This article employs newly discovered Warring States texts to reexamine questions regarding the use of the word mother in the Laozi—did it refer to the feminine role of providing and caring for the descendants of an inherently male cosmic and social order or was it simply a metaphor for an abstract philosophical concept? The author reinforces the latter interpretation suggesting that Mother referred to that existential moment of temporal transition between the cycle of life and death.

This essay examines the language of the Heng Xian and suggests that the text purposefully plays with Ru-style rhetoric, particularly that associated with the “Heart Method” for self-cultivation. The playful rhetoric is reminiscent of writings collected in the Zhuangzi and the use of parables associated with fourth century BCE philosopher Hu Shi.

Numerous recent discoveries in China of ancient tombs have greatly increased our knowledge of ritual and religious practices. These discoveries include excavated oracle bones, bronze, jade, stone and pottery objects, and bamboo manuscripts dating from the twelfth to fourth century BCE. Inscribed upon these artifacts are a large number of records of numerical sequences, for which no explanation has been found of how they were produced. Structural links to the Book of Changes, a divination manual that entered the Confucian canon, (...) are evident; yet, the algorithm described therein dates to the slightly later second to first century BCE. By combining archeological and statistical evidence, we propose a new methodology that enables us to reconstruct and test cleromantic techniques which can explain how these numerical sequences were generated. Dice and divination stalk use, either in combination or separately, appear in fact to have been underlying the rather stable numerical patterns in ancient China all the way back to the late Shang dynasty (1300–1046 BCE). Bringing to light such a long-standing technique, which awaits further confirmation from the ever-growing database of newly discovered numerical and textual records, can change drastically our understanding of early Chinese history and of the historical development of sophisticated arithmetical practices and the rationalization of chance. For liberal contractarians, moral and political principles are justified if agreeable to persons as free and equals. But for critics of liberal contractarianism, this justification applies only to those capable of agreement. Understanding why contractarianism suffers from the problem of exclusion helps up understand the distinctive character of contractarianism and the importance of agreement in particular. I suggest contractarianism need not be objectionably exclusive. I first consider why agreement is important in contractarianism, and then introduce the main versions of contemporary (...) contractarianism and their different understandings of agreement. I discuss how agreement results in exclusion in each, and distinguish two kinds of response to the problem of exclusion: differential inclusion and permissive inclusion. Differential inclusion is unsuccessful because it offers those not fully capable of agreement unequal status. Permissive inclusion may either make the circumstances of agreement more open, or characterize the capacities required for inclusion more permissively. I advocate the latter as the most promising response to the problem of exclusion. I outline a more inclusive contractualism based on the capacity to share goals. (shrink)

First published in 1959, this original study argues that the main characteristic of music is that it expresses and evokes emotion, and that all composers whose music has a tonal basis have used the same, or closely similar, melodic phrases, harmonies, and rhythms to affect the listener in the same ways. He supports this view with hundreds of musical examples, ranging from plainsong to Stravinsky, and contends that music is a language in the specific sense that we can identify idioms (...) and draw up a list of meanings. The book's final section analyzes two symphonies, Mozart's Fortieth and Vaughan Williams's Sixth, to explore the nature of musical inspiration and the process whereby the notes actually convey emotion from composer to listener. Ethnography in the field of postsecondary education has served as a magnifying glass bringing into focus university culture and student life. This paper highlights the ways in which ethnography is especially useful for understanding more recent dynamics and shifts in higher education. The authors utilize existing literature to uphold the relevancy of ethnography, while exploring its opportunities for research on adult students, online education, and for-profit colleges in particular. This article builds on recent accounts of diffuse and complex agentic practices in the global South by drawing on ethnographic data gathered in northwestern Ghana among the Dagaaba. Contemporary feminist discourses and theories, particularly in contexts in the global South, have sought to draw attention to the multifaceted ways in which women exercise agency in these contexts. Practices that in the past were perceived as instruments of women's subordination or as re-inscribing their oppression have been re/interpreted as agentic. Agentic practices (...) are theorized in more fluid terms than the binary pairing of agent/victim debates permit. Dagaaba contexts are deeply pervaded by beliefs in supernatural power forms, and these forces dis/empower certain forms of agentic acts. This article demonstrates that key factors combining with male power to regulate women's exercise of agency are perceived mystical forces. I argue that, in order not to risk missing agency—or rather “misdescribing” it—in the context of Dagaaba and most parts of sub-Saharan Africa, where the belief in mystical forces is profoundly pervasive, the role of these power forms as important determinants of the form that agentic practices assume—and more broadly, the way power works—needs critical attention in feminist theorizing. Michael Cook's classic study, Commanding Right and Forbidding Wrong in Islamic Thought (Cambridge, 2001), reflected upon the Islamic injunction to forbid wrongdoing. This book is a short, accessible survey of the same material. Using Islamic history to illustrate his argument, Cook unravels the complexities of the subject by demonstrating how the past informs the present. At the book's core is an important message about the values of Islamic traditions and their relevance in the modern world.

