So far, most of the philosophical literature on occupations has tried to assess the legitimacy of military rule in the aftermath of armed conflicts by exclusively employing the theoretical resources of just war theory. In this paper, I argue that this approach is mistaken. Occupations occur during or in the aftermath of wars but they are fundamentally a specific type of rule over persons. Thus, theories of political legitimacy should be at least as relevant as just war theory for the (...) moral evaluation of occupations. This paper, therefore, draws on both traditions and argues that just war theory plays a limited role in identifying the purposes and appropriate agents of occupation authority, but that theories of legitimacy are necessary for explaining why and under which conditions foreign actors have the right to rule in the aftermath of armed conflicts. This volume addresses the normative legitimacy of the international order, asking how we can make sense of legitimacy claims of increasingly diverse global governance institutions and practices and how their legitimacy relates to and differs from state legitimacy. -/- State legitimacy is a central concern of modern political thought but is inadequate when applied to institutions that differ from the state in type, level of governance, scope, and much else. We need a new, tailored approach to the legitimacy of institutions (...) beyond the state, especially international and transnational institutions. Such an approach includes foundational questions: what does it mean for institutions to be legitimate that have radically different purposes, means, interests, capacities, constituents, and roles from states? And what standards do such institutions have to meet in order to count as legitimate? The contributions to this volume seek to advance the debate on these questions at both abstract and more concrete levels. They range from conceptual questions about the nature of legitimacy and international institutions, to rule of law, to the legitimacy of the UN Security Council, the International Criminal Court, and occupying military forces in the face of challenges specific to their nature and context. Together they demonstrate both the promise and challenges of theorizing legitimacy beyond the state. -/- The chapters in this book were originally published as a special issue of the journal Critical Review of International Social and Political Philosophy. The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology further (...) and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. We then highlight two features of the institutional context beyond the state that set it apart from the domestic case: problems of feasibility and the structure of international law. (shrink)

This paper contributes to the calculization of evocation and erotetic implication as defined by Inferential Erotetic Logic (IEL). There is a straightforward approach to calculizing (propositional) erotetic implication which cannot be applied to evocation. First-order evocation is proven to be uncalculizable, i.e. there is no proof system, say FOE, such that for all X, Q: X evokes Q iff there is an FOE-proof for the evocation of Q by X. These results suggest a critique of the represented approaches to calculizing (...) IEL. This critique is expanded into a programmatic reconsideration of the IEL-definitions of evocation and erotetic implication. From a different point of view these definitions should be seen as desiderata that may or may not play the role of a point of orientation when setting up "rules of asking". (shrink)

The method of explication has been somewhat of a hot topic in the last 10 years. Despite the multifaceted research that has been directed at the issue, one may perceive a lack of step-by-step procedural or structural accounts of explication. This paper aims at providing a structural account of the method of explication in continuation of the works of Geo Siegwart. It is enhanced with a detailed terminology for the assessment and comparison of explications. The aim is to provide means (...) to talk about explications including their criticisms and their interrelations. There is hope that this treatment will be able to serve as a foundation to a step-by-step guide to be established for explicators. At least it should help to frame and mediate explicative disputes. In closing the enterprise will be considered an explication of ‘explication’, though consecutive explications improving on this one are undoubtedly conceivable. (shrink)

This encyclopedia article provides a procedural account of explication outlining each step that is part of the overall explicative effort (2). It is prefaced by a summary of the historical development of the method (1). The latter part of the article includes a rough structural theory of explication (3) and a detailed presentation of an examplary explication taken from the history of philosophy and the foundations of mathematics (4).

Causal processes can give rise to distinctive distributions in the linguistic variables that they affect. Consequently, a secure understanding of a variable's distribution can hold a key to understanding the forces that have causally shaped it. A storied distribution in linguistics has been Zipf's law, a kind of power law. In the wake of a major debate in the sciences around power-law hypotheses and the unreliability of earlier methods of evaluating them, here we re-evaluate the distributions claimed to characterize phoneme (...) frequencies. We infer the fit of power laws and three alternative distributions to 166 Australian languages, using a maximum likelihood framework. We find evidence supporting earlier results, but also nuancing them and increasing our understanding of them. Most notably, phonemic inventories appear to have a Zipfian-like frequency structure among their most-frequent members (though perhaps also a lognormal structure) but a geometric (or exponential) structure among the least-frequent. We compare these new insights the kinds of causal processes that affect the evolution of phonemic inventories over time, and identify a potential account for why, despite there being an important role for phonetic substance in phonemic change, we could still expect inventories with highly diverse phonetic content to share similar distributions of phoneme frequencies. We conclude with priorities for future work in this promising program of research. (shrink)

