En 2015, le Premier ministre finlandais commandait une étude préliminaire sur l’introduction d’un revenu de base. Cet article présente ses résultats provisoires. Il analyse les diverses options envisagées, les implications de l’introduction d’un revenu de base quant aux incitations ou désincitations à prendre un emploi, ainsi que les reconfigurations plus lointaines qu’une telle introduction entrainerait dans le fonctionnement des allocations sociales.

One way to obtain a comprehensive semantics for various systems of modal logic is to use a general notion of non-normal world. In the present article, a general notion of modal system is considered together with a semantic framework provided by such a general notion of non-normal world. Methodologically, the main purpose of this paper is to provide a logical framework for the study of various modalities, notably prepositional attitudes. The article investigates the validity of two different versions of the slippery slope argument construed in relation to human gene therapy: the empirical and the conceptual argument. The empirical version holds that our accepting somatic cell therapy will eventually cause our accepting eugenic medical goals. The conceptual version holds that we are logically committed to accepting such goals once we have accepted somatic cell therapy. It is argued that neither the empirical nor the conceptual version of the argument can provide (...) a conclusive moral reason for banning somatic cell therapy. According to a third interpretation, referred to as the arbitrary result argument, the many apparent similarities between somatic cell therapy and eugenic-based human genetic engineering drive us to make principled choices concerning what differences and similarities between the two practices should be regarded as morally (ir)relevant. Decisions of this kind are likely to have unpredictable moral consequences. Thus formulated, the slippery slope argument has much plausibility. One objects to somatic cell therapy not so much because of what is at the bottom of the slope on which it lies, but because it is on a slope of which one does not know what is at the bottom. While the arbitrary result argument does not provide a conclusive reason for prohibiting human gene therapy, it reminds of a very important thing: when making bioethical decisions, we should be as specific and as consistent as possible about our basic moral and medical concepts. Freedom and time in Nicholas Berdyaev's philosophical thought.

Purpose – This paper aims to present an overview of the various ethical, societal and critical issues that micro- and nanotechnology-based small, energy self-sufficient sensor systems raise in different selected application fields. An ethical approach on the development of these technologies was taken in a very large international, multitechnological European project. The authors approach and methodology are presented in the paper and, based on this review, the authors propose general principles for this kind of work. Design/methodology/approach – The authors’ approach (...) is based on a great amount of experience working together in multi-disciplinary teams. Ethical issues have usually been handled in the authors’ work to some degree. In this project, the authors had the opportunity to emphasise the human view in technological development, utilise the authors’ experience from previous work and customise the authors’ approach to this particular case. In short, the authors created a wide set of application scenarios with technical and application field experts in the authors’ research project. The scenarios were evaluated with external application field experts, potential consumer users and ethics experts. Findings – Based on the authors’ experiences in this project and in previous work, the authors suggest a preliminary model for construction activity within technology development projects. The authors call this model the Human-Driven Design approach, and Ethics by Design as a more focussed sub-set of this approach. As all enabling technologies have both positive and negative usage possibilities, and so-called ethical assessment tends to focus on negative consequences, there are doubts from some stakeholders about including ethical perspectives in a technology development project. Research limitations/implications – The authors argue that the ethical perspective would be more influential if it were to provide a more positive and constructive contribution to the development of technology. The main findings related to the ethical challenges based on the actual work done in this project were the following: the main user concerns were in relation to access to information, digital division and the necessity of all the proposed measurements; the ethics experts highlighted the main ethical issues as privacy, autonomy, user control, freedom, medicalisation and human existence. Practical implications – Various technology assessment models and ethical approaches for technological development have been developed and performed for a long time, and recently, a new approach called Responsible Research and Innovation has been introduced. The authors’ intention is to give a concrete example for further development as a part of the development of this approach. Social implications – The authors’ study in this particular case covers various consumer application possibilities for small sensor systems. The application fields studied include health, well-being, safety, sustainability and empathic user interfaces. The authors believe that the ethical challenges identified are valuable to other researchers and practitioners who are studying and developing sensor-based solutions in similar fields. Originality/value – The authors’ study covers various consumer application possibilities of small sensor systems. We present a dynamic approach to Peirce’s original construal of abductive logic as a logic of conjecture making, and provide a new decidable, contraction-free and cut-free proof system for the dynamic logic of abductive inferences with neighborhood semantics. Our formulation of the dynamic logic of abduction follows the philosophical and scientific track that led Peirce to his late, post-1903 characterization of abductive conclusions as investigands, namely invitations to investigate propositions conjectured at the level of pre-beliefs.

