In Born Free and Equal: A Philosophical Inquiry into the Nature of Discrimination, Kasper Lippert-Rasmussen defends the harm-based account of the wrongness of discrimination, which explains the wrongness of discrimination with reference to the harmfulness of discriminatory acts. Against this view, we offer two objections. The conditions objection states that the harm-based account implausibly fails to recognize that harmless discrimination can be wrong. The explanation objection states that the harm-based account fails adequately to identify all of the wrong-making properties (...) of discriminatory acts. We argue that the structure of a satisfactory view cannot be outcome-focused. We investigate the value of persons. Our primary goal is to chart a path from equal and extreme value to infinite value. We advance two arguments. Each argument offers a reason to think that equal and extreme value are best accounted for if we are infinitely valuable. We then raise some difficult but fruitful questions about the possible grounds or sources of our infinite value, if we indeed have such value.

The paper argues that Paul Ricoeur's The Philosophy of the Will retained a certain fidelity to phenomenology's early emphasis on subjectivity. When Ricoeur turned to the philosophy of language, he found a way to retain a certain emphasis on subjectivity and individuality that would make his work distinctive among other approaches to the philosophy of language. Hence, the title, Preserving the Eidetic Moment, intends to characterize Ricoeur's distinctive contribution to philosophy. Externalist theories hold that a comprehensive understanding of mental disorder cannot be achieved unless we attend to factors that lie outside of the head: neural explanations alone will not fully capture the complex dependencies that exist between an individual’s psychiatric condition and her social, cultural, and material environment. Here, we firstly offer a taxonomy of ways in which the externalist viewpoint can be understood, and unpack its commitments concerning the nature and physical realization of mental disorder. Secondly, we apply a (...) strongly externalist approach to the case of Autistic Spectrum Disorder, and argue that this condition can be illuminated by appeal to the hypothesis of extended cognition. We conclude by briefly considering the significance this strongly externalist approach may have for psychiatric practice and pedagogy. (shrink)

The criticism that voluntary codes of conduct are ineffective can be met by giving greater centrality to human rights in such codes. Provided the human rights obligations of multinational corporations are interpreted as moral obligations specifically tailored to the situation of multinational corporations, this could serve to bring powerful moral force to bear on MNCs and could provide a legitimating basis for NGO monitoring and persuasion. Approached in this way the human rights obligations of MNCs can be taken to include (...) support for political as well as economic rights. This will go some way towards filling the regulatory gap created by the difficulty of controlling the activities of corporations operating globally. However, such a proposal will require a measure of ‘meta-regulation’ whereby the operations of MNCs are legally required to be sufficiently transparent to create the conditions for effective external moral scrutiny. The community has legislatively conferred on external auditors a special but lucrative responsibility to provide fair and independent opinions about management''s preparation of company financial statements. In return, auditors are obliged by professional standards to act with integrity, independently and in the public interest. This study examined 174 auditors'' predisposition to provide just and fair judgements, using Kohlberg''s theory of developmental moral reasoning, one of the most widely accepted theories in justice psychology. Respondents came from five international audit firms in (...) Copenhagen. Results indicated that auditors with pre-conventional or low level of just reasoning or comprised 64 respondents, the largest group in the sample. The pre-conventional level suggests that people will act in their own self-interest and do the right only to avoid punishment. Pre-conventional auditors have the ability to "do deals", advantageous for business. When faced with an ethical crisis, however, auditors as this level will tend to focus on their own needs at the expense of others. The post-conventional or mid level of just reasoning comprised 59 auditors, second largest group in the sample. This level indicates that these auditors have the predisposition to act fairly on principal, particularly when faced with an ethical crisis. The conventional level or mid-just reasoning consisted of 51 auditors. People with a conventional level of just reasoning believe in law and order, the maintenance of the status quo, however they tend not to be critical of laws, nor authority even if those laws and authority are unjust or evil. This chapter is divided into three parts. In the first, I ask whether there is a human right to be spared extreme poverty. The answer is ‘Not necessarily’ if a human right is a legal right, and I argue that ‘human right’ either means a right in international law and associated policy, or else the term has an unacceptably wide sense. In the second section I consider microcredit as a poverty-alleviating mechanism, distinguishing between extreme and relative poverty in developing countries. (...) I argue that credit may not be a good way of alleviating extreme poverty, and that methods of collecting debt used by microcredit providers may have moral drawbacks. In the third section I consider the fit between the class of agents currently involved in offering financial services to the poor, and the class of agents recognized as duty-bearers by human rights law and policy. Unless states become highly involved in microcredit, it is not clear that microfinance providers are or can be human rights duty bearers. (shrink)

Against arguments that suggest that Rawls’s notion of reasonability is ‘obscure’ and ‘unclear’ I argue in this essay that the idea of reasonability in the later Rawls can be defended in three ways. First, it can be shown that reasonability is fundamental to the architectonic of the later work. Reasonability, and the subordination of reason to reasonability, is fundamental to the later (post-1980) writings. Second, it can be shown that reasonability is not necessarily a vague term as many have claimed. (...) Third, it can be shown that reasonability is fundamental to what Rawls calls the three major new ideas of Political Liberalism: overlapping consensus; the reconception of the priority of the right over the good; and the idea of public reason. This paper argues that Foucault’s genealogy of racism deserves appreciation due to the highly original concept of racism as biopolitical government. Modern racism, according to Foucault, is not merely an irrational prejudice, a form of socio-political discrimination, or an ideological motive in a political doctrine; rather, it is a form of government that is designed to manage a population. The paper seeks to advance this argument by reconstructing Foucault’s unfinished project of a genealogy of racism. Initially, the paper situates the (...) genealogy of racism within the context of Foucault’s work. It belongs to a period of transition between the mature and the late part of Foucault’s work, more specifically a period of transition from discipline to governmentality. The paper proceeds by reading closely key passages from the 1976 lectures at Collège de France in which Foucault proposes to rethink racism as a form of biopolitical government. While Foucault’s genealogy of racism remains an incomplete project, lacking for example any substantial treatment of European colonialism, the paper proposes to expand the Foucauldian analysis by linking it to the pan-German discourse between 1890 and 1914. Finally, the paper reflects on some of the implications of the Foucauldian analysis, in particular attempts to understand and counter contemporary forms of racism. Foucault’s genealogy of racism, in short, shows us the constructedness of our racialized world and challenges us to develop new and more effective strategies to change it. (shrink)

Construed as a theory of justice, relational egalitarianism says that justice requires that people relate as equals. Construed as a theory of what makes democracy valuable, it says that democracy is a necessary, or constituent, part of the value of relating as equals. Typically, relational egalitarians want their theory to provide both an account of what justice requires and an account of what makes democracy valuable. We argue that relational egalitarians with this dual ambition face the justice-democracy dilemma: Understanding social (...) relations in such a way that renders relational egalitarianism plausible as an answer to what makes democracy valuable comes at the price of understanding social relations in a way that makes it less plausible as a theory of justice, and vice versa. We also argue that there is no easy way out of the dilemma and that relational egalitarians, who want relational equality to provide both accounts mentioned, may simply have to set their ambitions lower on behalf of relational equality. This article focus on paradigms, methods and ethics of action research in the Scandinavian countries. The specific features of the action research paradigm are identified. a historical overview follows of some main action research projects in Norway, Sweden and Denmark. The tendency towards upscale action research projects from organisational or small community projects to large-scale, regional based network approaches are also outlined and discussed. Finally, a synthesised approach of the classical, socio-technical action research approach and the large-scale network and holistic (...) approaches is suggested as a promising approach for the future.