We argue that the need for commentary in commonly used linear calculi of natural deduction is connected to the “deletion” of illocutionary expressions that express the role of propositions as reasons, assumptions, or inferred propositions. We first analyze the formalization of an informal proof in some common calculi which do not formalize natural language illocutionary expressions, and show that in these calculi the formalizations of the example proof rely on commentary devices that have no counterpart in the original proof. We (...) then present a linear natural deduction calculus that makes use of formal illocutionary expressions in such a way that unique readability for derivations is guaranteed – thus showing that formalizing illocutionary expressions can eliminate the need for commentary. The paper addresses the referring problem in quantum mechanics, by spelling out the alternatives with complete or individual concepts, with directly referential labels, and with intuition. The connection between the way of referring and some metaphysical theses about objects will be explained. Then, the paper intends to make plausible that the Kantian way is the best way for the quantum domain, including quantum field theories.

The traditional use of the expression 'pseudoproblem' is analysed in order to clarify the talk of pseudoproblems and related phenomena. The goal is to produce a philosophically serviceable terminology that stays true to its historical roots. This explicative study is inspired by and makes use of the method of logical reconstruction. Since pseudoproblems are usually expressed by pseudoquestions a formal language of questions is presented as a possible reconstruction language for alleged pseudoproblems. The study yields an informal theory of pseudoproblems (...) whose presuppositions are critically investigated right away. At least one result remains: Claims of pseudoproblemship and their refutations must not be voiced casually - they are to be relativized and need substantial interpretive effort. (shrink)

Questions are everywhere and the ubiquitous activities of asking and answering, as most human activities, are susceptible to failure – at least from time to time. This volume offers several current approaches to the systematic study of questions and the surrounding activities and works toward supporting and improving these activities. The contributors formulate general problems for a formal treatment of questions, investigate specific kinds of questions, compare different frameworks with regard to how they regulate the activities of asking and answering (...) of questions, and situate these activities in a wider framework of cognitive/epistemic discourse. From the perspectives of logic, linguistics, epistemology, and philosophy of language emerges a report on the state of the art of the theory of questions. (shrink)

At first glance, every metaphysics of laws can be combined with every ontology of time. In contrast, the paper intends to show that Humeanism requires eternalism and that Power metaphysics must presuppose an existentially dynamical view of temporal existence, i.e. growing block or presentism. The presented arguments turn out to be completely independent of whether the laws of nature are deterministic or probabilistic: the world is non-productive and static or productively dynamical, the future be ‘open’ or not.

Frege's philosophy of language includes detailed views on judgments. His formal logic - the Begriffsschrift - documents some of these views in the introduction and treatment of the judgment stroke. In current logic such an expression is either entirely ignored or, appearing as turnstile, plays an fundamentally different role. In this paper I put forward four claims: (i) Considering Frege's Begriffsschrift, it is methodologically palpable why the judgment stroke was omitted in nearly all logical systems developed after Frege. (ii) The (...) Frege-style inclusion of the judgment stroke in a formal language represents a partial implementation of results from speech act theory. (iii) A more comprehensive implementation, not limited to the judgment stroke, helps to satisfy justified expectations about formal languages and logical calculi. (iv) Such an implementation has not yet been achieved in the current logical mainstream. (shrink)

The question of how to arrive at questions is ambiguous. I will concentrate on two readings: (i) How should one set up a formal syntax that accomodates questions? (ii) How does one, while working in a suitable formal language, arrive at a situation where one is allowed to or even must ask a certain question? In other words: How is the asking of questions regulated within a given formal language? I will propose an answer to question (i) and consider the (...) field of possibilities of answering (ii). Kant’s ontology of appearances implies that the numerical distinctness of empirical objects is grounded in their appearance-aspect, more precisely in space as pure intuition, in which alone such objects can be given. With distinguishing concepts things can only be thought: in contrast to Leibniz’s complete concepts and to Kripke’s rigid designators, Kant’s general concepts do not entail their referents analytically. They must be applied to intuition, i. e. be completed synthetically. Consequently, Kant’s ontology of merely singular individuals is closely connected (...) with a genuine semantics of synthetic reference via intuition, expressed by irreducible demonstratives such as “this”, “here”, and “now”. Accordingly, the judgment “There can be indiscernibles” is synthetic-apriori, which distinguishes Kant’s view both from skeptical empiricism and from heavyweight ontological realism. (shrink)

