We report the results of a study which tested receptive Italian grammatical competence and general cognitive abilities in bilingual Italian–Sardinian children and age-matched monolingual Italian children attending the first and second year of primary school in the Nuoro province of Sardinia, where Sardinian is still widely spoken. The results show that across age groups the performance of Sardinian–Italian bilingual children is in most cases indistinguishable from that of monolingual Italian children, in terms of both Italian language skills and general cognitive (...) abilities. However, where there are differences, these emerge gradually over time and are mostly in favor of bilingual children. (shrink)

In this essay, Lugones introduces a systemic understanding of gender constituted by colonial/modernity in terms of multiple relations of power. This gender system has a light and a dark side that depict relations, and beings in relation as deeply different and thus as calling for very different patterns of violent abuse. Lugones argues that gender itself is a colonial introduction, a violent introduction consistently and contemporarily used to destroy peoples, cosmologies, and communities as the building ground of the “civilized” West. This essay examines liminality as space of which dominant groups largely are ignorant. The limen is at the edge of hardened structures, a place where transgression of the reigning order is possible. As such, it both offers communicative openings and presents communicative impasses to liminal beings. For the limen to be a coalitional space, complex communication is required. This requires praxical awareness of one's own multiplicity and a recognition of the other's opacity that does not attempt to assimilate it into (...) one's own familiar meanings. Refusing the assumption of transparency and operating with relational identities, the complex communication that occurs in the limen—often invisible to dominant groups—can enable genuine coalition and effective resistance to domination. En el presente trabajo, abordamos la obra de Friedrich Nietzsche con el objeto de analizar el modo en que su temprana crítica a las instituciones educativas alemanas y, específicamente, a la filosofía universitaria de su tiempo deriva de manera progresiva en los esbozos de una concepción tardía de la filosofía, fundada en la vida misma como medio de conocimiento a través del “experimento”. El diagnóstico nietzscheano es crítico y su resolución, un gran desafío para los futuros pensadores, a quienes les (...) demanda vivir experimentalmente sus palabras más allá de los libros. Geschlecht und Gewalt, das Thema dieses Bandes, betrifft nicht nur die Frage nach den Charakteristika und Ursachen sexueller Aggression, sondern auch die Frage nach angeblichen geschlechtsspezifischen Formen der Aggression. Der vorliegende Beitrag befasst sich mit beidem und diskutiert sie als Teil von begrifflichen Ausweitungen der Kampfzone, d.h. der Erweiterungen des Aggressionsbegriffs im Verlauf der wissenschaftlichen Aggressionsforschung der zweiten Hälfte des 20. Jahrhunderts. Der Beitrag zeigt unter Anderem: was als Aggression wahrgenommen wird und in der Wissenschaft als solche gezählt wird, verändert (...) sich mit der Gesellschaft. Dabei wird aus epistemologischer bzw. wissenschaftsphilosophischer Perspektive gezeigt, wie sich rassistische, Status-, und Geschlechtsstereotype auf begriffliche Entscheidungen in wissenschaftlicher Forschung auswirken und somit die wissenschaftliche Arbeit am Begriff beeinflussen können. This paper investigates the emotive (or expressive) meaning of words commonly referred to as “loaded” or “emotive,” which include slurs, derogative or pejorative words, and ethical terms. We claim that emotive meaning can be reinterpreted from a pragmatic and argumentative perspective, which can account for distinct aspects of ethical terms, including the possibility of being modified and its cancellability. Emotive meaning is explained as a defeasible and automatic or automatized evaluative and intended inference commonly associated with the use of specific (...) terms, which can be represented and assessed considering its logical structure and its defeasibility conditions. This automatic inference is conceived as part of the connotation of an ethical term, and is not necessarily stable. By means of quasi-definitions, it is possible to modify the emotive meaning while maintaining the descriptive one, automaticizing the inferences drawn from an ethical word. Through examples drawn from the recent US presidential campaign, we show how re-contextualization and emotive contexts can affect emotive meaning. (shrink)

María Lugones, one of the premiere figures in feminist philosophy, has at last collected some of her most famous essays, as well as some lesser-known gems, into her first book.

