Trading on non-public material information is fertile ground for a discussion of ethical behavior. The long-running legal tug-of-war over what constitutes illegal insider trading delivers challenges to regulatory authorities charged with detecting and enforcing the law, and is likely one of the reasons that prosecution of insider trading events remains rather uncommon. One can observe both increased volume in the equity and option markets and run-ups in the stock price prior to the announcement of the acquisitions; however, the detection of (...) illegal or unethical insider trading can be difficult. Given the legal uncertainty around insider trading and the circumstantial evidence from the trading activity, it is almost impossible to identify unethical insider trades unless there is a whistleblower or trades are large in size and impeccable in timing. Using call option trading around two merger announcements with similar firms that resulted in different ultimate treatment from the SEC, we illustrate the struggle regulators and prosecutors have with identifying and enforcing unethical insider trades. The reasons conception is the most prominent account of the nature of critical thinking. It consists in responding appropriately to reasons. Responding to reasons can be following a rule, it can be making an exception to a rule, it can be responding to a situation that is unique. It depends on the context each time what is the appropriate response. Critical thinking is the educational cognate of rationality and is a sine qua non for a reasonable life in a modern (...) democratic society. Reasons are generally normative. If this is true then it is to be expected that critical thinking is normative and also rationality. Critical thinking consists in being appropriately moved by reasons. The normative element of reasons moves us to beliefs or actions. It depends on our character how reasons move us. This indicates that our character must be well formed to enable us to be appropriately moved. (shrink)

O. Matthiessen. Career-wise, however, Howe’s path to academia has (...) be en indirect: born in 1937, she gained her first professorship in 1989 in the Poetics Program at SUNY Buffalo. A visual artist by [End Page 192] training, Howe veered into a genre of writing in the 1970s that seeks to “install certain narrativ es somewhere between history, mystic speech, and poetry” (p. 44). Her poetry includes Secret History of the Dividing Line (1978), Pythagorean Silence (1982), and Defenestration of Prague (1983). In 1985 she published an original criti cal study, My Emily Dickinson, which criticized editors for having homogenized the format and typography of Dickinson’s manuscripts, taming the unruly rigor of poems which were originally “multifaceted visual and verbal productions.” Howe also argu ed that the Amherst poet should not be viewed as a victim of repression, as many feminists see her, but as a refuser of congregations, a powerful will-to-reclusion in art—“One unchosen American women alone at home and choosing.” Emily’s home was a nomadi c space between orthodoxies.An understanding of Howe’s kinship with Dickinson’s poetic daring is helpful for reading The Birth-Mark, whose prose is poetic, and whose protagonist, Mary Rowlandson, shared Dickinson’s “stubborn strength in isolation.” The captivity narratives ar e portals into the antinomian controversy of New England, which was “the primordial struggle of North American literary expression” (p. 4). It is not Gilbert and Gubar to whom Howe has recourse in her analyses of hostage consciousness. She cites the philo sophy of Emmanuel Lévinas. As with feminism, which she extends rather than follows, Howe takes up the philosophy of alterity without its orthodoxy. (In the face of frontier brutality she cannot discern the “Father of orphans and defender of widows” of Psalm 68.) Encounters in the wilderness of tribes, woods, and waters aroused an immodest otherness within the American literary unconscious, unsettling the styles of expression and selfhood which the puritan colonies were trying to instantiate. The literary awakening of Dickinson, Rowlandson, Melville, Hawthorne, and other writers was not due to the Great Awakening urged by churches, but to the traumatic transfer of sovereignty from God to frontier, a permanent revolution to which these writers’ imaginations would remain exposed.Howe’s new foray into criticism tracks the textual marginalia which yield the visionary utterances of Rowlandson and Hutchinson. A self-confessed “library cormorant,” Howe gathers a quiet spectacle of testimonies, those of separated loved ones dragged int o “Removes” by tribes of Native Americans. These resonant texts from New England village libraries and major collections at Harvard, are melded together by Howe’s intuitive, almost telepathic sensibility into a kind of spiritual drama informed by critical acumen. Howe takes her bearings from Patricia Caldwell’s essay “The Antinomian Language Controversy,” which appeared in the Harvard Theological Review in 1976. The dislocating frontier experience for Hutchinson, Rowlandson, and others forced the c reation of a different language. It is with this antinomian language that Howe develops a sensitive rapport, echoing its myriad haunting voices in her commentaries. Indeed, Howe’s work is a creative example of the fusion of horizons which Gadamer says epitomizes the hermeneutic event. Howe’s personal method as revealed in her interview: “Not to explain the work, not to trans late it, but to meet the work with writing... Not just to write a tribute, but to meet her [Dickinson] in the tribute. And that’s a kind of fusion” (p. 158). Some scholars will find her method obscure. It is often assumed that graphemes are a crucial level of orthographic representation above letters. Current connectionist models of reading, however, do not address how the mapping from letters to graphemes is learned. One major challenge for computational modeling is therefore developing a model that learns this mapping and can assign the graphemes to linguistically meaningful categories such as the onset, vowel, and coda of a syllable. Here, we present a model that learns to do this in English for strings (...) of any letter length and any number of syllables. The model is evaluated on error rates and further validated on the results of a behavioral experiment designed to examine ambiguities in the processing of graphemes. The results show that the model (a) chooses graphemes from letter strings with a high level of accuracy, even when trained on only a small portion of the English lexicon; (b) chooses a similar set of graphemes as people do in situations where different graphemes can potentially be selected; (c) predicts orthographic effects on segmentation which are found in human data; and (d) can be readily integrated into a full-blown model of multi-syllabic reading aloud such as CDP++ (Perry, Ziegler, & Zorzi, 2010). Altogether, these results suggest that the model provides a plausible hypothesis for the kind of computations that underlie the use of graphemes in skilled reading. (shrink)

