The ‘no-suicide contract’ is a frequently utilized tool in both the assessment and dispersal of suicidal patients. However, little attention has been given to questioning whether suicidal persons are able to give informed consent to enter such a contract. This article utilizes both the existing literature on no-suicide contracts and the results of recent research into the effects of this tool, to examine whether its use is consistent with the legal and ethical doctrine of informed consent. Particular attention is given (...) to issues of competence, fullness of information, voluntariness and paternalistic intervention when no-suicide contracts are used. This analysis finds the tool to be problematic and suggests that individual patients’ ability to give informed consent about a no-suicide contract needs to be carefully considered by clinicians. Using the linearized Einstein gravitational field equations and the Maxwell field equations it is shown that the plane of polarization of an electromagnetic wave is rotated by the gravitational field created by the electromagnetic radiation of a ring laser. It is further shown that this gravitational Faraday effect shares many of the properties of the standard electromagnetic Faraday effect. An experimental arrangement is then suggested for the observation of this gravitational Faraday effect induced by the ring laser.

Gilead et al.'s theory presupposes that traversing temporal, spatial, social, and hypothetical distances are largely interchangeable acts of mental travel that co-occur in human ontogeny. Yet, this claim is at odds with recent developmental data suggesting that children's reasoning is differentially affected by the dimension which they must traverse, and that different representational abilities underlie travel across different dimensions.

Coauthored scholarship increased substantially across fields of science during the twentieth century, but it is unclear whether this growth reflects change in the behavior of individual scientists or publishing differences between cohorts of researchers. I examine the publication records of an interdisciplinary sample of university scientists and find evidence of both career-aging and cohort-succession processes, although cohort differences are much more pronounced than individual changes. Specifically, scientists in this sample increased the percentage of their articles with coauthors by 0.63 percentage (...) points annually. However, compared to those who received their PhDs between 1953 and 1962, scientists who entered the workforce between 1983 and 1991 coauthored approximately one third more of their early career articles. Additionally, career-aging processes in coauthorship varied by PhD cohort, with earlier trained researchers increasing more rapidly. Overall, this article highlights cohort succession as a source of change in coauthorship, and underscores the importance of accounting for generational differences in studies of scientific careers. Nursing Inquiry 2003; 10: 218–228Implementing evidence-based nursing practice: a tale of two intrapartum nursing unitsDespite concerns that the rise of evidence-based practice threatens to transform nursing practice into a performative exercise disciplined by scientific knowledge, others have found that scientific knowledge is by no means the preeminent source of knowledge within the dynamic settings of health-care. We argue that the contexts within which evidence-based innovations are implemented are as influential in the outcomes as (...) the individual practitioners who attempt these changes. A focused ethnography was done in follow-up to an earlier trial that evaluated the effectiveness of a marketing strategy to encourage the adoption of evidence-based intrapartum nursing practice. Bourdieu's (1990, 1991) concepts of habitus, capital and social field were used in our refinement of the analysis of the ethnographic findings. Nursing leadership, interprofessional struggle with physicians, the characteristics of the community and the physical environment were prominent issues at all of the sites. Detailed descriptions of the sociohistorical context and of the experiences at two sites are presented to illustrate the complexities encountered when implementing innovations. (shrink)