I offer a new cartography of ethical resistance. I argue that there is an uncharted interaction between managerial secrecy and organizational silence, which may exponentially increase the incidence of corruption in ways not yet understood. Current methods used to raise levels of moral conduct in business and government practice appear blind to this powerful duo. Extensive literature reviews of secrecy and silence scholarships form the background for an early stage conceptual layout of the co-production of secrecy and silence.

In this article we aim to reconstruct some aspects of Davidson's idea of triangulation, and against this reconstruction, ask whether the idea is viciously circular. We begin by looking at the claim that without a triangularn setting, there is no saying what the cause of a being's responses is. In the first section we discuss the notion of relevant similarity, and what difference the presence of a second non‐linguistic being could make for the individuation of a common focus of attention. (...) In the second section we look at the role of a second person in language‐acquisition. It is important that being corrected to ‘go on as others do’ does not yet presuppose thought, and similarity standards can be applied to a learner's reactions even before she is aware of these standards. We also show why Davidson is not committed to any consensus view of correctness. In the last section we discern three charges of circularity that can be levelled against the idea of triangulation. We argue that Davidson can respond to the first two charges, and point to a way of answering the third. But the response we propound raises a new question, namely, why does the second being have to be a speaker or thinker even before the learner is aware of the three points of the triangle? (shrink)

Beginning with a historical overview of relativism, from Pythagoras in ancient Greece to Derrida and postmodernism, Maria Baghramian explores the resurgence of relativism throughout the history of philosophy. She then turns to the arguments for and against the many subdivisions of relativism, including Kuhn and Feyerabend's ideas of relativism in science, Rorty's relativism about truth, and the conceptual relativism of Quine and Putnam. Baghramian questions whether moral relativism leads to moral indifference or even nihilism, and whether feminist epistemology's concerns (...) about the very notion of objectivity can be considered a form of relativism. She concludes the relativism debate by assessing the recent criticisms such as Quine's argument from translation and Davidson's claim that even the motivations behind relativism are unintelligible. Finding these criticisms lacking, Baghramian proposes a moderate form of pluralism which addresses the legitimate worries that give rise to relativism without incurring charges of nihilism or anarchy. The first debate relates to the philosophical problem of "the beginning before the Beginning." The second concerns the necessity and possibility of mediation between incommensurable entities: the "demonic" and the social, desire and the Law, material production and representation. I contend: that the introduction of the chora in RPL is part of Kristeva's (...) effort to restore the legacy of a materialist economy of the beginning, as this is glimpsed in Plato's Timaeus from which Kristeva borrows her controversial term; and that the chora constitutes an attempt on Kristeva's part to explore a third space of ambiguous relationality in the context of which our transcendence to the "demonic" lies less "beyond us" than "in-between.". In accordance with standards published by the American Society for Bioethics and Humanities (ASBH), ethics consultants are expected to provide recommendations that align with scholarly literature, professional society statements, law, and policy. However, there are no studies to date that characterize the specific references that ethics consultants and educators use to inform their work. To address this gap, a convenience sample of clinical ethics consultants and educators was surveyed online through two major listservs for clinical ethics, the ASBH Clinical Ethics (...) Consultation Affinity Group (CECAG) and the Association of Bioethics Program Directors (ABPD). Ninety-five ethics consultants and/or educators with diverse educational background, credentials, and experience provided responses. In total, 451 references, 315 of which were unique, were reported. These references were broken into 6 categories after analysis: bioethics literature (divided into articles and books), professional society documents (divided into professional society statements and codes of ethics), federal/state/uniform/case law, hospital/health system policies, official religious teachings, and other. We found extensive variation and minimal overlap in the references respondents used for ethics consultation and education, even when referring to the same topics. Future research directions should include conducting more systematic efforts to characterize the references used by ethics consultants across the US; determining whether demographic characteristics of consultants influence the references used; and ascertaining whether the variation in references used reflects genuine disagreements in consultants’ and educators’ bioethical analysis or recommendations. Numerosas expresiones lingüísticas son producidas por los profesionales de las áreas de la Educación y Psicología para designar al sujeto con discapacidad. Nuestra mirada se centró en los discursos que se balizan en un lenguaje analítico y heurístico perteneciente al universo de la normalidad de la razón analítica. En contra de esta propuesta dialogamos con Wittgenstein sobre producción de sentido y de Vygotsky sobre mediación semiótica. Palabras claves: producción de sentido; mediación semiótica, discapacidad, inclusión.

