This article examines the relationship between online dispute resolution (ODR) and trust. We discuss what trust is, why trust is important, and how trust develops. Our claim is that efforts to implement online dispute resolution on a site or service in a manner that promotes trust need to consider ODR as just one tool in a broader toolbox of trust-building tools and techniques. These techniques are amongst others marketing, education, trust seals, and transparency. By evaluating ODR in its proper context (...) as one component of a larger trust strategy, we can more accurately set expectations for its results and position our projects for success. (shrink)

This study examines the situated use of rules and the social practices people deploy to correct projectable rule violations in pétanque playing activities. Drawing on Ethnomethodology and Conversation Analysis, and using naturally occurring video recordings, this article investigates socially organized occasions of rule use, and more particularly how rules for turn-taking at play are reflexively established in and through interaction. The alternation of players in pétanque is dependent on and consequential for the progressivity of the game and it (...) is a practical problem for the players when a participant projects to break a rule of “who plays next”. The empirical analysis shows that formulating rules is a practice for indicating and correcting incipient violations of who plays next, which retrospectively invoke and establish the situated expectations that constitute the game as that particular game. Focusing on the anticipative corrections of projectable violations of turn-taking rules, this study revisits the concept of rules, as they are played into being, from a social and interactional perspective. We argue and demonstrate that rules are not prescriptions of game conduct, but resources that reflexively render the players’ conducts intelligible as playing the game they are engaging in. (shrink)

Is it a paradigm case of the strong constitutionalism concept of the rule of law or has it fallen short of its rule of law ambitions? -/- This open access book traces the promise and paradox of the American rule of law in three interwoven ways. -/- It focuses on explicating the ideals of the American rule of law by asking: how do we interpret its history and the goals of its constitutional framers (...) to see the rule of law ambitions its foundational institutions express? -/- It considers those constitutional institutions as inextricable from the problem of race in the United States and the tensions between the rule of law as a protector of property rights and the rule of law as a restrictor on arbitrary power and a guarantor of legal equality. In that context, it explores the distinctive role of Black liberation movements in developing the American rule of law. -/- Finally, it considers the extent to which the American rule of law is compromised at its frontiers, and the extent that those compromises undermine legal protections Americans enjoy in the interior. Born’s quantum probability rule is traditionally included among the quantum postulates as being given by the squared amplitude projection of a measured state over a prepared state, or else as a trace formula for density operators. Both Gleason’s theorem and Busch’s theorem derive the quantum probability rule starting from very general assumptions about probability measures. Remarkably, Gleason’s theorem holds only under the physically unsound restriction that the dimension of the underlying Hilbert space \ must be larger than two. Busch’s (...) theorem lifted this restriction, thereby including qubits in its domain of validity. However, while Gleason assumed that observables are given by complete sets of orthogonal projectors, Busch made the mathematically stronger assumption that observables are given by positive operator-valued measures. The theorem we present here applies, similarly to the quantum postulate, without restricting the dimension of \ and for observables given by complete sets of orthogonal projectors. We also show that the Born rule applies beyond the quantum domain, thereby exhibiting the common root shared by some quantum and classical phenomena. (shrink)

We analyse the projected future evolution of the distribution of voting power and related quantities under the qualified majority decision rule for the Council of Ministers of the EU, prescribed by the forthcoming EU Reform Treaty. Our projections are based on the demographic changes forecast by eurostat [4] for the period stretching from the present to the middle of the 21st Century. We use a method similar to the one we used in [6], [7], [8] and [9].

This article examines ways in which research conducted under the Human Microbiome Project, an effort to establish a “reference catalogue” of the micro-organisms present in the human body and determine how changes in those micro-organisms affect health and disease, raise challenging issues for regulation of human subject research. The article focuses on issues related to subject selection and recruitment, group stigma, and informational risks, and explores whether: (1) the Common Rule or proposed changes to the Rule adequately address these issues (...) and (2) the Common Rule is the most appropriate vehicle to provide regulatory oversight and guidance on these topics. When do you have to sacrifice life and limb, time and money, to prevent harm to others? When must you save more people rather than fewer? These questions might arise in emergencies involving strangers drowning or trapped in burning buildings, but they also arise in our everyday lives, in which we confront opportunities to donate time or money to help distant strangers in need of food, shelter, or medical care. With the resources available, we can provide more help--or less. -/- (...) In The Rules of Rescue, Theron Pummer argues that we are often morally required to engage in effective altruism, directing altruistic efforts in ways that help the most. Even when the personal sacrifice involved makes it morally permissible not to help at all, he contends, it often remains wrong to provide less help rather than more. Using carefully crafted examples, he defends the view that helping distant strangers is more morally akin to rescuing nearby strangers than most of us realize. The ubiquity of opportunities to help distant strangers threatens to make morality extremely demanding, and Pummer argues that it is only thanks to adequate permissions grounded in considerations of cost and autonomy that we may pursue our own plans and projects. He ultimately concludes that many of us are required to provide no less help over our lives than we would have done if we were effective altruists. (shrink)

