In this essay, I want to provide an introduction to Aristotle's theory of the Greek Tragedy, which he outlines in his book, the Poetics . Many philosophers since Aristotle, including Friedrich Nietzsche and Walter Benjamin, have analysed tragic art and developed their own theories of how it works and what it is for. What makes Aristotle's theory interesting is that it is as relevant to art today as it was in Ancient Greece because it explains the features of not just (...) tragic art, but of the films and stories that we enjoy today. I will explain the features that Aristotle says make a good tragic play and give examples of them from popular culture. The examples I give will be from tragedy, but also from romance, crime and fantasy to demonstrate how he has outlined, not just the features of Greek Tragedy, but also the internal workings of the drama that we enjoy today. The contemporary relevance of Aristotle's theory is in the fact that the features he outlines are basic features of great stories, which I think is best illustrated by applying Aristotle's analysis to popular Hollywood movies. BackgroundClinical ethics consultations can be complex interventions, involving multiple methods, stakeholders, and competing ethical values. Despite longstanding calls for rigorous evaluation in the field, progress has been limited. The Medical Research Council proposed guidelines for evaluating the effectiveness of complex interventions. The evaluation of CEC may benefit from application of the MRC framework to advance the transparency and methodological rigor of this field. A first step is to understand the outcomes measured in evaluations of CEC in healthcare settings. ObjectiveThe primary (...) objective of this review was to identify and map the outcomes reported in primary studies of CEC. The secondary objective was to provide a comprehensive overview of CEC structures, processes, and roles to enhance understanding and to inform standardization.MethodsWe searched electronic databases to identify primary studies of CEC involving patients, substitute decision-makers and/or family members, clinicians, healthcare staff and leaders. Outcomes were mapped across five conceptual domains as identified a priori based on our clinical ethics experience and preliminary literature searches and revised based on our emerging interpretation of the data. These domains included personal factors, process factors, clinical factors, quality, and resource factors. ResultsForty-eight studies were included in the review. Studies were highly heterogeneous and varied considerably regarding format and process of ethical intervention, credentials of interventionist, population of study, outcomes reported, and measures employed. In addition, few studies used validated measurement tools. The top three outcome domains that studies reported on were quality, process factors, and clinical factors. The majority of studies examined multiple outcome domains. All five outcome domains were multidimensional and included a variety of subthemes.ConclusionsThis scoping review represents the initial phase of mapping the outcomes reported in primary studies of CEC and identifying gaps in the evidence. The confirmed lack of standardization represents a hindrance to the provision of high quality intervention and CEC scientific progress. Insights gained can inform the development of a core outcome set to standardize outcome measures in CEC evaluation research and enable scientifically rigorous efficacy trials of CEC. (shrink)

I. EXECUTIVE SUMMARY The MRCT Center Post-trial Responsibilities: Continued Access to an Investigational Medicine Framework outlines a case-based, principled, stakeholder approach to evaluate and guide ethical responsibilities to provide continued access to an investigational medicine at the conclusion of a patient’s participation in a clinical trial. The Post-trial Responsibilities (PTR) Framework includes this Guidance Document as well as the accompanying Toolkit. A 41-member international multi-stakeholder Workgroup convened by the Multi-Regional Clinical Trials Center of Brigham and Women’s Hospital and Harvard University (...) (MRCT Center) developed this Guidance and Toolkit. Project Motivation A number of international organizations have discussed the responsibilities stakeholders have to provide continued access to investigational medicines. The World Medical Association, for example, addressed post-trial access to medicines in Paragraph 34 of the Declaration of Helsinki (WMA, 2013): “In advance of a clinical trial, sponsors, researchers and host country governments should make provisions for post-trial access for all participants who still need an intervention identified as beneficial in the trial. This information must also be disclosed to participants during the informed consent process.” This paragraph and other international guidance documents converge on several consensus points: • Post-trial access (hereafter referred to as “continued access” in this Framework [for terminology clarification – see definitions]) is the responsibility of sponsors, researchers, and host country governments; • The plan for continued access should be determined before the trial begins, and before any individual gives their informed consent; • The protocol should delineate continued access plans; and • The plan should be transparent to potential participants and explained during the informed consent process. -/- However, there is no guidance on how to fulfill these responsibilities (i.e., linking specific responsibilities with specific