O silêncio e a invisibilidade são as palavras que melhor representam a história da mulher no decorrer de muitos séculos. Desde a antiguidade, as mulheres foram impedidas de falar, e até nos dias atuais, infelizmente, pouco se valoriza o discurso feminino. Em diversas sociedades, o direito a expressar-se é severamente combatido, punido com rigor. A essas mulheres, vilipendiadas em seus direitos, resta um único espaço: o da subalternidade. Nesse contexto de subalternidade, habitando o espaço prisional marginal, fazer uso da palavra (...) e apropriar-se do direito à fala é um ato de coragem e de rebeldia. O presente artigo analisa o testemunho de uma mulher em situação de prisão que, até chegar ali, teve quase todos os seus direitos humanos profanados. A narrativa destaca suas experiências e traz à luz suas memórias e a maneira como dialoga com o passado. A partir da cela da prisão, a mulher produz o seu discurso, elabora o seu balbucio, que embora abafado, ultrapassa as grades e os altos muros. É através do poder de sua voz que ela reivindica o direito à fala, o direito de recontar-se, de falar de si. Neste artigo, analisamos, sob a perspectiva dos Estudos Culturais, a história narrada por VB1, uma mulher negra que cumpre pena em regime fechado. A partir desta análise, propomos uma reflexão sobre o espaço prisional, o direito à fala e o papel da memória nesse processo. Teremos como referências teóricas as identidades culturais em tempos de pós-modernidade com Stuart Hall, as reflexões sobre memória individual e coletiva de Maurice Halbwachs, estudos acerca da subalternidade com Hugo Achugar e Gayatri Spivak, espaço fronteiriço e memórias subalternas com Edgar Nolasco, reflexões sobre o papel da mulher propostas por Michele Perrot, entre outros. This study investigates priming in an implicit word stem completion (WSC) task by analyzing the effect of linguistic stimuli characteristics on said task. A total of 305 participants performed a WSC task in two phases (study and test). The test phase included 63 unique-solution stems and 63 multiple-solution stems. Analysis revealed that priming (mean = 0.22) was stronger in the case of multiple-solution stems, indicating that they were not a homogeneous group of stimuli. Thus, further analyses were performed only for (...) the data of the unique-solution stems. Correlations between priming and familiarity, frequency of use, and baseline completion were significant. The less familiar words, which were less frequent, had higher priming values. At the same time, the stems with lower baseline completion generated more priming. A regression analysis showed that baseline completion was the only significant predictor of priming, suggesting that the previous processing of the stimuli had a greater impact on the stimuli with low baseline performance. At the same time, baseline completion showed significant positive correlations with familiarity and frequency of use, and a negative correlation with length. When baseline completion was the dependent variable in the regression analysis, the significant variables in the regression were familiarity and length. These results were compared with those obtained in a study using word fragment completion (WFC) by Soler et al. (2009), in which the same words and procedure were employed. Analysis showed that the variables that correlated with priming were the same as in the WSC task, and that completion baseline was the variable that showed the greatest predictive power of priming. This coincidence of results obtained with WFC and WSC tasks highlights the importance of controlling the characteristics of the stimuli used when exploring the nature of priming. (shrink)

In 1997, five decades after the publication of the landmark Hempel-Oppenheim article "Studies in the Logic of Explanation" Wesley Salmon published Causality and Explanation, a book that re-addresses the issue of scientific explanation. He provided an overview of the basic approaches to scientific explanation, stressed their weaknesses, and offered novel insights. However, he failed to mention Mary Hesse's approach to the topic and analyze her standpoint. This essay brings front and center Hesse's approach to scientific explanation formulated in the 1960s (...) and argues that rereading Hesse's account one can overcome the criticisms addressed towards another influential theory of explanation that of Bas van Fraassen's. Furthermore, it could bring the traditional philosophy of science into a fruitful conversation with science and technology studies and gender studies in science, technology and medicine. (shrink)

