This paper aims to show that the Knowledge Norm of Assertion (KNA) leads to trouble in certain dialectical contexts. Suppose a person knows that p but does not know that she knows that p. She asserts p in compliance with the KNA. Her interlocutor responds: “but do you know that p?” It will be shown that the KNA blocks the original asserter from providing any good response to this perfectly natural follow-up question, effectively forcing her to retract p from the (...) conversational scoreboard. This finding is not simply of theoretical interest: I will argue that the KNA would allow the retort “but do you know that p?” to be weaponized in strategic communication, serving as a tool for silencing speakers without having to challenge their testimonial contributions on their own merits. Our analysis can thereby provide a new dimension to the study of epistemic injustice, and underscores the importance of considering the norms governing speech acts also from the point of view of non-ideal social contexts. The debate over the merits of originalism has advanced considerably in recent years, both in terms of its intellectual sophistication and its practical significance. In the process, some prominent originalists—Lawrence Solum and Jeffrey Goldsworthy being the two discussed here—have been at pains to separate out the linguistic and normative components of the theory. For these authors, while it is true that judges and other legal decision-makers ought to be originalists, it is also true that the communicated content of the constitution (...) is its original meaning. That is to say: the meaning is what it is, not what it should be. Accordingly, there is no sense in which the communicated content of the constitution is determined by reference to moral desiderata; linguistic desiderata do all the work. In this article, I beg to differ. In advancing their arguments for linguistic originalism, both authors rely upon the notion of successful communications conditions. In doing so they implicitly open up the door for moral desiderata to play a role in determining the original communicated content. This undercuts their claim and changes considerably the dialectical role of linguistic originalism in the debate over constitutional interpretation. (shrink)

Rhetoric is widely regarded by both its detractors and advocates as a kind of antithesis to reason. In this book Thomas B. Farrell restores rhetoric as an art of practical reason and enlightened civic participation, grounding it in its classical tradition—particularly in the rhetoric of Aristotle. And, because prevailing modernist world views bear principal responsibility for the disparagement of rhetorical tradition, Farrell also offers a critique of the dominant currents of modern humanist thought. Farrell argues that rhetoric is not antithetical (...) to reason but is a manner of posing and answering questions that is distinct from the approaches of analytic and dialectical reason. He develops this position in a number of ways: through a series of bold reinterpretations of Aristotle's _Rhetoric_; through a detailed appraisal of traditional rhetorical concepts as seen in modern texts from the Army-McCarthy hearings to Edward Kennedy's memorial for his brother, Mario Cuomo's address on abortion, Betty Friedan's _Feminine Mystique_, and Vaclav Havel's inaugural address; and through a fresh appraisal of theories on the character of language and discourse found in contemporary philosophy, literary criticism, anthropology, deconstructionism, Marxism, and especially in Habermas's critical theory of communicative action. This paper revisits the concept of autonomy and tries to elucidate the fundamental insight that freedom and law cannot be understood through their opposition, but rather have to be conceived of as conditions of one another. The paper investigates the paradigmatic Kantian formulation of this insight and discusses the diagnosis that the Kantian idea might give rise to a paradox in which autonomy reverts to arbitrariness or heteronomy. The paper argues that the fatal version of the paradox can be defused (...) if we avoid the legalistic model of autonomy and rather turn to the model of participation in a practice. This leads to a dialectical understanding of the idea of autonomy that preserves the insight that freedom and law are mutually conditioning and simultaneously reveals that they remain in irresolvable tension with one another. Normative pragmatics can bridge the differences between dialectical and rhetorical theories in a way that saves the central insights of both. Normative pragmatics calls attention to how the manifest strategic design of a message produces interpretive effects and interactional consequences. Argumentative analysis of messages should begin with the manifest persuasive rationale they communicate. But not all persuasive inducements should be treated as arguments. Arguments express with a special pragmatic force propositions where those propositions stand in particular inferential relations to one (...) another. Normative pragmatics provides a framework within which varieties of propositional inference and pragmatic force may be kept straight. Normative pragmatics conceptualizes argumentative effectiveness in a way that integrates notions of rhetorical strategy and rhetorical situation with dialectical norms and procedures for reasonable deliberation. Strategic effectiveness should be seen in terms of maximizing the chances that claims and arguments will be reasonably evaluated, whether