This essay uses Garland’s framework from The Culture of Control to suggest an agenda for critical penology. This includes, as well as the analysis of choices actually made and the cultural repertoire actually available, describing and advocating other possible choices, and analysing the conditions of possibility for the adoption of other (better) policies and practices; and examining the implications for the future of choices which are currently being made. Carlen’s Women and Punishment: The Struggle for Justice and Garland’s edited collection (...) Mass Imprisonment in the USA are examples of these penologies. Another way in which penologists, social theorists and philosophers can attempt to influence policy choices is to contribute to enlargement of the available cultural repertoire. The development and promotion of restorative justice is given as one example of this; another is work by philosophers such as Duff, Matravers and Norrie which addresses questions such as the source, nature and limits of penal communities; the basis of political obligation, and the relational nature of responsibility for crime. No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

This book examines the birth of the scientific understanding of motion. It investigates which logical tools and methodological principles had to be in place to give a consistent account of motion, and which mathematical notions were introduced to gain control over conceptual problems of motion. It shows how the idea of motion raised two fundamental problems in the 5th and 4th century BCE: bringing together being and non-being, and bringing together time and space. The first problem leads to the exclusion (...) of motion from the realm of rational investigation in Parmenides, the second to Zeno's paradoxes of motion. Methodological and logical developments reacting to these puzzles are shown to be present implicitly in the atomists, and explicitly in Plato who also employs mathematical structures to make motion intelligible. With Aristotle we finally see the first outline of the fundamental framework with which we conceptualise motion today. (shrink)

According to the tradition of western theism, God is said to enjoy the attribute of being everywhere present. But what is it, exactly, for God to manifest ubiquitous presence? Well, presumably, it is for God to bear a certain relation – the ‘being present at’ relation – to every place. This article focuses on the ‘being present at’ relation which figures so prominently in the divine attribute of omnipresence, on both fundamental and derivative readings of that relation, and on a (...) host of philosophical problems which arise for each reading. It is divided between a discussion of the historical positions of Anselm and Aquinas; a note on the controversy stirred up by the modern contributions of Hartshorne, Swinburne, Taliaferro, and Wierenga; a brief glance at two curious and underexplored approaches; an investigation of the promising prospects for further inquiry afforded by recent work on the metaphysics of location; and some concluding comments on special problems of occupation for the Christian theist. Dworkin's theoretical disagreement argument, developed in Law's Empire, is presented in that work as the motivator for his interpretive account of law. Like Dworkin's earlier arguments critical of legal positivism, the argument from theoretical disagreement has generated a lively exchange with legal positivists. It has motivated three of them to develop innovative positivist positions. In its original guise, the argument from theoretical disagreement is presented as ‘the semantic sting argument’. However, the argument from theoretical disagreement has more than one version. (...) This article briefly discusses two versions and the leading replies to them, then focuses on the most influential version, directed at Hartian positivism. The article surveys the leading positivist rejoinders to the recast version, indicating key Dworkinian replies or assessing the strength of these rejoinders, and concludes with a rejoinder of its own, making a new case that the argument from theoretical disagreement isn't fatal for Hartian legal positivism. By questions of “canon,” we mean questions of what is fictionally true of some character, story, or world. What is canon is treated as authoritative or official, usually by creators and fans alike. But disputes about canon have arisen as storytellers and publishers have sought to capitalize on the popularity of their characters, churning out more and more stories to meet public demand, and at the same time engaging with growing fan bases. As audiences have become more involved, and as (...) fictional worlds have become messier, the authoritative nature of canon—and who authorizes it—has begun to erode. In this paper, we characterize canon as an article in the evolving relation between authors and audiences. More specifically, we characterize canon as an intangible good, subject to a form of cultural negotiation, resting on a power relation between producers and consumers of fictions. In Part I, we consider the author’s evolving role, and the rights of the creator to a story, character, or world. In Part II, we discuss the emerging activities of fans, particularly as they weigh on issues of canon. In Part III, we discuss canon as being subject to cultural negotiation, highlighting the importance of power dynamics in this negotiation. (shrink)
