Artificial Intelligence (AI) technologies offer new ways of conducting decision-making tasks that influence the daily lives of citizens, such as coordinating traffic, energy distributions, and crowd flows. They can sort, rank, and prioritize the distribution of fines or public funds and resources. Many of the changes that AI technologies promise to bring to such tasks pertain to decisions that are collectively binding. When these technologies become part of critical infrastructures, such as energy networks, citizens are affected by these decisions whether (...) they like it or not, and they usually do not have much say in them. The democratic challenge for those working on AI technologies with collectively binding effects is both to _develop_ and _deploy_ technologies in such a way that the democratic legitimacy of the relevant decisions is safeguarded. In this paper, we develop a conceptual framework to help policymakers, project managers, innovators, and technologists to assess and develop approaches to democratize AI. This framework embraces a broad sociotechnical perspective that highlights the interactions between technology and the complexities and contingencies of the context in which these technologies are embedded. We start from the problem-based and practice-oriented approach to democracy theory as developed by political theorist Mark Warren. We build on this approach to describe practices that can enhance or challenge democracy in political systems and extend it to integrate a sociotechnical perspective and make the role of technology explicit. We then examine how AI technologies can play a role in these practices to improve or inhibit the democratic nature of political systems. In an ideal democracy, people from all walks of life would come together to talk meaningfully and respectfully about politics. But we do not live in an ideal democracy. In contemporary democracies, which are marked by deep social divisions, different groups for the most part avoid talking to each other. And when they do talk to each other, their speech often seems to be little more than a vehicle for rage, hatred, and deception. -/- Democratic Speech in Divided Times argues (...) that we should nevertheless not give up on the ideal of democratic public speech. Drawing on the resources of political theory, epistemology, and philosophy of language, this book develops a sustained account of the norms that should govern public discourse in deeply divided circumstances. Should we try to find common ground when we talk to our political opponents, even though they seem unreasonable? Should we refrain from expressing anger, if we want to get things done? How can we use our speech to fight hate speech and disinformation? And is it even possible to speak to 'the other side,' in settings where different groups dislike one another, live apart from one another, and don't know much about one another? Democratic equality challenges both utilitarianism and classical liberal and libertarian thought which continues to exert a major influence in the politics of many capitalist countries. This chapter aims to clarify the content of, and motivation for, democratic equality. Section 1 begins with an outline of democratic equality. It introduces and clarifies, in a preliminary way, two key elements of democratic equality: the notion of fair equality of opportunity and the difference principle. Section 2 explains why Rawls considers democratic equality a (...) better account of what justice requires than rival accounts. Sections 3 and 4 briefly review some outstanding interpretative and normative issues within democratic equality. Section 4 also looks at the question of how far democratic equality can properly incorporate the just claims of sick and disabled people. Democratic equality incorporates a principle of productive reciprocity, however, this incorporation of productive reciprocity in democratic equality remains rather undeveloped. (shrink)

What are the social dynamics behind the rise and resilience of today’s authoritarian regimes? This paper seeks to answer this question by focusing on the longest lasting elected autocracy of our era, the AKP (Justice and Development Party) regime in Turkey. Building on the authoritarian neoliberalism literature’s criticism of the scholarship on competitive authoritarianism, I point out the seeds of authoritarianism in the pro-market reforms of the 1980s–2000s. However, both literatures fail to address the popular embrace of authoritarianism. In critical (...) engagement with analyses of fascism, I develop the concept ‘democratic autocracy’: a parliamentarised, individualised, personalistic, and relatively more market-oriented, twenty-first century version of fascism. The democratic autocracy in Turkey organises and mobilises the people through parties, youth and aid associations, paramilitary organisations, and unions. However, both unresolved economic crises and democratic autocracy’s sociopolitical dynamics set limits to its resilience, as well as to the sustainability of its parliamentarism. (shrink)

This article explores the personal responsibility of soldiers for fighting in unjust wars. Its reference point is the position developed by Jeff McMahan in his recent Killing in War. I claim that McMahan fails to give sufficient importance to institutional justifications on this matter. I argue for this by developing what I call the argument to democratic duty, which I claim embodies much current thinking about the obligations of soldiers in a democratic culture. The upshot of my argument is that (...) soldiers are placed in a contradictory position, between personal and institutional obligations. This is one sense in which soldiers can be victimized by the institution of war itself. (shrink)

