The Sarbanes–Oxley Act of 2002 requires audit committees of public companies’ boards of directors to install an anonymous reporting channel to assist in deterring and detecting accounting fraud and control weaknesses. While it is generally accepted that the availability of such a reporting channel may reduce the reporting cost of the observer of a questionable act, there is concern that the addition of such a channel may decrease the overall effectiveness compared to a system employing only non-anonymous reporting options. The (...) rationale underlying this concern involves the would-be reporter’s likelihood of reporting, the seriousness with which the organization treats an anonymous report, and the organization’s ability to thoroughly follow-up the report. Thus, we explore the extent to which the availability of an anonymous reporting channel influences intended use of non-anonymous reporting channels. Further, in response to Sarbanes–Oxley and the environment of financial scandals that led to its passage, many firms are strengthening their internal audit departments, and providing them with greater independence from upper management’s direct control. Accordingly, our examination tests whether the intended use of the internal audit department as an internal reporting channel is greater when the internal audit department is of “high” versus “low” quality. Finally, the study investigates intended reporting behavior across three different cases (e.g., settings). Results show that the existence of an anonymous channel does reduce the likelihood of reporting to non-anonymous channels, that generally the internal audit department quality does not affect reporting to non-anonymous channels, and that case-setting affects the type of channel to be used. Van Inwagen's General Composition Question (GCQ) asks what conditions on an object and its constituents make the object a whole that these constituents compose, as opposed to an object linked to the constituents by a relation other than composition. The answer is traditionally expected to cite no mereological terms, to hold of metaphysical necessity and to be such that no defeating scenarios can be conceived (e.g., a scenario in which the conditions are met but the constituents fail to genuinely compose (...) the object). While not all writers agree on setting these high expectations on the principles that constitute answers to the GCQ (Hawley 2006), there is a yet unsettled issue concerning the principles’ naturalistic accreditation: Could putative principles be constrained and informed by advanced physical knowledge? Arguing positively, we outline two styles of principles worthy of naturalistic authority. In an explorative spirit, we notice that each style incurs certain costs. First, the principle in question may fail some of the above expectations set in an aprioristic context. Second, it may require a specific meta-theoretic understanding of what it takes to achieve naturalistic accreditation. Finally, it may address the GCQ “piecemeal” and fail to generalize to objects of all physical sorts.1. (shrink)

We report the results of a study that examines the association between gender and individuals’ intentions to report fraudulent financial reporting using non-anonymous and anonymous reporting channels. In our experimental study, we examine whether reporting intentions in response to discovering a fraudulent financial reporting act are associated with the participants’ gender, the perpetrator’s gender, and/or the interaction between the participants’ and perpetrator’s gender. We find that female participants’ reporting intentions for an anonymous channel are higher than for male participants; the (...) fraud perpetrator’s gender and the interaction with participants’ gender were not significantly associated with anonymous channel reporting intentions. Neither of the two factors nor the interaction between the two factors was associated with reporting intentions to a non- anonymous reporting channel. Results from an additional analysis indicate that male and female participants differ in the extent to which they judge the reduction in personal costs of an anonymous reporting channel compared to a non-anonymous reporting channel and that the reduction in personal costs mediates the relationship between participant gender and anonymous reporting intentions. What is a scientific theory? This book considers this fundamental question by presenting a range of options and the issues they raise. It draws comparisons between theories and artworks and proposes that we should stop thinking of theories as things altogether.

Although still highly controversial, the idea that we can use technology to radically alter our environment in order to mitigate the climate challenges we now face is becoming an ever more discussed approach. This chapter takes up a specific climate engineering technology, carbon capture, usage, and storage (CCUS), and highlights how this technology works and how its governance still needs further work to ensure that it is aligned to the ideal of sustainable development. Given that climate engineering technologies like CCUS (...) have the potential to ameliorate many of the climate issues and support the SDGs, there remains a lacuna of inserting these globally impactful technologies within a normative political framework to respect that proper responsibility is attributed. The aim of the chapter is to examine the concept of accountability, how it has been traditionally understood in the literature, and why a polysemic and multidimensional account of accountability is required if climate engineering technologies like CCUS are actually to support sustainable development. This may serve as a first theoretically informed basis for reflection on how to create a synergy between the responsible deployment of climate engineering innovation and the achievement of the SDGs targets, one that can shed light on how justifications and decisions about sustainable strategies and constraints are managed, taken and communicated. Although continued investments in nanotechnology are made, atomically precise manufacturing (APM) to date is still regarded as speculative technology. APM, also known as molecular manufacturing, is a token example of a converging technology, has great potential to impact and be affected by other emerging technologies, such as artificial intelligence, biotechnology, and ICT. The development of APM thus can have drastic global impacts depending on how it is designed and used. This paper argues that the ethical issues that arise from APM (...) - as both a standalone technology or as a converging one - affects the roles of stakeholders in such a way as to warrant an alternate means furthering responsible innovation in APM research. This paper introduces a value-based design methodology called Value Sensitive Design (VSD) that may serve as a suitable framework to adequately cater to the values of stakeholders. Ultimately, it is concluded that VSD is a strong candidate framework for addressing the moral concerns of stakeholders during the preliminary stages of technological development. (shrink)

