In eighteenth-century French natural history, the notion of preformation was not only a model for a small preexisting embryo that gradually extended its shape through the influx of particles, but also for an order that coordinated the dynamic relation between organic parts. Preformation depended therefore also on a hidden order behind the continuity of visible forms. Louis Bourguet, Charles Bonnet, and Georges Cuvier distinguished three organizational levels: First, the synchronic or functional order of organic systems; second, the diachronic order of (...) the initiation of mechanical processes; and third, the hierarchical order that regulates the interaction of organic parts. In this essay, I reconstruct and compare the three organizational levels in the writings of Bourguet, Bonnet and Cuvier, relate their models of organic unity to the principle of perfection, and contrast these models with Georges Buffon's critique of system theories. In a long-term transformation, that begins in Antiquity but takes a crucial turn in the Renaissance anatomies, the “fibre” becomes from around 1750 the operative building block and at the same time the first unifying principle of function-structure-complexes of organic bodies. It occupies the role that the cell takes up in the cell œconomies of the second third of the nineteenth century. In this paper, I will first discuss some key notions, technical analogies, and images that are related to “fibre”-concepts (...) from Andreas Vesalius to Albrecht von Haller and then focus on Charles Bonnet's and Denis Diderot's fibre œconomies. In Bonnet's and Diderot's fibre œconomies, the self-active, regulating properties of fibre-agents and their material structures, that reach from fibre bundles, tissues and membranes to apparati of organs, are united within the concrete whole of individual organized “systems” or “networks.”. This essay focuses on the structure of agency in Georg Ernst Stahl's model of organic order and the role that it plays for the difference between living and non-living beings in the discourses of medicine and natural history around 1700. Stahl calls the order of organic beings an "organism". He characterizes the "organism" through the notions of tonic movement, energy and ratio. The tonic movement is a mechanism of contraction and relaxation of organic units to direct fluids to certain parts (...) of the body; the energy represents a certain, limited potential of the living body to act spontaneously and to react if it is irritated; and the ratio expresses the logic of a processual, directed order imposed on corporeal dispositions. This ratio inheres in natural agents. However, to establish his theory of agency, Stahl first analyzes the irregular blood movements that characterize diseases. The capacity of the organic body to change these movements and to heal itself in redirecting them, leads him to the assumption that such bodies can regulate their own order and that self-regulation requires an autonomous agent. In diesem Artikel geht es um die historische und konzeptuelle Entwicklung von Charles Bonnets (1720-1793) allgemeiner Systemtheorie organismischer Ordnung. Hierfür wird der Kontext von Bonnets Ansatz in Naturgeschichte und Philosophie rekonstruiert. Leitfaden zur Analyse von Bonnets Systemtheorie bildet das Problem der doppelten Verortung des Organischen: Zum einen unterscheiden sich organisierte Körper durch ihre Ordnungsform von allen nicht organisierten Körpern, und zum anderen reihen sie sich zusammen mit den nicht-organisierten Körpern in eine Stufenleiter der Wesen ein, die von den Elementen bis (...) zum Menschen reicht und Mineralien, Pflanzen und Tiere umfasst. Anhand dieser Problemstellung wird eine Interpretationsebene entwickelt, die es erlaubt, Bonnets Ansatz einer bestimmten Transformation zwischen klassischer Metaphysik und Naturgeschichte zuzuordnen. The article focuses on the historical and conceptual development of Charles Bonnet's (1720-1793) general system theory of organismic order. The context of Bonnet's work will be reconstructed in natural history and philosophy. The problem of the double position of organic bodies is central for the understanding of Bonnet's theory: On the one hand, organized bodies are different from all non-organized bodies, and on the other hand, organized and non-organized beings form a single scale of beings that reaches from the elements to minerals, plants, animals and humans. ArgumentIn this essay, I sketch a problem-based framework within which I locate the concept of “organism” in the system theories of Georg Ernst Stahl, Théophile Bordeu, and Paul-Joseph Barthez. Around 1700, Stahl coins the word “organism” for a certain concept of order. For him, the concept explains the form of order of living bodies that is categorically different from the order of other bodies or composites. At the end of the century, the “organism” as a specific form of order becomes (...) a major topos in many discourses. I will not so much focus on experiments and objects as on basic problems that contribute to the general framework of the concept of organism as a key concept of the vitalist movement between 1700 and 1800. For this purpose, I will investigate the combination of three explanatory tools. These tools refer to regulating agents, functional interactions, and stimulus-reactions-schemes within individual organic systems of forces. They are related to various themes – especially to energy, sensibility, and sympathy. I will retrace some aspects of these relations. (shrink)

