This paper describes a three-year project designed to build the capacity of members of research ethics committes to perform their roles and responsibilities efficiently and effectively. The project participants were made up of a cross-section of the membership of 13 Research Ethics Committees (RECs) functioning in Nigeria. They received training to develop their capacity to evaluate research protocols, monitor trial implementation, provide constructive input to trial staff, and assess the trial's success in promoting community engagement in the research. Following the (...) training, technical assistance was provided to participants on an ongoing basis and the project's impacts were assessed quantitatively and qualitatively. Results indicate that sustained investment in capacity building efforts (including training, ongoing technical assistance, and the provision of multiple tools) improved the participants’ knowledge of both the ethical principles relevant to biomedical research and how effective REC should function. Such investment was also shown to have a positive impact on the knowledge levels of other RECs members (those who did not receive training) and the overall operations of the RECs to which the participants belonged. Building the capacity of REC members to fulfill their roles effectively requires sustained effort and investment and pays off by enabling RECs to fulfill their essential mission of ensuring that trials are conducted safely and ethically. What is morality? How many moral values are there? And what are they? According to the theory of morality-as-cooperation, morality is a collection of biological and cultural solutions to the problems of cooperation recurrent in human social life. This theory predicts that there will be as many different types of morality as there are different types of cooperation. Previous research, drawing on evolutionary game theory, has identified at least seven different types of cooperation, and used them to explain seven different (...) types of morality: family values, group loyalty, reciprocity, heroism, deference, fairness and property rights. Here we explore the conjecture that these simple moral ‘elements’ combine to form a much larger number of more complex moral ‘molecules’, and that as such morality is a combinatorial system. For each combination of two elements, we hypothesise a candidate moral molecule, and successfully locate an example of it in the professional and popular literature. These molecules include: fraternity, blood revenge, family pride, filial piety, gavelkind, primogeniture, friendship, patriotism, tribute, diplomacy, common ownership, honour, confession, turn taking, restitution, modesty, mercy, munificence, arbitration, mendicancy, and queuing. These findings indicate that morality – like many other physical, biological, psychological and cultural systems – is indeed a combinatorial system. Thus morality-as-cooperation provides a principled and powerful theory, that explains why there are many moral values, and successfully predicts what they will be; and it generates a systematic framework that has the potential to explain all moral ideas, possible and actual. Pursuing the many implications of this theory will help to place the study of morality on a more secure scientific footing. (shrink)

In this article, I examine what Kant’s Formula of Universal Law requires of an individual agent in situations of great need, e.g.: if you can easily help a drowning child, or if you know of a famine situation in another country. I first explain why I do not simply apply the standard interpretation of how one can derive concrete duties from Kant’s Universal Law formulation of the Categorical Imperative. I then glean an alternative procedure from Kant’s texts and give the (...) reasons for using that interpretation. Finally, I apply the alternative procedure to situations of great need. – According to the interpretation I glean from Kant’s texts, one (i) should not make an exception to (ii) laws that we believe to be objectively necessary, whereby we derive these rules from (iii) universal ends of humankind. Since we take survival as one of the universal ends of mankind, we deem helping someone whose life is in danger as objectively necessary (to achieve the end). The formal Categorical Imperative demands that one does not make an exception to this rule. Applying this interpretation to cases of great need depends on at least three factors: (i) how urgent the need is, (ii) how great the costs are to the one who helps, and (iii) how many people can help. But at one extreme, where you are the only one who can easily save an innocent person’s life, the Kantian procedure generates a strict duty to help the other in need. (shrink)

