Re-consent in research, the asking for a new consent if there is a change in protocol or to confirm the expectations of participants in case of change, is an under-explored issue. There is little clarity as to what changes should trigger re-consent and what impact a re-consent exercise has on participants and the research project. This article examines applicable policy statements and literature for the prevailing arguments for and against re-consent in relation to longitudinal cohort studies, tissue banks and biobanks. (...) Examples of re-consent exercises are presented, triggers and non-triggers for re-consent discussed and the conflicting attitudes of commentators, participants and researchers highlighted. We acknowledge current practice and argue for a greater emphasis on ‘responsive autonomy,’ that goes beyond a one-time consent and encourages greater communication between the parties involved. A balance is needed between respecting participants' wishes on how they want their data and samples used and enabling effective research to proceed. (shrink)

BackgroundGenealogical research and ancestry testing are popular recreational activities but little is known about the impact of the use of these services on clients’ biological and social families. Ancestry databases are being enriched with self-reported data and data from deoxyribonucleic acid analyses, but also are being linked to other direct-to-consumer genetic testing and research databases. As both family history data and DNA can provide information on more than just the individual, we asked whether companies, as a part of the consent (...) process, were informing clients, and through them clients’ relatives, of the potential implications of the use and linkage of their personal data.MethodsWe used content analysis to analyse publically-available consent and informational materials provided to potential clients of ancestry and direct-to-consumer genetic testing companies to determine what consent is required, what risks associated with participation were highlighted, and whether the consent or notification of third parties was suggested or required.ResultsWe identified four categories of companies providing: 1) services based only on self-reported data, such as personal or family history; 2) services based only on DNA provided by the client; 3) services using both; and 4) services using both that also have a research component. The amount of information provided on the potential issues varied significantly across the categories of companies. ‘Traditional’ ancestry companies showed the greatest awareness of the implications for family members, while companies only asking for DNA focused solely on the client. While in some cases companies included text recommending clients inform their relatives, showing they recognised the issues, often it was located within lengthy terms and conditions or privacy statements that may not be read by potential clients.ConclusionsWe recommend that companies should make it clearer that clients should inform third parties about their plans to participate, that third parties’ data will be provided to companies, and that that data will be linked to other databases, thus raising privacy and issues on use of data. We also suggest investigating whether a ‘generational consent’ should be created that would include more than just the individual in decisions about participating in genetic investigations. (shrink)

In recent years, feminist scholarship on emotional labor has proliferated. I identify a related but distinct form of care labor, hermeneutic labor. Hermeneutic labor is the burdensome activity of: understanding and coherently expressing one’s own feelings, desires, intentions, and movitations; discerning those of others; and inventing solutions for relational issues arising from interpersonal tensions. I argue that hermeneutic labor disproportionately falls on women’s shoulders in heteropatriachal societies, especially in intimate relationships between women and men. I also suggest that some of (...) the gendered burdens of emotional labor that feminist scholars point out would better be described as hermeneutic labor. Drawing on feminist philosophy as well as findings from social psychology and sociology, I argue that the exploitation of women’s hermeneutic labor is a pervasive element of what Sandra Bartky calls the ‘micropolitics’ of intimate relationships. The widespread expectation that women are relationship maintenance experts, as well as the prevalence of a gendered demand-withdraw pattern of communication, leads an exploitative situation to appear natural or even desirable, even as it leads to women’s dissatisfaction. This situation may be considered misogynistic in Kate Manne’s sense, where misogyny is a property of social environments rather than a worldview. (shrink)

An entry on the meaning and history of emergence as well as the current debate on emergentism in philosophy and the sciences.

