American literary historians have viewed Ralph Waldo Emerson’s resignation from the Unitarian ministry in 1832 in favor of a literary career as emblematic of a main current in American literature. That current is directed toward the possession of a self that is independent and fundamentally opposed to the “accoutrements of society and civilization” and expresses a Transcendentalist antipathy toward all institutionalized forms of religious observance. In the ongoing revision of American literary history, this traditional reading of the supposed anti-institutionalism of (...) the Transcendentalists has been duly detailed and continually supported. Richard A. Grusin challenges both traditional and revisionist interpretations with detailed contextual studies of the hermeneutics of Ralph Waldo Emerson, Henry David Thoreau, and Theodore Parker. Informed by the past two decades of critical theory, Grusin examines the influence of the higher criticism of the Bible—which focuses on authorship, date, place of origin, circumstances of composition, and the historical credibility of biblical writings—on these writers. The author argues that the Transcendentalist appeal to the authority of the “self” is not an appeal to a source of authority independent of institutions, but to an authority fundamentally innate. A coherent theory of relations was a critical part of Russell’s metaphysics. In Appearance and Reality Bradley posed a problem that sits squarely in the way of any doctrine of “external” relations. Russell, determined to advance such a doctrine, tried several times to find a way around the paradox and apparently believed he had succeeded by making use of one of his inventions, the theory of logical types.Gilbert Ryle and Alan Donagan have advanced an argument that I read, over the (...) objections of its authors, as a special case of Bradley’s. In this paper I argue that the ad hoc solution suggested by Donagan to the special problem is one that Russell had already indicated a willingness to accept but that the general problem of the paradox remains.What finally prevents Russell from solving the paradox is a combination of his refusal to abandon the claim that relations are constituents of facts and the necessity of distinguishing a relational fact from its converse. Following some hints that Russell left, I do some reconstruction, showing how the theory of types would (and should) have been applied had Russell followed through on his own insights. The result, I suggest, is a truly Russellian theory that escapes Bradley’s paradox. (shrink)

This analysis of Mexico’s nanotechnology policies utilizes indicators developed by the Organization for Economic Co-operation and Development, which in 2008 conducted a pilot survey comparing the nanotechnology policies of 24 countries. In this paper, we apply the same questionnaire to the Mexican case, adding business information derived from the National Institute of Statistics and Geography survey on nanotechnologies, also an OECD instrument.

Co-authored letter to the APA to take a lead role in the recognition of teaching in the classroom, based on the participation in an interdisciplinary Conference on the Role of Advocacy in the Classroom back in 1995. At the time of this writing, the late Myles Brand was the President of Indiana University and a member of the IU Department of Philosophy.

At the International Legal Ethics Conference IV held at Stanford Law School between 15 and 17 July 2010, one of the two opening plenary sessions consisted of a panel who debated the proposition that legal ethics should be mandatory in legal education. The panel included leading legal ethics academics from jurisdictions around the world—both those where legal ethics is a compulsory part of the law degree and those where it is not. It comprised Professors Andrew Boon, Brent Cotter, Christine (...) class='Hi'>Parker, Stephen L Pepper and Richard Wu, and was organised and chaired by Professor Kim Economides. This is an edited version of the panel's discussion. It provides a useful summary of the state of legal ethics teaching in the jurisdictions represented as well as a marshalling of the arguments for and against legal ethics as a required course in the university law degree. In their paper ’Too much medicine: not enough trust?' Zoë Fritz and Richard Holton explore the connection between trust and overtreatment and overinvestigation. Whilst their paper is insightful, here I argue that much more could be made of a doctor’s trust and how this exacerbates overtreatment and overinvestigation. By taking Fritz and Holton’s view of trust as having ‘our best interests at heart’ as my starting point, I argue that doctor’s do not always trust that patients or the system (...) has their interests at heart and so use overtreatment and overinvestigation to protect themselves. I also point to the tensions created by a lack of trust on the doctor’s part as a focal point for much needed sustained ethical analysis. (shrink)

Joshua Parker has made many interesting points, and we welcome the opportunity to develop the ideas of ‘Too Much Medicine, Not Enough Trust’. We will address: (i) the asymmetry between the trust that patients extend to doctors, and the trust that doctors extend to patients; (ii) our reasons for doubting that litigation or complaints reflect a betrayal of the patient–doctor relationship and (iii) the importance of institutional trust, both for the doctor and the patient.

