This paper presents a theory of empty names that is consistent with direct-reference theory and Millianism.

Making good decisions in extremely complex and difficult processes and situations has always been both a key task as well as a challenge in the clinic and has led to a large amount of clinical, legal and ethical routines, protocols and reflections in order to guarantee fair, participatory and up-to-date pathways for clinical decision-making. Nevertheless, the complexity of processes and physical phenomena, time as well as economic constraints and not least further endeavours as well as achievements in medicine and healthcare (...) continuously raise the need to evaluate and to improve clinical decision-making. This article scrutinises if and how clinical decision-making processes are challenged by the rise of so-called artificial intelligence-driven decision support systems (AI-DSS). In a first step, this article analyses how the rise of AI-DSS will affect and transform the modes of interaction between different agents in the clinic. In a second step, we point out how these changing modes of interaction also imply shifts in the conditions of trustworthiness, epistemic challenges regarding transparency, the underlying normative concepts of agency and its embedding into concrete contexts of deployment and, finally, the consequences for (possible) ascriptions of responsibility. Third, we draw first conclusions for further steps regarding a ‘meaningful human control’ of clinical AI-DSS. (shrink)

In this paper, I defend a well-known theory of belief reports from an important objection. The theory is Russellianism, sometimes also called `neo-Russellianism', `Millianism', `the direct reference theory', `the "Fido"-Fido theory', or `the naive theory'. The objection concernssubstitution of co-referring names in belief sentences. Russellianism implies that any two belief sentences, that differ only in containing distinct co-referring names, express the same proposition (in any given context). According to an old and attractive view, vagueness must be eliminated before semantic notions — truth, implication, and so on — may be applied. This view was accepted by Frege, but is rarely defended nowadays.1 This..

Simulations are used in very different contexts and for very different purposes. An emerging development is the possibility of using simulations to obtain a more or less representative reproduction of organs or even entire persons. Such simulations are framed and discussed using the term ‘digital twin’. This paper unpacks and scrutinises the current use of such digital twins in medicine and the ideas embedded in this practice. First, the paper maps the different types of digital twins. A special focus is (...) put on the concrete challenges inherent in the interactions between persons and their digital twin. Second, the paper addresses the questions of how far a digital twin can represent a person and what the consequences of this may be. Against the background of these two analytical steps, the paper defines first conditions for digital twins to take on an ethically justifiable form of representation. (shrink)

Trust is one of the big buzzwords in debates about the shaping of society, democracy, and emerging technologies. For example, one prominent idea put forward by the High‐Level Expert Group on Artificial Intelligence appointed by the European Commission is that artificial intelligence should be trustworthy. In this essay, we explore the notion of trust and argue that both proponents and critics of trustworthy AI have flawed pictures of the nature of trust. We develop an approach to understanding trust in AI (...) that does not conceive of trust merely as an accelerator for societal acceptance of AI technologies. Instead, we argue, trust is granted through leaps of faith. For this reason, trust remains precarious, fragile, and resistant to promotion through formulaic approaches. We also highlight the significance of distrust in societal deliberation, as it is relevant to trust in various and intricate ways. Among the fruitful aspects of distrust is that it enables individuals to forgo technology if desired, to constrain its power, and to exercise meaningful human control. (shrink)

In this paper, I present a new semantics for demonstratives. Now some may think that David Kaplan (1989a,b) has already given a more than satisfactory semantics for demonstratives, and that there is no need for a new one. But I argue below that Kaplan's theory fails to describe the linguistic meanings of 'that' and other true demonstratives. My argument for this conclusion has nothing to do with cognitive value, belief sentences, or other such contentious matters in semantics and the philosophy (...) of mind. Rather, it appeals to the obvious fact that there can be true utterances of certain sentences containing several occurrences of the same demonstrative (for instance, 'That is taller than that'). My argument can be answered by making a fairly modest revision in Kaplan's theory. But I believe that the resulting revised version of Kaplan's theory ignores or distorts various important semantic features of 'that'. Thus I ultimately argue in favor of a more substantial departure from Kaplan's theory. Perhaps the most remarkable feature of the theory I favor is that it ascribes three distinct sorts of meanings to demonstratives. (shrink)