Philosophy in the English-speaking world is dominated by analytic approaches to its problems and projects; but theology has been dominated by alternative approaches. Many would say that the current state in theology is not mere historical accident, but is, rather, how things ought to be. On the other hand, many others would say precisely the opposite: that theology as a discipline has been beguiled and taken captive by 'continental' approaches, and that the effects on the discipline have been largely deleterious. (...) The methodological divide between systematic theologians and analytic philosophers of religion is ripe for exploration. The present volume represents an attempt to begin a much-needed interdisciplinary conversation about the value of analytic philosophical approaches to theological topics. Most of the essays herein are sympathetic toward the enterprise the editors are calling analytic theology; but, with an eye toward balance, the volume also includes essays and an introduction that try to offer more critical perspectives on analytic theology. In this paper I offer an argument against one important version of panentheism, that is, mereological panentheism. Although panentheism has proven difficult to define, I provide a working definition of the view, and proceed to argue that given this way of thinking about the doctrine, mereological accounts of panentheism have serious theological drawbacks. I then explore some of these theological drawbacks. In this article I argue that Kant's conception of dignity is commonly misunderstood. On the basis of a few passages in the Grundlegung scholars often attribute to Kant a view of dignity as an absolute inner value all human beings possess. However, a different picture emerges if one takes into account all the passages in which Kant uses ‘dignity’. I shall argue that Kant's conception of dignity is a more Stoic one: He conceives of dignity as sublimity ( Erhabenheit ) (...) or the highest elevation of something over something else. ‘Dignity’ expresses that something is ‘raised above’ all else. What it is raised above, and in virtue of what, depends on the context in which Kant uses ‘dignity’. For instance, he talks about the dignity of a monarch to refer to his rank as the ruler of his subjects. When Kant refers to the dignity of humanity, he expresses the view that human beings have a prerogative over the rest of nature in virtue of being free. What Kant is saying in the famous Grundlegung passage on dignity is that morality is raised above other determinations of will in that morality alone should be valued unconditionally. In unfolding the complicated usage of ‘dignity’ in Kant's works, my reading helps to bring out the coherence of his ethics. (shrink)

This book is a critical introduction to contemporary French philosopher Jacques Rancière. It is the first introduction in any language to cover all of his major work and offers an accessible presentation and searching evaluation of his significant contributions to the fields of politics, pedagogy, history, literature, film theory and aesthetics. This book traces the emergence of Rancière’s thought over the last forty-five years and situates it in the diverse intellectual contexts in which it intervenes. Beginning with his egalitarian critique (...) of his former teacher Louis Althusser, the book tracks the subsequent elaboration of Rancière’s highly original conception of equality. This approach reveals that a grasp of his early archival and historiographical work is vital for a full understanding both of his later politics and his ongoing investigation of art and aesthetics. Along the way, this book explains and analyses key terms in Rancière’s very distinctive philosophical lexicon, including the ‘police’ order, ‘disagreement’, ‘political subjectivation’, ‘literarity’, the ‘part which has no part’, the ‘regimes of art’ and ‘the distribution of the sensory’. This book argues that Rancière’s work sets a new standard in contestatory critique and concludes by reflecting on the philosophical and policy implications of his singular project. (shrink)