Finland is internationally known as one of the leading centers of twentieth century analytic philosophy. This volume offers for the first time an overall survey of the Finnish analytic school. The rise of this trend is illustrated by original articles of Edward Westermarck, Eino Kaila, Georg Henrik von Wright, and Jaakko Hintikka. Contributions of Finnish philosophers are then systematically discussed in the fields of logic, philosophy of language, philosophy of science, history of philosophy, ethics and social philosophy. Most public discussion has focused on those effects of genetic research that are considered in some way unwanted or unpleasant. For example, there has been much debate concerning the risks and the ethical appropriateness of genetic screening, gene therapy, and agricultural applications based on genetic techniques. It often claimed that genetic research may cause new problems such as genetic discrimination, stigmatization, environmental risks, or mistreatment of animals. Genes and Morality: New Essays adopts a critical attitude toward genetic research, on both (...) a theoretical and a practical level. It presents some of the most important problems in the ethics of genetic engineering, including the questions of genetic health and disease, genetic testing, responsibility for health, patenting non-human and human life, and problems related to the disclosure of genetic information. The aim of the book is to focus on real ethical and conceptual issues. Consider, for instance, the concept of genetic disease. As one of the contributors, Ingmar Pörn, writes, fear of genetic disease, or anxiety, is not itself a disease any more than fear of becoming unemployed is a disease. Alleviating such emotions is not a medical task to be discharged by drug therapy. Modern explainable AI methods remain far from providing human-like answers to ‘why’ questions, let alone those that satisfactorily agree with human-level understanding. Instead, the results that such methods provide boil down to sets of causal attributions. Currently, the choice of accepted attributions rests largely, if not solely, on the explainee’s understanding of the quality of explanations. The paper argues that such decisions may be transferred from a human to an XAI agent, provided that its machine-learning algorithms perform genuinely abductive inferences. (...) The paper outlines the key predicament in the current inductive paradigm of ML and the associated XAI techniques, and sketches the desiderata for a truly participatory, second-generation XAI, which is endowed with abduction. There has been little theoretical debate of why companies behave in socially responsible ways whilst descriptive analysis of corporate social responsibility is flourishing. As result, there have been few methodological debates on how to study both what responsible actions are and why companies act accordingly. This methodological and theoretical essay discusses how institutional social theory has been and could be used in explaining socially responsible corporate behaviour. It is explored what kinds of theoretical tools are needed in explaining this behaviour (...) and how various tools can be integrated into one model explaining socially responsible corporate actions. It is argued that researchers should empirically focus simultaneously on normative origins and institutional environments of responsibilities, on power relations determining the particular responsibilities, and on institutional arrangement of corporate actions. A systematic attempt to understand cognitive characteristics of translation by bringing its logical, pragmatic, and hermeneutic features together and examining a number of scientific, logical (philosophical and formal),and philosophical applications. The notion of translation investigated here is called explanatory since it is not a translation in the standard, meaning-saving sense but aims to provide an explanation for the meaning change in exact terms.