In several jurisdictions, irremediable suffering from a medical condition is a legal requirement for access to assisted dying. According to the expressivist objection, allowing assisted dying for a specific group of persons, such as those with irremediable medical conditions, expresses the judgment that their lives are not worth living. While the expressivist objection has often been used to argue that assisted dying should not be legalised, I show that there is an alternative solution available to its proponents. An autonomy-based approach (...) to assisted suicide regards the provision of assisted suicide (but not euthanasia) as justified when it is autonomously requested by a person, irrespective of whether this is in her best interests. Such an approach has been put forward by a recent judgment of the German Federal Constitutional Court, which understands assisted suicide as an expression of the person’s right to a self-determined death. It does not allow for beneficence-based restrictions regarding the person’s suffering or medical diagnosis and therefore avoids the expressivist objection. I argue that on an autonomy-based approach, assisted suicide should not be understood as a medical procedure but rather as the person’s autonomous action. (shrink)

This paper argues that data-driven medicine gives rise to a particular normative challenge. Against the backdrop of a distinction between the good and the right, harnessing personal health data towards the development and refinement of data-driven medicine is to be welcomed from the perspective of the good. Enacting solidarity drives progress in research and clinical practice. At the same time, such acts of sharing could—especially considering current developments in big data and artificial intelligence—compromise the right by leading to injustices and (...) affecting concrete modes of individual self-determination. In order to address this potential tension, two key elements for ethical reflection on data-driven medicine are proposed: the controllability of information flows, including technical infrastructures that are conducive towards controllability, and a paradigm shift towards output-orientation in governance and policy. Delia Graff Fara maintains that many desire ascriptions underspecify the content of the relevant agent’s desire. She argues that this is inconsistent with certain initially plausible claims about desiring, desires, and desire ascriptions. This paper defends those initially plausible claims. Part of the defense hinges on metaphysical claims about the relations among desiring, desires, and contents.

A structured character is a semantic value of a certain sort. Like the more familiar Kaplanian characters, structured characters determine the contents of expressions in contexts. But unlike Kaplanian characters, structured characters also have constituent structures. The semantic theories with which most of us are acquainted do not mention structured characters. But I argue in this paper that these familiar semantic theories fail to make obvious distinctions in meaning---distinctions that can be made by a theory that uses structured characters. Thus (...) David Chalmers uses Bayesian theories of credence to argue against referentialism about belief. This paper argues that Chalmers’s Bayesian objections to referentialism are similar to older, more familiar objections to referentialism. There are familiar responses to the old objections, and there is a predictable way to modify those old responses to meet Chalmers’s Bayesian objections. The new responses to the new objections are no less plausible than the old responses to the old objections. Chalmers’s positive theory of belief and credence (...) is structurally similar to typical referential theories of those objects, but his theory is more speculative and dubious. (shrink)

In a recent article, Wilkinson puts forward the notion of identity-relative paternalism. According to Wilkinson’s final formulation of this principle, ‘[i]ndividuals should be prevented from doing to future selves (where there are weakened prudential unity relations between the current and future self) what it would be justified to prevent them from doing to others’.1 In medical ethics, it is usually assumed that hard paternalism, that is, acting against a competent person’s wishes for their own benefit, is not justified. According to (...) Mill’s harm principle, we may only limit people’s freedom if they cause harm to others.2 Harm to self is not a sufficient reason for overriding competent persons’ decisions. Wilkinson, however, draws on Parfit’s reductionist view of personal identity to argue that sometimes, patients’ future selves are sufficiently disconnected from their present selves to treat future selves like different persons. If a competent person’s medical decision negatively affects a future self, this should be treated like a case of harm to others. Thus, overriding competent persons’ decisions in such cases—and treating them against their will—could be justified. In this commentary, I point out two problems with this approach. David Kaplan distinguishes between character and content in his theory of demonstratives and indexicals. This paper argues that David Kaplan's theory of demonstratives contains two different, incompatible, descriptions of what character is. It argues that one of them is superior. It argues that, ultimately, a theory of indexicals needs a theory of structured characters.

Building on the emotion-centered model of voluntary work behavior, this research tests the relations between leader narcissism, followers’ malicious and benign envy, and supervisor-targeted counterproductive work behavior. Results across five studies, two experimental studies, and two field surveys indicate that leader narcissism relates positively to followers’ negative emotions, which in turn mediates the positive relation between leader narcissism and supervisor-targeted CWB. Proposed negative relations between leader narcissism and positive emotions were only partly supported. Our findings advance the understanding of envy (...) and the detrimental impact of leader narcissism on organizational functioning. (shrink)

I say that this is Russellianism's most notorious consequence because it is so often used to argue against the view: many philosophers think that it is obvious that (1) and (2) can differ in truth value, and so they conclude that Russellianism is false. Let's call this the Substitution Objection to Russellianism.