Over the last 60 years the idea of human dignity has become increasingly prominent in the political discourse on human rights. In United Nations documents, for instance, human dignity is currently presented as the justification for human rights. In this paper I shall argue that the contemporary way in which human dignity is thought to ground human rights is very different from the way human dignity has been understood traditionally. My aim is to contrast the contemporary paradigm of dignity to (...) a different one that has been prominent historically from Cicero onwards. My conclusion is that if one wants to use the contemporary conception of dignity, one cannot refer to the history of philosophy for support of this conception, and if one wants to use this history in support, one would have to employ a different conception of dignity that uses a different pattern of thought. This paper pursues a thorough-going instrumentalist, or means-ends, approach to the theory of inductive inference. I consider three epistemic aims: convergence to a correct theory, fast convergence to a correct theory and steady convergence to a correct theory (avoiding retractions). For each of these, two questions arise: (1) What is the structure of inductive problems in which these aims are feasible? (2) When feasible, what are the inference methods that attain them? Formal learning theory provides the tools for a complete (...) set of answers to these questions. The concept of autonomy is one of Kant's central legacies for contemporary moral thought. We often invoke autonomy as both a moral ideal and a human right, especially a right to determine oneself independently of foreign determinants; indeed, to violate a person's autonomy is considered to be a serious moral offence. Yet while contemporary philosophy claims Kant as the originator of its notion of autonomy, Kant's own conception of the term seems to differ in important respects from our present-day interpretation. Ontologies, as the term is used in informatics, are structured vocabularies comprised of human- and computer-interpretable terms and relations that represent entities and relationships. Within informatics fields, ontologies play an important role in knowledge and data standardization, representation, integra- tion, sharing and analysis. They have also become a foundation of artificial intelligence (AI) research. In what follows, we outline the Coronavirus Infectious Disease Ontology (CIDO), which covers multiple areas in the domain of coronavirus diseases, including etiology, transmission, epidemiology, pathogenesis, diagnosis, (...) prevention, and treatment. The “paradox of forgiveness” can be described as follows: Forgiving, unlike forgetting, is tied to reasons. It is a response to considerations that lead us to think that we ought to forgive. On the other hand, acts of forgiveness, unlike excuses, are responses to instances of culpable wrongdoing. If, however, the wrongdoing is culpable, there is (or seems to be) no reason to forgive it. So two mutually exclusive theses about forgiveness both seem to be equally warranted: Forgiveness is related (...) to reasons, but there can be no reasons for forgiveness. In this paper, I attempt to dissolve this paradox. I argue that the paradox arises as a result of a too narrow conception of “reason” and that it can be dissolved if we acknowledge different kinds of reasons for forgiveness. More specifically, I examine three kinds of reasons for forgiving an act of wrongdoing: (1) Moral reasons that make forgiveness morally mandatory. (2) Prudential reasons for forgiveness. (3) Moral reasons that pertain to the character of the forgiver and that favor forgiveness without making it morally mandatory. I show that while the paradox of forgiveness arises when we consider reasons of the first kind, it can be dissolved with recourse to reasons of the second and third kind. The upshot of the argument is that we can be rational in deciding to overcome our feelings of resentment towards an act of unjustified and unexcused wrongdoing—and this is a strong point in favor of forgiveness. Formal learning theory is the mathematical embodiment of a normative epistemology. It deals with the question of how an agent should use observations about her environment to arrive at correct and informative conclusions. Philosophers such as Putnam, Glymour and Kelly have developed learning theory as a normative framework for scientific reasoning and inductive inference.

Was the zoological garden a place for science in the 19th and 20th centuries? This question cannot be answered with a simple yes or no. Rather, this Special Issue suggests, we need to reconstruct how the concrete conditions of the zoo as an institution influenced, enabled, triggered, facilitated, obstructed, or impeded scientific research. The zoo was and is a multifunctional space serving different constituencies, such as scientists of different disciplines, artists, breeders, and the general public. This collection of articles argues (...) that despite or even because of its hybrid character, the zoo generated knowledge about exotic animals in often unexpected ways. This Special Issue conceives of “science at the zoo” as a an “impure,” yet very rich epistemic constellation with its very own dynamic, tensions, and contradictions. The first part of this introduction provides a historical overview of the topic. Synthesizing the existing secondary literature, it addresses the major themes of science at the zoo: the debate among scientists about the pros and cons of research conducted in and outside the cages; the gap between the promise of doing research at the zoo and the actual practices; and the emergence of new fields of knowledge such as zoo veterinary medicine, zoo biology, and conservation science. The introduction's second part draws out the common topics that connect the eight articles of this Special Issue: the multiplicity of spaces interacting with the zoo; the broad range of historical actors, including academics, animal traders, and zoo keepers; the changing roles of the zoo-going public; and the negotiation of authority and epistemic hierarchies in producing knowledge about zoo animals. The large numbers of zoos and the long temporal range these articles cover bring the constant evolution of “science at the zoo”-and hence its intrinsic historical dimension-to the fore. (shrink)

