Bien qu’il faille se garder de donner à ce qualificatif de « pré-historique » la charge péjorative qu’il a dans le vocabulaire courant, il n’en demeure pas moins que (...) Patočka assigne, dans une visée encore hégélienne, l’Asie à un stade non encore historique. Nous nous proposons donc d’interroger la pertinence d’une telle assignation, à partir de la perspective propre à Patočka et des différentes sources et exemples tirés du bouddhisme, du confucianisme et du taoïsme qu’indique le philosophe tchèque, sans toutefois en développer les significations. The Boltzmann and Gibbs approaches to statistical mechanics have very different definitions of equilibrium and entropy. The problems associated with this are discussed and it is suggested that they can be resolved, to produce a version of statistical mechanics incorporating both approaches, by redefining equilibrium not as a binary property but as a continuous property measured by the Boltzmann entropy and by introducing the idea of thermodynamic-like behaviour for the Boltzmann entropy. In response to the introduction of the Reformation in France, constituting a trauma for the royal power and the ecclesiastical personnel, Gallicanism was able to serve for conciliatory projects testifying to the attitude of ecclesiastical tolerance in the sense which is its own 16th century. It is then an opportunity to rethink the interactions between the king and the Church, but also the definition of Christianity. Indeed, ecclesiastical tolerance seems to support claims of autonomy of the Gallican Church as a (...) solution to the schism. This book reimagines the compositional semantics of comparative sentences using words such as more, as, too, and others. The book's central thesis entails a rejection of a fundamental assumption of degree semantic frameworks: that gradable adjectives like tall lexicalize functions from individuals to degrees, i.e., measure functions. I argue that comparative expressions in English themselves introduce “measure functions”; this is the case whether that morphology targets adjectives, as in *taller* or *more intelligent*; nouns, as in *more coffee*, *more coffees*; verbs, (...) such as *run more*, *jump more*; or expressions of other categories. Furthermore, she suggests that expressions that comfortably and meaningfully appear in the comparative form should be distinguished from those that do not in terms of a general notion of "measurability": a measurable predicate has a domain of application with non-trivial structure. This notion unifies the independently motivated distinctions between, for example, gradable and non-gradable adjectives, mass and count nouns, singular and plural noun phrases, and telic and atelic verb phrases. Based on careful examination of the distribution of dimensions for comparison within the class of measurable predicates, I tie the selection of measure functions to the specific nature and structure of the domain entities targeted for measurement. The book ultimately explores how, precisely, we should understand semantic theories that invoke the "nature" of domain entities: does the theory depend for its explanation on features of metaphysical reality, or something else? Such questions are especially pertinent in light of a growing body of research in cognitive science exploring the understanding and acquisition of comparative sentences. (shrink)

The central argument of this article turns on the dual‐nature thesis. This thesis sets out the claim that law necessarily comprises both a real or factual dimension and an ideal or critical dimension. The dual‐nature thesis is incompatible with both exclusive legal positivism and inclusive legal positivism. It is also incompatible with variants of non‐positivism according to which legal validity is lost in all cases of moral defect or demerit (exclusive legal non‐positivism) or, alternatively, is affected in no way at (...) all by moral defects or demerits (super‐inclusive legal non‐positivism). The dual nature of law is expressed, on the one hand, by the Radbruch formula, which says that extreme injustice is not law, and, on the other, by the correctness argument, which says that law's claim to correctness necessarily includes a claim to moral correctness. Objective: Appropriate reactivity to emotional facial expressions, even if these are seen whilst we are engaged in another activity, is critical for successful social interaction. Children with conduct problems (CP) and high levels of callous-unemotional (CU) traits are characterized by blunted reactivity to other people's emotions, while children with CP and low levels of CU traits can over-react to perceived emotional threat. No study to date has compared children with CP and high vs. low levels of CU traits to typically (...) developing (TD) children or each other, using a task that assesses attentional capture by irrelevant emotional faces. -/- Method: All participants performed an attentional capture task in which they were asked to judge the orientation of a single male face that was displayed simultaneously with two female faces. Three types of trials were presented, trials with all neutral faces, trials with an emotional distractor face and trials with an emotional target face. Fifteen boys with CP and high levels of CU traits, 17 boys with CP and low levels of CU traits and 17 age and ability matched TD boys were included in the final study sample. -/- Results: Compared to TD children and children with low levels of CU traits, children with CP and high levels of CU traits showed reduced attentional capture by irrelevant emotional faces. -/- Conclusions: This study is the first to demonstrate a different pattern in emotional attentional capture in children with CP depending on their level of CU traits. A key question in understanding visual awareness is whether any single cortical area is indispensable. In a transcranial magnetic stimulation experiment, we show that observers' awareness of activity in extrastriate area VS depends on the amount of activity in striate cortex (Vl). From the timing and pattern of effects, we infer that back-projections from extrastriate cortex influence information content in Vl, but it is Vl that determines whether that information reaches awareness.

