On 1 December 2019, over one hundred Aboriginal nations performed ancestral and creation dances in synchrony across the Australian continent. One of the communities that danced was the Anaiwan nation from the north-eastern region of New South Wales, Australia. Since 2014 I have been working with Anaiwan people in a collaborative activist research project, creating and maintaining an Aboriginal community garden on the fringes of my hometown of Armidale as a site for land reclamation and decolonising, multispecies research. The community (...) garden is adjacent to the site of the old East Armidale Aboriginal Reserve, where over one hundred dispossessed Aboriginal people were forced to live on the municipal town garbage depot in the mid-twentieth century. This paper positions both the Nation Dance 2019 movement, and the Armidale Aboriginal Community Garden, as rhythmic events that activate Aboriginal Law and sovereignty that is held enduring in the land but that has been buried alive by the settler-colonial state. Focusing on the tensions between deep Indigenous ancestral temporality and colonial territoriality, I argue that the emergence of the Anthropocene reveals a dangerous dissonance between the rhythms of Aboriginal Law patterned through present-day Australian environments and the grid-based structures of colonial governance imposed upon them. “Songspirals are a university for us, they are a map of understandings” (Gay’wu Group of Women, 2019, p. 33). This paper is authored by Bawaka Country, acknowledging Country’s ability to teach and share. Country is homeland and place. Country is everything and the relationships that bring everything to life. Country is knowledge. This paper is shaped and enabled by songspirals. Songspirals are sung and cried by Yolŋu people in north east Arnhem Land, Australia, to awaken Country, to make and remake (...) the life-giving connections between people and place. The Goŋ-gurtha songspiral leads this paper, showing us how a Yolŋu Country-led pedagogy centres Country’s active agency by learning through, with, and as Country. This pedagogy shares with us the ongoing connections within and between generations to ensure that knowledge remains strong and that sharing is done the right way, according to Yolŋu Rom, Law/Lore. This learning is predicated on relationality and responsibility. It is a more-than-human learning in which human knowing is decentred and Country is knowledgeable. It is a learning which recognises and respects its limits and it is a learning in which the ongoing sovereignty of Yolŋu people is front and centre. (shrink)

The odds of encountering a senior citizen selling on the street have increased. The claim that they have no choice but to work and sell on the street, despite the dangers, illnesses, and psychological issues they may face, to provide for their family’s needs is very evident. Therefore, this study explores the quality of life, lived experiences, challenges, and coping mechanisms of senior citizen street vendors in Bulacan, Philippines. The study employed Heideggerian Phenomenology and Interpretative Phenomenological Analysis (IPA). According to non-cognitivism, moral sentences and judgements do not aim to represent how things morally are. This paper presents an empirical argument against this view. We begin by showing that non-cognitivism entails the prediction that after some reflection competent ordinary speakers’ semantic intuitions favor that moral sentences and judgements do not aim to represent how things morally are. At first sight, this prediction may seem to have been confirmed by previous research on folk metaethics. However, a number of methodological worries (...) lead us to doubt this interpretation. We, therefore, conducted a psychological study that alleviates these worries as far as possible. It turned out that competent ordinary speakers’ reflective semantic intuitions dominantly fail to favor that moral sentences do not aim to represent how things morally are. This challenge to non-cognitivism is defended and supplemented by considering deflationary theories of moral truth and middle ground theories in the cognitivism/non-cognitivism debate. (shrink)

Clinical ethicists move in different environments and interface with a variety of stakeholders, and are therefore uniquely positioned to answer the call for equity and anti-racism. We describe why a clinical ethicist should contribute to anti-racism efforts and describe general approaches for addressing racism across institutional contexts, including: (1) addressing racism as a bedside clinical ethics consultant, (2) addressing a wider lens of anti-racism work across multiple ethics consults over time, and (3) addressing racism at the organizational level.

Moral abolitionists claim that morality ought to be abolished. According to one of their most prominent arguments, this is because making moral judgments renders people significantly less tolerant toward anyone who holds divergent views. In this paper we investigate the hypothesis that morality’s tolerance-decreasing effect only occurs if people are realists about moral issues, i.e., they interpret these issues as objectively grounded. We found support for this hypothesis (Studies 1 and 2). Yet, it also turned out that the intolerance associated (...) with realism is mediated by moral conviction and perceived consensus. People tend to feel more strongly about those moral issues they ground objectively and, in doing so, are more prone to display the vice of moral smugness toward those who disagree with them. The remedy for this that has been recommended is humility which we found (Study 3) is indeed related to reduced intolerance, in part by predicting a reduction in realism, but also in part through a direct connection to intolerance. Although corporate social responsibility practice increasingly addresses gender issues, and gender and CSR scholarship is expanding, feminist theory is rarely explicitly referenced or discussed in the CSR literature. We contend that this omission is a key limitation of the field. We argue that CSR theorization and research on gender can be improved through more explicit and systematic reference to feminist theories, and particularly those from feminist organization studies. Addressing this gap, we review developments in feminist organization theory, mapping their relevance (...) to CSR. With reference to six major theoretical perspectives in CSR scholarship, we note feminist research relating to each. Drawing upon FOS theory and CSR theory, we then develop an integrated theoretical framework for the analysis of gender issues in CSR. Our framework enables us to identify research strengths in the gender and CSR literature, as well as gaps therein, to open new conversations and to posit future research directions for this emerging area of scholarship. Our paper illustrates how a better grounding of CSR in feminist theory can contribute to CSR research more broadly. (shrink)

