By rethinking the meaning of a central idiom in the Great Learning, this essay intends to open up a new horizon for the hermeneutics of early Confucian thinking, which has little to do with metaphysics. Through a careful etymological study of ge wu and a dialogue between the Great Learning and Heidegger's phenomenology of human affection, I demonstrate the critical position of the human heart in early Chinese thinking. Through a comparative study of the meanings and origins of justice symbolized in the Greek word dikē and the Chinese word yi 毅, this essay explores an alternative understanding of justice exemplified in Mencius' teaching and illuminates a possibility of social and political justice that originates in the human heart instead of reason. On the basis of a genealogical study of yi that identifies its root meanings as "the dignity of the self" and "amity and affinity," this study recovers and (...) revives a way of justice that may preserve and promote the dignity of the individual and the solidarity of political community at once without succumbing to the violence and rigidity of traditional Western metaphysics. In so doing, it highlights a long overlooked dimension of early Confucian moral practice and establishes its unique relevancy for the contemporary debates on justice. (shrink)

This essay presents an in-depth interpretation of the controversial dialogue in Analects 13.18 through careful and critical investigation of its historical background and philosophical significations. With a clarification of the multifaceted connotations of the word zhi (?, upright, forthright), my study brings out the play of irony in Confucius's words in Analects 13.18. According to my interpretation, not only is Confucius's reaction not inappropriate but it also demonstrates the art of early Confucian moral discretion that was informed by the teaching (...) of quan (? moral discretion). Accordingly, Confucius's judgment of the case embodied a high and bright middle way of moral choice originating in the openness and sincerity of heart. It epitomized a singular moment of deliberation and decision that was responsible for a sinuous opening of piety and individuality within the interplay of conflicting conditions and requisitions. Through a Confucian critique of modern colonial politics and the failure of Western conscience in a number of historical and literary settings (including the Opium Wars, the Holocaust and the modern slavery), the article criticizes the illusory foundation and inexorable predicaments of modern imperialism. The goal of my investigation is to break open the normative authority of modern Western ideologies so as to initiate a new horizon for the hermeneutics of Confucianism and to suggest an alternative vision of humanity and (...) cosmopolitanism in Confucianism. Despite a growing interest in and sympathy with Confucianism, there remains a stereotyped conception of Confucian civil order as a form of authoritarian hierarchy that is responsible for various oppressions in ancient China and is reprehensible from a modern egalitarian perspective. One central target of this modern criticism is the Confucian maxim of sangang 三綱, whose underlying idea is essential for regulating the relationship between sovereign and subject, father and son, and husband and wife in traditional Confucian society. By laying bare the philosophical prejudices underlying certain modern deprecations of Confucianism, this article defends the integrity of Confucian civilization and reclaims its significance for the modern world. Taking on a typical criticism of Confucian Ethics by Alsadire MacIntyre, I argue that the ideal of Confucian self can be defined neither in terms of Western concepts of autonomy nor heteronomy; it consists rather in a kind of virtuosity as inspired by the empathetic openness of the self. Through a comparative study (...) of Confucian and typical Western ethical theories, I will demonstrate further how the empathetic embodiment of the Confucian self informs an order of ritual that may still be relevant for the modern world in promoting harmonious social and political orders that can elevate the conventional and current power hierarchies into the virtuous rule of benefaction. In this article, I establish first the critical role of conscience in Heidegger's Being and Time . As the call of care, conscience attests to the authenticity of Da-sein as it discloses and "accomplishes" Da-sein as the being it is delivered over to be. Heidegger's interpretation of conscience also epitomizes the central aporias of Being and Time , which, with a view to revoking the Western metaphysical tradition, ultimately recalls it. At the heart of such aporias is the hermeneutic circle (...) in the attestation of conscience, whose voice only "reaches him who wants to be brought back." While the language of conscience and attestation was put away in Heidegger's later writings, I argue that the question concerning conscience is a leading question that will continue to guide us to build our way back and forth. Drawing upon John Burnet’s interpretation of mesotēs, I explore the original meanings of this important Greek word and its inherent relations to the conceptsof formal cause, final cause, and actuality (energeia). My investigation reveals the concept of mesotēs as an Ariadne’s thread running through the whole system ofAristotle’s moral and natural philosophy. It also throws a new light on the implications of Aristotle’s definition of moral virtue and the essential role it plays in the truth of human existence.

Divergences and controversies are inevitable in the discussion of freedoms and rights, especially in the matter of reproduction. The Chinese first social egg freezing lawsuit raises the question: is the freedom to freeze eggs for social reasons justified because it is an instance of reproductive rights? This paper accepts social egg freezing as desirable reproductive freedom, but following Harel's approach and considering two theories of rights, the choice and interest theories of rights, we argue that social egg freezing is not (...) a reproductive right because one cannot justify a right or an instance of rights via merely describing the function of those instances that have been justified as right, that is, the choice theory lacks justifying normativity. Since reserving fertility and a suspension from reproduction do not serve reproductive ends per se, the sufficient reason for demanding social egg freezing as a right should be found in other ends rather than in right‐to‐reproduce, that is, the interest theory denies the demand as a right‐to‐reproduce. Permitting it on any grounds without guaranteeing adequate and accessible resources, especially in light of cross‐border reproductive care, raises serious questions about reproductive equality and violates the idea of reproductive rights. Therefore, any ground for social egg freezing should be weighed against whether more pressing reproductive needs, specifically those that are justified as rights, have been met. It would be social progress to shoulder these burdens for the vulnerable and then allow social egg freezing—if right‐to‐reproduce were not the only privilege of the few. (shrink)

Carried out, it finally amounts to this, which also I believe,—“That government is best which governs not at all;” and when men are prepared for it, that will be the kind of government which they will have. Government is at best but an expedient; but most governments are usually, and all governments are sometimes, inexpedient. (...) The objections which have been brought against a standing army, and they are many and weighty, and deserve to prevail, may also at last be brought against a standing government. The standing army is only an arm of the standing government. The government itself, which is only the mode which the people have chosen to execute their will, is equally liable to be abused and perverted before the people can act through it. But it is not the less necessary for this; for the people must have some complicated machinery or other, and hear its din, to satisfy that idea of government which they have. Despite there being little consensus on what intelligence is or how to measure it, the media and the public have become increasingly preoccupied with the concept owing to recent accomplishments in machine learning and research on artificial intelligence (AI). Governments and corporations are investing billions of dollars to fund researchers who are keen to produce an ever‐expanding range of artificial intelligent systems. More than 30 countries have announced such research initiatives over the past 3 years 1. For example, the EU (...) The discussion of collective agency involves the reduction problem of the concept of a collective. Individualism and Cartesian internalism have long restricted orthodox theories and made them face the tension between an irreducible concept of a collective and ontological reductionism. Heterodox theories as functionalism and interpretationism reinterpret the concept of agency and accept it as realized on the level of a collective. In order to adequately explain social phenomena that have relations as their essence, in this paper we propose a (...) relational, holistic account of collective agency and argue that functionalism and interpretationism can be integrated into such an account.