Why and under what conditions are individuals altruistic to family and friends in their social networks? Evolutionary psychology suggests that such behaviour is primarily the product of adaptations for kin- and reciprocal altruism, dependent on the degree of genetic relatedness and exchange of benefits, respectively. For this reason, individuals are expected to be more altruistic to family members than to friends: whereas family members can be the recipients of kin and reciprocal altruism, friends can be the recipients of reciprocal altruism (...) only. However, there is a question about how the effect of kinship is implemented at the proximate psychological level. One possibility is that kinship contributes to some general measure of relationship quality (such as ‘emotional closeness’), which in turn explains altruism. Another possibility is that the effect of kinship is independent of relationship quality. The present study tests between these two possibilities. Participants (N= 111) completed a self-report questionnaire about their willingness to be altruistic, and their emotional closeness, to 12 family members and friends at different positions in their extended social networks. As expected, altruism was greater for family than friends, and greater for more central layers of the network. Crucially, the results showed that kinship made a significant unique contribution to altruism, even when controlling for the effects of emotional closeness. Thus, participants were more altruistic towards kin than would be expected if altruism was dependent on emotional closeness alone – a phenomenon we label a ‘kinship premium’. These results have implications for the ongoing debate about the extent to which kin relations and friendships are distinct kinds of social relationships, and how to measure the ‘strength of ties’ in social networks. Abstract: This article addresses a foundational issue in Kant's moral philosophy, the question of the relation of the Categorical Imperative to value. There is an important movement in current Kant scholarship that argues that there is a value underlying the Categorical Imperative. However, some scholars have raised doubts as to whether Kant has a conception of value that could ground the Categorical Imperative. In this paper I seek to add to these doubts by arguing, first, that value would have to (...) be of a particular kind in order to be the foundation of Kant's moral philosophy. Second, I argue that Kant does not have such a conception of value, and that his arguments rule out that value could ground his moral philosophy. I then outline an alternative reading of how Kant uses ‘inner value’. My conclusion will be that Kant does not derive the Categorical Imperative from an underlying value. While some of his passages could also be read as if value were foundational for Kant, a close look at these passages and his arguments point away from this conclusion. (shrink)

A key factor for the acceptance of robots as regular partners in human-centered environments is the appropriateness and predictability of their behaviors, which depend partially on the robot behavior’s conformity to social norms. Previous experimental studies have shown that robots that follow social norms and the corresponding interactions are perceived more positively by humans than robots or interactions that do not adhere to social norms. However, the conducted studies only focused on the effects of social norm compliance in specific scenarios. (...) Therefore, this paper aims to guide further research studies by compiling how researchers in relevant research fields think the perception of robots and the corresponding interactions are influenced independently of a specific scenario if a robot’s behavior conforms to social norms. Additionally, this study investigates what characteristics and metrics constitute a good general benchmark to objectively evaluate the behavior of social robots regarding its conformity to social norms according to researchers in relevant research communities. Finally, the paper summarizes how the obtained results can guide future research toward socially aware robot behavior. (shrink)

