In Respect for Nature Paul W. Taylor argues that there is a moral obligation to respect all living things. I argue that there is no such obligation. Taylor presents three basic premises for his position. The first two are shown to be mistaken but not necessary for Taylor's argument. The third, that being a nonsentient teleological centre of life confers moral significance, while necessary, fails to be rationally compelling. I argue: (1) The relevant concept of teleology as readily applies to (...) inanimate objects as it does to nonsentient life forms. (2) The inanimate–nonsentient distinction (at the relevant molecular level) is founded upon a continuum which offes no basis sufficient to justify The Life Principle. (3) The concept of teleology, as used by Taylor, is too unclear and ill-founded to serve as the basis for a rationally compelling argument. (shrink)

Gewirth and hare claim amoralism is contrary to reason. Gewirth believes amoralism to be logically inconsistent. Hare believes amoralism to be imprudent and hence irrational. By defining the problem as one of amoralism rather than 'non'moralism, Gewirth and hare assume illegitimate moral presuppositions. I show their arguments fail by comparing their arguments to the arguments given by someone who accepts the language and presuppositions of magic. High degrees of uncertainty and a lack of effective therapeutic treatments have characterized the COVID-19 pandemic and the provision of drug products outside research settings has been controversial. International guidelines for providing patients with experimental interventions to treat infectious diseases outside of clinical trials exist but it is unclear if or how they should apply in settings where clinical trials and research are strongly regulated. We propose the Professional Oversight of Emergency-Use Interventions and Monitoring System as an alternative pathway based (...) on guidance developed for the ethical provision of experimental interventions to treat COVID-19 in Singapore. We support our proposal with justifications that establish moral duties for physicians to record outcomes data and for institutions to establish monitoring systems for reporting information on safety and effectiveness to the relevant authorities. Institutions also have a duty to support generation of evidence for what constitutes good clinical practice and so should ensure the unproven intervention is made the subject of research studies that can contribute to generalizable knowledge as soon as practical and that physicians remain committed to supporting learning health systems. We outline key differences between POEIMS and other pathways for the provision of experimental interventions in public health emergencies. (shrink)

Recent discussion of Scanlon's account of value, which analyses the value of X in terms of agents' reasons for having certain pro-attitudes or contra-attitudes towards X, has generated the problem (WKR problem): this is the problem, for the buck-passing view, of being able to acknowledge that there may be good reasons for attributing final value to X that have nothing to do with the final value that X actually possesses. I briefly review some of the existing solutions offered to the (...) WKR problem, including those by Philip Stratton-Lake and Jonas Olson, and offer a new, better one, which accommodates all the relevant cases presented in the literature. (shrink)

In dieser Krisensituation sind alle Beteiligten mit ethischen Fragen konfrontiert, beispielsweise nach gerech- ten Verteilungskriterien bei begrenzten Ressourcen und dem gesundheitlichen Schutz des Personals angesichts einer bisher nicht therapierbaren Erkrankung. Daher werden schon jetzt klinische und ambulante Ethikberatungsangebote verstärkt mit Anfragen nach Unterstützung konfrontiert. Wie können Ethikberater*innen Entscheidungen in der Krankenversorgung im Rahmen der COVID-19-Pandemie unterstützen? Welche Grenzen von Ethikberatung sind zu beachten? Bislang liegen hierzu (...) noch wenige praktische Erfahrungen vor. Angesichts der dynamischen Entwicklung erscheint es der Akademie für Ethik in der Medizin (AEM) wichtig, einen Diskurs über die angemessene Rolle der Ethikberatung bei der Bewältigung der vielfachen Heraus- forderungen durch die COVID-19-Pandemie zu führen und professionelle Hinweise zu geben. Mit dem vorliegenden Diskussionspapier möchte die AEM einen Beitrag zur Beantwortung wesentlicher Fragen leisten, die sich für die Ethikberatung in den verschiedenen Bereichen des Gesundheitswesens stellen. Republican liberty, as recently defended by Philip Pettit and Quentin Skinner, characterises liberty in terms of the absence of domination, instead of, or in addition to, the absence of interference, as favoured by Berlin-style negative liberty. This article considers several claims made on behalf of republican liberty, particularly in Pettit's and Skinner's recent writings, and finds them wanting. No relevant moral or political concern expressed by republicans, it will be contended here, fails to be accommodated by negative liberty.

