The importance of legal epidemiology in public health law research has undoubtedly grown over the last five years. Scholars and practitioners together have developed guidance on best practices for the field, including: placing emphasis on transdisciplinary collaborations; creating valid, reliable, and repeatable research; and publishing timely products for use in decision-making and change. Despite the energy and expertise researchers have brought to this important work, they name significant challenges in marshalling the diverse skill sets, quality controls, and funding to implement (...) legal epidemiology activities. The Centers for Disease Control and Prevention has worked to develop cross-cutting research and translation on issues of national priority in legal epidemiology, and has explored ways to overcome some of these challenges. As such, this article describes a case study of the use of law to characterize states' prior authorization policies regarding medication used to treat attention-deficit/hyperactivity disorder, a central component of a broader effort to improve behavior therapy options for young children with ADHD. This article highlights the types of legal epidemiology work we have undertaken, the application of this work to an emerging public health problem, and the lessons learned in creating impactful research for the field. While education in ethics and the responsible conduct of research is widely acknowledged as an essential component of graduate education, particularly in the STEM disciplines, little consensus exists on how best to accomplish this goal. Recent years have witnessed a turn toward the use of games in this context. Drawing from two NSF-funded grants, this paper takes a critical look at the use of games in ethics and RCR education. It does so by: setting the development of research and engineering (...) ethics games in wider historical and theoretical contexts, which highlights their promise to solve important pedagogical problems; reporting on some initial results from our own efforts to develop a game; and reflecting on the challenges that arise in using games for ethics education. In our discussion of the challenges, we draw out lessons to improve this nascent approach to ethics education in the STEM disciplines. (shrink)

Human moral judgement may have evolved to maximize the individual's welfare given parochial culturally constructed moral systems. If so, then moral condemnation should be more severe when transgressions are recent and local, and should be sensitive to the pronouncements of authority figures (who are often arbiters of moral norms), as the fitness pay-offs of moral disapproval will primarily derive from the ramifications of condemning actions that occur within the immediate social arena. Correspondingly, moral transgressions should be viewed as less objectionable (...) if they occur in other places or times, or if local authorities deem them acceptable. These predictions contrast markedly with those derived from prevailing non-evolutionary perspectives on moral judgement. Both classes of theories predict purportedly species-typical patterns, yet to our knowledge, no study to date has investigated moral judgement across a diverse set of societies, including a range of small-scale communities that differ substantially from large highly urbanized nations. We tested these predictions in five small-scale societies and two large-scale societies, finding substantial evidence of moral parochialism and contextual contingency in adults' moral judgements. Results reveal an overarching pattern in which moral condemnation reflects a concern with immediate local considerations, a pattern consistent with a variety of evolutionary accounts of moral judgement. After introducing the new field of cultural evolution, we review a growing body of empirical evidence suggesting that culture shapes what people attend to, perceive and remember as well as how they think, feel and reason. Focusing on perception, spatial navigation, mentalizing, thinking styles, reasoning (epistemic norms) and language, we discuss not only important variation in these domains, but emphasize that most researchers (including philosophers) and research participants are psychologically peculiar within a global and historical context. This rising tide of (...) evidence recommends caution in relying on one’s intuitions or even in generalizing from reliable psychological findings to the species, Homo sapiens. Our evolutionary approach suggests that humans have evolved a suite of reliably developing cognitive abilities that adapt our minds, information-processing abilities and emotions ontogenetically to the diverse culturally-constructed worlds we confront. There is an idea, extremely common among social contract theorists, that the primary function of social institutions is to secure some form of cooperative benefit. If individuals simply seek to satisfy their own preferences in a narrowly instrumental fashion, they will find themselves embroiled in collective action problems – interactions with an outcome that is worse for everyone involved than some other possible outcome. Thus they have reason to accept some form of constraint over their conduct, in order to achieve (...) this superior, but out-of-equilibrium outcome. A social institution can be defined as a set of norms that codify these constraints.1 Simplifying somewhat, one can then say that social institutions exist in order to secure gains in Pareto-efficiency. The Grim Reaper version of this paradox has recently been employed in favor of various finitist metaphysical theses, ranging from temporal finitism to causal finitism to the discrete nature of time. Here, I examine a new challenge to these finitist arguments—namely, the challenge of implying that the future cannot be endless. Eminent political theorist Joseph Carens tests the limits of democratic theory in the realm of immigration, arguing that any acceptable immigration policy must be based on moral principles even if it conflicts with the will of the majority.

