We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. The rating of perceived exertion can be used to monitor the exercise intensity during laboratory and specific tests, training sessions, and to estimate the internal training load of the athletes. The aim of the present study was to develop and validate a specific pictorial perceived exertion scale for soccer players called GOAL Scale. The pictorial GOAL Scale was validated for twenty under-17 soccer players. In the validation phase, the athletes were evaluated in a progressive protocol involving stimuluses of 3 min (...) with 1 min for the rest into the stages until the voluntary exhaustion in Maximal Cardiopulmonary Effort Test, and in the Yo Yo Intermittent Recovery Test – Level 1. The RPE identified by the GOL Scale, by the Borg Scale 6 – 20 and by the Cavasini Scale, as well as the heart rate, perceptual of the heart rate and the blood lactate concentration were immediately evaluated after each stage of both tests. Spearman’s correlation coefficient was used. Construct scale validity was examined by regressing GOAL Scale against Borg Scale 6 – 20 and Cavasini Scale and concurrent scale validity was investigated by regressing GOAL Scale against HR, beats/min and blood lactate concentration during two progressive tests. There was a significant correlation values of the GOAL Scale with Borg Scale, Cavasini Scale, %HRmax, HR and lactate during tests. The results evidenced concurrent and construct validity of the GOAL Scale across a wide range of exercise intensity. The absence of verbal anchors makes the use of this instrument to soccer, futsal and beach soccer athletes of different languages and different literacy levels possible. (shrink)

A "slippery slope argument" is a type of argument in which a first step is taken and a series of inextricable consequences follow, ultimately leading to a disastrous outcome. Many textbooks on informal logic and critical thinking treat the slippery slope argument as a fallacy. In this volume, Douglas Yoder uses the tools of modern and postmodern philosophy and biblical criticism to elucidate the epistemology of the Tanakh, the collection of writings that comprise the Hebrew Bible. Despite the conceptual sophistication of the Tanakh, its epistemology has been overlooked in both religious and secular hermeneutics. The concept of revelation, the genre of apocalypse, and critiques of ideology and theory are all found within or derive from epistemic texts of the Tanakh. Yoder examines how philosophers (...) such as Spinoza, Hume, and Kant interacted with such matters. He also explores how the motifs of writing, reading, interpretation, image, and animals, topics that figure prominently in the work of Derrida, Foucault, and Nietzsche, appear also in the Tanakh. Recent work in artificial intelligence has increasingly turned to argumentation as a rich, interdisciplinary area of research that can provide new methods related to evidence and reasoning in the area of law. Douglas Walton provides an introduction to basic concepts, tools and methods in argumentation theory and artificial intelligence as applied to the analysis and evaluation of witness testimony. He shows how witness testimony is by its nature inherently fallible and sometimes subject to disastrous failures. At the same time (...) such testimony can provide evidence that is not only necessary but inherently reasonable for logically guiding legal experts to accept or reject a claim. Walton shows how to overcome the traditional disdain for witness testimony as a type of evidence shown by logical positivists, and the views of trial sceptics who doubt that trial rules deal with witness testimony in a way that yields a rational decision-making process. On September 1, 2023, Texas made important revisions to it its decades‐old statute granting legal safe harbor immunity to physicians who withhold or withdraw life‐sustaining treatment over the objection of critically ill patients’ surrogate decision‐makers. However, lawmakers left untouched glaring flaws in a key safeguard for patients—the transfer option. The transfer option is ethically important because, when no hospital is willing to accept the patient in transfer, that fact is taken as strong evidence that the surrogates’ treatment requests fall outside (...) accepted medical practice. But there are serious shortcomings in how the transfer option is carried out in Texas and many other states, which undermines the ethical usefulness of the process. We identify these shortcomings and recommend revisions to state statutes and professional guidelines to overcome them. (shrink)