stakeholders, conditions, and duration). To fill this gap, the MRCT Center convened a working group in September of 2014 to develop a framework to guide stakeholders with identified responsibilities. This resultant Framework sets forth applicable principles, approaches, recommendations and ethical rationales for PTR regarding continued access to investigational medicines for research participants. According to Paul (Transformative experience, 1st edn, Oxford University Press, 2014), transformative experiences pose a challenge to decision theory since their value cannot be anticipated. Building on Pettigrew’s (in: Lambert, Schwenkler (eds) Becoming someone new: essays on transformative experience, choice, and change, Oxford University Press, pp 100–121, 2020) redescription, this paper presents a new approach to how and when transformative decisions can nevertheless be made rationally. Thanks to fundamental higher-order facts that apply to any kind of experience, an agent always (...) at least knows the general shape of the utility space. This in combination with the knowledge about the non-transformative alternative in the choice set can enable rational decision-making despite the presence of a transformative experience. For example, this paper’s approach provides novel arguments for why gender transition (cf. McKinnon in Res Philosophica 92(2):419–440, 2015) or staying childfree (cf. Barnes in Philos Phenomenol Res 91(3):775–786, 2015) can be rational. (shrink)

Mark Schroeder has recently proposed a new analysis of knowledge. I examine that analysis and show that it fails. More specifically, I show that it faces a problem all too familiar from the post-Gettier literature, namely, that it is delivers the wrong verdict in fake barn cases.

The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics (...) consultants, and futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. Futility disputes are increasing and courts are slowly abandoning their historical reluctance to engage these contentious issues, particularly when confronted with inappropriate surrogate demands for aggressive treatment. Use of the judicial system to resolve futility disputes inevitably brings media attention and requires clinicians, hospitals, and families to debate these deep moral conflicts in the public eye. A recent case in Minnesota, In re Emergency Guardianship of Albert Barnes, explores this emerging trend and the complex responsibilities of clinicians and hospital (...) administrators seeking to replace an unfaithful surrogate demanding aggressive therapy. Use of the courts requires the coordinated commitment of significant institutional resources, management of intense media scrutiny and individual and organizational courage to enter the unpredictable world of litigation. Given the dearth of legislative guidance on medical futility, individual clinicians and institutions will continue to bear the difficult responsibility for resolution of individual futility disputes. The Barnes case illustrates how one institution successfully used the judicial system to replace an unfaithful surrogate, cease the provision of inappropriate aggressive care, and stimulate a community dialogue about appropriate care at the end of life. At the point at which Strife holds complete sway the four elements are completely separated and all life is destroyed; at the point at which Love is completely dominant there is also a destruction of the biological world, this time because the elements are blended into a perfectly homogeneous (...) mixture. This interpretation of the cosmic cycle, which has prevailed almost since it was developed by Friedrich Panzerbieter and seconded by authority of Eduard Zeller was challenged by Paul Tannery and then by H. von Arnim . Long after these essentially programmatic critiques, three independent studies published in 1965 by Jean Bollack, Uvo Hölscher and Friedrich Solmsen mounted a vigorous challenge to the received view. However, in a detailed monograph devoted to Empedocles' cosmic cycle, Denis O'Brien brought to bear an impressive array of scholarly evidence and critical acumen in support of the traditional view . Several challenges to the traditional view have appeared since O'Brien's book, of which the most significant is that of A. A. Long, who, while criticizing attempts of some opponents of the traditional view, produced some novel and interesting arguments against it. Although the traditional view continues to enjoy the support of authorities such as Jonathan Barnes and M. R. Wright, there is a decided shift in favour of revisionary views. Nevertheless recent advocates of a revisionary interpretation do not provide detailed refutations of the traditional view; Long's arguments remain the strongest objections to the traditional view, and they have never been refuted. In lieu of an abstract, here is a brief excerpt of the content:Book Reviews Catherine Osborne. Rethinking Early Greek Philosophy: Hippolytus of Rome and the Presocratics. London: Duckworth, 1987. Pp. viii + 383. NP. A quick look at Kirk, Raven, and Schofield's standard The PresocraticPhilosophers(Cambridge University Press, 1983) or Barnes's recent Early GreekPhilosophy (Penguin, 1987) reveals a clear distinction between (a) direct quotations (ipsissima verba) of the Presocratics and (b) testimonia (doxographic or otherwise) about their thought. This bifurcation into (...) original fragments and testimonia is called into question by Osborne in her book. For Osborne, the standard procedure of identifying fragments within a larger context and then interpreting