Over the past two decades, William Kentridge has consolidated a worldwide reputation as an artist of great verve and scope. One of the divine quotations narrated from the timeline of Qur’ānic revelation is seen as a word of Prophet Mohammad in the 30th verse of the surah of al-Furqān. It’s observed that the speaker of this verse is Prophet Mohammad and he complains to God about his tribe which neglects the Qur’ān. In the present study, semantic structure and the meaning area of the phrase “mahjūr”, which is the key word in this verse, the meaning of it in the (...) timeline of Qur’ānic revelation and the interpretations attributed to it in the following centuries are traced. Likewise by examining Qur’ānic exegesis chronologically and investigating the interpretations of the exegetes on the relevant verse, it’s tried to see the semantic breaking points, changes and transformations regarding this verse in the historical process. Finally, the approaches of the exegetes who interpreted this verse in terms of the method of maqāsidī tafsir or the principle of teleological interpretation are determined. The approaches detected in this respect are first explained in a descriptive style, and then they’re evaluated in an analytical point of view. The findings and conclusions we reached in this study are as follows: As stated by the majority of exegetes, especially Qatāda, al-Zamakhsharī, Ibn Atiyya, Fakhr al-Dīn al-Rāzī and al-Sa‘ālibī, the aforementioned verse belongs to the Prophet Mohammed in terms of both wording and meaning. It hasn’t been determined that there’s a conflict about the pertaining of this word to him. According to this hadith quoted in surah al-Furqān, the Qurayshi polytheists made unwarranted objections to the Prophet and the divine instructions that he brought, his heart was narrowed in the face of their attitude towards the Qur’ān, and for these reasons he complained about his tribe to God. It can be said that this meaning seen in Mecca in the tenth year of his prophethood, namely, insulting the Qur’ān, abandoning it, and denying the themes in it, also includes Muslims after the revelation period. Accordingly, it can be thought that the aspect and situation of not acting on the provisions of the Qur’ān and not thinking about its verses are also valid for the interlocutors of the next period. In this direction, when we look at the history of tafsir, it has been determined that the exegetes who interpreted this verse in terms of teleological interpretation asserted different approaches. It was seen that al-Zamakhsharī, al-Rāzī, Abū al-Barakāt al-Nasafī, al-Bikā‘ī, Kamālpasazāde, Sayhzāda and Ibn ʻĀshūr interpreted this complaint of the Prophet by associating it with the coming of punishment. Therefore, in compliance with them, this verse aimed to threaten all the interlocutors, especially the Quraysh. On the other hand, it has recognized that Ibn al-Qayyim al-Jawziyah, Ibn Kathir, Bursavī and Sayyid Qutb evaluated this verse in the context of the types and ways to abandon the Qur’ān. Thus, they interpreted the relevant verse in terms of maqāsidī tafsir in a way that would cover both the first addressees of Qur’ānic revelation and other interlocutors in the following periods. In a nutshell, it can be considered that not endeavoring to understand and interpret the Qur’ān, or keeping it away from family and social life, law, understanding of earning and spending, not referring to it in such matters, or giving up living a life pursuant to it, are some of the routes and sorts of abandonment of it for Muslims. Yet, the legal doctrines of consent and informed consent differ in their applications. In patient care, the judicial doctrines of consent and informed (...) consent are disclosure doctrines based on the obligation of physicians to inform their patients of the following types of information: the nature of the procedure the physician is recommending in the patent’s care (P), the alternatives to the physician‐recommendation (A), and the risks of procedure and its alternatives (R). In addition, the physician must provide truthful answers to the patient’s questions (Q) to the best of the physician’s abilities. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. This paper reviews the obligations that study sponsors owe to their study participants based on the very definition of research as a systematic activity whose purpose is to develop generalizable knowledge to help all humans. Counterpoint Arguments The following are counterpoint arguments that need to be appreciated to more fully understand the concepts that impact the thesis that ‘raw data’ should be open to the public to allow the opportunity of checking of the results of its associated scientific paper and for further analysis. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. Counterpoint Arguments The following are counterpoint arguments that need to be appreciated to more fully understand the concepts that impact the thesis that ‘raw data’ should be open to the public to allow the opportunity of checking of the results of its associated scientific paper and for further analysis. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. Temporal analyses of causal directionality fail if causes needn't precede their effects. Certain well-known difficulties with alternative (non-temporal) analyses have, in recent accounts, been avoided by attending more carefully to the formal features of relations typically figuring in philosophical discussions of causation. I discuss here a representative of such accounts, offered by David Sanford, according to which a correct analysis of causal priority must issue from viewing the condition relation as nonsymmetrical. The theory is shown first to be an implicitly (...) counterfactual treatment at its base: this provides for an explicit reformulation of several key notions in the theory. An argument is then presented, independent of these modal considerations, for the conclusion that causal priority is possible only given certain implausible assumptions about the asymmetric character of causal laws which, I claim, are not met. The best objection to this argument is shown to fail on several counts, partly in light of the counterfactual results offered earlier. It is concluded that, if laws are symmetric, analyses of the sort discussed must look elsewhere for the source of causal priority; but if laws are not symmetric, resting causal priority so heavily on nomological asymmetry is no analysis at all. Many areas of genetic research, genetic forensics and genetic essentialism are treated in public sphere debate as suspicious and problematic or are subject to waves of moral panic. In cultural theory, likewise, strong critiques of the genetic essentialism emerge as part of a broader critical assessment of the discourses of the biological sciences and the assertion of a connection between genes and human behavior. However, the scientific and popular claim to the existence of a “gay gene” is not treated in (...) the same way, and has been widely celebrated both within lesbian/gay culture and more broadly in liberal-humanist speech. This essay suggests that it is not enough to presume that this is a result of the extension of essentialism into new popular understandings of human biology. Rather, this essay examines five reasons which have made the popular acceptance of a “gay gene” tenable: the dominance of “gay personage” arguments, the continued influence of early sexology, the suspicion of psychological and constructionist approaches to lesbian/gay sexualities, the effectiveness of genetic essentialism in“ethnic rights” political approaches and the continued centrality of “fixed subjecthood” in contemporary western culture. Precipitated largely by publication of the Theodicy in 1706, requests for a systematic exposition of Leibniz’s philosophy led to his self-described Éclaircissement sur les monades, begun in the summer of 1714 at the request of Remond. Unlike the treatise on philosophical theology, Leibniz’s Monadology is at once broadly systematic but sketchy and compressed: so it is useful, but then not so useful, as an introduction to his philosophy. Leibniz later decompressed it somewhat by adding references to the Theodicy, where certain (...) issues received fuller treatment. Rescher’s new book goes several steps further, still reckoning Leibniz as his own best commentator: in addition to those passages from the Theodicy, other passages from the Leibniz corpus are brought alongside each section of the Monadology, letting them pretty much speak for themselves about the ideas of that section, with a miminum of added commentary. This is a swell idea, and I think Rescher succeeds in executing it. The result is a useful work for students, who in a single edition get Leibniz’s original effort at carving his system at its joints—the principles of philosophy, he called them—and enough additional text to flesh out a full-bodied picture of his mature philosophy. Cloth, $45.00.When Leibniz received the 1710 issue of the Royal Society’s Philosophical Transactions in early 1711, he read John Keill’s public charge that he had stolen the calculus from Newton. Leibniz twice sought amends (...) from the Society in the form of a retraction, in response to which a committee was formed to investigate and issue a report. The resulting Commercium epistolicum, written by the good Isaac Newton himself and condemning Leibniz, was published in early 1713. In Vienna at the time, Leibniz learned of its contents in a June letter from Johann Bernoulli, who complained about this “scarcely civilized