Wigmore thought that there was a science of proof underlying legal reasoning that could be displayed in any given case as a graphic sequence of argumentation from the evidence in the case leading to the ultimate probandum. Argumentation technology has now vindicated this approach by providing useful qualitative methods that can be applied to identifying, analyzing, and evaluating the pro and con arguments put forward by both sides in a trial. In this chapter, it is shown how to apply argumentation (...) schemes, such as argument from witness testimony, using argument diagrams applied to typical sequences of evidence-based legal reasoning in which there is a successive refinement of arguments displayed as the evidence comes into a case. It is shown how argument from applying rules to cases, teleological, argument from expert witness testimony, and abductive reasoning are centrally important for this purpose. (shrink)

Este artigo apresenta um pouco dos estudos de Roger Bacon sobre Alquimia. Filósofo medieval, Bacon deu sequência à tradição de estudos herméticos. Como parte de uma das ciências especiais, assim como ele a compreendia, a Alquimia teve destaque como elemento importante no seu projeto filosófico-científico. A fim de apresentar um pouco o lugar da Alquimia no corpus baconiano, o texto parte de uma breve exposição da possível origem dessa arte entre os povos da antiguidade oriental e, posteriormente, sua chegada à (...) Europa medieval. Passa-se então a apresentar os ensinamentos alquímicos transmitidos por Bacon; sua compreensão de Alquimia não como magia, mas como ciência positiva, cujos métodos e resultados podiam ser corroborados pela Ciência Experimental; a elaboração de uma breve chave de leitura dos termos alquímicos enviados ao Papa Clemente IV, juntamente com a defesa de que a Alquimia é uma arte hermética e precisa ser preservada da ignorância do homem comum, sendo revelada a quem a mereça em corpo e alma. Este trabalho é de natureza bibliográfica e de revisão de literatura e tem por objetivo fazer uma reflexão sobre as reinvindicações sociais que estão na pauta de grupos que por vezes foram negligenciados por discursos hegemônicos da sociedade. As reinvindicação destes grupos buscam dar visibilidade a lutas por reconhecimento de direitos básicos das mulheres, das pessoas negras, da classe trabalhadora, e de outras vozes que são silenciadas pelo totalitarismo dos discursos hegemônicos. Buscaremos utilizar estudos de Stuart Hall, Homi Bhabha e (...) Judith Butler, visando questionar a pretensa homogeneidade e estabilidade das categorias de cultura, etnia e gênero. A partir de uma compreensão de que tais categorias não são estanques, buscaremos questionar algumas vozes preconceituosas que se fundamentam na compreensão homogênea dessas categorias. Além disso, pretendemos apresentar o pensamento de Angela Davis como uma forma de unificar as reinvindicações de classe, etnia e gênero, como meio de dar mais consistência a luta daqueles que muitas vezes são excluídos do pleno exercício da cidadania. Although fallacies have been common since Aristotle, until recently little attention has been devoted to identifying and defining them. Furthermore, the concept of fallacy itself has lacked a sufficiently clear meaning to make it a useful tool for evaluating arguments. Douglas Walton takes a new analytical look at the concept of fallacy and presents an up-to-date analysis of its usefulness for argumentation studies. Walton uses case studies illustrating familiar arguments and tricky deceptions in everyday conversation where the charge of (...) fallaciousness is at issue. The numerous case studies show in concrete terms many practical aspects of how to use textual evidence to identify and analyze fallacies and to evaluate arguments as fallacious. Walton looks at how an argument is used in the context of conversation. He defines a fallacy as a conversational move, or sequence of moves, that is supposed to be an argument that contributes to the purpose of the conversation but in reality interferes with it. The view is a pragmatic one, based on the assumption that when people argue, they do so in a context of dialogue, a conventionalized normative framework that is goal-directed. Such a contextual framework is shown to be crucial in determining whether an argument has been used correctly. Walton also shows how examples of fallacies given in the logic textbooks characteristically turn out to be variants of reasonable, even if defeasible or questionable arguments, based on presumptive reasoning. This is the essence of the evaluation problem. A key thesis of the book, which must not be taken for granted as previous textbooks have so often done, is that you can spot a fallacy from how it was used in a context of dialogue. This is an innovative and even, as Walton notes, "a radical and controversial" theory of fallacy. (shrink)

