An historical review of the concepts of self-consciousness is presented, highlighting the important role of the body (particularly, body perception but also body action) and the social other in the construction of self-consciousness. More precisely, body perception, especially intermodal sensory perception including kinesthetic perception, is involved in the construction of a sense of self allowing self-nonself differentiation. Furthermore, the social other, through very early social and emotional interactions, provides meaning to the infant’s perception and contributes to the development of his/her (...) symbolization capacities. This is a necessary condition for body image representation and awareness of a permanent self in a time-space continuum (invariant over time and space). Self-image recognition impairments in the mirror are also discussed regarding a comprehensive developmental theory of self-consciousness. Then, a neuropsychological and neurophysiological approach to self-consciousness reviews the role of complex brain activation/integration pathways and the mirror neuron system in self-consciousness. Finally, this article offers new perspectives on self-consciousness evaluation using the mirror as an experimental paradigm to study self- and other- image and body recognition. (shrink)

Les violences subies pendant l’enfance peuvent gravement affecter le développement et la santé des mineurs. La clinique de la violence chez l’enfant et l’adolescent et son traitement sont très spécifiques. Pédiatres et médecins légistes ont ainsi créé la Société française de pédiatrie médico-légale ( sfpml ) afin de penser les violences faites aux mineurs, du repérage à l’expertise, pour proposer des actions adaptées à leur particulière vulnérabilité et penser la prévention. L’enfant doit être un sujet de soins et non pas (...) un objet d’investigation. La pédiatrie médico-légale promeut une pratique intégrée dans une dynamique de parcours de soins. L’expérimentation nationale « Santé protégée » a pour objectif d’améliorer la santé globale de ces enfants et adolescents en facilitant l’accès aux soins, le suivi et la coordination. Il paraît important aujourd’hui de mener des actions de prévention et de soins et d’assurer un accompagnement sécurisant des enfants pour limiter l’impact des violences et leur permettre de bien grandir. In the literature on medical ethics, it is generally admitted that vulnerable persons or groups deserve special attention, care or protection. One can define vulnerable persons as those having a greater likelihood of being wronged – that is, of being denied adequate satisfaction of certain legitimate claims. The conjunction of these two points entails what we call the Special Protection Thesis. It asserts that persons with a greater likelihood of being denied adequate satisfaction of their legitimate claims deserve special attention, (...) care or protection. Such a thesis remains vague, however, as long as we do not know what legitimate claims are. This article aims at dispelling this vagueness by exploring what claims we have in relation to health care – thus fleshing out a claim-based conception of vulnerability. We argue that the Special Protection Thesis must be enriched as follows: If individual or group X has a greater likelihood of being denied adequate satisfaction of some of their legitimate claims to physical integrity, autonomy, freedom, social provision, impartial quality of government, social bases of self-respect or communal belonging, then X deserves special attention, care or protection. With this improved understanding of vulnerability, vulnerability talk in healthcare ethics can escape vagueness and serve as an adequate basis for practice. (shrink)

BackgroundEverybody has the right to decide whether to receive specific medical treatment or not and to provide their free, prior and informed consent to do so. As dementia progresses, people with Alzheimer’s dementia (PwAD) can lose their capacity to provide informed consent to complex medical treatment. When the capacity to consent is lost, the autonomy of the affected person can only be guaranteed when an interpretable and valid advance directive exists. Advance directives are not yet common in Germany, and their (...) validity is often questionable. Once the dementia diagnosis has been made, it is assumed to be too late to write an advance directive. One approach used to support the completion of advance directives is ‘Respecting Choices’®—an internationally recognised, evidence-based model of Advance Care Planning (ACP), which, until now, has not been evaluated for the target group of PwAD. This study’s aims include (a) to investigate the proportion of valid advance directives in a memory clinic population of persons with suspected AD, (b) to determine the predictors of valid advance directives, and (c) to examine whether the offer of ACP can increase the proportion of valid advance directives in PwAD.MethodWe intend to recruit at leastN = 250 participants from two memory clinics in 50 consecutive weeks. Of these, the first 25 weeks constitute the baseline phase (no offer of ACP), the following 25 weeks constitute the intervention phase (offer of ACP). The existence and validity of an advance directive will be assessed twice (before and after the memory clinic appointment). Moreover, potential predictors of valid advance directives are assessed.DiscussionThe results of this study will enhance the development of consent procedures for advance directives of PwAD based on the ACP/Respecting Choices (R) approach. Background This