English summary: Kant described phenomenology as that which comes from us, and that which comes to us, a duality that leads towards the theological horizon. Kant opened a field of inquiry that historical phenomenology, born with Husserl and Heidegger, repeated. C'est la reconduire la pensee a l'eclat d'un fait premier ou puiser ensuite ses ressources: il y a la loi. Kant le decrit comme un appel, a defaut de tout a fait le nommer ainsi, l'interpretant ensuite tout a la fois comme ce qui vient de nous (comme si le sujet ethique se donnait a lui-meme la loi) et ce qui vient a nous (comme si ce meme sujet repondait a la loi venue de Dieu). Prendre au serieux cette dualite suppose que le chantier kantien de l'ethique ouvre alors sur un horizon theologique. Kant ouvre un chantier que la phenomenologie historique, celle qui nait avec Husserl et Heidegger, repete. Nous avons ete appeles - la trace laissee en nous par cet appel est trop forte pour que le moindre doute puisse encore s'elever a son propos, mais la question vient aussitot: quelle voix s'est fait entendre? Quel appel nous surprend et nous souleve? Appel de l'etre (Martin Heidegger), appel de l'Autre (Emmanuel Levinas) ou appel de la vie (Michel Henry)? Nous avons ete appeles, affectes, blesses - ce qui brise la vie lui appartient encore, mais qu'est-ce donc qui la brise et la releve? Multiples sont les figures de l'appel, mais a chaque fois il y a la loi et cette injonction d'etre - cette injonction silencieuse a laquelle le poete aura donne son exacte formule: Tu dois changer ta vie (Rilke). Pour des raisons souvent historiques, la pensée occidentale moderne a surtout pensé la norme et la loi. Elle a parfois aussi – mais plus rarement – réfléchi sur le principe mais elle a souvent négligé l'exception. Or cette dernière joue un rôle central en droit en ce qu'elle le crée réellement et en tous les sens du terme. Certains auteurs ont tenté de mettre en évidence l'importance de ladite exception mais leur vision a souvent été trop réductrice et l'exception a (...) trop souvent été réduite à l'idée négative de crise. L'auteur de ce travail, juriste et philosophe, après avoir envisagé les différents aspects pris par l'exception en droit et ouvert pour la première fois en philosophie du droit le sens de cette notion, propose ici de définir l'exception comme le hors du commun et de ne tenir vraiment pour exceptionnelles que les "belles" exceptions, à savoir celles qui rendent l'homme meilleur. Un droit ne peut en effet porter dignement ce nom que lorsqu'il aide chacun à devenir plus grand et à se tenir plus droit qu'il ne se tenait avant qu'il soit édicté. Cependant, pour ne pas se réduire aux simples déclarations d'intention, un tel droit ne peut réellement exister que par des beaux gestes – aussi modestes et quotidiens soient-ils – car ce sont eux en effet qui nous donnent chaque jour l'envie de devenir meilleur que nous le sommes et qui créent véritablement le droit. Un nouveau mode de rapport au monde est ne en Grece ancienne: l'attitude critique, laquelle a marque durablement l'histoire occidentale pour ensuite s'imposer de plus en plus a l'echelle mondiale. Des ce moment beaucoup s'est joue, car l'independance de la pensee, le rapport questionnant au monde, le pur interet pour le connaitre, la tradition de la discussion critique et du franc-parler individuel - c'est-a-dire la tradition du rapport critique a la tradition - allaient non seulement penetrer a l'interieur meme des (...) doctrines juive, chretienne et musulmane pour en inflechir le cours, mais gagner a l'epoque moderne puis contemporaine leur espace propre dans la Cite. Inventeurs de la democratie et de la philosophie, les Grecs ont donne naissance a cet ethos-critique dont le mode d'etre, le pli culturel si l'on veut, n'allait plus nous quitter. En depit des detours et de tous les meandres, les Lumieres du XVIIIe, de meme qu'auparavant la Renaissance, se comprennent donc comme les fruits lointains des Lumieres antiques. Dit autrement, il n'y a rien d'absolument inedit dans la critique generale des croyances et l'atheisme moderne lui-meme, dans la recherche d'un fondement anthropologique a la Cite et a ses lois, dans la decouverte de la relativite des connaissances mais aussi des valeurs d'une culture a l'autre, dans l'exercice de la libre pensee, dans le questionnement radical porte sur la nature du lien politique et les meilleurs moyens d'assurer le bien-vivre-ensemble mais quelque chose comme le prolongement et l'elargissement dans l'espace moderne, de ce dont l'Athenes democratique a fourni le premier germe et la premiere impulsion. A relire les Grecs, generation apres generation, tous a des degres divers, Romains, Juifs, Chretiens, Musulmans, etc., s'inoculerent et se transmirent les uns les autres ce germe critique qui, selon les differents sols et les differentes periodes historiques, epousa des formes variees. Le present essai propose donc une relecture du monde moderne fondee sur une reinterpretation de l'input