Charges of inconsistency are frequently made against opponents of abortion for failing to ‘live out’ their beliefs. One such popular charge is that opponents of abortion are inconsistent for failing to ‘adopt the babies they don’t want aborted’—in this chapter, I will focus on a slightly broader version of this charge. I will understand adoption* broadly to include adopting and/or fostering children, as well as concretely supporting the systems involved in facilitating adoption and foster care through financial means, volunteering, and/or (...) advocacy. I will argue that opponents of abortion do not have special obligations to adopt* for the reasons often presumed, and thus are not inconsistent for failing to do so. However, I will go on to argue that they nevertheless have compelling reasons to do so—to decrease future abortions and oppose abortion with integrity. (shrink)

Persons with dementia often prefer to participate in decisions about their health care, but may be prevented from doing so because healthcare decision-making law facilitates use of advance directives or surrogate decision makers for persons with decisional impairments such as dementia. Federal and state disability law provide alternative decision-making models that do not prevent persons with mild to moderate dementia from making their own healthcare decisions at the time the decision needs to be made. The corporate social responsibility literature has increasingly explored relationships between civil society and social movements, including non-governmental organizations, and corporations, as well as the role of NGOs in multi-stakeholder governance processes. This paper addresses the challenge of including a plurality of civil society voices and perspectives in business–NGO relations, and in CSR as a process of governance. The paper contributes to CSR scholarship by bringing insights from feminist literature to bear on CSR as a process of governance, and engaging with (...) leaders of women’s NGOs, a group of actors rarely included in CSR research. The issues raised inform contributions to the CSR literature relating to the role of women’s NGOs with regard to the gender equality practices and impacts of corporations, and with respect to defining the meaning and practice of CSR. The paper frames marginalized NGOs as important actors which can contribute to pluralism, inclusion and legitimacy in CSR as a process of governance. It identifies several key barriers to the participation of women’s NGOs in CSR, and concludes by making suggestions for future research, as well as practice. (shrink)

The upstream framework presented in public health and medicine considers health problems from a preventive perspective, seeking to understand and address the root causes of poor health. Medical-legal partnerships (MLPs) have demonstrated the value of this upstream framework in the practice of law and engage in upstream lawyering by utilizing systemic advocacy to address root causes of injustices and health inequities. This article explores upstreaming and its use by MLPs in reframing legal practice.

Legal, medical, and public health professionals have been complicit in creating and maintaining systems that drive health inequities. To ameliorate this, current and future leaders in law, medicine, and public health must learn about racism and its impact along the life course trajectory and how to engage in antiracist practice and health equity work.

ABSTRACT:This article reviews a conversation between business ethicists and feminist scholars begun in the early 1990s and traces the development of that conversation in relation to feminist theory. A bibliographic analysis of the business ethics and corporate social responsibility literatures over a twenty-five-year period elucidates the degree to which gender has been a salient concern, the methodologies adopted, and the ways in which gender has been analyzed. Identifying significant limitations to the incorporation of feminist theory in these literatures, we discuss (...) how feminist scholarship relating to behavior, organizations, and economics could be integrated. We suggest that a better integration of feminist theory would strengthen BE/CSR research, and point to new research directions and agendas arising from our approach. (shrink)