The term 'implicit bias' has very swiftly been incorporated into philosophical discourse. Our aim in this paper is to scrutinise the phenomena that fall under the rubric of implicit bias. The term is often used in a rather broad sense, to capture a range of implicit social cognitions, and this is useful for some purposes. However, we here articulate some of the important differences between phenomena identified as instances of implicit bias. We caution against ignoring these differences: it is likely (...) they have considerable significance, not least for the sorts of normative recommendations being made concerning how to mitigate the bad effects of implicit bias. Karl Popper’s “Indeterminism in Quantum Physics and in Classical Physics” suffers unjust neglect. He judged determinism false: the future is open. In principle, replacing Laplace's variant of predetermination with predictable predetermination renders “scientific” determinism scientific and so refutable. Popper claimed that he had refuted it. Now a metaphysical system may have an extension—in the mathematical sense—that may render it explanatory and testable. If it exists, then it is not unique but has many alternative extensions. Popper’s proof is then inconclusive.

This is the first article in a two-part series describing subject and family perspectives from the central thalamic deep brain stimulation for the treatment of traumatic brain injury using the Medtronic PC + S first-in-human invasive neurological device trial to achieve cognitive restoration in moderate to severe traumatic brain injury, with subjects who were deemed capable of providing voluntary informed consent. In this article, we report on interviews conducted prior to surgery wherein we asked participants about their experiences recovering from (...) brain injury and their perspectives on study enrollment and participation. We asked how risks and benefits were weighed, what their expectations and fears were, and how decisions were reached about trial participation. We found that informed consent and enrollment decisions are fraught. Subjects and families were often split, with subjects more focused on putative benefits and families concerned about incremental risk. Both subjects and families viewed brain injury as disruptive to personal identity and relationships. As decisions were made about study enrollment, families struggled with recognizing the re-emergent agency of subjects and ceding decision-making authority to subjects who had previously been dependent upon them for protection and guidance. Subjects and family members reported a hope for the relief of cognitive disabilities, improved quality of life, normalization of interpersonal interactions, and a return to work or school as reasons for study participation, along with altruism and a desire to advance science. Despite these aspirations, both subjects and families appreciated the risks of the intervention and did not suffer from a therapeutic misconception. A second essay to be published in the next issue of Cambridge Quarterly of Healthcare Ethics—Clinical Neuroethics will describe interviews conducted after surgery, the effects of cognitive restoration for subjects, families, and challenges presented to the social structures they will call upon to support them through recovery. Socrates’ official answer to Meno’s question about the value of knowledge, near the end of Plato’s Meno, is that knowledge is stable. I argue that both the answer and the question have been widely misunderstood. The question has been taken to be why knowing at a time is better than true belief at that time, and Socrates’ answer has been taken to point to the greater persistence of knowledge over time. I argue instead that, given the broader context of the (...) question and answer in the Meno, together with what Plato has to say about stability elsewhere, Meno’s question is better understood as a more difficult question – and Socrates’ answer as a good solution to it. This also involves arguing that Socrates’ analogy to the statues of Daedalus is not intended as the simple illustration of Socrates’ official answer for which commentators have taken it. (shrink)

This text provides an extensive exploration of the relationship between the thought of Otto Neurath and Rudolf Carnap, providing a new argument for the complementarity of their mature philosophies as part of a collaborative metatheory of science. In arguing that both Neurath and Carnap must be interpreted as proponents of epistemological naturalism, and that their naturalisms rest on shared philosophical ground, it is also demonstrated that the boundaries and possibilities for epistemological naturalism are not as restrictive as Quinean orthodoxy has (...) previously suggested. Both building on and challenging the scholarship of the past four decades, this naturalist reading of Carnap also provides a new interpretation of Carnap’s conception of analyticity, allowing for a refutation of the Quinean argument for the incompatibility of naturalism and the analytic/synthetic distinction. In doing so, the relevance and potential