This paper argues for an intrinsic connection between Logic-Based Therapy (LBT) and empirical psychology, a connection that suggests the need to employ both philo­sophical and psychological theories in the clinical setting. This link is established by arguing that LBT is conceptually grounded in naturalized epistemology, the view introduced and defended by W. V. O. Quine in the aftermath of his attack on the Analytic-Synthetic dis­tinction. Naturalized epistemology places empirical psychology and logic on the same epis­temic foundation, and, it is argued, (...) it is this foundation that both supports the application of logic in the clinical setting and connects logic to empirical psychology. One consequence of this view is that LBT should be understood as providing a theoretical framework for other forms of philosophical counseling, an idea that establishes the logic-based approach to therapy as the sine qua non of the counseling enterprise. These comments on Cohen’s paper (IJPP, this issue) focus on the question of whether Cohen’s attempt to derive antidotes from incompatible or contradictory philosophical camps— such as Hume’s subjective theory of beauty, on the one hand, and Augustine’s objectivist account—present a fatal problem for Cohen’s LBT. The paper concludes with suggesting a constructive way around the problem.

Pragmatic Tactics in Mediation Mediation is the process by which a neutral third-party works with disputing parties to assist them in reaching an acceptable, voluntary settlement of their dispute. Mediators are often faced with competing demands over and above those of the dispute itself. For example, establishing and maintaining control of the mediation process without appearing to bully the disputants, persuading a party to reexamine it's position without appearing to lose their neutrality, and convincing a party that the present offer (...) of settlement is the best possible, given the circumstances, without appearing to be determined to reach closure at all costs.The present paper examines data from labor, divorce, and community mediations to show how mediators reduce tensions like those mentioned above through various devices such as establishing common ground, reframing the issue, use of metaphorical examples, and reliance on innuendo, ambiguity, and equivocation. In “Women, Welfare and the Politics of Need Interpretation,” Nancy Fraser pursues a “meaning-oriented” inquiry intended to illuminate the gender bias of the American welfare system in order to aid feminists and their allies in the continuing political struggles over the welfare system. For Fraser the fundamental issues are over judgments about what women need—“need interpretation.” I argue that although her analysis of the system is vivid and provocative, it is inadequate as a contribution either to political theory (...) or practical strategy. Fraser substitutes a search for patterns and meanings for careful clarification and defense of political values. She leaves needs without foundation and does not explore the capacities for change in modem liberal states. The meanings she reveals provide us neither with a sound basis for judgments on political values nor with a strategy for improvement. (shrink)

This article is based on a performance piece, Thought Conductor # 2, by the artist Bruce Gilchrist. In a live-art context, the signals generated by an individual hooked up to an EEG are converted into passages of musical notation and played by a string quartet. What is happening here, or rather what kind of happening is taking place, is the focus of this article. The article explores the relations between the author, the score, and the sound in Thought Conductor (...) # 2 as well in John Cage’s 4’33”, the landmark work that inspired the Thought Conductor pieces, and which has been described as one of the first happenings in America. These key elements offer clues to the different kinds of ‘presences’ that the performances embody, and the different notions of ‘life’ to which they refer. The sound of TC2 is the sound of an event. Continuing his quest to bring American philosophy back to its roots, Bruce Wilshire connects the work of such thinkers as Thoreau, Emerson, Dewey, and James with Native American beliefs and practices. His search is not for exact parallels, but rather for fundamental affinities between the equally "organismic" thought systems of indigenous peoples and classic American philosophers. Wilshire gives particular emphasis to the affinities between Black Elk’s view of the hoop of the world and Emerson’s notion of horizon, and also (...) between a shaman’s healing practices and James’s ideas of pure experience, willingness to believe, and a pluralistic universe. As these connections come into focus, the book shows how European phenomenology was inspired and influenced by the classic American philosophers, whose own work reveals the inspiration and influence of indigenous thought. Wilshire’s book also reveals how artificial are the walls that separate the sciences and the humanities in academia, and that separate Continental from Anglo-American thought within the single discipline of philosophy. In lieu of an abstract, here is a brief excerpt of the content:Kenneth Burke, John Dewey, and the Pursuit of the PublicPaul StobIn Deliberation Day, Bruce Ackerman and James Fishkin argue for the creation of a national holiday, "Deliberation Day," in which citizens come together over a two-day period in