Arthur Ripstein’s conception of Kantian freedom has exerted an enormous recent influence on scholars of Kant’s political philosophy; however, the conception seems to me flawed. In this paper, I argue that Ripstein’s conception of Kantian freedom as “your capacity to choose the ends you will use your means to pursue” – your “purposiveness” – is both too narrow and too broad: (1) Wrongful acts such as coercive threats cannot choose my ends for me; instead, such acts wrongfully restrict my perceived (...) options. And (2) rightful changes to the context in which I choose that render my means insufficient for my ends restrict my capacity to choose them. Alternatively, my purposiveness reduces to my entitlements; but then freedom as purposiveness is viciously circular or fails as a new approach to the “devastating” objection that motivates it. Background: In the last two decades, nursing authors have published ethical analyses of palliative sedation—an end-of-life care practice that also receives significant attention in the broader medical and bioethics literature. This nursing literature is important, because it contributes to disciplinary understandings about nursing values and responsibilities in end-of-life care. Research aim: The purpose of this project is to review existing nursing ethics literature about palliative sedation, and to analyze how nurses’ moral identities are portrayed within this literature. Research design: We (...) reviewed discussion papers, written by nurses about the ethics of palliative sedation, which were cited in MEDLINE, CINAHL, Nursing and Allied Health, or Philosopher’s Index (search date March 2018). Twenty-one papers met selection criteria. We performed a comprehensive review and analysis (using the Qualitative Analysis Guide of Leuven), of the values, responsibilities, and relationships reflected in authors’ portrayal of the nursing role. Findings: Two different tones are apparent in the extant nursing ethics literature. One is educational, while the other is critically reflective. Irrespective of tone, all authors agree on the alleviation of suffering as a fundamental nursing responsibility. However, they differ in their analysis of this responsibility in relation to other values in end-of-life care, including those that depend on consciousness. Finally, authors emphasize the importance of subjective and experience-based understandings of palliative sedation, which they argue as depending on nurses’ proximity to patients and families in end-of-life care. Discussion and conclusion: Based on our findings, we develop three recommendations for future writing by nurses about palliative sedation. These relate to the responsibility of recognizing how consciousness might matter in (some) peoples’ moral experiences of death and dying, to the importance of moral reflectiveness in nursing practice, and to the value of a relational approach in conceptualizing the nursing ethics of palliative sedation. The pandemic reveals; the novel coronavirus pandemic has brought the historically rooted inequities of our society to the forefront. We argue that an intersectional analysis is needed to further help peel back the veil that the pandemic has begun to reveal. We identify structural gendered racism—the totality of interconnectedness between structural racism and structural sexism in shaping race and gender inequities—as a root cause of health problems among Black women and other women of color, which has been amplified during the (...) pandemic. We show that women of color occupy disadvantaged positions within households, occupations, and health care institutions, and therefore face heightened risk for COVID-19 and lowered resources for mitigating the impact of the deadly virus. Intersectional analyses and solutions must be centered to also reveal, we hope, a new way forward. (shrink)

I assess Edwards' two principal arguments against Deflationary conceptions of Truth and argue that neither is fully successful, then revisit the ‘Inflationary’ argument of chapter 1 of Truth and Objectivity. A case is outlined for a more variegated account of the opposition between realist and anti-realist views of different regions of thought than Edwards' account permits.