Democratic alternation in power involves uncontrolled policy experiments. One party is elected on one policy platform that it then implements. Things may go well or badly. When another party is elected in its place, it implements a different policy. In imposing policies on the whole community, parties in effect conduct non-randomized trials without control groups. In this paper, we endorse the general idea of policy experimentation but we also argue that it can be done better by deploying in policymaking randomized (...) controlled trials. We focus primarily on the democratic benefits of using randomized trials in policymaking and on how they can enhance the democratic legitimacy of policy. We argue that randomized trials resonate well with three key democratic principles: non-arbitrariness, revisability and public justification. Randomized trials’ contribution to non-arbitrariness and revisability is not unique; other types of evidence can advance these democratic principles as well. But through their peculiar democratic scrutability, randomized trials are well-equipped to contribute to the public justifiability of policy. (shrink)

The years that followed the fall of the Berlin wall and various authoritarian regimes in different regions of the world, witnessed the growth of a wide literature on democratization, which was influenced more and more by the paradigm of transition and the “consolidation” of democracy. Since then, evaluations as well as perspectives through which were seen various regimes (the new democracies “with problems”) are developed mainly through the theoretical lens of consolidation paradigm, according to which full democratic consolidation was (...) the endpoint of regime transitions. But it has become clear today that in many countries, in which more than three decades have passed since the fall of authoritarian regimes, the issue of “completion” of democracy in their social and political context is still far from being a happy reality. The purpose of this paper is to criticize both in the theoretical and the empirical level, the concept of “consolidation of democracy”, seeing it as a non-valid concept for the study of democratization. This paper will argue that essentially the concept of consolidation is teleological and problematic in the sense that democracy is seen not as a process but an endpoint product. (shrink)

This renewed interest in a persistent theme is initiated by the call for a democratization of expertise that has become the order of the day in the legitimation of research funding. Algorithms can now identify patterns and correlations in the (big) datasets, and predict outcomes based on those identified patterns and correlations with the use of machine learning techniques and big data, decisions can then be made by algorithms themselves in accordance with the predicted outcomes. Yet, algorithms can inherit questionable values from the datasets and acquire biases in the course of (machine) learning, and automated algorithmic decision-making makes it more difficult for people to see algorithms as biased. While researchers have (...) taken the problem of algorithmic bias seriously, but the current discussion on algorithmic fairness tends to conceptualize ‘fairness’ in algorithmic fairness primarily as a technical issue and attempts to implement pre-existing ideas of ‘fairness’ into algorithms. In this paper, I show that such a view of algorithmic fairness as technical issue is unsatisfactory for the type of problem algorithmic fairness presents. Since decisions on fairness measure and the related techniques for algorithms essentially involve choices between competing values, ‘fairness’ in algorithmic fairness should be conceptualized first and foremost as a political issue, and it should be (re)solved by democratic communication. The aim of this paper, therefore, is to explicitly reconceptualize algorithmic fairness as a political question and suggest the current discussion of algorithmic fairness can be strengthened by adopting the accountability for reasonableness framework. This book offers a systematic treatment of the requirements of democratic legitimacy. It argues that democratic procedures are essential for political legitimacy because of the need to respect value pluralism and because of the learning process that democratic decision-making enables. It proposes a framework for distinguishing among the different ways in which the requirements of democratic legitimacy have been interpreted. Peter then uses this framework to identify and defend what appears as the most plausible conception of democratic legitimacy. There is a growing consensus among philosophers of science that core parts of the scientific process involve non-epistemic values. This undermines the traditional foundation for public trust in science. In this article I consider two proposals for justifying public trust in value-laden science. According to the first, scientists can promote trust by being transparent about their value choices. On the second, trust requires that the values of a scientist align with the values of an individual member of the public. I (...) argue that neither of these proposals work and suggest an alternative that does better. When scientists must appeal to values in the course of their research, they should appeal to democratic values: the values of the public or its representatives. (shrink)