Recent, well-publicized accounting scandals have shown that the penalties outsiders impose on those found culpable of earnings management can be severe. However, less is known about how colleagues within internal labor markets respond when they believe fellow managers have managed earnings. Designers of responsibility accounting systems need to understand the reputational costs managers impose on one another within internal labor markets. In an experimental study, 159 evening MBA students were asked to assume the role of a manager in a company (...) and respond to a scenario in which another manager (the target manager) has the opportunity to engage in earnings management. Participants provided causal attributions, assessed the morality of the target manager, and indicated whether they would change their judgments about the target manager's reputation. The study manipulated three between-subjects factors: (1) whether the target manager chose to engage in earnings management, (2) whether the company's budgetary control system was rigid or flexible, and (3) whether the target manager's work history was average or above average. We found that causal attributions are affected more by the budgetary systems when the target did not manage earnings than when the manager did. We also found that morality judgments were significantly associated with the target manager's behavior, but not with the budgetary system. In addition, participants' judgments about the target manager's reputation were more strongly associated with morality judgments than with causal attributions. In 2016, France passed a major law that is unique in giving terminally ill and suffering patients the right to the controversial procedure of continuous deep sedation until death (CDS). In so doing, the law identifies CDS as a sui generis clinical practice, distinct from other forms of palliative sedation therapy, as well as from euthanasia. As such, it reconfigures the ethical debate over CDS in interesting ways. This paper addresses one aspect of this reconfiguration and its implications for the (...) intentions at work in this complex time at the end of life. The concept of intention is often considered central to the ethics of end-of-life care, but its role is recognized to be problematic, with charges of elusiveness and ambiguity. I aim to show that consideration of the French law affords a new understanding of the intentionality of CDS, and that in addition to the obvious importance of this for clarifying the ethics of the practice, it may suggest new ways of addressing the wider problem of ambiguous clinical intentions at end of life. Preventive vaccination can protect not just vaccinated individuals, but also others, which is often a central point in discussions about vaccination. To date, there has been no systematic study of self- and other-directed motives behind vaccination. This article has two major goals: first, to examine and distinguish between self- and other-directed motives behind vaccination, especially with regard to vaccinating for the sake of third parties, and second, to explore some ways in which this approach can help to clarify and guide (...) vaccination debates and policy. I propose conceiving of vaccination in terms of three basic elements: the vaccination decision-maker, the vaccine recipient and the primary beneficiary. I develop a taxonomy based on the relations between these elements to distinguish four kinds of vaccination: self-protective, paternalistic, altruistic and indirect. I finally discuss the case of human papillomavirus vaccine regulation for men and women to show how each kind of vaccination is associated with and raises specific ethical questions. (shrink)