Scalar utilitarianism, a form of utilitarianism advocated by Alastair Norcross, retains utilitarianism's evaluative commitments while dispensing with utilitarianism's deontic commitments, or its commitment to the existence or significance of moral duties, obligations and requirements. This article disputes the effectiveness of the arguments that have been used to defend scalar utilitarianism. The problem of collective action is that each member of a group wants other members to make necessary sacrifices while he or she 'free rides', reaping the benefits of collective action without doing the work. Inevitably the end result is that no one does the work and the common interest is not realized. This book analyses the social pressure whereby groups solve the problem of collective action. The authors show that the problem of collective action requires a model of group (...) process and cannot be deduced from simple models of individual behaviour. They employ formal mathematical models to emphasize the role of small subgroups of especially motivated individuals who form the 'critical mass' that sets collective action in motion. The book will be read with special interest by sociologists, social psychologists, economists and political scientists. In a series of influential papers, John McDowell has argued that the rule‐following considerations explored in Wittgenstein’s later work provide support for a particularist form of moral objectivity. The article distinguishes three such arguments in McDowell’s writings, labelled the Anthropocentricism Argument, the Shapelessness Argument, and the Anti‐Humean Argument, respectively, and the author disputes the effectiveness of each of them. As far as these metaethical debates are concerned, the article concludes that the rule‐following considerations leave everything in their place.

The vertebrate retina is said to be inverted because the photoreceptors are oriented in the posterior direction and are thus unable to maximize photodetection under conditions of low illumination. The tapetum lucidum is a photoreflective structure located posterior to the photoreceptors in the eyes of some fish and terrestrial animals. The tapetum reflects light forward, giving incident photons a “second chance” to collide with a photoreceptor, substantially enhancing retinal photosensitivity in dim light. Across vertebrates (and arthropods), there are a wide (...) variety of tapeta that vary in structure, chemical composition, and even tissue architecture, indicating repeated convergent evolution. To date, the tapetum has not been observed in any cephalopod, however, which also possess a camera‐like eye, but with the retinal photoreceptors oriented in the anterior direction. We therefore hypothesize that the tapetum lucidum is a compensatory adaptation for the suboptimal design of the inverted retina of vertebrates. (shrink)

One Rawlsian response to G. A. Cohen’s criticisms of justice as fairness which Cohen canvasses, and then dismisses, is the 'Freedom Objection'. It comes in two versions. The 'First Version' asserts that there is an unresolved trilemma among the three principles of equality, Pareto-optimality, and freedom of occupational choice, while the 'Second Version' imputes to Rawls’s theory a concern to protect occupational freedom over equality of condition. This article is mainly concerned with advancing three claims. First, the 'ethical solution' Cohen (...) advances against the First Version of the Freedom Objection does not grant a fair hearing to the Freedom Objection. Second, the distinction Cohen presses between the legal and moral right of occupational choice in his response to the Second Version cannot save him from worries about Stalinist coercion. Third, Cohen’s response to the First Version of the Freedom Objection is actually in tension with his response to the Second Version of the Freedom Objection. (shrink)

Act-utilitarianism comes in two standard varieties: ‘subjective’ act-utilitarianism, which tells agents to attempt to maximize utility directly, and ‘objective’ act-utilitarianism, which permits agents to use non-utilitarian decision-making procedures. This article argues that objective actutilitarianism is exposed to a dilemma. On one horn of it is the contention that objective act-utilitarianism makes inconsistent claims about the rightness of acts. On the other horn of it is the contention that objective act-utilitarianism collapses back into what is, essentially, subjective act-utilitarianism. Three objective act-utilitarian (...) responses to this dilemma are explored and rejected. The recommended conclusion is that a consistent utilitarian must either embrace subjective act-utilitarianism, or abandon act-utilitarianism altogether. In this article, I appeal to the phenomenon of moral hazard in order to explain how at least some of the inequalities permitted by Luck Egalitarianism can be given an alternative, more plausible grounding than that which is supplied by Luck Egalitarianism. This alternative grounding robs Luck Egalitarianism of a potentially significant source of intuitive support whilst enabling conditional welfare policies to survive the attacks on them made by Elizabeth Anderson, Jonathan Wolff, and others.