Maria Rosa Antognazza's pioneering biography provides a unified portrait of this unique thinker and the world from which he came. At the centre of the huge range of Leibniz's apparently miscellaneous endeavours, Antognazza reveals a single master project lending unity to his extraordinarily multifaceted life's work. Throughout the vicissitudes of his long life, Leibniz (...) tenaciously pursued the dream of a systematic reform and advancement of all the sciences. As well as tracing the threads of continuity that bound these theoretical and practical activities to this all-embracing plan, this illuminating study also traces these threads back into the intellectual traditions of the Holy Roman Empire in which Leibniz lived and throughout the broader intellectual networks that linked him to patrons in countries as distant as Russia and to correspondents as far afield as China. One reason for the popularity of Craver’s mutual manipulability account of constitutive relevance is that it seems to make good sense of the experimental practices and constitutive reasoning in the life sciences. Two recent papers propose a theoretical alternative to in light of several important conceptual objections. Their alternative approach, the no de-coupling account, conceives of constitution as a dependence relation that once postulated provides the best explanation of the impossibility of breaking the common cause coupling of a macro-level mechanism (...) and its micro-level components. This entails an abductive view of constitutive inference. Proponents of the NDC or abductive account recognize that their discussion leaves open a big question concerning the practical dimension of the notion of constitutive relevanssssce: Is it possible to faithfully reconstruct constitutional reasoning in science in terms of a failure to de-couple, via interlevel experiments, phenomena from their mechanistic constituents? Focusing on the field of memory and long-term potential research, this article argues that the abductive account provides a more adequate description of interlevel experiments in neuroscience. Na perspectiva da Psicologia Histórico-Cultural, o trabalho, exigência para que o homem sobreviva, lhe possibilita desenvolver-se, apropriar-se da cultura humana histórica e coletivamente elaborada, para atender às demandas que suas tarefas lhe impõem. Em um processo coletivo, por meio de sua inserção nas relações produtivas, ao aprender o que lhe é necessário para executar suas atividades, o homem se humaniza, e vai criando o que necessita e pode, para atender suas necessidades, o que permite afirmá-lo enquanto produto e produtor da (...) cultura, da ciência e da tecnologia. E essa é a função básica da escola, preparar o aluno para, na medida em que se humaniza, assumir um lugar, uma posição reconhecida socialmente. Nesse processo, o Trabalho Colaborativo/Ombreado entre os professores da Educação Especial, do ensino comum e da equipe pedagógica escolar, envolvendo confiança e credibilidade entre os pares, é essencial ao desenvolvimento psicointelectual dos estudantes com deficiência/necessidades educativas especiais. Para melhor caracterizar o Trabalho Colaborativo, apresenta-se o resultado de uma pesquisa efetuada na Biblioteca Digital de Teses e Dissertações na qual se buscou identificar suas características, limites e desafios. A essência do Trabalho Colaborativo entre os professores está numa relação de apoio, na qual todos assumem a responsabilidade no processo de aprendizagem dos conteúdos escolares, o que exige espaço e tempo para sua consecução, além de uma fundamentação teórica que articulada a uma prática pedagógica lhe dê consistência. Se executado dessa forma, o Trabalho Colaborativo/Ombreado caracteriza-se como essencial à inclusão escolar. Conclui-se que, para efetivá-lo, torna-se imperiosa a definição clara e consciente dos objetivos para a escolarização, pois há muita diversidade entre as especificidades da deficiência ou das necessidades educacionais especiais. No entanto, essa forma de atuação articulada encontra diferentes entraves que se constituem em seus limites e desafios exigindo vontade política para minimizá-los, permitindo sua organização adequada. Discutem-se esses desafios e apresenta-se um exemplo no qual, pelo trabalho colaborativo pôde-se estabelecer condições para que uma aluna que, pelo vestibular conquistou uma vaga no curso de Medicina mas adquiriu uma tetraplegia no decorrer do curso, pudesse terminar sua graduação. Aphasia is a complex disorder, frequent after stroke (with an incidence of 38%), with a detailed pathophysiological characterization. Effective approaches are crucial for devising an efficient rehabilitative strategy, in order to address the everyday life and professional disability. Several rehabilitative procedures are based on psycholinguistic, cognitive, psychosocial or pragmatic approaches, including amongst those with a neurobehavioral approach the Melodic Intonation Therapy (MIT). Van Eeckhout’s adaptation of MIT to French language (Melodic-Rhythmic Therapy: MRT) has implemented the training strategy by adding a (...) rhythmic structure reproducing French prosody. The purpose of this study was to adapt MRT rehabilitation procedures to Italian language and to verify its efficacy in a group of six chronic patients (five males) with severe non-fluent aphasia and without specific aphasic treatments during the previous 9 months. The patients were treated 4 days a week for 16 weeks, with sessions of 30–40 min. They were assessed 6 months after the end of the treatment (follow-up). The patients showed a significant improvement at the Aachener Aphasie Test (AAT) in different fields of spontaneous speech, with superimposable results at the follow-up. Albeit preliminary, these findings support the use of MRT in the rehabilitation after stroke. Specifically, MRT seems to benefit from its stronger structure than the available stimulation-facilitation procedures and allows a better quantification of the rehabilitation efficacy. (shrink)