or not they are accepted. Procedural rationality should be seen in terms of adjustment to the demands of concrete circumstances. Two types of adjustment are illustrated: rhetorical strategies for framing the conditions for dialectical deliberation and rhetorical strategies for making do with limitations to dialectical deliberation. Horkheimerian’s critique of the Enlightenment, shows the process whereby the demystification of the world is triggered by way of an “an act of sovereignty” of reason. There the man lost for reason his possibility of self-criticism, causing it to be in instrumental reason. Since its inception, the Enlightenment, as myth, mutilated reason, over the pursuit of truth –theoretical truth and moral truth–, there was a renounce to sense. The dream of Enlightenment rationality was reduced to the 'instrumentalization'. This dialectic (...) not only reveals the irreversible crisis of reason, but leaves in place, in the discussion of critical theory, the idea of the 'social pathology of reason', from which a “normative horizon” can be proposed, hinting at the scene of the ethical discussion the lack of rationality of societies. The core function of argumentation in a democratic setting must be to constitute a modality for citizens to engage differences of opinion constructively – for the present but also in future exchanges. To enable this function requires acceptance of the basic conditions of public debate: that consensus is often an illusory goal which should be replaced by better mastery of living with dissent and compromise. Furthermore, it calls for an understanding of the complexity of real-life public debate which is an (...) intermixture of claims of fact, definition, value, and policy, each of which calls for an awareness of the greater ‘debate environment’ of which particular deliberative exchanges are part. We introduce a rhetorical meta-norm as an evaluation criterion for public debate. In continuation of previous scholarship concerned with how to create room for differences of opinion and how to foster a sustainable debate culture, we work from a civically oriented conception of rhetoric. This conception is less instrumental and more concerned with the role of communication in public life and the maintenance of the democratic state. A rhetorical meta-norm of public argumentation is useful when evaluating public argumentation – not as the only norm, but integrated with specific norms from rhetoric, pragma-dialectics, and formal logic. We contextualise our claims through an example of authentic contemporary public argumentation: a debate over a biogas generator in rural Denmark. (shrink)

This article examines the relevance of Hegel’s theory of recognition within educational theory and practice in relation to the development of a non-affirmative theory of education. The article argues that Hegel’s theory of recognition can serve as a fruitful starting point for articulating an educational theory that can contribute to the subject’s open-ended formation in modern society. To start with, the article surveys the connection between Hegel’s educational thought and his concept of recognition. Against this backdrop, the article singles out (...) how Hegel’s theory of recognition provides a compelling theory of intersubjectivity that calls attention to the role of norms in personal development and the construction of the social world. In continuation of a non-affirmative principle, it is argued that Hegelian recognition underlines, first, that the subject’s formation can fruitfully be an open-ended and dynamic process and, second, that in order to underpin this process it is necessary to critically assess norms and norm-generating practices within an educational context. The objective of this paper is twofold. First, it aims to contribute to the debate about the normativity of meaning not by means of providing and defending new arguments, but by analysing and reflecting on some of the presuppositions and seemingly irresolvable dialectical points of disagreement. Second, it seeks to achieve the first aim by critically engaging with some of the objections raised against semantic normativity by anti-normativists like Kathrin Glüer, Anandi Hattiangadi and Åsa Wikforss as well as discussing some (...) of the ideas defended by normativists like Hans-Johann Glock, Severin Schroeder and Daniel Whiting. The upshot of the discussion is meant to provide a clearer representation of some of the arguments and concepts that guide the debate, though the proposed analysis, if correct, should also add some support for the normativist’s case. In response to the companions in guilt arguments, some error theorists have tried to defend a nihilist thesis that there truly are no normative epistemic reasons to believe, and further no normative reasons whatsoever, making them global normative error theorists. In his recent paper, Patrick Clipsham tries to adjudicate on this debate. Dubbing this nihilist response a “bullet-biting” one, he argues that sophisticated forms of this response are viable and immune from the frequently leveled charges. However, he further argues that (...) despite its success of avoiding these charges, the nihilist response is bound to face a dialectical disadvantage, that is, it impairs the error theorist’s ability to criticize the opponents. In this paper, I argue for two propositions. First, while there are viable nihilist responses, they are not or at least should not be as how Clipsham has represented them. Second, the new charge from dialectical disadvantage also fails, along with the older charges. (shrink)