This paper develops a means–end analysis of an inductive problem that arises in particle physics: how to infer from observed reactions conservation principles that govern all reactions among elementary particles. I show that there is a reliable inference procedure that is guaranteed to arrive at an empirically adequate set of conservation principles as more and more evidence is obtained. An interesting feature of reliable procedures for finding conservation principles is that in certain precisely defined circumstances they must introduce hidden particles. (...) Among the reliable inductive methods there is a unique procedure that minimizes convergence time as well as the number of times that the method revises its conservation principles. Thus the aims of reliable, fast and steady convergence to an empirically adequate theory single out a unique optimal inference for a given set of observed reactions—including prescriptions for when exactly to introduce hidden particles. In medizinethischen Kontexten bezeichnet der Ausdruck „Odysseus-Verträge“ Selbstbindungen, die in der vorausschauenden Bitte von Patienten an ihre Ärzte bestehen, eigene spätere Behandlungspräferenzen nicht zu befolgen. Umstritten ist jedoch, ob eine vorhergehende Anweisung ein Handeln gegen den Patientenwillen in der aktualen Behandlungssituation rechtfertigt. In diesem Beitrag wird die Frage nach der Verbindlichkeit von Odysseus-Anweisungen erörtert. Zunächst wird gezeigt, dass die Befolgung einer Odysseus-Anweisung eine Form des paternalistischen Handelns darstellt und die Frage nach der Verbindlichkeit von Odysseus-Anweisungen daher in diejenige nach der (...) Rechtfertigung paternalistischen Handelns zu überführen ist . Im Folgenden wird als Rechtfertigungsmodell für paternalistisches Handeln ein Zustimmungsmodell verteidigt , dem zufolge eine paternalisierende Maßnahme durch die antizipierte spätere Zustimmung des Patienten zu dieser Maßnahme gerechtfertigt wird . Nach einer Erörterung des Einwandes, dass damit die besonderen normativen Probleme von Odysseus-Anweisungen aus dem Blick geraten , werden abschließend Fälle untersucht, in denen aufgrund eines irreversiblen Kompetenzverlustes keine spätere Zustimmung zur paternalisierenden Maßnahme mehr möglich ist. In diesen Fällen, so die These, ist ein paternalistisches Handeln gegen den aktualen Patientenwillen nicht gerechtfertigt; kommt es hier also zu einem Konflikt zwischen dem in der Vorausverfügung dokumentierten und dem aktualen Patientenwillen, ist letzterer zu respektieren .In the context of medical ethics, the term „Ulysses contract“ denotes an advance directive by means of which a patient binds himself for the future by instructing a doctor to act against his foreseen future preferences. There is some controversy, however, about whether a person’s prior decisions should be regarded as mandatory for the doctor even when they conflict with her present desires. In this contribution, I address the questions whether and under what circumstances Ulysses instructions should be regarded as binding. In Part , I attempt to show that observing a Ulysses instruction means acting paternalistically and that therefore the question whether Ulysses contracts ought to be respected should be transformed into the question how paternalistic action can be justified. Parts and are concerned with the justification of paternalistic action. On the basis of a conception of welfare as being tied to the person’s interests and preferences, I defend a consent-based model of justification . More specifically, I suggest that the patient’s anticipated later consent to a precedent paternalistic action should count as its justification . In what follows, I attempt to rebut the objection that this account does not do justice to the specific normative problems of Ulysses contracts . Finally, I examine cases in which, due to an irreversible loss of competence, a paternalistic action cannot be assented to by the patient. I argue that in these cases, acting against the patient’s present wishes cannot be justified. If in such a case a patient’s present request runs contrary to the past request expressed in the advance directive, the former should be respected. (shrink)

How is metaphysics related to the empirical sciences? Should metaphysics in general be guided by the sources, methods and results of the sciences? And what about the special case of the metaphysics of the social world: should it likewise be guided by the sources, methods and results of the social sciences? In her paper “Social Science as a Guide to Social Metaphysics?”, K. Hawley raises the question: If we are sympathetic to the project of naturalising metaphysics, how should we approach (...) the metaphysics of the social world? She proceeds by discussing three approaches to social metaphysics: inference to the best explanation from current social science, descriptive conceptual analysis, and normative, especially ‘ameliorative’ projects. At the end of her discussion, she reaches a rather pessimistic conclusion, especially as regards the IBE approach: “a number of phenomena indicate that the prospects for securely basing social metaphysics via inference to the best explanation from social science are currently faint. […] We need to look elsewhere if we are to develop a metaphysics of the social world.” In my comments on her paper, I try to re-animate the program of an inductive metaphysics by defending the idea that the method of inference to the best explanation should be the central method of justification for metaphysics in general and for social metaphysics in particular. Negative theology or apophasis - the idea that God is best identified in terms of 'absence', 'otherness', 'difference' - has been influential in modern Christian thought, resonating as it does with secular notions of negation developed in continental philosophy. Apophasis also has a strong intellectual history dating back to the early Church Fathers. Silence and the Word both studies the history of apophasis and examines its relationship with contemporary secular philosophy. Leading Christian thinkers explore in their own way the extent (...) to which the concept of the apophatic illumines some of the deepest doctrinal structures of Christian faith, and of Christian self-understanding both in terms of its historical and contemporary situatedness, showing how a dimension of negativity has characterised not only traditional mysticism but most forms of Christian thought over the years. When people are performing a task, it is hard to know whether they are about to make a mistake. Klaproth, Halbrügge, Krol, Vernaleken, Zander, and Russwinkel address this by recording EEG signals while people are performing a flight control task, and show that by examining the EEG signal they can determine when people failed to notice particular stimuli, which could lead to better assistive tools.