Moral rules provide the baseline for ethics, proscribing unacceptable behavior; moral ideals inspire us to act in ways that improve the human condition. Whatever the moral ideals for pure research, science has a practical side so it is important to find a moral ideal to give guidance to more applied research. This article presents a moral ideal for use-inspired research based on Norman Care’s idea of shared-fate individualism This ideal reflects the observation that all human lives, both present and (...) future are tightly coupled and, as a result, research projects should be chosen, where possible, with the goal of service to others. Together with the ideals of the habit of truth and the gift economy, shared-fate individualism provides the basis for a humane ethics of science. (shrink)

The aim of this paper is to propose a novel reading of the critical legitimacy of the regulative use of reason in the Transcendental Dialectic of Kant's Critique of Pure Reason. After introducing some key terminology of the Dialectic, I analyse the shortcomings of two influential accounts of the regulative use of reason and identify their common problem in their commitment to the descriptivity of the ideas of reason. I then offer my rule‐based account of the regulative use of reason (...) by clarifying how Kant transforms reason's metaphysical inclinations into prescriptive rules of bottom‐up empirical research. Finally, I explain why such interpretation of reason is metaphysically innocent and thereby a promising approach to understand its role in Kant's scientific project. (shrink)

I spell out the sense in which the rule-following considerations are about meaning determination, and investigate whether the principle of meaning determination used in the early Davidson's account of meaning determination - the principle of charity - provides an answer to what I shall call "Wittgenstein's paradox". More precisely, I am interested in one aspect of the paradox: the "problem of objectivity". My question (...) then is whether meaning, as determined by charity, is such that the correctness of the applications of meaningful expressions is an objective matter. After running us through the basics of the radical interpretation account of meaning determination I argue that the principle of charity does seem to fall prey to the problem of objectivity. After unsuccessfully trying to rescue objectivity by means of Lewisian natural properties, this is the verdict I in the end endorse. (shrink)

The traditional conception of ethical theory sees it as the project of developing a coherent set of rules from which one can infer all determinate moral verdicts. I am not optimistic about the prospects for constructing such a theory. To explain this pessimism, we need to understand what moral rules are and what roles they might play in ethical theory.

I briefly consider why Descartes stopped work on the _Rules_ towards the end of my paper. My main concern is to accurately characterize the project represented in the _Rules_, especially in its relation to early-modern logic.

The present study seeks to accomplish three goals: to shed light on the problem of reason in Husserl’s co-inherited philosophical project, to elucidate his transcendental critique of reason, and to present Husserl's idea of reason in its distinctive features. A historical excursus first provides a frame to understand the necessity of a critique of reason, its proper subject-matter, and its function for the project of genuine philosophy. In particular, this historical reflection identifies the form that a critique must assume in (...) order to fulfil its philosophical-scientific task. The focus is then directed at Husserl's methodological recalibration of the problem of reason. Husserl's ‘prinzipielle Kritik’ is elucidated in his transcendental reassessment of the headings ‘reason’ and ‘unreason,’ and is thought in connection to the concept of Selbstbesinnung. Lastly, Husserl’s idea of reason is reconstructed in relation to, and in disambiguation from, the concepts of self-evidence, logos, synthesis, fulfilment, positing, etc. Reason, as teleological rule and structural form of transcendental subjectivity, is clarified in its dependence on, and irreducibility to, the problems of constitution and in light of the question of its objective/subjective character. Usual derivations of Lilders's projection rule show that Liuders's rule is the rule required by quantum statistics to calculate the final state after an ideal (minimally disturbing) measurement. These derivations are at best inconclusive, however, when it comes to interpreting Liuders's rule as a description of individual state transformations. In this paper, I show a natural way of deriving Liiders's rule from well-motivated and explicit physical assumptions referring to individual systems. This requires, however, the introduction of a concept of (...) individual state which is not standard. (shrink)

