It is inevitable that some inmates in large state prison systems will suffer from terminal conditions and die while incarcerated. But how those inmates experience that event is primarily controlled by correctional policies and by the prison medical and correctional staff assigned to their care. Compassion for inmates who are dying cannot be legislated or mandated, but humane and compassionate care for the dying can be facilitated or thwarted by legislative and correctional policies, and by the manner in which correctional (...) personnel interpret those policies.Death in New York State prisons is a frequent event, occurring at a rate substantially higher than that in most other states. With a prison population that has risen to 70,000 inmates and with the nation’s highest rate of human immunodeficiency virus infection, more than 2,817 inmates died in New York prisons during the period 1990-1998. In April 1992, in the face of an ever-increasing death rate in its prisons, the New York State legislature passed the Medical Parole Law, a measure designed to permit dying inmates to be released on parole prior to their normal release eligibility date. Logical consistency demands that Mercier and Sperber's (M&S's) argumentative theory of reasoning apply to their own reasoning in the target article. Although they hint that their argument applies to professional reasoners such as scientists and philosophers, they do not develop this idea. In this commentary, I discuss the applicability of argumentative theory to science and philosophy, emphasizing the perils of moral reasoning.

In Marc. gr., classis XI,18 an anonymous florilegium consisting of selected paragraphs of the Second Part of the Fifth Division of the 3rd book of Thomas Aquinas’ Summa contra Gentiles is extant. These paragraphs were excerpted from the Greek translation of the Latin text by Demetrios Cydones and 106 ; ch. 101, § 2 partim; 103; ch. 94, § 3-5; 12-15). The main topic of this text is «fate». An edition of it is offered, and it is argued, on the (...) basis of its similarity with another florilegium Thomisticum of the professed Byzantine Thomist Georgios Scholarios - Gennadios II as well as with some of his writings, that it must be attributed to the same author. It should be probably placed in 1444/53 and regarded as part of Scholarios’ preparation for refuting Georgios Gemistos - Plethon’s Laws II,6, which from 1439 onwards was circulated independently as De fato. This dissertation focuses on the contemporary debate over moving from an individualist form of liberalism to one that seeks to accommodate the special claims of various groups in modern society. I deal with authors who examine ways that group dynamics affect the individual. They are worried about whether it is possible or wise to extend individualist liberalism into a group-accommodating liberalism. Presently, it is a matter of deep controversy how liberal democracies ought to interpret and accommodate the social reality and (...) normative claims of racial minorities. ;Race denotes privilege, it precipitates class antagonisms, hostility, and anger between various groups, it motivates misconceptions and misunderstandings. Racism is responsible for both immediate and intergenerational harm. And yet, the members of disadvantaged racial groups see their racial identity as something precious that should be preserved. For many the opportunity to identify with others in terms of a common racial heritage is an important source of pride. This disparity poses special problems for philosophical liberalism. What is the philosophical import of race and racism for various political theories within the contemporary Anglo American tradition of individualist liberalism? How ought the liberal tradition, an individualist thesis, to interpret and accommodate racial identity? ;This dissertation casts the philosophical debate concerning race in a new light. I argue that whether racial identities are compatible with liberal democratic ideals depends on how one defines race and the liberal ideals involved. Hence, I urge a critical stance on the issue of race. I am critical of both classical individualist liberalism, and the stand that groups do not pose any problems in a modern liberal democracy. I argue that we do not get an adequate picture of society from liberal conceptions of race and racism. What this analysis does, then, is call for a synthesis of historical, social, and cultural insights to inform and enrich the philosophical conception of race and racism.

Müller argues that double dissociations do not imply underlying modularity of the cognitive system, citing neural networks as examples of fully distributed systems that can give rise to double dissociations. We challenge this claim, noting that suchdouble dissociations typically do not “scale-up,” and that even some singledissociations can be difficult to account for in a distributed system.