Digital phenotyping for mental health is an emerging trend which uses digital data, derived from mobile applications, wearable technologies and digital sensors, to measure, track and predict the mental health of an individual. Digital phenotyping for mental health is a growing, but as yet underexamined, field. As we will show, the rapid growth of digital phenotyping for mental health raises crucial questions about the values that underpin and are reinforced by this technology, as well as regarding to whom it may (...) become valuable. In this commentary, we explore these questions by focusing on the construction of value across two interrelated domains: user experience and epistemologies on the one hand, and issues of data and ownership on the other. In doing so, we demonstrate the need for a deeper ethical and epistemological engagement with the value assumptions that underpin the promise of digital phenotyping for mental health. (shrink)

At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. Philosophical and sociological approaches in technology have increasingly shifted toward describing AI (artificial intelligence) systems as ‘(moral) agents,’ while also attributing ‘agency’ to them. It is only in this way – so their principal argument goes – that the effects of technological components in a complex human-computer interaction can be understood sufficiently in phenomenological-descriptive and ethical-normative respects. By contrast, this article aims to demonstrate that an explanatory model only achieves a descriptively and normatively satisfactory result if the concepts of ‘(moral) (...) agent’ and ‘(moral) agency’ are exclusively related to human agents. Initially, the division between symbolic and sub-symbolic AI, the black box character of (deep) machine learning, and the complex relationship network in the provision and application of machine learning are outlined. Next, the ontological and action-theoretical basic assumptions of an ‘agency’ attribution regarding both the current teleology-naturalism debate and the explanatory model of actor network theory are examined. On this basis, the technical-philosophical approaches of Luciano Floridi, Deborah G. Johnson, and Peter-Paul Verbeek will all be critically discussed. Despite their different approaches, they tend to fully integrate computational behavior into their concept of ‘(moral) agency.’ By contrast, this essay recommends distinguishing conceptually between the different entities, causalities, and relationships in a human-computer interaction, arguing that this is the only way to do justice to both human responsibility and the moral significance and causality of computational behavior. Recent philosophy of language has been profoundly impacted by the idea that mainstream, model-theoretic semantics is somehow incompatible with deflationary accounts of truth and reference. The present article systematizes the case for incompatibilism, debunks circularity and “modal confusion” arguments familiar in the literature, and reconstructs the popular thought that truth-conditional semantics somehow “presupposes” a correspondence theory of truth as an inference to the best explanation. The case for compatibilism is closed by showing that this IBE argument fails to rule out (...) two kinds of deflationism: the position Field famously accused Tarski of having; and a less familiar version of the view that defines reference in terms of a deflated notion of truth. Finally, the distinction between unifying and constitutive explanation is used to forestall the response that correspondence theory is literally part of mainstream semantics. (shrink)

Examples are the relation between deliberative democracy and democracy qua decision-making procedure along the lines of the majority principle, the connection between human rights as moral rights and constitutional rights as positive rights, the relation between constitutional review qua ideal representation of the people and parliamentary legislation, the commitment of legal argumentation (...) to both authoritative and non-authoritative reasons, and the distinction between rules as expressing a real “ought” and principles as expressing its ideal counterpart. Various emerging technologies, from social robotics to social media, appeal to our desire for social interactions, while avoiding some of the risks and costs of face-to-face human interaction. But can they offer us real friendship? In this book, Alexis Elder outlines a theory of friendship drawing on Aristotle and contemporary work on social ontology, and then uses it to evaluate the real value of social robotics and emerging social technologies. In the first part of the book Elder develops a (...) robust and rigorous ontology of friendship: what it is, how it functions, what harms it, and how it relates to familiar ethical and philosophical questions about character, value, and well-being. In Part II she applies this ontology to emerging trends in social robotics and human-robot interaction, including robotic companions for lonely seniors, therapeutic robots used to teach social skills to children on the autism spectrum, and companionate robots currently being developed for consumer markets. Elder articulates the moral hazards presented by these robots, while at the same time acknowledging their real and measurable benefits. In the final section she shifts her focus to connections between real people, especially those enabled by social media. Arguing against critics who have charged that these new communication technologies are weakening our social connections, Elder explores ways in which text messaging, video chats, Facebook, and Snapchat are enabling us to develop, sustain, and enrich our friendship in new and meaningful ways. In the debate between positivism and non-positivism the argument from relativism plays a pivotal role. The argument from relativism, as put forward, for instance, by Hans Kelsen, says, first, that a necessary connection between law and morality presupposes the existence of absolute, objective, or necessary moral elements, and, second, that no such absolute, objective, or necessary moral elements exist. My reply to this is that absolute, objective, or necessary moral elements do exist, for human rights exist, and human rights exist (...) because they are justifiable. (shrink)

