This article formulates a novel conception of constitutions based on John Finnis’s jurisprudential work. The ‘central case constitution’ transcends the formal or functionalist analyses currently dominant in constitutional theory by considering a constitution as having a ‘double life’. Constitutions are necessarily and intrinsically normative and factual. The article explores Finnis’s natural law philosophy, emphasizing the central case constitution’s alignment with the practical reasonableness viewpoint and its role in directing a political community towards its common good. Focusing on key elements (...) such as the rule of law and the context of a political community, the central case constitution emerges as a legal determination that structures society, frames political institutions and authoritatively directs communities towards justice. The answer to the question is yes, if such disclosure serves the patients’ well-being and future interests.The patient, Miss M, may have had her own reasons for asking Dr. C not to inform her parents of her condition (...) — perhaps she was worried about their reaction, or believed that such disclosure was unnecessary, because she could already understand, have an opinion and make decisions for herself. In this respect, Article 12 of the United Nations Convention on the Rights of the Child provides assurance for “the child, who is capable of forming his or her own views, the right to express those views freely in all matters affecting” him or her. As a 16-year-old, Miss M plausibly senses her capacity for decision-making that is independent of her parents. Various developmental theories, such as those of Jean Piaget and Lawrence Kohlberg, affirm that her decision-making competence might have reached maturity by age 16.1 Seeing her wishes respected, Miss M may be encouraged to open up to Dr. C and receive suitable medical care or services, which may not be there if confidence in her doctor is broken. Polycomb response elements (PREs) are regulatory switch elements that can direct the genes that they control to be either active or silenced. Once decided, this on or off state is maintained through subsequent cell divisions. We do not know how the switching works, or how it is copied to newly replicated chromosomes. Experiments that switch a silenced PRE to an active state have provided insights into both questions. A PRE switched experimentally can remember its previously silenced state and return to (...) it after several cell divisions. In the most recent study of this phenomen on,(1) the data show that several distinct variables affect the ability of PREs to “remember” and restore their previous state. With a vast majority of the land in the Driftless Region of the Midwestern United States dedicated to agricultural production, the future of farming has significant economic, social, recreational, agricultural, and ecological implications. An important literature stream has developed on ways agriculture can change to impact both human and ecological communities positively. In this study, we examine the processes and extent to which community narratives assert and inform regional identities that shape the meaning of being a good farmer. Using a (...) mixed methods approach, we examine what farmers consider good farming and how they utilize community narratives to assert their perspective of good farming. Employing a correlational analysis, we examined the relative importance of the four dimensions of good farming (productivist, conservationist, civic-minded, and naturalist). In addition, we used narrative analysis to explore the development of community narratives that assert a multi-dimensional view of good farming. Data for this study was collected through 21 semi-structured interviews with farmers, two focus groups of farmers, and a survey of farmers with 82 survey participants. The mean scores for conservationist, civic-minded, and naturalist dimensions were significantly higher than those for productivists. There was no significant correlation between the productivists dimension and the three other dimensions of good farming. Through analysis of transcripts, we identified a community narrative that actively problematized a dominant cultural narrative centered on production agriculture. Collectively, a community narrative is emerging in the Driftless Region that sought to normalize agricultural practices that promote profitable farms, vibrant communities, and a wide array of ecosystem services. A key philosophical feature of Peter Jackson’s film interpretation of J.R.R. Tolkien’s The Lord of the Rings is its use of fantasy to inspire a “recovery” of the actual or, in other words, a reawakening to the beauty of nature