importance of their scientific meta-theory for contemporary questions in the philosophy of science is demonstrated. This text appeals to students and researchers working on Logical Empiricism, Quine, the history of analytic philosophy and the history of philosophy of science, as well as proponents of naturalized epistemology. This essay takes issue with Alasdair MacIntyre’s denial that teaching is a practice. It does so less by appeal to MacIntyre’s concept of practice than by criticism of his conception of teaching. It argues that this conception, as reconstructed from adversions to teaching in a range of his writings, does less than justice to what good teachers accomplish; and that, if this inadequacy is rectified—as much else in his writings suggests that it ought to be—there are clearer grounds for acknowledging (...) teaching as a practice. This revolution is the subject of Joseph Dauben's important studythe most thorough yet writtenof the philosopher and mathematician who was once called a "corrupter of youth" for an innovation that is now a vital component of elementary school curricula.Set theory has been widely adopted in mathematics and philosophy, but the controversy surrounding it at the turn of the century remains of great interest. His religious beliefs led him to expect paradoxes in any concept of the infinite, and he always retained his belief in the utter veracity of transfinite set theory. Biomedical engineering technologies such as brain–machine interfaces and neuroprosthetics are advancements which assist human beings in varied ways. There are exciting yet speculative visions of how the neurosciences and bioengineering may influence human nature. However, these could be preparing a possible pathway towards an enhanced and even posthuman future. This article seeks to investigate several ethical themes and wider questions of enhancement, transhumanism and posthumanism. Four themes of interest are: autonomy, identity, futures, and community. Three larger questions can be asked: (...) will everyone be enhanced? Will we be “human” if we are not, one day, transhuman? Should we be enhanced or not? The article proceeds by concentrating on a widespread and sometimes controversial application: the cochlear implant, an auditory prosthesis implanted into Deaf patients. Cochlear implantation and its reception in both the deaf and hearing communities have a distinctive moral discourse, which can offer surprising insights. The paper begins with several points about the enhancement of human beings, transhumanism’s reach beyond the human, and posthuman aspirations. Next it focuses on cochlear implants on two sides. Firstly, a shorter consideration of what technologies may do to humans in a transhumanist world. Secondly, a deeper analysis of cochlear implantation’s unique socio-political movement, its ethical explanations and cultural experiences linked with pediatric cochlear implantation—and how those wary of being thrust towards posthumanism could marshal such ideas by analogy. As transhumanism approaches, the issues and questions merit continuing intense analysis. (shrink)

In the economic literature on the firm, especially in the transaction–cost tradition, a sharp distinction is drawn between so-called “market transactions” and “administered transactions.” This distinction is of enormous importance for business ethics, since market transactions are governed by the competitive logic of the market, whereas administered transactions are subject to the cooperative norms that govern collective action in a bureaucracy. The widespread failure to distinguish between these two types of transactions, and thus to distinguish between adversarial and non-adversarial relations, (...) has led many business ethicists to develop a “uniform” moral code. Yet in market transactions, the checks and balances built into the system of commercial exchange are such as to permit more instrumental forms of behavior. In administered transactions, by contrast, these checks and balances are absent, and thus the institutional context calls for much greater exercise of moral restraint. In this paper, I begin the task of developing an adversarial ethic for business. According to this view, the competitive environment licenses a greater range of “self-interested” behavior, but also imposes its own constraints on the strategies that firms may adopt in the pursuit of their interests. One of the most influential ideas in the field of business ethics has been the suggestion that ethical conduct in a business contextshould be analyzed in terms of a set of fiduciary obligations toward various “stakeholder” groups. Moral problems, according to this view, involve reconciling such obligations in cases where stakeholder groups have conflicting interests. The question posed in this paper is whether the stakeholder paradigm represents the most fruitful way of articulating the moral problems that arise in business. By (...) way of contrast, I outline two other possible approaches to business ethics: one, a more minimal conception, anchored in the notion of a fiduciary obligation toward