In this chapter, we will argue that the very concept of risk management must be called into question. The argument will take the form that the use of the phrase ‘risk management’ operates to cover over the ethical dimensions of what is at the bottom of the problem, namely, risky decision making. Risky decision making takes place whenever and wherever decisions are taken by those whose lives are not immediately threatened by the situation in which the risk to other (...) people’s lives is created by their decision. The concept of risk management implies that risk is already there, not created by the decision, but lies already inherent in the situation that the decision sets into motion. The risk that exists in the objective situation simply needs to be “managed”. By changing the semantics of ‘risk management’ to ‘risk taking’ or ‘risky decision making’, the ethics of responsibility for risking other people’s lives will come into focus. The argument of the chapter is that by heightening the ethical sensitivity of decision makers, these decision makers will be less likely to make decisions that will cause harm and/or death to those who are the principal actors in the situation created by the decision. The author outlines his thesis that legal discourse is a special case of general practical discourse (Sonderfallthese) and develops it as an attempt to cover both the authoritative, institutional, or real and free, discursive, or ideal dimension of legal reasoning. On this basis, he examines the objections raised by Habermas (1996) to the special case thesis. First, he discusses the reduction of general practical discourse to moral discourses (genus proximum problem) holding that the former is a combination of moral, (...) ethical, and pragmatic arguments within the priority of just; second, he examines the objection that general practical arguments change their character or nature when employed in legal contexts (subset and specification problem) and the related problems concerning legal validity and unjust law. The cover illustration for Richard Joyce’s elegant and powerful recent work, The Evolution of Morality, is a reproduction of an oddly fascinating and disturbing sixteenth-century engraving, the Anatomia del corpo humano. One has to examine the image for a minute to realize that the standing human figure, stripped of skin, and with muscles, tendons and joints revealed, holds the anatomist’s knife in his left hand and that, with his right, he holds up the single piece of skin, from bearded (...) face to dangling extremities, that had once covered his body. This is the anatomist self-flayed, revealed to inspection by his own knife. A double worry is suggested: the body without the skin may have surprising, or disquieting, features. There is no assurance that what is revealed will accord with our preconceptions. Additionally, there is the thought that only the artist’s magic, freezing a moment in time, permits the body to maintain its integrity. In reality, the body of the self-flayer would collapse and die in short order. -/- Richard Joyce similarly undertakes to wield the analytic knife of science and philosophy to cut away the surface appearance of the moral sense and see what lies beneath. Again, what we find may be surprising or disquieting. Beneath the surface, we find the once-hidden articulation of the moral sensibility. We see its parts, how they are connected, how one links to another. And we may also suspect or fear that what remains cannot long stand inspection in such a state. It is here argued that functionalist constraints on psychology do not preclude the applicability of classic forms of reduction and, therefore, do not support claims to a principled, or de jure, autonomy of psychology. In Part I, after isolating one minimal restriction any functionalist theory must impose on its categories, it is shown that any functionalism imposing an additional constraint of de facto autonomy must also be committed to a pure functionalist--that is, a computationalist--model for psychology. Using an extended parallel (...) to the reduction of Mendelian to molecular genetics, it is shown in Parts II and III that, contrary to the claims of Hilary Putnam and Jerry Fodor, there is no inconsistency between computational models and classical reductionism: neither plurality of physical realization nor plurality of function are inconsistent with reductionism as defended by Ernest Nagel. Employing the results of Part I, the conclusions of Parts II and III are generalized in Part IV to cover any version of functionalism whatsoever; thus, functionalism and reductionism are shown to be consistent. It is urged in conclusion that although a de facto form of autonomy is defensible, there are sound methodological grounds for unconditionally rejecting any principled version of the autonomy of psychology. In free speech theory ‘speech’ has to be defined as a special term of art. I argue that much free speech discourse comes with a tacit commitment to a ‘Subtractive Approach’ to defining speech. As an initial default, all communicative acts are assumed to qualify as speech, before exceptions are made to ‘subtract’ those acts that don’t warrant the special legal protections owed to ‘speech’. I examine how different versions of the Subtractive Approach operate, and criticise them in terms of (...) their ability to yield a substantive definition of speech which covers all and only those forms of communicative action that – so our arguments for free speech indicate – really do merit special legal protection. In exploring alternative definitional approaches, I argue that what ultimately compromises definitional adequacy in this arena is a theoretical commitment to the significance of a single unified class of privileged communicative acts. I then propose an approach to free speech theory that eschews this theoretical commitment. (shrink)

Many systems of quantified modal logic cannot be characterised by Kripke's well-known possible worlds semantic analysis. This book shows how they can be characterised by a more general 'admissible semantics', using models in which there is a restriction on which sets of worlds count as propositions. This requires a new interpretation of quantifiers that takes into account the admissibility of propositions. The author sheds new light on the celebrated Barcan Formula, whose role becomes that of legitimising the Kripkean interpretation of (...) quantification. The theory is worked out for systems with quantifiers ranging over actual objects, and over all possibilia, and for logics with existence and identity predicates and definite descriptions. The final chapter develops a new admissible 'cover semantics' for propositional and quantified relevant logic, adapting ideas from the Kripke-Joyal semantics for intuitionistic logic in topos theory. Aesthetic judgements are autonomous, as many other judgements are not: for the latter, but not the former, it is sometimes justifiable to change one's mind simply because several others share a different opinion. Why is this? One answer is that claims about beauty are not assertions at all, but expressions of aesthetic response. However, to cover more than just some of the explananda, this expressivism needs combining with some analogue of cognitive command, i.e. the idea that disagreements over beuaty (...) can occur, and when they do it is a priori that one side has infringed the norms governing aesthetic discourse. This combination can be achieved by reading Kant’s aesthetic theory in expressivist terms. The resulting view is a form of quasi-realism about beauty. The position has its merits, but cannot ultimately explain the phenomena which motivate it. This conclusion generalises to quasi-realism about other matters. (shrink)

It is well written, thoroughly researched, and clearly focused in presenting the history and implications of the core positions of classical and contemporary pragmatists. It is targeted basically for the general college and university student in American and Western Philosophy, the History of Philosophy, and American Studies. Without too much of a stretch, it seems equally suitable for the general reader familiar with some philosophy outside the academic and scholarly community. (...) While the selections of pragmatic authors covered are representative of some classical and contemporary pragmatists, some prominent pragmatists did not make the final cut, including Royce, Mead, Lewis, Goodman, Carnap, Reichenbach, Rescher, and van Fraassen.