Invariantism about ‘might’ says that ‘might’ semantically expresses the same modal property in every context. This paper presents and defends a version of invariantism. According to it, ‘might’ semantically expresses the same weak modal property in every context. However, speakers who utter sentences containing ‘might’ typically assert propositions concerning stronger types of modality, including epistemic modality. This theory can explain the phenomena that motivate contextualist theories of epistemic uses of ‘might’, and can be defended from objections of the sort that (...) relativists mount against contextualist theories. Many philosophers think that the Substitution Objection decisively refutes Russellianism. This objection claims that sentences (1) and (2) can differ in truth value. Therefore, it says, the sentences express different propositions, and so Russellianism is false.

Names and natural kind terms have long been a major focus of debates about meaning and reference. This article discusses some of the theories and arguments that have appeared in those debates. It is remarkably difficult to say what names are without making controversial theoretical assumptions. This article does not attempt to do so here. It instead relies on paradigm examples that nearly all theorists would agree are proper names, for instance, ‘Aristotle’, ‘Mark Twain’, ‘London’, ‘Venus’, and ‘Pegasus’. All of (...) the proper names that are discussed in the article are singular nouns that have no syntactic structure. Most of them refer to objects, but some, such as ‘Pegasus’, apparently do not. The article begins with proper names and the question ‘What is the meaning of a proper name?’ It turns to natural kind terms later. (shrink)

The aim of this study was to explore the coping resources of hope and sense of coherence, which are rooted in positive-psychology theory, as potential resilience factors that might reduce the emotional distress experienced by adults from three cultural groups in Israel during the chronic-stress situation of a pandemic. The three cultural groups examined were secular Jews, Ultra-Orthodox Jews, and Arabs. We compared these cultural groups during the second wave of the Covid-19 pandemic, just before the Jewish New Year (mid-September (...) 2020) as a second lockdown was announced. Data were gathered from 248 secular Jews, 243 Ultra-Orthodox Jews, and 203 Arabs, who were 18–70 years old (M= 37.14,SD= 12.62). The participants filled out self-reported questionnaires including the Brief Symptom Inventory as a measure of emotional/psychological distress (i.e., somatization, depression, and anxiety) and questionnaires about sense of coherence and different types of hope (i.e., intrapersonal, interpersonal, and transpersonal) as measures of coping resources and resiliency. Differences were found between the three groups in terms of several variables. The Arab participants reported the highest levels of emotional distress and the lowest levels of interpersonal and transpersonal hope; whereas the Ultra-Orthodox participants revealed the highest levels of sense of coherence and other resilience factors. A structural equation model revealed that, in addition to the sociodemographic factors, only sense of coherence and intrapersonal hope played significant roles in explaining emotional distress, explaining 60% of the reported distress among secular Jews, 41% among Ultra-Orthodox Jews, and 48% among Arabs. We discuss our findings in light of the salutogenic and hope theories. We will also discuss their relevancy to meaning-seeking and self-transcendence theory in the three cultural groups. (shrink)