Reconstructing the philosophical project of William James, Alexis Dianda deploys a concept of experience that avoids both foundationalist epistemology and an account of the subject rooted in immediately given objects of consciousness. In doing so, Dianda rethinks the role of experience as well as the aims and resources of pragmatic philosophy.

I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

The article begins with an outline of the balancing construction as developed by the German Federal Constitutional court since the Lüth decision in 1958. It then takes up two objections to this approach raised by Jürgen Habermas. The first maintains that balancing is both irrational and a danger for rights, depriving them of their normative power. The second is that balancing takes one out of the realm of right and wrong, correctness and incorrectness, and justification, and, thus, out of the (...) realm of the law. The article attempts to counter these objections by showing that there exists a rational structure of balancing that can be made explicit by a “Law of Balancing” and a “Disproportionality Rule.” These rules show, first, that balancing is not a danger for rights but, on the contrary, a necessary means of lending them protection, and second, that balancing is not an alternative to argumentation but an indispensable form of rational practical discourse. The author's thesis is that there is a conceptually necessary connection between law and morality which means legal positivism must fail as a comprehensive theory. The substantiation of this thesis takes place within a conceptual framework which shows that there are at least 64 theses to be distinguished, concerning the relationship of law and morality. The basis for the author's argument in favour of a necessary connection, is formed by the thesis that individual legal norms and decisions as well as (...) whole legal systems necessarily make a claim to correctness. The explication of this claim within the frame of discourse theory shows that the law has a conceptually necessary, ideal dimension, which connects law with a procedural, universalistic morality. Cognitive partitions are useful. The notion of numerical identity helps us induce them. Consider, for instance, the role of identity in representing an equivalence relation like taking the same train. This expressive function of identity has been largely overlooked. Other possible functions of the concept have been over-emphasized. It is not clear that we use identity to represent individual objects or quantify over collections of them. The nineteenth-century French writer examines the development of democratic government in the United States and the state of political and social life.

Contemporary research in compositional, truth-conditional semantics often takes judgments of the relative unacceptability of certain phrasal combinations as evidence for lexical semantics. For example, observing that completely full sounds perfectly natural whereas completely tall does not has been used to motivate a distinction whereby the lexical entry for full but not for tall specifies a scalar endpoint. So far, such inferences seem unobjectionable. In general, however, applying this methodology can lead to dubious conclusions. For example, observing that slightly bent is (...) natural but slightly cheap is not (that is, not without a “too cheap” interpretation) leads researchers to suggest that the interpretation of bent involves a scalar minimum but cheap does not, contra intuition—after all, one would think that what is minimally cheap is (just) free. Such claims, found in sufficient abundance, raise the question of how we can support semantic theories that posit properties of entities that those entities appear to lack. This paper argues, using theories of adjectival scale structure as a test case, that the (un)acceptability data recruited in semantic explanations reveals properties of a two-stage system of semantic interpretation that can support divergences between our semantic and metaphysical intuitions. AbstractWhile the literature on oncofertility decision-making was central to the bioethics debate on social egg freezing when the practice emerged in the late 2000s, there has been little discussion juxtaposing the two forms of egg freezing since. This article offers a new perspective on this debate by comparing empirical qualitative data of two previously conducted studies on medical and social egg freezing. We re-analysed the interview data of the two studies and did a thematic analysis combined with interdisciplinary collaborative auditing (...) for empirical ethics projects. Despite their different contexts, major similarities in women’s decision-making and reasoning were found. We developed two main common themes. Firstly, women felt a clear need to plan for future options. Secondly, they manipulated decision-times by postponing definitive decisions and making micro-decisions. The comparison highlights that the passage of time and the preservation of future choice seems to permeate all aspects of the patient experiences in both studies. As a result of considering real-world lived experiences, we suggest that there are many overlaps in women’s reasoning about egg freezing regardless of why they are making a decision to freeze. These overlaps are morally relevant and thus need to be further integrated into the existing arguments that have been canvassed in the flourishing egg freezing and fertility preservation debates across the field, and in policy and practice globally.