way” of holding what was in effect a tribunal from which the chief witness was absent. By year’s end Leibniz had enlisted Wolff to see into print Leibniz’s anonymous statement—overstatement, in fact—of his case, and nine months later Keill replied with an equally overstated rejoinder. Late autumn of 1714 found Leibniz back in Hannover, suffering from gout and the tiresome pressure to advance his work on the history of the house of Brunswick-Lüneburg. If only he felt better and had more free time, he could collect his mathematical papers and set an end to the dispute by writing his own Commercium epistolicum: as it was (Leibniz told Wolff in the spring of 1715), he had no intention of giving Newton’s cronies the luxury of his time.The Leibniz-Clarke exchange began in the shadows of this dispute, contributing to Leibniz’s already established distaste for parts of British philosophy. Already in 1690 he was describing (to Huygens and others) Newton’s gravitational attraction as “inexplicable.” Soon after Leibniz was surprised to discover that Locke had accepted Newtonian attraction in the second edition of the Essay—surprised, at least, until he came to see it as part and parcel of the dangerous idea that God could attach any old property whatever to matter if He chose, including thought. Leibniz’s misgivings didn’t see the light of day in the early 1700s, when he penned them in the Preface to the Nouveaux Essais; but he went out of his way to work an explicit complaint about Mr. Newton and Mr. Locke into the Théodicée of 1710 (§19 of the Preliminary Discourse). The calculus dispute followed. By the time Leibniz got round to writing Princess Caroline about the dispute in a letter of May 1715, he was insisting that the Newtonians deserved public censure, and that the Britons deserved Leibniz as historiographer of England. For her own part, Caroline now wondered if Samuel Clarke, who had translated Newton’s Opticks into Latin, would in the end be unbiased enough to translate Leibniz’s Théodicée into English. Moreover Caroline doubted that Clarke’s notion of the soul was theologically innocent. Replying in November, Leibniz summarized his view that natural religion was in great decline in England, and the famous exchange began.Despite there being no monograph devoted to it until now, the Correspondence ıs (and was) famous. If a book-length study is overdue, so perhaps are three reminders—that a significant portion of the Correspondence is devoted to issues other than space and time and gravitation, that the depth to which its issues are pursued was compromised by impatience on the side of both parties, and that Clarke’s philosophical views aren’t so well-understood as Leibniz’s own. Nowhere does Vailati set out to make these points explicitly, but they emerge over the course of his book, and together with exegetical soundness are its chief contributions. Since the appearance of Bertrand Russell’s A Critical Exposition of the Philosophy of Leibniz, Leibniz’s theory of relations has been a topic of considerable discussion and controversy. Russell himself argued that Leibniz cannot consistently assert both the primary motivation for his denial of relations—that all propositions are of subject-predicate form—and also that relations are to be understood as somehow mental, their foundations being guaranteed by the divine mind. For on the one hand, God must know all relational truths about numbers, (...) aggregates, and relations among monads; but on the other hand, any judgment lacking a subject and predicate will be meaningless. In the treatise On the Change of Names (part of his magnum opus, the Allegorical Commentary), Philo of Alexandria brings his figurative exegesis of the Abraham cycle to its fruition. Taking a cue from Platonist interpreters of Homer's Odyssey, Philo reads Moses's story of Abraham as an account of the soul's progress and perfection. Responding to contemporary critics, who mocked Genesis 17 as uninspired, Philo finds instead a hidden philosophical reflection on the ineffability of the transcendent God, the transformation of (...) souls which recognize their mortal nothingness, the possibility of human faith enabled by peerless faithfulness of God, and the fruit of moral perfection: joy divine, prefigured in the birth of Isaac. “Spinoza's Extended Substance: Cartesian and Leibnizian Reflections” This essay examines Woolhouse's interpretation of Spinoza's extended substance. According to that interpretation, the extended substance is a quasi‐Platonic form, and Spinoza's substance is not actually extended. This essay argues that the burden of defending such an interpretation is very great indeed, and requires that we read Spinoza's understanding of Descartes and Leibniz's understanding of Spinoza in unusual and awkward ways.