and the many possible ways of living in healthier ecological relation to the world. Though none of these ways is perfectly achieved, this pluralistic view is demonstrated in the various lifeways of Hobbits, Elves, Men, and Ents. All of the positive (...) relationships embodied in the films—to trees, mountains, horses, and vegetable gardens—involve loving care and attention, receiving nourishment and livelihood without instrumentalization, or reducing nature to mere resource. The films also vividly display a variety of ugly and destructive ways of using the land to accrue power and wealth. These noxious ways, specifically because they actively destroy the lands that they use, always need more. They will thus eventually annihilate the beautiful ways of being if they are not actively resisted. Some of those who would rather be tending their own trees, gardens, or horses or even wandering in the wild forests must therefore turn their attention to struggle and resistance instead. This is a struggle full of grief, and at times even verging on despair, but it is marked by the refusal to give up hope. Indeed, what Jackson and Tolkien have to say about hope is as important in responding to the ecological crisis as anything they have to say about nature, inasmuch as they help to remind us that even in our own times, “there is still hope.”. Kant’s philosophy of science takes on sharp contour in terms of his interaction with the practicing life scientists of his day, particularly Johann Blumenbach and the latter’s student, Christoph Girtanner, who in 1796 attempted to synthesize the ideas of Kant and Blumenbach. Indeed, Kant’s engagement with the life sciences played a far more substantial role in his transcendental philosophy than has been recognized hitherto. The theory of epigenesis, especially in light of Kant’s famous analogy in the first Critique, posed crucial (...) questions regarding the ‘looseness of fit’ between the constitutive and the regulative in Kant’s theory of empirical law. A detailed examination of Kant’s struggle with epigenesis between 1784 and 1790 demonstrates his grave reservations about its hylozoist implications, leading to his even stronger insistence on the discrimination of constitutive from regulative uses of reason. The continuing relevance of these issues for Kant’s philosophy of science is clear from the work of Buchdahl and its contemporary reception. (shrink)

The first was Evil and the Problem of God, while the second was titled Causing, Perceiving and Believing: An Examination of the Philosophy of C. J. Ducasse (Dordrecht, Holland: D. While previous studies of Dewey's work have taken either a historical or topical focus, Shook offers an innovative, organic approach to understanding Dewey and eloquently shows that Dewey's instrumentalism grew seamlessly out of his idealism. He argues that most current scholarship operates under a mistaken impression of Dewey's early philosophical positions.

The essays in this volume blend historical and philosophical reflection with concern for contemporary political problems. They show that the causes and motivations of civil religion are a permanent fixture of the human condition, though some of its manifestations and proximate causes have shifted in an age of multiculturalism, religious toleration, and secularization.

Practical wisdom and judgment, rather than seen as ‘things’ hidden inside the mind, are best talked of, we suggest, as emerging developmentally within an unceasing flow of activities, in which practitioners are inextricably immersed. Following a performative line of thinking, we argue that when practitioners (namely, individuals immersed in a practice, experiencing their tasks through the emotions, standards of excellence and moral values the practice engenders or enacts) face a bewildering situation in which they do not know, initially at least, (...) how to proceed, the judgment they exercise emerges out of seeking to establish a new orientation to their puzzling surroundings. They do so through actively trying to be in touch with their felt emotions and moral sensibilities, while attempting to articulate linguistically the feelings experienced in order to get a clearer view of relevant aspects of the situation at hand. Coming to a judgment involves moving around within a landscape of possibilities, and in so doing, being spontaneously responsive to the consequences of each move, and assessing which one (or combination of moves) seems best in resolving the initial tension aroused in one’s initial confusion. In this essay I will consider not only what Kant, as a philoso­pher, thought of medicine as a faculty, but what medicine as a faculty thought of Kant as a philosopher.

