This study builds on the work of contemporary civic republicans, supplying a detailed analysis of the concept of domination absent in the familiar accounts of political freedom as non-domination.

This masterly study has a grand sweep. It ranges over centuries, with a long look backward over several millennia. Yet the history it unfolds is primarily the story of individuals: thinkers and dreamers who envisaged an ideal social order and described it persuasively, leaving a mark on their own and later times. The roster of utopians includes men of all stripes in different countries and eras--figures as disparate as More and Fourier, the Marquis de Sade and Edward Bellamy, Rousseau and (...) Marx. Fascinating character studies of the major figures are among the delights of the book. Utopian writings run the gamut from fictional narratives to theoretical treatises, from political manifestos to constitutions for a new society. The Manuels have structured five centuries of utopian invention by identifying successive constellations, groups of thinkers joined by common social and moral concerns. Within this framework they analyze individual writings, in the context of the author's life and of the socio-economic, religious, and political exigencies of his time. Concentrating on innovative works, they highlight disjunctures as well as continuities in utopian thought from the Renaissance through the twentieth century. This article aims to offer a refined way of understanding what we mean by the concepts of meaningfulness and meaning in life. The first step is to separate worthwhileness, as the broadest evaluation of life taking all types of values into account, from meaningfulness, which is seen as one type of intrinsic value along with, for example, well-being, moral praiseworthiness, and authenticity, which I argue are also separate types of intrinsic value. After discussing why we should not settle with the (...) currently popular fitting attitudes analysis of meaningfulness, I argue that the meaningfulness of a life should be seen to be about the positive contribution beyond itself that this particular life is able to make. I show how this analysis is different from previous similar accounts and how it is able to avoid a number of challenges that have troubled these previous accounts, such as the pleasure machine challenge, the results machine challenge, and the doing good unintentionally challenge. I also demonstrate how it is able to account for prototypical examples of meaningful and meaningless lives and how it is compatible with subjectivism, supernaturalism, and objective naturalism, which is seen as a merit. Finally, I conclude with some notes about what could make life meaningful, given the current analysis of meaningfulness itself. (shrink)

We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

While the rule of law is surely a very important good, the familiar discussions found in the literature lead many to conclude that it is either a relatively trivial political ideal, or else a redundant one. What is needed is a new and persuasive defense of the rule of law that properly reflects its great significance for human well being. An important step towards building such an argument is to question a widely-shared but often unnoticed assumption that the rule of (...) law should be understood as a virtue of legal systems. The path is then cleared for a republican argument built on two theses: first, the thought that an ideal society would be one in which no one is the master of anyone else, and second, the thought that our freedom from domination is not natural or pre-institutional. The literature on human mate preferences is vast but most data come from studies on college students in complex societies, who represent a thin slice of cultural variation in an evolutionarily novel environment. Here, I present data on the mate preferences of men and women in a society of hunter-gatherers, the Hadza of Tanzania. Hadza men value fertility in a mate more than women do, and women value intelligence more than men do. Women place great importance on men’s foraging, and (...) both sexes rate character as important. From its start, American philosophy looked beyond Europe's atomistic empiricism toward a continuity between our thought and nature's aesthetic splendor. Jonathan Edwards found beauty in the structure of being reflected in relations among ideas. For Emerson, each of us is a "transparent eyeball" in which nature's beauty fortifies our moral and spiritual agency. At the apex of this tradition is John Dewey, for whom "aesthetic experience [is] the highest mode of human experience" (Henning 55).Although aesthetic theory is usually associated with the cognitive evaluation of art, Dewey explores a broader non-reflective or unconscious dimension. Henning's appropriation of "unconscious"—the cradle of Freud's infantile id—is intentionally provocative. American culture, reflected in academic thought, has largely resisted appeals to subterranean urges and drives. In doing so, however, we perpetuate a myth of rational and moral exceptionalism masking a history of colonialism, oppression, and crass commercialism. In accepting the unconscious, European thought has taken strides to acknowledge and address such ills. Henning wonders whether America might accept "a dynamic unconscious, were it presented with an alternative mythology" (10) and finds a viable candidate in Dewey's underappreciated notion of qualitative immediacy: an "aesthetic (directly felt) connection between ourselves and [End Page 77] the world" (Henning 5). In affirming the unconscious depth of experience, this American reconfiguration welcomes "aesthetic experience back into our philosophical lives" (Henning 5).When embodied meaning supplements cognitive reflection, we come to champion "the sensuous, lived body" as "the primary reality" of qualitative immediacy—a felt aesthetic unity punctuated by "impulsions" arising from an organism's needs (Henning 69). As "a site of adaptive adjustments," Henning continues, "the body is responsive to the brink of coalescence at the point of contact with the world, in which things that are 'outside of it' belong to it" (71). Strong reciprocity is an effective way to promote cooperation. This is especially true when one not only cooperates with cooperators and defects on defectors (second-party punishment) but even punishes those who defect on others (third-party, “altruistic” punishment). Some suggest we humans have a taste for such altruistic punishment and that this was important in the evolution of human cooperation. To assess this we need to look across a wide range of cultures. As part of a cross-cultural project, I played three (...) experimental economics games with the Hadza, who are hunter-gatherers in Tanzania. The Hadza frequently engaged in second-party punishment but they rarely engaged in third-party punishment. Other small-scale societies engaged in less third-party punishment as well. I suggest third-party punishment only became more important in large, complex societies to solve more pressing collective-action problems. (shrink)