The philosopher Stanley Cavell once asked, "Can a human being be free of human nature?" _On Ceasing to Be Human_ examines philosophical as well as literary texts and contexts, in which various senses of Cavell's question might be explored and developed. During the past thirty or so years, the very concept of "being human" has been called into question within such fields as cybernetics, animal-rights theory, analytic philosophy. This book examines these issues, but its main concern is the link between (...) freedom and nonidentity that Cavell's question implies, and which turns out to be a major concern among the thinkers Bruns takes up in this book: Maurice Blanchot, Emmanuel Levinas, Michel Foucault, Gilles Deleuze and Félix Guattari, and Jacques Derrida. BackgroundTo limit selective and incomplete publication of the results of clinical trials, registries including ClinicalTrials.gov were introduced. The ClinicalTrials.gov registry added a results database in 2008 to enable researchers to post the results of their trials as stipulated by the Food and Drug Administration Amendment Act of 2007. This study aimed to determine the direction and magnitude of any change in publication proportions of registered breast cancer trials that occurred since the inception of the ClinicalTrials.gov results database.MethodsA cross-sectional study design (...) was employed using ClinicalTrials.gov, a publicly available registry/results database as the primary data source. Registry contents under the subcategories ‘Breast Neoplasms’ and ‘Breast Neoplasms, Male’ were downloaded on 1 August 2015. A literature search for included trials was afterwards conducted using MEDLINE and DISCOVER databases to determine publication status of the registered breast cancer trials.ResultsNearly half (168/340) of the listed trials had been published, with a median time to publication of 24 months (Q1 = 14 months, Q3 = 42 months). Only 86 trials were published within 24 months of completion. There was no significant increase in publication proportions of trials that were completed before the introduction of the results database compared to those completed after (OR = 1.00, 95 % CI =.61 to 1.63; adjusted OR = 0.84, 95 % CI =.51 to 1.39). Characteristics associated with publication included trial type (observational versus interventional adjusted OR =.28, 95 % CI =.10 to.74) and completion/termination status (terminated versus completed adjusted OR =.22, 95 % CI =.09 to.51).ConclusionsLess than a half of breast cancer trials registered in ClinicalTrials.gov are published in peer-reviewed journals. In this study, we investigate the impact of frequent service learning on the emotional, personal development, and leadership characteristics of business students at a Catholic university in the United States. We examine the aforementioned impact of frequent service learning through a novel panel data set provided by the University’s Institute for Leadership and Service, ranging from the years 2008 through 2015. Specifically, we conduct an empirical analysis across the emotional, personal development, and leadership dimensions, and examine the too-much-of-a-good-thing effect of (...) Pierce and Aguinis in relation to service learning. Our results suggest that business students experience statistically significant increases in several emotional, personal development, and leadership dimensions as the number of service learning experiences increases. We provide mixed evidence of the TMGT effect when aggregating the emotion and personal development dimensions against the number of service-learning experiences via examination of cross-dimensional averages. Our study yields implications for the optimal number of service learning projects for business schools. (shrink)

This article is a response to criticisms of my book on Karl Marx’s Theory of History which were made by four authors in last December’s number of Analyse & Kritik. After clarifying (section 2) an ambiguity in an argument for historical materialism which is presented in the book, I contend (3-5), against objections raised by Philippe Van Parijs, that historical materialism is consistent only if it explains production relations functionally, by reference to their propensity to develop the productive forces. Next (...) (6-8) I address and rebut the views of Wal Suchting and Milton Fisk, who both think that the role of class struggle in historical materialism is larger than the one I assign to it. Finally (9-12) I try to vindicate the doctrine of base and superstructure proposed in my book against the skepticism of Steven Lukes. (shrink)