Pseudoproblems, pseudoquestions, pseudosentences (etc.) constitute an iridescent group of concepts which were prominently used by the Vienna Circle (including Wittgenstein). In the course of an explication this paper presents a compilation of the many different meanings that were given to these expressions. This includes the more prominent Viennese approaches as well as a more recent one by Roy Sorensen. A novel proposal concerning the use ofthe term is made, suggesting that nothing is just a pseudoproblem, but only relative to a (...) certain state of discourse. While the paper follows an explicative methodology, several uses of 'pseudoproblem', including the explicated one, relate pseudoproblemhood to other kinds of analysis. (shrink)

In a recent essay Jürgen Ludwig Scherb strives for a benevolent reconsideration of Heidegger's famous phrase 'the nothing noths' (,das Nichts nichtet'). In 1932 Rudolf Carnap attacked this expression for being meaningless and a pseudo-sentence. Using Stanislaw Lesniewski's ontology. Scherb reconstructs 'the nothing noths' in the tradition of Desmond Paul Henry. My text tries to show that attempts to rehabilitate Heidegger's dictum by just providing such a reconstruction must fail. Indeed, all that Scherb's and Henry's results illustrate is the trivial (...) fact that for every concatenation of signs there is a reconstruction that renders it syntactically well formed and provable. If Scherb wants his reconstruction to stand out among all the other possible reconstructions, it will be necessary for him to scrutinize more than the three words 'the nothing noths'. To facilitate an adequate critique, my text includes an informal introduction to the talk about reconstructions and offers further reconstructions which provide material for illustration and comparison. In the early Analytic Philosophy, the concept of a pseudosentence was used as a polemical device. To try and formalize a sentence without success was a means to ›debunk‹ it as a pseudosentence. The classical example is Heidegger’s dictum of the nothing which noths. But, according to Carnap, not only did Carnap not understand what Heidegger said, but also Heidegger himself must have misunderstood his own utterances! Does Carnap's diagnosis remain intact if one admits the possibility of a misunderstanding and (...) misconstrual on Carnap’s side, too? Should not Carnap's concept of formalization be substituted by that of logico-hermeneutical reconstruction in order to obviate any such infelicities? In everyday communication, we very rarely ever feel the need to undertake a significant effort to understand each other. This attitude is at odds with Friedrich Schleiermacher’s view that misunderstandings are ubiquitous and that one has to actively invest into the establishment of correct understandings. Therefore, one should ask: Are there good reasons to reject the view that we misunderstand ourselves all the time? Or: Is there any worth in the view that misunderstandings are prevalent? The answers developed in this paper are generalized so that they apply to philosophical contexts and a maxim of escalating formalization is formulated. The debate about peer disagreement is adduced as an illustration of philosophical practices that evade the maxim and thus stagnate cognitively. (shrink)

Kant rejects Leibniz’s Principle of the Identity of Indiscernibles. In quantum mechanics, Leibniz’s principle is also apparently violated. However, both ways of rejecting the PII differ significantly. In particular, Kant denies that spatiotemporal objects are unique individuals and establishes appearances as merely singular ones. The distinction between ‘unique’ and ‘singular’ individuals is crucial for the role that intuition plays in cognition: it will be shown that Kant’s way of rejecting the PII goes against the standard versions of conceptualism and non-conceptualism (...) which, in turn, points out the relevance of this issue for the understanding of transcendental idealism. Finally, the systematic relevance will be checked by defending a Kantian interpretation of quantum individuality. (shrink)