antique grec, une analyse qui tient compte de la nouvelle humanite, critique et reflechie, decouverte en Grece, et qui prend donc ses distances vis-a-vis des approches proposees par des auteurs comme H. Blumenberg (la Modernite releve d'une auto-affirmation absolument originale, d'une curiosite theoretique sans precedent dans l'histoire), M. Gauchet (le desenchantement du monde est un phenomene essentiellement moderne, la democratie d'aujourd'hui tout autre chose que la democratie antique), et R. Brague (l'Occident tient davantage de la Rome christianisee et hellenisee que d'Athenes). A partir de l'examen de cas concrets, tels que l'idee de creativite artistique dans l'Antiquite, l'agnosticisme ou l'atheisme, la satire sociale tous azimuts d'un Lucien de Samosate, on peut constater que la culture contemporaine n'est pas essentiellement differente mais reprend bien plutot le fil d'interrogations et d'audaces anciennes. Le monde moderne a rompu avec certains aspects de sa tradition, mais il n'a pas rompu avec son passe, celui plus ancien, qu'il redecouvre de maniere plus libre aujourd'hui. Le but de l'ouvrage n'est d'ailleurs aucunement de sacraliser l'hellenisme, mais de montrer que le potentiel critique, inscrit dans la dynamique meme de cette culture, peut nous aider a mieux faconner la societe ouverte de demain. Man unterscheidet in der Organisation verschiedener Tiere folgende Kategorien von Parallelismen: 1) die Homologien, welche auf einen gemeinsamen Ursprung der betreffenden Organe hinweisen, 2) die Analogien, die als eine Folge von ähnlichen Funktionen oder der äusseren Wirkungen sekundär enstehen, 3) die Homomorphien, wodurch ich diejenigen Übereinstimmungen im Körperbau von verschiedenen Tieren bezeichne, welche auf Grund der allgemeinen Gesetze der Morphogenese zustande kommen. Das Studium der Homologien ist historischer Art, dasjenige der Homomorphien und Analogien typologischer Art.Man kann weiter unterscheiden: eine allgemeine (...) Homomorphie, welche sich im Tierreiche überall, wo dazu günstige Bedingungen vorhanden sind, offenbart , und eine spezielle Homomorphie, welche als eine der Möglichkeiten bei einer begrenzten Anzahl von Tierformen hervortritt . Die Grenze zwischen diesen beiden Kategorien ist natürlich nicht sehr deutlich, ebenso wie manchmal die Grenze zwischen Homologien, Homomorphien und Analogien. The paper presents a perspective on our relation to our environment that is inspired by Confucian thought and that stands in contrast to certain common strands in contemporary philosophical discussions. It conceptualizes our relation to what we encounter on a day-to-day basis primarily in terms of the way we experience and respond to situations, rather than to the objects affected in the situations. From this perspective, the contemporary philosophical distinction between a first- and a third-person point of view is often (...) not suited for describing our responses to situations. Instead, our responses to situations can vary along different dimensions, including the way we direct our attention, our thoughts and sentiments, our motivations, etc., and these variations admit of degrees. Such variations depend on various factors, such as the different ways in which one relates to the object affected in a situation and the kind of person one is. and cannot be adequately described in terms of a shift from one point of view to another. The paper discusses two examples, anger and compassion, to illustrate this alternative perspective, but the discussion can be extended to other areas such as gratitude. (shrink)

SummaryIn this article I am criticizing Davidson's claim that psychological description and explanation are impossible without a strong assumption of rationality of the subject. I am trying to dispute his thesis that presupposition of coherence between propositional attitudes must be treated as a constitutive principle of psychology which fundamentally differentiates this science from physics and precludes the existence of strict psycho‐physical laws. Philosophical and empirical arguments are brought forward tho show that Davidson overestimates the role of rationality considerations in psychology. (...) There is no a priori reason why mental states should not be gradually included in a deterministic nomological net.RésuméDans cet article, je critique la thèse de Davidson selon laquelle la description et I'explication psychologiques sont impossibles si I'on ne fait pas I'hypothèse forte de la rationalité du sujet. Je conteste sa thése que la présuppositions d'une cohérence entre les attitudes propositionnelles doive être considérée comme un principe constitutif de la psychologie, principe qui la différencierait fondamentalement de la physique et interdirait I'existence de lois psycho‐physiques strictes. Des arguments philosophiques et empiriques sont produits pour montrer que Davidson surestime le rôle des considérations de rationalité en psychologie. Philosophische und empirische Argumente werden vorgelegt urn zu zeigen, dass Davidson die Rolle von Rationalitätserwägungen in der Psychologie überschätzt. Es gibt keine apriorischen Gründe dafür, dass mentale Zustände nicht nach und nach in ein deterministisches Netzwerk von Gesetzen eingefügt werden könnten. (shrink)

