We agree with van der Pijl et al that the question of how to ensure consent is obtained for procedures which occur during labour and childbirth is vitally important, and worthy of greater attention.1 However, we argue that the modified opt-out approach to consent outlined in their paper may not do enough to protect the choice and agency of birthing people. Moreover, while their approach reflects a pragmatic attempt to facilitate legal clarity and certainty in this context, this is not (...) necessarily responsive to the messy realities of decision-making during labour (and beyond). We outline some of our concerns with their proposals and demonstrate how these illuminate some broader, longstanding tensions around consent and medical law. The authors place significant focus on the particularities of labour, outlining six ways in which maternity care is ‘unlike the usual healthcare setting’ (van der Pijl M et al,1p4). We support the need for attentiveness to these particularities and the problematic nature of consent in this context. Recent scholarly attention on the possible ‘political, ethical and theoretical implications and meanings of birthing embodiment’ (Chadwick R,2p2) has invited more nuanced conversation about consent, agency and decision-making during labour. However, while recognising the embodied particularities of labour, we must also avoid essentialising the differences of labouring bodies and thereby reinforcing exclusionary norms of consent. I present a problem for a prominent kind of conservatism, viz., the combination of traditional moral & religious values, patriotic nationalism, and libertarian capitalism. The problem is that these elements sometimes conflict. In particular, I show how libertarian capitalism and patriotic nationalism conflict via a scenario in which the thing that libertarian capitalists love – unregulated market activity – threatens what American patriots love – a strong, independent America. Unrestricted libertarian rights to buy and sell land would permit the sale (...) of all American territory by private individuals to foreign powers. Patriotic nationalists regard this as outrageous, but libertarian capitalists cannot refuse it. (shrink)

The basis of the Periodic Table is discussed. Electronic configuration recurs in only 21 out of the 32 groups. A better basis is derived by considering the highest classical valency (v) exhibited by an element and a new measure, the highest valency in carbonyl compounds (v*). This leads to a table based on the number of outer electrons possessed by an atom (N) and the number of electrons required for it to achieve an inert (noble) gas configuration (N*). As one of the preeminent philosophers of the twentieth century, W. V. Quine made groundbreaking contributions to the philosophy of science, mathematical logic, and the philosophy of language. This collection of essays examines Quine's views, particularly his holism and naturalism, for their value to feminist theorizing today. Some contributors to this volume see Quine as severely challenging basic tenets of the logico-empiricist tradition in the philosophy of science—the analytic/synthetic distinction, verificationism, foundationalism—and accept various of his positions as potential resources for (...) feminist critique. Other contributors regard Quine as an unrepentant empiricist and, unlike feminists who seek to use or extend his arguments, they interpret his positions as far less radical and more problematic. In particular, critics and advocates of Quine's arguments that the philosophy of science should be "naturalized"—understood and pursued as an enterprise continuous with the sciences proper—disagree deeply about whether such a naturalized philosophy is "philosophy enough." Central issues at stake in these disagreements reflect current questions of special interest to feminists and also bridge the analytic and postmodern traditions. They include questions about whether and how the philosophy of science, as a form of practice, is or can be normative as well as questions concerning the implications of Quine's philosophy of language for the transparency and stability of meaning. In representing feminist philosophy centrally engaged with the analytic tradition, this volume is important not only for what it contributes to the understanding of Quine and naturalized epistemology but also for what it accomplishes in working against restrictive conceptions of the place of feminism within the discipline. Nelson More than a dozen years ago, in the pages of The Philosophical Quarterly,1 this writer contested Sraffa and Keynes' claim, advanced in the introduction to their edition ofthe Abstract? that it was Hume and not Adam Smith (as traditionally supposed) who was the author of that work. The traditional view, which might be called the Adam Smith authorship-theory, was (...) largely inspired by and seemed nailed shut by Hume's reference to a "Mr Smith" in a letter to Francis Hutcheson, datedMarch 4, 1740.3There appeared tobe goodreasonsforidentifying this "Mr Smith" with Adam Smith and then the latter with the undivulged author of the Abstract. It was known, for instance, that previous to March 4, 1740, Adam Smith had been a student of Hutcheson's and that Hutcheson was in the habit of setting his students the task of writing abstracts of newly published philosophical works.4 Since Hutcheson had originallylooked with favor on both the Treatise and its author,5 it had to seem more than likely that he had set his students the task ofwriting an abstract ofthe newly published Treatise ofHume. It was known, too, that Adam Smith was in possession of a copy ofthe Treatise soon after the date of H.6 Who, then, might be the "Mr Smith" adverted to in H's "My Bookseller has sent to Mr Smith a Copy of my Book, which I hope he has receive, as well as your Letter," except that same student of Hutcheson's, Adam Smith? What other Smith might have been known to Hutcheson, whom Hume could have wanted to refer to? No other Smith appeared to fit the bill. But why should Hume have wanted to refer in his correspondence with Hutcheson to an obscure, sixteen-year-old student ofHutcheson's, besides going to the trouble of having his bookseller send him a copy of the Treatise, unless that student had in some way made himselfnot only known to Hume but so highly regarded that Hume would want to favor him, presumably at his own expense, with a copy ofthe Treatise? The only tenable answer had to seem to be that this same student had composed such a perceptive and laudatory précis of the Treatise for Hutcheson that the latter had shown it to Hume and Hume, in the honest attempt to excite interest and sales of that languishing work, had seen to its publication as the Abstractl These are the reasonings Volume XVII Number 1 83 JOHN O. NELSON and considerations that inspired and seemed to confirm the Adam Smith authorship-theory.7 As can be perceived, these reasonings and considerations all revolve around the reference to a "Mr Smith"in H andthe identification of that Smith with Adam Smith. When, therefore, Sraffa and Keynes in the introduction to their edition oftheAbstract pointed out that there existed another Smith who might arguably be the Mr Smith referred toin H, namely, the DubUn publisher oftwo ofHutcheson's works, John Smith "at the Philosopher's Head on the Blind Quay," its major prop being seemingly knocked out from under it, the Adam Smith authorship-theory crashed—at least in the eyes of the general world—to the ground. And in thelatter's place, various ofits supporting reasons being given a lease on life, such as Hume's well-known endeavors and desires to excite interest in this first work of his, the Hume authorship-theory, so to speak, seated itself. In my previous venture into this subject, "Has the Authorship of An Abstract ofa Treatise ofHuman Nature Really Been Decided?"8 I tried, I believe with some success, to show that Sraffa and Keynes' arguments were not so unanswerable as they were generally taken to be and that, in fact, they presented various difficulties which the traditional theory avoided. Die kritische Auseinandersetzung mit zeitgenössischen Strömungen der Philosophie nahm in Nelsons Lehrtätigkeit und Veröffentlichungen breiten Raum ein. Neben konkurrierenden Ausprägungen des Neukantianismus grenzte er sich gegen Pragmatismus, Positivismus und die phänomenologische Schule ab, vor allem aber auch gegen Autoren wie Bergson und Spengler, die einem Paradigma von Philosophie verpflichtet waren, das Nelson in seinen Vorlesungen mit dem Ausdruck "intuitive Philosophie" bezeichnete. Nelsons Kritik beschränkt sich nicht darauf, dieser Art Philosophie Begründungsmängel vorzuwerfen. Vielmehr sieht er die "intuitive Philosophie" in dem (...) klassischen Denkfehler befangen, gehaltvolle Aussagen aus bloßen Begriffen herzuleiten und die Gültigkeit ihrer Thesen durch die fälschliche Berufung auf begriffliche Tatsachen zu erschleichen. An article by Luigino Bruni and Robert Sugden published in this journal argues that market relations contain elements of what they call ‘fraternity’. This Response demonstrates that my own views on interpersonal relations and markets – which originated in the feminist analysis of caring labour – are far closer to Bruni and Sugden's than they acknowledge in their article, and goes on to discuss additional important dimensions of sociality that they neglect.

