With the growth of precision medicine research on health data and biospecimens, research institutions will need to build and maintain long-term, trusting relationships with patient-participants. While trust is important for all research relationships, the longitudinal nature of precision medicine research raises particular challenges for facilitating trust when the specifics of future studies are unknown. Based on focus groups with racially and ethnically diverse patients, we describe several factors that influence patient trust and potential institutional approaches to building trustworthiness. Drawing on (...) these findings, we suggest several considerations for research institutions seeking to cultivate long-term, trusting relationships with patients: Address the role of history and experience on trust, engage concerns about potential group harm, address cultural values and communication barriers, and integrate patient values and expectations into oversight and governance structures. After decades of single issue movements and identity politics on the U.S. left, the series of large demonstrations beginning in 1999 in Seattle have led many to wonder if activist politics can now come together around a common theme of global justice. This book pursues the prospects for progressive political movements in the 21st century with case studies of ten representative movements, including the anti-globalization forces, environmental interest groups, and new takes on the peace movement.

Background: Clinical genomic implementation studies pose challenges for informed consent. Consent forms often include complex language and concepts, which can be a barrier to diverse enrollment, and these studies often blur traditional research-clinical boundaries. There is a move toward self-directed, web-based research enrollment, but more evidence is needed about how these enrollment approaches work in practice. In this study, we developed and evaluated a literacy-focused, web-based consent approach to support enrollment of diverse participants in an ongoing clinical genomic implementation study. (...) Methods: As part of the Cancer Health Assessments Reaching Many (CHARM) study, we developed a web-based consent approach that featured plain language, multimedia, and separate descriptions of clinical care and research activities. CHARM offered clinical exome sequencing to individuals at high risk of hereditary cancer. We interviewed CHARM participants about their reactions to the consent approach. We audio recorded, transcribed, and coded interviews using a deductively and inductively derived codebook. We reviewed coded excerpts as a team to identify overarching themes. Results: We conducted 32 interviews, including 12 (38%) in Spanish. Most (69%) enrolled without assistance from study staff, usually on a mobile phone. Those who completed enrollment in one day spent an average of 12 minutes on the consent portion. Interviewees found the information simple to read but comprehensive, were neutral to positive about the multimedia support, and identified increased access to testing in the study as the key difference from clinical care. Conclusions: This study showed that interviewees found our literacy-focused, web-based consent approach acceptable; did not distinguish the consent materials from other online study processes; and valued getting access to testing in the study. Overall, conducting empirical bioethics research in an ongoing clinical trial was useful to demonstrate the acceptability of our novel consent approach but posed practical challenges. (shrink)

In Recognizing Wrongs, John C. P. Goldberg and Benjamin C. Zipursky develop and defend “civil recourse theory,” according to which torts are injurious wrongs that give rise to a claim of redress. My discussion extends beyond tort law to explore the ethics of reparations for historical injustice, in particular, regarding the case of Black Americans. I begin by relating the notion of wrongdoing that figures prominently in civil recourse theory to morality. Then I explore the idea that the relevant (...) sort of wrongdoing is relational and injurious, and how this claim applies to historical injustice. Finally, I take up the idea that a redress claim is one a victim is entitled but not obligated to make in order to think about whether the discretionary nature of tort action is empowering to persons who have been wrongfully injured. With gratitude for our commentators’ thoughtful and generous engagement with Recognizing Wrongs, we offer in this reply a thumbnail summary of their comments and responses to some of their most important questions and criticisms. In the spirit of friendly amendment, Tom Dougherty and Johann Frick suggest that a more satisfactory version of our theory would cast tort actions as a means of enforcing wrongdoers’ moral duties of repair. We provide both legal and moral reasons for declining their invitation. Rebecca Stone (...) draws a particular link between civil recourse in private law theory and the right of self-defense as recognized in criminal law and moral theory. While we share Stone’s basic inclination, we argue for a different version of the link than the one that she draws. Veronica Rodriguez-Blanco provides a critique of our model of negligence law based on action theory. In response, we explain – in a way that we hope sheds light on debates over moral luck – how it is possible for the law to define negligence such that its commission depends simultaneously on the character of the defendant’s conduct and on the consequences that result from it. Though generally sympathetic to our approach, Stephen Smith faults us for failing satisfactorily to explain important remedial dimensions of tort law. Stubbornly, we insist that we can account for these, and indeed can do so on more satisfactory terms than corrective justice theorists. Finally, Erin Kelly challenges us to consider how our work might inform the analysis of two pressing issues of racial justice: overcriminalization and reparation payments. While we question whether our work to date has as much to offer on these matters as she suggests, we also maintain that the core principle of civil recourse theory – where there is a right there is a remedy – provides grounds for critiquing modern law’s failure to provide adequate accountability when police officers use excessive force against persons of color. For at least the last twenty years, philosophers have attempted various strategies for reviving the Hegelian notion of recognition and redeploying it in discourses centered around social justice, including multiculturalism, feminism, race theory, and queer theory. Hegel’s master-slave dialectic may seem like an obvious place to start to analyze the oppression of one group by another. The pathologization of women’s depression covers over the social and institutional causes of that symptomology. Insofar as patriarchal values continue to devalue and debase women and mothers in ways that colonize psychic space, and depression becomes a cover for what I call ‘social melancholy.’ This is not the melancholy of traditional psychoanalysis, but a form of melancholy that results from oppression, domination, and the colonization of psychic space. Social melancholy differs from both Freud’s notion of melancholy in that it is (...) the result of social factors that constitute the depressed subject as ashamed and lacking agency. Crucial to my analysis is a distinction between shame and guilt missing from traditional psychoanalytic accounts of melancholy and depression. (shrink)

