This Handbook fills a large gap in current scholarly literature on animal abuse studies. It moves considerably beyond the debate that has traditionally dominated the discourse of animal abuse – the link between one-on-one interpersonal violence and animal abuse – and towards those institutionalised forms of animal abuse which are routine, everyday, socially acceptable and invisibilised. Chapters from expert contributors raise issues such as: the use of animals as edibles; vivisection; animal sexual assault; animals used in sport and hunting; animal (...) trafficking; the use of animals by youth gangs, by other groups and in war; species extinction; and the passivity of national and international organisations in combating animal abuse. The idea that plants have minds can sound improbable, but some widely respected contemporary scientists and philosophers find it plausible. It turns out to be rather tricky to vindicate the presumption that plants do not have minds, for doing so requires getting clear about what plants can do and what exactly a mind is. By connecting the most compelling empirical work on plant behavior with philosophical reflection on the concept of minds, _Plant Minds _aims to help non-experts begin to think (...) clearly about whether plants have minds. Relying on current consensus ideas about minds and plants, Chauncey Maher first presents the best case for thinking that plants do _not_ have minds. Along the way, however, he unearths an idea at the root of that case, the idea that having a mind requires the capacity to represent the world. In the last chapter, he defends a relatively new and insightful theory of mind that rejects that assumption, making room for the possibility that plants do have minds, primarily because they are alive. This study aims to use the Asian knowledge model “APO” as a determinant for performance excellence in universities and identifying the most effecting factors on it. This study was applied on Al-Azhar University in Gaza strip. The result of the study showed that (APO) model is valid as a measure and there are four dimensions in the model affecting significantly more than the others (university processes, KM leadership, personnel, KM outputs). Furthermore, performance excellence produced though modernizing the means of education, (...) curriculum development, technology and flexibility in the organizational structure. The study recommends expanding the usage of (APO) model, enhancing the role of knowledge leadership, technology, organizational flexibility, sharing culture and incentive systems that encouraging innovation. First published in Spanish in 2006, _Twenty Theses on Politics_ is a major statement on political philosophy from Enrique Dussel, one of Latin America’s—and the world’s—most important philosophers, and a founder of the philosophy of liberation. Synthesizing a half-century of his pioneering work in moral and political philosophy, Dussel presents a succinct rationale for the development of political alternatives to the exclusionary, exploitative institutions of neoliberal globalization. In twenty short, provocative theses he lays out the foundational elements for a politics (...) of just and sustainable coexistence. Dussel first constructs a theory of political power and its institutionalization, taking on topics such as the purpose of politics and the fetishization of power. He insists that political projects must criticize or reject as unsustainable all political systems, actions, and institutions whose negative effects are suffered by oppressed or excluded victims. Turning to the deconstruction or transformation of political power, he explains the political principles of liberation and addresses matters such as reform and revolution. _Twenty Theses on Politics_ is inspired by recent political transformations in Latin America. As Dussel writes in Thesis 15, regarding the liberation praxis of social and political movements, “The winds that arrive from the South—from Nestor Kirchner, Tabaré Vásquez, Luiz Inácio Lula da Silva, Evo Morales, Hugo Chávez, Fidel Castro, and so many others—show us that things can be changed. The _people _must reclaim sovereignty!” Throughout the twenty theses Dussel engages with Latin American thinkers and activists and with radical political projects such as the World Social Forum. He is also in dialogue with the ideas of Marx, Hegel, Habermas, Rawls, and Negri, offering insights into the applications and limits of their thinking in light of recent Latin American political thought and practice. In the 1960s, newborn screening programs tested for a single very rare but serious disorder. In recent years, thanks to the development of new screening technology, they have expanded into panels of tests; a federally sponsored expert group has recommended that states test for twenty-nine core disorders and twenty-five secondary disorders. By the standards used to decide whether to introduce new preventive health services into clinical use, the decision-making in newborn screening policy has been lax.