analysis is about practical living bioethics and how law, ethics and sociology understand and respect children’s consent to, or refusal of, elective heart surgery. Analysis of underlying theories and influences will contrast legalistic bioethics with living bioethics. In-depth philosophical analysis compares social science traditions of positivism, interpretivism, critical theory and functionalism and applies them to bioethics and childhood, to examine how living bioethics may be encouraged or discouraged. Illustrative examples are drawn from research interviews and observations in two (...) London paediatric cardiac units. This paper is one of a series on how the multidisciplinary cardiac team members all contribute to the complex mosaic of care when preparing and supporting families’ informed consent to surgery. Results The living bioethics of justice, care and respect for children and their consent depends on theories and practices, contexts and relationships. These can all be undermined by unseen influences: the history of adult-centric ethics; developmental psychology theories; legal and financial pressures that require consent to be defined as an adult contract; management systems and daily routines in healthcare that can intimidate families and staff; social inequalities. Mainstream theories in the clinical ethics literature markedly differ from the living bioethics in clinical practices. Conclusion We aim to contribute to raising standards of respectful paediatric bioethics and to showing the relevance of virtue and feminist ethics, childhood studies and children’s rights. (shrink)

Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. BackgroundThe UN Convention on the Rights of Persons with Disabilities, and the reformed guardianship law in Germany, require that persons with a disability, including people with dementia in Alzheimer’s disease (PwAD), are supported in making self-determined decisions. This support is achieved through communication. While content-related communication is a deficit of PwAD, relational aspects of communication are a resource. Research in supported decision-making (SDM) has investigated the effectiveness of different content-related support strategies for PwAD but has only succeeded in improving understanding, (...) which, although one criterion of capacity to consent, is not sufficient to ensure overall capacity to consent. The aim of the ‘spatial intervention study’ of the DECIDE project is to examine an innovative resource-oriented SDM approach that focuses on relational aspects. We hypothesise that talking to PwAD in their familiar home setting (as opposed to a clinical setting) will reduce the complexity of the decision-making process and enhance overall capacity to consent. MethodsPeople with a suspected or confirmed diagnosis of dementia in Alzheimer’s disease will be recruited from two memory clinics (N = 80). We will use a randomised crossover design to investigate the intervention effect of the decision-making place on capacity to consent. Besides reasoning capacity, which is part of overall capacity to consent and will be the primary outcome, various secondary outcomes (e.g., other aspects of capacity to consent, subjective task complexity, decisional conflict) and suspected moderating or mediating variables (e.g., meaning of home, demographic characteristics) will be assessed.DiscussionThe results of the study will be used to develop a new SDM strategy that is based on relational resources for PwAD. If a change in location achieves the anticipated improvement in capacity to consent, future research should focus on implementing this SDM strategy in a cost-effective manner in clinical practice.Trial registration: DRKS00030799. The aim of this article is to investigate and discuss the notions of difference and representation in Emmanuel Levinas and Gilles Deleuze, articulating such notions through the example of a university extension project involving the formation of a musical ensemble composed of autistic children. Our research involved a review of four major philosophical works—Emmanuel Levinas’ Totality and Infinity; Among Us: Essays On Alterity; and “The Concept Of Difference In Bergson”; and Gilles Deleuze’s Difference and Repetition--in addition to secondary references. The (...) main articulations of the investigation carried out in the project consist of aspects such as: taking responsibility for the autistic child through cultivating asymmetrical relationships, a process that takes place through sensibility, below any representation; and not totalizing the alterity involved while maintaining, at the same time, its radical difference. In addition, there is an emphasis in the work on the difference of each child, beyond his or her diagnostic identity, understanding that all participants are undergoing unique processes of differentiation, and that some differences are not more privileged than others, in that that such hierarchies are determined by power relations. Another contribution of this research is the emphasis on the intensive affective flows of children, and the construction of relationships of mutual affection, which increases the circulation of vital energy in each one. Finally, the results of the project are offered as guidelines for clinical practice, and for the cultivation of a politics of difference, as an alternative to hegemonic practices in autism studies in contemporary times. Scholarly opinions vary on what language is, how it evolved, and from where or what it evolved. Long considered uniquely human, today scholars argue for evolutionary