Algorithmic decision-making increasingly shapes people's daily lives. Given that such autonomous systems can cause severe harm to individuals and social groups, fairness concerns have arisen. A human-centric approach demanded by scholars and policymakers requires considering people's fairness perceptions when designing and implementing algorithmic decision-making. We provide a comprehensive, systematic literature review synthesizing the existing empirical insights on perceptions of algorithmic fairness from 58 empirical studies spanning multiple domains and scientific disciplines. Through thorough coding, we systemize the current empirical literature along (...) four dimensions: (1) algorithmic predictors, (2) human predictors, (3) comparative effects (human decision-making vs. algorithmic decision-making), and (4) consequences of algorithmic decision-making. While we identify much heterogeneity around the theoretical concepts and empirical measurements of algorithmic fairness, the insights come almost exclusively from Western-democratic contexts. By advocating for more interdisciplinary research adopting a society-in-the-loop framework, we hope our work will contribute to fairer and more responsible algorithmic decision-making. (shrink)

This article reconstructs Badiou’s oeuvre from the vantage point of the last volume of his Being and Event trilogy. It determines the perspective and task of The Immanence of Truths and demonstrates in what way an “absolute ontology” is the result of an act of forcing that serves as the measure for a truth’s truthness. This allows to argue that Badiou’s is and always was a philosophy of freedom.

Menopause is puzzling because life-history theory predicts there should be no selection for outliving one’s reproductive capacity. Adaptive explanations of menopause offered thus far turn on women’s long-term investment in offspring and grandoffspring, all variations on the grandmother hypothesis. Here, I offer a very different explanation. The patriarch hypothesis proposes that once males became capable of maintaining high status and reproductive access beyond their peak physical condition, selection favored the extension of maximum life span in males. Because the relevant genes (...) were not on the Y chromosome, life span increased in females as well. However, the female reproductive span was constrained by the depletion of viable oocytes, which resulted in menopause. (shrink)

In a modern, plural society, there can be no settled agreement on the concrete legal content of a country's constitution. The idea of the constitution is nonetheless pivotal in contemporary, liberal‐minded theories of political justification, such as the ones advanced by Jürgen Habermas and John Rawls. Justification in these theories depends finally on “constitutional patriotism,” a consciously shared sentiment arising from an ethical assessment of their country by the country's people, according to which the country credibly pursues a certain regulative (...) political ideal for which the constitution stands. For several decades, renewed interest in the connection between perception and knowledge has sustained a robust debate over external world skepticism. Recently, however, a growing consensus claims the skeptical challenge has been substantially met, and that realism in some robust form has emerged a clear victor. I invite us to rethink this consensus in a two-part response. The first forges a temporary alliance with skepticism against prominent forms of contemporary realism. That these fail to rebuff ews bolsters Barry Stroud’s call (...) for a new paradigm of objectivity. In the second part I sketch such a paradigm based upon a transactional interpretation of John Dewey’s pragmatism, and indicate its resilience to skeptical attacks. (shrink)

In contrast to educational policies in the U.S., which assume an individualistic path of success and promote the assimilation of students, this essay argues for pedagogies where teachers focus upon facilitating the development of strong relationships en route to creating exciting educational environments and fertile contexts for social justice movements. Powerful teachers model the process whereby a commitment to appreciating the perspectives of individual students is combined with the orchestration of a dynamic intersubjective context, because such contexts call out the (...) strongest performances of individuals. Viewing educational events in terms of the patterns and rhythms that transpire in a particular social fields allows educators ways to create powerful educational environments even in neocolonial contexts that pit students and teachers against one another. Viewing educational events as social fields also allows us to understand how the common classroom, which focuses each student on the material in front of them, creates impotent individuals who dissociate themselves from others. Increasing complexities facing physicians negotiating the bedside decision continue to fuel the debate over who is the appropriate party to offer ethics consults, should one be needed, during the decision-making process. Some very good arguments have been put forth on behalf of clinical ethicists as being the proper and best party to engage in ethics consultations. However, serious questions remain about the role of the clinical ethicist and his ability to provide the necessary level of objectivity called for in an (...) ethics consult.I argue that the clinician's professional psyche, or mode of thinking as a professional, leaves him little room to maneuver as an objective and detached third party ethics consultant. Several factors are cited and discussed that greatly influence the analyses applied to a case problem by physicians. The most formidable of these factors are habits and the practice of defensive medicine. I conclude that clinical ethicists are less suited for the overall tasks required of an objective consultant in medical cases that appear to involve insurmountable ethical issues. (shrink)