Conversely, when I now say, “Palms are beautiful,” or “I love palms,” it (...) is really individual palms that I have in mind. This quote from Elaine Scarry’s On Beauty and Being Just applies perfectly to an experience I recently had regarding a painting by an artist I had assumed I didn’t much care for. Perhaps it would be best to lead into my epiphany gradually, to recreate the preparation that might have been necessary to have my realization. Actually, I speak of a double epiphany, in that it was shared by the friend I was travelling with when we saw the artwork in question. He and I are both painters, and have much in common, both in terms of our own work and our voracious appetite for seeing museums, so when I planned a trip for late October 2018 to see thirty museums in two weeks in Germany and Austria, I knew just whom to call. David Carbone and I have known each other, and appreciated each other’s work, since leaving graduate school in 1975, meeting at the College Art Association held that year in Washington, DC, where people compete for jobs while trying to maintain a veneer of civility. David made less of an effort than most, and I vividly remember him in saddle shoes he had painted bright blue, wearing a tie featuring a burlesque dancer, sipping champagne in the garden courtyard of the National Gallery. All the nearby aspiring art historians were immaculately dressed and scrupulously behaved, but David finished his drink, and in imitation of a arion 27.1 spring/summer 2019 Russian toast, threw his empty glass against the wall, where it noisily shattered. I like this guy, thought I. Over the next few days, visiting DC’s museums together, I recognized the brilliance of his commentaries on the art we saw. And his wit: He told of studying with his painting professor, who became frustrated with David’s pace in painting and said “David, painting is really very simple!” The reply: “But, what if you’re not simple?” I can’t conjure a single artist about whose work we’ve disagreed in the course of the fortythree years we’ve known each other. Meeting often in New York, where he lives with his wife Donna (who, like my wife, is always perfectly willing to let us go museum schlepping without them), we’ve also travelled in central Italy, and even flew to Fort Worth to see a show of the Le Nain brothers. A very sweet guard there asked us, “Who ARE you?” and when we said we were painters, she said, “Oh, because I’ve never seen anybody look at paintings this long, or talk about them so much!” Berlin is a treasure trove, where we visited ten fine museums, then flew to Vienna, which was hosting an extensive exhibit of Bruegel’s paintings, though feast might be a more apt word. A visual feast, but one that didn’t leave one sated, jaded, or bloated, but rather improved, made less ambivalent about membership in a questionable species. Yes, the viewer consumed a meal of war, famine, foolishness, and pride, but the chef made it not just palatable but beautiful, thought-provoking and humorous. Bruegel and his contemporary Rabelais seem kindred spirits, skeptical but amused, bawdy but tender, creating not just works but micro to macro worlds, an alternate world view, in fact. Each painting mesmerized anyone looking long and carefully enough, discovering that a tiny girl on a sled is able to get a purchase on the ice not just with her diminutive sticks, but by the miniscule iron nails in which they end, painted with a one hair-brush. From this minutia we graduate to a wider and wider view, one that comes to imply infinity. Bruegel’s brilliant guidance doesn’t confront us... (shrink)