continuity between human language and animal communication systems. But while it is generally recognized that language is an evolving communication system, scholars continue to debate from which species language evolved, and what behavioral and cognitive features are the precursors to human language. To understand the nature of protolanguage, some look for homologs in gene functionality, (...) brain areas, or anatomical structures such as the supralaryngeal vocal tract; others point toward primates, their gestural, vocal, multimodal, and in later evolving hominins also their pantomimic communication systems; and still others draw parallels between the musicality that characterizes language and the pitch found in the numerous sounds produced by animals. Accordingly, protolanguage theories today are multiple and diverse, and protolanguages might have also been diverse. This special issue on Evolving (Proto)Language/s for Lingua bundles several of the protolanguage theories that were put forward at the sixth edition of the Ways to Protolanguage conference series, held at the Calouste Gulbenkian Foundation in Lisbon, in 2019. Not aimed at surveying all the different ways there are to conceptualize, study, and model protolanguage/s, this issue provides interested readers with good overviews on the role played in current theorizing on protolanguage/s by (paleo)anthropology, genetics, physiology, developmental, evolutionary, ecological, and pragmatic research lines. Online supplement, "Mulsow: Additions to Notes drawn from the 2002 edition of Moderne aus dem Untergrund" full versions of nearly 300 notes that were truncated in the print edition. Hosted on H. C. Erik Midelfort's website. Martin Mulsow's seismic reinterpretation of the origins of the Enlightenment in Germany won awards and renown in its original German edition, and now H. C. Erik Midelfort's translation makes this sensational book available to English-speaking readers. In Enlightenment Underground, Mulsow shows that even in (...) the late seventeenth century some thinkers in Germany ventured to express extremely dangerous ideas, but did so as part of a secret underground. Scouring manuscript collections across northern Europe, Mulsow studied the writings of countless hitherto unknown radical jurists, theologians, historians, and dissident students who pushed for the secularization of legal, political, social, and religious knowledge. Often their works circulated in manuscript, anonymously, or as clandestinely published books. Working as a philosophical microhistorian, Mulsow has discovered the identities of several covert radicals and linked them to circles of young German scholars, many of whom were connected with the vibrant radical cultures of the Netherlands, England, and Denmark. The author reveals how radical ideas and contributions to intellectual doubt came from Socinians and Jews, church historians and biblical scholars, political theorists, and unemployed university students. He shows that misreadings of humorous or ironic works sometimes gave rise to unintended skeptical thoughts or corrosively political interpretations of Christianity. This landmark book overturns stereotypical views of the early Enlightenment in Germany as cautious, conservative, and moderate, and replaces them with a new portrait that reveals a movement far more radical, unintended, and puzzling than previously suspected. As an outcome of scientific thinking, evolutionary theories change in accordance with progress made. Here, we trace the evolution of evolutionary thought through seven different research schools that have arisen since the introduction of Darwin’s Origin of Species. These schools include Darwinism, the Modern Synthesis, Micro-, Meso-, and Macroevolution, Ecology, and Reticulate Evolution. The schools of Darwinism and the Modern Synthesis together lie at the foundation of the Neo-Darwinian paradigm. This paradigm has now expanded into the schools of Microevolution, Mesoevolution, (...) and Macroevolution that respectively study how genes, organisms, and species evolve over time. The school of Ecology instead investigates how genes, organisms, and species interact with one another and with the physical environment in space. The Eco-Evo-Devo paradigm attempts to integrate the tenets of Ecology with those of Micro-, Meso-, and Macroevolutionary research. The Reticulate Evolution school studies non-selectionist mechanisms such as symbiosis, symbiogenesis, lateral gene transfer, infective heredity, and hybridization. This paper outlines the major research directions and points of controversies that arise between these distinct schools. It furthermore situates the Extended Evolutionary Synthesis and Third Way of Evolution along these schools. The call for an Extended Evolutionary Synthesis originated in the Mesoevolution school, while scholars active in the Third Way of Evolution movement are developing ways to recognize the important contributions made by all evolution schools. This paper discusses the establishment of a governance framework to secure the development and deployment of “good AI”, and describes the quest for a morally objective compass to steer it. Asserting that human rights can provide such compass, this paper first examines what a human rights-based approach to AI governance entails, and sets out the promise it propagates. Subsequently, it examines the pitfalls associated with human rights, particularly focusing on the criticism that these rights may be too Western, too individualistic, (...) too narrow in scope and too abstract to form