Most research on student plagiarism defines the concept very narrowly or with much ambiguity. Many studies focus on plagiarism involving large swaths of text copied and pasted from unattributed sources, a type of plagiarism that the overwhelming majority of students seem to have little trouble identifying. Other studies rely on ambiguous definitions, assuming students understand what the term means and requesting that they self-report how well they understand the concept. This study attempts to avoid these problems by examining student perceptions (...) of more complex citation issues. We presented 240 students with a series of examples, asked them to indicate whether or not each should be considered plagiarism, and followed up with a series of demographic and attitudinal questions. The examples fell within the spectrum of inadequate citation, patchwriting, and the reuse of other people’s ideas. Half were excerpted from publicized cases of academic plagiarism, and half were modified from other sources. Our findings indicated that students shared a very strong agreement that near verbatim copy and paste and patchwriting should be considered plagiarism, but that they were much more conflicted regarding the reuse of ideas. Additionally, this study found significant correlation between self-reported confidence in their understanding and the identification of more complex cases as plagiarism, but this study found little correlation between academic class status or exposure to plagiarism detection software and perceptions of plagiarism. The latter finding goes against a prevailing sentiment in the academic literature that the ability to recognize plagiarism is inherently linked to academic literacy. Overall, our findings indicate that more pedagogical emphasis may need to be placed on complex forms of plagiarism. (shrink)

In 1981, Paris and Wilkie raised the open question about whether and to what extent the axiom system did satisfy the Second Incompleteness Theorem under Semantic Tableaux deduction. Our prior work showed that the semantic tableaux version of the Second Incompleteness Theorem did generalize for the most common definition of appearing in the standard textbooks.However, there was an alternate interesting definition of this axiom system in the Wilkie–Paris article in the Annals of Pure and Applied Logic 35 , pp. 261–302 (...) which we did not examine in our year-2002 article in the Journal of Symbolic Logic. Our first goal is to show that the incompleteness results of our prior paper can generalize in this alternate context. We will also develop a formal analysis, using a new technique called Passive Induction, that is simpler than the formalism we had used before.A further reason our results are of interest is that we have shown in a companion paper published in Electronic Notes in Theoretical Computer Science 165 , pp. 213–226 that some very unorthodox axiomizations for are anti-thresholds for the Herbrandized version of the Second Incompleteness Theorem. Thus, different axiomizations for have nearly fully opposite incompleteness properties.This paper is self-contained. It will not require a knowledge of our earlier results. (shrink)

Players of electronic games, particularly on-line role-playing games, may invest a substantial degree of time, effort, and personal identity into the game scenarios they generate. Yet, where the wishes of players diverge from those of game publishers, the legal and ethical interests of players remain unclear. The most applicable set of legal principles are those of copyright law, which is often grounded in utilitarian justifications, but which may also be justified on deontological grounds. Past copyright cases involving video arcade and (...) per-sonal computer gaming suggest that the gaming scenaria generated by players may constitute original selec-tion and arrangement of the game elements, thus qualifying such gaming sequences for copyright protection as either derivative works or works of joint authorship. But this result may be difficult to justify on utilitarian theories. Rather, the personal investment of game players suggests a deontological basis for claims of game sequence ownership. (shrink)

Many scientists have until recently considered consciousness to be unsuitable for scientific research. As Damasio remarks, 'studying consciousness was simply not the thing to do before you made tenure, and even after you did it was looked upon with suspicion' . Prompted by technological developments as well as conceptual changes, this attitude has changed within the last decade or so, and an explanation of consciousness is currently seen by many as one of the few remaining major unsolved problems of modern (...) science. It has become customary to describe this change in terms of an ongoing 'Consciousness Boom'. What is occasionally forgotten, however, is that although contemporary main stream neuroscience might only recently have started to investigate consciousness, the topic is by no means a terra incognita for those familiar with the philosophical tradition. Since the beginning of the modern era, consciousness has been subjected to intense investigations by such diverse thinkers as Descartes, Locke, Leibniz, Hume, Kant, Hegel, Kierkegaard, Nietzsche, James, Dilthey, Bergson and many others. As for more recent times, consciousness and subjectivity have been of main concern to phenomenologists throughout the twentieth century, whereas the interest in these issues in analytical philosophy has only been particularly evident in the last ten to fifteen years. The majority of the systematic investigations in analytical philosophy have moreover been conducted in a rather ahistorical manner, with no particular attention being paid to the possible resources of the tradition. But by ignoring the tradition one might miss out on important insights that in the best of circumstances end up being rediscovered decades or centuries later. (shrink)

This work explores the paradigms which generated the state ideology before the modern times in the only case in which the genuine existence of it can be proven: the Byzantine State. Byzantium is the only pre-modern society that has fulfilled the criteria which define the existence of a state that has, among others, a vast bureaucratic mechanism, propaganda instruments and an ideology. This study targets, in particular, the meanings received by the ideological in the Byzantine horizon, the connotations which the (...) high official or the common people had when being the subject for the ideological message. These connotations cannot be understood if we do not take into account the meaning and use which philosophy had in the Byzantine cultural model, a different sense and use from what modernity accredited as philosophy. Empirical evidence indicates that bereaved spouses are surprisingly muted in their responses to their loss, and that after a few months many of the bereaved return to their emotional baseline. Psychologists think this is good news: resilience is adaptive, and we should welcome evidence that there is less suffering in the world. I explore various reasons we might have for regretting our resilience, both because of what resilience tells us about our own significance vis-à-vis loved ones, and because resilience may (...) render us incapable of comprehending how things really stand, valuewise. I also compare our actual dispositions to extreme alternatives (“sub-resilience” and “super-resilience”), and consider whether we might endorse (plain) resilience as a kind of mean. (shrink)

