Questions concerning moral problems caused by the lifesciences and concerning the adequate methods and instruments to solve these are timely and urgent; especially in the face of intense debates on the acceptability of research on human embryonic stem cells and preimplantation diagnostics, to name only two applications developed from research in the life-sciences. Unfortunately, the constant and accusing demand that life-scientists must behave morally does not give us a clue on how ethics may help in establishing guidelines for moral behaviour. (...) In this heated situation the foundation of ethics-committees seems to be the motto of the day. But instead of functioning as necessary and fruitful scientific advisory boards, these committees run the risk of being misused as a fashionable (and soon forgotten) weapon in the battle for political opinion-leadership. In the following article, the view is defended that ethics is a scientific enterprise and has an important role to play in political decision making on lifesciences issues. This text considers art as an action of life and power, or stated slightly differently, how art is an aesthetic-political game of implication in the bio-political device of our time, especially, in the spaces of “exclusion”, or “social exclusion”. In this sense the present paper builds on Saül Karsz’s interpretation of exclusion as a “false concept for a true problem” : that is, the exclusion of groups, populations, people is real… but it is also true that the disciplines that to (...) investigate the subject use this real problem for their own purposes. Exclusion as a concept qualifies an enormous field of discourse and research practices that convert the true problem of exclusion into a false concept: a weapon used to give to read, to watch and to interpret the problem of exclusion. Nevertheless, exclusion exists. And it is necessary to think of how we can treat it without relying on empty rhetoric or a fashioned position, or participating in a blind activism that depoliticizes the necessity to think about exclusion in all its forms. After discussing diverse contemporary aesthetic theories, and in particular the theories of J. Rancière, this work presents the figure of the museum of the future in which art can be understood as an aesthetic-political game able to transform life in its spaces of power, a promise of emancipation and equality. Organized rape has been an integral aspect of warfare for a long time even though classics on warfare have predominantly focused on theorizing ‘regular’ warfare, that is, the situations in which one army encounters another in a battle to conquer or defend a territory. Recently, however, much attention has been paid to asymmetric warfare and, accordingly, to phenomena such as guerrilla tactics, terrorism, hostage taking and a range of identity-related aspects of war such as religious fundamentalism, holy war, ethnic cleansing (...) and war rape. In fact, war rape can be taken as a perfect example of an asymmetric strategy. In war rape the soldier attacks a civilian (not a fellow combatant) and a woman (not another male soldier), and does this only indirectly with the aim of holding or taking a territory. The primary target here is to inflict trauma and through this to destroy family ties and group solidarity within the enemy camp. This article understands war rape as a fundamental way of abandoning subjects: rape is the mark of sovereignty stamped directly on the body, that is, it is essentially a bio-political strategy using (or better, abusing) the distinction between the self and the body. Through an analysis of the way rape was carried out by the predominantly paramilitary Serbian forces on Bosnian soil, this article theorizes a two-fold practice of abjection: through war rape an abject is introduced within the woman’s body (sperm or forced pregnancy), transforming her into an abject-self rejected by the family, excluded by the community and quite often also the object of a self-hate, sometimes to the point of suicide. This understanding of war rape is developed in the article through a synthesis of the literature on abandonment (Agamben, Schmitt) and abjection (Bataille, Douglas, Kristeva) and concomitantly it is argued that the penetration of the woman’s body works as a metaphor for the penetration of enemy lines. In addition it is argued that this bio-political strategy, like other forms of sovereignty, operates through the creation of an ‘inclusive exclusion’. The woman and the community in question are inscribed within the enemy realm of power as those excluded. (shrink)

