Dr. McGee presents a cogent argument for the patentability of the diagnosis of gene forms that are found to be associated with disease or other phenotypic manifestations. We're convinced he's wrong. An analogy will help explain why.

BackgroundFor over 35 years, Africa has continued to host HIV vaccine trials geared towards overturning the HIV/aids pandemic in the continent. However, the methods of sharing the vaccines, when available remain less certain. Therefore, the study aims to explore stakeholders’ perspectives in the global South, in this case, Tanzania, on how HIV vaccines ought to be fairly shared.MethodsThe study deployed a qualitative case study design. Data were collected through in-depth interviews and focus group discussions with a total of 37 purposively (...) selected participants. This included researchers, institutional review board members, a policymaker, HIV/aids advocates, and community advisory board members. The data obtained were inductively and deductively analyzed.Results Findings indicate that HIV vaccines can be shared fairly under the principles of distributive justice (contribution, need and equality). Thus, contribution-based sharing ought to be utilized upon the necessity to prioritize vaccine access or subsidized trial benefits to host communities. Need-based sharing ought to be considered for non-host communities that are at an increased risk of HIV infection. Lastly, equal-based sharing would be useful at later stages of vaccine distribution or when the aforementioned principles are deemed morally inappropriate. However, none of the benefit-sharing approaches is free of limitations and a counterbalancing sense of unfairness.ConclusionFair sharing of HIV vaccines, when available, ought to be informed by the contribution, need and equality principles of distributive justice. Countries in the global south including Tanzania are likely to be prioritized during the distribution of the HIV vaccines due to their participation in HIV vaccine trials and due to the disproportionate HIV burden evident in the region. ABSTRACT The question of axiomatizability of first-order temporal logics is studied w.r.t. different semantics and several restrictions on the language. The validity problem for logics admitting flexible interpretations of the predicate symbols or allowing at least binary predicate symbols is shown to be ?1 1-complete. In contrast, it is decidable for temporal logics with rigid monadic predicate symbols but without function symbols and identity.

Global clinical trials depend on a range of standards in order for research results to be comparable. As standardization is more than a mere technical exercise, tensions can arise when things are not uniform. This paper uses empirical data from interviews with principal investigators as well as Clinical Research Organization and pharmaceutical industry representatives working in India’s clinical trial industry to critically examine the ways Indian researchers navigate quests for standardization. It turns the analytical lens to the often obfuscated work (...) of standardization aiming to transcend the biological and cultural specificity of research participants and research sites. Drawing on the concept of local biologies, it illustrates that the universal body presumed by clinical trial methodology is, in fact, a specifically Euro-American one: Indian participants not only need to be made globally comparable but also aligned with the drugs’ future consumers. Focusing on the tensions between biomedicine’s postulation of bodily universality and trial participants’ local biologies, this paper advances recent interventions problematizing the structural violence undergirding global clinical trials. It also contributes to the literature on local biologies in its discussion of how these are negotiated in Indian for-profit clinical trials. (shrink)