Albert Camus is one of the best known philosophers of the twentieth century, as well as a widely read novelist. This book contextualises Camus in his troubled and conflicted times, and analyses the enduring popularity of his major philosophical and literary works in connection with contemporary political, social, and cultural issues.

The atonement is one of the central and defining doctrines of Christian theology. Yet the nature of the atonement – how it is that Christ's life and death on the cross actually atone for human sin – remains a theological conundrum. This article offers a new argument for an old theory of the atonement, namely, penal substitution. First, it sets out the theological context for the argument. This involves giving some account of alternative theories of the atonement in the tradition, (...) and why penal substitution might be thought a particularly appealing way of thinking about the atonement. The article then presents an argument for a version of penal substitution that involves the application of an idea found in some Augustinian accounts of the transmission of sin from Adam to his progeny. At the end of this exposition, it offers some brief comments on the metaphysics undergirding the theology of this argument. The final section discusses several theological and philosophical objections to this reasoning. (shrink)

Cooperation requires that individuals are able to identify, and preferentially associate with, others who have compatible preferences and the shared background knowledge needed to solve interpersonal coordination problems. The present study investigates the nature of such similarity within social networks, asking: What do friends have in common? And what is the relationship between similarity and altruism? The results show that similarity declines with frequency of contact; similarity in general is a significant predictor of altruism and emotional closeness; and, specifically, sharing (...) a sense of humor, hobbies and interests, moral beliefs, and being from the same area are the best predictors. These results shed light on the structure of relationships within networks and provide a possible checklist for predicting attitudes toward strangers, and in-group identification. (shrink)

Contemporary approaches to “non-market accounting” depend critically on methods of “monetization,” i.e., determining prices for goods outside the market. Monetization constitutes a case of economic measurement in a narrow sense that has not yet been analyzed in the literature on measurement in economics. Monetization, I will argue, uses homo economicus—originally created as a model to explain existing prices—as a measuring device, one that generates new prices for goods that are not traded on markets. Homo economicus, though long contested in microeconomics, (...) is thus enjoying a dubious revival in non-market accounting. (shrink)