shareholders; and the other, a broader conception, focused on the concept of market failure. We examine two competing solutions to Benardete paradoxes: causal finitism, according to which nothing can have infinitely many causes, and the unsatisfiable pair diagnosis (UPD), according to which such paradoxes are logically impossible and no metaphysical thesis need be adopted to avoid them. We argue that the UPD enjoys notable theoretical advantages over causal finitism. Causal finitists, however, have levelled two main objections to the UPD. First, they urge that the UPD requires positing a ‘mysterious force’ that prevents paradoxes from (...) arising. Since such a force is implausible, the UPD is in trouble. Second, they employ recombination or patchwork principles to argue that paradoxical situations would be possible if causal finitism were false. Since such situations are not possible, causal finitism is true, and so a substantive metaphysical thesis is needed to avoid the paradoxes. We argue that the UPD proponent can successfully respond to these objections. (shrink)

The concept of an operator is used in a variety of practical and theoretical areas. Operators, as both conceptual and physical entities, are found throughout the world as subsystems in nature, the human mind, and the manmade world. Operators, and what they operate, i.e., their substrates, targets, or operands, have a wide variety of forms, functions, and properties. Operators have explicit philosophical significance. On the one hand, they represent important ontological issues of reality. On the other hand, epistemological operators form (...) the basic mechanism of cognition. At the same time, there is no unified theory of the nature and functions of operators. In this work, we elaborate a detailed analysis of operators, which range from the most abstract formal structures and symbols in mathematics and logic to real entities, human and machine, and are responsible for effecting changes at both the individual and collective human levels. Our goal is to find what is common in physical objects called operators and abstract mathematical structures, with the name operator providing foundations for building a unified but flexible theory of operators. The paper concludes with some reflections on functionalism and other philosophical aspects of the ‘operation’ of operators. (shrink)

A prominent objection to the MOA is that it suffers from a symmetry problem: an exactly parallel modal ontological argument can be given for God's non-existence. Ecology and sustainability are current narratives about the behavior of humans toward themselves and the environment. Ecology is defined as a science, and a philosophy of ecology has become a recognized domain of the philosophy of science. For some, sustainability is an accepted, important moral goal. In 2013, a Special Issue of the journal Sustainability dealt with many of the relevant issues. Unfortunately, the economic, ideological, and psychological barriers to ethical behavior and corresponding social action remain great as well as (...) obvious. In this paper, I propose that a new, non-standard and non-propositional logic of real processes, Logic in Reality (LIR) grounded in physics applies to the science and philosophy of these narratives and helps to explicate them. Given the ecological role of organizations and institutions, reference is often made to organizational or institutional logics as guides to ecological practice. This paper suggests that these logics are either too abstract or too informal to have an impact in a conflictual world. Recognition of the suggested new, transdisciplinary logical dimension of ecological processes may provide credibility and support to new initiatives in ecology and its philosophy. (shrink)

Contract cheating, or plagiarism via paid ghostwriting, is a significant academic ethical issue, especially as reliable methods for its prevention and detection in students’ assignments remain elusive. Contract cheating in academic assessment has been the subject of much recent debate and concern. Although some scandals have attracted substantial media attention, little is known about the likely prevalence of contract cheating by students for their university assignments. Although rates of contract cheating tend to be low, criminological theories suggest that people who (...) employ ghostwriters for their assignments are likely to re-offend, and little is known about re-offence rates in this form of academic misconduct. We combined previously-collected datasets and conducted additional, and previously-unreported, analyses on self-report measures of contract cheating prevalence. We found that few students, on aggregate, ever engaged in contract cheating but this varied substantially among samples. Of those who ever engaged in contract cheating, 62.5% did so more than once. The data also suggested that engagement in contract cheating is influenced by opportunity. These figures may help policy makers, and researchers who are creating contract cheating detection methods, to estimate base rates of contract cheating and the likelihood of re-offence. (shrink)