Some philosophers (includingMichael Devitt and Mark Richard) claim that attitude ascriptions canbe used to predict behavior, but argue that if Russellianism weretrue, then this would not be so. (...) They conclude that Russellianism isfalse. I defend Russellianism from this objection. I present severalanalyses of ``sentence S can be used to predict event E''. I arguethat, on each of these analyses, attitude ascriptions can be used topredict behavior, even if Russellianism is true. Furthermore, if myarguments are incorrect, and attitude ascriptions cannot be used topredict behavior under Russellianism, then Russellians can explainaway the intuition that they can be so used. In the article ‘Represent Me: Please! Towards an Ethics of Digital Twins in Medicine’, I analysed and tried to better understand the main ethical challenges associated with Digital Twins. For those who are just entering the debate with this article: DT is a metaphor for a bundle of artificial intelligence driven simulation technologies that constantly, in real time and ad personam simulate single or multiple parts of the body and make predictions about future health states based on these simulations. My (...) argument addresses the need to look at the breadth of challenges through a perspective of representation. From such a take, key consequences can be drawn for the further development of such technologies, the required means of control and not least the way to think about the interaction between humans and ‘their’ simulations. I am very grateful for the subsequent suggestions, criticisms and further arguments, which have helped me to elaborate my arguments more clearly and have led to a substantial advancement of the debate and the discussion about ethical questions in dealing with DT. Jenny Blumenthal-Barby,1 Deborah Lupton,2 Jenny Krutzinna,3 Janina Loh,4 Brent Mittelstadt,5 Sven Nyholm,6 Daniel Tigard7 and Max Tretter8 have made excellent points, which, in the following, I will not be able to reply to individually and in detail. In this response, I will try to bundle the open points and questions along the comments and considerations mentioned above and attempt to outline their significance for an ethics of DT. Research in basic and clinical neuroscience of music conducted over the past decades has begun to uncover music’s high potential as a tool for rehabilitation. Advances in our understanding of how music engages parallel brain networks underpinning sensory and motor processes, arousal, reward, and affective regulation, have laid a sound neuroscientific foundation for the development of theory-driven music interventions that have been systematically tested in clinical settings. Of particular significance in the context of motor rehabilitation is the notion that musical (...) rhythms can entrain movement patterns in patients with movement-related disorders, serving as a continuous time reference that can help regulate movement timing and pace. To date, a significant number of clinical and experimental studies have tested the application of rhythm- and music-based interventions to improve motor functions following central nervous injury and/or degeneration. The goal of this review is to appraise the current state of knowledge on the effectiveness of music and rhythm to modulate movement spatiotemporal patterns and restore motor function. By organizing and providing a critical appraisal of a large body of research, we hope to provide a revised framework for future research on the effectiveness of rhythm- and music-based interventions to restore and train motor function. This paper presents a number of objections to Jeffrey King's quantificational theory of complex demonstratives. Some of these objections have to do with modality, whereas others concern attitude ascriptions. Various possible replies are considered. The debate between quantificational theorists and direct reference theorists over complex demonstratives is compared with recent debates concerning definite descriptions.

Germany is an interesting case with respect to the governance of reprogenetics. It has a strong profile in the technosciences and high aims regarding the global bioeconomy, yet her regulation of human genetics, reproductive medicine and embryo research has for a long time been rather restrictive. German biopolitical exceptionalism has often been explained by reference to Catholicism and the legacy of the Nazi past. The Germans, so goes the common story, have learnt the lessons of history and translated them into (...) unconditional respect for human dignity, which in turn translates into unconditional protection of human life, including the human embryo, and the firm repudiation of any eugenic distinction between ‘life worth to live’ and ‘life not worth to live’. This, however, is not the whole story. Alongside deontological strictness we find another strand of governing body politics and reprogenetics in Germany, the rule-and-exception model, running from the mid-1970s abortion law via the 2002 Stem Cell Act to the 2011 regulation of pre-implantation genetic diagnosis. In contrast to the former, that strongly draws on Kant and his concept of human dignity, the latter bears resemblances to Carl Schmitt's concept of state of exception. The article will show that the rule-and-exception model builds the exception into the rule and transforms the meaning and mandate of ethics, namely from safeguarding ethical standards to deciding about the exception. Given that the exception has now tended to become the rule, the question is whether the lessons of history will govern German reprogenetics for much longer. (shrink)

Public trust of conventionally produced food is now a pivotal issue for the Canadian food supply chain as consumers are increasingly demanding traceability, transparency and sustainability of the agri-food system. To ensure that Canadians understand what farmers do, how they do it, and why—there has been significant human and financial investment by both the agri-food industry and government over the last decade. Farmers, civil servants, and non-farming agricultural professionals alike are being encouraged to join the national conversation promoting the legitimacy (...) of conventional agriculture. As part of this large-scale effort, women in agriculture are advocating, in gendered ways, for the safety and legitimacy of the agri-food system and its conventional farming practices. This is being done by utilizing their motherhood capital. This motherhood capital legitimizes the authority granted to mothers as expert decisionmakers regarding their children’s food consumption. Through the usage of their motherhood capital, women are being positioned—and are positioning themselves—as an important voice in re-narrating the story of conventional agriculture through the circulation of their maternal foodwork experiences. Using their authority as mothers they are advocating for the safety, necessity, and trustworthiness of conventional agriculture to counter narratives of mistrust and risk. (shrink)