In Expériences sur le principe de la vie (Chez D’Hautel, Paris, 1812), Jean César Legallois, a French physician and physiologist, explored the basic regulatory framework of vital processes of warm-blooded animals. He decapitated rabbits and cut off their limbs in order to search for a seat of life that is located in the spinal cord. Through ligatures and artificial pulmonary insufflations, he kept the trunks of rabbits alive for some minutes. Legallois thus criticized models of organic order in which the (...) spinal cord only mediates, like a gross nerve, between the brain and the body. He identified a certain section of the spinal cord that influences respiratory acts, and he also established a connection between the spinal cord and the movement of the heart. Further on, Legallois envisioned experiments that would extend the life-time of headless trunks through the infusion of arterial blood. (shrink)

In his paper ‘Ethical problems with kindness in healthcare’, Jesudason sets out an interesting examination of the concept of kindness, arguing that it poses significant ethical challenges due to its discretionary nature. I suggest that kindness, a concept difficult to define, may still have a role to play in healthcare. Different treatments of kindness show us that it need not be discretionary, and that kind care can be provided to all. Finally, curiosity may also have a role to play in (...) medicine to help promote inclusiveness. (shrink)

This essay first discusses the three major arguments in favor of euthanasia and physician-assisted-suicide in contemporary Western society, viz ., the arguments of mercy, preventing indignity, and individual autonomy. It then articulates both Confucian consonance and dissonance to them. The first two arguments make use of Confucian discussions on suicide whereas the last argument appeals to Confucian social-political thought. It concludes that from the Confucian moral perspectives, none of the three arguments is fully convincing.

The article introduces and defends the Nomological Account of ground, a reductive account of the notion of metaphysical explanation in terms of the laws of metaphysics. The paper presents three desiderata that a theory of ground should meet: it should explain the modal force of ground, the generality of ground, and the interplay between ground and certain mereological notions. The bulk of the paper develops the Nomological Account and argues that it meets the three desiderata. The Nomological Account relies on (...) two central notions: the notion of a ‘law of metaphysics’ and the notion of ‘determination via the laws’. The paper offers the constructional conception of the laws of metaphysics, on which the metaphysical laws are general principles that characterize construction–operations such as composition, constitution, or set-formation. The role of determination in the account is explained and some reductive approaches to the notion are sketched. The case for the Nomological Account presented in this article is also a case for the laws of metaphysics. Since the Nomological Account offers a promising approach to metaphysical explanation we should take the laws of metaphysics seriously. (shrink)

The present study takes Confucian entrepreneurs as an entry point to portray the dynamics and problems involved in the process of putting moral precepts into practice, a central issue in business ethics. Confucian entrepreneurs are defined as the owners of manufacturing or business firms who harbor the moral values of Confucianism. Other than a brief account of their historical background, 41 subjects from various parts of Mainland China, Taiwan, Hong Kong, Singapore and Kuala Lumpur were selected for in-depth interviews. By (...) studying the moral choices they made in the market, it was discovered that, contrary to the prevalent mode of inquiry in economics either to reduce all social phenomena to rational calculations or to consider moral actions in terms of utilitarian values, their economic action cannot be accounted for by the postulate of utility maximization, and that the efforts to do business according to their moral principles can be very costly. The study also attempts to document how these Confucian entrepreneurs reconciled the conflict between the moral values they cherished and the instrumental goals they pursued, and will seek to uncover how they responded when faced with this dilemma. The paper explores a deductive-nomological account of metaphysical explanation: some truths metaphysically explain, or ground, another truth just in case the laws of metaphysics determine the latter truth on the basis of the former. I develop and motivate a specific conception of metaphysical laws, on which they are general rules that regulate the existence and features of derivative entities. I propose an analysis of the notion of ‘determination via the laws’, based on a restricted form of logical entailment. I argue (...) that the DN-account of ground can be defended against the well-known objections to the DN-approach to scientific explanation. The goal of the paper is to show that the DN-account of metaphysical explanation is a well-motivated and defensible theory. (shrink)

This study examines the degrees of corporate disclosure and transparency of publicly listed companies in two emerging markets and analyzes corporatedisclosure practices as a function of specific firm characteristics. The analysis uses the disclosure and transparency scores extracted from a survey instrument designed to rate disclosure practices of publicly listed companies by using the OECD Corporate Governance Principles as an implicit benchmark. Empirical results show that financial characteristics explain some of the variation in the degrees of corporate disclosure for firms (...) in Hong Kong but not for firms in Thailand. Further, corporate governance characteristics, such as board size and board composition, show more significant associations with the degrees of corporate disclosure inThailand than in Hong Kong. The results are broadly consistent with the notion that good corporate governance leads to better corporate disclosure and transparency in less developed markets. (shrink)