Rather than as a giving of permission to someone to transgress one’s bodily boundaries, I argue for defining sexual consent as feeling-with one’s sexual partner. Dominant approaches to consent within feminist philosophy have failed to capture the intercorporeal character of erotic consciousness by treating it as a form of giving permission, as is evident in the debate between attitudinal and performative theories of consent. Building on the phenomenology of Maurice Merleau-Ponty, Ann Cahill, Linda Martín Alcoff, and others, I argue that (...) taking consent to be an intercorporeal and dynamic coexistence of desiring bodies opens up new ways of thinking about the role of consent in sexual ethics. I suggest that phenomenology’s theories of embodied consciousness, operative intentionality, and the direct perception of others provide a better groundwork for conceptualizing the role of ambiguity and subtle power dynamics in sexual encounters than attitudinal or performative accounts of consent. I also defend my view against Jonathan Jenkins Ichikawa’s argument for doing away with the concept of consent in sexual ethics due to consent's stubborn and infelicitous presupposition of permission-giving. An argument is presented to the effect that the ability to feel or to experience meaning conditions the ability to mean, and is thus essential to our notion of meaning. The experience of meaning is manifested in the "fine shades" of use and behavior. Theses, so obvious in music, constitute understanding music, which makes music understanding so relevant to understanding language. Applying these notions of understanding, feeling, and experience--as well as their explication in terms of comparisons, internal relation, and mastery (...) of technique--to music, where they are so apt and natural, is fertile both for the philosophy of language and the philosophy of music. Sacred Harp singers the world over gather weekly to sing out ofThe Sacred Harp, a collection of shape-note songs first published in 1844. Their tradition is highly ritualized, and it plays an important role in the lives of many participants. Following the implementation of lockdown protocols to combat the COVID-19 pandemic, groups of Sacred Harp singers quickly and independently devised a variety of means by which to sing together online using Zoom, Jamulus, and Facebook Live. The rapidity and creativity with (...) which Sacred Harp singers developed ways to sustain their activities attests to the strength and significance of this community of practice, and in this article I describe each modality and provide an account of how it came to be developed and widely used. As a participant-observer, I completed extensive fieldwork across these digital sites and conducted semi-structured interviews with 22 other singers. I found that online singing practices have reshaped the Sacred Harp community. Many singers who did not previously have the opportunity to participate now have access, while others have lost access due to technological barriers or lack of interest in online activities. At the same time, geographical barriers have disintegrated, and singing organizers must make an effort to maintain local identity. A stable community of singers has emerged in the digital realm, but it is by no means identical to the community that predated the pandemic. I also identify the ways in which online singing has proven meaningful to participants by providing continuity in their personal and communal practice. Specifically, online singing allows participants to access and celebrate their collective memories of the Sacred Harp community, carry out significant rituals, and continue to grow as singers. While no single modality replicates the complete Sacred Harp singing experience, together they function “like pieces in a puzzle”, allowing individual participants to access many of the elements of Sacred Harp singing that are most meaningful to them. In this essay I identify three characteristics that I think make philosophy the distinctive discipline that it is: its breadth, the fundamentality of the question it raises and its concern with the question of the difference of what appears to be the case from what is the case. I then argue that philosophy is necessary because it is at heart a very practical discipline. I end by arguing that philosophy has to a large extent lost its characteristic breadth and that (...) it should regain it in order to be able to make a difference in the world. (shrink)

Brute facts are facts that don't have explanations. They are instrumental in our attempts to give accounts of other facts or phenomena, and so they play a key role in many philosophers' views about the structure of the world. This volume explores neglected questions about the nature of brute facts and their explanatory role.

