“Teflon immorality’’ (or TI) is immorality that goes on unchecked—the wrongdoing is not stopped and its perpetrators, beyond the reach of punishment or other sanction, often persist in their immoral ways. The idea that the immoral prosper has been recognized as morally (and legally) disturbing presumably for as long as humanity has been reflective, and can be found already in the Bible. The reasons behind a great deal of successful immorality are important practically, but uninteresting philosophically. (...) Sometimes, however, we face events that are more interesting philosophically, and Teflon immorality results from oddities such as moral paradoxes and perversions. These, however, have remained largely unnoticed. I will outline a tentative survey of this topic. After showing its pervasiveness and importance, I will briefly reflect on its relevance to the way we should think about morality and about the means to further it, and confront possible objections. We sometimes harm people legitimately, by standing in front of them in the queue at the cinema and buying the last available ticket, for instance, or by acting in self-defense. If we harm them illegitimately, however, we ostensibly have a moral obligation to compensate them for the harm done. And the more we harm them, the greater the compensation that, prima facie, we need to offer. But if the harm increases further, at some point we will need to offer less (...) compensation. Yet more harm, and it is quite likely that no compensation at all will be morally expected. In such situations, the greater the harm, the better off we will be, morally, in one important respect. This is morally absurd but, I claim, true, and it does not appear to have received significant philosophical attention. I explore the issue. (shrink)

This chapter offers an overview of issues posed by the problem of immoral artists, artists who in word or deed violate commonly held moral principles. I briefly consider the question of whether the immorality of an artist can render their work aesthetically worse (making connections to chapters in the Theory section of the handbook), and then turn to questions about what the audience should do and feel in response to knowledge of these moral failings. I discuss questions such as (...) whether audiences have reason not to purchase or consume work by these artists, whether their shows and exhibitions should be canceled, and how fans might grapple with the emotional turmoil they feel when artists whom they love act or speak in ways that are morally condemnable. This book examines what, if anything, makes a depiction of fictional immorality—such as the murder, torture, or sexual assault of a fictional character—an example of immoral fiction, and therefore something that should be morally criticized and possibly prohibited.

In _The Immorality of Punishment_ Michael Zimmerman argues forcefully that not only our current practice but indeed any practice of legal punishment is deeply morally repugnant, no matter how vile the behaviour that is its target. Despite the fact that it may be difficult to imagine a state functioning at all, let alone well, without having recourse to punishing those who break its laws, Zimmerman makes a timely and compelling case for the view that we must seek and put (...) into practice alternative means of preventing crime and promoting social stability. Does immorality necessarily involve irrationality? The question is often taken to be among the deepest in moral philosophy. But apparently deep questions sometimes admit of deflationary answers. In this case we can make way for a deflationary answer by appealing to dualism about rationality, according to which there are two fundamentally distinct notions of rationality: structural rationality and substantive rationality. I have defended dualism elsewhere. Here, I’ll argue that it allows us to embrace a sensible – I will not (...) say boring – moderate view about the relationship between immorality and irrationality: roughly, that immorality involves substantive irrationality, but not structural irrationality. I defend this moderate view, and argue that many of the arguments for less moderate views turn either on missing the distinction between substantive and structural rationality, or on misconstruing it. Is it appropriate to honour and admire people who have created great works of art, made important intellectual contributions, performed great sporting feats or shaped the history of a nation if those people have also acted immorally? This book provides a philosophical investigation of this important and timely question. -/- The authors draw on the latest research from ethics, value theory, philosophy of emotion, social philosophy and social psychology to develop and substantiate arguments that have been made in the public (...) debates about this issue. This paper defends the Famine Relief Argument against Having Children, which goes as follows: conceiving and raising a child costs hundreds of thousands of dollars; that money would be far better spent on famine relief; therefore, conceiving and raising children is immoral. It is named after Peter Singer’s Famine Relief Argument because it might be a special case of Singer’s argument and because it exposes the main practical implication of Singer’s argument—namely, that we should not become parents. I answer five (...) objections: that disaster would ensue if nobody had children; that having children cannot be wrong because it is so natural for human beings; that the argument demands too much of us; that my child might be a great benefactor to the world; and that we should raise our children frugally and give them the right values rather than not have them. Previous arguments against procreation have appealed either to a pessimism about human life, or to the environmental impact of overpopulation, or to the fact that we cannot obtain the consent of the non-existent. Malevolence and cruelty are commonly attributed to a failure of moral reasoning or a lack of moral imagination. We present the contrasting viewpoint – immorality as an active, creative, or resourceful act. More specifically, we develop the concept of "immoral imagination" (Jacobs, 1991) and explore how it can enter into Rest's (1986) four processes of decision making: sensitivity, judgment, intention, and implementation. The literature on revenge and workplace deviance illustrates these processes.