The question of what is truly just in the matter of a country's currently established human-rights interpretations appears not to be the same as the question of what it is morally right to do by way of coercively effectuating a given set of such interpretations. There are grounds for contending that acts of support for a coercive political regime can be justified morally on the condition that the regime's prevailing human-rights interpretations are made continuously available to effective, democratic critical re-examination. Ethical decision theory may not be sufficiently well developed to furnish reliable guidelines to people involved in complex decision making that involves conflict between ethical considerations and business imperatives such as making a profit. In conditions of ethical uncertainty hindsight bias may occur, and this study reports on an exploration of hindsight bias effects among participants in continuing education in business programmes. A new hypothesis is proposed to explain the perennially enlarged breasts of human females. The nubility hypothesis proposes that hominid females evolved protruding breasts because the size and shape of breasts function as an honest signal of residual reproductive value. Hominid females with greater residual reproductive value were preferred by males once reliable cues to ovulation were lost and long-term bonding evolved. This adaptation was favored because female-female competition for investing males increased once hominid males began to provide valuable resources.

The Pentecostal understandings of baptism in the Holy Spirit hold potential for a more substantively pneumatological understanding of spiritual formation, but there are conceptual barriers to overcome before this potential can be realized. Specifically, the emphasis of revivalism on crisis experience and individualistic piety must be set within a larger framework that is more expansively ecclesiological and eschatological. A more expansively eschatological view of Spirit baptism can provide this framework, opening breathing room for prioritizing a pneumatological vision of spiritual formation (...) in the life and mission of the church. Spirit baptism can still refer to new breakthroughs in the life of the Spirit but those experiences would be couched within a larger vision of spiritual formation. (shrink)

This article examines a contemporary proposal of how to conceive of materialism, more specifically of a materialist dialectics. This proposal was formulated by Alain Badiou and it is of huge interest for the contemporary discussion as it inscribes the very historical coordinates in which it was articulated into its own proposal. The article develops this by arguing that Badiou's materialist dialectic historically situates itself after idealist options seem to have become impossible. However, the very dialectical kernel of this materialism leads (...) Badiou to claim that after the perpetuated struggle between materialism and idealism is declared to have been overcome, the very split separating the two returns in an inverted form inside materialism, splitting it again into two. Thereby the immanent split in materialism leads to two options: either one defends a materialism devoid of any idealist reference or a materialism which seeks to rescue something of idealism. The article concludes by suggesting that only from a detailed reconstruction of the functioning of philosophy in Badiou's system does it become possible to conceive of the threats that any materialism today faces and to delineate the proposed option of how to avoid them consistently. The article demonstrates how, today, materialism can only be properly materialist by resurrecting something of idealism, which is why it deserves the name of what I call an “idealism without idealism.”. A re-examination of determinism and compatibilism and incompatibilism in free will debates.

This paper articulates the commitments, contours and justifications for a pluralist but non-eclectic critical, realist, reflexive social science with emancipatory aims. In it, we stress that social science can and should be used to guide the conceptualization of desirable and viable forms of social organization and their conditions of realization. In this regard, we advocate explanatory theorizing as an ethical duty of social scientists and as a moral good in itself as well as being an inherent epistemological component of scientific (...) practice. This entails that we take seriously the research strategies apposite to our disciplinary, intertextual and interdiscursive locations to make a serious theoretical case and practical case for the kind of social science here advocated. In our view, such a social science must acknowledge the path-breaking work of Roy Bhaskar, but must also recognize that the arguments deployed in texts as a resource in intellectual work can never be treated as the axiomatic grounds for further thought, but must be interrogated thoroughly and in each case what is to be retained must be defensible. No position has a monopoly of relevant insights and the development of science often involves syntheses. Syntheses must not be syncretic but reflexively interrogated to assess epistemological, ontological and conceptual coherence to avoid eclecticism. Development in critical realist philosophy will, we believe, continue to confront and offer plausible resolutions to a range of battles within and pertinent to philosophy and social-scientific metatheory. However, realists must recognize the continuing importance and discursive effects of a variety of critical and realist work in being able to defend, sustain and develop rigorous social-scientific research with emancipatory commitments.