the basis of sound AI governance. After rebutting these reproaches, a plea is made to move beyond the calls for a human rights-based approach, and start taking the necessary steps to attain its realisation. It is argued that, without elucidating the applicability and enforceability of human rights in the context of AI; adopting legal rules that concretise those rights where appropriate; enhancing existing enforcement mechanisms and securing an underlying societal infrastructure that enables human rights in the first place, any human rights-based governance framework for AI risks falling short of its purpose. Research on the influence of industry on chemical regulation has mostly been conducted within the framework of the production of ignorance. This special issue extends this research by looking at how industry asserts its interests––not just in the scientific sphere but also at other stages of policy-making and regulatory process––with a specific focus on the types of tools or instruments industry has used. Bringing together sociologists and historians specialized in Science and Technology Studies, the articles of the special issue study (...) the arenas in which instruments and practical guidelines for public policy are negotiated or used. The aim is to observe the devices in the making or in action, from the selection of actors to the production of thresholds, criteria, and other technical regulations. The introduction highlights how industry influence on expertise and regulation is undoubtedly far more pervasive and multifarious than has been conceptualized to date by social scientists. Putting this issue back at the heart of both the STS and social sciences research agendas is increasingly urgent and could lead to new inquiries able to highlight these logics even more widely, using fresh empirical examples. It is important to understand the drivers of green consumption, because of growing concern for the health of the planet. In this paper, the assumption that a virtue-green product relationship exists is tested. The objective is to understand how product morality can influence the valuation of green products. Relying on virtue theory and positive spillover as conceptual bases, the research implicitly and explicitly tests and confirms green product virtue. The results demonstrate that perceived green product virtue leads to positive emotions, (...) which explain heightened purchase intentions. In line with the conceptualization, I show that the effect is moderated by the importance consumers place on their own morality. Importantly, explicitly framing green products as virtuous activates positive spillover by consumers; when green products are branded with a virtue cue, they encourage consumers to be more virtuous. Beyond being perceived as better people, when consumers interact with green products they effectively engage in more moral acts, such as making donations. The results confirm the perception of green products as moral agents and provide marketers with insights into the marketing value of virtue cues in green product consumption. (shrink)

The explanatory power of structures in analytical sociologists’ agent-based models brings into question methodological individualism. We defend that from an explanatory point of view, the syntactic properties of models require semantic conditions of interpretation drawn from a conceptual research framework; in such a framework, social/relational structures have only partial, explanatory power ; and taking the explanation further through generative mechanism modeling necessitates calling upon methodological individualism’s generic framework of interpretation that relies on social actors’ rational capacity. In the 1990s, Building Information Modeling (BIM) software significantly altered architectural approaches to planning and building. Based on parametric methods, BIM technologies sought to simulate the construction process prior to a building’s realisation. These computer simulations challenged the existing practice of representing a building through plan, section and elevation, proposing that one computational model could create a more efficient way of building. The history of BIM explorations and applications, while hardly linear, can be traced back to developments in computing since (...) the post-war period. This article maps some of these histories by examining how the computational model became an organisational infrastructure, collecting data about design and building parameters, and facilitating knowledge transfer across industries. Special attention will be given to the foundational role of Charles Eastman’s work on a Building Description System (BDS) in the 1970s, as well as Robert Aish’s contribution to RUCAPS, one of the earliest applications of Building Modeling for the design of parametric structures. I will further address research on interface technologies and computational curve modelling as well as the popularisation of Building Information systems through the office of Gehry Partners. By highlighting the interrelated nature of technology and cultural shifts in the making of BIM, this contribution sheds light on the epistemic status of computer simulations in architecture, and the dynamics of the design and building processes in which they are used. Cet article entend cerner la spécificité de la critique littéraire de l’art telle qu’elle fut pratiquée par les écrivains et poètes en France entre 1850 et 1950, dans le sillage de Diderot, à partir d’un examen des écrits sur l’art de Diderot, Baudelaire, Zola, Stendhal, Huysmans, Valéry, Proust, Reverdy, Leiris. Au-delà des différences individuelles de goût, de statut, de sujets traités et de la prolixité discursive évidente dans la pratique, on peut mettre en lumière les points de convergence qui s’observent (...) dans leurs écrits, afin de cerner le propre de la critique littéraire de l’art du point de vue de la démarche, de la méthode et du style. Ces convergences prennent fond dans une posture commune aux écrivains, qui est celle du non-spécialiste, cultivant résolument la pensée libre et subjective. (shrink)

