This commentary highlights the scientific history of the NIH-Moderna COVID-19 vaccine and corroborates Sarpatwari’s theme of private capture of value created by the public. The commentary also identifies missteps by the Trump and Biden Administrations and offers policy recommendations: better contracts with and incentives for pharmaceutical manufacturers and a not-for-profit “public option” for pharmaceutical development.

In recent months, pharmaceutical manufacturers have brought legal challenges to a provision of the 2022 Inflation Reduction Act (IRA) empowering the federal government to negotiate the prices Medicare pays for certain prescription medications. One key argument made in these filings is that price negotiation is a “taking” of property and violates the Takings Clause of the US Constitution. Through original case law and health policy analysis, we show that government price negotiation and even price regulation of goods and services, including (...) patented goods, are constitutional under the Takings Clause. Finding that the IRA violates the Takings Clause would radically upend settled constitutional law and jeopardize the US’s most important state and federal health care programs. (shrink)

BackgroundThe Freedom of Information Act (FOIA) provides access to unreleased government records that can be used to enhance the transparency and integrity of biomedical research. We characterized FOIA requests to Department of Health and Human Services (HHS) agencies, including request outcomes, processing times, backlogs, and costs.MethodsUsing HHS FOIA annual reports, we extracted data on the number of FOIA requests received and processed by HHS agencies between 2008 and 2017, as well as request outcomes. Processing times were reported in three time (...) increments, < 1–20, 21–60, or 61+ days, and trends in backlog status were also described. Information about costs and fees collected were aggregated.ResultsBetween 2008 and 2017, 69.6% of 530,094 HHS FOIA requests were received by the Centers for Medicare and Medicaid Services (CMS), 18.9% by the Food and Drug Administration (FDA), and 11.6% by all other HHS agencies. During this period, CMS processed 374,728 requests, FDA 114,938, and other HHS agencies 61,890. CMS and FDA reduced backlogged requests by 9396 (89.7%) and 4289 (65.3%), respectively, leaving backlogs of 1081 and 2279 requests at the end of 2017. CMS fully or partially granted 60.3% of requests whereas FDA fully or partially granted 72.4%. Of all requests to CMS, 82.0% were considered simple and 18.0% complex; 82.2% of simple requests and 54.9% of complex requests were processed in 20 days, and 5.6% and 29.9% were processed in 61+ days. In contrast, 60.2% of requests to FDA were considered simple and 39.8% complex; 28.8% of simple requests and 9.0% of complex requests were processed in 20 days, and 58.3% and 81.5% were processed in 61+ days. The costs to HHS associated with FOIA requests totaled $446.4 million ($809 per processed request), increasing from $28.1 million ($423 per request) in 2008 to $53.3 million ($1544 per request) in 2017. In total, HHS collected $8.5 million in fees (1.9% of total costs).ConclusionsFOIA is frequently used to obtain information about HHS and its agencies. With growing costs, minimal fees collected, and lengthy processing times, HHS agencies’ FOIA programs might be made more efficient through greater proactive record disclosure. (shrink)

As there is currently a neo-Aristotelian revival currently taking place within contemporary metaphysics and dispositions, or causal powers are now being routinely utilised in theories of causality and modality, more attention is beginning to be paid to a central Aristotelian concern: the metaphysics of substantial unity, and the doctrine of hylomorphism. In this paper, I distinguish two strands of hylomorphism present in the contemporary literature and argue that not only does each engender unique conceptual difficulties, but neither adequately captures the (...) metaphysics of Aristotelian hylomorphism. Thus both strands of contemporary hylomorphism, I argue, fundamentally misunderstand what substantial unity amounts to in the hylomorphic framework – namely, the metaphysical inseparability of matter and form. In recent work, Adlam (2022b), Chen & Goldstein (2022), and Meacham (2023) have defended accounts of laws that take laws to be primitive global constraints. A major advantage of these accounts is that they’re able to accommodate the many different kinds of laws that appear in physical theories. In this paper I’ll present these three accounts, highlight their distinguishing features, and note some key differences that might lead one to favor one of these accounts over the others. This paper argues that the reason why political leadership often involves dirty hands is because of its relationship with violence. To make the case, it maintains that violent means create and assert a form of dominating power that is in tension with the proper ends of political action. This power casts a wide shadow, frequently dominating large numbers of non-targets and empowering unscrupulous agents. On the other side of the balance, characteristically political justifications for violence are ‘supra-moral,’ meaning that they (...) are motivated by the value of a conception of morality taken as a whole (or, indeed, morality as such) rather than by any particular moral value. The weight that ought to be given to such ends is indeterminate in a way that makes uncancelled remainders arising from the evil of violence likely in many cases. (shrink)