n 1695 John Locke published The Reasonableness of Christianity, an enquiry into the foundations of Christian belief. He did so anonymously, to avoid public involvement in the fiercely partisan religious controversies of the day. In the Reasonableness Locke considered what it was to which allChristians must assent in faith; he argued that the answer could be found by anyone for themselves in the divine revelation of Scripture alone. He maintained that the requirements of Scripture were few and simple, and (...) therefore offered a basis for tolerant agreement among all Christians, and thepromise of peace, stability, and security through toleration. This is the first critical edition of the Reasonableness: for the first time an authoritative annotated text is presented, with full information about sources, variants, amendments, and the publishing history of the work. In “Causality and Determination,” Anscombe rejects the two received opinions on the nature of causality in the modern philosophical tradition. She rejects the Humean conception of universal generalization based on the constant conjunction in experience of cause and effect, and she also rejects the notion that causality entails a necessary connection between cause and effect. As an alternative, she suggests that the core notion of causality is one of the derivativeness of the effect from the cause. Her consideration of causality (...) ranges generally over all types of causality, but I believe that the most significant implication of her position is in application to the causality of human action. Leonard EMERSON, WHITMAN, AND CONCEPTUAL ART The widespread abandoning of the art object at the end of the 1960s was taken as something radically, even frighteningly, new, by critics and artists alike. Objects, concept artist Joseph Kosuth was asserting by 1969, are "irrelevant" to art. Though an artist might choose, as in the past, to "employ" objects, "all art is finally conceptual." In fact it was now (...) time that the object, nothing more than the "physical residue" of the artist's mental activity, was dispensed with.1 "We / open our eyes and ears seeing life / each day excellent as it is," John Cage chanted: "This / realization no longer needs art...."2 Aestheticians as disparate as Murray Krieger and Harold Rosenberg reacted to this "transfiguration of the commonplace," as Arthur Danto has called it. Danto has gained a wide scholarly audience for his ideas about the 1960s as "the end of art," or at least as the beginning of "post-historical art."3 We know from such works as Renato Poggioli's TL· T^ry oftL· Avant-Garde that, in this century, particular movements have routinely declared themselves to be art's climax.4 Critics like Jacques Barzun and artists like Amedee Ozenfant had been saying for years that art was exhausted. Yet conceptualism's attack on the object struck most critics as something both alarming and new: Irving Sandler wrote in a special edition of the College Art Association's Art Journal devoted to the problem that it demolished "every notion of what art should be,"5 and Murray Krieger feared that this "leap beyond Pop Art" would "complete the obliteration of the realm of art, its objects, its museums...."6 But the conceptualist attacks on the art object were, in fact, not new. One can find attacks as scathing in Emerson and Whitman; so scathing, that criticism has rarely taken them seriously. The attacks the concep297 298Philosophy and Literature tualists mounted in the 1960s were only the culmination ofan intellectual tendency which appeared throughout the West one hundred and sixty years before. It has long been a scholarly commonplace that after 1800 an "intellectual tendency"—as M. H. Abrams finallytermed it—extolling the possibilities of this world emerged in all parts of Western culture. When itappears in literature we nowusually call it, withAbrams, Natural Supernaturalism; or, with Harold Bloom, the "visionary company." Man, Wordsworth decreed, can and must learn to find "Paradise" in "the common day."7 Surprisingly litde work has been done on what happened when this intellectual tendency, Natural Supernaturalism, confronted the art object. Emerson and Whitman can stand for many who were necessarily ill at ease with the idea of art objects as elite objects superior to the common things it was their mission to extol. Wordsworth works before these two; Ruskin develops similar ideas into greater complexity; but since Emerson writes clear expository prose and avoids fanciful terminology, he makes a good place to enter this dark wood. Let us begin with some straightfor-ward, overdue interdisciplinary history, reading Emerson on the art object, noticing similar passages in Whitman, and noting where Emerson has reworked Hegel for his own ends. For Emerson objects are but thought's "inert effect," as for the concept artist Kosuth they would be but the "physical residue" of the artist's activity. Emerson and Kosuth, opposite Shakespeare, do not applaud the art process as the giving to an airy nothing a local habitation and a name; rather they disdain the stuff as petrifactions, as dead mud footprints left by living thoughts diat have raced away.8 In his essay "Circles," Emerson derides our admiration for a work of architecture, directing us to the "litde waving hand" that built it, for "that which builds is better than that which is built." By the same logic, the invisible thoughts which truly wrought the object were even better than the hand and "nimbler."9 When such passages are discussed at all, they are usually considered Platonic,10 but, in his essay "Art," Emerson envisions a use for art objects Plato would have blinked at.