Non-naturalist realists are committed to the belief, famously voiced by Parfit, that if there are no non-natural facts then nothing matters. But it is morally objectionable to conditionalise all our moral commitments on the question of whether there are non-natural facts. Non-natural facts are causally inefficacious, and so make no difference to the world of our experience. And to be a realist about such facts is to hold that they are mind-independent. It is compatible with our experiences that there are (...) no non-natural facts, or that they are very different from what we think. As Nagel says, realism makes scepticism intelligible. So the non-naturalist must hold that you might be wrong that your partner matters, even if you are correct about every natural, causal fact about your history and relationship. But to hold that conditional attitude to your partner would be a moral betrayal. So believing non-naturalist realism involves doing something immoral. (shrink)

Is torturing innocent people ever morally required? I rebut responses to the ticking-bomb dilemma by Slote, Williams, Walzer, and others. I argue that torturing is morally required and should be performed when it is the only way to avert disasters. In such situations, torturers act with dirty hands because torture, though required, is vicious. Conversely, refusers act wrongly, yet virtuously, thus displaying admirable immorality. Vicious, morally required acts and virtuous, morally wrong acts are odd, yet necessary to preserve the (...) ticking-bomb dilemma’s phenomenology, the role of habituation in moral development, the virtue/continence distinction, and morality’s overridingness, consistency, and plausibility. Causal judgments are widely known to be sensitive to violations of both prescriptive norms (e.g., immoral events) and statistical norms (e.g., improbable events). There is ongoing discussion as to whether both effects are best explained in a unified way through changes in the relevance of counterfactual possibilities, or whether these two effects arise from unrelated cognitive mechanisms. Recent work has shown that moral norm violations affect causal judgments of agents, but not inanimate artifacts used by those agents. These results have (...) been interpreted as showing that prescriptive norm violations only affect causal reasoning about intentional agents, but not the use of inanimate artifacts, thereby providing evidence that the effect of prescriptive norm violations arises from mechanisms specific to reasoning about intentional agents, and thus casting doubt on a unified counterfactual analysis of causal reasoning. Four experiments explore this recent finding and provide clear support for a unified counterfactual analysis. Experiment 1 demonstrates that these newly observed patterns in causal judgments are closely mirrored by judgments of counterfactual relevance. Experiment 2 shows that the relationship between causal and counterfactual judgments is moderated by causal structure, as uniquely predicted by counterfactual accounts. Experiment 3 directly manipulates the relevance of counterfactual alternatives and finds that causal judgments of intentional agents and inanimate artifacts are similarly affected. Finally, Experiment 4 shows that prescriptive norm violations (in which artifacts malfunction) affect causal judgments of inanimate artifacts in much the same way that prescriptive norm violations (in which agents act immorally) affect causal judgments of intentional agents. That people do wrong would appear to be a moral datum: a moral realm without wrongdoing may not be coherent. Thus, an adequate philosophic theory of morality ought to allow for it. But such a theory ought also to explain wrongdoing, both axiologically and causally. This is so if we take such a theory to have practical significance. Indeed, insofar as moral philosophy and its cognate areas have practical significance, explaining wrongdoing is arguably the most pressing practical issue for theory (...) construction in this domain. For a philosophical theory of morality to have practical significance, and, further, to have influence on behavior, it must be psychologically relevant to the organisms that it ranges over. That is, the concepts that the theory purports to explain must be plausibly realized within the psychology of the creatures for which the theory is intended. Any theory satisfying this constraint would then be in a position to illuminate those psychological features that are explanatory of blameworthy behavior. The argument presented here is that moral realism and its underlying moral psychology, cognitivism, face serious difficulties allowing for and explaining, both metaphysically and psychologically, such behavior. Moral cognitivism and realism fail to adequately account for this most fundamental of moral phenomena. Hence, a comprehensive understanding of moral experience is impossible within the cognitivist/realist perspective. (shrink)

