The style of Wittgenstein's writing in his Philosophical Investigations seems quite peculiar to many readers, and is in many way unlike any other style of writing in the history of philosophy. In Philosophical Health, Richard Gilmore argues that Wittgenstein's ultimate goal in the "Investigations" is to restore us to a condition of philosophical health. The traditional methods and styles of doing philosophy, Gilmore suggests, led to a strange kind of philosophical sickness. This book considers the role of postmodernism (skepticism towards metanarratives and anti-essentialism) in Ralph Waldo Emerson's philosophy by putting it in conversation with key 20th and 21st century thinkers such as Beauvoir, Coates, Derrida, Paz, Rorty, and Zizek. Postmodern Emerson shows how Emersonian skepticism to metanarratives such as sexism, racism, Beauvoiran "serious values," and others, can help us face some of society's gravest contemporary social and philosophical challenges. Methodologically, the book exemplifies Emersonian postmodernism by defying traditional philosophical metanarratives about the (...) difference between high and low culture or serious and ridiculous subjects, and Emerson with what would seem to be his opposite. This is itself a postmodern gesture, breaking rules of genre and topic to make unlikely but interesting connections. There are possible worlds in which time is circular and finite in duration, forming a loop of, say, 12,000 years. There are also possible worlds in which time is linear and infinite in both directions, and in which history is repetitive, consisting of infinitely many 12,000 year epochs, each two of which are exactly alike with respect to all intrinsic, purely qualitative properties. Could one ever have empirical evidence that one inhabits a world of the first kind rather than a (...) world of the second kind? We argue for the affirmative answer, contra Quine (1979), Newton-Smith (1980), and Bergström (2013). Our argument for that conclusion differs from an argument for the same conclusion due to Susan Weir, reported by Richard Sorabji (1988). Weir’s argument is probabilistic and explicitly requires having evidence against determinism. Our argument is a direct appeal to the simplicity of laws, and it involves no probabilistic component. It is modeled on Shoemaker’s (1969) argument that one could have evidence of time without change. (shrink)

Recognizing the growing interdependence of the European Union and the importance of codes of conduct in companies’ operations, this research examines the effect of a country’s culture on the implementation of a code of conduct in a European context. We examine whether the perceptions of an activity’s ethicality relates to elements found in company codes of conduct vary by country or according to Hofstede’s (1980, Culture’s Consequences (Sage Publications, Beverly Hills, CA)) cultural constructs of: Uncertainty Avoidance, Masculinity/Femininity, Individualism, and Power (...) Distance. The 294 individuals, who participated in our study, were from 8 Western European countries. Their responses to our 13 scenarios indicate that differences in the perceptions of ethicality associate primarily with the participants’ country as opposed to their employer (i.e., accounting firm), employment level, or gender. The evidence also indicates that these country differences associate with Hofstede constructs of Individualism and Masculinity. (shrink)

In Defensor Pacis Marsilius of Padua grounds the legitimacy of the kingdom, or the state, on the peace that rule provides the citizens. Looking at Aristotle’s claim that the civitas strives to be like an animal in which all parts in the right proportion for the sake of health, Marsilius argues that ‘the parts of the kingdom or state will be well disposed for the sake of peace [tranquilitas].’ Marsilius goes on to define peace as the agreeable ‘belonging together’ of (...) all members of the kingdom or the state. In this way, Marsilius moves away from a theological ground of the legitimacy of the state towards one that is entirely secular. However, the ground is an unstable one in that it acknowledges the fact that the ‘members’ of the body politic are characterised by difference. As such, the ground of legitimate authority will be characterised as much by force as by peace or by the relation of force to peace. (shrink)