The Parmenides poses the question for what entities there are Forms, and the criticism of Forms it contains is commonly supposed to document an ontological reorientation in Plato. According to this reading, Forms no longer express the excellence of a given entity and a Socratic, ethical perspective on life, but come to resemble concepts, or what concepts designate, and are meant to explain nature as a whole. Plato’s conception of dialectic, it is further suggested, consequently changes into a value-neutral (...) method directed at tracing the interrelation of such Forms, an outlook supposedly documented in certain passages on method from the Sophist and the Statesman as well. -/- The article urges that this reading is untenable. For in the Parmenides the question for what entities one should posit Forms is left open, and the passages on method from the Sophist and Statesman neither encourage a non-normative ontology nor a value-neutral method of inquiry. What the three dialogues encourage us to do is rather to set common opinions about the relative worth and value of things aside when conducting ontological inquiries; and this attitude, the article concludes, demonstrates a close kinship, rather than a significant difference, between Plato’s Socrates and his Eleatic philosophers. This book reconstructs the concept and practice of dialectics as a means of grounding a critical theory of society. At the center of this project is the thesis of phronetic criticism or a form of reason that is able to synthesize human value with objective rationality. This book argues that defects in modern forms of social reason are the result of the powers of social structure and the norms and purposes they embody. Increasingly, modern societies are driven not by (...) substantive values concerning human good but by the technical imperatives of economic management leading to a cultural condition of nihilism that has eroded dialectical consciousness. The first half of the book demonstrates the various ways that social power erodes and undermines critical-rational forms of consciousness. The second part of the book constructs an alternative basis for critical reason by showing how it requires seeing human value as essentially ontological: that is, constituted by objective forms of sociality that either promote human freedom or pervert our capacities and drives toward pathological forms of life. The philosophical claim is that a critical theory of ethics must be rooted in these concrete forms of life and that this will serve as a critical vantage point for critical political judgment and transformational praxis. Beginning with the influential discussion of the dialectic of progress found in Amy Allen’s The End of Progress, this paper outlines some difficulties encountered by critical theories of normative justification drawing on the early Frankfurt School. Characterizing Adorno and Horkheimer’s critical social theory as a dialectical reflection eschewing questions of normative foundations, I relate their well-known treatment of the dialectic of enlightenment reason and myth to their critique of capitalist society as a negative totality. By exploring the concepts (...) of historical development used by Adorno and Horkheimer to describe both the progressive domination of capitalism, and the formation and cultivation of reflective consciousness, I trace the importance of progression and its inseparable relationship to regression in these early versions of critical theory. The dialectical social theory found here recognizes the persistence of social contradictions on both a methodological level and on the level of theory’s development and expression, a connection potentially obscured by a division of historical progress according to its temporal orientation. Particularly in Adorno’s later work, an opposition to the negative social totality requires notions of cultivation and learning which work against the prevailing forms of conceptual thinking, including the concern for the stability of rational foundations. With Habermas it is important to realize that one has to differentiate between moral and non-moral (a-moral) norms, which is different from what is immoral. However, since the Renaissance reflections on human freedom were caught up in the dialectic of necessity (nature) and freedom. A brief sketch is given of the development of this dialectic within modern philosophy – as it was manifested in the thought of Descartes, Hobbes, Leibniz, Locke, Berkely, Hume, Kant, Schelling, Hegel, Comte, Marxism, (...) the Baden school of neo-Kantianism (Windelband, Rickert, Weber) and existentialism (Jaspers, Merleau-Ponty). The influence of the neo-Kantian opposition of facts and values within social thought is briefly highlighted, followed by a brief characterization of the normative inclination of human beings. Then some of the problems entailed in the modern concept of freedom are analyzed in relation to the idea of autonomy. This idea is burdened by the problem that the conditions for being human have to coincide with what meets these conditions, namely the human being. In addition it is difficult to derive collective norms from the autonomy of a single individual. The alternative avenue suggested by the idea of ontic normativity will be investigated in a separate article, exploring the way towards a more integral understanding of normativity. (shrink)