Mirko Garasic (2021) argued that space travel and, by extension, the colonization of other planets could morally justify using technologies and interventions capable of profoundly modifying the characteristics of astronauts and future Martian generations. According to Garasic, however, the fact that space interventions such as human (bio)enhancement or reproductive technologies such as artificial wombs may be morally justified does not mean that they are morally acceptable technologies to be used on Earth as well. Garasic’s thesis is that we should resist (...) the temptation to establish or reinforce a continuity between the ethical standards that apply to space travel and those that apply on Earth because what applies in space (or on other planets) does not necessarily apply to our planet. Garasic argues that in space, genetic enhancement interventions are morally acceptable, as they are essential for survival. On Earth, however, we can survive even without any form of (bio)enhancement. In a previous article (2022), we presented several arguments against Garasic’s thesis regarding the exceptional morality of what is morally acceptable in space. In this article, we examine and reply to Garasic (2022), showing that he fails to defend his thesis from the objections we previously advanced. Garasic’s mistakes are: (1) assuming nature (and consequently what is “natural”) as a normative point of reference which allows establishing what is moral and what is not moral; (2) defending the choices concerning reproduction as an insufficiently demanding and therefore unsatisfactory moral principle (according to Garasic we should not bring into the world people who can have a quality of life or a condition of well-being superior to mere survival); and finally (3) of not explaining clearly what it means to defend a principle of moral exceptionalism for space travel (Garasic does not explain whether this position applies to any behavior, for which what on Earth is a virtue, in space is a vice or is not a general principle, but he makes this case only for enhancement and reproductive technologies). Through our analysis, we not only refute Garasic’s position but also show that any attempt to address space travel issues as “special” moral issues faces several difficulties and, ultimately, is doomed to failure. Both current and past analyses and critiques of transhumanist and posthumanist theories have had a propensity to cite the Greek myth of Prometheus as a paradigmatic figure. Although stark differences exist amongst the token forms of posthumanist theories and transhumanism, both theoretical domains claim promethean theory as their own. There are numerous definitions of those two concepts: therefore, this article focuses on posthumanism thought. By first analyzing the appropriation of the myth in posthumanism, we show how the myth fails to (...) be foundational and how we need to rethink the posthumanist mythological framework. We then introduce Haldane’s Daedalus figure as a fruitful analogy to understand the demiurgic posture that critics mean to unveil by first using Prometheus. Daedalus embodies the artisan role, whose status as an inventor for the mighty preserves from the gods' direct opprobrium. Thereafter, we introduce the Camusian Myth of Sisyphus as a competing analogy that ultimately serves as a myth better suited to address the posthumanist position on an existential standpoint. we ultimately show that Sisyphus, as the ‘absurd man’ that Camus claims him to be, is himself the posthuman, thus serving as a more ideal foundational myth for posthumanism and preserving the importance of narrative in posthuman discourses. To conclude, we specifically show that the concept of Sisyphus as a posthuman icon has significance that reaches beyond narrative value to current ecological debates in posthumanism. (shrink)

Based on an unfinished manuscript by the late philosopher Dallas Willard, this book makes the case that the 20th century saw a massive shift in Western beliefs and attitudes concerning the possibility of moral knowledge, such that knowledge of the moral life and of its conduct is no longer routinely available from the social institutions long thought to be responsible for it. In this sense, moral knowledge--as a publicly available resource for living--has disappeared. Via a detailed survey of main developments (...) in ethical theory from the late 19th through the late 20th centuries, Willard explains philosophy's role in this shift. In pointing out the shortcomings of these developments, he shows that the shift was not the result of rational argument or discovery, but largely of arational social forces--in other words, there was no good reason for moral knowledge to have disappeared. The Disappearance of Moral Knowledge is a unique contribution to the literature on the history of ethics and social morality. Its review of historical work on moral knowledge covers a wide range of thinkers including T.H Green, G.E Moore, Charles L. Stevenson, John Rawls, and Alasdair MacIntyre. But, most importantly, it concludes with a novel proposal for how we might reclaim moral knowledge that is inspired by the phenomenological approach of Knud Logstrup and Emmanuel Levinas. Edited and eventually completed by three of Willard's former graduate students, this book marks the culmination of Willard's project to find a secure basis in knowledge for the moral life. (shrink)

In this paper we present a theoretical hybrid framework for ethical decision making, drawing upon Emmanuel Levinas’ view on ethics as “first philosophy”, as an inherent infinite responsibility for the other. The pivotal concept in this framework is an appeal to a heightened sense of personal responsibility of the moral actor to provide the ethical context within which conventional approaches to applied business ethics could be engaged. Max Weber’s method of reconciling absolutism and relativism in ethical decision making is adopted (...) to provide the synergy between personal responsibility and contextual realities, forging a coherent framework. The paper concludes by discussing ways that business could make way for the flourishing of ethics of responsibility in individuals. (shrink)