Alternative food networks are emerging in opposition to industrial food systems, but are criticized as being exclusive, since customers’ ability to patronize these market spaces is premised upon their ability to pay higher prices for what are considered the healthiest, freshest foods. In response, there is growing interest in widening the demographic profile given access to these alternative foods. This research asks: what barriers do alternative food businesses face in providing access and inclusion for low income consumers? Surveys and interviews (...) with 45 alternative food businesses in British Columbia, Canada uncovered five key barriers. The findings indicate that the barriers are symptomatic of structural issues in the Canadian food and social welfare systems. Although opportunities exist for business operators to widen access for low income shoppers, these alone cannot meaningfully ameliorate food-access inequality. Rather, these barriers underscore issues of income-disparity, poverty, and food-access inequality more broadly, and require structural and societal change to rectify. (shrink)

Her attention devolves primarily on the notorious standard meter paragraph of § 50. Important to her reading is her conviction about what it is from the Tractatus that is being criticized and about how it (...) is being criticized.I believe Gert's reading of the passage is mistaken. Benjamin Barber is one of America's preeminent political theorists. He has been a significant voice in the continuing debate about the nature and role of democracy in the contemporary world. A Passion for Democracy collects twenty of his most important writings on American democracy. Together they refine his distinctive position in democratic theory. Barber's conception of "strong democracy" contrasts with traditional concepts of "liberal democracy," especially in its emphasis on citizen participation in central issues of public debate. These essays (...) critique the "thin representation" of liberal democracy and buttress the arguments presented in Barber's twelve books, most recently in his well-received Jihad vs. McWorld: How Globalism and Tribalism Are Re-shaping the World. In these pieces, Barber argues for participatory democracy without dependence on abstract metaphysical foundations, and he stresses the relationship among democracy and civil society, civic education, and culture. A Passion for Democracy is divided into four sections. In the first, "American Theory: Democracy, Liberalism, and Rights," Barber addresses issues of ongoing relevance to today's debates about the roots of participatory democracy, including individualism vs. community, the importance of consent, and the irrelevance of Marxism. "Education for Democracy: Civic Education, Service, and Citizenship" applies Barber's theories to three related topics and includes his much-discussed essay "America Skips School." In human systems this may take the form of new ways of working or relating, new ideas for products, procedures, artefacts, or even the creation of a different culture or a new organizational form. This article will explore the creation of new order using the principles of complexity and the concepts of creativity and innovation. Rips et al. raise important questions about the relation between infant quantification and achievement of natural number concepts. However, they may be oversimplifying the interactions that characterize actual development in real time. Though they propose a worthwhile agenda for future research, its explanatory power will be limited if it does not address developmental issues with greater sensitivity.