The study of social inequality and stratification has long been at the core of sociology and the social sciences. In this article, I argue that certain tendencies have become entrenched in our dominant paradigm that leave many researchers pursuing coarse-grained analyses of how difference relates to inequality. Centrally, despite the importance of categories and categorization for how researchers study social inequality, contemporary theories of categories are poorly integrated into conventional research. I contend that the widespread and often unquestioned use of (...) state categories as categories of analysis reinforces these tendencies. Using research on colorism as an inspiration, I highlight several components of what I call the infracategorical model of inequality, which urges researchers to disaggregate difference by shifting our focus from membership in categories to the cues of categories, membership in subcategories, and perceived typicality. Kant holds that the whole “higher faculty of knowledge” (‘reason’ or ‘understanding’ in a broad sense), is a spontaneous faculty. But what could this mean? It seems that it could either be a perfectly innocent claim or a very dangerous one. The innocent thought is that reason is spontaneous because it is not wholly passive, not just a slave to what bombards the senses. If so, then the rejection of Hume’s radical empiricism would suffice for Kant’s claim. But the dangerous (...) thought is that reason, and the ‘I think’ which expresses it, is free, having the power to produce something entirely from itself. While this freedom is characteristic of practical reason, could it be characteristic of reason in general, even in its theoretical employment? Some contemporary interpreters have admirably defended the ‘dangerous’ conception by stripping it of the implication that it makes reason in general entirely self-sufficient. I attempt to add to this effort. However, what I contend is that this weightier conception of spontaneity (‘absolute’ or ‘non-relative’ spontaneity) requires abandoning a certain approach to the question that has been assumed by virtually everyone in the debate—namely, that the question can be answered by siding with either the so-called ‘metaphysical’ or the ‘epistemic’ interpreters of Kant. My goal is to suggest that the proper perspective on reason’s spontaneity resists such characterizations all together, and thereby resists any of the conditions under which it could be understood as ‘relative’ to anything. Aristocrats and commoners ultimately must answer to the Final Authority. These concepts are reflected in the Declaration of Independence: "all men are created equal and they are endowed by their Creator with certain unalienable rights -- that among these are life, liberty and the pursuit of happiness." As debates rage over the place of faith in our national life, Tocqueville’s nineteenth-century crediting of religion for shaping America is largely overlooked today. Now, in _Republicanism, Religion, and the Soul of America,_ Ellis Sandoz reveals the major role that Protestant Christianity played in the formation and early period of the American republic. Sandoz traces the rise of republican government from key sources in Protestant civilization, paying particular attention to the influence of the Bible on the Founders and the blossoming (...) of the American mind in the eighteenth century. Sandoz analyzes the religious debt of the emergent American community and its elevation of the individual person as unique in the eyes of the Creator. He shows that the true distinction of American republicanism lies in its grounding of human dignity in spiritual individualism and an understanding of man’s capacity for self-government under providential guidance. The purpose of this paper is to offer a defense of the emergentist view concerning emergent brute facts. To this end, I review and evaluate the three main objections raised against the possibility of emergent brute facts; the simplicity argument, the question of whether the idea of emergent brute facts is a coherent idea and the question of empirical evidence. My contention is that none of these arguments is successful in refuting the possibility or the plausibility of the existence of (...) emergent brute facts. I also argue that, in the end, the question revolves around empirical evidence, and that empirical considerations favour the existence of emergent brute facts. (shrink)

Phenomenologists have long viewed love as a central form of inter-subjective engagement. I show here that it is also of concern to phenomenological ethics. After establishing the relation of phenomenology to ethics, I show that both classical and existential phenomenology view love as an act of valuing the loved one. I argue that a second act of valuing is latent in phenomenology: valuing the relationship. These values are evident in the phenomenological distinction between true love, which generates a “perspective in (...) difference,” and false love, which seeks union with the beloved manifesting in devotion and/or jealousy. Because culturally dominant heteronormative scripts incline individuals toward false love, lovers should create their own pacts for ethical relationships. I consider consensually non-monogamous relationships as an example. (shrink)

Scientific Essentialism defends the view that the fundamental laws of nature depend on the essential properties of the things on which they are said to operate, and are therefore not independent of them. These laws are not imposed upon the world by God, the forces of nature or anything else, but rather are immanent in the world. Ellis argues that ours is a dynamic world consisting of more or less transient objects which are constantly interacting with each other, and whose (...) identities depend on their roles in these processes. Natural objects must behave as they do, because to do otherwise would be contrary to their natures. The laws of nature are, therefore, metaphysically necessary, and consequently, there are necessary connections between events. Brian Ellis calls for the rejection of the theory of Humean Supervenience and an implementation of a new kind of realism in philosophical analysis. (shrink)