En deçà de la symbolique d’échange et « d’objet-matières » à donner ou à garder telle que l’a définie Freud, les jeunes enfants associent également cette étape à la perte des eaux et à la naissance, et certains vécus (...) difficiles ayant entouré la naissance peuvent alors se raviver. Dans cet article, deux vignettes cliniques issues d’une pratique en crèche montrent que les notions théoriques d’angoisse de mort par écoulement et liquéfaction décrites dans le champ de la clinique de l’autisme peuvent éclairer cette étape de l’enfance. Anhand eines dreistufigen Modells der Nachfrage nach Normen, ihrer Funktionen und des Angebots an verfügbaren Normen wird untersucht, warum und mit welcher Zielsetzung welche Ethik-Maßnahmen wann und wo eingeführt wurden. Grundlegende theoretische Annahme ist, dass (...) Personen in öffentlichen Ämtern und Mandaten in einem Treue- und Legitimationsverhältnis zum demokratischen Souverän stehen, welches sich als eine Kette von Principal-Agent-Beziehungen modellieren lässt. Empirisch wird das Modell entwickelt aus einem Vergleich der so genannten”Ethik-Infrastrukturen“- also des Bestandes an Normen und Regeln, die das Verhalten von Abgeordneten, Exekutivpolitikern und Verwaltungsmitarbeiter regeln - in Deutschland und USA. Korruption und Skandale spielen hierbei eine entscheidende Rolle, aber auch die politische und administrative Kultur eines Landes sowie die Setzung internationaler Standards. Die Studie wurde ausgezeichnet mit dem Nachwuchspreis 2005 der DVPW als beste Dissertation. (shrink)

Dans leurs écrits sur l’art, Diderot et Baudelaire montrent comment les lignes des tableaux dirigent l’œil pour générer un intérêt, voire un choc déclencheur d’une expérience esthétique lorsqu’elles sont brisées. Les rides, fissures, plis qui rompent l’harmonie des figures sont pour Diderot une source profonde d’émotion, tandis que la ligne serpentine est de préférence infléchie en arabesque par Baudelaire. À leur façon, le philosophe et le poète montrent ainsi comment la pensée esthétique moderne se nourrit de ces désordres et irrégularités (...) de l’art en redéfinissant le beau idéal classique en une brisure de l’idéal. In this article I present the phenomenological tradition as a new grounding for human rights as universal rights. The hypothesis defended is to conciliate Husserl’s phenomenological method and Reinach’s a priori law in order to offer a new grounding to human rights. In order to combine Husserl and Reinach’s ideas, I propose to expand the comprehension of a priori. It would be present as eidos of each object and I name it as material a priori; it also be present in (...) the eidetic relations and I name it as formal a priori. Yet the object would have an essence, a necessary content, a material a priori, and necessary states of affairs, necessary relations and connections, a formal a priori. Reinach, in The A priori Foundations of the Civil Law, describes eidetic relations, such as, the relation between promise, claim and obligation. I propose three eidetic universalities to ground law, these are what I will call human rights. I also face a few difficulties presented by DuBois and De Vecchi derived from the amoral approach of a priori laws. Then, I highlight the difference between this proposition and Albert’s. Finally, I defend the proposition that a priori laws are beyond natural and positive laws. (shrink)

D'un philosophe comme de l'autre, on peut dire qu'ils sont tous deux, dans l'horizon contemporain, des penseurs de l'amour. Tous deux s'inscrivent en faux contre la réduction de ce dernier à la sexualité, mais, tout autant, contre sa réduction inverse, plus ancienne, à une forme de mystique éthérée de type platonico-chrétien qui a pu se formuler sous le terme d'agapè. Nous nous proposons dans cette contribution d'étudier la pensée de J.-L. Marion en adoptant l'hypothèse d'une « unité théo-phénoménologique » de (...) son questionnement. Nous faisons usage du terme « théo-phénoménologie » en référence à l'approche de l'œuvre du philosophe et théologien grec Christos Yannaras, et souhaitons ce faisant rendre justice à l'avancée de J.-L. Marion en situant son geste philosophique singulier à la lumière de la théologie orthodoxe du Christianisme grec oriental telle qu'elle est elle-même renouvelée philosophiquement par C. Yannaras. Jean-Luc Marion and Christos Yannaras are both well-known as contemporary love-thinkers. Both refuse the reduction of love to sexuality as much as its older opposite reduction to a form of platonic christian mystics sometimes named agapè. In the following contribution I wish to examine Jean-Luc Marion's approach while making the hypothesis of its « theo-phenomenological » unity. Since the expression « theo-phenomenology » is used in reference to the work of the contemporary Greek philosopher and theologian Christos Yannaras, I aim at doing justice to Marion's philosophical thrust by putting his conception of love in the light of the Orthodox theology of the Eastern Church as it is nowadays philosophically renewed by Yannaras.