Aristotle’s political theory is often dismissed as undemocratic due to his treatment of natural slavery and women and to his conception of political rule as rule by turns. The second reason presents no less serious challenges than the first for finding democracy in Aristotle’s political theory. This article argues that Aristotle’s account of ruling in turns hinges on a critique of master rule and an affirmation of political rule, which involves both the rulers and the ruled in the project of (...) ruling. Legal contracts and litigation documents common to the American legal system were encoded in the eXtensible Markup Language (XML). XML also represents rules about the contracts and litigation procedure. In addition to an expert system tool that allows one to make inferences with that engine, a Graphical User Interface (GUI) generates the XML representing the rules. A rulebase is developed by marking up examples of the XML to be interpreted and the XML to be generated, analogously to Query (...) By Example. This article provides a broader context of the synergy between XML and artificial intelligence by including discussions of: (1) the role of Artificial Intelligence in handling routine litigation; (2) how the use of XML enables legal expert systems to get their `input' without the user having to enter the same information again for the expert system;(3) the advantages of XML markup over other forms of markup for documents; (4) the relationship between XML and ontologies; (5) other projects using XML with rules or legal affairs. The rule-following paradox of Kripke's Wittgenstein posits that there is no fact of the matter about an individual that can determine whether he means one thing or another by a term, such as "+". The paradox thus renders the existence of meaning illusory. The objective of this thesis is to examine the paradox and try to offer a version of a dispositional account that can counteract Kripke's skeptics. ;Gaining insights from previous dispositionalist accounts of meaning and rule-following, including those of (...) Dretske, Fodor, Millikan, Martin & Heil, Shogenji, and Yallowitz, my project is to put all those insights together to formulate a functional view of human dispositions to rule-following which will resolve the error, finitude, and first-person epistemic problems that Kripke raises against the dispositionalist approach. Specifically, I argue that rule-following or meaning consists in one's possessing a disposition, realistically construed. A rule-following disposition is real in the sense that it is responsible for, and hence not to be equated with, its manifestations under various conditions. A person acquires a real disposition to rule-following through a learning history which is constrained by biologically innate human endowments of learning and cognition. The error problem then becomes the problem of how to identify the disposition without vacuity or circularity. My claim is that identifying a rule-following disposition is a task of scientific hypothesizing, which is epistemically and methodologically sound. The finitude problem is in my view a form of Humean inductive skepticism. My response to it is to adopt a reliabilist theory of justification and its treatment of the induction problem. A distinctive contribution of mine is to offer a functionalist account of dispositions and introspection in the resolution of the first-person epistemic problem. My aim is to do full justice to the phenomenology and epistemology of meaning and rule-following from the first-person point of view. ;My conclusion is that a satisfactory dispositional account such as the one I offer not only vindicates the reality of rule-following and meaning but also increases our understanding of the nature of meaning and human rule-following phenomenon. The article presents an attempt to evaluate the influence of the late Wittgenstein philosophy (by the example of the rule-following problem) on sociology and some empirical programs of sociological research. At first we give a brief overview of the rule-following problem and consider, on the one hand, a skeptical reading and a skeptical solution to the problem by S. Kripke and, on the other hand, criticism towards Kripke by some Wittgensteinians). Then we reveal the role of skeptic reading in the (...) sociological works of D. Bloor and the role of anti-sceptic reading in ethnomethodological projects. At the end we show the paramount importance of Peter Winch – we prove the following thesis: the ideas of Peter Winch anticipated many of the points and arguments in the dispute between D. The projection postulate is the source of a long standing controversy in the interpretation of the axiomatic foundations of quantum mechanics. In a sense which is made precise in chapter II the projection postulate is a mathematical theorem easily derivable within the mathematical framework of the theory. This theorem receives a clear and straightforward interpretation if Luders' rule is given only statistical significance. Under the assumption that an interpretation of quantum mechanics has to provide an account of the (...) process of measurement as a change on the state of individual systems, however, additional interpretive assumptions are needed in order to arrive at a satisfactory interpretation of Luders' rule. ;I show in chapter III that there are serious problems with the usual interpretation by making explicit in a quantum logical framework the concept of individual state and minimal disturbance implicit in this view. In chapter IV I show that it is possible to formulate a natural interpretation of Luders' rule as a description of 'dispersion free' state transformations within a semantic framework that takes states of individual systems to be represented by Boolean ultrafilters , as opposed to the usual approach that takes individual states to be represented by lattice ultrafilters. This lay the ground for the clarification of several interpretive issues in the foundations of quantum mechanics. It is shown that Luders' rule can be justified as a description of individual state transformations without the need of imposing additional assumptions. The derivation of Luders' rule within the semantic framework of B-states shows an important connection between interpretation that take individual state to be 'relative' to experimental situations and the statistical structure of the theory. I show that the quantum state ω can be interpreted as defining a probability measure on a subalgebra of the algebra of projection operators that is not fixed (as in classical statistical mechanics) but changes with ω and appropriate boundary conditions, hence with the dynamics of the theory. This subalgebra, while not embeddable into a Boolean algebra, will always admit two-valued homomorphisms, which correspond to the different possible ways in which a set of “determinate” quantities (selected by ω and (...) the boundary conditions) can have values. The probabilities defined by ω (via the Born rule) are probabilities over these two-valued homomorphisms or value assignments. So any universe of interacting systems, including those functioning as measuring instruments, can be modelled quantum mechanically without the projection postulate. (shrink)