In this paper, I set out a new Kantian approach to resolving conflicts between moral obligations for highly autonomous machine agents. First, I argue that efforts to build explicitly moral autonomous machine agents should focus on what Kant refers to as duties of right, which are duties that everyone could accept, rather than on duties of virtue (or “ethics”), which are subject to dispute in particular cases. “Moral” machines must first be rightful machines, I argue. I then show how this (...) shift in focus from ethics to a standard of public right resolves the conflicts in what is known as the "trolley problem" for autonomous ma-chine agents. Finally, I consider how a deontic logic suitable for capturing duties of right might meet Kant’s requirement that rightfully enforceable obligations be consistent in a system of equal freedom under universal law. Why must we respect others’ rights to dispute scientific knowledge such as that the Earth is round, or that humans evolved, or that anthropogenic greenhouse gases are warming the Earth? In this paper, I argue that in On Liberty Mill defends the freedom to dispute scientific knowledge by appeal to a novel social epistemic rationale for free speech that has been unduly neglected by Mill scholars. Mill distinguishes two kinds of epistemic warrant for scientific knowledge: 1) the positive, direct evidentiary (...) warrant that scientific experts construct for their knowledge by applying the methods Mill had set out in his A System of Logic, Ratiocinative and Inductive, and 2) a social testimonial warrant that the non-expert “public” has for what Mill refers to as their “rational[ly] assur[ed]” beliefs on scientific subjects. Mill does not argue that scientific claims can never be proven true with complete practical certainty to scientific experts, nor does he argue that scientists must engage in free debate with critics such as flat-earthers in order to fully understand the grounds of their scientific knowledge. Instead, Mill argues that in the absence of the freedom to dispute scientific knowledge, non-experts cannot establish that scientific experts are credible sources of testimonial knowledge. To establish the credibility of scientific expert speakers, non-expert audiences must have a rational assurance, Mill argues, that experts have satisfactory answers to objections that might undermine the positive, direct evidentiary proof of scientific knowledge. But since non-experts cannot distinguish objections that undermine such expert proof from objections that do not, censorship of any objection — even the irrelevant objections of literal or figurative flat-earthers — will prevent non-experts from determining whether scientific expert speakers are credible. Hence, while censoring irrelevant objections would not undermine the positive, direct evidentiary warrant that scientific experts have for their knowledge, doing so would destroy the non-expert, social testimonial warrant for that knowledge. The asymmetry between how expert scientific speakers and non-expert audiences warrant their scientific knowledge is what both generates and necessitates Mill’s social epistemic rationale for the “absolute” freedom to dispute it. The concept of biological mimicry is viewed as a ‘process of life’ theory rather than a ‘process of change’ theory—regardless of the historical interest and heuristic value of the subject for the study of evolution. Mimicry is a dynamic ecological system reflecting the possibilities for mutualism and parasitism created by a pre-established bipartite signal-based relationship between two organisms – a potential model and its signal receiver (potential operator). In a mimicry system agency and perception play essential, interconnected roles. Mimicry thus (...) describes emergent biologically meaningful relationships based on synergy, and is not an object-based theory. Biosemiotics offers a particularly valuable discipline for analysing the dynamics and nuances of mimicry systems, and can thus pave the way for a better and more complete understanding of how mimicry has evolved in the past, and how it might evolve in the future—presented here with special reference to the need for an integrated, ‘third way of evolution’ approach to biological relativity. Neo-Aristotelian ethical naturalists argue that moral norms are natural norms that apply to human beings. A central issue for neo-Aristotelians is to determine what belongs to the good human life; the question is complicated, since we take up a diversity of different lives, many of which seem good, and it seems unclear what the human species-characteristic life really is. The Aristotelian tradition gives some guidance on this question, however, because it describes us as rational animals with intellectual and appetitive powers; (...) the perfection of those powers is what makes us good qua human. This is especially well spelled out in Thomas Aquinas; he takes moral virtues of courage and temperance to be perfections of our sense appetites, a power of going for things presented as good through our senses. These virtues thereby shape our passions, specifically the passions of fear, daring and concupiscent love, which are a result of the sense appetites pursuing what appears as good. This view provides a framework for virtue, which can then be taken as the perfections of distinct powers shared by all human beings, though actualized in a variety of ways. In this article, I will focus on the passion of fear, which I here describe, following Aquinas, as a movement of sense appetite away from evils that are difficult or impossible to avoid. My focus will be on showing that this passion is necessary, irreplaceable by our cognitive powers, and that the underlying sensitive appetites that produce fear must be perfected for any human being to count as good. The Chicago school of pragmatism was one of the most controversial and prominent intellectual movements of the late 1800s and early 1900s. Spanning the ferment of academic and social thought that erupted in those turbulent times in America, the Chicago pragmatists earned widespread attention and respect for many decades. They were a central force in philosophy, contesting realism and idealism for supremacy in metaphysics, epistemology and value theory. Their functionalist views formed the Chicago school of religion, which sparked intense scrutiny (...) into the real meaning of theism, religious experience and the role of religious values in society. Their social standpoint on psychology generated the Chicago school of sociology, social psychology and symbolic interactionism that dominated the social sciences until the 1960s. Their educational philosophy was a major component of progressivism, aiming to make schools more responsive to the democratic and industrial character of the country. In economics, labour issues, civil rights and liberal politics, the Chicago school was also impossible to ignore This four-volume set focuses on the cornerstones of the thought grounding such intellectual activism: their philosophies of human nature, intelligence, values and social purpose. While other collections of the writings of the most prominent Chicago pragmatists (John Dewey, George Mead and James Tufts) offer some of their own individual work, no other collection captures the entire breadth and depth of the movement as a whole. Hegel's Philosophy of Right was his last systematic work and the most complete statement of his mature views on ethical and political philosophy. It explores the relationships between three distinct conceptions of human freedom: persons as possessing contract rights, subjects as reflective moral agents, and individuals as members of an ethical community. It strongly influenced the early Marx and with the rise of debates over liberalism and communitarianism in the latter half of the twentieth century. This chapter develops an account of epistemic nihilism—roughly, the rejection of truth’s intrinsic or instrumental value in favor of statements that reject or obscure truth to secure an advantage for the speaker—by examining three instances of such nihilism: lying, bullshit, and trolling. It further argues that epistemic nihilism, exacerbated by changes in the media landscape, can pose a significant threat to liberal democratic institutions and ideals by undermining the democratic ideal of good faith engagement on a level playing field, while (...) also encouraging undemocratic actions (e.g., terrorism) among interlocutors who take the nihilist’s claims seriously. Finally, this chapter argues that in extreme cases, we are justified in denying epistemic nihilists a platform from which to speak by drawing a parallel with vexatious litigant laws that deny individuals the right to petition courts for redress on the grounds that abuse of that right results in significant harm to both individuals and the legal system itself.