Why are the fundamentals of education apparently so little changed in our era of digital technology? Is their obstinate persistence evidence of resilience or obsolescence? Such questions can best be answered not by imagining an uncertain high-tech future, but by examining a well-documented past--a history of instruction and media that extends from Gilgamesh to Google. Norm Friesen looks to the combination and reconfiguration of oral, textual, and more recent media forms to understand the longevity of so many educational arrangements and (...) practices. Friesen examines the interrelationship of reading, writing, and pedagogy in the case of the lecture and the textbook--from their premodern to their postmodern incarnations. Over hundreds of years, these two forms have integrated textual, oral, and (more recently) digital media and connected them with changing pedagogical and cultural priorities. The Textbook and the Lecture opens new possibilities for understanding not only mediated pedagogical practices and their reform but also gradual changes in our conceptions of the knowing subject and of knowledge itself. Although Karl Marx and Søren Kierkegaard are both major figures in nineteenth-century Western thought, they are rarely considered in the same conversation. Marx is the great radical economic theorist, the prophet of communist revolution who famously claimed religion was the "opiate of the masses." Kierkegaard is the renowned defender of Christian piety, a forerunner of existentialism, and a critic of mass politics who challenged us to become "the single individual." But by drawing out important themes bequeathed them by their shared (...) predecessor G. W. F. Hegel, Jamie Aroosi shows how they were engaged in parallel projects of making sense of the modern, "dialectical" self, as it realizes itself through a process of social, economic, political, and religious emancipation. In The Dialectical Self, Aroosi illustrates that what is traditionally viewed as opposition is actually a complementary one-sidedness, born of the fact that Marx and Kierkegaard differently imagined the impediments to the self's appropriation of freedom. Specifically, Kierkegaard's concern with the psychological and spiritual nature of the self reflected his belief that the primary impediments to freedom reside in subjectivity, such as in our willing conformity to social norms. Conversely, Marx's concern with the sociopolitical nature of the self reflected his belief that the primary impediments to freedom reside in the objective world, such as in the exploitation of the economic system. However, according to Aroosi, each thinker represents one half of a larger picture of freedom and selfhood, because the subjective and objective impediments to freedom serve to reinforce one another. By synthesizing the writing of these two diametrically opposed figures, Aroosi demonstrates the importance of envisioning emancipation as a subjective, psychological, and spiritual process as well as an objective, sociopolitical, and economic one. The Dialectical Self attests to the importance and continued relevance of Marx and Kierkegaard for the modern imagination. (shrink)

In this paper, I will argue for a complex of three theses. First, that the problem of deep disagreement is an instance of the regress problem of justification. Second, that the problem of deep disagreement, as a regress problem, depends on a dialecticality requirement for arguments. Third, that the dialecticality requirement is plausible and defensible.

The increasing use of online simulations as replacements for animal dissection in the classroom or lab raises important questions about the nature of simulation itself and its relationship to embodied educational experience. This paper addresses these questions first by presenting a comparative hermeneutic-phenomenological investigation of online and offline dissection. It then interprets the results of this study in terms of Borgmann’s (1992) notion of the intentional “transparency” and “pliability” of simulated hyperreality. It makes the case that it is precisely encumbrance (...) and disruption—elements that are by definition excluded from simulations and interfaces—which give dissection its educational value. (shrink)

The Oxford English Dictionary defines fulfilment as ‘satisfaction or happiness as a result of fully developing one's potential or realizing one's aspirations; self-fulfillment’. Not only has the idea of fulfilment underpinned ‘approximately twenty centuries of philosophy’ as Lefebvre notes, it plays an indispensable role in both popular and scholarly accounts of education and upbringing. Experiences of education, of upbringing and of ‘life lessons’, however, are so often not about the fulfilment of oneself, about the discovery and actualisation of one's full (...) potential. Such experiences instead involve moments of sometimes irreparable failure and loss—a matter that has not received a great deal of attention in educational research and theory. After briefly examining the way that fulfilment is favourably framed both in humanistic psychology and in neo-humanist Bildungstheorie, this paper considers some of the exceptions to the nearly ubiquitous identification of education with fulfilment: Arthur Schopenhauer's view of the irrationality of human (developmental) experience and Ludwig Wittgenstein's use of the term ‘conditioning’ (Abrichtung) in some of his accounts of learning and socialisation. We then focus on failure and loss in education through an overview of the pedagogical theory of O.F. Bollnow. Bollnow, as is gradually being recognised in English-language scholarship, saw moments of uncertainty, disorientation and above all crisis as indispensable in educational experience—for both student and teacher. In this way, we show that instead of being the pursuit of self-fulfilment, education is unavoidably a matter of difficulty, disruption and also failure. It reshapes us, and this reshaping can be seen as being as much about formation as it is about deformation. (shrink)