This book is about the ways in which real-world democracies fall short of democratic ideals and why those shortfalls matter. The project is rooted in a vast body of empirical findings that political scientists have accumulated over the last seven decades. These are findings about political ignorance, voter behaviour, the policymaking process, polarization, and the popular control of representatives. These findings are often both surprising and troubling—they suggest our democracies fall far short of democratic ideals. The book is a detailed, (...) careful exploration of why such findings matter. In part, that involves giving an account of what makes democracy valuable in the first place: why does democracy matter? And in part it involves connecting the value of democracy to the rights and duties of ordinary citizens. The overarching argument is that our duties to obey the law, and the moral permissibility of enforcing those laws, depend on the realization of democratic ideals. From the theory of ‘deliberative democracy’ to the politics of the ‘third way’, the present Zeitgeist is characterized by attempts to deny what Chantal Mouffe contends is the inherently conflictual nature of democratic politics. Far from being signs of progress, such ideas constitute a serious threat to democratic institutions. This essay explores Adorno's neglected writings on democracy in the United States, composed in English and directed toward an American audience, to illuminate a democratic theory and practice oriented around the concepts of “democratic leadership,” “democratic pedagogy,” and “democratic enlightenment.” Bridging disciplinary divides, this essay brings the lens of artistic modernism to bear on Adorno's writings on democracy in America to illuminate the distinctive contributions of a political theory that might only appear partial and preliminary when analyzed through the lens (...) of conventional politics. Adorno's understanding of “democratic enlightenment” resonates with the modernist concept of epiphany and represents a translation of artistic modernism to the political realm. Democracy is not naturally plausible. Why turn such important matters over to masses of people who have no expertise? Many theories of democracy answer by appealing to the intrinsic value of democratic procedure, leaving aside whether it makes good decisions. In Democratic Authority, David Estlund offers a groundbreaking alternative based on the idea that democratic authority and legitimacy must depend partly on democracy's tendency to make good decisions.Just as with verdicts in jury trials, Estlund argues, the authority and legitimacy of (...) a political decision does not depend on the particular decision being good or correct. But the "epistemic value" of the procedure--the degree to which it can generally be accepted as tending toward a good decision--is nevertheless crucial. Yet if good decisions were all that mattered, one might wonder why those who know best shouldn't simply rule.Estlund's theory--which he calls "epistemic proceduralism"--avoids epistocracy, or the rule of those who know. He argues that while some few people probably do know best, this can be used in political justification only if their expertise is acceptable from all reasonable points of view. This paper argues against the call to democratize artificial intelligence (AI). Several authors demand to reap purported benefits that rest in direct and broad participation: In the governance of AI, more people should be more involved in more decisions about AI—from development and design to deployment. This paper opposes this call. The paper presents five objections against broadening and deepening public participation in the governance of AI. The paper begins by reviewing the literature and carving out a set of claims (...) that are associated with the call to “democratize AI”. It then argues that such a democratization of AI (1) rests on weak grounds, because it does not answer to a demand of legitimization, (2) is redundant in that it overlaps with existing governance structures, (3) is resource intensive, which leads to injustices, (4) is morally myopic and thereby creates popular oversights and moral problems of its own, and finally, (5) is neither theoretically nor practically the right kind of response to the injustices that animate the call. The paper concludes by suggesting that AI should be democratized not by broadening and deepening participation but by increasing the democratic quality of the administrative and executive elements of collective decision making. A widely held picture in political science emphasizes the cognitive shortcomings of us citizens. We’re ignorant. We don’t know much about politics. We’re irrational. We bend the evidence to show our side in the best possible light. And we’re malleable. We let political elites determine our political opinions. This paper is about why these shortcomings matter to democratic values. Some think that democracy’s value consists entirely in its connection to equality. But the import of these shortcomings, I argue, cannot be (...) explained in purely egalitarian terms. To explain it, we must instead think of democracy’s value partly in terms of collective autonomy. Our ignorance and irrationality undermine the epistemic conditions for realizing this kind of autonomy. They stop us knowing the outcomes of our political choices. Our irrationality and malleability undermine the independence conditions for realizing such autonomy. They mean our political choices are subject to problematic kinds of interpersonal influence. Thus, at root, the import of the widely held picture is that, if accurate, it closes off this critical aspect of democracy’s value. (shrink)