Carl Schmitt sees the 1933 Nazi seizure of power as a revolution that inaugurates an entirely new era of political-legal order. Analyzing Schmitt’s rarer Nazi-texts, diaries, and correspondence, I argue that from 1933 to 1936 Schmitt attempts to theorize the Nazi revolution by developing an entirely new political language of Nazism, cleansed from non-German ways of thinking, especially nineteenth-century liberalism. I focus on three conceptual transformations through which Schmitt understands the remaking of the German state: The shift from the liberal (...) democratic neutral state to a new one-party state or a Führer-state dominated by a movement – a shift symbolized by the “death of Hegel”; the transformation of sovereign power into Führertum, represented by the symbolical deaths of Jean Bodin and Thomas Hobbes, whose thought cannot comprehend the totality of the Nazi movement, and the perversion of the liberal-democratic equality before the law to the völkisch equality of the race as the basis of all Nazi political–legal life. Criticizing previous interpretations of Schmitt’s Nazi thinking, I demonstrate that when Schmitt abandons his own decicionist thought in favor of concrete order thinking in 1933/1934 the idea of race becomes the basis of his political–legal thought. New data-driven ideas of healthcare have increased pressures to reform existing data infrastructures. This article explores the role of data governing institutions during a reform of both secondary health data infrastructure and related legislation in Finland. The analysis elaborates on recent conceptual work on data journeys and data frictions, connecting them to institutional and regulatory issues. The study employs an interpretative approach, using interview and document data. The results show the stark contrast between the goals of open and Big Data (...) inspired reforms and the existing institutional realities. The multiple tensions that emerged during the process indicate how data frictions emanate to the institutional level, and how mundane data practices and institutional dynamics are intertwined. The article argues that in the Finnish case, public institutions acted as sage-guards of public interest, preventing more controversial parts from passing. Finally, it argues that initiating regulatory and infrastructural reforms simultaneously was beneficial for solving the tensions of the initiative and analysing either side separately would have produced misleading accounts of the overall initiative. The results highlight the benefits of analysing institutional dynamics and data practices as connected issues. (shrink)

This essay enquires into the implications for criminal law of Derrida’s analysis in the Death Penalty seminars. The seminars include a reading of Kant’s Metaphysics of Morals, specifically Kant’s reflections on the sovereign right to punish, which is read in conjunction with the reflections of Freud and Reik on the relation between the unconscious and crime, as well as Nietzsche’s reflections on morality, punishment and cruelty. What comes to the fore in Derrida’s analysis is a system of economic exchange operating (...) on an unconscious level, of which criminal law forms an intrinsic part. Derrida’s analysis of the ‘origin’ of crime in the seminars poses serious questions to the assumption of freedom underlying modern criminal law. The link, which he posits between punishment and political theology, likewise challenges the existing theories and forms of punishment. What the seminars call for, in the name of the Kantian Enlightenment, is a radical break with economic circularity as it operates in respect of crime and punishment. (shrink)

The roots of the « Bolivarian revolution » are located in the fall of the dictatorship in 1958. The role of the armed forces in the history of the Venezuelan left considerably predates Chavez’s accession to power in 1998. If we are to understand the political process involved here, we must grasp the nature of the historical bonds between the radical left and certain sectors of the armed forces. The article reviews this history, examining the achievements of the Chavez governments (...) in power since 1998; It then addresses certain current debates in the country, notably on the question of the construction of a socialism for the twenty-first century and the role of the armed forces in the struggles of the country. ABSTRACT This article offers a new reading of Carl Schmitt and his Nazi engagement by chronologically examining the changing uses of Roman law in his Weimar and Nazi thought. I argue that Schmitt’s different ways of narrating the modern reception of Roman law disclose, first, the Nazification of his thought in the spring of 1933, and second, the partial and apologetic de-Nazification of his thinking in the 1940s. While Schmitt’s Weimar-era works are defined by a positive use of Roman imagery, (...) ranging from Schmitt’s support to the Catholic Church to his endorsement of Benito Mussolini’s ‘total state’ in Italy, Schmitt’s Nazi writings from 1933 to 1936 describe the reception of Roman law as an anti-German virus that must be overcome by the Nazi movement. This shift mirrors Schmitt’s transformation from an authoritarian thinker sympathetic to Italian Fascism into a devoted Nazi. However, once Schmitt begins to see that Germany will lose World War II, he recalibrates his position. While Schmitt’s earlier Nazi writings offered a negative estimation of the historical school of Friedrich Carl von Savigny, in his 1943/44 book on European legal science, Schmitt portrays Savigny as the paradigmatic European, whose work opens the path for a renewed legal science. This essay argues that Carl Schmitt’s postwar writings offer an original critique of biotechnology and utopian thinking. Examining the classics of utopian literature from Plato to Thomas More and Aldous Huxley, Schmitt illustrates the rise of utopianism that aims to transform human nature and even produce an artificial “human-machine.” Schmitt discovers a counterimage to the emerging era of biotechnology from a katechontic form of Christianity and maintains that human beings must recognize their shared humanity in God, warning us that without (...) a realm of transcendence, the enemy no longer offers an existential mirror but begins to incarnate foreign values, which must be destroyed completely. By comparing Schmitt with Michel Foucault and Donna Haraway, it is also argued that Schmitt’s thinking unlocks a novel path to exploring the meaning and histories of biopolitics and posthumanism. From a Schmittian perspective, Foucault’s depiction of biopolitics appears as a mere prelude to the coming age of biotechnology that will lead us into a posthuman era. Demonstrating interesting contrasts with Haraway’s utopian vision of the cyborg, it is maintained that Schmitt’s thinking offers a distinctively conservative-Christian critique of posthumanism. This article introduces a rhetorical theory of narrative in reading Kierkegaard, comparing Kierkegaard’s praxis to Phelan’s definition of “somebody telling somebody else that something happened on some occasion and for some purpose(s).” Use of pseudonyms problematizes “the somebody” telling and makes apparent the differing purposes of author and narrator. In the early authorship, the purpose is usually a life-view. The “something happened” may seem irrelevant in Kierkegaard, but it evokes questions of lived experience and life-view. The “occasion” for telling is (...) textually mediated, and thus draws a novel connection to literary history. Finally, I examine Kierkegaard’s real and authorial readers. (shrink)