Although the role of fairness in tax compliance has been of increasing interest among the academic and professional tax communities, very little is known about the role of interactional fairness. Interactional fairness refers to the quality of the treatment provided to individuals from authority figures, such as tax authority representatives. We conduct an experiment using US taxpayers to examine the role of interactional fairness on tax compliance intentions, and how detection influences this relation. Taxpayers’ detection salience reflects their perceptions that (...) they will be audited by the tax authority. Using insights from conditional cooperation theory, we predict and find that detection moderates the relation between interactional fairness and tax compliance intentions, such that the effect of interactional fairness on tax compliance intentions diminishes with higher detection. Of the various loci of systematic theology that call for sustained philosophical investigation, the doctrine of sanctification stands out as a prime candidate. In response to that call, William Alston developed three models of the sanctifying work of the Holy Spirit: the fiat model, the interpersonal model, and the sharing model. In response to Alston’s argument for the sharing model, this paper offers grounds for a reconsideration of the interpersonal model. The say-on-pay regulation in the Dodd-Frank Act requires publicly-traded U.S. firms to hold a nonbinding, advisory shareholder vote on executive compensation. Advocates claim that SOP voting gives shareholders a mechanism to hold managers and boards more accountable. Critics contend that SOP votes may simplistically reflect shareholders’ reactions to the overall value of CEO compensation or the firm’s net income. However, based on prior research, we contend that market participants’ SOP votes are likely to consider current income attributes. For example, the (...) market punishes firms that do not meet or beat benchmarks such as analyst earnings expectations, and that shareholders scrutinize the quality of the income sources of firms that consistently meet/beat analyst expectations. We thus expect that more shareholders will provide ‘agree’ SOP votes for a firm that consistently meets/beats analyst forecasts and does so when net income does not include nonrecurring gains. Further, we consider whether perceptions about the fairness of CEO compensation play a mediating role in the relationship between the interaction of these two current income attributes and SOP votes. Results from an experiment using evening MBA students as participants indicates that the two current income attributes significantly interact with respect to the percentage of agree SOP votes, and that compensation fairness perceptions fully mediate this relationship. Further, the mediating effect of compensation fairness perceptions is robust to including CEO-level and other determinants found in prior research. We conclude with a discussion of our findings and their implications for public policy and research. (shrink)

This research project aims to accomplish two primary objectives: (1) propose an argument that a posthuman ethics in the design of technologies is sound and thus warranted and, (2) how can existent SBD approaches begin to envision principled and methodological ways of incorporating nonhuman values into design. In order to do this this MRP will provide a rudimentary outline of what constitutes SBD approaches. A particular design approach - Value Sensitive Design (VSD) - is taken up as an illustrative example (...) given that it, among the other SBD frameworks, most clearly illustrates a principled approach to the integration of values in design. -/- This explication will be followed by the strongest arguments for a posthumanist ethic, primarily drawing from the works of the Italian philosophers Leonardo Caffo and Roberto Marchesini and Francesa Ferrando. In doing so I will show how the human imperative to account for nonhuman values is a duty and as such must be continually ready-to-hand when making value-critical decision. (shrink)

The view that quantum particles cannot be regarded as individuals was articulated in the early days of the 'quantum revolution' and became so well-entrenched that French and Krause called it 'the Received View'. However it was subsequently shown that quantum statistics is in fact compatible with a metaphysics of particle individuality, subject to certain caveats. As a consequent it has been claim that there exists a kind of underdetermination of the metaphysics by the physics which in turn has been used (...) to motivate a form of 'notice' structural realism. In this essay I will review this purported underdetermination and the motivation for structural realism that it purportedly provides in the context of recent developments in both the philosophy of physics and metaphysics. I aim to conclude that such developments reinforce the underdetermination and allow one to respond to certain critical concerns regarding its motivational power. (shrink)

In this paper I examine Brandom's account of Hegel's claim that the content of an intention can only be determined retrospectively. While Brandom's account, given in Chapter 11 of A Spirit of Trust, sets a new standard for thinking about this topic, I argue that it is flawed in three important respects. First, Brandom is not able to make sense of a distinction that is central for Hegel, namely, between the consequences of an action that ought to have been foreseen (...) by an acting agent, given the right of objectivity of the action, and unforeseeable consequences that are completely contingent. Second, Brandom incorrectly conceptualizes the disparity and unity that all actions display as temporally successive features of an action, rather than as speculatively identical features. Third, Brandom's account cannot make sense of cases of retrospective determination that involve self-deception, and this demonstrates that he misses something critical about Hegel's account of action, namely, that action is expressive of the logic of essence. Several prominent philosophers have argued that the fact that depressed agents sometimes make moral judgments without being appropriately motivated supports Humean externalism – the view that moral motivation must be explained in terms of desires that are distinct from or “external” to an agent’s motivationally inert moral judgments. This essay argues that such motivational failures do not, in fact, provide evidence for this view. I argue that, if the externalist argument from depression is to undermine a philo-sophically important version of (...) internalism, it must make use of a general assumption about motivational states. However, at a reasonable level of abstraction, the needed assumption also implies that even desires could not be effective sources of motivation. For, just as depressed agents might sometimes lack motivation to act consistently with their moral judgments, they also sometimes lack motivation to pursue their desires. Moreover, the most plausible responses that Humeans can give to this general argument undermine the externalist case against internalism. Thus, there is a deep tension between the argument from depression for externalism and a fundamental Humean commitment. (shrink)