The dual-use issue is often framed as a series of paralyzing ‘dilemmas’ facing the scientific community as well as institutions which support innovation. While this conceptualization of the dual-use issue can be useful in certain contexts its usefulness is more limited when reflecting on the governance and politics of the dual-use issue. Within this paper, key shortcomings of the dilemma framing are outlined. It is argued that many of the issues raised in the most recent debates about ‘dual-use’ bird flu (...) research remain unresolved. This includes questions about the trajectories of certain lines of research, as well as broader trends in the practice and governance of science. What difference does the Judeo-Christian tradition make in (...) shaping the modern relationship with nature?To answer these questions I will give brief descriptions of the way in which three cultural traditions have structured the relationship between man and nature: societies that are ruled by sacred kings, societies where power over nature is attributed to divinities, and the Old Testament tradition. As cases of sacred kinship, I present ethnographic material taken from my anthropological fieldwork among the Lulubo, Lokoya, and Lotuho peoples from the East Bank of the Nile in Southern Sudan. I will use the term "Eastern Nilotic" as shorthand for this complex of peoples. For the societies where divinities play the central role, I take the Western Nilotic Dinka, Nuer, and Atuot living in the flood plains of the Nile north of the kingship societies.In comparing these three traditions my point of departure is René Girard's analysis of culture as a mechanism to resolve conflict by directing the aggression of the members of society onto a victim and so achieving a new consensus. We shall see that in the kingship societies what we call natural phenomena play an integral part in culturally staging the scapegoat mechanism. They are the stage of human rivalries and their resolution. Among the polytheistic Western Nilotes they are the instrument through which the gods make their power felt and demand attention from humans. In the Old Testament, natural phenomena remain the domain of God's power. Humans should not try to interfere. Their mission is to combat human evil as defined in Mosaic law. [End Page 31]2. Kings as Ecological AgentsThe survival of the communities of the Lokoya and Lulubo on the East Bank of the Nile who traditionally live in well-fortified village-polities, counting in the precolonial period between 1500 and 2500 inhabitants, is dependent on forces that are unpredictable (Simonse 1992). As agriculturists they are dependent on regular rains. However, the rains in their area are erratic and localized. As a result there is always a risk that the harvest may fail. The soil is of varying quality, giving varying yields in different places. The birth rate is another major concern. It determines the security of the community in its relationship to neighboring, frequently hostile, communities. There is the concern for epidemics, crop-eating insects and birds, and root-eating worms. Violent winds may destroy the crop, and lions and leopards may kill humans and cattle. A concern of a different order is the extent of the effectiveness of weapons, spears, and bows and arrows, in assuring security.When adversity affects the community, the first question asked by those affected is that regarding its cause. Frequently the cause is a breach of the social rules: an act of violence and a failure to perform or properly perform a ritual of purification necessitated by the violence. It may also be unconscious resentment on the part of a person or group that feels excluded from benefits enjoyed by others. It may be the cry of a neglected relative. It may be incest. It may be an attack by outsiders.Among the Lulubo and Lokoya, responsibility for the various aspects of the natural environment that can be critical for community survival is allocated to the different clans. In the case of a crisis (drought, infertility) the clan associated with the problem is the target of investigations. ISBN: 0-19-515203-4.At the very last page of her book Kristin Shrader-Frechette writes: "We fail to recognize that unless we are the agents of democracy and social reform, there will be neither democracy nor social reform." This is such a short (...) sentence, and yet it is so important. Shrader-Frechette writes this book in order for us the readers to be moved both philosophically and politically speaking. It is a Socratic way of shocking the student, and causing her to reflect upon the way she has conceived things, the way she has interpreted the world. This is not an easy book to read—it is more like watching a violent film: it tells us about greediness, cruelty, misery, cynicism, and the like. But just like watching a good film, after reading the book one cannot remain indifferent.This book, then, is not a typical neutral piece of philosophy or social science. Shrader-Frechette has an agenda on her mind, and she claims that not only is it wrong not to do something to stop environmental injustice, but in fact people have a duty to be active, politically speaking (see especially [End Page 140] pp. 195-7). Indeed, it is about time environmental philosophers realize that they have a social obligation not to remain unconcerned. Their first weapon is their philosophical tools, which they should employ to reveal and criticize what is going on. In this case, for example, Shrader-Frechette not only describes many cases of