The goal of this book is to develop a new approach to reading the rule-following sections guided by a simple idea. The simple idea is that Wittgenstein's remarks on rule-following are split between two distinct but complementary projects. The projects are marked not only by different guiding questions, but different presuppositions and methodologies. There is of course precedent for reading the rule-following remarks as comprising two parts. For example, there is the reading of (S. Kripke 1982) on which Wittgenstein first (...) presents a skeptical challenge before turning to its skeptical solution. And there are readings like (Minar 2011) and (Goldfarb 2012) that likewise treat the sections as roughly divided into two components or "chapters." But even these commentators do not explicitly associate their components with different questions and associated methodologies, and so fall short of attributing to Wittgenstein's text anything quite like the thoroughgoing bipartite structure I will be proposing here. All extensions of the modal Grzegorczyk logic Grz possessing projective Beth's property PB2 are described. It is proved that there are exactly 13 logics over Grz with PB2. All of them are finitely axiomatizable and have the finite model property. It is shown that PB2 is strongly decidable over Grz, i.e. there is an algorithm which, for any finite system Rul of additional axiom schemes and rules of inference, decides if the calculus Grz+Rul has the projective Beth property.

If we consider Wittgenstein's career as a whole, it appears that he wrote more on the philosophy of logic and mathematics than any other subject. Yet his writings on these subjects have exerted little influence. Indeed, the tide of response to Remarks on the Foundations of Mathematics, which contains the bulk of his latest views of mathematics, has been for the most part overwhelmingly negative. Given his later emphasis on the context-bound character of language, mathematics and logic--where language apparently operates (...) in an maximally precise, clear and general way--represent two of the most difficult cases for Wittgenstein to confront. My thesis aims to defend Wittgenstein from the charges of benighted arrogance traditionally levelled against him. I argue that Wittgenstein's later discussions of mathematics form a central part of a larger philosophical project, internally related to Philosophical Investigations and shaping in specific ways Wittgenstein's reaction to both scepticism and accounts of the nature of logical and mathematical truth. I see Wittgenstein criticizing the unreflective use of mathematical tools in philosophy, not offering a competing philosophy of mathematics. ;Too few of Wittgenstein's readers have been willing to offer detailed exegesis of his writing . This has made it difficult to understand how the aphoristic style of his late writing bears on the philosophical problems being discussed. On my view, the quality of Wittgenstein's writing is intrinsic to his later conception of the nature of logic, mathematics and philosophy. Line by line engagement with his texts is thus imperative in order to achieve an understanding of his philosophical objectives and criticisms. My dissertation offers as a paradigm of such reading a detailed exegesis and criticism of the opening five sections of Remarks on the Foundations of Mathematics. ;I briefly explore in some detail the origin and genesis of Wittgenstein's interest in rule-following, from its roots in the Tractatus's conception of logical syntax. This background illuminates Wittgenstein's later conception of logical truth and his criticisms of Frege's and Russell's arguments for logicism. To explore these criticisms, I focus on Wittgenstein' s discussions of the Frege-Russell definition of "Number" in "logical" terms. Placed in their appropriate philosophical and historical context, Wittgenstein's seemingly outrageous remarks about the nature of proof, mathematical logic and the foundations of mathematics do not simply betray his ignorance. Nor do they commit him to a revisionist attitude toward mathematical practice. Rather, they raise fundamental questions about the philosophical presuppositions lying behind attempts to bring particular mathematical results to bear in philosophy. (shrink)