the fragments without reference to that context is to be put aside "in favour of reading the text of the Presocratics as embedded texts within the context of the interpretations they were selected to illustrate" (183). This new methodology is not offered by Osborne as applicable across the board, for all the Presocratics. It is a nonstarter for, say, Parmenides, for whom we have (obvious) verbatim quotation in Simplicius (and consequently no need to take into account the Simplician context). But in the case of some other Presocratics we are not on such secure grounds. Or so Osborne thinks, and the book illustrates her hermeneutical principles with reference to Heraclitus and Empedocles as their thought is embedded in the text of Hippolytus of Rome's Refutation of All Heresies. Osborne's strategy proceeds in two distinct stages: (1) She first offers us a couple of examples of Hippolytus's interpretive skills, both of which, in different ways, reveal him as a pretty reliable (if biased) and interesting philosophical and textual exegete. In this regard she presents Hippolytus's discussion of Aristotle's doctrine of substance in the Categoriesand Metaphysics Z (in the context of Hippolytus's refutation of the heretic Basileides) and, secondly, his reworking of Irenaeus's life of Simon Magus, the reputed founder of gnosticism. Aristotle is a particularly good test case because we can, of course, check Hippolytus's report against the original. Having done so, Osborne is led to conclude that "little of interest can be derived from the limited amount of material that is quoted directly from Aristotle" (183; cf. also 66). Nonetheless, for Osborne comparison with Aristotle's text reveals Hippolytus as not bereft of philosophical acumen, even though his interpretation is colored by the particular polemics in which he is engaged. In sum, then, Osborne understands Hippolytus as an intelligent (if biased) interpreter of Aristotle and not a particularly good source for ipsissimaverba. (2) On the basis of these conclusions about Hippolytus as a source for Aristotle's metaphysical theory and for the life of Simon Magus, Osborne turns to Hippolytus's discussion of Heraclitus and Empedocles (in the context of his refutations of the [ll9] 120 JOURNAL OF THE HISTORY OF PHILOSOPHY 28"1 JANUARY ~99 o heretics Noetus and Marcion). Her goal is to urge a new nonfragment-based methodology for the study of the Presocratics, grounded in the conclusions she has just reached about Hippolytus as an interpreter of Aristotle and Irenaeus. The major obstacle which she faces in validating such a methodology is that in the cases of Heraclitus and Empedocles we have no original text by which to judge Hippolytus's reliability or interpretive skills. In lieu of such original texts all that Osborne has at her disposal is her own conclusion just reached about Hippolytus as a generally reliable (if biased) interpreter of Aristotle and Irenaeus. But just here is the major problem with Osborne 's proposed methodology: granting for the sake of argument that Hippolytus is a pretty good interpreter of Aristotle and Irenaeus, this does not entail that he is a reliable exegete of anyone else. He might be, he might not. We don't know and, more importantly, we have no way of finding out. Osborne assumes that Hippolytus had a greater knowledge of the relevant texts than we do (67, 185), and thus interpreted the Presocratics on this basis. He might have, he might not. In any event, Osborne's assumption is a case of special pleading. Equally plausible is that Hippolytus possessed no more of Heraclitus or Empedocles than we do and, consequendy, had... (shrink)

The overlap and differences between the parallel regulatory systems for research create ample room for confusion and missteps, as discussed by Barbara Bierer and Mark Barnes in their report in this supplement. In practice, beyond the inherent differences in the two systems of regulations themselves, there are many issues that further complicate the application of these regulations. These include the variation in size of the institutions receiving PHS funding, the increased prevalence of multisite research, the allocation of research conduct (...) and oversight to external organizations, and the variability in assignment of human subject protection roles between the IRB and the institution. Disability is primarily a social phenomenon -- a way of being a minority, a way of facing social oppression, but not a way of being inherently or intrinsically worse off. This is how disability is understood in the Disability Rights and Disability Pride movements; but there is a massive disconnect with the way disability is typically viewed within analytic philosophy. The idea that disability is not inherently bad or sub-optimal is one that many philosophers treat with open skepticism, and sometimes (...) even with scorn. The goal of this book is to articulate and defend a version of the view of disability that is common in the Disability Rights movement. Social constructionism is often considered a form of anti-realism. But in contemporary feminist philosophy, an increasing number of philosophers defend views that are well-described as both realist and social constructionist. In this paper, I use the work of Sally Haslanger as an example of realist social constructionism. I argue: that Haslanger is best interpreted as defending metaphysical realism about social structures; that this type of metaphysical realism about the social world presents challenges to some popular ways of understanding metaphysical realism.