This article examines pregnancy as a dyadic body-project within surrogate motherhood arrangements. In gestational surrogacy arrangements, the surrogate mother agrees to have an embryo that has been created using IVF, with the genetic materials of the intended parents or of anonymous donors, surgically implanted in her womb. Based on anthropological fieldwork among Jewish-Israeli surrogates and intended mothers involved in these arrangements, this article focuses upon the interactive identity management practices that the women jointly undertake during the pregnancy. For each side, (...) creating an unambiguous definition of motherhood was central to their individual identity-work. For surrogates, the possible imputations of immorality required redefining pregnant embodiment as separate from maternal identity, while for intended mothers, the surrogate’s embodiment of the pregnancy represented competing claims to their own maternity. Through verbal communication and through practices of disembodiment and vicarious embodiment, the women construct a ‘shifting body’ which they use to designate the social label of pregnancy, identity-building processes associated with pregnant embodiment, and even the lived experience of pregnancy. This example of a dyadic body-project contributes to the existing scholarship on the role of the body in the management of identity. While previous works have examined projects of the body as individualistic pursuits, the shifting body exemplifies that body-projects can be collaborative, dual forms of identity-work and that pregnancy can be the site of these projects. While Simone de Beauvoir’s theory of alterity has been the topic of much discussion within Beauvoir scholarship, feminist theory, and social and political philosophy, it has not commonly been a reference point for those working within ethics. However, Beauvoir develops a novel view that those concerned with the ethical import of respect for others should consider seriously, especially those working within the Levinasian tradition. I claim that Beauvoir distinguishes between two forms of otherness: namely, existential alterity and sociopolitical alterity. While (...) sociopolitical alterity is a contingent and surmountable form of otherness that results from oppression of individuals and groups, existential alterity is a necessary feature of the human condition that discloses the foreignness of the other as a freedom. Out of this view of existential alterity, I argue, Beauvoir develops an ethic of asymmetrical reciprocity. In contrast with Levinas, who dismisses reciprocity as a symmetrical or reversible model of relation that minimizes difference, Beauvoir promulgates a view of reciprocity that does not fall into the problems that Levinas diagnoses. Moreover, asymmetrical reciprocity more successfully figures the ethical relation to the other than the absolute asymmetry one finds in Levinas, which becomes evident through revisiting Levinas’s account of eros and contrasting it with that of Beauvoir. This is a short introduction to animal ethics in which I present the major views in the literature concerning animal ethics and then apply these to questions such as zoos, pets and experimenting on animals. I also address the question of our obligations and duties towards animals and their relation to our obligations and duties to the environment.