In this important book, Michael J. Perry examines three of the most disputed constitutional issues of our time: capital punishment, state laws banning abortion, and state policies denying the benefit of law to same-sex unions. The author, a leading constitutional scholar, explains that if a majority of the justices of the Supreme Court believes that a law violates the Constitution, it does not necessarily follow that the Court should rule that the law is unconstitutional. In cases in which it (...) is argued that a law violates the Constitution, the Supreme Court must decide which of two importantly different questions it should address: is the challenged law unconstitutional? Is the lawmakers' judgment that the challenged law is constitutional a reasonable judgment? Perry not only illuminates moral controversies that implicate one or more constitutionally entrenched human rights, but also the fundamental question of the Supreme Court's proper role in adjudicating such controversies. Perry argues that certain sorts of indexicals are 'essential', in the sense that they cannot be eliminated in favor of descriptions. This paper also introduces the influential idea that certain sorts of indexicals play a special role in thought, and have a special connection to action.

The founder of modern linguistics, Ferdinand de Saussure inaugurated semiology, structuralism, and deconstruction and made possible the work of Jacques Derrida, Roland Barthes, Michel Foucault, and Jacques Lacan, thus enabling the development of French feminism, gender studies, New Historicism, and postcolonialism. Based on Saussure's lectures, _Course in General Linguistics_ traces the rise and fall of the historical linguistics in which Saussure was trained, the synchronic or structural linguistics with which he replaced it, and the new look of diachronic linguistics that (...) followed this change. Most important, Saussure presents the principles of a new linguistic science that includes the invention of semiology, or the theory of the "signifier," the "signified," and the "sign" that they combine to produce. This is the first critical edition of _Course in General Linguistics_ to appear in English and restores Wade Baskin's original translation of 1959, in which the terms "signifier" and "signified" are introduced into English in this precise way. Baskin renders Saussure clearly and accessibly, allowing readers to experience his shift of the theory of reference from mimesis to performance and his expansion of poetics to include all media, including the life sciences and environmentalism. An introduction situates Saussure within the history of ideas and describes the history of scholarship that made _Course in General Linguistics_ legendary. A collection of twelve essays by John Perry and two essays he co-authored, this book deals with various problems related to "self-locating beliefs": the sorts of beliefs one expresses with indexicals and demonstratives, like "I" and "this." Postscripts have been added to a number of the essays discussing criticisms by authors such as Gareth Evans and Robert Stalnaker. Included with such well-known essays as "Frege on Demonstratives," "The Problem of the Essential Indexical," "From Worlds to Situations," and "The Prince (...) and the Phone Booth" are a number of important essays that have been less accessible and that discuss important aspects of Perry's views, referred to as "Critical Referentialism," on the philosophy of language and the philosophy of mind. Much of the discussion surrounding the ethics of abortion has centered around the notion of personhood. This is because many philosophers hold that the morality of abortion is contingent on whether the fetus is a person - though, of course, some famous philosophers have rejected this thesis (e.g. Judith Thomson and Don Marquis). In this article, I construct a novel argument for the immorality of abortion based on the notion of impairment. This argument does not assume that the fetus is (...) a person - indeed, I concede (for the sake of argument) that the fetus is not a person - and hence the morality of abortion is not contingent on whether the fetus is a person. I finish by answering a plethora of objections to my argument, concluding that none of them are successful. (shrink)

