Certain recent experiments are often taken to show that people are far more likely to classify a foreseen side-effect of an action as intentional when that side-effect has some negative normative valence. While there is some disagreement over the details, there is broad consensus among experimental philosophers that this is the finding. We challenge this consensus by presenting an alternative interpretation of the experiments, according to which they show that a side-effect is classified as intentional only if the agent considered (...) its relative importance when deciding on the action. We present two new experiments whose results can be explained by our hypothesis but not by any version of the consensus view. In the course of doing so, we develop a methodological critique of the previous literature on this topic and draw from it lessons for future experimental philosophy research. (shrink)

In the opening lines of ‘Black Orpheus’, written as a preface to an anthology of negritude poetry, Sartre challenges white readers ‘to feel, as I do, the shock of being seen’. Reading this poetry, he thinks, should undermine white people’s presumption of the objectivity of their perspective. Accordingly, the essay itself contradicts two prominent aspects of the philosophy he had so far developed: the idea that poetry could not be politically engaged; and the theory of radical freedom. These changes are (...) ultimately rooted in his realisation, upon reading this poetry, that his previous understanding of prose is mistaken. This has the consequence that his philosophical method, which derives ontological conclusions from prose descriptions of experience, has two important limitations: its premises cannot be drawn solely from his own experience; and French prose might be insufficient for formulating all relevant premises. He therefore revises his method to deploy this poetry as phenomenological grounds for ontological conclusions, which transforms his ontology of human existence to include cultural inheritance as a primary feature. We will see how this reading of negritude poetry exemplifies both the epistemic challenge involved in what he calls ‘the look’ and the use of listening in response to it. (shrink)

Clinical ethics consultation has become an important resource, but unlike other health care disciplines, it has no accreditation or accepted curriculum for training programs, no standards for practice, and no way to measure effectiveness. The Clinical Ethics Credentialing Project was launched to pilot‐test approaches to train, credential, privilege, and evaluate consultants.

Philosophers have recently argued that traditional discussions of virtue and character presuppose an account of behaviour that experimental psychology has shown to be false. Behaviour does not issue from global traits such as prudence, temperance, courage or fairness, they claim, but from local traits such as sailing-in-rough-weather-with-friends-courage and office-party-temperance. The data employed provides evidence for this view only if we understand it in the light of a behaviourist construal of traits in terms of stimulus and response, rather than in the (...) light of the more traditional construal in terms of inner events such as inclinations. More recent experiments have shown this traditional conception to have greater explanatory and predictive power than its behaviourist rival. So we should retain the traditional conception, and hence reject the proposed alteration to our understanding of behaviour. The scholars who defend or dispute moral relativism, the idea that a moral principle cannot be applied to people whose culture does not accept it, have concerned themselves with either the philosophical or anthropological aspects of relativism. This study, shows that in order to arrive at a definitive appraisal of moral relativism, it is necessary to understand and investigate both its anthropological and philosophical aspects. Carefully examining the arguments for and against moral relativism, Cook exposes not only that anthropologists have (...) failed in their attempt to support relativism with evidence of cultural differences, but that moral absolutists have been equally unsuccessful in their attempts to refute it. He argues that these conflicting positions are both guilty of an artificial and unrealistic view of morality and proposes a more subtle and complex account of morality. (shrink)

Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their neighbors (...) to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. Banking firms are becoming increasingly aware that their clients’ management of environmental and social risks may in term threaten their own business as lenders and investors. In addition, stakeholders are requiring banks to improve their social performance. As a result, some banks are developing corporate social responsibility (CSR) policies and management systems to reduce potential risks and improve their performance. In the Spanish financial system, half of the banking firms are savings banks, most of which have always used some Corporate (...) Social Responsibility (CSR) criteria in their management. Private Banks have only recently started to integrate social aspects in their performance. However, no formal analysis has been carried out on the impact of CSR strategies. Various initiatives have been launched nationally and internationally to include the social dimension in management systems. The purpose of this research is to analyse the social performance of the main Spanish financial companies through public data such as social or sustainability reports and media sources. In order to do this, we need to determine which CSR criteria most greatly affect banking firms and to choose the most accurate quantitative and qualitative indicators to measure social performance. The question—what is a political constitution?—might seem, at first blush, fairly innocuous. At one level, the idea of a political constitution seems fairly well settled, at least insofar as most political constitutionalists subscribe to a similar set of commitments, arguments and assumptions. At a second, more reflective level, however, there remains some doubt whether a political constitution purports to be a descriptive or normative account of a real world constitution, such as Britain’s. By exploring the idea of a political constitution (...) as differently articulated by J.A.G. Griffith, Adam Tomkins and Richard Bellamy, this essay explores why the normativity of a political constitution may be indistinct and ill-defined, and how compelling reasons for this indistinctness and ill-definition are to be found in the very idea of a political constitution itself. A political constitution is here conceived as a ‘model’ which supplies an explanatory framework within which to make sense of our constitutional self-understandings. The discipline of thinking in terms of a model opens up a critical space wherein there need not be some stark, all-encompassing choice between constitutional models, which, in turn, allows for more subtle understandings of Britain’s constitution as neither exclusively ‘political’ nor ‘legal’. This paper examines how digital technologies might be used to improve ethical attitudes towards nonhuman animals, by exploring the case study of nonhuman apes kept in modern zoos. The paper describes and employs a socio-ethical framework for undermining anti-ape prejudice advanced by philosopher Edouard Machery which draws on classic anti-racism strategies from the social sciences. We also discuss how digital technologies might be designed and deployed to enable and enhance rather than impede the three anti-prejudice strategies of contact and interaction, (...) enlightenment, and individualization. In doing so, the paper illuminates the broad potential and limitations of digital technology to both harm and benefit animals via its effects on human ethical attitudes. This examination provides guidance for future projects and empirical work on using digital technologies to promote moral respect for a range of nonhuman animals in different settings. (shrink)

This paper articulates a new understanding of Sartre’s philosophical methodology in his early publications up to and including Being and Nothingness. Through his critique of Husserl across these works, Sartre develops an original and sophisticated variety of transcendental phenomenology. He was attracted to Husserl’s philosophy for its promise to establish the foundations of empirical psychology but ultimately concluded that it could not fulfil this promise. Through the analyses that led him to this conclusion, Sartre formulated a new kind of phenomenological (...) reduction and a distinctive kind of transcendental argument to draw conclusions about mind-independent reality from phenomenological premises. His aims were to dissolve the traditional distinction between mind and world, to establish that the mind is accessible to empirical study, and to formulate the conceptual framework required to study the mind systematically. Sartre’s philosophy of psychology, therefore, drove the philosophical development of the methodological foundation of his philosophical project. (shrink)

When policymakers craft rules for use by the general public, they must take into account the ways in which their rules are likely to be misapplied. Should contractualists and rule consequentialists do the same when they search for rules whose general acceptance would be non-rejectable or ideal? I argue that these theorists face a dilemma. If they ignore the possibility of misapplication, they end up with an unrealistic view that rejects rules designed to protect us from others’ mistakes. On the (...) other hand, if they take misapplication into account, they end up rejecting rules that appeal to what really matters morally in favor of easier-to-apply proxies for these rules. This leaves them unable to say why certain wrong acts are wrong, which in turn may lead them to mistaken verdicts about moral worth and wronging. I show how this misapplication dilemma applies to standard contractualist and rule consequentialist theories, but also suggest how it might generalize to other two-level theories, including those designed to avoid the ideal world objection. In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. The aim of this paper is to critically examine David Shaw, Wybo Dondorp, and Guido de Wert’s arguments in favour of the procurement of human organs from human/nonhuman-primate chimeras, specifically from great-ape/human chimeras. My main claim is that their arguments fail and are in need of substantial revision. To prove this I first introduce the topic, and then reconstruct Shaw et al.’s position and arguments. Next, I show that Shaw et al.: (1) failed to properly apply the subsidiarity and proportionality (...) principles; (2) neglected species overlapping cases in their ethical assessment; (3) ignored the ethics literature on borderline persons; and (4) misunderstood McMahan’s two-tiered moral theory. These mistakes render an important part of their conclusions either false or problematic to the point that they would no longer endorse them. Finally I will briefly mention a possible multipolar solution to the human organ shortage problem that would reduce the need for chimeras’ organs. (shrink)

Cortical stimulation has been used for brain mapping for over a century, and a standard assumption is that stimulation interferes with task execution due to local effects at the stimulation site. Stimulation can however produce afterdischarges which interfere with functional localization and can lead to unwanted seizures. We previously showed that cognitive effort can terminate these afterdischarges, when termination thus occurs, there are electrocorticography changes throughout the cortex, not just at sites with afterdischarges or sites thought functionally important for the (...) cognitive task used, and thresholds for afterdischarges and functional responses can change among stimulation trials. We here show that afterdischarge termination can occur prior to overt performance of the cognitive tasks used to terminate them. These findings, taken together, demonstrate that task-related brain changes are not limited to one or a group of functional regions or a specific network, and not limited to the time directly surrounding overt task execution. Discrete locations, networks and times importantly underpin clinical behaviors. However, brain activity that is diffuse in location and extended in time also affect task execution and can affect brain mapping. This may in part reflect fluctuating levels of attention, engagement, or motivation during testing. (shrink)

