No existing normative decision theory adequately handles risk. Expected Utility Theory is overly restrictive in prohibiting a range of reasonable preferences. And theories designed to accommodate such preferences (for example, Buchak's (2013) Risk‐Weighted Expected Utility Theory) violate the Betweenness axiom, which requires that you are indifferent to randomizing over two options between which you are already indifferent. Betweenness has been overlooked by philosophers, and we argue that it is a compelling normative constraint. Furthermore, neither Expected nor Risk‐Weighted Expected Utility Theory (...)

Law in Context.Stephen Bottomley & Simon Bronitt (eds.) - 2006 - Federation Press.
This fourth edition of Law in Context not only updates the text by reference to the latest thinking and developments in the broad area of 'law in context', but also introduces readers to the wider social, political and regulatory contexts of law.Bottomley and Bronitt, as in previous editions, expose readers to the multitude of contexts (some explicit, others implicit) that affect how law is made, broken and enforced by the state or individual citizens. The fundamental ideals of law - (...)

Critique of Violence: Between Poststructuralism and Critical Theory.Beatrice Hanssen - 2000 - Routledge.
_Critique of Violence_ is a highly original and lucid investigation of the heated controversy between poststructuralism and critical theory. Leading theorist Beatrice Hanssen uses Walter Benjamin's essay 'Critique of Violence' as a guide to analyse the contentious debate, shifting the emphasis from struggle to dialogue between the two parties. Regarding the questions of critique and violence as the major meeting points between both traditions, Hanssen positions herself _between_ the two in an effort to investigate what critical theory and poststructuralism (...)

Shock to Thought: An Encounter (of a Third Kind) with Legal Feminism.Anne Bottomley - 2004 - Feminist Legal Studies 12 (1):29-65.
This paper takes a recently published text and, in examining it closely, argues that it exemplifies trends within feminist scholarship in law, which might be characterised asestablishing a form of orthodoxy. The paper explores some of the ways in which thiso rthodoxy is constructed and presented, and argues that it is characterised by a commitment both to `grand theory' and Hegelian dialectics. The adoption of this model of work seems to offer a chance to hold together the triangular figure of (...)

    Law, Diagram, Film: Critique Exhausted.Anne Bottomley & Nathan Moore - 2012 - Law and Critique 23 (2):163-182.
What potential can be found in the work of Deleuze and Guattari for critical legal scholarship? The authors argue that their work can be deployed to re-think ‘critique’ by directly addressing the place and role of the ‘critic’. It is argued that the continued commitment to a stance of ‘resistance’ in CLS is underpinned by never-ending dualisms which, if not confronted and replaced, can only make CLS ever more redundant. The authors ask: ‘what is critique beyond the dualism of power (...)

Landscape as a Topology of Being and Appearance.Beatrice Nunold - 2008 - Proceedings of the Xxii World Congress of Philosophy 1:191-226.
Our reality constitutes itself as being one of pictures. Landscape is a product of aesthetic reflection as well as the perception of reality and virtual reality of the first order (VR 1). Pictorial representation of a landscape is virtual reality of the second order (VR 2). A picture is a structure of relations with a specific topology or an interrelationship. A picture is set in relation. Topology relates to relational similarities and differences as well as their transfer into other interrelationships, (...)

Visual Statistical Learning With Stimuli Presented Sequentially Across Space and Time in Deaf and Hearing Adults.Beatrice Giustolisi & Karen Emmorey - 2018 - Cognitive Science 42 (8):3177-3190.
This study investigated visual statistical learning (VSL) in 24 deaf signers and 24 hearing non‐signers. Previous research with hearing individuals suggests that SL mechanisms support literacy. Our first goal was to assess whether VSL was associated with reading ability in deaf individuals, and whether this relation was sustained by a link between VSL and sign language skill. Our second goal was to test the Auditory Scaffolding Hypothesis, which makes the prediction that deaf people should be impaired in sequential processing tasks. (...)

Up to the present, there have not been any specific norms regarding medically assisted human reproduction in Romanian legislation. Due to this situation the general legislation regarding medical assistance, the Penal and Civil law and the provisions of the Code of Deontology of the Romanian College of Physicians are applied to the field of medically assisted human reproduction. By analysing the ethical and legal conflicts regarding medically assisted human reproduction in Romania, some characteristics cannot be set apart because they derive (...)