Vardanyan’s Theorems [36, 37] state that $\mathsf {QPL}(\mathsf {PA})$ —the quantified provability logic of Peano Arithmetic—is $\Pi ^0_2$ complete, and in particular that this already holds when the language is restricted to a single unary predicate. Moreover, Visser and de Jonge [38] generalized this result to conclude that it is impossible to computably axiomatize the quantified provability logic of a wide class of theories. However, the proof of this fact cannot be performed in a strictly positive signature. The system $\mathsf (...) {QRC_1}$ was previously introduced by the authors [1] as a candidate first-order provability logic. Here we generalize the previously available Kripke soundness and completeness proofs, obtaining constant domain completeness. Then we show that $\mathsf {QRC_1}$ is indeed complete with respect to arithmetical semantics. This is achieved via a Solovay-type construction applied to constant domain Kripke models. As corollaries, we see that $\mathsf {QRC_1}$ is the strictly positive fragment of $\mathsf {QGL}$ and a fragment of $\mathsf {QPL}(\mathsf {PA})$. (shrink)

Minors are generally considered incompetent to provide legally binding decisions regarding their health care, and parents or guardians are empowered to make those decisions on their behalf. Parental authority is not absolute, however, and when a parent acts contrary to the best interests of a child, the state may intervene. The best interests standard is the threshold most frequently employed in challenging a parent''s refusal to provide consent for a child''s medical care. In this paper, I will argue that the (...) best interest standard provides insufficient guidance for decision-making regarding children and does not reflect the actual standard used by medical providers and courts. Rather, I will suggest that the Harm Principle provides a more appropriate threshold for state intervention than the Best Interest standard. Finally, I will suggest a series of criteria that can be used in deciding whether the state should intervene in a parent''s decision to refuse medical care on behalf of a child. (shrink)

A new pragmatic approach, based on the latest developments in argumentation theory, analyzing appeal to expert opinion as a form of argument. Reliance on authority has always been a common recourse in argumentation, perhaps never more so than today in our highly technological society when knowledge has become so specialized—as manifested, for instance, in the frequent appearance of "expert witnesses" in courtrooms. When is an appeal to the opinion of an expert a reasonable type of argument to make, and when (...) does it become a fallacy? This book provides a method for the evaluation of these appeals in everyday argumentation. Specialized domains of knowledge such as science, medicine, law, and government policy have gradually taken over as the basis on which many of our rational decisions are made daily. Consequently, appeal to expert opinion in these areas has become a powerful type of argument. Challenging an argument based on expert scientific opinion, for example, has become as difficult as it once was to question religious authority. Walton stresses that even in cases where expert opinion is divided, the effect of it can still be so powerful that it overwhelms an individual's ability to make a decision based on personal deliberation of what is right or wrong in a given situation. The book identifies the requirements that make an appeal to expert opinion a reasonable or unreasonable argument. Walton's new pragmatic approach analyzes that appeal as a distinctive form of argument, with an accompanying set of appropriate critical questions matching the form. Throughout the book, a historical survey of the key developments in the evolution of the argument from authority, dating from the time of the ancients, is given, and new light is shed on current problems of "junk science" and battles between experts in legal argumentation. I argue that, against what is commonly believed, Spinoza’s use of the relation of constitution to characterize the relation between attributes and the essence of a substance does not indicate that, for him, there must be a numerical identity between each attribute and the essence constituted by that attribute. To do this, I follow a twofold strategy. First, I contend that the claim that because in Spinoza’s time constitution was understood as a one- to-one relation is mistaken: the main logicians (...) of Spinoza’s time, all Cartesian philosophers, believe that the constitution of an essence can be a many-to-one relation. I show that Spinoza can both accept that constitution is a many-one relation and share Descartes’ understanding of this relation. Second, I defend the claim that Spinoza’s use of constitution in the Ethics is consistent with these logicians’ account of constitution. In particular, I focus on Spinoza’s inclusion of the intellect in the definition of attribute and his definition of God. (shrink)

He also discusses the inappropriate use of this kind of argument, referring to various major case studies, including the Salem witchcraft trials, the McCarthy hearings, and the Alger (...) Hiss case. This book makes an original contribution in the areas of argumentation theory and informal logic, contending that, despite its traditional classification as a fallacy, the argument from ignorance is a genuine, very common, and legitimate type of argumentation with an identifiable structure.