The nature and effectiveness of any international legal agreement is heavily shaped by the forum in which it is negotiated and implemented. This includes both the substantive content that global policymakers agree upon and the subsequent state compliance with those provisions. Forums differ in their institutional characteristics, thereby providing unique opportunities and costs for participating actors. Forums may have different mandates, capacities, cultures, members, and legal processes — all of which ultimately affect distributions of power and influence. These differences then (...) shape how issues are framed, the content of agreements as they are negotiated, and the incentives states have to comply with any obligations. (shrink)

Crisis occupies an ambiguous place in the writings of Hannah Arendt. Not only does crisis undermine categories of judgment, but in doing so it eliminates prejudices as well, forcing us to judge without them. Although Arendt never had an opportunity to fully develop her understanding of judgment, we know that she considered it to be ‘the most political of man’s mental abilities,’ and her writings on education reflect this. In her essay, ‘The Crisis in Education’ she draws a connection between (...) judgment and crisis, linking it to the work of the classroom. It is this relationship, between crisis and judgment, that I examine. In doing so, I turn to two figures central to Arendt’s work – Immanuel Kant and Adolf Eichmann – each of whom embody opposing aspects of what it means to judge, epitomized by a conceptual tension between example and cliché. In the last two decades, there has been a pronounced growth of CSR rating agencies that assess corporations based on their social and environmental performance. This article investigates the impact of CSR ratings on the behavior of individual corporations. To what extent do corporations adjust their behavior based on how they rank? Our primary finding is that being dropped from a CSR ranking appears to do little to encourage firms to acknowledge and address problems related to their social and environmental (...) performance. Specific rankings appear not to have a widespread effect of influencing firms to acknowledge negative CSR events and publicly present plans and actions to address them. Whether firms are well or poorly ranked, they appear to focus on and publicly discuss their “positive” CSR activities. We discuss the wider significance of these results as well as the overall significance of CSR rankings for a global economy. (shrink)

This paper proposes a contextualist solution to the puzzle about free will. It argues that the context-sensitivity of statements about freedom of the will follows from the correct analysis of these statements. Because the analysis is independently plausible, the contextualism is warranted not merely in virtue of its capacity to solve the puzzle.

Previous accounting ethics research berates auditors for ethical lapses that contribute to the failure of Andersen (e.g., Duska, R.: 2005, Journal of Business Ethics 57, 17–29; Staubus, G.: 2005, Journal of Business Ethics 57, 5–15; however, some of the blame must also fall on regulatory and professional bodies that exist to mitigate auditors’ ethical lapses. In this paper, we consider the ethical and economic context that existed and facilitated Andersen’s failure. Our analysis is grounded in Akerlof’s (1970, Quarterly Journal of (...) Economics August, 488–500) Theory of the Market for Lemons and we characterize the market for audit reports as a market for lemons. Consistent with Akerlof’s model, we consider the appropriateness of the countervailing mechanisms that existed at the time of Andersen’s demise that appeared to have effectively failed in counteracting Andersen’s ethical shortcomings. Finally, we assess the appropriateness of the remedies proposed by the Sarbanes–Oxley Act of 2002 (SOA) to ensure that similar ethical lapses will not occur in the future. Our analysis indicates that the SOA regulatory reforms should counteract some of the necessary conditions of the Lemons Model, and thereby mitigate the likelihood of audit failures. However, we contend that the effectiveness of the SOA critically depends upon the focus and attention of the␣Public Companies Accounting Oversight Board (PCAOB) towards assessing the ethical climates of public accounting firms. Assessments by the PCAOB of public accounting firm’s ethical climate are needed to sufficiently ensure that public accounting firms effectively promote and maintain audit quality in situations where unconscious bias or economic incentives may erode the public accounting firm’s independence. We argue that understanding of autism can be strengthened by increasing involvement of autistic individuals as researchers and by exploring cascading impacts of early sensory, perceptual, attentional, and motor atypicalities on social and communicative developmental trajectories. Participatory action research that includes diverse participants or researchers may help combat stigma while expanding research foci to better address autistic people's needs.

This collection of essays was created as a tribute to Dr. Irving Greenberg, a truly major figure in the American Jewish community for the past forty years. The authors who have contributed to this volume are a testimony to Dr. Greenberg's repercussive presence and theological contribution.