The question of whether or not a closed border entry policy under the unilateral control of a democratic state is legitimate cannot be settled until we first know to whom the justification of a regime of control is owed. According to the state sovereignty view, the control of entry policy, including of movement, immigration, and naturalization, ought to be under the unilateral discretion of the state itself: justification for entry policy is owed solely to members. This position, however, is inconsistent (...) with the democratic theory of popular sovereignty. Anyone accepting the democratic theory of political legitimation domestically is thereby committed to rejecting the unilateral domestic right to control state boundaries. Because the demos of democratic theory is in principle unbounded, the regime of boundary control must be democratically justified to foreigners as well as to citizens, in political institutions in which both foreigners and citizens can participate. Democratic innovations have been widely presented by both academics and practitioners as a potential remedy to the crisis of representative democracy. Many argue that deliberation should play a pivotal role in these innovations, fostering greater citizen participation and political influence. However, it remains unclear how digitalization affects the quality of deliberation—whether digital democratic innovations (DDIs) undermine or enhance deliberation. This paper takes an inductive approach in political theory to critically examine three features of online deliberation that matter for deliberative democracy: (...) scale, transparency, and the facilitation of equality. It argues that the enhancement of equality should be given special attention when designing and implementing deliberative DDIs. Equality is a basic democratic value that is crucial for the intrinsic quality of deliberation. One way of enhancing equality through digital deliberative practices is via AI facilitation, which can assist human facilitators and help mitigate power dynamics, often present in non-digital settings. This essay seeks to provide a justification for the ‘egalitarian authority claim’, according to which citizens of democratic states have a moral duty to obey (at least some) democratically made laws because they are the outcome of an egalitarian procedure. It begins by considering two prominent arguments that link democratic authority to a concern for equality. Both are ultimately unsuccessful; but their failures are instructive, and help identify the conditions that a plausible defense of the egalitarian authority claim must meet. (...) The first argument (discussed in Section II, after Section I clarifies what authority and democracy are taken to consist in) appeals to the simple idea that fairness disallows granting ourselves special privileges that we deny to others; and it suggests that fairness thus requires obeying democratic decisions rather than acting on our own judgment of the right policy. I show that this argument fails; and its failure indicates that we must invoke a less formal, more substantive understanding of equality to justify democratic authority. The second argument, recently suggested by Thomas Christiano, does just that. Democratic authority is, on this account, not justified by the formal demand for equal treatment but by the distinctive value of showing public equal respect to our fellow citizens. Such public equal respect requires treating as authoritative the democratic decisions in which citizens had an equal say. This argument does not, however, succeed in its goal either. While it plausibly establishes the value of democratic institutions, it does not provide grounds for a duty to obey democratic decisions (Section III). This essay thus develops an alternative argument, according to which egalitarian procedures have authority because, by obeying them, we can avoid acting on certain considerations that must be excluded from our intrinsically valuable egalitarian relationships. The authority of democratic decisions rests on the egalitarian fact that none of us has more of a say than any other, not on the further fact (crucial to the previous argument) that each of us has a positive say (Sections IV and V). The argument in turn helps us understand the limits of democratic authority: it is constrained not only by a demand for equality, and by considerations of justice, but also by a requirement of mutual concern without which our egalitarian relationships lack their distinctive value (Section VI). When the Supreme Court in 2003 struck down a Texas law prohibiting homosexual sodomy, it cited the right to privacy based on the guarantee of "substantive due process" embodied by the Constitution. But did the court act undemocratically by overriding the rights of the majority of voters in Texas? Scholars often point to such cases as exposing a fundamental tension between the democratic principle of majority rule and the liberal concern to protect individual rights. Democratic Rights challenges this view by (...) showing that, in fact, democracy demands many of these rights. Corey Brettschneider argues that ideal democracy is comprised of three core values--political autonomy, equality of interests, and reciprocity--with both procedural and substantive implications. These values entitle citizens not only to procedural rights of participation but also to substantive rights that a "pure procedural" democracy might not protect. What are often seen as distinctly liberal substantive rights to privacy, property, and welfare can, then, be understood within what Brettschneider terms a "value theory of democracy." Drawing on the work of John Rawls and deliberative democrats such as Jürgen Habermas, he demonstrates that such rights are essential components of--rather than constraints on--an ideal democracy. Thus, while defenders of the democratic ideal rightly seek the power of all to participate, they should also demand the rights that are the substance of self-government. (shrink)