environmental injustice, but she also eloquently analyzes the arguments that are used by those opposing policies that are meant to rectify environmental disadvantages. Her position is unequivocal: environmental injustice is wrong because it is immoral, and because it discriminates against people, often the more vulnerable. Environmental injustice is defended by arguments which are philosophically flawed and morally repugnant. However, there are growing cases of environmental injustice because there are strong interests behind them, and because the more powerful can exploit the vulnerability of those marginalized by society. The reader can hear the echo of the French novelist Emile Zola's famous article, apropos of the Dreyfus affair: "J'accuse."What is 'environmental justice'? Often goods (e.g., cheaper electricity or faster cars) are manufactured with an environmental cost (pollution). Obviously, one relevant question is whether we need these goods. Let us assume that society decides we do. Sometimes this production ends up in severe injustice. Sometimes only the rich enjoy the benefits (e.g., faster cars) while the entire population pays the cost (more air pollution, more noise). Sometimes it is the case that society in general enjoys the benefits (e.g., cheaper electricity). Nevertheless, only a small group bears the cost.Why is the cost so unevenly distributed? First, pollution and hazardous waste must be treated by professionals so it is transferred to, and concentrated in several locations to be treated. This exposes the populations that live there to very high levels of pollution. These people, then, face risks to their health and well-being, which other people do not have to face.Furthermore, when this happens house prices in the area usually fall, and these people are trapped there: so sharp is the fall in house pricing in their area that they cannot move to another, cleaner, or safer place, because whatever price they will get for their houses won't allow them to buy a decent house in cleaner areas. Once the process has started, even more pollution is attracted to this place. This is partly due to market forces: buying burial space for hazardous waste becomes very cheap in these locations, and therefore more and more firms use these locations for the burial [End Page 141] of hazardous waste. Our relatively accommodating habitat at the fold of lithosphere and atmosphere enables a Lethe of oblivion, though many elements of our world are hostile to breath: water, fire, earth, extremes of height, heat, or cold. Nothing could be more fundamental for aerobic terrestrial creatures than breathing. So its routine cloaking in impercipience must somehow be functional and require a great deal of nervous expenditure. As such The Post Card may well be Archive Fever’s phantom limb, something essential that has been cut off and that haunts the text. In 2000 Bill Joy proposed that the best way to prevent technological apocalypse was to "relinquish" emerging bio-, info- and nanotechnologies. His essay introduced many watchdog groups to the dangers that futurists had been warning of for decades. One such group, ETC, has called for a moratorium on all nanotechnological research until all safety issues can be investigated and social impacts ameliorated. In this essay I discuss the differences and similarities of regulating bio- and nanotechnological innovation to the efforts to (...) regulate nuclear and biological weapons of mass destruction. I then suggest the creation of a global technology regulatory regime to ensure the safe and equitable diffusion of genetic, molecular and information technologies, and point out the principal political obstacles to implementing such a regime. (bio)The general struggle throughout Christian history has been to seek the proper balance between dominion and limits, intervention and nonintervention, givenness, and creativity. This struggle has worked itself out in six areas that touch human life. In this essay, I will revisit the Catholic tradition’s treatment of these in terms of dominion and limits to see whether we can discern developmental (...) patterns that might suggest an approach to issues pertaining to the sources of life (reproductive ethics) as we move into the next century.1. Abortion. The history of the treatment of abortion in the Catholic tradition is the history of an evaluation. This evaluation was somewhat muddied by [End Page 387] unclarity and inconsistency in the use of terms. Thus, some theologians distinguished three types of abortion: prevention of conception, abortion of an inanimate fetus, and abortion of an animated fetus. Others regarded all interventions into the life-giving process as homicides. Still others argued that termination of a nonanimated fetus was justified to save the life of the mother. And still others said such termination was anticipated homicide or the misuse of semen conceptum.Such unclarities and qualifications eventually vanished and produced an evaluation of fetal life that yielded to very few competing interests, what John Noonan (1970) referred to as “an almost absolute value.” There was some dominion or control, but the limits became increasingly clear and powerful.2. Individual and corporate self-defense. Augustine disallowed lethal individual or personal self-defense, but established the first elementary rules for war. Aquinas allowed both. Vitoria, Suarez, and others refined the criteria justifying war (jus ad bellum) and listed them as three: recovery of property, resistance to aggression, and vindication of injuries (injustices). Pius XII narrowed these to a single reason: national self-defense. The Challenge of Peace (NCCB 1983) moves away from the licitness of nuclear war and nuclear deterrence even for self-defense. Once again, the limits to the dominion over life in war grow stronger and more powerful even as the weapons of such dominion grow more powerful.3. Capital punishment. Over the centuries, Christian thinkers, such as Thomas Aquinas, permitted the use of capital punishment. Three justifications were proposed to found this right of the state: retribution, deterrence, and reform. In the past decades, however, these justifications have been seriously questioned. Both the American and Philippine bishops’ conferences have rejected all use of capital punishment. Most recently John Paul II (1995, n. 56, p. 709) adduces defense of society as the only possible justification for it and sees such cases as “very rare if not practically non-existent.”4. The preservation of life. The theme of a balance between dominion and limits is perhaps nowhere clearer than in the Catholic approach to life preservation. Catholic tradition does not accept our culture’s rejection of death. Rather it asserts that the facts that we are pilgrims, that Christ has overcome death and lives, and that we also will live with him yield a general value judgment on the meaning and value of life as we now live it: Life is a basic good but not an absolute one. One reason that they are difficult to teach about is that they have proved notoriously difficult for art historians to come to terms with. This is undoubtedly a consequence of their abstraction. (...) In the face of an apparent disintegration of the traditional pictorial distinction between figure and ground, multiplicities of (sometimes contradictory) readings present themselves. The question, posed to students, as to what they represent is an open one. To many, recalling the opinions of the baffled audience of the 1950s, they are nothing but an inchoate mess. In 1950 Time magazine referred to them as "chaos," prompting Pollock to wire a heated reply, "NO CHAOS DAMN IT."1Pollock's claim of "no chaos" can, however, be unpacked. Given the suggestive ambiguity and "chaos" of the images, there is little in the work itself that challenges the numerous, often contradictory, readings that have been posited. In fact, how art historians approach such images tells students something about the way art history itself works and how art historians are faced with particular choices in applying their discursive models. They must choose whether these accounts "fit" or satisfy the conditions of "rightness," to evoke Nelson Goodman's terms.2The numerous questions that have been asked of what the paintings actually represent are themselves demonstrative of the wide variety of techniques that modern art historians have at their disposal. Analyses have been based upon observations that are couched in the vocabularies of the political (often Marxist theory), feminism, psychoanalysis, iconography, formalism, and so forth.3 At the time of the paintings' creation even the CIA was in on the act; apparently realizing the ambiguity of the work left it open to political manipulation, they secretly funded the promotion of abstract expressionism as a weapon of the cold war.4 Simultaneously, members of Congress such as George Dondero were actually claiming the opposite—that Pollock was making paintings that were a "means of espionage" (sic) and that "If you know how to read them... [they] will disclose weak spots in U.S. fortifications, and such crucial constructions as Boulder Dam."5Ernst Gombrich's celebrated frustration with abstract art highlights the problems that those following traditional art historical methods had with such art at the time. The book sheds new light on the physical, mental, and vocal training of the performer and furthermore gives insight into Fabre's revolutionary thoughts on contemporary theatre.1Breathing is the first of the ten performative principles that together create the basic grammar in which the language of the performers is grounded.Three-phased breathing (one part in, one part out, one part nothing) is a basic condition in the series of exercises Jan Fabre developed throughout his career. The clinical phenomenon discussed (...) in this paper is defined as a serious but not severe depression occurring upon returning from the Iraq war. The impression, from the vantage point of a psychotherapist, is that too many details are lacking from the account that is provided and that the case is hurriedly