In this paper I explore some of the moral issues that could emerge from the creation of human–nonhuman chimeras capable of human gamete production and human pregnancy. First I explore whether there is a cogent argument against the creation of HNH-chimeras that could produce human gametes. I conclude that so far there is none, and that in fact there is at least one good moral reason for producing such types of creatures. Afterwards I explore some of the moral problems that (...) could emerge from the fact that a HNH-chimera could become pregnant with a human conceptus. I focus on two sets of problems: problems that would arise by virtue of the fact that a human is gestated by a nonhuman creature, and problems that would emerge from the fact that such pregnancies could affect the health of the HNH-chimera. Research clearly shows that increasing the number of women in leadership positions yields financial benefits for the organization. Despite this, there has been limited upward movement in the percentage of women in senior leadership positions. Few studies have examined the linkage between masculine culture and the implications for men. Using a mixed methods approach with two studies, this research focused on four aspects of masculine contest cultural norms and how they impact male identity and perceptions of career advancement. Study 1 (...) used a qualitative interview study of 10 male executives and found that masculine contest culture norms were evident but were being perpetuated and reinforced by organizational culture instead of individual masculine identities. In addition, Study 1 demonstrated a shift in masculine contest culture norms reducing the emphasis on the strong male archetype. Study 2 examines the relationship between masculine contest culture attributes impacting perceived opportunities for career development and promotion. We evaluated these relationships through a large‐scale survey study and found that at higher levels of masculine contest culture norms, men's perceptions of procedural justice for career development and promotion were lower compared with women. Broadly, the findings suggest that masculine archetypes of leadership negatively affect men and women. (shrink)

In the present paper we address the problem of optical isomerism embodied in the socalled “Hund’s paradox”, which points to the difficulty to account for chirality by means of quantum mechanics. In particular, we explain the answer to the problem proposed by the theory of decoherence. The purpose of this article is to challenge this answer on the basis of a conceptual analysis of the phenomenon of decoherence, that reveals the limitations of the theory of decoherence to solve the difficulties (...) posed by optical isomerism and, in general, by quantum measurement. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

The use of technologies like artificial intelligence can drive productivity growth, efficiency and innovation. The goal of this study is to develop an anomaly detection method for locating flaws on the surface of sandwich panels using YOLOv5. The proposed algorithm extracts information locally from an image through a prediction system that creates bounding boxes and determines whether the sandwich panel surface contains flaws. It attempts to reject or accept a product based on quality levels specified in the standard. To evaluate (...) the proposed method, a comparison was made with a sandwich panel damage detection method based on a convolutional neural network and methods based on thresholding. The findings show that the proposed method, which is based on an object detector, is more accurate than the alternatives. The characteristics of the model, which can reject or accept a product according to the standard and limit allowable manufacturing flaws to obtain a quality product, also enable this system to improve industrial standards for producing sandwich panels while increasing speed. We each have good reason to mislead rather than make bullshit assertions, but to make bullshit assertions rather than lie. This is because these forms of deception damage credibility in different ways. We can trust the misleader to assert only what they believe to be true. The relation between Wittgenstein's philosophy of mathematics and mathematical Intuitionism has raised a considerable debate. My attempt is to analyse if there is a commitment in Wittgenstein to themes characteristic of the intuitionist movement in Mathematics and if that commitment is one important strain that runs through his Remarks on the foundations of mathematics. The intuitionistic themes to analyse in his philosophy of mathematics are: firstly, his attacks on the unrestricted use of the Law of Excluded Middle; secondly, his distrust (...) of non-constructive proofs; and thirdly, his impatience with the idea that mathematics stands in need of a foundation. These elements are Fogelin's starting point for the systematic reconstruction of Wittgenstein's conception of mathematics. (shrink)