Achieving a Better Life On the Planet. Are We Our 'Brothers' Keepers'?Beatrice Sofaer - 1994 - Nursing Ethics 1 (3):173-177.
All living human beings have the moral right not to be denied reasonable help in life threatening situations. Disasters take on many forms, but their consequences for individuals may be prolonged and stretch into the next generation. We have a moral obligation to create a better life for people by speaking out and trying to prevent man-made disasters and their consequences. To do this the commitment to life and its value must be reinforced. A number of suggestions are made, particularly (...)

Or, la dématérialisation du contexte propre à ces environnements complexifie de manière exponentielle sa compréhension, multipliant les risques de malentendus, de décalages, d’incompréhension. 28. Kant on the Human Standpoint.Béatrice Longuenesse - 2005 - New York: Cambridge University Press.
In this collection of essays Béatrice Longuenesse considers the three aspects of Kant's philosophy, his epistemology and metaphysics of nature, his moral philosophy and his aesthetic theory, under one unifying standpoint: Kant's conception of our capacity to form judgements. She argues that the elements which make up our cognitive access to the world - what Kant calls the 'human point of view' - have an equally important role to play in our moral evaluations and our aesthetic judgements. Her discussion ranges (...)

Sexuality in Folktales: Asset or Liability to Socialisation of Learners in Zimbabwean schools.Beatrice Taringa - 2023 - HTS Theological Studies 79 (3):7.
The portrayal of sexuality in folktale course-books that are prescribed for secondary school learners in Zimbabwe is indeed a cause for concern. Not much attention, if any, has been given to exploring the portrayal of ‘sexuality’ especially in ChiShona prescribed course-books. This article qualitatively explored through content and discourse analysis the portrayal of ‘sexuality’ in folktales prescribed course-books based on an Afrocentric perspective of Unhu and Ubuntu. The study sought to determine whether course-books are an asset or a liability for (...)

Aristotle explicitly speaks of intelligible matter in three passages only, all from the Metaphysics, in the context of the analysis of definition as the formula that expresses the essence: Metaph. Z10, 1036 a8-11; Metaph.Z11, 1037 a5; Metaph.H6, 1045 a34-36 and 45 b1. In the case of the occurrences of Z10 and Z11, there is almost unanimous consensus that Aristotle uses the expression in a technical way, to indicate the matter of that particular type of objects that are intelligible compounds, of (...)

Self-Sacrificial Leadership and Employee Behaviours: An Examination of the Role of Organizational Social Capital.Ahmed Mohammed Sayed Mostafa & Paul A. Bottomley - 2018 - Journal of Business Ethics 161 (3):641-652.
Drawing on social exchange theory, this study examines a mechanism, namely organizational social capital, through which self-sacrificial leadership is related to two types of employee behaviours: organizational citizenship behaviours and counterproductive behaviours. The results of two different studies in Egypt showed that self-sacrificial leadership is positively related to OSC which, in turn, is positively related to OCBs and negatively related to CPBs. Overall, the findings suggest that self-sacrificial leaders are more likely to achieve desirable employee behaviours through improving the quality (...)

Medical science is advancing all the time. Researchers are constantly trying to find new ways to help people to have long and healthy lives. Thanks to their work, doctors today can cure diseases, lessen pain, replace unhealthy limbs or organs, and help infertile couples have children. Doctors can even keep seriously ill people alive against all odds. But not everyone is enamored with advances in medicine. They question whether it is appropriate to prolong life in all cases, or believe that (...)

The article reconstructs three key concepts of Hans Vaihinger: the idea of mental fictions as self-contradictory, provisory, conscious, and purposeful; the law of the devolution of ideas stating that an idea oscillates between dogma, hypothesis, or fiction; and the underlying assumption about human consciousness that the psyche constructs thoughts around perceptions like an oyster produces a pearl. In a second, constructive part, these concepts are applied in a discussion of John Searle’s social ontologically extended theory of speech acts. The article (...)