While the many efforts to decolonize or dismantle the vestiges of colonialism that remain are laudable, they can also reinforce what they seek to end. For decolonization to be impactful, it must be done with epistemic and cultural humility, requiring decolonial scholars, project leaders, and well-meaning people to be more sensitive to those impacted by colonization and not regularly included in the discourse. (...) INTRODUCTION Decolonization is complex. To successfully achieve decolonization, projects should incorporate the voices of those subjugated or silenced. Including such voices requires sincerely exploring who has been affected by colonialism or neocolonialism and how, as well as cultural sensitivity. In its basic use, decolonization refers to countries under colonial rule gaining independence or freedom from forms of subjugation. Additionally, scholars use the term to refer to efforts to dismantle neocolonialism and vestiges of colonialism. The process includes de-silencing subjugated voices.[1] I use decolonization in the latter way to refer to countries with technical independence. While arguably colonization ended formally with independence from colonizing powers, neocolonialism is the indirect, informal, and sometimes subtle control of the people, their economy, and political life despite formal independence from colonizing authorities. I conceptualize neocolonialism as a system that involves direct and involuntary control of another’s political, economic, or social life, impacting their worldview and ways of encountering the world. Decolonization may target actions, places, or systems like health care or AI to overcome the ills of colonialism and neocolonialism. It also may target knowledge and require rethinking how people develop their knowledge base. For example, if people grew up seeing an outside colonizer as superior, they would need to change their knowledge of superiority. Decolonization may target power, for example, changing who owns and distributes COVID-19 vaccines and who distributors exclude in the distribution of vaccines. Decolonization could require looking at those disempowered in the distribution process. Additionally, decolonization may target autonomy of persons by freeing people, ensuring human and individual rights, and respecting cultural traditions. Decolonization projects that try to de-silence by including the voices of those affected by colonialism and neocolonialism must examine inclusiveness in the context of the culture of the subrogated individuals. Examples of decolonization projects include making datasets inclusive of diverse peoples and places, returning to traditional food and eating practices, making sure hospitals in developing countries are led by locals and respectful of cultural traditions, returning unethically obtained artefacts or objects. Another project would be laying the groundwork for equality in formerly colonized countries to ensure that business ownership, education, and financial success will flow fairly to those previously victimized by colonization. Summarily, there are many strategies for decolonizing. However, it is worth asking whether the strategies have risks that undermine the goal of decolonization. I. Understanding Decolonization Discourses Many fields, from AI to politics, economics, health care, aviation, and academia, discuss decolonization. The content of the discourse on decolonization depends on the region and field discussing it. Rather than just reporting on decolonization, the discussions may be calls to action. For example, decolonization discourses reflect activism for cognitive justice, such as equal consideration of Indian or African knowledge systems in global health discourses.[2] In politics and political science, some scholars frame decolonization as an anti-western, anti-colonial movement by Africans to emancipate Africa/ns from subjugation or shift the continent to postcolonialism and post-neo-colonialism. This framing walls off non-African participants and may undermine their capacity to benefit the conversation.[3] There are other political scientists who actively support decolonization and see it as a field of activism in support of anyone and countries where colonization harmed people and development.[4] The point is that two ways of conceptualizing decolonization in politics and political science are discernible. One conceptualization is less inclusive since it alienates scholars and professionals from Western, high-income, or developed countries. The other is more inclusive. In humanitarian studies, including philosophy, some decolonization articles and conversations are efforts to end the destructive force of colonization. They focus on either the form, such as ecocide, genocide, and many others, or the geographic location, such as Africa, Asia, Latin America, and Oceania.[5] Finally, the feelings one brings into this conversation can adversely impact how one engages in them and who they listen to or are willing to hear from. For example, anger, rage, bitterness, and hatred are emotions that are not uncommon in spaces of decolonization conversations. Decolonization conversations that originate from a place of negativity risk deepening the psychological state of victimhood and prevent people from disrupting constructively or critically engaging in the conversation.[6] II. Understanding Decolonization Strategies Decolonization strategies mainly aim to de-silence victims of domination or subjugation. People have proposed many strategies for decolonizing. These strategies may be informed by what the target is for decolonization. Decolonization can target power relations in global health. For example, during the COVID-19 pandemic, public health organizations noted the power imbalance in vaccine distribution. Decolonization could involve de-silencing those affected by neocolonialism to bring about a more balanced distribution of power and a more fair distribution of the vaccine. By analyzing who was adversely impacted by the distribution and who ought to wield power, those engaged in decolonizing advocated for positive change and equitable power relations. Equally, when being is the target of decolonization, the language of unlearning or relearning and mental decolonization take centre stage in the decolonization discourse. For example, the quest to decolonize colonized minds aims to demythologize African inferiority and Western superiority. Demythologizing African inferiority enables those engaged in the decolonization discourse to cultivate and foster African agency.[7] Finally, when knowledge production is the target of decolonization, scholars use inclusion and cognitive justice. For example, they try to alter the knowledge that underlies global health ethics.[8] “[D]decolonizing researchers aim to respectfully understand and integrate theory from Other(ed) perspectives, while also critically examining the underlying assumptions that inform their Western research framework.”[9] One common strategy that scholars use in decolonization is inclusion. It is worth asking, does including people who have been subrogated foster decolonization? Whether that is effective depends on whether included people are more heard or whether the strategies to include them create new forms of silencing. III. Inclusion and the Quest to Decolonize Evaluating how effective inclusion is in the quest to de-silence subjugated voices is important. First, inclusive strategies are not neutral. They are epistemically situated. This situatedness constrains meaning-making in different ways: how and what questions are asked, how social roles are constructed, organized or assigned, and who is admitted to the room where these conversations occur.[10] Inclusion strategies may reinforce (unchallenged) assumptions. For example, to address prejudices and stereotypes in global health images, Arsenii Alenichev and his colleagues[11] successfully inverted “one stereotypical global health image” by prompting a generative AI to produce “an image of a traditional Indian or African healer healing a White Child.” Although there were some problems with the image of the White child, this innovation is a significant, useful effort to de-embed or strip global health images of problematic pictures that mythologize White superiority and Black inferiority. Yet it is possible that using categories like traditional Indian or African reinforces unchallenged assumptions, raising key questions regarding how language and words create new stereotypes. It is common to define traditional as non-conventional, unorthodox, and informal. Yet studies continue to reveal that non-scientifically appraised healing approaches in India or Africa are not only effective but also real, meaningful, fundamental, and primary care-seeking behaviours in many communities in these regions.[12] Suppose inclusive strategies are not un-situated. These conversations may be had within the structures, language, and spaces built by or connected to colonialism. The spaces, language, places, and structures in which these conversations occur can limit who can participate and how they participate. Importantly, some conditions are not conducive to participation as equals. The allocated time for the discussion could also constrain how individuals express themselves. It is unclear who is ultimately heard. Furthermore, epistemic situatedness of inclusion can impact decolonization conversations when participants are beneficiaries of, products of, and trained by structures and systems they seek to dismantle. To enhance the decolonization project and its goals, a pressing task is to unveil and question how the circumstances may inhibit activism. If the vestiges of colonialism continue to structure the decolonization discourse invisibly, the vestiges may undermine decolonization. For example, a public health discussion that includes white Western doctors and Western pharmaceutical executives in Africa may have many local Africans at the table but could still effectively devalue their input based on built-in assumptions and biases that are vestiges of colonialism. Second, exclusion and inclusion are also not binary. Individuals may experience exclusion, even while included (the phenomenon called internal exclusion). In other words, inclusion can fail to be substantial or become a means of enhancing optics, “a way of (un)consciously weakening the radical claims being pursued.”