their local schools and community centers to deliberate over the merits of presidential candidates and their platforms (Ackerman and Fishkin 2004). While Ackerman and Fishkin propose that the government pay (...) each citizen a $150 stipend for voluntary participation, the purpose is not so much to monetarily to reward citizens for "showing up" as it is to foster an enriched civic culture that would send shockwaves through America's political infrastructure: "If Deliberation Day succeeded, everything else would change: the candidates, the media, the activists, the interest groups, the spin doctors, the advertisers, the pollsters, the fund raisers, the lobbyists, the political parties. All would have no choice but to adapt to a more attentive and informed public" (3). The task of Deliberation Day would be to create a new social context in which citizens could become enlightened through public participation. As the authors conclude the book, "We can, through an act of political imagination, create new institutions for redeeming the ancient promise of democratic citizenship. Ordinary men and women need not be the hapless playthings of the powerful. They can and must find new ways to hold their leaders to account, and redeem their dignity as human beings by responsibly shaping their collective destiny" (219).Ackerman and Fishkin's proposal is indeed filled with political imagination. I bring their proposal to light not to critique the possibilities and limitations of Deliberation Day, but to understand the way in which the authors understand "the public." At the bottom, what the polity needs, Ackerman and Fishkin believe, is a public space dedicated to the reinvigoration [End Page 226] of political culture. It is not that the citizenry is incapable of hammering out intelligent political solutions, but that it needs access to social contexts that facilitate deliberation and the emergence of a common good. To foster a culture of political intelligence, the public needs only the chance to enter the forums that will facilitate thorough, cooperative political decision-making.Ackerman and Fishkin are not alone in calling for access to or creation of these types of forums. Habermas's bourgeois public sphere—a public space in which citizens could come together and rationally debate the activities of the state—essentially represents the evolution of a context, a social space, a public arena (Habermas 1989). The bourgeois public sphere is meant to be egalitarian, providing citizens a forum in which to debate openly and foster a common political consciousness.1 But this sphere has proved problematic for a number of scholars. Oskar Negt and Alexander Kluge (1993), for example, propose a proletarian public sphere to counter capitalism's socioeconomic domination over public resources. Joan Landes (1988) argues that the bourgeois public sphere entails male domination in public life, to the exclusion of women. Nancy Fraser (1992) builds on the feminist critique by adopting the term "counterpublics," collectives of citizens—women, peasants, the working class, and other groups demarcated by issues of race, gender, and ethnicity—that arise in reaction to the dominant public sphere.2In the introduction to Counterpublics and the State (2001), Robert Asen and Daniel Brouwer argue that critiques of the bourgeois public sphere specifically and public sphere theory generally amount to three "reconfigurations" in the way in which scholars think of the public. First, scholars have come to recognize the existence and interaction of multiple public spheres. Second, they have come to acknowledge permeable boundaries of access to the multiple public spheres. Third, scholars have come to recognize the dynamic role of the state in shaping public discourse. One considerable result of these three reconfigurations is an increasing recognition of the political divisions that permeate society (Asen and Brouwer 2001, 17-25).If Asen and Brouwer are right, and I think they are, these three reconfigurations represent the general thrust of contemporary public sphere scholarship, including as it is understood among communication scholars.3 And however diverse such scholarship may be, a few common themes seem to recur across... In two recent papers, Christian List and Philip Pettit have argued that there is a problem in the aggregation of reasoned judgements that is akin to the aggregation of the preference problem in social choice theory. 1 Indeed, List and Pettit prove a new general impossibility theorem for the aggregation of judgements, and provide a propositional interpretation of the social choice problem that suggests it is a special case of their impossibility result. 