Americans have recently had thrust into their faces multiple media borne medical and social ethics dilemmas ranging from Dr. Kevorkian's euthanizing a patient on national television to payments by managed care providers for experimental medical treatments,to the nationally telecast situation which this paper will attempt to address. The case at hand concerns a minor in need of a repeat(third) kidney transplant who has been offered a kidney by her father. He also provided a kidney for her second kidney transplant some (...) years ago. The teenage girl went into her current kidney failure/organ rejection state because, feeling well, she stopped taking her antirejection medications. Her father appears to understand the consequences of this offer and is willing nonetheless to donate his remaining kidney to his daughter. His ex-wife and daughter want the kidney and will take it knowing what it will do to him. Of additional interest is that he is incarcerated as a prisoner for a crime for which he will be eligible for parole in the not distant future. This means that although altruistically self-induced, the State will become financially responsible for his medical care and dialysis treatments. This paper will attempt to analyze the competing issues presented by this dilemma and address the underlying conflict between the parameters patient autonomy, parental beneficence and the deontologically based responsibilities of the state and of the health care team. Anticolonial theorists and revolutionaries have long turned to dialectical thought as a central weapon in their fight against oppressive structures and conditions. This relationship was never easy, however, as anticolonial thinkers have resisted the historical determinism, teleology, Eurocentrism, and singular emphasis that some Marxisms place on class identity at the expense of race, nation, and popular identity. In recent decades, the conflict between dialectics and postcolonial theory has only deepened. In _Decolonizing Dialectics _George Ciccariello-Maher breaks this impasse by bringing (...) the work of Georges Sorel, Frantz Fanon, and Enrique Dussel together with contemporary Venezuelan politics to formulate a dialectics suited to the struggle against the legacies of colonialism and slavery. This is a decolonized dialectics premised on constant struggle in which progress must be fought for and where the struggles of the wretched of the earth themselves provide the only guarantee of historical motion. In _Representation in Cognitive Science_, Nicholas Shea offers a theory of representation, of what it is for something to be a representation or have intentionality. Some things have intentionality derivatively. They have it in virtue of something else that has it. Not all intentionality can be like this. Some items must have original intentionality. That is what Shea offers a theory of. Near the end of the book, he makes a provocative suggestion about plants: if his theory is correct, then (...) some of their parts have original intentionality. That is provocative for at least two reasons. First, many theorists think that every cognitive system has original intentionality; since plants don’t have it, they’re not cognitive systems. However, if plants do have it, that argument fails. It can’t be used to show that plants aren’t cognitive systems. Second, and separately, many theorists think that any system with original intentionality is also a cognitive system. On that assumption, if plants turn out to have original intentionality, then they positively are cognitive systems. While Shea makes this suggestion with these provocative implications, he does not adequately develop it. Doing so is my goal in this essay, focusing on the foraging of parasitic vines. (shrink)

This article approaches contemporary European debates on the subject of realism through the lenses offered by two decolonial thinkers: Fanon and Dussel. Whereas both share with realism a fundamental emphasis on reality as the starting point for theory – an assumption shared by much decolonial thought – they nevertheless provide another layer of specificity in their consideration of the colonial condition, diagnosing a fundamental absence of reciprocity that dictates the course of decolonization as a transformation of reality. Reconsidering the debates (...) on realism in light of these insights therefore provides a powerful basis for both formulating a specifically decolonial realism and for engaging in comparative political theorizing more generally. Testimony is an invaluable source of knowledge. We rely on the reports of those around us for everything from the ingredients in our food and medicine to the identity of our family members. Recent years have seen an explosion of interest in the epistemology of testimony. Despite the multitude of views offered, a single thesis is nearly universally accepted: testimonial knowledge is acquired through the process of transmission from speaker to hearer. In this book, Jennifer Lackey shows that this (...) thesis is false and, hence, that the literature on testimony has been shaped at its core by a view that is fundamentally misguided. She then defends a detailed alternative to this conception of testimony: whereas the views currently dominant focus on the epistemic status of what speakers believe, Lackey advances a theory that instead centers on what speakers say. The upshot is that, strictly speaking, we do not learn from one another's beliefs - we learn from one another's words. Once this shift in focus is in place, Lackey goes on to argue that, though positive reasons are necessary for testimonial knowledge, testimony itself is an irreducible epistemic source. This leads to the development of a theory that gives proper credence to testimony's epistemologically dual nature: both the speaker and the hearer must make a positive epistemic contribution to testimonial knowledge. The resulting view not only reveals that testimony has the capacity to generate knowledge, but it also gives appropriate weight to our nature as both socially indebted and individually rational creatures. The approach found in this book will, then, represent a radical departure from the views currently dominating the epistemology of testimony, and thus is intended to reshape our understanding of the deep and ubiquitous reliance we have on the testimony of those around us. How, in a secular world, should we resolve ethically controversial and troubling issues relating to health care? Should we, as some argue, make a clean sweep, getting rid of the Hippocratic ethic, such vestiges of it as remain? Jennifer Jackson seeks to answer these significant questions, establishing new foundations for a traditional and secular ethic which would not require a radical and problematic overhaul of the old. This article sets out from an analysis of the pioneering work of Susan Buck-Morss to rethink, not only Hegel and Haiti, but broader questions surrounding dialectics and the universal brought to light by the Haitian Revolution. Reading through the lens of C.L.R. James’ The Black Jacobins , I seek to correct a series of ironic silences in her account, re-centering the importance of Toussaint’s successor, Jean-Jacques Dessalines, and underlining the dialectical importance of identitarian struggles in forging the universal. Finally, I (...) offer Frantz Fanon’s reformulation of the Hegelian master-slave dialectic—overlooked in Buck-Morss’ account—as a corrective that allows us to truly rethink progress toward the universal in decolonized dialectical terms. As the range of conditions for which we can test prenatally expands, society and the medical profession need to develop guidelines about which tests ought to be offered and which ought not to be. Notions of fetal privacy and confidentiality can help to define limits to what parents may reasonably learn about their future child.