In this paper I want to propose that we see solipsism as arising from certain problems we have about identifying ourselves as subjects in an objective world. The discussion will centre on Wittgenstein’s treatment of solipsism in his Tractatus Logico- Philosophicus. In that work Wittgenstein can be seen to express an unusually profound understanding of the problems faced in trying to give an account of how we, who are subjects, identify ourselves as objects in the world. We have in his (...) compressed remarks, the kernels of a number of arguments which all come together to form what can be called the problem of self-identification. I want to argue that the solipsism of the Tractatus arises at least in part as a solution to, or – to put it less optimistically – as a symptom or articulation of this problem. In approaching Wittgenstein’s early discussion of solipsism in this way I will obviously be in disagreement with some other interpretations of the work. For example, there are those who think that there is no ‘solipsism of the Tractatus’.1 In fact, the Tractarian arguments presented below as motivating solipsism have been seen as fulfilling the quite opposite function of refuting it. I do not intend in this piece to engage with alternative interpretations. Let me say a little bit about why I have granted myself the licence not to do so. First, the focus of my concern with solipsism is on how it connects with what I have called the problem of self-identification. John Rawls’s political liberalism and its ideal of public reason are tremendously influential in contemporary political philosophy and in constitutional law as well. Many, perhaps even most, liberals are Rawlsians of one stripe or another. This is problematic, because most liberals also support the redefinition of civil marriage to include same-sex unions, and as I show, Rawls’s political liberalism actually prohibits same- sex marriage. Recently in Perry v. Schwarzenegger, however, California’s northern federal district court reinterpreted the traditional rational basis review (...) in terms of liberal neutrality akin to Rawls’s “public reason,” and overturned Proposition 8 and established same-sex marriage. (This reinterpretation was amplified in the 9th Circuit Court’s decision upholding the district court on appeal in Perry v. Brown.) But on its own grounds Perry should have drawn the opposite conclusion. This is because all the available arguments for recognizing same-sex unions as civil marriages stem from controversial comprehensive doctrines about the good, and this violates the ideal of public reason; yet there remains a publicly reasonable argument for traditional marriage, which I sketch here. In the course of my argument I develop Rawls’s politically liberal account of the family by drawing upon work by J. David Velleman and H. L. A. Hart, and discuss the implications of this account for political theory and constitutional law. (shrink)

Scholars have failed to solve this conundrum, because they have failed to recognise in the fragments of Heraclitus the Obscure alternative forms of the law of the unity of opposites. Aristotle (wrongly) took one formulation of the law of the unity of opposites to imply an endless succession of the one and the many, and therefore the agreement of Heraclitus with Empedocles. This work is a study of Plato's ethical theory and in particular his paradoxical theses that virtue is knowledge and vice is ignorance and that no one voluntarily does evil. In the opening chapters O'Brien discusses Plato's debt to Homer and Hesiod and to the historians and tragedians. The succeeding chapters are devoted to an analysis of the ethical doctrines of over a dozen dialogues ranging from the Apology to the Laws. The principles of interpretation employed in the analysis (...) are: 1) each doctrine must be understood in relation to every other as well as to the whole, 2) we must give a literary analysis of the dialogues in addition to a textual and philosophical one, since Plato often prefers to suggest his view through his literary art rather than give them explicit statement, and 3) statements must be interpreted in context. From an application of these principles, Professor O'Brien concludes that Plato's ethical theory constitutes a unified set of doctrines. Elements which are often thought to be antithetic, i.e., the Socratic paradoxes and the partition of the soul, are seen to be complementary. The one affirms the rational unity of human nature and action and the other, the irrational multiplicity of both. In his words, they affirm "... virtue is knowledge, and it is more than knowledge." The book contains a long bibliography and an extensive index of topics discussed and texts cited. As a result, O'Brien's view on nearly every topic and text is readily accessible.—O. J. L. (shrink)

Doctors have an ethical and legal duty to respect patient confidentiality. We consider the basis for this duty, looking particularly at the meaning and value of autonomy in health care. Enabling patients to decide how information about them is disclosed is an important element in autonomy and helps patients engage as active partners in their care.Good quality data is, however, essential for research, education, public health monitoring, and for many other activities essential to provision of health care. We discuss whether (...) it is necessary to choose between individual rights and the wider public interest and conclude that this should only rarely be necessary. The paper makes some recommendations on practical steps which could help ensure that good quality information is available for work which benefits society and the public health, while still enabling patients’ autonomy to be respected. Teilhard’s cosmological speculation is a valuable basis for an environmental ethics that perceives individual natural objects as good in themselves and the world as good in itself. Teilhard perceives man as fundamentally part of a cosmic environmental whole that is greater than mankind taken individually or collectively. His holistic views on human biological and psychological and social evolution are, I argue, compatible with a biocentric environmental ethics. I discuss some similarities and differences with the views of the deep ecology movement. (...) I show that Teilhard’s hierarchical system is not humanistically oriented in a way that need be interpreted by Teilhardians as contrary to environmental well-being. I argue that Teilhard’s sympathies toward transportation technology, including the automobile, can be interpreted in his holistic manner. I conclude that Teilhard’s theocentric views are also a basis for supporting an environmental ethics which is both optimistic and not anthropocentric. (shrink)