Pretendemos mostrar que, no Górgias, diálogo dedicado à crítica da retórica, as frequentes alusões de Sócrates à compleição do corpo, bem como o uso recorrente de metáforas corpóreas para referir-se ao que, por analogia, passa-se com a alma servem de ferramenta retórica para fazer frente à retórica de Górgias. Desse modo, ao mesmo tempo em que chamamos atenção para a maneira como Platão se vale das armas do adversário justamente para atacá-lo, ressaltamos o papel imprescindível do corpo como evidência da (...) alma na filosofia platônica. Com isto, nosso intuito é reforçar a vertente interpretativa segundo a qual Platão pode ser entendido mais como um pensador que parte dos problemas prementes de seu tempo para daí nos conduzir a reflexões filosóficas – no diálogo em questão, as consequências políticas de uma paidéia pautada numa retórica sofística –, do que como um filósofo comprometido apenas com uma metafísica transcendente. Creativity has often been declared, especially by philosophers, as the last frontier of science. The assumption is that it will defy explanation forever. I will defend two claims in order to oppose this assumption and to demystify creativity: (1) the perspective that creativity cannot be explained wrongly identifies creativity with what I shall call metaphysical freedom; (2) the Darwinian approach to creativity, a prominent naturalistic account of creativity, fails to give an explanation of creativity, because it confuses conceptual issues with (...) explanation. I will close with some remarks on the status and differences in some explanations available in contemporary cognitive science. (shrink)