P-zombies are creatures that are physically (functionally, behaviorally) like you and I and yet lack phenomenal consciousness. If such creatures are possible, it’s (typically) taken to show property dualism is true: phenomenal consciousness isn’t reducible to—nor does it supervene on—physical states. If inverted qualia are possible, it’s possible that you and I have identical physical states and yet you see tomatoes as green and I see tomatoes as red. If this is the case, then (again) property dualism is (typically) taken (...) to be true. In this article, I’ll show that p-zombies and inverted qualia—if they are actually possible—prove more than previously thought: if one thinks p-zombies or inverted qualia are possible, then she should endorse one of the four following theses: (i) substance dualism, (ii) we have even more reason to reject p-zombies and inverted qualia since they entail an even more radical conclusion than previously thought (i.e. substance dualism), (iii) eliminativism about selves, or (iv) friends of p-zombies and inverted qualia have homework: they need to show a relevant, plausible disanalogy between arguments for p-zombies and inverted qualia as traditionally stated and my parallel arguments that entail substance dualism. My purpose here isn’t to defend any of these particular options. Instead, my purpose is to highlight that these are the four options available to take. (shrink)

In cases in which we must choose between either (i) preventing a woman from remaining unwillingly pregnant or (ii) preventing a fetus from being killed, we should prevent the fetus from being killed. But this suggests that in typical cases abortion is wrong: typical abortions involve preventing a woman from remaining unwillingly pregnant over preventing a fetus from being killed. And so abortion is typically wrong—and this holds whether or not fetuses are persons.

Critics of skeptical theism often claim that if it (skeptical theism) is true, then we are in the dark about whether (or for all we know) there is a morally justifying for God to radically deceive us. From here, it is argued that radical skepticism follows: if we are truly in the dark about whether there is a morally justifying reason for God to radically deceive us, then we cannot know anything. In this article, I show that skeptical theism does (...) not entail that we are in the dark about whether (or for all we know) there is a morally justifying reason for God to deceive us. And hence arguments against skeptical theism that make use of this assumption fail. (shrink)

It is often assumed that if the fetus is a person, then abortion should be illegal. Thomson1 laid the groundwork to challenge this assumption, and Boonin2 has recently argued that it is false: he argues that abortion should be legal even if the fetus is a person. In this article, I explain both Thomson’s and Boonin’s reason for thinking that abortion should be legal even if the fetus is a person. After this, I show that Thomson’s and Boonin’s argument for (...) legalised abortion fail; they have not given us good reason for thinking abortion should be legal.1 Finally, I argue that—if we play Boonin’s game—abortion should be illegal. When discussing the ethics and politics of abortion, whether the fetus is a person is usually central.3 4.2 However, Thomson1 long ago challenged this view. She argued that abortion is permissible even if the fetus is a person. To do so, she asks us to consider a case in which you are non-consensually taken to a hospital and hooked up to a famous violinist. The violinist, if he is to survive, needs to filter his blood through your body. After 9 months, he will be fine and you can unplug yourself and go on your way. If you unplug yourself prior to this, however, he will die. Is it permissible to unplug yourself? Thomson thinks the answer is ‘yes’. And this, she thinks, shows that abortion is permissible even if the fetus is a person. While the majority of her article focuses on the ethics of abortion, it is clear that she also aims to show that abortion should be legal if the fetus is a person; she would no doubt reject the view that the state is right to coerce you into ….