In this paper I examine the prospects for a successful neo–logicist reconstruction of the real numbers, focusing on Bob Hale's use of a cut-abstraction principle. There is a serious problem plaguing Hale's project. Natural generalizations of this principle imply that there are far more objects than one would expect from a position that stresses its epistemological conservativeness. In other words, the sort of abstraction needed to obtain a theory of the reals is rampantly inflationary. I also indicate briefly why this (...) problem is likely to reappear in any neo–logicist reconstruction of real analysis. (shrink)

Hospital ethics committees have evolved as a response to complicated legal, ethical, and social dilemmas that accompany modern medicine. In the United States, their growth has been augmented by Joint Commission for the Accreditation of Healthcare Organizations standards and the Patient Self-Determination Act. There appears to be an implicit presumption that all clinical ethics consultation practices are relatively similar. Finally, there is heightened awareness of the needs for quality standards and assessment of the outcomes of ethics consultations.

We are printing, by kind permission of the Law Commission, two sections of the report of the Law Commission on injuries to unborn children. This report was the result of a request to the Law Commission by the Lord Chancellor at the time (Lord Hailsham of Saint Marylebone) to advise on `what the nature and extent of civil liability for antenatal injury should be'. The Law Commission followed its usual practice in such circumstances of consulting various bodies and obtaining expert (...) advice on the subject and then embodying the results in a working paper (Working Paper No. 47 - injuries to unborn children) published on 19 January 1973, which preceded their report (Cmnd 5709). Meanwhile a Royal Commission is considering much wider issues of civil liability for injury (including antenatal injury) but the terms of reference for the Law Commission were much narrower and confined to the position of children injured before birth. In the section relating to the present law the report makes it clear that it is probable that liability under the common law already exists. The Scottish Law Commission has also issued a report (Cmnd 5371). They were given different terms of reference and came to somewhat different conclusions. We are printing from this long report the paragraphs discussing the medical background and the summary of recommendations. As will be evident on reading the paragraphs on the medical background to injuries to the unborn child, events are moving very rapidly, particularly in the study of congenital defects and the effects of drugs but the problems of proof present great difficulty. Other causes of injury to the unborn child are better known to the general public: for example, those following the illness, infection and disease of the mother during pregnancy, injury caused in attempted termination of pregnancy and the risks resulting from the mother's condition. The summary of the recommendations sets out very clearly the legal position of the unborn child, as the Law Commission sees it, arising from injury before birth, the final conclusion being that `legislation is desirable'. These extracts from the report, apart from their intrinsic interest, lead on to the paper by Mr Kennedy and Dr Edwards in which they set out their criticisms of it, and provide quick references to the original document. Relevant semiotic theory is meaningfully integrated into each chapter.

The Agriculture, Food and Human Values Society and the journal _Agriculture and Human Values_ provided a crucial intellectual space for the early transdisciplinary critique of the industrial agrifood system. This paper describes that process and presents the concept of “The Doctors of Agrifood Studies” as a metaphor for the key role critical agrifood social scientists played in documenting the unsustainability of conventional agriculture and working to create an alternative, ethical, sustainable agrifood system. After the introduction, the paper details the “Critical (...) Turn” in agrifood studies, followed by a reconsideration of my “Four Questions” framework, focusing on the current tension between the food security and food sovereignty discourses and movements. For Martin, the right to free higher education may be claimed only by those ready and willing pursue autonomy supporting higher education. The unready and unwilling, among whom may be counted carers, disabled, and devout, are excluded. This is unjust. I argue that this injustice follows from a tension between three elements of Martin’s argument: (1) a universal right to autonomy supporting higher education; (2) qualifications on entitlements to access this right in order to preserve the value of higher educational (...) goods; (3) luck egalitarian motivations in Martin’s distributive ethics. I consider options for avoiding such injustices and their implications for Martin’s argument. (shrink)

The Parmenides is notorious for the criticisms it directs against Plato's own Theory of Forms, as presented in the middle period. But the second and major portion of the dialogue has generally been avoided, despite its being offered as Plato's response to the problems; the text seems intractably obscure, appearing to consist of a series of bad arguments leading to contradictory conclusions. Carefully analyzing these arguments and the methodological remarks which precede them, Meinwald shows that to understand Plato's response we (...) need to recognize his important distinction between two kinds of predication. Read in the light of this distinction, the arguments can be seen to be sound, and the contradictions merely apparent. Meinwald then proceeds to demonstrate the direct application of Plato's crucial innovation in solving the problems of the first part of the dialogue, including the infamous Third Man. On Meinwald's interpretation, the new distinction is associated with developments in metaphysics which take Plato well beyond the problems commonly thought to tell against Platonism. (shrink)

In one of his many metaphorical turns of phrase – a leitmotif in The Philosophical Discourse of Modernity — Jürgen Habermas speaks of the path not taken by modern philosophers, a path that might have led them towards his own intersubjective notion of communicative reason. Habermas is especially critical of his predecessors, Theodor W. Adorno and Max Horkheimer, because, he believes, they repudiated the rational potential in the culture of modernity. Whenever Adorno and Horkheimer heard the word ‘culture’, they apparently (...) reached for their revolvers. By the 1940s, their confidence in modern culture had allegedly succumbed to bitter disillusionment. Indeed, on Habermas's view, the confidence of these early critical theorists had been shaken so badly by the emergence of Nazism and Stalinism that their scepticism finally embraced reason itself, ‘whose standards ideology critique had found already given in bourgeois ideals’. Consequently, Adorno and Horkheimer were forced to call into question their own immanent critique of modernity: ideology critique itself came ‘under suspicion of not producing truths’. These philosophers supposedly had little choice but to render their now suspect critique ‘independent even in relation to its own foundations’. (shrink)