ABSTRACT: So far in this book, we have examined algorithmic decision systems from three autonomy-based perspectives: in terms of what we owe autonomous agents (chapters 3 and 4), in terms of the conditions required for people to act autonomously (chapters 5 and 6), and in terms of the responsibilities of agents (chapter 7). -/- In this chapter we turn to the ways in which autonomy underwrites democratic governance. Political authority, which is to say the ability of a government to exercise (...) power, may be justifiable or not. Whether it is justified and how it can come to be justified is a question of political legitimacy. Political legitimacy is another way in which autonomy and responsibility are linked. This relationship is the basis of the current chapter, and it is important in understanding the moral salience of algorithmic systems. We will draw the connection as follows. We begin, in section 8.1, by describing two uses of technology: crime predicting technology used to drive policing practices and social media technology used to influence elections (including by Cambridge Analytica and by the Internet Research Agency). In section 8.2 we consider several views of legitimacy and argue for a hybrid version of normative legitimacy based on one recently offered by Fabienne Peter. In section 8.3 we will explain that the connection between political legitimacy and autonomy is that legitimacy is grounded in legitimating processes, which are in turn based on autonomy. Algorithmic systems—among them PredPol and the Cambridge Analytica-Facebook-Internet Research Agency amalgam—can hinder that legitimation process and conflict with democratic legitimacy, as we argue in section 8.4. The attempt to connect philosophy and social hope has been one of the key distinguishing features of critical theory as a tradition of enquiry. This connection has been questioned forcefully from the perspective of a post-philosophical pragmatism, as articulated by Rorty. In this article I consider two strategies that have been adopted by critical theorists in seeking to reject Affection Rorty's suggestion that we should abandon the attempt to ground social hope in philosophical reason. We consider argumentative strategies of the (...) philosophical anthropologist and of the rational proceduralist. Once the exchanges between Rorty and these two strands of critical theory have been reconstructed and assessed, an alternative perspective emerges. It is argued that philosophical reasoning best helps to sustain social hope in a rapidly changing world when we consider it in terms of the practice of democratic criticism. (shrink)

The attempt to connect philosophy and social hope has been one of the key distinguishing features of critical theory as a tradition of enquiry. This connection has been questioned forcefully from the perspective of a post-philosophical pragmatism, as articulated by Rorty. In this article I consider two strategies that have been adopted by critical theorists in seeking to reject Rorty's suggestion that we should abandon the attempt to ground social hope in philosophical reason. We consider argumentative strategies of the philosophical (...) anthropologist and of the rational proceduralist. Once the exchanges between Rorty and these two strands of critical theory have been reconstructed and assessed, an alternative perspective emerges. It is argued that philosophical reasoning best helps to sustain social hope in a rapidly changing world when we consider it in terms of the practice of democratic criticism. (shrink)

Nonhuman animals are unable to exert any direct control over the functioning of democratic institutions –the decisions of which, nevertheless, have a pervasive impact on their lives. Their interests are therefore likelier to be set back or unfairly discounted, and their choices are more vulnerable to arbitrary interference. Because of this, some authors have suggested that we ought to redesign our political institutions so that they are more responsive to the interests of animals. We argue that this strategy fails to (...) address the root of the problem, which is animals’ lack of robust political agency. We defend that, should it become technologically feasible, we have a pro tanto obligation, derived from the values that underpin democracy, to uplift, or radically enhance, the political agency of nonhuman animals, so that they can better participate in mass democratic politics, express their interests as they see them, self-organise to defend them, and hold their representatives accountable. Finally, we explain how our argument manages to resist the most important objections against animal enhancement and, in some cases, it does so better than alternative proposals based on the value of animal well-being.