The white‐rot fungus Phanrochaete chrysosporium has the ability to degrade a wide variety of structurally diverse organic compounds, including a number of environmentally persistent organopollutants. The unique biodegradative abilities of this fungus appears to be dependent upon its lignin‐degrading system. The non‐specific and partially extracellular nature of this system suggests that it may be useful as a supplementary means to treat organochemical wastes.

Commentators on empirical research in business ethics have recommended that use should be made of meta-analysis – the quantitative analysis of a group of research studies. This paper elaborates upon those recommendations by conducting, as a "case study" for further reflection, a meta-analysis of studies of accountants' organizational-professional conflict (OPC) previously published in accounting and psychology journals. Of five variables capable of analysis, only the population correlation coefficient between OPC and organizational tenure is identified. It was not possible to find (...) the population correlation coefficient of the other four variables, for which several possible reasons are suggested. The paper then shows how meta-analysis can make a valuable contribution, even when the substantive findings are limited, by providing guidance for future research and a safeguard against the drawing of unjustified conclusions, to which the more usual narrative reviews of literature are prone. It is crucial for understanding the debates between Hindus and Buddhists about metaphysical, epistemological and linguistic questions during the classical period. In an extensive commentary, the author explains the course of the argument from verse to verse and alludes to other theories of classical (...) Indian philosophy and numerous other technical matters. Notes to the translation and commentary go further into the historical and philosophical background of Kumarila's ideas. The book provides an introduction to the history and the development of Indian epistemology, a synopsis of Kumarila's work and an analysis of its argument. This paper reexamines the thesis of a split between politics and morality in the political theory of the eighteenth century. At its center is the notion of a “civil society” and the safeguards necessary for its proper functioning. While arguments are drawn from several discourses (economic, juridical, political, ethical), the focus is on the political and ethical reasoning of the age derivative of natural law and dependent upon the free and open exchange of ideas.

Safe and effective methods of preconception gender selection through flow cytometric separation of X- and Y-bearing sperm could greatly increase the use of gender selection by couples contemplating reproduction. Such a development raises ethical, legal, and social issues about the impact of such practices on offspring, on sex ratio imbalances, and on sexism and the status of women. This paper analyzes the competing interests in preconception gender selection, and concludes that its use to increase gender variety in a family, and (...) possibly for selecting the gender of firstborn, might in many instances be ethically acceptable. The idea of splitting off cells from embryos to clone human beings sounds so bizarre and dangerous that one would think the practice should not be permitted. A closer look reveals its ethical acceptability.

Advance directives such as living wills are attractive in that they give us a sense of control over our futures. But they also tend to obscure conflicts between a patient's competent wishes and later, incompetent interests. They allow caregivers to avoid evaluating quality of life in assessing the best interests of incompetent patients.

Ethical and legal traditions recognize prenatal duties to avoid harm to offspring. However, applying the harm principle to pregnancy requires a careful balancing of a baby's welfare with a pregnant woman's interest in liberty and bodily integrity. In the case of maternal PKU the mother can prevent harm to her baby by returning to the admittedly unpleasant diet that prevented her from being retarded. Informing, counseling, and access to medical care should be the primary policy. Seizures and forced treatment cannot (...) be justified in this case, and only rarely in other situations. (shrink)

This chapter argues that scientific and philosophical progress in our understanding of the living world requires that we abandon a metaphysics of things in favour of one centred on processes. We identify three main empirical motivations for adopting a process ontology in biology: metabolic turnover, life cycles, and ecological interdependence. We show how taking a processual stance in the philosophy of biology enables us to ground existing critiques of essentialism, reductionism, and mechanicism, all of which have traditionally been associated with (...) substance ontology. We illustrate the consequences of embracing an ontology of processes in biology by considering some of its implications for physiology, genetics, evolution, and medicine. And we attempt to locate the subsequent chapters of the book in relation to the position we defend. (shrink)