This essay seeks to illuminate the ethical concerns that animate Richard Rorty's philosophy. I argue that Rorty's ethics foregrounds as its central priority the issue of responsibility and frame Rorty's work as offering us a picture of ethical comportment in a postfoundational, pluralistic milieu, where citizens not only recognize the contingency of their own deepest beliefs but give up any sense of responsibilities owed to nonhuman authorities. To paraphrase Rorty, from any number of occasions, all we have to be responsible (...) to is each other. Yet Rorty goes even further than antiauthoritarianism in ethics. He not only shifts to thinking about ethics in terms of our relations to others; he specifically attunes this ethics to those who are suffering or excluded or merely previously unnoticed. In some cases, however, we remember the past event from an external “observer” perspective and view ourselves in the remembered scene. Are such observer perspective images genuine memories? sProblems about the nature of integral parts and wholes were central to twelfth-century discussions of the individuation and persistence over time of both substances and artifacts. This paper examines in detail Abaelard’s contribution to these discussions arguing that Abaelard proposes a solution to these problems which preserves our common sense intuitions about identity over time. In Abaelard’s work we find an explicit solution to the problem of the identity over time of living things which appeals to the persistence of the (...) vegetative soul through the loss or addition of corporeal matter. In work from the school of the Montani we apparently also have an account of Abaelard’s solution to the problem of the identity over time of artifacts which distinguishes between the role of a part in an integral whole and the material which plays that role such that the role persists when the matter is replaced. Why would Rene Descartes, the father of modern rationalist philosophy, choose "meditations" -- a term and genre associated with religious discourse and practice -- for the title of his magnum opus that lays the metaphysical foundations for his reform of all knowledge, including mathematics and sciences? Why did he believe that the immortality of the soul and the existence of God, which the Meditations on First Philosophy set out to demonstrate, can only be made self-evident through meditating? These are the (...) question that Christopher Wild's book answers. Descartes discovered the "foundations of a marvelous science" through a dramatic conversion in southern Germany in the winter of 1619. In this article, we review approaches to modeling a connection between spatial and mathematical thinking across development. We critically evaluate the strengths and weaknesses of factor analyses, meta-analyses, and experimental literatures. We examine those studies that set out to describe the nature and number of spatial and mathematical skills and specific connections between these abilities, especially those that included children as participants. We also find evidence of strong spatial-mathematical connections and transfer from spatial interventions to mathematical understanding. Finally, we map (...) out the kinds of studies that could enhance our understanding of the mechanisms by which spatial and mathematical processing are connected and the principles by which mathematical outcomes could be enhanced through spatial training in educational settings. What is social justice? At this point, there is considerable disagreement. For many, the term social justice is baffling and useless, with no real meaning. Most who use it argue that social justice is the moral fairness of the system of rules and norms that govern society. Do these rules work so that all persons get what is due to them as human beings and as members of the community? Shifting from the will of individuals in rendering justice to the (...) outcome of the system of rules in achieving justice can be a dangerous leap. To some, it suggests that virtually every inequality arises because the rules of the game are unfair and that the state must intervene whenever there are unequal outcomes. The dangers of this leap are the primary focus of Is Social Justice Just?, whose twenty-one authors accepted an invitation to "explore, reassess, and critique the concept of social justice-relating it to ongoing debates in economics, history, philosophy, politics, public policy, religion, and the broader culture.". This article summarizes Carroll Izard’s contributions to theory and research on emotion competence and an emotion-centered preventive intervention program. Cal’s contributions to emotion competence research began with some of the earliest studies of whether or not recognition and labeling of emotions relate to social and behavioral functioning. He also theorized about the adaptive use of discrete emotions, a construct Cal termed “emotion utilization.” He translated theory and research on emotions into seven principles for emotion-based prevention and intervention, and he applied (...) these principles to a preventive intervention, the Emotions Course. The Emotions Course has been shown to promote emotion competence and reduce problem behaviors. The article concludes with recommendations to deepen the research base on emotion competence. (shrink)