This paper analyzes the impacts of index inclusions and exclusions on corporate sustainable firms by studying a sample of US stocks that are added to or deleted from the Dow Jones Sustainability World Index over the period 2002-2008. The impacts are measured in terms of stock return, risk and liquidity. We cannot find any strong evidence that announcement per se has any significant impact on stock return and risk. However, on the day of change, index inclusion (exclusion) stocks experience a (...) significant but temporary increase (decrease) in stock return. Liquidity deteriorates after the announcement day and bounces back significantly near the day of change. Systematic risk shows little change after announcements. But, idiosyncratic risk is higher after announcements. The overall results support Harris and Eitan's (The Journal of Finance 41(4), 815-829, 1986) price pressure hypothesis, which posits that event announcement does not carry information and any shift in demand (and hence the corresponding price change and liquidity change) is temporary. Obtaining informed consent from patients is a moral and legal duty and, thus, a key legitimation for medical treatment. The pivotal prerequisite for valid informed consent is decision-making capacity of the patient. Related to the question of whether and when consent should be morally and legally valid, there has been a long-lasting philosophical debate about freedom of will and the connection of freedom and responsibility. The scholarly discussion on decision-making capacity and its clinical evaluation does not sufficiently take into account (...) this fundamental debate. It is contended that the notion of free will must be reflected when evaluating decision-making capacity. Namely, it should be included as a part of the appreciation-criterion for decision-making capacity. The argumentation is mainly drawn on the compatibilism of Harry Frankfurt. A solution is proposed which at the same time takes the notion of free will seriously and enriches the traditional understanding of decision-making capacity, strengthening its justificatory force while remaining clinically applicable. It is often claimed that the social sciences cannot be reduced to a lower-level individualistic science. The standard argument for this position is the Fodorian multiple realizability argument. Its defenders endorse token–token identities between “higher-level” social objects and pluralities/sums of “lower-level” individuals, but they maintain that the properties expressed by social science predicates are often multiply realizable, entailing that type–type identities between social and individualistic properties are ruled out. In this paper I argue that the multiple realizability argument for explanatory (...) holism is unsound. The social sciences are indeed irreducible, but the principled reason for this is that the required token–token identifications cannot in general be carried through. In consequence, paradigmatic social science predicates cannot be taken to apply to the objects quantified over in the lower-level sciences. The result is that typical social science predicates cannot even be held to be co-extensive with individualistic predicates, which means type–type identifications are ruled out too. Multiple realizability has nothing to do with this failure of co-extensiveness, because the relevant social science predicates are not multiply realized in the sense intended by the explanatory holists, a sense which presupposes reductive token–token identifications. In the Transcendental Aesthetic of the Critique of Pure Reason, Immanuel Kant famously claims that we have an a priori intuition of space as an ‘infinite given magnitude’. Later on, in the Transcendental Analytic, he seems to add that the intuition of space presupposes a synthetic activity of the transcendental imagination. Several authors have recently pointed out that these two claims taken together give rise to two problems. First, it is unclear how the transcendental imagination of a finite mind could (...) ever result in the intuition of an entity that is infinitely large. Second, Kant claims that our intuition of space has a ‘whole-prior-to-its-parts’ structure, such that its parts are given only as limitations of the whole, while synthesis is compositional and has a ‘parts-prior-to-their-whole’ structure, because it consists in first running through and then taking together the parts of a sensible manifold. I will solve these two problems by showing that Kant thought that synthesis does not always have a compositional structure but that there is also a form of ‘decomposing’ synthesis, which has a whole-prior-to-its-parts structure. Building on similarities between Kant, Edmund Husserl and G. W. F. Hegel, I will argue that infinite space is given to us in intuition by precisely such an activity of decomposition, one that allows us to differentiate between finite spatial objects and the unlimited phenomenal horizon in which they appear. In their influential paper “The extended mind”, Andy Clark and David Chalmers argue for the possibility of the extended mind. Based on Clark and Chalmers’s views, Stephen Hetherington argues in his paper “The extended knower” that there are extended knowers, provided epistemic externalism holds. He also uses the argument and its conclusion to criticize Baron Reed’s scepticism in the paper “The long road to skepticism” : 236–262, 2007). In this chapter, I argue that both Hetherington’s notion of the extended knower (...) and his argument are problematic. This is because the conceptual intelligibility of his notion of the extended knower entails the highly counterintuitive consequence that, in some cases, some negative entities would have to be constitutive of the extended knower. I also show that Hetherington’s criticism of Reed’s scepticism is not successful, and that there is no reason to believe that Clark and Chalmers would hold that there is the extended knower in Hetherington’s sense.