This paper approaches the importance of the colonial difference through a discussion of the debate between Sartre and Foucault on the proper role of the intellectual. The existentialist emphasis on the situation—and the concomitant imperative for intellectual totalization—would lead Sartre to a more sophisticated and radical understanding of his own situation as a European intellectual. This development was largely driven by Fanon, who would push Sartre’s understanding of the gaze toward recognizing the centrality of decolonization, and thereby of an alter-humanism (...) which envisions itself as resolving the aporias of the European intellectual. The Common Rule governs research on human subjects and attempts to balance respect for individual decision-making with efficiency when research risks are low. The regulations allow research to be conducted without consent if the data or biospecimens collected in a study are deidentified, and consent can be waived for identifiable data and biospecimens if the risks of the research are minimal and consent is deemed impracticable. These approaches have been widely used for research using clinical databases and residual clinical and (...) research biospecimens, and they have proven remarkably successful over the past twenty-five years, if success is measured by a lack of adverse events.But the landscape is changing. Typically, the parents claim that they were inadequately warned of a potential problem in their child, and that this paucity (...) of timely information prevented them from avoiding the pregnancy or from obtaining an abortion. While these cases have arisen in a variety of clinical circumstances, a characteristic example is the obstetrician who fails to offer amniocentesis to a woman of advanced maternal age who subsequently gives birth to a child with Down syndrome. Since the parents were prevented from learning of the abnormality and therefore exercising the option to terminate the pregnancy, they may claim damages for themselves for the wrongful birth of the infant. Decision-Making Capacity First published Tue Jan 15, 2008; substantive revision Fri Aug 14, 2020 In many Western jurisdictions the law presumes that adult persons, and sometimes children that meet certain criteria, are capable of making their own medical decisions; for example, consenting to a particular medical treatment, or consenting to participate in a research trial. But what exactly does it mean to say that a subject has or lacks the requisite capacity to decide? This question has to do with what (...) is commonly called “decisional capacity”, a central concept in health care law and ethics, and increasingly an independent topic of philosophical inquiry. -/- Decisional capacity can be defined as the ability of subjects to make their own medical decisions. Somewhat similar questions of capacity arise in other contexts, such as capacity to stand trial in a court of law and the ability to make decisions that relate to personal care and finances. However, the history behind the more general legal notions of capacity to stand trial and capacity to manage one’s life is different and operates somewhat differently in law (Roth, Meisel, & Litz 1977; Zapf & Roesch 2005). For the purposes of this discussion the notion of decisional capacity will be limited to medical contexts only; most notably, those where decisions to consent or to refuse treatment or participation in clinical research are concerned. In this essay, we draw on John Haugeland’s work in order to argue that Burge is wrong to think that exercises of perceptual constancy mechanisms suffice for perceptual representation. Although Haugeland did not live to read or respond to Burge’s Origins of Objectivity, we think that his work contains resources that can be developed into a critique of the very foundation of Burge’s approach. Specifically, we identify two related problems for Burge. First, if (what Burge calls) mere sensory responses are (...) not representational, then neither are exercises of constancy mechanisms, since the differences between them do not suffice to imply that one is representational and the other is not. Second, taken by themselves, exercises of constancy mechanisms are only derivatively representational, so merely understanding how they work is not sufficient for understanding what is required for something, in itself, to be representational (and thereby provide a full solution to the problem of perceptual representation).