We investigate expansions of Heyting algebras in possession of a unary term describing the filters that correspond to congruences. Hasimoto proved that Heyting algebras equipped with finitely many normal operators have such a term, generalising a standard construction on finite-type boolean algebras with operators. We utilise Hasimoto’s technique, extending the existence condition to a larger class of EHAs and some classes of double-Heyting algebras. Such a term allows us to characterise varieties with equationally definable principal congruences using a single equation. (...) Moreover, in the presence of a dual pseudocomplement operation, discriminator varieties are characterised by a pair of equations. We also prove that a variety of dually pseudocomplemented EHAs with a normal filter term is semisimple if and only if it is a discriminator variety. This generalises two known results, one by Kowalski and Kracht for finite-type varieties of BAOs, and the other by the present author for dually pseudocomplemented Heyting algebras without additional operations. What role should a citizen's religious convictions play in her political activities? Is she, for example, permitted to decide on the basis of her religious convictions to support laws that criminalize abortion or discourage homosexual relations? Christopher Eberle is deeply at odds with the dominant orthodoxy among political theorists about the relation of religion and politics. His argument is that a citizen may responsibly ground her political commitments on religious beliefs, even if her only reasons for her political commitments (...) are religious in nature. Since the 1990s, the influence of the internet and social media in daily communication has skyrocketed. This has brought both remarkable opportunities and perceived perils. Recent years have seen increases in suicide and mental health concerns, political polarization, and online aggression. Can such phenomenon be connected causally to communication via social media? This article reviews the evidence for perceived deleterious effects of social media on several areas of human welfare, including political polarization, depression and suicide, aggression, and cyberbullying. In addition (...) to examining contemporary evidence from psychological studies, a historical analysis is included to examine whether we truly live in a uniquely difficult time or whether similar patterns of social behavior can be witnessed in other, pre-internet times. It is concluded that evidence may link social media to some negative social outcomes but in ways that are nuanced and complicated, often interacting with user motivations and personalities and situational variables. An increased focus on preregistered, standardized scientific methods and cautious interpretation of effect sizes can help clarify real versus phantom effects of social media. (shrink)

Cognitive abilities cannot be measured directly. What we can measure is individual variation in task performance. In this paper, we first make the case for why we should be interested in mapping individual differences in task performance on to particular cognitive abilities: we suggest that it is crucial for examining the causes and consequences of variation both within and between species. As a case study, we examine whether multiple measures of inhibitory control for non-human animals do indeed produce correlated task (...) performance; however, no clear pattern emerges that would support the notion of a common cognitive ability underpinning individual differences in performance. We advocate a psychometric approach involving a three-step programme to make theoretical and empirical progress: first, we need tasks that reveal signature limits in performance. Second, we need to assess the reliability of individual differences in task performance. Third, multi-trait multi-method test batteries will be instrumental in validating cognitive abilities. Together, these steps will help us to establish what varies between individuals that could impact their fitness and ultimately shape the course of the evolution of animal minds. Finally, we propose executive functions, including working memory, inhibitory control and attentional shifting, as a sensible starting point for this endeavour. (shrink)