What exactly is the role of empirical beliefs in moral reflective equilibrium (RE)? And if they have a part to play, can changes in our empirical beliefs effectuate changes in the moral principles we adopt? Conversely, can empirical beliefs be adjusted in light of certain moral convictions? While it is generally accepted that empirical background theory is of importance to the method of wide reflective equilibrium (WRE), this article focuses on a different aspect, namely the role of empirical beliefs that (...) is intrinsic to the coherence relation of moral beliefs in any (narrow or wide) conception of RE. First, it is shown that in the application of RE, empirical beliefs are crucial to the procedure of matching principles to considered judgments. Changes in our empirical beliefs may therefore upset the relevant coherence relation and motivate changes in the moral principles we adopt. This more detailed account of the interplay between empirical and moral beliefs can help evaluate the overall philosophical appeal of RE. Finally, it is argued that, at least in WRE, the relation between empirical and moral beliefs need not be a one-way street, that is, moral convictions can provide us with some epistemic means of adjudicating between competing empirical descriptions of the world. Building on the work of Peter Hinst and Geo Siegwart, we develop a pragmatised natural deduction calculus, i.e. a natural deduction calculus that incorporates illocutionary operators at the formal level, and prove its adequacy. In contrast to other linear calculi of natural deduction, derivations in this calculus are sequences of object-language sentences which do not require graphical or other means of commentary in order to keep track of assumptions or to indicate subproofs. Both bosons and fermions satisfy a strong version of Leibniz’s Principle of the Identity of Indiscernibles (PII), and so are ontologically on a par with respect to the PII. This holds for non-entangled, non-product states and for physically entangled states—as it has been established in previous work. In this paper, the Leibniz strategy is completed by including the (bosonic) symmetric product states. A new understanding of Pauli’s Exclusion Principle is provided, which distinguishes bosons from fermions in a peculiar ontological way. (...) Under the eternalist hypothesis that objects or events exist independently of being present two different views of persistence are on the market: Persisting objects endure if they are multiply located in time, and persisting objects perdure if they are singly located by having numerically different temporal parts. Recently, several authors have argued that special relativity favours perdurantism over its endurantist rival. In my talk, I want to show that in fact the purported arguments are only those against endurantism, and that (...) with similar ones we should argue against perdurantism, as well: Enduring and perduring entities are both in conflict with SR which undermines the eternalist hypothesis. For arguing in favour of perdurantism Yuri Balashov, on the one hand, considers spatially unextended objects in Minkowski space-time and claims that for the endurantists there are unwelcome consequences from an adequate concept of their coexistence. On the other hand, spacelike extended objects are under investigation. Concerning point-like objects, Cody Gilmore has convincingly shown that Balashov’s arguments fail and, therefore, I will confine me to extended object. My paper has two parts following the two different strategies – namely, concerning the problem of the endurantist “explanatory deficiency” according to Balashov, and the problem of criss-crossing hyperplanes according to Gilmore. Using meta-metaphysical instruments, the paper analyzes the dispute between ‘reductionist’ Humean categoricalism and ‘bold’ Anti-Humean dispositionalism. It is argued that both views are non-Quinean, hence, heavyweight ontological realisms: careful analysis of specific scientific theories alone is not sufficient. Further, sophisticated philosophical reasoning is needed to defend Anti-Humeanism as well as Humeanism. The paper finally suggests that most if not all ontological disputes are unavoidably “speculative” due to essentialism which cannot be read off contemporary physical theories.

We are dealing with the Dirac Hamiltonian H = H0 + V with no magnetic field and radially symmetric electrostatic potential V = V(r), preferably the Coulomb potential. While the observable H is precisely predictable, its components H0 (relativistic mass) and V (potential energy) are not. However they both possess precisely predictable approximations H0 ∼ and V∼ which approximate accurately if the particle is not near its nucleus. On the other hand, near 0, H0 and V are practically unpredictable, perhaps (...) in agreement with the fact, that a neutrino also should be in the game. [We have not yet studied the corresponding observables for the (≥ 12-dimensional) problem of electro-weak interaction.] Mathematically we are focusing on the spectral theory of the unbounded self-adjoint operators H0 ∼ and V ∼. We can prove that V ∼ is unitarily equivalent to V(r) again, by a unitary map given as Wiener-Hopf-type singular integral operator in the standard separation of variables for radially symmetric Dirac Hamiltonians. [This is, as far as the continuous spectrum is concerned.] Very similar unitary equivalence holds for H 0 ∼ and H 0. We are tempted to regard this as a form of “renormalization”. (shrink)

The problem of the motion of empirical objects, as it appears from Newton through Leibniz, Huygens and Mach down to Einstein, acquires a special twist in Special Relativity : the shape of object’s surfaces appears to vary depending only on their relative state of motion . Through comparison of SRT with the Lorentz/Poincaré-Theory the following claim is expounded and justified: According to SRT and in opposition to LPT contraction of moving objects does not consist in the change of properties in (...) the same object: instead of a modification of an object caused by another object there is a relativisation of the absolute proper shape "caused" by time. There are many problems with temporal continuity, but there is a hard one for those philosophers who believe that the world is existentially dynamical. In particular, this holds for those who take seriously the requirement that in such a world must vary what exists unrestrictedly. As a paradigmatic case study, the paper discusses the Growing Block Theory of time, as recently presented by Correia and Rosenkranz who consider temporal passage in the strong existential sense of the term. Then, it will (...) be shown that their account fails to do justice to the continuity-requirement: nothing comes next. Without the time continuum, however, the genuinely temporal character of the dynamics gets lost: the objection of spatial analogue turns back. Finally, the paper suggests that Kantian consciousness-dependence is what one needs in order to get a genuinely temporal dynamics that really makes it distinguishable from mere variation across space.