explained away invoking a naturalistic evolutionary model.The psychotherapeutic, as well as the clinical (Stanghellini 2007) and the research (Stanghellini and Ballerini 2008) interview is a quest for meaning. Its first concern is an accurate unfolding of subjective experiences and the organization of these experiences according to a pattern of sense that is immanent to the experiences themselves; the interpretation or the explanation of these experiences according to a model that is not immanent in the clinical material itself may come as a later step.The first step may be called the explication of case material. ISBN: 0-19-515203-4.At the very last page of her book Kristin Shrader-Frechette writes: "We fail to recognize that unless we are the agents of democracy and social reform, there will be neither democracy nor social reform." This is such a short (...) sentence, and yet it is so important. Shrader-Frechette writes this book in order for us the readers to be moved both philosophically and politically speaking. It is a Socratic way of shocking the student, and causing her to reflect upon the way she has conceived things, the way she has interpreted the world. This is not an easy book to read—it is more like watching a violent film: it tells us about greediness, cruelty, misery, cynicism, and the like. But just like watching a good film, after reading the book one cannot remain indifferent.This book, then, is not a typical neutral piece of philosophy or social science. Shrader-Frechette has an agenda on her mind, and she claims that not only is it wrong not to do something to stop environmental injustice, but in fact people have a duty to be active, politically speaking (see especially [End Page 140] pp. 195-7). Indeed, it is about time environmental philosophers realize that they have a social obligation not to remain unconcerned. Their first weapon is their philosophical tools, which they should employ to reveal and criticize what is going on. In this case, for example, Shrader-Frechette not only describes many cases of environmental injustice, but she also eloquently analyzes the arguments that are used by those opposing policies that are meant to rectify environmental disadvantages. Her position is unequivocal: environmental injustice is wrong because it is immoral, and because it discriminates against people, often the more vulnerable. Environmental injustice is defended by arguments which are philosophically flawed and morally repugnant. However, there are growing cases of environmental injustice because there are strong interests behind them, and because the more powerful can exploit the vulnerability of those marginalized by society. The reader can hear the echo of the French novelist Emile Zola's famous article, apropos of the Dreyfus affair: "J'accuse."What is 'environmental justice'? Often goods (e.g., cheaper electricity or faster cars) are manufactured with an environmental cost (pollution). Obviously, one relevant question is whether we need these goods. Let us assume that society decides we do. Sometimes this production ends up in severe injustice. Sometimes it is the case that society in general enjoys the benefits (e.g., cheaper electricity). Nevertheless, only a small group bears the cost.Why is the cost so unevenly distributed? First, pollution and hazardous waste must be treated by professionals so it is transferred to, and concentrated in several locations to be treated. This exposes the populations that live there to very high levels of pollution. These people, then, face risks to their health and well-being, which other people do not have to face.Furthermore, when this happens house prices in the area usually fall, and these people are trapped there: so sharp is the fall in house pricing in their area that they cannot move to another, cleaner, or safer place, because whatever price they will get for their houses won't allow them to buy a decent house in cleaner areas. Once the process has started, even more pollution is attracted to this place. This is partly due to market forces: buying burial space for hazardous waste becomes very cheap in these locations, and therefore more and more firms use these locations for the burial [End Page 141] of hazardous waste. However, there is a second reason for this: it seems that the authorities and committees that decide where to send the waste to, are formed by middle class people who are less likely to live in those locations. This book is about the use of legal scholarship by judges. It discusses the possibility that legal scholarship may function as a genuine source of law in modern municipal legal systems. The book advances a number of claims, some conceptual, some empirical, some normative. The major conceptual claims are found in Chapters 2 and 3, where a general account of the notion of a source of law is provided. Roughly, sources of law are documents or practices (e.g. statutes, judicial decisions, (...) official customs) from which norms can be derived that function as sources of content-independent reasons for judges to decide