We consider Helen Longino's proposal that "ontological heterogeneity", "complexity of relationship", and "the non-disappearance of gender" are criteria for good science and cannot be separated into cognitive and social virtues. Using a research program in neuroendocrinology investigating a hormonal basis for sex-differentiated lateralization as a case study, the authors disagree concerning whether the first two criteria can be construed as criteria for good science. Concerning the non-disappearance of gender criterion, we argue that its appropriateness is context specific, and that its (...) cognitive and social formulations are separable and should be construed as such. SUMMARYThe Machiavellian Moment was largely responsible for establishing what remains the dominant understanding of American Revolutionary ideology. Patriots, on this account, were radical whigs; their great preoccupation was a terror of crown power and executive corruption. This essay proposes to test the whig reading of patriot political thought in a manner suggested by Professor Pocock's pioneering first book, The Ancient Constitution and the Feudal Law. The whig tradition, as he taught us, located in the remote Saxon past an ‘ancient constitution’ (...) of liberty, in which elected monarchs merely executed laws approved by their free subjects in a primeval parliament. This republican idyll, whigs believed, was then tragically interrupted by the Norman Conquest of 1066, which introduced feudal tenures and monarchical tyranny. Did patriot theorists accept this narrative? The answer, I shall argue, is strikingly mixed. By the early 1770s, appeals to the ‘ancient constitution’ had become less common in patriot writing. And by the end of the 1770s, many patriots had absorbed a completely different understanding of the feudal past—one pioneered by Royalist historians of the seventeenth century and then adapted by Scottish historians of the eighteenth. This shift reflects a broader transformation in patriot political and constitutional theory. (shrink)

In this article, I will present a construction of a Nishitanian ethics of sympathy primarily based on passages from Nishitani Keiji’s principal work of his middle period Religion and Nothingness (Shūkyō to ha nani『宗教とは何か』). To establish the normativity of Nishitani’s concept of sympathy I will present his concept of force (chikara 力) as its basis. I will argue that the role of force has been hereto overlooked in the analysis of Nishitani’s concept of circuminsessional relations which has impaired the task (...) of constructing an ethical theory from his thought. I will primarily engage with Brett Davis’s work on circuminsessional relations to demonstrate this point, as I believe he has provided the most robust account of it thus far. After establishing this construction, I aim to elucidate the relative advantages of Nishitanian ethics of sympathy and address potential critiques. First, I will position Nishitanian ethics of sympathy as responding to Nietzsche’s critique of Schopenhauer’s morality of compassion. Nietzsche's critique is strong and that responding to him on Nishitanian grounds will be useful in demonstrating the advantages of my construction. Next, I will respond to a critique given in Peter-Hans Liederbach’s ‘Between the Ontological and the Ontic’ that accuses Nishitani’s philosophy of being unable to offer a basis for ethics. Lastly, I wish to position Nishitanian ethics of sympathy as a starting point for expanding the tradition of sympathy-based morality in East Asian philosophy. I will do this by relating Nishitani’s concept of sympathy to Justin Tiwald’s work on sympathy in Confucianism. (shrink)

In her final fragmentary novel Sanditon, Jane Austen develops a theme that pervades her work from her juvenilia onward: illness, and in particular, illness imagined, invented, or self-inflicted. While the “invention of odd complaints” is characteristically a token of folly or weakness throughout her writing, in this last work imagined illness is also both a symbol and a cause of how selves and societies degenerate. In the shifting world of Sanditon, hypochondria is the lubricant for a society bent on turning (...) health into a commodity. As a result, people’s rationality and their moral character come under attack. Catherine Belling’s recent subtle study, A Condition of Doubt: The Meanings of Hypochondria, unveils hypochondria’s discursive and cultural character. Running sharply against the tenor of Austen’s treatment, however, she argues in defense of the rationality of hypochondriacs; the notion that the condition may involve morally significant defects is not entertained; any connection to the commercialization of health care is muted. Here, I contrast Austen’s morally and epistemically negative rendering of her hypochondriacal characters in Sanditon with Belling’s efforts to create a sympathetic understanding of people with hypochondria. I will argue that, despite time gaps and genre differences, joint consideration of these texts can help bioethicists better appreciate how medicine can intensify, pathologize, and exploit anxieties about illness and death, thus adding to the challenges of living well in the face of mortality and morbidity. This contribution offers a sympathetic historical and intercultural reflection on Stephen Palmquist’s work Kant and Mysticism. It examines the appropriateness of this portrayal of Kant and mysticism in relation to its historical context, suggesting that Kant is committed to an account of rationality, ethical personhood and a ‘critical ethos’ in tension with mysticism; and the inadequacy of Kant’s understanding of mysticism in the context of South and East Asian philosophical and religious discourses, indicating the need for an intercultural turn in (...) the philosophy of religion. This dissertation is an investigation of the questions of time, history, and facticity in Dilthey and Heidegger. It is an exploration of the contextual character of experience and the scope and limits of understanding and interpretation. In particular, this work considers their historical and temporal character and relation to facticity. Facticity is that which escapes and resists interpretation, narration, and understanding. In Heidegger's language, facticity indicates the "thrownness" and "uncanniness" of existence which throws the "subject" and its construction of meaning (...) into question. As such, facticity is a positive characteristic of the finitude of human existence. I offer a reconstruction of the question of history in the works of Dilthey and Heidegger through an analysis of "historicality" . The discussion of Dilthey attempts to clarify his project of a "critique of historical reason" and his grounding of the human sciences. The interpretation of Heidegger is based on Heidegger's "hermeneutics of factical life" as developed in his lecture courses of the early 1920's and his thinking of the "event"-character of being in his works of the 1930's.