[13] For example, in South Africa, many institutions have made significant efforts to diversify their faculties due to the promulgation of the Employment Equity Act 55.[14] The act requires South African institutions to implement employment equity that redresses the history of harmful discrimination in the country. The act further requires transforming departments and institutional administrations. Although many recognize and support the need to transform departments in South Africa, the rhetoric of transformation departs sharply from the lived experiences.[15] This misalignment between the plan and practice is evident in the underrepresentation of black people and females in senior management teams, professorships in many universities and health departments, and positions of power in some South African institutions. Those selected in the transformation of the departments have also complained of being overworked. The burden of extra work undermines their ability to develop agency and voice in the space they now occupy or fulfil key requirements that have implications for their career trajectory.[16] This is called the minority tax. Notably, "the minority tax… is the burden of extra responsibilities [placed] on faculty of colour to achieve diversity and inclusion and contributes to attrition and impedes academic promotion."[17] One challenge for decolonializing projects will be for decolonial scholars and those selected for decolonization objectives to have the humility to decline invitations, requests, roles, and platforms for which they are either unqualified or lack the capacity to fulfil. At its heart, decolonization strategies must empower those included rather than weaken them. Finally, inclusion can lead to a phenomenon known as elite capture.[18] Elite capture occurs when socially advantaged individuals in a group monopolize or exploit activism to their own benefit at the expense of the larger, struggling group. Elite capture weakens decolonization efforts from within, revealing that those likely to benefit from global inclusive efforts are those who fulfil globally constructed standards, those “already present in the room.” There is no better strategy to weaken decolonial movements than weakening the project from within by strategically positioning individuals who share physical properties with the victims of exclusion and silencing but intellectually, behaviourally, psychologically, and emotionally share more common ground with the colonizer. Such insiders may be unaware they are furthering neocolonial conditions rather than decolonizing. In relation to decolonization, particularly in global health, elite capture reveals that those whose voices are loudest in the room are not necessarily those more impacted by colonialism. They may benefit more from reinforcing colonialism. Opportunism weakens meaningful activism from within, preventing good initiatives and strategies from having their intended impact or taking substantive root.[19] This paper cannot do justice to elite capture, but it is worth noting its negative impacts. IV. Improving the Impact of Decolonization To end neo-colonialism, it is important to understand how it manifests and what to do at each level. Beyond the academic discourse, many tangible efforts exist to decolonize through de-silencing. Examples of these efforts include the ME2 movement that seeks to centre the concerns and experiences of sexually abused or harassed victims in the public discourse. At the funding level, many grant-awarding agencies like Wellcome Trust have dedicated huge budgets to studies that help them understand how they may have perpetrated colonialism or neocolonialism and what they can do differently going forward.[20] In South Africa, promulgating the Employment Equity Act 55 was a tangible attempt to entrench decolonization concerns in a country's regulatory framework. Yet, these decolonization efforts could fail to be substantive if they do not reflect cultural sensitivity. Two key components of cultural sensitivity are worth highlighting here: epistemic and cultural humility. Epistemic humility is an intellectual virtue described as knowing one’s limitations and the limitations of the learning methods employed. At its simplest, it is the ability to admit when one is wrong. Cultural humility includes genuine attempts to learn about and embrace other cultures. Epistemic and cultural humility are signs of academic excellence and strength. Epistemic and cultural humility seriously acknowledge how the state of our knowledge, cognitive limitations, experiences, and backgrounds, while constraining us, also invite us to listen, learn, grow, and change. The limitations-owing account of epistemic and cultural humility suggests that “a person who is aware of her cognitive limitations and owns them is much better positioned to achieve such epistemic goods as true beliefs and understanding than someone who… simply has insight into the epistemic status of her beliefs.”[21] Epistemic and cultural humility may help prevent decolonization projects that unintentionally reinforce what they seek to dismantle. Epistemic humility calls on decolonizers to defer tasks for which they are not qualified to suitably qualified persons. Beyond this, humility supports brave scholarship that imagines and reimagines how featuring the same voices, faces, and perspectives possibly introduces new forms of domination or silencing. Cultural knowledge can lead to a more intentional way of seeking out the right people or a more diverse group than those frequently featured in decolonization conversations. This would give others more opportunities to navigate these spaces and should do so in ways that are familiar to them. One ought to be more sensitive to those who would ordinarily not be included in these conversations. Unless we radically and boldly reimagine these discussions, we risk alienating those most negatively impacted by neocolonialism. CONCLUSION Decolonization conversations are complex and the subject of academic debate. The strategies employed to decolonize can harm or help the victims of neo-colonialism. Inclusion of previously silenced individuals may not be enough to overcome the vestiges of colonialism, leading to a false inclusion, where those included feel excluded or contribute in ways reflecting their own biases and circumstances. Inclusion of an elite or people who do not truly represent the subjugated can lead to elite capture. For decolonization strategies to be impactful, for example, in the context of global health, project leaders and participants must engage in conversations employing epistemic and cultural humility. This article reflects on the effects the media's constant projection of female images of sexually suggestive aesthetic perfection produces on woman's perception of herself and, above all, on her tendency to seek confirmation of her own worth essentially through other people's approving glances. After exploring the analogy between this mechanism and Bentham's Panopticon system, the article goes on to reflect on the profound psychological implications of the awareness of being scrutinized by others, leading to disempowerment and interiorization of the (...) rule. Aristotle’s political theory is often dismissed as undemocratic due to his treatment of natural slavery and women and to his conception of political rule as rule by turns. The second reason presents no less serious challenges than the first for finding democracy in Aristotle’s political theory. This article argues that Aristotle’s account of ruling in turns hinges on a critique of master rule and an affirmation of political rule, which involves both the rulers and the ruled in the project of (...) ruling. In this work I bring a conception of language and meaning as a shared institution to bear upon rule-following scepticism, i.e., upon the sceptical problem concerning the semantic determinacy of expressions involving infinite or indefinitely large and open extensions. Such scepticism proceeds from the observation that the extensions of expressions of this kind are not uniquely determined by epistemically accessible facts, to conclude that the expressions in question are indeterminate in point of extension, and that their meaning must consist in (...) their use. ;In the first chapter of this work, I argue that rule-following considerations by themselves do not suffice to establish these conclusions, and that additional premises are needed. I consider both internalist and extensionalist schemes to supplement the sceptical argument. I find such schemes lacking in persuasive support. Chapter 2, in particular, concentrates on Kripke's well known exegesis of Wittgenstein's argument, and on the internalist requirements upon which it is based. ;In Chapter 3, I offer an externalist account of the normative aspect in rule following. On the account I give, the rule one is projecting is determined extensionally by one's position in a community in which his projections would be corrected and evaluated by other members, and from which one has acquired the rule in the first place through a chain of communication, rather than by one's own projections, taken in isolation, which constitute only a partial understanding of the rule in question. This account is not designed to refute scepticism; rather its aim is to account for the normativity of rule-following in ways which do not invoke the internalist requirement upon which rule following scepticism is based. The selective connections that nerve cells make to each other and to effector and receptor cells outside the nervous system are essential to organized behavior. The retinotectal projection has been used frequently in the experimental investigation of how such patterned sets of connections are formed. This article traces the evolution of some of the dominant experimental paradigms and concepts that have resulted in the currently accepted rules underlying the retinotectal map.