legal cases one way or another. The relevant notion of content-independence is derived (with qualifications) from H.L.A. Hart's jurisprudence. Indeed, the book's analysis of the concept of a source of law relies at various points on Hartian insights about law and legal reasoning. Chapter 4 argues that legal scholarship - or, more precisely, a particular type of legal scholarship that might be described as standard or doctrinal - can be, and indeed is, used as a source of law in modern legal systems. The conclusion that legal scholarship is used as a source of law (and thus as a source of content-independent reasons for action) may come as a surprise to those who associate judicial recourse to legal scholarship with judicial activism. This association is discussed and criticized in Chapters 5 and 6. It is argued that, in spite of a relatively common opinion to the contrary, legal scholarship can be used to mitigate discretion. In fact, it is precisely because it can be used in this way that judges sometimes refer to scholarship deceptively and suggest that it limits discretion in situations in which it really does not. Dentre os códigos fascistas que organizam o desejo, o racismo se destaca (dentre o machismo, a homofobia, por exemplo) por tentar situar a alteridade num determinado grupo de pessoas de forma a controlá-la, subjugá-la. Esse desejo de distinção provém, em grande medida, da angústia produzida pela presença da alteridade dentro do próprio sujeito. Há algo em um livro como o de Carolina que é preciso ser destacado: trata-se de uma resposta singular a um pacto social perverso, organizado pelo racismo. Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. The possibility that autonomous weapons will be deployed on the battlefields of the future raises the challenge of determining who can be held responsible for how these weapons act. Robert Sparrow has argued that it would be impossible to attribute responsibility for autonomous robots' actions to their creators, their commanders, or the robots themselves. This essay reaches a much different conclusion. It argues that the problem of determining responsibility for autonomous robots can be solved by addressing it within (...) the context of the military chain of command. The military hierarchy is a system of distributing responsibility between decision makers on different levels and constraining autonomy. If autonomous weapons are employed as agents operating within this system, then responsibility for their actions can be attributed to their creators and their civilian and military superiors. The importance of addressing the existential threat to humanity, climate change, has grown remarkedly in recent years while conflicting views and interests in societies exist. Therefore, climate change agendas have been weaponized to varying degrees, ranging from the international level between countries to the domestic level among political parties. In such contexts, climate change agendas are predominantly driven by political or economic ambitions, sometimes unconnected to concerns for environmental sustainability. Consequently, it can result in an environment that fosters antagonism and (...) disputes over power and position and increases the risk of prolonged confrontations, hindering the collective global efforts to mitigate and adapt to climate change. Through the current discourse, we aim to provide a preliminary definition of the weaponization of climate change and environmental degradation and examine its risks and consequences on international relations, political dynamics, public perception, and the comprehensive integrity of climate action. We also recommend embracing a globally coordinated, scientifically substantiated approach to circumvent climate change by building an eco-surplus cultural value system. (shrink)

One of the several reasons given in calls for the prohibition of autonomous weapons systems (AWS) is that they are against human dignity (Asaro, 2012; Docherty, 2014; Heyns, 2017; Ulgen, 2016). However there have been criticisms of the reliance on human dignity in arguments against AWS (Birnbacher, 2016; Pop, 2018; Saxton, 2016). This paper critically examines the relationship between human dignity and autonomous weapons systems. Three main types of objection to AWS are identified; (i) arguments based on technology (...) and the ability of AWS to conform to International Humanitarian Law; (ii) deontological arguments based on the need for human judgement and meaningful human control, including arguments based on human dignity; (iii) consequentialist reasons about their effects on global stability and the likelihood of going to war. An account is provided of the claims made about human dignity and AWS, of the criticisms of these claims, and of the several meanings of ‘dignity’. It is concluded that although there are several ways in which AWS can be said to be against human dignity, they are not unique in this respect. There are other weapons, and other technologies, that also compromise human dignity. Given this, and the ambiguities inherent in the concept, it is wiser to draw on several types of objections in arguments against AWS, and not to rely exclusively on human dignity. (shrink)