While new generations of implantable brain computer interface devices are being developed, evidence in the literature about their impact on the patient experience is lagging. In this article, we address this knowledge gap by analysing data from the first-in-human clinical trial to study patients with implanted BCI advisory devices. We explored perceptions of self-change across six patients who volunteered to be implanted with artificially intelligent BCI devices. We used qualitative methodological tools grounded in phenomenology to conduct in-depth, semi-structured interviews. Results (...) show that, on the one hand, BCIs can positively increase a sense of the self and control; on the other hand, they can induce radical distress, feelings of loss of control, and a rupture of patient identity. We conclude by offering suggestions for the proactive creation of preparedness protocols specific to intelligent—predictive and advisory—BCI technologies essential to prevent potential iatrogenic harms. Hume is usually taken to have an evidentialist account of testimonial belief: one is justified in believing what someone says if one has empincal evidence that they have been reliable in the past. This account is impartialist: such evidence is required no matter who the person is, or what refotions she may have to you. I, however, argue that Hume has another account of testimony, one grounded in sympathy. This account is partialist, in that empincal evidence is not required in (...) order for one to be justified in believing some of the assertions of one's friends. (shrink)

ANALOGY has not just to do with the abstruse details and niceties of metaphysics but rather underlies the structure of all metaphysical thought. It is the heart of metaphysics. No system of metaphysics can discard it, without prejudice to the richness and variety of being. Without analogy there is elimination and over-simplification. Metaphysics is far from being a straightforward science; it is highly complex and its method and style of argument are not easy to master. Its field of inquiry is (...) wide. It is the task of the metaphysician to reduce the world of things to an intelligible unity. (shrink)

In this chapter I defend a novel view of the relationships among intention for the future, self-control, and co-operation. I argue that when an agent forms an intention for the future she comes to regard herself as criticizable if she does not act in accordance with her intention and as praiseworthy if she does. In forming intentions, then, agents acquire dispositions to have reflexive evaluative attitudes. In contexts where the agent has inclinations that run contrary to her unrescinded intention, these (...) evaluative attitudes help her to resist these inclinations. Intentions have, in other words, a built-in mechanism for self-control. I go on to argue that this mechanism can also function as a mechanism for co-operative behaviour. Sometimes a common species of co-operation just is the exercise of self-controlled behaviour in a social context. If this is on the right track, agents like us are not just equipped to formulate and abide by plans for the future, we are also thereby equipped for exercising self-control and participating in co-operative ventures. It is suggested that George Cotkin's essay is unpersuasive in its two central claims. Firstly, the evidence is not persuasive that there has been a discernible "moral turn" among historians in the last two decades; rather, it is argued that an engagement with morality has been fairly constant in historical scholarship since its ancient origins. Secondly, it is felt that Cotkin is evasive on whether he wishes historians merely to have opinions about the moralities of others in the past or (...) to be moral agents themselves; the first position is thought to be tenable, the latter probably not. One kind of successful communication involves the transmission of knowledge from speaker to hearer. Such testimonial knowledge transmission is usually seen as conforming to three widely held epistemological approaches: reliabilism, impartialism and evidentialism. First, a speaker must be a reliable testifier in order that she transmits knowledge, and reliability is cashed out in terms of her likelihood of speaking the truth. Second, if a certain speaker's testimony has sufficient epistemic weight to be believed by hearer1, then it should also be (...) believed by hearer2. Third, the normative constraint here is evidentially grounded: whether or not a hearer should believe a speaker depends on the evidence the hearer has that the speaker is telling the truth. I argue that there are cases of testimonial knowledge transmission that are incompatible with these three claims. This is when one accepts the testimony of an intimate friend. (shrink)