The book examines how Darwinism has been used to explain novelty and change in culture through the Darwinian approach to creativity and the theory of memes. The first claims that creativity is based on a Darwinian process of blind variation and selection, while the latter claims that culture is based on and explained by units - memes - that are similar to genes. Both theories try to describe and explain mind and culture by applying Darwinism by way of analogies. Kronfeldner (...) shows that the analogies involved in these theories lead to claims that give either wrong or at least no new descriptions or explanations of the phenomena at issue. Whereas the two approaches are usually defended or criticized on the basis that they are dangerous for our vision of ourselves, this book takes a different perspective: it questions the acuteness of these approaches. Darwinian theory is not like a dangerous wolf, hunting for our self image. Far from it, in the case of the two analogical applications addressed in this book, Darwinian theory is shown to behave more like a disoriented sheep in wolf's clothing. - A revised and much shortened version of a dissertation (2007, Darwinism, Memes and Creativity: A Critique of Analogical Reasoning from Nature to Culture). Barbara Stafford is at the forefront of a growing movement that calls for the humanities to confront the brain’s material realities. In Echo Objects she argues that humanists should seize upon the exciting neuroscientific discoveries that are illuminating the underpinnings of cultural objects. In turn, she contends, brain scientists could enrich their investigations of mental activity by incorporating phenomenological considerations—particularly the intricate ways that images focus intentional behavior and allow us to feel thought. This, then, is a book for both (...) sides of the aisle, a stunningly broad exploration of how complex images—or patterns that compress space and time—make visible the invisible ordering of human consciousness. Stafford demonstrates, for example, how the compound formats of emblems, symbols, collage, and electronic media reveal the brain’s grappling to construct mental objects that are redoubled by prior associations. On the other hand, she compellingly shows that findings in evolutionary biology and the neurosciences are providing profound opportunities for understanding aesthetic conundrums as old and deep-seated as the human urge to imitate, the mapping of inner space, and the role of narrative and nonnarrative representation. As precise in her discussions of firing neurons as she is about the coordinating dynamics of image making, Stafford locates these major transdisciplinary issues at the intersection of art, science, philosophy, and technology. In this conceptual article, we argue that defining corporate social responsibility and corporate social irresponsibility as opposite constructs produces a lack of clarity between responsible and irresponsible acts. Furthermore, we contend that the treatment of the CSR and CSI concepts as opposites de-emphasizes the value of CSI as a stand-alone construct. Thus, we reorient the CSI discussion to include multiple aspects that current conceptualizations have not adequately accommodated. We provide an in-depth exploration of how researchers define CSI and both identify (...) and analyze three important gray zones between CSR and CSI: the role of harm and benefit, the role of the actor and intentionality, and the role of rectification. We offer these gray zones as factors contributing to the present lack of conceptual clarity of the term CSI, as a concept in its own right, leading to difficulties that researchers and managers experience in categorizing CSI acts as distinct from CSR. While some countries are moving toward legalization, euthanasia is still criticized on various fronts. Most importantly, it is considered a violation of the medical ethics principle of non-maleficence, because it actively seeks a patient’s death. But, medical ethicists should consider an ethical alternative to euthanasia. In this article, we defend cryocide as one such alternative. Under this procedure, with the consent of terminally-ill patients, their clinical death is induced, in order to prevent the further advance of their brain’s deterioration. Their (...) body is then cryogenically preserved, in the hope that in the future, there will be a technology to reanimate it. This prospect is ethically distinct from euthanasia if a different criterion of death is assumed. In the information-theoretic criterion of death, a person is not considered dead when brain and cardiopulmonary functions cease, but rather, when information constituting psychology and memory is lost. We argue that philosophers are competent to facilitate public discussion concerning restrictions on human migration across political borders. We also argue that presenting public audiences with a prima facie case for open borders offers a unique opportunity to elucidate important aspects of philosophical reasoning. Finally, we share resources and a lesson plan for those keen to examine the case for open borders with students, or to facilitate public discussion on these issues.

Este trabajo surge de un diálogo interdisciplinario entre dos tesis doctorales, una de educación y otra de filosofía, que comparten un interés sobre formas emancipadoras y democráticas de pensar con otros y otras en la escuela pública latinoamericana. Desde una perspectiva crítica propia de la filosofía de la educación latinoamericana realizamos un análisis epistemológico sobre las distintas formas de habitar la pregunta dentro de una práctica filosófica con niños y niñas. Tomamos como objeto de estudio una experiencia específica de comunidad (...) de indagación realizada en 2022 en el sur de Mendoza, Argentina. Entramamos herramientas teóricas de Walter Kohan, Paulo Freire y Jacques Rancière con la intención de visibilizar diversas formas de habitar la producción de saberes dentro de dicha comunidad. Proponemos dos nudos problemáticos: por un lado, el orden explicador/embrutecedor a partir de Rancière y, por el otro,la pregunta como afirmación vital a partir de Kohan y Freire. Trabajamos una serie de disonancias en torno a la circulación y a la potencia de la pregunta en la escuela y la educación pública. Finalmente proponemos una síntesis de estas problemáticas en la postulación de una “pregunta niña” como potencia epistémica emancipadora que supone una intimidad con los otros y otras, con las cosas y el mundo abierta desde una igualdad política e intelectual radical. This work aims to identify the constituents of forgiveness in terms of the forgiver's beliefs and motivating goals. After addressing the antecedents of forgiveness—a perceived wrong—and distinguishing the notion of mere harm from that of offense, we describe the victim's typical retributive reactions—revenge and resentment—and discuss their advantages and disadvantages. Then we focus on the forgiver's mind-set, pointing to the relationship between forgiveness and acceptance of the wrong, addressing the forgiver's motivating goals, and discussing both their self-interested and altruistic implications. (...) In so doing we also discuss the role of the forgiver's positive feelings towards the offender, arguing that, however important, they are unnecessary to forgiveness. We finally identify two kinds of forgiveness—conditional and unconditional—suggesting that they are grounded on different notions of “worth.”. (shrink)