A comprehensive excursion, into anthropology, ethnography, linguistics, social and political science lead me to the conclusion that human societies are ruled by systems of shared concepts, and that these systems of thought function as a kind of public or external mind, which produces and maintain the social forms of life. Taking into account the fact that philosophy originally - in ancient Greece - was a ‘public affair’, I came up with the idea that philosophy should try to map the public (...) mind. In other words, the idea that philosophers should draw up a project for making what I call philosophical maps, i.e. maps of public thought. In what follows, I will give a brief account of this idea in the hope that other philosophers may draw inspiration from it. Of course, all this involves speculation, but it does not interfere with regular philosophy. It simply adds something to it from the outside as it were, that is from a descriptive point of view. As I will make clear, this idea is consistent with the efforts of Wittgenstein to achieve a radical descriptive philosophy. (shrink)

In this paper Section 1 distinguishes between two modes of interpreting legal rules: rehearsal and discourse, arguing that the former takes priority over the latter in law, as in many other contexts. Section 2 offers two arguments that following a legal rule in the rehearsing mode presents a riddle. The first argument develops from law, and submits that legal rules do not tell us anything, because they are tautological. The second one develops from philosophy (Wittgenstein's later works), confronting (...) us with the paradox that incompatible courses of action may be derived from any rule. My solution presents a theory of rules as icons (Section 3). I use “icon” rather than “picture,” partly to avoid confusion with what is known among philosophers as “the picture theory of meaning.” Interpretation in the rehearsing mode hinges on imagination: imagining oneself in the space of reasons for action rather than reasoning oneself. In this act of imagination, we project ourselves into the rule in ways that are similar to the way we grasp the sense of paintings, music, stories, or poems. Finally (Section 4) I will defend the position that my view solves the puzzles in the second section, by arguing (a) that it is a better account of what Wittgenstein wrote than two competing theories (intuitionism and conventionalism), and (b) that it provides a more satisfactory account of how lawyers deal with legal rules in actual practice. Rule of law is a concept that is regularly debated by legal philosophers, often in connection to discussion of the concept of law. In this article, the focus is not on the substance of the conceptual claims, but on the methodologies employed by legal philosophers, investigating seminal articles on the rule of law by Joseph Raz and Jeremy Waldron. I argue that their philosophical argumentations often crucially depend on empirical or legal doctrinal arguments. However, these arguments remain underdeveloped. I explore (...) how these arguments could be linked to approaches related to rule of law in different fields of legal scholarship and investigate how the methodologies of these fields may complement each other. Thus, the article aims to provide an argument for a specific form of triangulation of three kinds of approaches to the rule of law: philosophical, social-scientific and legal doctrinal. This research project seeks to discover whether certain characteristics of a moral issue facilitate individuals’ abilities to detect violators of a conditional rule. In business, conditional rules are often framed in terms of a social contract between employer and employee. Of significant concern to business ethicists is the fact that these social contracts are frequently breached. Some researchers in the field of evolutionary psychology argue that there is a biological basis to social contract formation and dissolution in business. However, (...) although it is inescapable that biological forces shaped a fixed neural structure that guides and limits humans’ abilities, we argue that characteristics of the situation in which the person finds himself or herself moderate the activation of these neural circuits in ordinary business social contract situations. Specifically, the moral intensity associated with the social contract conditional rule is likely to influence peoples’ abilities to detect violators of the rule. This study utilizes adapted versions of the Wason selection task and manipulates the issue-contingent moral intensity characteristics of magnitude of consequences, proximity, and social consensus to assess if moral intensity facilitates detection of rule violators. Results from this empirical study indicate no relationship between moral intensity characteristics and issue recognition but do provide insights into the evolutionary psychology approach. (shrink)