It is common to hear talk of the aim of belief and to find philosophers appealing to that aim for numerous explanatory purposes. What belief 's aim explains depends, of course, on what that aim is. Many hold that it is somehow related to truth, but there are various ways in which one might specify belief 's aim using the notion of truth. In this article, by considering whether they can account for belief 's standard of correctness and the epistemic (...) norms governing belief, I argue against certain prominent specifications of belief 's aim given in terms of truth, and advance a neglected alternative. This essay considers the reliability and proper role of authorial intention in the interpretation of figurative language and argues that, even in cases of metaphor and irony, the meaning of a text must remain logically independent of the intent of its historical author. Irony and metaphor have been broadly considered to be the most problematic cases for the anti-intentionalist approach to interpretation. The arguments in this essay address standard intentionalist arguments and, in the end, defend a sort of hypothetical intentionalism (...) that is, in all significant respects, anti-intentionalist. William Barnes' reputation as one of the pre-eminent British "dialect" poets, the equal of Robert Burns and John Clare, is being increasingly recognized. The range of his writings is extraordinary as evidenced by the contents of this collection, which includes works on etymology, philology, topography, mathematics, ancient history and economics. This collection displays the full diversity of Barnes' considerable intellect. Aristotle is one of the very greatest thinkers in the Western tradition, but also one of the most difficult. The contributors to this volume do not attempt to disguise the nature of that difficulty, but at the same time they offer a clear exposition of the central philosophical concerns in his work. Approaches and methods vary and the volume editor has not imposed any single interpretation, but has rather allowed legitimate differences of interpretation to stand. An introductory chapter provides an (...) account of Aristotle's life, and then guides the reader through the complex subject of what Aristotle actually wrote as a basis for characterising his philosophical development. When are we obligated to believe someone? To what extent are people authorities about their own experiences? What kind of harm might we enact when we doubt? Questions like these lie at the heart of many debates in social and feminist epistemology, and they’re the driving issue behind a key conceptual framework in these debates—gaslighting. But while the concept of gaslighting has provided fruitful insight, it's also proven somewhat difficult to adjudicate, and seems prone to over-application. In what follows, I (...) argue that Katherine Hawley's theory of trust can provide a useful alternative lens for looking at contested testimony. To do this, I focus on a particularly complex—but increasingly popular—application of gaslighting: the physician/patient relationship, and the idea of ‘medical gaslighting’. I argue that, even though patients can experience harm when they are disbelieved, there are nevertheless good reasons for physicians not to trust patients about at least some of their own narratives. Here I look to some work in the historical sciences in order to draw out some of the epistemic benefits of “speculative narratives,” which bears on some more general epistemic benefits of speculative reasoning. Due to the contingent nature of much historical evidence, some degree of speculative reasoning is necessary to get the epistemological ball rolling in the historical sciences, and I argue that speculative narratives provide the necessary sort of frameworking apparatus for doing precisely this. Sometimes, learning about the origins of a belief can make it irrational to continue to hold that belief—a phenomenon we call ‘genealogical defeat’. According to explanationist accounts, genealogical defeat occurs when one learns that there is no appropriate explanatory connection between one’s belief and the truth. Flatfooted versions of explanationism have been widely and rightly rejected on the grounds that they would disallow beliefs about the future and other inductively-formed beliefs. After motivating the need for some explanationist account, we raise (...) some problems for recent versions of explanationism.