At a time when the importance of philosophy, and the humanities in general, is being questioned and at a time when the question of gender equality is a huge public question, 22 women in philosophy lay out in this book how they think of philosophy, what they actually do, and how that is applied to actual problems. Today the way philosophical work is presented is very narrowly circumscribed and as a result, this excludes people who do not want to, or cannot effectively, present their work in a particular manner. This canonization of the mode of presentation of philosophical work also serves to maintain the status quo of analytic philosophy as an exclusively academic discipline. In this paper I argue that diversity in how philosophical thinking is presented should be allowed, and even, encouraged. I argue that it (...) is in philosophy’s interest to expand the ways that it is presented, because not doing so not only limits who can participate in philosophy, but it also limits who philosophy attracts and so how far-reaching philosophy can be. In this paper I argue that thinking in terms of process metaphysics and seeing the mind and mental disorders as processual in nature allows for a more complete understanding of mental disorders than is allowed by non-processual frameworks, while it also allows us to incorporate what we currently know about them. In addition, it can address problems in psychiatry that arise when we ask the wrong kinds of questions that naturally arise within a non-processual metaphysical framework. Scientists and science policy experts understandably wring their hands about the politicization of science and the failure of the general public to recognize good science from bad, good policy from bad. This concern is not new to the scientific community. But the frustration factor is exacerbated by the rising stakes of science illiteracy and politicization in a world in which science plays an increasingly integral part. That said, the usual reaction among the outraged is to scapegoat one or another societal (...) institution: the politicians, of course, but also the religious right, ignorant and underpaid teachers, school boards, journalists and so on. Lost in the passion of the moment is a notion that the community most capable of making a profound difference is "our community" - not by issuing diatribes against "the other culture" but by working to become an integral part of that culture just as science is now - be it in health care, environmental challenges, the response to terrorism and so on - an integral part of society. In lieu of an abstract, here is a brief excerpt of the content:Trains Of Thought And AfterthoughtsJohn EllisWhen I think about how this conference has gone, it’s hard not to begin with the fact that so many came. “We happy few” turned out not to be so few after all.* While I cannot be the most objective judge of a conference that I spent so much time helping to plan, it still seems to me that being able to listen, on (...) two successive evenings, to talks of the quality of Bernard Knox’s and Stanley Crouch’s was a rare treat. Stanley’s talk had the effect that all first-rate criticism must have; it made those who heard it want to rush out and get the book to read or reread it. And I shall long remember Bernard’s anecdote about Aristophanes being subpoenaed, which was just about the funniest and most instructive story I’ve ever heard. Singling out any of the shorter papers is unfair, for I enjoyed all of them, but I have to say that poetry as a genre would not be lagging behind the other genres (fiction and drama) in our age if there were more people who could read poetry like Rosanna Warren.Rather than commenting on how things turned out, I should tell you a little of how we wanted things to turn out, so that you can get your own sense of the relation between our intent and what actually happened. The one stark fact that faced everyone involved in planning this conference was that it was easy to say what we didn’t want to do—we could see examples of that everywhere—but deciding how to chart a new course was an altogether different question. There was one shape [End Page 197] we knew we didn’t want, but there were all kinds of possible shapes we could have chosen to replace it. The program as you heard it was in fact the result of many different trains of thought.Take the panel on poets and critics; it might seem just a nice invention, but was actually the result of a studied train of thought. The most visible sign of what has gone wrong with academic criticism is that it is now largely written for and read by other academic critics. Academic criticism in the process has lost touch with the wider world of readers and writers. Academic critical essays have become a game played on campuses in an increasingly isolated and parochial world where they are heavily involved in matters of professional hierarchy and the place of individuals within it, but in very little else in the real world. The “poets and critics” panel was, in part, an attempt to begin to bring academic criticism back to the reality of readers and writers, to subordinate the unquestionable cleverness and intellectual ingenuity of academics to a common sense and realism that recently seem to have been in somewhat short supply.The panel on how to read a book results from a quite different train of thought. Academic criticism has now assumed a forbidding verbal complexity. A highly elaborate verbal superstructure covers over the essentials of the situation—literature and its readers—to the extent that it becomes a barrier that obscures what is real in it. This panel was in part an attempt to cut through pseudo-complexity and to return to the basic elements of the situation. I might well have said “the basic theory of the situation,” since I’m always reluctant to concede theory to people who have no exclusive claim to it (as they imagine) but merely misuse it.1The notion of “back to basics” really requires no justification. There is a charming story of a man who has played golf all his life, but each year goes back to his first teacher and says to him quite simply: teach me how to play golf. The teacher instructs him as he does anyone else who has never played the game, beginning with how to hold a club, how to stand, and so on. This might seem a rather obsessive habit—unless you know who this man is. One has to assume that this... (shrink)

Stage models are becoming increasingly popular in explaining change from current behavior to more environmentally friendly alternatives. We review empirical applications of a recently introduced model, the stage model of self-regulated behavioral change (SSBC). In the SSBC, change toward pro-environmental behavior takes place in four, qualitatively different stages (predecisional, preactional, actional, and postactional) which are each influenced by constructs taken from theories previously established to describe and predict pro-environmental behavior. We performed a systematic literature search to retrieve peer-reviewed SSBC-based studies. (...) The review includes 10 studies published between 2013 and 2018, six of which employed a cross-sectional, three an interventional and one a correlational longitudinal design. The cross-sectional and longitudinal studies generally support the model, although there are some irregularities that warrant further investigation. The interventional studies found stage-tailored informational measures to be more effective than non-stage-tailored measures in promoting stage progression and behavioral change. Furthermore, we identified several challenges that researchers may face when applying the SSBC. These include whether and how to analyze multiple behavioral alternatives; how to address the challenge of measuring a comprehensive model while keeping questionnaire length manageable; selecting and defining the role of model constructs in a behavioral context while keeping results comparable; and establishing a validated and reliable tool to diagnose a person’s stage of change. Based on these insights, we develop recommendations for researchers designing SSBC studies, in order to support a founded and efficient advancement of the theory which will then serve both researchers and practitioners aiming to promote pro-environmental behavior.