While political and ethical philosophers today are familiar with critiques of confinement in both critical prison studies and critical animal studies, The Ethics of Captivity is unusual in that it brings these critiques of incarceration together, bridging human and nonhuman animal liberation movements. While Lisa Guenther’s recent book, Solitary Confinement: Social Death and Its Afterlives, also critiques the mass incarceration of both human and nonhuman animals, it is far more common to see human and animal liberation movements opposed on this (...) issue, as when the incarceration of humans is deplored for treating those individuals like animals. In the summer of 2012, “meat” themed posters were hung throughout the city of Edmonton, Alberta. A textual analysis of three of the posters from this collection revels that the concept of sacrifice is more appropriate to describe “meat”-eating in Alberta than the concept of the absent referent. These posters celebrate the consumption of “meat” and unabashedly make evident the living animal origins of “meat.” I argue that that the prominence of the cattle industry relative to Alberta’s economy, and its (...) ties to the production and reproduction of dominant Albertan identity negate the requirement of the absent referent. The consumption of “beef” is largely considered an expression of loyalty to the region, and as a means to preserve Alberta’s heritage. The noncriminal putting to death of nonhuman animals can instead be understood as symbolic and literal sacrifices in the constitution of dominant Albertan identity and economy. As such, this paper makes an intervention into ecofeminist literature as well as vegan literature written for mainstream populations that employ the absent referent in the aim of countering “meat”-eating practices. The goal of this essay is to explore the meaning of experience in William Harvey’s natural philosophy. I begin with Cunningham’s argument that, for Harvey, anatomy was an experience-based science of final causes. But how could one experience final causes? I answer this by first articulating Harvey’s conception of anatomy, before turning to his understanding of experience.What did anatomia mean in the early seventeenth century? Environmental ethicists often make claims about the intrinsic value of nature or parts thereof. Advances in intrinsic value theory, most notably Ben Bradley’s ‘Two Concepts of Intrinsic Value,’ successfully cleave the concept of intrinsic value into two: a Moorean and Kantian variety. This paper seeks to classify and organize different environmental theorists within a Bradley-inspired framework, helping to bring clarity and charity to the claims of older and newer environmental ethicists. There, Derrida (...) describes ethics as a paradox between the universal and the individual, between equality and singularity. Kierkegaard’s reading of the story of Abraham and Isaac from Genesis is the centerpiece of Derrida’s analysis. If we read The Gift of Death, with its focus on this story of father and son, in relation to Ricoeur and Levinas on the question of fatherhood, it reads as the culmination of a dialectical tension between the two. And if we read the Abraham story as a legend about father-son relations rather than just a parable of faith, The Gift of Death appears to uncover not just the paradoxical logic of ethics but also the uncompromising logic of patriarchy and paternal authority.Paternity Begets FraternityIn “Fatherhood: from Phantasm to Symbol” Ricoeur describes fatherhood as a battle of wills struggling for recognition. He brings together what he calls the different perspectives of psychoanalysis, phenomenology, and religion in order to rearticulate the oedipal situation as a process of recognition (rather than a structure) which moves from the father as phantasm to the father as symbol and replaces images of real murder with symbolic sacrifice. Through his dialectical analysis, Ricoeur himself attempts to articulate a recognition of fatherhood that moves us away from the phantasm of the father as castrator to the symbol of the father as compassionate. Relying on Hegelian dialectics, Ricoeur outlines a movement from psychoanalysis’s fantastic image of an omnipotent father who must be killed so that the son might live, through Phenomenology of Spirit’s master-slave dialectic, to the Christian religious representation of the loving father sacrificing Himself through His son for the sake of all His children. In this higher stage of the dialectic of paternity, the murder of the father is replaced by his sacrifice. Oddly, however, Ricoeur’s dialectic remains at the level of the master-slave fight to the death, where—without the Hegelian resolution—the only options available to insure the recognition of the father by the son (or the son by the father) are murder or suicide. For Ricoeur, recognition requires death, symbolic if not imaginary, whereas Hegel insists that recognition comes only when the master and slave are willing to risk death but also realize the necessity of avoiding it; mutual recognition cannot be maintained if one of the parties is dead.For Ricoeur, recognition does not necessitate avoiding death but rather moving away from the realm of the family and the body to the level of the social and the law. In order for the father-son relationship to be one of mutual recognition, the father must sacrifice his absolute authority so that the son might also participate in it. The goal of recognition is equality, which can be achieved only through social contracts that abstract from the particulars of embodied familial relations. One such social operation is designation, [End Page 45] which is removed from the realm of the bodily drives that motivate the oedipal scenario. Designation requires the sublimation of bodily drives into abstract laws that can equalize bodies by turning them into symbols.The move from psychoanalysis to Christianity is a move from a domestic family to a social family: through God the Father’s sacrifice of His son, we all become members of the Christian family; we all become children of God. For Ricoeur, it is not that God is the Father because He gives the Law. Rather, the law, the covenant or contract, enables Him to be recognized as father [490]. Ricoeur implicitly rejects the Lacanian association of the Father with the Law or the Name. He claims that there is no Name of the Father. “Father” is not a name but a designation [Ricoeur 485]. She was educated by French nuns, studied literature and worked as a journalist before going to Paris in 1966 to do graduate work with Lucien Goldmann and Roland Barthes. While in Paris she finished her doctorate in French literature, became involved in the influential journal Tel Quel, and began psychoanalytic training. In 1979 she finished her training as a psychoanalyst. Currently, Kristeva is a professor of linguistics as the University of Paris VII (...) and a regular visiting professor at Columbia University. Abstract: In this article I contest a reading of Wittgenstein's Philosophical Investigations —a reading of it as debunking philosophy. I concede that such a reading is not groundless, but I show why it is nonetheless mistaken. To do so, I distinguish two different ways of viewing Philosophical Investigations and its concern with philosophical problems, an External View and an Internal View. On the External View, readers of the book are taken to know ahead of time what philosophical problems are. On (...) the Internal View, readers are not taken to know this ahead of time: the task of the book is to disclose what philosophical problems are, to show them coming into being. One thing disclosed is our participatory role in philosophical problems coming to be. Learning about the nature of philosophical problems is thus learning about our own nature; metaphilosophical knowledge is in part self-knowledge. If the Internal View is correct (as I believe it is), then Philosophical Investigations does not debunk philosophy but provides a different conception of philosophy and the philosopher's task.