This article addresses the boundaries of law and historiography in scrutinizing some rarely analyzed aspects of the works of Reinhart Koselleck. The article studies the significance of the tradition of ‘politico-juridical’ concepts in Koselleck’s thought, by tracing the intellectual history and biographies of some notable legal historians that for the large part defined the legal historical discourse after the Second World War. It is argued that a research of the connections between Koselleck and these legal historians provides an insight into (...) the themes of the temporality of law and the universality of legal concepts in Koselleck’s articles. In contextualizing the thinking and texts of Reinhart Koselleck, this article benefits from previously unused primary sources and illuminates the reference group and intellectual atmosphere in which Koselleck worked in and around 1968. One of the paradoxes of the free software ideology is its reliance on the legal institutions it was created to object to. One could argue that Free Software Foundation is using copyright to enforce their free software licenses as aggressively as the Business Software Alliance is enforcing its clients’ copyrights. We will show that the reality is more complex and that there is a significant difference: the free software community uses primarily non-legal enforcement methods and trusts on social norms. We (...) argue that free software could be used as a tool to make copyright more accepted in the less developed world because of its positive connection with copyright and community based approach. We explain why strong copyright is also in the interest of free software developers. The article concludes by suggesting that World Intellectual Property Organization should include free software into its development agenda. (shrink)

This is an interdisciplinary study of what is cognitively going on when we interpret, respresent, or evaluate cultural entities, works of art included. In addition, the role of interpretation in experience and in cultural objects is elucidated from a cognitive point of view. The book relies on theories of action, perception, possible worlds, modalities, intentionality. cognition, and brain research, and it contains anumber of case studies. The book ptovides some new insights into some much-discussed problems related to interpretation.

Two different but closely related issues in current cognitive science will be considered in this essay. One is the controversial and extensively discussed question of how connectionist and symbolic representations of knowledge are related to each other. The other concerns the notion of connectionist learning and its relevance for the understanding of the distinction between propositional and nonpropositional knowledge. More specifically, I shall give an overview of a result in Rantala and Vadén (1994) establishing a limiting case correspondence between symbolic (...) and connectionist representations and, on the other hand, study the problem, preliminarily investigated in Rantala (1998), of how propositional knowledge may arise from nonpropositional knowledge. I shall also try to point out that on some more or less plausible assumptions, often made by cognitive scientists, these results may have some significance when we try to comprehend the nature of human knowledge representation. Some of these assumptions are rather hypothethical and debatable for the time being and they will become justified in the future only if there will be more progress in the empirical and theoretical research on the brain and on artificial networks. The assumptions concern, besides some questions of the behavior of neural networks, such things as the relevance of pattern recognition for modelling human cognition, in particular, knowledge acquisition, and the relation between emergence and reduction.