Following the enshrinement of the Mencius (an edited compilation of his thought by disciples) as one of the Four Books by Sung neo-Confucianists, he was studied by all educated Chinese. This book begins a reassessment of Mencius by studying his ethical thinking in relation to that of other early Chinese thinkers, including Confucius, Mo Tzu, the Yangists, and Hsün Tzu. „Daß alle Sätze die Zeit in irgendeiner Weise enthalten, scheint uns zufällig, im Vergleich damit, daß auf alle Sätze die Wahrheitsfunktionen anwendbar sind.“ Die Zeit „schmeckt nach Inhalt“, die Wahrheitsfunktionen hingegen nach „Darstellungsform“. Diese Bemerkung Wittgensteins spiegelt eine Intuition wider, von der sich der überwiegende Teil analytischer Sprachphilosophie leiten lässt. Sebastian Rödl zeigt in seinem Buch, dass diese Intuition fehlgeht und dabei mit einem verengten Verständnis von Logik und einer falschen Auffassung der Natur unseres endlichen Verstandes zusammenhängt. Für einen endlichen (...) Verstand sind entgegen dieser Intuition „Wahrheitsbezug und Zeitbewußtsein [...] zwei Seiten einer kognitiven Form“ (81), und in einer diesem Verstand angemessenen, aus dem Prinzip des Anschauungsbezugs entwickelten Logik fällt die Zeit nicht auf die Seite des Inhalts, wie Wittgenstein gemutmaßt hatte, sondern charakterisiert die Formen unseres Aussagens: die Formen prädikativer Einheit. Das von diesem Gedanken vorausgesetzte Verständnis von Logik entfaltet Rödl im ersten Teil seiner Arbeit; das für einen anschauungsbezogenen Verstand charakteristische System der Formen zeitlicher Aussagen entwickelt er im zweiten Teil. In meiner Besprechung konzentriere ich mich auf eine Beschreibung des Systems zeitlicher Aussageformen (I), um dieses System in einem zweiten Schritt daraufhin zu befragen, ob sich durch dessen Darstellung tatsächlich ein angemessenes und vollständiges Bild der Zeitlichkeit eines endlichen Verstandes ergibt (II). Die liberale Theologie geht davon aus, daß man die traditionelle christliche Lehre heute nicht mehr glauben kann und daß man sie deshalb verändern muß. Sie will sich nicht vom Christentum offen absagen, sondern das Christentum verändern oder eine neue Version des Christentums einführen. Radical Orthodoxy (RO), vor allem von John Milbank gegründet, will eine Gegenbewegung dazu sowie zum Säkularismus sein: „A theology which claims to be radical and orthodox“. In diesem Aufsatz möchte ich untersuchen, ob sie es wirklich ist, und (...) ich werde Indizien dafür vorstellen, daß sie es nicht ist. Real engines of the artificial intelligence revolution, machine learning models, and algorithms are embedded nowadays in many services and products around us. As a society, we argue it is now necessary to transition into a phronetic paradigm focused on the ethical dilemmas stemming from the conception and application of AIs to define actionable recommendations as well as normative solutions. However, both academic research and society-driven initiatives are still quite far from clearly defining a solid program of study and intervention. In (...) this contribution, we will focus on selected ethical investigations around AI by proposing an incremental model of trust that can be applied to both human-human and human-AI interactions. Starting with a quick overview of the existing accounts of trust, with special attention to Taddeo’s concept of “e-trust,” we will discuss all the components of the proposed model and the reasons to trust in human-AI interactions in an example of relevance for business organizations. We end this contribution with an analysis of the epistemic and pragmatic reasons of trust in human-AI interactions and with a discussion of kinds of normativity in trustworthiness of AIs. (shrink)

Holm (2022) argues that a class of algorithmic fairness measures, that he refers to as the ‘performance parity criteria’, can be understood as applications of John Broome’s Fairness Principle. We argue that the performance parity criteria cannot be read this way. This is because in the relevant context, the Fairness Principle requires the equalization of actual individuals’ individual-level chances of obtaining some good (such as an accurate prediction from a predictive system), but the performance parity criteria do not guarantee any (...) such thing: the measures merely ensure that certain population-level ratios hold. It is argued that while the use of hsing need not connote something unlearned and shared, Mencius did view jen-hsing in terms of certain unlearned emotional predispositions shared by all jen. He regarded jen as a species distinguished from other animals by its capability of cultural accomplishment, and felt that it is the presence of the emotional predispositions that makes this possible.