The claim will strike some as surprising—not least the so-called “humanist” critics who for almost (...) three decades have been defending ethical discourse against attacks from proponents of “literary and cultural theory.” There have been various intellectual sources for these attacks: neo-Marxists have claimed that ethical discourse is intrinsically class-specific and therefore ideological; psychoanalytic critics and theorists have often eschewed ethical inquiry in the belief that human conduct is predominantly determined by amoral unconscious forces; many feminists have argued that traditional ethical discourses are rendered untenable by their “gendered” histories; poststructuralists, while in some cases wanting to keep ethics on the agenda, have found it disconcertingly hard—even impossible—to conjure worthwhile ethical discourse out of a position which denies the existence of “centered” moral agents, and which sees language as inherently slippery and self-contradictory; postcolonialists tend to see Western ethical discourses as culpably ethnocentric. And so on.Yet, whatever the rhetoric of these and other strands of literary and cultural theory, it is too simple to say that they have renounced ethics altogether. Clearly, feminism, postcolonialism, Marxism, and other movements are ethical projects, and one of David Parker’s central points in Ethics, Theory, and the Novel is that the rhetoric of ethical refusal on the part of some proponents of these movements reflects an act of costly and unwarranted cultural repression: “the expansive moment of poststructuralism in the 1970s and early 1980s has suppressed some discursive possibilities which, constituted as we are partly by [End Page 519] various religious and humanistic traditions, we stand in abiding need of, and are poorer without” (pp. 3–4). Another casualty of the process, he argues, has been literature itself: it has been downgraded by the proponents of cultural studies, relegated to secondary, evidential status. Parker wants to retrieve cultural centrality and prestige for literature, and to insist that literary theory needs a rich conception of canonical literature, which “ought to be regarded as Theory’s resistant Other” (p. 6). Together with humanist criticism itself, such texts should function as the “subversive Other to the suppressive will of hegemonic Theory” (p. 146).The sense of regret at suppressed human richness and possibility is everywhere apparent in this subtle, deeply considered book. Parker’s characterization of our ethical and broader cultural predicament owes much to Charles Taylor’s monumental Sources of the Self; in particular, to Taylor’s claim that we need to “acknowledge the full range of goods we live by” (p. 20), and his three-fold account of our ethical traditions: Kantian/Judeo-Christian, Enlightenment, Romantic. Out of the cultural pluralism inherent in Taylor’s project Parker fashions a critical pluralism which reads, and also evaluates, novels in the light of their treatment of the “various goods”—the ethical strands—they explore, dramatize, and embody. His principle texts are Middlemarch, Anna Karenina, The White Peacock, and Women in Love. It is central to his case that with variousness comes tension and conflict, and that the greatest literature is that which gives ethical complexity and diversity the least reductive, “the fullest, most engaged and most intelligent examination” (p. 197). Such writing constitutes a canon—an institution for which Parker offers a courageous and compelling defense. He argues that some texts just are better than others at reflecting “the full range of good we live by,” and that, far from being merely an expression of supremacist cultural bias, the ethnocentrism of the Western canon actually schools us in “a long ethical tradition of self-reflection precisely on the tendency to self-righteous superiority” (p. 50).Literature’s contribution to “self-reflection” is crucial precisely because we are so prone to repress, to forget: the cultural selectivity against which Taylor warns is mirrored and enacted in the individual psyche. The Internet presents opportunities for corporations to efficiently build their brands online and to enhance their global reach. But there are threats as well as opportunities, since anti-branding and free-riding activities are easier in cyberspace. One such threat is theunauthorized incorporation of a trademark into a domain name. This can lead to trademark dilution and cause consumer confusion. But some users claim a right to use these trademarks for the purpose of parody or criticism. Underlying these trademark conflicts is the (...) familiar tension between property rights and free speech rights. While some trademark scholars are reluctant to consider a trademark as property, we find strong support for the property paradigm in Hegel’s philosophy. Assuming that a trademark is an earned property right, we propose that a trademark owner should be allowed to control the permutations of its trademark incorporated into domain names unless a reasonable person would not confuse that domain name with the company’s mark. But we also conclude that there must be latitude to employ a domain name for negative editorial comment, so long as the source and purpose of that domain name is plainly apparent. (shrink)