In the face of causal complexity, scientists reconstitute phenomena in order to arrive at a more simplified and partial picture that ignores most of the 'bigger picture.' This paper will distinguish between two modes of reconstituting phenomena: one moving down to a level of greater decomposition (toward organizational parts of the original phenomenon), and one moving up to a level of greater abstraction (toward different differences regarding the phenomenon). The first aim of the paper is to illustrate that phenomena are (...) moving targets, i.e., they are not fixed once and for all, but are adapted, if necessary, on the basis of the preferred perspective adopted for pragmatic reasons. The second aim is to analyze in detail the second mode of reconstituting phenomena. This includes an exposition of the kind of pragmatic-pluralistic picture resulting from the fact that phenomena are reconstituted by a move up to a level of greater abstraction. (shrink)

Nowadays, there is a quite considerable amount of literature on the use of analogy or more generally of inferences by parallel reasoning in contemporary legal reasoning and particularly so within Common Law. These studies are often motivated by research in artificial intelligence seeking to develop suitable software-support for legal reasoning. Recently, Rahman et al. developed a dialogical approach in the framework of Constructive Type Theory to what in Islamic Jurisprudence was called qiyās or correlational inferences. In their last chapter the (...) authors suggested that such an approach contributes to the study of patterns of reasoning by precedent cases within contemporary Common Law. In the present paper we will further motivate the deployment of the dialogical framework developed in Rahman et al. within Civil and Common Law. After a presentation of Scott Brewer’s take on analogy within Common Law, that has striking structural similarities to reasoning by precedent case rooted in ratio legis, we will illustrate the implementation of the framework with a brief discussion of some cases of legal reasoning based on Spanish Civil Law but where the accent is put in the emerging ruling rather than in the existing of a case in Common Law. Moreover, quite surprisingly, the case under study suggests that even cases of Law interpretation fit the argumentation pattern of qiyās al-‘illa. A caveat: in the present paper we will focus mainly in discussing the dynamics of the meaning constitution involved rather than in setting the rules of the underlying dialogical framework, the latter is the subject of a follow-up paper. Human nature is a concept that transgresses the boundary between science and society and between fact and value. It is as much a political concept as it is a scientific one. This chapter will cover the politics of human nature by using evidence from history, anthropology and social psychology. The aim is to show that an important political function of the vernacular concept of human nature is social demarcation (inclusion/exclusion): it is involved in regulating who is ‘us’ and who is (...) ‘them.’ It is a folk concept that is used for dehumanization, for denying (a) membership in humankind or (b) full humanness to certain people in order to include or exclude them from various forms of politically relevant aspects of human life, such as rights, power, etc. (shrink)

This research aims to identify the ethical issues perceived by intensive care nurses in their everyday practice. It also aims to understand why these situations were considered an ethical issue and what interventions/strategies have been or are expected to be developed so as to minimize them. Data were collected using a semi-structured interview with 15 nurses working at polyvalent intensive care units in 4 Portuguese hospitals, who were selected by the homogenization of multiple samples. The qualitative content analysis identified end-of-life (...) decisions, privacy, interaction, team work, and health-care access as emerging ethical issues. Personal, team, and institutional aspects emerge as reasons behind the experience of these issues. Personal and team resources are used in and for solving these issues. Moral development and training are the most significant strategies. (shrink)