Departing from the relationship between the texts of the Ghanaian poet and novelist Kojo Laing and a recent international art exhibition, this article traces the relationship between style and the multivalent activity of flight across Laing’s work. Drawing upon an intercontinental range of philosophers – from Deleuze and Guattari to contemporary Akan thinkers – it analyses the intersections between gender, geography, and language in Laing’s texts, and demonstrates their value within the context of discussion of contemporary literature’s investment in possible (...) futures. Laing’s transnational aesthetic foregrounds lines of flight across and between different linguistic and cultural communities, and traces relentlessly emerging or possible constellations of relation. Situating Laing in the context of his interdisciplinary reception, this article seeks to explore the aesthetic and ethical ramifications of the unusual networks of affiliation and response of one of West Africa’s most important, yet critically undervalued, contemporary writers. Duns Scotus was a brilliant light that flashed a brief time across the medieval sky hut was destined ultimately to he outshone by other luminaries immediately preceding him (Aquinas) and following him (Ockham). Perhaps no individual in the past half century has done more to illuminate the Subtle Doctor's thought and times than Allan B. Wolter, O.F.M. Both his editing and his translating of primary sources as well as his detailed readings and expositions of Scotus's theories have put medieval scholars in his debt. The present volume is a collection of thirteen essays on particular aspects of Scotus's work, preceded by an introduction. Ten of the essays have been previously published in other sources ranging from.the late 1940s to the present. But as editor Marilyn McCord Adams points out in her forward, many of these can be found only with difficulty in often inaccessible journals and books. Thus the value of this single volume. The essays are grouped under three headings: metaphysics and epistemology, action theory and ethics, and philosophical theology. As is often true with any volume spanning a number of topics and years, the quality of exposition and analysis is uneven. Obviously, in a limited space, I cannot hope to treat all subjects in a volume as comprehensive 518 BOOK REVIEWS as Wolter's. Permit me, however, to begin by making some general comments and then to narrow my remarks to one particular issue. Wolter's introduction to the volume is as clear and concise an overview of Scotus's ideas as one is likely to find anywhere in the literature. In general, the essays in the first part of the book on matters meta· physical and epistemological are quite solid. Here we find explicated many of the concepts which have become identified with Scotus: the formal distinction, univocity of being, the common nature and the hraecceity that constitutes distinct individuals. Wolter does justice to the subtlety and brilliance of Scotus's thinking and allows readers both old and new to Scotus to acknowledge him as a metaphysician for the ages. The author is particularly adept at explicating with helpful analogies some of the Subtle Doctor's most difficult concepts. I benefitted from his thought-provoking comparison between the formal distinction and a spotlight on a stage which can illuminate different and distinguishable aspects of the same reality. The next section on action rtheory and ethics draws in part on Wolter's work which culminated in the 1986 publication of Duns Scotus on the Will and Morality. Wolter has been in the forefront of those who urge that Scotus's description of an innate affection for justice in the will is crucial in understanding the freedom Scotus thought proper to humans. What remains unclear to me is how this strand in Scotus's writing relates to others which clearly imply a libertarian view of free• dom emphasizing the will's utter self-determination. Yet, surely, truth in advertising is an uncommon virtue. The frank honesty of Jeffrey Bloechl, the editor of this volume, is much to be commended.What unifies the essays in this volume is not a common topic or a common approach but a common concern with the problem of understanding the relation between Christianity and secular reason. The issue in play is how much respect a religion that claims to be the recipient of divine revelation owes to autonomous reasoning in any particular age. The problem is exacerbated in those periods of history that are marked by strong claims for the powers of human reasoning.Bloechl’s introduction is particularly helpful due to its distinction between secular reason and secularized reason. Unless a believer takes the fideist position of holding that only claims grounded in faith are valid knowledge-claims, there is no reason to deny or cast skeptical aspersions on secular reason. The term simply names the use of reason according to its proper governing principles on any topic where the justifications for various truth-claims are drawn only from this-worldly experience and, for