2 Specifically, they show that no judgement aggregation (...) function for a group is possible if the group seeks to satisfy certain `minimal conditions' designed to ensure that the function is both responsive to the individually rational views of its members and collectively rational in the set of judgements it holds. In this article, I resist the List and Pettit claim that there is the same propensity for collective irrationality or incoherence in the aggregation of reasoned judgements as there is in the aggregation of preference. I argue that reason, because it has a logical structure that is lacking in mere preference, has the effect of giving priority to some aggregations over others, a priority that is not permitted by one of the conditions imposed by List and Pettit. This avoids the incoherence that would otherwise exist if these different aggregations, not consistent with one another, were to compete at the same level of priority. The priority of some aggregations is particularly apparent, I shall argue, if one views the aggregation of judgements through the lens of common law decision-making. Philosophers writing on the subject of human action have found it tempting to introduce their subject by raising Wittgenstein's question, 'What is left over if you subtract the fact that my arm goes up from the fact that I raise my arm?' The presumption is that something of particular interest is involved in an action of raising an arm that is not present in a mere bodily movement, and the philosopher's task is to specify just what this is. Unfortunately, such (...) an approach does not take us very far, since a person could properly be said to raise his (or her) arm while asleep or hypnotized even though he (or she) would not be performing an action in the sense of 'action' with which philosophers are particularly concerned. To avoid this kind of difficulty I shall approach the subject of human action is a more academic way: I shall expound some important rival theories of human action, and introduce the relevant issues by commenting critically on those theories. One of the issues I eventually introduce is a metaphysical one. A theory of action makes sense, I contend, only on the assumption that there are such 'things' as actions (or events). After considering some key arguments bearing on the issue I conclude that, as matters currently stand in philosophy, a metaphysically noncommittal attitude toward actions and events seems justified. George Berkeley (1685-1753) is the superstar of Irish Philosophy. He entered Trinity College, Dublin, in 1700 and became a fellow in 1707. In 1724 he resigned his Fellowship to become Dean of Derry, and in 1734 he was made Bishop of Cloyne. He settled in Oxford in 1752 and died the following year. The work of George Berkeley is marked by its diversity and range. His writings take in such topics as mathematics, psychology, politics, health, economics, deism and education, as (...) well as that with which he is most associated - philosophy. Whatever topic he dealt with, his grasp of the subject matter was always impressive and his criticisms of his contemporaries often acute. Among the most noteable of the British Empiricists, he took his starting point from Locke's new 'way of ideas', but he rejected abstract ideas and the possibility of real existence outside perception. It is for this doctrine that he is most known - that there is no such thing as matter, and that things are collections of ideas which can exist only in our minds and only for so long as they are perceived. This philosophy, summed up in his phrase 'to be is to be perceived', he termed 'immaterialism'. A.C. Fraser's collection includes a series of what were previously unpublished notes by Berkeley on all the main topics of his philosophy. Many philosophers believe that the traditional problem of our knowledge of the external world was dissolved by Wittgestein and others. They argue that it was not really a problem - just a linguistic `confusion' that did not actually require a solution. Bruce Aune argues that they are wrong. He casts doubt on the generally accepted reasons for putting the problem aside and proposes an entirely new approach. By considering the history of the problem from Descartes to Kant, Aune shows (...) that analogous arguments create difficulties for the contemporary philosophical consensus. He makes it clear that the problem remains acute, particualarly for our understanding of scientific evidence. Summary During the past decade, the cultural restorationist wing of the New Right has sought to impose its own anachronistic and sentimental conception of ?British culture? on schools and colleges. This conception, which is little more than a glib celebration of quintessential ?Englishness?, characterises the national culture in largely monolithic and ethnically undifferen?tiated terms. Concerned about the possible pernicious effects of educational policies inspired by such thinking, we present the findings of a recently completed ethnographic study of 8?11 year?olds? conceptions (...) of British national culture. Our paper considers the extent to which children's understanding of this complex form of collective identity may vary with age, and ethnicity. We conclude by exploring the implications of the findings for anti?racist and multicultural education. (shrink)

The body of the law is an ambiguous phrase. Conventionally, it designates the law as a determinate corpus; legal codes, statutes, and the rulings of common law. But it can also refer to the subjected body that is produced by and is part of the law. This subjected body is necessary for the law's existence. Thinking Through the Body of the Law reconceives the role of the body in the founding, maintaining, and regulation of our legal systems and social order (...) and elaborates on its implications for issues of legal responsibility and justice. Taking into account and sometimes challenging the tenets of critical legal theory, critical race theory, and feminist jurisprudence, these essays examine the body and the law as they relate to surrogacy, the Holocaust, land-rights for Aboriginals, murder, the media and insanity, taxation, genetic engineering, and sexy dressing and sexual harassment.