The goal of this paper is to propose a unified approach to the split scope readings of negative indefinites, comparative quantifiers, and numerals. There are two main observations that justify this approach. First, split scope shows the same kinds of restrictions across these different quantifiers. Second, split scope always involves low existential force. In our approach, following Sauerland, natural language determiner quantifiers are quantifiers over choice functions, of type <<,t>,t>. In split readings, the quantifier over choice functions scopes above other (...) operators (such as intensional verbs like must or can). Determiner quantifiers leave a choice-function trace when they move and this trace combines with the noun restriction, which is interpreted low. That split scope always involves low existential force is derived, without stipulation, from Kratzer’s idea that low existential force can be achieved via binding (into the noun restriction). Affective congruency effects in the evaluation task can be explained by either spreading of activation or response competition. Eliminating effects of response compatibility by using other tasks (semantic categorisation, naming task) typically also eliminates affective congruency effects. However, there is no need for processing the affective information of the stimuli in these tasks either, which could be necessary for an affectively mediated spreading of activation (Spruyt et al., 2007, 2009, 2012). We introduced a new task to further test this hypothesis. (...) The valent/neutral-categorisation task does not confound affective congruency with response compatibility, but still requires a processing of the stimuli's valence. No affective congruency effect was obtained with this task in two experiments, disfavouring a conditional spreading activation account. On the other hand, a significant priming effect was found for associated word pairs in Experiment 1, providing evidence for the sensitivity of the task to detect spreading activation processes. Much attention has been focused in recent years on the ethical acceptability of physicians receiving gifts from drug companies. Professional guidelines recognize industry gifts as a conflict of interest and establish thresholds prohibiting the exchange of large gifts while expressly allowing for the exchange of small gifts such as pens, note pads, and coffee. Considerable evidence from the social sciences suggests that gifts of negligible value can influence the behavior of the recipient in ways the recipient does not always realize. (...) Plato's depiction of the world soul's cognitive activity in Timaeus 37 A 2‐C 5 offers a general account of intellectual cognition. He gives this account by describing the activity of an ideal cognitive agent, involving the very same comparative mechanism that governs human intellectual activity, namely, the active production of a propositional grasp of sameness and difference that things have in relation to each other in several respects. Plato depicts the world soul's intellectual activity as entirely devoid of immediate forms (...) of cognition such as perception and/or intellectual intuition: everything the world soul cognizes is the outcome of its active comparison of things with each other. In particular, there is no direct cognitive grasp of the being of things. The paper ends with a suggestion as to how to understand Plato's account of the world soul's activity as an instance of the ‘like is known by like’ principle of cognition. (shrink)

Emotion is conceptualised as an emergent, dynamic process based on an individual's subjective appraisal of significant events. It is argued that theoretical models of emotion need to propose an architecture that reflects the essential nature and functions of emotion as a psychobiological and cultural adaptation mechanism. One proposal for such a model and its underlying dynamic architecture, the component process model, is briefly sketched and compared with some of its major competitors. Recent empirical evidence in support of the model is (...) reviewed. Special emphasis is given to the dynamic aspect of emotion processes, in particular the sequence of appraisal checks and the synchronisation of response systems, as well as the capacity of the model to predict individual differences in emotional responding. This paper examines a number of questions about the degree to which the clinical practice of medicine is affected, if at all, by the legal systems in four countries: Chile, Germany, Japan and the United States. The focus on these four countries in four different regions of the world offers a unique perspective within which to examine medical treatment decisions made by patients and their proxies or surrogates, the potential role for universal written instruments such as advance directives, the cross-professional (...) tensions between clinical and legal concerns in very distinct cultures, and the degree to which legal activities can change or affect clinical realities in the context of these different political and health care systems. We have incorporated, whenever relevant, the insights of many disciplines, including the social sciences, in analyzing the existing interrelations between law and behavior in this specific context. Der Beitrag untersucht, inwieweit die klinische Praxis in vier Ländern mit unterschiedlichen Rechtssystemen und Berufskulturen durch Rechtsnormen oder das Verständnis von Recht beeinflußt wird. Es wird gefragt, welche Funktion rechtliche Interventionen bei der Veränderung von Verhaltensnormen in unterschiedlichen Gesundheitssystemen haben können. Folgende Themenbereiche werden diskutiert: Entscheidungen über die medizinische Behandlung, die von Patienten und ihren Angehörigen oder Stellvertretern getroffen werden; die mögliche Rolle umfassender schriftlicher Verfügungen wie z.B. der Patiententestamente ; die berufsübergreifenden Spannungen zwischen medizinischen und rechtlichen Belangen in sehr unterschiedlichen Kulturen; der Einfluß, den gesetzgeberische Aktivitäten im Kontext der verschiedenen politischen und Gesundheitssysteme auf die medizinische Wirklichkeit haben. Antisemitism is on the rise. Recently, discussions have considered so-called “no-go zones for Jews” (city areas Jews should avoid to reduce the likelihood of being attacked). In this context and drawing from attribution theory, we examined if news consumers perceive a Jewish hate crime victim as partly responsible for being attacked when news coverage explicitly emphasizes that the victim displayed religious symbols (kippah) in a certain inner-city location. We conducted a quota-based survey experiment (N = 392) in Germany (4 groups, (...) between-subjects design) and randomly exposed participants to news coverage about an anti-Semitic attack. The article either emphasized that the Jewish victim displayed religious symbols (kippah) or not, and highlighted the specific location of the attack (Berlin synagogue vs. deprived inner-city district of Berlin). Moderated mediation analysis suggested that participants perceived the victim’s behavior to be more provocative when the news article highlighted that the victim displayed religious symbols and when the attack occurred in a deprived Berlin district. Yet, effects were only detected for individuals with low (vs. high) levels of education. Perceived provocativeness in turn increased victim blaming indicating that some individuals indirectly regarded the Jewish victim to be partly responsible for being attacked. (shrink)