In a recent article, Krauss (2017) raises some fundamental questions concerning (i) what the desiderata of a definition of lying are, and (ii) how definitions of lying can account for partial beliefs. This paper aims to provide an adequate answer to both questions. Regarding (i), it shows that there can be a tension between two desiderata for a definition of lying: 'descriptive accuracy' (meeting intuitions about our ordinary concept of lying), and 'moral import' (meeting intuitions about what is wrong with (...) lying), vindicating the primacy of the former desideratum. Regarding (ii), it shows that Krauss' proposed 'worse-off requirement' meets neither of these desiderata, whereas the 'comparative insincerity condition' (Marsili 2014) can meet both. The conclusion is that lies are assertions that the speaker takes to be more likely to be false than true, and their distinctive blameworthiness is a function of the extent to which they violate a sincerity norm. In the 5th century a number of sophists challenged the orthodox understanding of morality and claimed that practicing injustice was the best and most profitable way for an individual to live. Although a number of responses to sophistic immoralism were made, one argument, in fact coming from a pair of sophists, has not received the attention it deserves. According to the argument I call Immortal Repute, self-interested individuals should reject immorality and cultivate virtue instead, for only a virtuous agent (...) can win the sort everlasting reputation that makes a life truly admirable and successful. In contemporary Western moral philosophy literature that discusses the Chinese ethical tradition, it is a commonplace practice to use the Chinese term daode 道德 as a technical translation of the English term moral. The present study provides some empirical evidence showing a discrepancy between the terms moral and daode. There is a much more pronounced difference between prototypically immoral and prototypically uncultured behaviors in English (USA) than between prototypically bu daode 不道德 and prototypically bu wenming 不文明 behaviors in Mandarin Chinese (...) (Mainland China). If the Western concept of immorality is defined in contraposition to things that are matters of etiquette or conventional norms and thus tied to a more or less tangible moral / conventional distinction, then we are dealing with a different structure in Mandarin Chinese – the prototypically bu daode and bu wenming behaviors seem to largely overlap. We also discuss whether bu lunli 不倫理 and bu hefa 不合法 can be considered adequate candidates for translation of immorality and we answer in the negative. (shrink)

This book explores a much-neglected area of moral philosophy--the typology of immorality.

Using five different child–sacrifice cases, I argue that the relationship between the ethics of care and the ethics of justice is not that one is wholly right while the other is morally wrong or irrelevant, or that one somehow has priority over the other, or that one is supererogatory while the other is required, or that one is a role ethic while the other is a real ethic, or that they are equivalent. Instead, I propose that the ethics of justice (...) and care are simply descriptions of the virtues of justice and care, understood richly and broadly. Each prescribes perceptions, values, self–conceptions, etc. as well as actions and passions in every sphere of human life. Like other actual (rather than idealized) virtues, justice and care sometimes conflict with each other. They demand incompatible actions, passions, perceptions, etc. The available options in conflict situations feel both right and wrong because they are admirably immoral acts and/or dirty hands acts. I argue that these conflicts do not undermine the primacy, practicality or consistency of morality. (shrink)

In this paper, I argue the practice of procreation is immoral regardless of the consequences of human presence such as climate change and overpopulation; the lack of consent, interests and moral desert on the part of nonexistent individuals means someone could potentially suffer in the absence of moral justification. Procreation is only morally justified if there is some method for acquiring informed consent from a non-existent person; but that is impossible; therefore, procreation is immoral.

In this paper, I argue that there exists a class of immoral beliefs. These beliefs are immoral not for the usual reasons, i.e. because of their tendency to cause harm, their immoral acquisition, or the fact that they involve unjustified moral judgments. Rather, the class of beliefs to which I wish to draw attention includes beliefs that do not even have any moral content, but whose non-moral content is still morally significant. These beliefs are immoral because holding them constitutes an (...) immoral condition of the belief-holder. This usually involves a moral failure of the belief-holder. We may object to such beliefs for all of the usual reasons, but I wish to draw attention to their objectionable content based on the kind of character they represent a person as having.1. (shrink)