We establish a duality between the category of involutive bisemilattices and the category of semilattice inverse systems of Stone spaces, using Stone duality from one side and the representation of involutive bisemilattices as Płonka sum of Boolean algebras, from the other. Furthermore, we show that the dual space of an involutive bisemilattice can be viewed as a GR space with involution, a generalization of the spaces introduced by Gierz and Romanowska equipped with an involution as additional operation.

The Chinese ethical tradition has often been thought to oppose Western views of the self as autonomous and possessed of individual rights with views that emphasize the centrality of relationship and community to the self. Through an examination of the problematic forms of pride highlighted in early texts and the traits to which they are opposed, the paper identifies three main dimensions of humility in early Confucian thought. These include a deflated self-conception, caution and fearfulness, as well as seriousness and awe. It then shows that the term jing 敬 is closely related to all three dimensions, and hence that this is the term in early Confucian thought closest to encompassing all the different aspects of (...) humility understood in a broad sense. Algorithmic predictions are promising for insurance companies to develop personalized risk models for determining premiums. In this context, issues of fairness, discrimination, and social injustice might arise: Algorithms for estimating the risk based on personal data may be biased towards specific social groups, leading to systematic disadvantages for those groups. Personalized premiums may thus lead to discrimination and social injustice. It is well known from many application fields that such biases occur frequently and naturally when prediction models are applied to (...) people unless special efforts are made to avoid them. Insurance is no exception. In this paper, we provide a thorough analysis of algorithmic fairness in the case of insurance premiums. We ask what “fairness” might mean in this context and how the fairness of a premium system can be measured. For this, we apply the established fairness frameworks of the fair machine learning literature to the case of insurance premiums and show which of the existing fairness criteria can be applied to assess the fairness of insurance premiums. We argue that two of the often-discussed group fairness criteria, independence (also called statistical parity or demographic parity) and separation (also known as equalized odds), are not normatively appropriate for insurance premiums. Instead, we propose the sufficiency criterion (also known as well-calibration) as a morally defensible alternative that allows us to test for systematic biases in premiums towards certain groups based on the risk they bring to the pool. In addition, we clarify the connection between group fairness and different degrees of personalization. Our findings enable insurers to assess the fairness properties of their risk models, helping them avoid reputation damage resulting from potentially unfair and discriminatory premium systems. Recent evidence of intergenerational epigenetic programming of disease risk broadens the scope of public health preventive interventions to future generations, i.e. non existing people. Due to the transmission of epigenetic predispositions, lifestyles such as smoking or unhealthy diet might affect the health of populations across several generations. While public policy for the health of future generations can be justified through impersonal considerations, such as maximizing aggregate well-being, in this article we explore whether there are rights-based obligations supervening on intergenerational epigenetic (...) programming despite the non-identity argument, which challenges this rationale in case of policies that affect the number and identity of future people. We propose that rights based obligations grounded in the interests of non-existing people might fall upon existing people when generations overlap. In particular, if environmental exposure in F0 will affect the health of F2 through epigenetic programming, then F1 might face increased costs to address F2's condition in the future: this might generate obligations upon F0 from various distributive principles, such as the principle of equal opportunity for well being. Results: We analyzed 1,402 surveys and 15 in-depth interviews. Many (32%) CL participants reported greater difficulty refilling medications and a minority (14%) reported greater difficulty accessing HIV care during the pandemic. Most (99%) Opt4Mamas participants reported no difficulty refilling medications or accessing HIV/pregnancy care. Among the CL participants, older women were less likely (aOR = 0.95, 95% CI: 0.92–0.98) and women with more children were more likely (aOR = 1.13, 95% CI: 1.00–1.28) to report difficulty refilling medications. Only 2% of (...) CL participants reported greater difficulty managing FP and most (95%) reported no change in likelihood of using FP or desire to get pregnant. Qualitative analysis revealed three major themes: (1) adverse organizational/economic implications of the pandemic, (2) increased importance of pregnancy prevention during the pandemic, and (3) fear of contracting COVID-19. In this article, we defend a normative theory of prenatal equality of opportunity, based on a critical revision of Rawls's principle of fair equality of opportunity . We argue that if natural endowments are defined as biological properties possessed at birth and the distribution of natural endowments is seen as beyond the scope of justice, Rawls's FEO allows for inequalities that undermine the social conditions of a property-owning democracy. We show this by considering the foetal programming of disease and the (...) possibility of germ-line modifications. If children of lower socioeconomic background are more likely to develop in a poor foetal environment and germ-line enhancements are available only to the rich, initial inequalities between the rich and the poor would grow, and yet FEO would be satisfied. In order to avoid the problem, we propose a revised FEO principle omitting any reference to the comparison of natural endowments. Our revised FEO requires that institutions mitigate social class effect from reproduction and gestation to the greatest extent compatible with parental freedoms and the value of the family. (shrink)

The philosophical study of Confucian thought seeks to both understand the nature of Confucian thought in its historical and cultural context and relate it in an intellectually fruitful manner to contemporary philosophical discourse. Someone engaged in such a study will be pulled inward toward approximating the perspectives of the Confucian thinkers set in the context of their concerns and activities, and pulled outward away from the Confucians’ world of ideas to relate them to our present concerns and interests, specifically those (...) that characterize contemporary philosophical discourse. These two psychological forces, the inward pull and outward pull, can be combined in different ways in the psychological orientation that underlies such a study. This essay presents and discusses the merits of an approach that it describes as “studying Confucian thought from the inside out.” On this approach, the inward pull is maximally dominant, and even as the outward pull leads us to move beyond the Confucians’ own perspectives to relate their ideas to our present concerns and interests, we at the same time seek to do so in a way that is maximally continuous with their perspectives. Such an approach helps draw out the distinctive characteristics and insights of Confucian thought, and also furthers a direction of inquiry that the Confucian thinkers themselves advocate. (shrink)

Neuroenhancement involves the use of neurotechnologies to improve cognitive, affective or behavioural functioning, where these are not judged to be clinically impaired. Questions about enhancement have become one of the key topics of neuroethics over the past decade. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. This suggests that for many neuroenhancement is viewed simultaneously as a source of both promise and concern. (shrink)

BackgroundThe COVID-19 pandemic has changed the healthcare landscape drastically. Stricken by sharp surges in morbidity and mortality with resource and manpower shortages confounding their efforts, the medical community has witnessed high rates of burnout and post-traumatic stress amongst themselves. Whilst the prevailing literature has offered glimpses into their professional war, no review thus far has collated the deeply personal reflections of physicians and ascertained how their self-concept, self-esteem and perceived self-worth has altered during this crisis. Without adequate intervention, this may (...) have profound effects on their mental and physical health, personal relationships and professional efficacy.MethodsWith mentions of the coronavirus pervading social media by the millions, this paper set out to collate and thematically analyse social media posts containing first-person physician reflections on how COVID-19 affected their lives and their coping mechanisms. A consistent search strategy was employed and a PRISMA flowchart was used to map out the inclusion/exclusion criteria.ResultsA total of 590 social media posts were screened, 511 evaluated, and 108 included for analysis. Salient themes identified include Disruptions to Personal Psycho-Emotional State, Disruptions to Professional Care Delivery, Concern for Family, Response from Institution, Response from Society and Coping Mechanisms.ConclusionIt is evident that the distress experienced by physicians during this time has been manifold, multi-faceted and dominantly negative. Self-concepts were distorted with weakened self-esteem and perceived self-worth observed. The Ring Theory of Personhood (RToP) was adopted to explain COVID-19’s impact on physician personhood as it considers existential, individual, relational and social concepts of the self. These entwined self-concepts serve as ‘compensatory’ to one another, with coping mechanisms buffering and fortifying the physician’s overall personhood. With healthcare institutions playing a vital role in providing timely and targeted support, it was further proposed that a comprehensive assessment tool based on the RToP could be developed to detect at-risk physicians and evaluate the presence and effectiveness of established support structures.