Mitochondrial replacement techniques (MRTs) usually aim to prevent the genetic transmission of maternally inherited mitochondrial diseases. Until now, only the UK and Australia have implemented specific legal regulations of MRTs. In both countries, clinical trials on these techniques are only permissible for cases with a high risk of severe mitochondrial disease in the offspring. However, these techniques can also be applied to treat infertility, especially for older women with impaired oocyte quality. In some countries without legal regulation of these techniques, (...) MRTs are already offered for this purpose. Yet, this application of MRTs has received insufficient attention in the bioethical literature so far.In this paper, I examine whether there are ethical reasons to prohibit trials on MRTs in the context of infertility when they are permitted for preventing mitochondrial disease. Allowing MRTs in one context but not the other might be justified either because their application in the context of mitochondrial disease (1) is supported by a more convincing evidence base, (2) has a higher potential benefit or (3) has a lower risk. I compare both applications of MRTs with respect to these three factors. I conclude that there is no convincing reason to prohibit clinical trials on MRTs for infertility when they are permitted in the context of mitochondrial disease. (shrink)

According to the expressivist objection, laws that only allow assisted dying for those suffering from certain medical conditions express the judgement that their lives are not worth living. I have recently argued that an autonomy-based approach that legally allows assisted suicide for all who make an autonomous request is a way to avoid the expressivist objection. In response to this, Thomas Donaldson has argued that rather than avoiding the expressivist objection, an autonomy-based approach extends this objection. According to Donaldson, this (...) is because helping a person achieve a goal requires endorsement of that goal. In this reply, I show that Donaldson misunderstands the target of the expressivist objection: it is not aimed at an individual’s attitude towards another person’s death but rather at a legal regulation. Moreover, helping someone end their life does not necessarily require endorsing this goal—instead, respect for a person’s autonomous choice can be another reason for providing assisted suicide. Donaldson also assumes that the autonomy-based approach requires doctors to accept autonomous requests for assisted dying. Yet, this approach merely makes it legal for individuals (not necessarily only doctors) to provide assisted suicide to autonomous persons but does not require anyone to do so. (shrink)

This article reports findings of a survey of college students in 3 educational settings regarding student perceptions of mass media ethics pedagogy, including course objectives, value systems examined, the use of civil law and/or ethics codes as standards of media ethics, and teaching techniques used in media ethics instruction. Of particular interest was how closely student expectations correlate with previous research findings indicating instructor techniques and goals. The results revealed several areas in which instructor goals and the student rankings were (...) not in accordance, including marked discrepancies between professor and student views on ethical standards employed, values systems examined, and teaching techniques preferred. The study concluded that most students would respond well to a stand-alone media ethics course employing a variety of teaching methods. Respondents felt the course should not emphasize universal ethics, but should respect pluralistic principles and examine various cultural interpretations of media ethics. (shrink)

This article assesses the recently renewed interest in the just war criterion of sovereign authority from a Thomistic perspective. It contrasts the classical conceptualisation of authority as found in the work of St Thomas Aquinas with the argument made by today’s revisionist just war thinkers. The article points out that the two approaches start from fundamentally different units of moral analysis. While the Thomistic just war emphasises the common good of the political community revisionists advocate the perspective of moral individualism. (...) As a result, for Thomism, only those entrusted with the responsibility for the common good of the political community are entitled to wage war while, in contrast, revisionists argue that any individual has the right to wage war. The latter side’s position, the article criticises, is problematic from a moral point of view as it runs counter to the just war tradition’s concern about restraint in the employment of force. This article improves our understanding of the reasons underlying the intellectual migration of scientists from existing cognitive domains to nascent scientific fields. To that purpose we present, first, a number of findings from the sociology of science that give different insights about scientific migration. We then attempt to bring some of these insights together under the conceptual roof of an actor-based approach linking expected utility and diffusion theory. Intellectual migration is seen as the choice of scientists who decide under uncertainty (...) and on the base of estimations about probabilities, costs, and benefits of the migration. The resulting choice model can be used as a heuristic base for further exploration of the subject. (shrink)

This essay investigates the change in the Catholic attitude toward nuclear weapons as articulated by Pope Francis. Francis has generally followed the position of his immediate predecessors with regard to the Catholic teaching on just war. While the resort to armed force remains a morally justifiable option if the principles of just war have been met, the pope forcefully emphasises the tools of nonviolent peacebuilding. Recently, however, Francis made an original just war argument when he broke with the Church’s established (...) position on nuclear weapons. The pope declared both the use and possession of nuclear weapons “immoral” and, thus, abandoned the Church’s reluctant acceptance of nuclear deterrence that had survived the end of the Cold War. In this essay, I analyse the rationale behind Francis’s decision to break with nuclear deterrence, which is mainly grounded in the disillusionment about the failed promise of nuclear disarmament. Furthermore, I assess the impact of the new position with regard to Catholic soldiers serving in nuclear armed militaries. (shrink)