The position of immoralism in analytic aesthetics and the philosophy of art holds that a work's moral defects can sometimes contribute to its artistic value. This position has suffered massive criticism in recent years. In support of immoralism, I present in this paper a new argument by examining immorality in the artistic genre of transgressive art. I argue that in the category of transgressive art, due to the nature of immorality that is a transgressive and liberating force against (...) morality's authority, being immoral can contribute directly to an artwork's artistic value by contributing to the realization of its artistic aim. With the exception of pornography, the morality of popular forms of entertainment has not been studied extensively by philosophers. The present paper aims to start discussion on the moral status of horror films, whose popularity and success has grown steadily since the 1970s. In particular, the author focuses on so-called “slasher” or “gorefest” films, where the narration revolves around the graphic and realistic depiction of a series of murders. The paper’s main thesis is that it is immoral to produce, distribute, (...) and view films of this kind. The reasons are traced back to two facts: 1) living the moral life requires being disposed to react compassionately to the sight of human victimization, and 2) the most violent horror films either overwhelm the spectator or promote a detachment from violence that may interfere with the development and maintenance of the correct reactive attitudes to human victimization. Moral intensity theory is used to explain how characteristics of moral issues affect ethical decision-making. According to moral intensity theory, individuals and firms will make more ethical decisions when moral intensity is present, such as greater negative consequences, including harm to customers. However, evidence suggests this does not always happen in crisis situations. For example, Fisher Price waited until 30 babies died before recalling its Rock’n Play Sleeper in 2019. In this article, the concept of immoral entrenchment is introduced to (...) address how crises affect the expected firm responses to morally intense ethical issues. Immoral entrenchment suggests that firms experience threat-rigidity responses to crises that lead to collective moral disengagement. Immoral entrenchment results in firms’ denial of responsibility and unethical behavior, instead of ethical behavior, in the face of highly negative consequences. The study in this article tests immoral entrenchment in the context of the speed to recall 843 consumer products. Supplemental qualitative evidence illustrates the collective moral disengagement dimension of immoral entrenchment. Contributing to the literature on ethics and crisis, the findings demonstrate that crises can generate immoral entrenchment in firms, which reverses the expected ethical response of those firms to issues with high moral intensity. This essay discusses Mary Beth Willard's _Why It's OK to Enjoy the Work of Immoral Artists_ and puts it into dialogue with my book _Drawing the Line._ In particular, I focus on the role of aesthetic projects in thinking about artistic immorality, and develop further thoughts on the public/private and individual/social distinctions with respect to our engagement with the arts.

The purpose of this paper is to emphasize a social phenomenon that exists in Israel: immoral medicine.In recent years, nurses have been exposed to many instances of immoral medicine in hospitals. We want to protest about the demands for money from patients who are waiting for surgical intervention, arouse the medical community’s conscience concerning these immoral activities, and improve professional and moral behaviour.

:In a recent paper in Nature1 entitled The Moral Machine Experiment, Edmond Awad, et al. make a number of breathtakingly reckless assumptions, both about the decisionmaking capacities of current so-called “autonomous vehicles” and about the nature of morality and the law. Accepting their bizarre premise that the holy grail is to find out how to obtain cognizance of public morality and then program driverless vehicles accordingly, the following are the four steps to the Moral Machinists argument:1)Find out what “public morality” (...) will prefer to see happen.2)On the basis of this discovery, claim both popular acceptance of the preferences and persuade would-be owners and manufacturers that the vehicles are programmed with the best solutions to any survival dilemmas they might face.3)Citizen agreement thus characterized is then presumed to deliver moral license for the chosen preferences.4)This yields “permission” to program vehicles to spare or condemn those outside the vehicles when their deaths will preserve vehicle and occupants.This paper argues that the Moral Machine Experiment fails dramatically on all four counts. The most popular and convincing arguments for the claim that vegetarianism is morally obligatory focus on the extensive, unnecessary harm done to animals and to the environment by raising animals industrially in confinement conditions (factory farming). I outline the strongest versions of these arguments. I grant that it follows from their central premises that purchasing and consuming factoryfarmed meat is immoral. The arguments fail, however, to establish that strict vegetarianism is obligatory because they falsely assume that eating vegetables is the (...) only alternative to eating factory-farmed meat that avoids the harms of factory farming. I show that these arguments not only fail to establish that strict vegetarianism is morally obligatory, but that the very premises of the arguments imply that eating some (non-factory-farmed) meat rather than only vegetables is morally obligatory. Therefore, if the central premises of these usual arguments are true, then strict vegetarianism is immoral. (shrink)