disciplinary reasons, make no use of divine revelation. It is the type of reasoning that is done within a saeculum, that is, within a given period of time, according to the canons of sound reasoning operative in that epoch. The term “secularized reason,” by contrast, names the view of reason that is hostile to the legitimacy of any knowledge-claim that involves the testimony of divine self-disclosure as its warrant. The proponents of secularized reason often conveniently overlook the likelihood that such hostility risks begging the question by disallowing any form of divinely backed testimony in principle, while allowing human testimony in such spheres as history or courts or law. If one is prepared in general to accept testimony as a justification for a truth-claim, then the proper criterion is the credibility of the source. But then there is no principled way to preclude in advance the possibility that testimony that originates with God might provide the strongest possible type of warrant for certain knowledge-claims. It is mere prejudice to decide in advance that this alternative is simply beyond the pale of consideration.Threaded through the essays in this volume is the perennial problem of the relationship of faith and reason. Earlier ages posed the problem on their own terms, sometimes quite different from modern assumptions. Readers unfamiliar with the thought of Thomas Aquinas, for instance, might well be [End Page 141] surprised to learn that the very first question of the Summa theologiae asks whether any sort of sacra doctrina is necessary beyond the philosophical sciences. Such a stance does not raise a question about whether faith can be a genuine source of knowledge, but merely asks if there is need for the sort of knowledge that is grounded in faith. ISBN 978-0-19-964302-8.When students of St. Augustine consider his teaching on memory, they turn instinctively to the Confessions, book 10, and to On the Trinity, books 11 and 12. The lyrical passage in the Confessions is easy to teach and (...) intriguing in its contents. Paige Hochschild paints a much larger picture, drawing on far more sources. She also sees memory as a central category in Augustine’s thought. In the opening paragraph of the introduction, she describes memory (for Augustine) as the way the mind meets the world, as the way things external to the body are apprehended, as the way intelligible objects are known, and as what it means to be constituted in the image of God. This is a big order. And “order,” in Augustine’s sense, is key: the mind, as memory, brings order to the natural world, but also brings to light a providential order that is implicit in the sensible.The book is divided into three parts: (1) the philosophical tradition (Plato, Aristotle, and Plotinus), (2) Augustine’s earlier writings (from the Cassiciacum dialogues up to De magistro and De musica), and (3) the Confessions and De trinitate. The conclusion of this complex study is that memory is salvific: it accounts for the soul’s progress by the dialectical play of the knowledge and love of what is possessed, yet not possessed. The lifelong process of healing in which memory functions is fulfilled in contemplation.Two characteristics of Hochschild’s book can be mentioned at the outset. First, she studies each author diachronically, measuring progress and growth in the author’s thought, and particularly in his understanding of memory. Second, she readily invokes a wide range of categories to explain and illuminate her main topic. The book is anything but an extended encyclopedia article on “memoria in Augustine.” The two principal terms in the title, “memory” and “theological anthropology,” are richly developed and elaborated.Chapter 1 begins with a short note on Augustine’s knowledge of Plato. It is generally admitted that Augustine read some of the dialogues of Plato in translation: the Timaeus, the Republic (albeit only parts of it), the Phaedo, and the Phaedrus. Some of these works, at least, may have come down to him through doxographers. But Plato’s influence on Augustine remains shadowy. It is “Platonism,” and particularly Plotinus, that influences him so clearly, a point made memorably in Confessions 7.9.13-15, and its intriguing reference to the libri Platonicorum. Before all else, Platonism delivers Augustine from the bondage of materialism.Hochschild treats Plato’s doctrine of memory under four headings: sense perception, knowledge as recollection, divisions in the ways of knowing, and the practice of dialectic. In regard to sense perception, the sharp distinction (found in the Republic) between opinion (doxa) and knowledge (epistêmê) [End Page 144] needs to be refined, Hochschild avers. At least in some later works, the sensible is an image of the intelligible, and hence some sense perception can be infallible. On the next topic, Plato invokes recollection to explain direct apprehension of the forms, but recollection does not recall what was perceived in the past but is a restoration of a clear, logical relationship. The Republic introduces a new element, “the illuminative power of the Good” (21).
