey, and as Kierkegaard said, life is lived forward, but is understood backwards (Kierkegaard 1843).In the nineties and the early 2000s, I was trying to help improve the quality of care of people at the end of life, and I wrote a book, entitled The Palliative Ethic of Care: Clinical Wisdom at Life’s End (Fins 2006), in which I addressed notions of phronesis—practical wisdom—in integrating theory and practice toward improving how people die. I became interested in the Quinlan case (Quinlan 1976), and the right to die, and around the same time, I ran into a colleague of mine at Cornell: Dr. Nicholas D. Schiff. Dr. Schiff is a neurologist, who was a protégé of Fred Plum, who was the originator of the concept of the vegetative state with Bryan Jennett, back in 1972. Fred was both of our teachers here at Cornell. Niko (Dr. Schiff) was interested in patients with disorders of consciousness, and was beginning to envision doing work—that ultimately, we did—using deep brain stimulation (DBS) to try to treat patients in the minimally conscious state, a category that was subsequently codified in 2002.I realized that a whole population of people—with these disorders of consciousness—had been somewhat marginalized, and their neglect essentially devolves back to the considerations of the right to die. The right to die was established in the Quinlan case because Judge Hughes—the presiding chief judge of the New Jersey Supreme Court—talked about Ms. Quinlan’s loss of a cognitive, sapient state as being the moral warrant for her right to die, given the fact that it was viewed as a futile situation. I recognized, over the ensuing years—from my background in palliative and end-of-life care—[1] that we had over-generalized notions of futility... (shrink)

In lieu of an abstract, here is a brief excerpt of the content:TRUE INTERPRETATIONS by Stephen Davies Could conflicting interpretations of a literary work be equally true? Bodi Monroe C. Beardsley and Joseph Margolis assumed fhis to be impossible in their famous debate about the relationship between the multiplicity of interpretations of literary works and the assessment of such interpretations for truth.1 The assumption was implicit in the first premise of the following argument. Although they disagreed about the argument's (...) soundness, they did agree about the truth of this premise. The argument goes like this: (1)No work of literature can be interpreted truly both as p and not-p (nor as both p and q where p and q are contraries). (2)Many a work of literature admits of equally plausible/convincing/ revealing but contradictory or contrary interpretations; so (3)Interpretations of works of literature cannot be assessed for truth (nor can they be assessed for falsity). This argument is an important one for, ifit is accepted, it entails that literary criticism and analysis are not deductively based. The use of deduction in practical (as opposed merely to formal) reasoning is possible only where the premises and conclusion might be assessed for truth. Margolis accepts the soundness of this argument, but Beardsley does not. Both accept that the premises of the argument are true. Because Beardsley believes that the conclusion is false, he believes that the argument must be invalid. (Beardsley thinks that the appropriate con290 Stephen Davies291 elusion to draw is that sometimes we cannot discover which of several conflicting interpretations is the true and correct reading.) Margolis believes that the argument is valid and, hence, that the conclusion is proved. The disagreement between them centers on the role of the second premise in generating the conclusion. Beardsley argues that the only test for "plausibility" or "convincingness " or "revealingness" is truth. How could an interpretation be plausible except by being plausibly true? On the (inadequate) evidence available, two interpretations might be equally plausible, but that is to say that, on the given evidence, their truth is equally probable. This means only that there is no way of settling which of them is true and that, under the condition of ignorance which obtains, we are in no position to judge which of them is true. It does not show that interpretations cannot be assessed for truth, although it does show that the matter of their truth might not be satisfactorily determinable. So, according to Beardsley, the conclusion does not follow from the premises: "I hold that all of the literary interpretations that deserve the name obey [the principle of 'the Intolerability of Incompatibles']. But of course I do not wish to deny that there are cases of ambiguity where no interpretation can be established over its rivals; nor do I wish to deny that there are many cases where we cannot be sure that we have the correct interpretation." 2 Margolis's reply might be developed as follows: where two interpretations are equally consistent with the text, it would make sense to claim that one of them is true and the other false only if there might be some further evidence, as yet unconsidered, which could settle the matter. But, in the case ofmany conflicting and equally plausible interpretations of literary works, all the evidence that there could be is in; there is no further (hidden) evidence to be appealed to. So there is no truth ofthe matter. The judgment that the interpretations are equally plausible is not equivalent to a decision to suspendjudgment for the lack ofdecisive evidence, but, rather, a recognition that all the relevant evidence underdetermines questions of truth. Thus, there can be no right, no true, interpretation and, accordingly, in being tested for revealingness or whatever, interpretations are not being tested for truth.