A culturally influential sub-discipline within literary studies, literary theory has developed in parallel form in other arts and social science disciplines, so that one might refer to "cultural theory" or "social theory" as well, or even just to "theory." It's as familiar as the word "postmodern" and as tricky as "deconstruction." What is it about? What is at stake? Theory is about rationality. This book's title invites two different interpretations of what it might mean to say so. For many, the (...) essence of literary theory is the unmasking and redescription of rationality in other terms. Put ironically, rationality is male; rationality is white; rationality is repression.... The book's title, however, can also be read in a second way. On this reading, rationality itself is the essence of literary theory and central to literature, art, and society. Certain conceptions of what it entails can be problematic; the critique in the first way of reading the title remains relevant. Yet one can affirm rationality as integral to human flourishing, including the processes of producing, analyzing, and enjoying literature, art, and culture. Good and evil are the most general ethical categories from which we can get our bearings in the fundamental philosophical and normative problems of ethics. In the contemporary scholarly literature the interpretation of the good is multifunctional. Good is regarded as a model of morality, as the most general moral requirement or most general moral evaluation, and finally as a practical norm, i.e., a requirement embodied in moral experience, as a unity of the objective and subjective in moral actions. The (...) history of ethical thought was bound to reach this broad, all-embracing conception of the good, indeed, that was the way it went, mastering the content of the category of the good, bit by bit, focusing attention now on one, now on another of its aspects. Hence the most general explanation of the good as a synonym for morality has not at all been the same throughout the different stages in the history of ethical thought. Good, like evil, and like all other ethical categories, had a different compass and different sets of attributes in diverse ethical systems. One must also consider that until modern times, there had never existed a single categorial term to designate morality as a whole. As O. G. Drobnitskii noted, the words "good and evil," "justice," "virtue," and "manners" were often preferred to the concept "morals"; and moreover, each of these words was used to designate not only the particular phenomena within moral philosophy but the entire domain of morals in general. Using tools like argument diagrams and profiles of dialogue, this paper studies a number of examples of everyday conversational argumentation where determination of relevance and irrelevance can be assisted by means of adopting a new dialectical approach. According to the new dialectical theory, dialogue types are normative frameworks with specific goals and rules that can be applied to conversational argumentation. In this paper is shown how such dialectical models of reasonable argumentation can be applied to a determination of whether an (...) argument in a specific case is relevant are not in these examples. The approach is based on a linguistic account of dialogue and text from congruity theory, and on the notion of a dialectical shift. Such a shift occurs where an argument starts out as fitting into one type of dialogue, but then it only continues to makes sense as a coherent argument if it is taken to be a part of a different type of dialogue. Merriam-Webster defines it simply as “the art, science, or profession of teaching.” In contemporary academic discourse, however, pedagogy is generally left undefined — with its apparent implicit meanings ranging anywhere from a specific “model for teaching” (e.g., behaviorist or progressivist instruction) to a broadly political philosophy of education in general (most famously, a “pedagogy of the oppressed”). In this paper, Norm Friesen and Hanno Su follow the Continental pedagogical tradition in giving pedagogy a general but explicit (...) definition. They do so by looking at how pedagogy arises both in everyday life and in school as unavoidably ethical activity undertaken primarily for the sake of the young person or child. Such activities, the authors maintain, are structured not so much by processes, methods, and outcomes, but by irresolvable oppositions and the tensions between them. They illustrate this inductively through a series of images and examples — moving gradually from ones involving parenting and early childhood to ones from elementary and secondary schooling. In this way, Friesen and Su show that pedagogy is not so much one or more ideologically focused or evidence-based instructional or psychological approaches to be mastered by a professional or teaching specialist. It is instead an independent but ethically informed practical perspective — one that can (and has) been extended to form a distinctively pedagogical theory and discipline.