This study examines whether journalists and bloggers label paid content. In Germany, as in many other countries, advertorials have to be designated as advertising to enable the target audience to identify the promotional character of the content. This applies both to the traditional mass media and to blogs, for which advertorials provide a key source of income. To date, there have been no empirical findings on the designation practice based on a comparison of journalists and bloggers. The present study presents (...) an online survey in Germany completed by 936 journalists and 463 bloggers in 2017. The results indicate that, in fact, bloggers do not label advertorials less frequently than journalists do: 91.6 % of bloggers and 91.7 % of journalists stated that they label paid content as advertising. Reformed theology is often thought to be antipathetic to virtue theory. However, Jonathan Edwards is a counterexample to this way of thinking. In this article, I offer an account of Edwards’s moral thought as a case study of Reformed theology that is also a species of virtue theory, focusing on what he says about the formation of character. I argue that key doctrinal commitments drive his moral theology, and generate some interesting problems for his ethics. Although his work is not (...) without shortcomings, Edwards is a thinker whose moral theology might be usefully repaired and retrieved by contemporary theologians in the Reformed tradition for whom ‘duties are founded on doctrines’. It follows that individuals who exhibit a stronger preference for future over immediate rewards should be more disposed to engage in reciprocal altruism – in other words, ‘patient’ people should be more cooperative. The present study tested this prediction by investigating whether participants’ contributions in a public-good game correlated with their ‘discount rate’. Learning to argue in a computer-mediated and structured fashion is investigated in this research. A study was conducted to compare dyads that were scripted in their computer-mediated collaboration with dyads that were not scripted. A process analysis of the chats of the dyads showed that the scripted experimental group used significantly more words, engaged in significantly more broadening and deepening of the discussion, and appeared to engage in more critical and objective argumentation than the non-scripted control group.

The concept of divine justice has been the subject of considerable scrutiny in recent philosophical theology, as it bears upon the notion of punishment with respect to the doctrine of eternal damnation. In this essay, I set out a version of the traditional retributive view of divine punishment and defend it against one of the most important and influential contemporary detractors from this position, Thomas Talbott. I will show that, contrary to Talbott’s argument, punishment may satisfy divine justice, and that (...) perfect justice is commensurate with retribution, rather than, as he suggests, reconciliation and restoration. In several recent articles and a monograph, Andrew Loke has outlined a particular model of the Incarnation, which he calls the Divine Preconscious Model. In this article I provide a critique of this model, drawing on recent work by James Arcadi in order to show that there are serious theological costs involved in adopting the DPM.

This article considers several problems concerning the origin of the soul in the work of the nineteenth century American theologian, William G. T. Shedd. He opts for the traducian position, which is, that the soul is passed down from parents to child, in a way similar to the passing of physical seed from two human parents that fuse in syngamy to form a genetically distinct entity. On 26 February 2020, the Federal Constitutional Court of Germany pronounced a judgement that the prohibition of assisted suicide services set out in § 217 of the Criminal Code is void. It thereby reestablished the legal state that had obtained before 2015. Furthermore, it defined the right to die as an autonomy-based right, thereby dissociating the right to take one???s life from states of extreme suffering caused by illness. The judgement implies that one can, in principle, resort to assistance for (...) suicide even in the absence of illness and suffering. In this contribution, I deal with the problems that arise as a consequence of dissociating legitimate assisted suicide from states of illness. I analyze Bettina Schöne-Seifert???s suggestion to regard an understandable (,,nachvollziehbar“) wish to die as a wish that is protected by the right to autonomy. It turns out that the criterion of understandability is deficient: it either commits us to regarding every wish to die as understable or it undermines the anti-paternalistic requirement of respecting the patient???s autonomy. Are we justified in keeping the demented in prison for crimes they committed when they were still healthy? The answer to this question is an issue of considerable practical importance. The problem arises in cases where very aged criminals exhibit symptoms of dementia while serving their sentence. In these cases, one may wonder whether lodging these criminals in penal institutions rather than in normal caretaking facilities is justifiable. In this paper, I argue that there are justificatory reasons for punishing the (...) demented for their past crimes. In part 2, I examine three theories of punishment—retributivism, prevention theories and expressivism—with regard to the question of whether they provide justificatory reasons for punishing the demented. I argue that only expressivism provides these reasons. In part 3, I defend the view that expressivism, though not convincing as a general theory of punishment, is plausible if applied only to a specific subclass of punitive actions. More precisely, expressivism, or so I argue, is plausible with regard to those acts of punishment that consist in intending to inflict suffering without actually inflicting suffering. Since the punishment of demented patients falls within this class, it can be justified on an expressivist basis. In part 4, I discuss six objections to my view and rebut them. (shrink)