This paper uses detailed art criticism to ground a distinctive take on debates about the interaction of moral and aesthetic value. Immoralists claim that moral flaws can make artworks aesthetically better than they would otherwise be. I argue that whether or not immoralism is true, immoralists have not provided compelling characterizations of strategies that might constitute this kind of “immoral artistry.” The main exception is found in the work of A. W. Eaton. I critique Eaton’s perspective by way of sustained (...) interpretive-philosophical discussion of The Wire and especially The Sopranos. The discussion has implications for value interaction debates, conceptualizations of the “rough hero” genre, theories of appropriate response to fictions, and more applied debates about the moral criticism of film and television. This paper focuses on an underappreciated issue that dreams raise for moral evaluation: is immorality possible in dreams? The evaluatiotial internalist is committed to answering ‘yes.’ This is because the internalist account of moral evaluation holds that the moral quality of a person's actions, what a person does, her agency in any given case is completely determined by factors that are internal to that agency, such as the person's motives and/or intentions. Actual production of either good or bad effects (...) is completely irrelevant to the moral evaluation of that agency. Since agency can be expressed in a dream, the internalist is committed to dream immorality. Some may take this as a reductio of evaluational internalism, but whether or not this is the case the issue reveals what such a theory is committed to. In this paper I explore the significance of dreams to morality, and argue that the absurdity of dream immorality supports an account of moral evaluation with an externalist component, rather than a purely internalist account of moral evaluation. It is gratifying to me, though perhaps it will be disappointing to you, to discover that Neil Levy and I agree on much of what to say about the morality of punishment. His summary of the contents of The Immorality of Punishment is both generous and, for the most part, accurate, and the concerns that he raises are certainly reasonable. In what follows, I will address what I take to be the most significant of these concerns.IAs Levy notes, in (...) the book I discuss alleged moral justifications of legal punishment that have been proposed both from a retributivist and from a non-retributivist perspective. In my article "Even if the fetus is not a person, abortion is immoral: The impairment argument" (this journal), I defended what I called “The impairment argument” which purports to show that abortion is immoral. Bruce Blackshaw (2019) has argued that my argument fails on three accounts. In this article, I respond to his criticisms.

Since the introduction of the new nursing curriculum in the United Kingdom, nurse edu cation has undergone a series of fundamental changes, including the introduction of stu dent status, closer links (and in many cases full integration) with higher education, and, for the majority of preregistration courses, the award of a higher education diploma. It is this author's opinion that, given the duration, nature and location of such courses, the award of a diploma amounts to a grave injustice and is (...) representative of a situation that is immoral and corrupt. This opinion is presented from the perspective of educational awards as goods or rewards to be distributed fairly, in recognition of the efforts and abil ities of students. (shrink)

Although the definition of a mental disorder has remained essentially the same from Diagnostic and Statistical Manual of Mental Disorder, Third Edition, Revised (DSM-III-R) through DSM-IV to DSM-IV-TR, the account of the paraphilias has changed continually. Although the definition in all the DSMs explicitly rules out deviant sexual behavior as sufficient for labeling someone as having a mental disorder, deviant sexual behavior counts as sufficient for all the paraphilias in DSM-III-R. In DSM-IV, the account of all the paraphilias is made (...) consistent with the definition. In DSM-IV-TR, mere deviant sexual behavior is not sufficient for being classified as having a paraphilia, but immoral deviant sexual behavior is. Thus, in DSM-IV-TR, only those paraphilias that involve immoral deviant sexual behavior are inconsistent with the definition, but deviant sexual behavior by itself does not count as a mental disorder. This paper highlights the relevance of moral authority, and the role that egoistic ethical claims have in waging war. This is done, in view of the just war tradition, by drawing a parallel between the crusades in the 'kingdom of heaven' proclaimed in 1095, and the present Islamic jih d , as well as the Bush administration's declaration of a war on terror. It maintains that the role of self-legitimized leaders is crucial in shaping the order of the jus ad (...) bellum criteria, in both Christian and Muslim societies, and that the indiscriminate usage of just war rhetoric proves to be a formidable weapon. Moral authority is described as a power resource, capable of capsizing the relevance of ethics, subjecting the interpretation of justice to declare war to the self-proclaimed authorities, and moving masses on the grounds of enthusiasm.