The warrant for investigating the relationship between Augustine and narrative ethics is prompted, among other things, by a consideration of the appeals to Augustine among a diversity of views within the vast field of narrative ethics. Disparate thinkers from distinctively different backgrounds and with different motives and purposes, while all sharing an interest in the category of "narrative," also share a common interest in employing Augustine's Confessions in their efforts. Thus the question emerges as to what it is about this (...) ancient text which so readily serves such diverse yet unified purposes. ;After a thorough investigation and evaluation of the appeals to Augustine among a sampling of contemporary narrativists I turn to the Confessions directly. I argue that an examination of the anti-Manichaean aspects of its composition yield important insights regarding its usefulness in the efforts of contemporary narrativists. Specifically, I argue that implicit in this work is a theology of creation which supplies essential foundations to the contemporary discussion of narrative ethics. (shrink)

Finlay extends just war theory to provide a rigorous and systematic account of the right to resist oppression and of the forms of armed force it can justify. He specifies the circumstances in which rebels have the right to claim recognition as legitimate actors in revolutionary wars against domestic tyranny and (...) injustice, and wars of liberation against wrongful foreign occupation and colonialism. Arguing that violence is permissible only in a narrow range of cases, Finlay shows that the rules of engagement vary during and between different conflicts and explores the potential for irregular tactics to become justifiable, such as non-uniformed guerrillas and civilian disguise, the assassination of political leaders and regime officials, and the waging of terrorist war against civilian targets. For many Americans, the election of Barack Obama as the country's first black president signaled that we had become a post-racial nation - some even suggested that race was no longer worth discussing. Of course, the evidence tells a very different story. And while social scientists are fully engaged in examining the facts of race, normative political thought has failed to grapple with race as an interesting moral case or as a focus in the expansive theory of social justice. Political (...) thought's under participation in the debate over the status of blacks in American society raises serious concerns since the main academic task of political theory is to adjudicate discrepancies between the demands of ideal justice and social realities. Christopher J. Lebron contends that it is the duty of political thought to address the moral problems that attend racial inequality and to make those problems salient to a democratic polity. Thus, in The Color of Our Shame, he asks two major questions. First, given the success of the Civil Rights Act and the sharp decline in overt racist norms, how can we explain the persistence of systemic racial inequality? Second, once we have settled on an explanation, what might political philosophy have to offer in terms of a solution? In order to answer these questions Lebron suggests that we reconceive of racial inequality as a condition that marks the normative status of black citizens in the eyes of the nation. He argues that our collective response to racial inequality ought to be shame. While we reject race as a reason for marginalizing blacks on the basis of liberal democratic ideals, we fail to live up to those ideals - a situation that Lebron sees as a failure of national character. Drawing on a wide array of resources including liberal theory, virtue ethics, history, and popular culture, Lebron proposes a move toward a "perfectionist politics" that would compel a higher level of racially relevant moral excellence from individuals and institutions and enable America to meet the democratic ideals that it has set for itself. Representation theorems are often taken to provide the foundations for decision theory. First, they are taken to characterize degrees of belief and utilities. Second, they are taken to justify two fundamental rules of rationality: that we should have probabilistic degrees of belief and that we should act as expected utility maximizers. We argue that representation theorems cannot serve either of these foundational purposes, and that recent attempts to defend the foundational importance of representation theorems are unsuccessful. This article address the ways in which contemporary psychologists might usefully engage in a dialogue with Catholic philosophers and theologians influenced by the thought of St. Thomas Aquinas. The specific point of common agreement and vision between these diverse approaches lies in the general notion that human action is directed toward an end which the individual judges to be good in some sense. This paper examines three accounts of the sleeping beauty case: an account proposed by Adam Elga, an account proposed by David Lewis, and a third account defended in this paper. It provides two reasons for preferring the third account. First, this account does a good job of capturing the temporal continuity of our beliefs, while the accounts favored by Elga and Lewis do not. Second, Elga’s and Lewis’ treatments of the sleeping beauty case lead to highly counterintuitive consequences.