A perennial problem in interpreting Hobbes’s moral and political thought in Leviathan has been to square the apparently irreducible normativity of central Hobbesian concepts and premises with his materialism and empiricism. Thus, Hobbes defines a “law of nature” as a “precept or general rule, found out by reason, by which a man is forbidden to do that which is destructive of his life” and the “right of nature” as “the liberty each man hath to use his own power, as he (...) will himself, for the preservation of his own nature”. The present study aims at proposing a time series-based network public opinion emergency management decision support algorithm for the problems of low decision accuracy and long decision time in traditional similar algorithms. In this proposed algorithm, after the time series data are preprocessed, the association rules of the original indicator data of network public opinion emergencies are mined, the original indicator data matrix of NPOEs will be constructed, and the improved local linear embedding approach will be employed to obtain (...) the original indicator data of NPOEs. After carrying out the preprocessing according to the preprocessing results, the objective weight of the emergency decision index is calculated through the interval value fuzzy information entropy measurement of the emergency decision index, the emergency management decision support model is constructed, and the emergency management decision support of the NPOE is realized. The simulation experiment results show that the proposed algorithm has a better effect on the decision-making effect of the management of NPOEs, and a higher decision-making efficiency is achieved. A transnational capitalist class has emerged as that segment of the world bourgeoisie that represents transnational capital, the owners of the leading worldwide means of production as embodied in the transnational corporations and private financial institutions. The spread of TNCs, the sharp increase in foreign direct investment, the proliferation of mergers and acquisitions across national borders, the rise of a global financial system, and the increased interlocking of positions within the global corporate structure, are some empirical indicators of the transnational (...) integration of capitalists. The TCC manages global rather than national circuits of accumulation. This gives it an objective class existence and identity spatially and politically in the global system above any local territories and polities. The TCC became politicized from the 1970s into the 1990s and has pursued a class project of capitalist globalization institutionalized in an emergent transnational state apparatus and in a "Third Way" political program. The emergent global capitalist historic bloc is divided over strategic issues of class rule and how to achieve regulatory order in the global economy. Contradictions within the ruling bloc open up new opportunities for emancipatory projects from global labor. (shrink)