The paper is a defense of the moral methodology of John Rawls against criticisms by R.M. Hare and Peter Singer. Rawls is accused of intuitionism and subjectivism by Hare and of subjectivism and relativism by Singer, I argue that Rawls does not rely on intuitions as such, but on judgments on which there is a consensus. This does not commit Rawls to subjectivism for what is required for objectivity in ethics as in science is simply a rational justification procedure for (...) principles, which Rawls provides. Moreover, an appeal to a moral consensus at some point is inescapable. Finally, concerning the charge of relativism, I point out that Rawls includes in his justification procedure only those judgments on which there is a consensus among competent judges. Though there is the possibility that conflicting sets of judgments may be equally valid for different societies in the unlikely case that there is nothing invariant in the judgments of competent judges, this is a relativism we can accept. While most ethics studies use student samples, the participants in our research were 306 business professionals from Afghanistan, Germany, Philippines and the United States. Our sample included 168 male business professionals and 138 female business professionals. Our research examined whether factors such as taking a college ethics course, gender, or being from a specific country significantly associate to being sensitive to ethical dilemmas. Our data indicate that individuals who had taken an ethics course in college were more sensitive to two (...) of our four ethical dilemmas. Our analyses indicate that business professionals from Afghanistan and Germany were consistently less sensitive to unethical activities than were the business professionals the United States. Gender was significant in only two of the four scenarios we examined; male business professionals were more likely to agree with the unethical act for these scenarios. Individuals who were more prone to responding in a socially desirable manner reported a lower likelihood of supporting unethical actions. Our research raises questions about the difference between being required to take an ethics course versus taking an elective ethics course. Finally, our research indicates that female professionals are more sensitive to minor ethical deviations than male professionals; an alternate explanation is that male professionals were more willing to accept minor ethical deviations. A medical information commons is a networked data environment utilized for research and clinical applications. At three deliberations across the U.S., we engaged 75 adults in two-day facilitated discussions on the ethical and social issues inherent to sharing data with an MIC. Deliberants made recommendations regarding opt-in consent, transparent data policies, public representation on MIC governing boards, and strict data security and privacy protection. Community engagement is critical to earning the public's trust.

The reputation and influence of Emmanuel Levinas has grown powerfully. Well known in France in his lifetime, he has since his death become widely regarded as a major European moral philosopher profoundly shaped by his Jewish background. A pupil of Husserl and Heidegger, Levinas pioneered new forms of exegesis with his post-modern readings of the Talmud, and as an ethicist brought together religious and non-religious, Jewish and non-Jewish traditions of contemporary thought. Richard A. Cohen has written a book which (...) uses Levinas' work as its base but goes on to explore broader questions of interpretation in the context of text-based ethical thinking. Levinas' reorientation of philosophy is considered in critical contrast to alternative contemporary approaches such as those found in modern science, psychology, Nietzsche, Freud, Husserl, Heidegger, Sartre, Merleau-Ponty, Derrida and Ricoeur. Ame Naess, John Rodman, George Sessions, and others, designated herein as ecosophers, propose an egalitarian anti-anthropocentric biocentrism as a basis for a new environmental ethic. I outline their “hands-off-nature” position and show it to be based on setting man apart. The ecosophic position is thus neither egalitarian nor fully biocentric. A fully egalitarian biocentric ethic would place no more restrictions on the behavior of human beings than on the behavior of any other animals. Uncontrolled human behavior might lead to the (...) destruction ofthe environment and thus to the extinction of human beings. Posner characterizes the current preoccupation with moral and constitutional theory as an evasion of the real need of American law, which is for a greater understanding of the social, economic, and political facts out of which great legal controversies arise, and advocates a rebuilding of the law on the basis of systematic empirical inquiry.

This elevating pull of an ethics that can account for the relation of self and other without reducing either term is the central theme of these essays.

In this paper, I want to explore the relationship between the various forms of individual self-interest and the appropriate structures of government. I shall begin with the former, and by degrees extend the analysis to the latter. I do so in order to mount a defense of principles of limited government, private property, and individual liberty. The ordinary analysis of self-interest treats it as though it were not only a given but also a constant of human nature, and thus makes (...) few allowances for differences between persons. Yet common experience tells us that personality and behavior are as unique as fingerprints. The positive inquiry, therefore, is how we find what is constant about self-interest in a world of natural human diversity. The normative inquiry must take into account both the constant and variable features of human nature in order to determine what forms of social arrangements hold the greatest prospect of long-term social advantage. The gulf between ‘is’ and ‘ought’ must be overcome here, as it must be in all normative discourse. Yet we cannot make sensible judgments of what ought to be the case in the domain of rules unless we first have some idea of what is the case in the domain of behavior. The initial inquiry asks why self-interest is regarded as a constant of human behavior. The explanation derives more from the biological and less from the social. The powerful pressures of natural selection weed out any organisms for whom selfinterest is not the paramount consideration. (shrink)

In this paper I want to cast doubt on the claim that there is a legitimate process of reasoning to the best explanation which can serve as an alternative to either straightforward inductive reasoning or a combination of inductive and deductive reasoning. I shall argue a) that paradigmatic cases of acceptable arguments to the best explanation must be considered enthymemes and b) that when the suppressed premises are made explicit we have all of the premises we need to present either (...) a straightforward inductive argument or an argument employing both induction and deduction.