Zusammenfassung Der Beitrag analysiert auf der Basis theoretischer Überlegungen sowie empirischer Ergebnisse Möglichkeiten und Grenzen einer „interkulturellen Öffnung“ von Sportvereinen, worunter Strukturanpassungen verstanden werden, die auf die Inklusion und Integration von Personen mit Migrationshintergrund zielen. Es wird gezeigt, inwiefern eine nachhaltige interkulturelle Öffnung der Vereine von der programmatischen Anbindung an den Vereinszweck, von der kontinuierlichen Behandlung in den Kommunikationswegen, von spezifischen Personalentscheidungen und der Kompatibilität mit der Organisationskultur abhängig ist.

How do animals make themselves move? Unlike most modern theories, Aristotle answers this question through a general theory of animal movement valid for both humans and animals. This book interprets this theory and analyses its fundamental concepts.

This chapter first argues against the widely accepted “mentalist” interpretation of Aristotle’s conception of the perception of external objects. On that view, the perception of objects results from an act of synthesis of the diverse perceptual input provided by the different sense modalities. I argue that Aristotle’s conception of perception does not require such mental “construction” of external objects. For him, we unfailingly perceive external objects by way of modally specific perception: perception without qualification is primarily of external 3-D objects, (...) while modally specific perception is of perceptual qualities. As the special senses cannot operate in isolation from the perceptual system as a whole, it follows that we see colors, hear sounds, etc., and thereby perceive the objects whose colors and sounds they are. The second part offers a causal interpretation of Aristotle’s definition of perception as “reception of the form without the matter,” according to which the causal history of sensory affection fixes the content of the resulting act of perception: perception is cognitive in virtue of being the matterless presence of external things’ qualities in the perceiver. The ArgumentWhat kind of objects are computer programs used for simulation purposes in scientific settings? The current investigation treats a special case. It focuses on “event generators,” the program packages that particle physicists construct and use to simulate mechanisms of particle production. The paper is an attempt to bring the multiplex and unfolding character of such knowledge objects to the fore: Multiple meanings and functions are embodied in the object and can be drawn out selectively according to the requirements of (...) a work setting. The object's conceptual complexity governs its application in some contexts, while the object is considered a mere “black box,” transparent and ready-to-hand, in others. These two poles span a full spectrum of object aspects, functions, and conceptions. Event generators are ideas turned into software, testing grounds for models, just a tool to study the performance of a detector, etc. The object's multiplex nature is submitted to negotiation among different actors. Today there is a growing wave of demands being placed upon the pharmaceutical industry to contribute to improved access to medicines for poor patients in the developing countries. 1 This article aims to contribute to the development of a systematic approach and broad consensus about shared benchmarks for good corporate practices in this area. A consensus corridor on what constitutes an appropriate portfolio of corporate responsibilities for access to medicines -especially under conditions of 'failing states' and 'market failure' 2 – (...) is not only in the interest of the world's poor, but also of corporations that want to contribute to the solution of one of the most significant social problems of our time. We report an experiment on two treatments of an ultimatum minigame. In one treatment, responders’ reactions are hidden to proposers. We observe high rejection rates reflecting responders’ intrinsic resistance to unfairness. In the second treatment, proposers are informed, allowing for dynamic effects over eight rounds of play. The higher rejection rates can be attributed to responders’ provision of a public good: Punishment creates a group reputation for being “tough” and effectively “educate” proposers. Since rejection rates with informed proposers drop to (...) the level of the treatment with non-informed proposers, the hypothesis of responder’s enjoyment of overt punishment is not supported.