Background:The decision whether to initiate cardiopulmonary resuscitation may sometimes be ethically complex. While studies have addressed some of these issues, along with the role of nurses in cardiopulmonary resuscitation, most have not considered the importance of nurses acting as advocates for their patients with respect to cardiopulmonary resuscitation.Research objective:To explore what the nurse’s advocacy role is in cardiopulmonary resuscitation from the perspective of patients, relatives, and health professionals in the Basque Country (Spain).Research design:An exploratory critical qualitative study was conducted from (...) October 2015 to March 2016. Thematic analysis was used to analyse the data.Participants:Four discussion groups were held: one with patients and relatives (n = 8), two with nurses (n = 7 and n = 6, respectively), and one with physicians (n = 5).Ethical considerations:Approval was obtained from the Basque Country Clinical Research Ethics Committee.Findings:Three significant themes were identified: (a) accompanying patients during end of life in a context of medical dominance, (b) maintaining the pact of silence, and (c) yielding to legal uncertainty and concerns.Discussion:The values and beliefs of the actors involved, as well as pre-established social and institutional rules reduced nurses’ advocacy to that of intermediaries between the physician and the family within the hospital environment. On the contrary, in primary health care, nurses participated more actively within the interdisciplinary team.Conclusion:This study provides key information for the improvement and empowerment for ethical nursing practice in a cardiac arrest, and provides the perspective of patients and relatives, nurses and physicians. This provocative study exposes the ways in which Wittgenstein's philosophical views have been misunderstood, including the failure to recognize the reductionist character of Wittgenstein's work. Author John Cook provides well-documented proof that Wittgenstein did not hold views commonly attributed to him, arguing that Wittgenstein's later work was mistakenly seen as a development of G. E. Moore's philosophy--which Wittgenstein in fact vigorously attacked. He also points to an underestimation of Russell's influence on Wittgenstein's thinking. Cook goes on to show how these (...) misunderstandings have had grave consequences for philosophy at large, and proposes that a more subtle appreciation of linguistic philosophy can yield valuable results. Various influential ethical theories propose that we should strive to develop morally sound character traits, either because good actions are those that issue from good character traits, or because good traits are those that generally incline us toward actions that are good for some independent reason such as the intentions with which they are performed or the consequences of performing them. This proposal obviously raises questions about the nature and origins of character traits, and our degree of control over them. (...) Jonathan Webber articulates an original interpretation of existentialism as the ethical theory that human freedom is the foundation of all other values. Offering an original analysis of classic literary and philosophical works published by Jean-Paul Sartre, Simone de Beauvoir, and Frantz Fanon up until 1952, Webber's conception of existentialism is developed in critical contrast with central works by Albert Camus, Sigmund Freud, and Maurice Merleau-Ponty. -/- Presenting his arguments in an accessible and engaging style, Webber contends that (...) Beauvoir and Sartre initially disagreed over the structure of human freedom in 1943 but Sartre ultimately came to accept Beauvoir's view over the next decade. He develops the viewpoint that Beauvoir provides a more significant argument for authenticity than either Sartre or Fanon. He articulates in detail the existentialist theories of individual character and the social identities of gender and race, key concerns in current discourse. Automaticity is rapid and effortless cognition that operates without conscious awareness or deliberative control. An action is virtuous to the degree that it meets the requirements of the ethical virtues in the circumstances. What contribution does automaticity make to the ethical virtue of an action? How far is the automaticity discussed by virtue ethicists consonant with, or even supported by, the findings of empirical psychology? We argue that the automaticity of virtuous action is automaticity not of skill, but of motivation. (...) Automatic motivations that contribute to the virtuousness of an action include not only those that initiate action, but also those that modify action and those that initiate and shape deliberation. We then argue that both goal psychology and attitude psychology can provide the cognitive architecture of this automatic motivation. Since goals are essentially directed towards the agent’s own action whereas attitudes are not, we argue that goals might underpin some virtues while attitudes underpin others. We conclude that consideration of the cognitive architecture of ethical virtue ought to engage with both areas of empirical psychology and should be careful to distinguish among ethical virtues. Webber argues for a new interpretation of Sartrean existentialism. On this reading, Sartre is arguing that each person’s character consists in the projects they choose to pursue and that we are all already aware of this but prefer not to face it. Careful consideration of his existentialist writings shows this to be the unifying theme of his theories of consciousness, freedom, the self, bad faith, personal relationships, existential psychoanalysis, and the possibility of authenticity. Developing this account affords many insights (...) into various aspects of his philosophy, not least concerning the origins, structure, and effects of bad faith and the resulting ethic of authenticity. This discussion makes clear the contributions that Sartre’s work can make to current debates over the objectivity of ethics and the psychology of agency, character, and selfhood.