What makes a mental representation about what it's about? The majority view among naturalists seems to be that representation has something to do with causation, or information, or correlation, or some other related notion. But such "information-based" views (e.g. Fodor, Prinz, Stalnaker, Usher, Mandik, Tye, and lots of other people who gesture towards this kind of theory1) cannot accommodate representation of the distal.

Libertarians often emphasize courts’ potential to alleviate pollution problems without the need for legislation and regulation. However, this chapter argues courts cannot completely replace these other tools. Because of the historical conditions in which pollution law develops, we should expect courts in industrial societies to initially develop legal standards that deliver limited protection against many common pollution threats. As societies grow wealthier and citizens begin favoring stricter defenses against pollution, courts honoring longstanding precedents will struggle to keep pace with changing (...) priorities. Because legislators and regulators are authorized to create and alter laws deliberately in a way judges are not, they can perform an essential function by updating legal standards amidst changing circumstances. Libertarianism stands the best chance of addressing the challenges pollution creates by allowing each branch of the liberal division of powers to perform its role, not by substituting the judiciary for all other branches. In these writings by one of our most creative legal philosophers, Meir Dan-Cohen explores the nature of the self and its response to legal commands and mounts a challenge to some prevailing tenets of legal theory and the neighboring moral, political, and economic thought. The result is an insider's critique of liberalism that extends contemporary liberalism's Kantian strand, combining it with postmodernist ideas about the contingent and socially constructed self to build a thoroughly original perspective on some of the most (...) vital concerns of legal and moral theory.Dan-Cohen looks first at the ubiquity of legal coercion and considers its decisive impact on the nature of legal discourse and communication, on law's normative aspirations and claim to obedience, and on the ideal of the rule of law. He moves on to discuss basic values, stressing the preeminence of individual identity and human dignity over the more traditional liberal preoccupations with preference-based choice and experiential harm. Dan-Cohen then focuses more directly on the normative ramifications of the socially constructed self. Fundamental concepts such as responsibility and ownership are reinterpreted to take account of the constitutive role that social practices--particularly law and morality--play in the formation of the self.Throughout, Dan-Cohen draws on a uniquely productive mix of philosophical traditions and subjects, blending the methods of analytic philosophy with the concerns of Continental philosophers to reconceive the self and its relation to ethics and the law. This article deals with choice-inducing algorithms––algorithms that are explicitly designed to affect people’s choices. Based on an ethnographic account of three Israeli data analytics companies, I explore how algorithms are being designed to drive people into choice-making and examine their co-constitution by an assemblage of specifically positioned human and nonhuman agents. I show that the functioning, logic, and even ethics of choice-inducing algorithms are deeply influenced by the epistemologies, meaning systems, and practices of the individuals who devise and use them (...) and that such algorithms are similarly affected by interorganizational relationships, various nonhuman agents, and changing geopolitical contexts. I conclude by discussing the flexibility of choice-inducing algorithms and by arguing that such algorithms are not programmed to induce specific choices but to more generally convert people into choosers, and thus, to algorithmically create the modern need to choose. This article contributes to the growing literature on algorithms and culture and to our understanding of choice-making in contemporary life. At the same time, it provides a new vocabulary that offers to critically engage with algorithms and their power without losing sight of the often very specific contexts from which they arise. The dominant methodology in health policy for prioritizing and rationing health care resources is cost-effectiveness analysis, typically using quality adjusted life years (QALYs) or disability adjusted life years (DALYs) to measure health outcomes. The construction of these measures involves a number of moral or value choices, including: How should states of health and disability be evaluated, and whose preferences (e.g., the disabled or non-disabled) should be used? How should these evaluations reflect that prioritization will involve tradeoffs between health benefits for (...) different persons or groups? Do all QALYs count equally, no matter what age at which they are received? Should discount rates be applied to health benefits? I will show the nature of the moral issues at stake in answering these questions, and briefly argue how they should be answered. (shrink)

Paul Taylor has argued that all living organisms have equal inherent worth. David Schmidtz objects, insisting that there is little to be gained by talk of “equality” in interspecific contexts. On Schmidtz’s view, ethicists should be satisfied simply to say that all organisms deserve respect, while leaving unspecified how such claims to respect measure up to one another. Yet in this paper, I contend that Schmidtz’s position cannot be sustained in the face of predictable and ongoing conflict between species. When (...) sacrifices of some organisms’ interests and lives are inevitable, it is facile to demand simply that all living things deserve respect. Ethicists must be able to say how such conflicts are to be resolved, which means that they must have something to say about how organisms and their interests compare to one another in their moral significance. Paul Taylor may be wrong to think that such questions should be answered by appeal to the moral equality of all living things, but his mistake lies in thinking that all beings’ natures as “teleological centers of life” captures all that is relevant from a moral point of view.