Drawing on postmodernist analyses, Leaky Bodies and Boundaries presents a feminist investigation into the marginalization of women within western discourse that denies both female moral agency and bodylines. With reference to contemporary and historical issues in biomedicine, the book argues that the boundaries of both the subject and the body are no longer secure. The aim is both to valorize women and to suggest that "leakiness" may be the very ground for a postmodern feminist ethic. The contribution made by Margrit (...) Shildrick is to go beyond modernist feminisms to radically displace the mechanisms by which women are devalued. The anxiety that postmodernism cannot yield an ethics, nor advance feminist concerns is addressed. (shrink)

Autonomous weapons systems (AWS), sometimes referred to as “killer robots”, are receiving evermore attention, both in public discourse as well as by scholars and policymakers. Much of this interest is connected with emerging ethical and legal problems linked to increasing autonomy in weapons systems, but there is a general underappreciation for the ways in which existing law might impact on these new technologies. In this paper, we argue that as AWS become more sophisticated and increasingly more capable than (...) flesh-and-blood soldiers, it will increasingly be the case that such soldiers are “in the power” of those AWS which fight against them. This implies that such soldiers ought to be considered hors de combat, and not targeted. In arguing for this point, we draw out a broader conclusion regarding hors de combat status, namely that it must be viewed contextually, with close reference to the capabilities of combatants on both sides of any discreet engagement. Given this point, and the fact that AWS may come in many shapes and sizes, and can be made for many different missions, we argue that each particular AWS will likely need its own standard for when enemy soldiers are deemed hors de combat. We conclude by examining how these nuanced views of hors de combat status might impact on meaningful human control of AWS. (shrink)

. This paper investigates the mechanisms of knowledge production of twenty-first century robotics-inspired morphology. How robotics influences investigations into the structure, development, and change of organic forms? Which definition of form is presupposed by this new approach to the study of form? I answer these questions by investigating how robots are used to understand and generate new questions about the locomotion of extinct animals in the first case study and in high-performance fishes in the second case study. After having illustrated (...) the landscape of twentieth-century morphology, I will reflect on the definition of form adopted in twenty-first century robotics-inspired morphology as well as on the differences between this approach to the study of form and the so-called nature-inspired disciplines, such as bionics or biomimetics. In the conclusion, I suggest that we are now in a material turn in morphology, characterized by the coexistence of the robotic, the virtual, and the real, which enables an understanding of how the structures and dynamics of shapes change over time. Increasing awareness of the importance of the biodiversity of the whole global biosphere has led to further awareness that the problems which arise in connection with preservation and exploitation of our planet’s biodiversity are best tackled from a global perspective. The ‘Biodiversity Convention’ and the ‘Human Genome Project’ are some of the concrete attempts at such globalisation. But, while these efforts are certainly very good at the intentional level and on paper, there is, at the practical level of implementation, the (...) danger that globalisation may simply translate into westernisation, given the Western world’s dominance and will to dominate the rest of the globe. How is ‘global bioethics’ to be possible in a world inhabited by different cultural groups whose material situation, powers, ideas, experiences and attitudes differ rather markedly and who are not, in any case, equally represented in globalisation efforts and fora? One index of the pertinence of this question is that talk about biodiversity, biotechnology, biotrade etc. is being increasingly matched by talk about biopiracy, biorade, biocolonialism etc. In this paper, I attempt to explore and develop these very general concerns. Due to advances in military technology, there has been an outpouring of research on what are known as autonomous weapon systems (AWS). However, it is common in this literature for arguments to be made without first making clear exactly what definitions one is employing, with the detrimental effect that authors may speak past one another or even miss the targets of their arguments. In this article I examine the U.S. Department of Defense and International Committee of the Red Cross definitions (...) of AWS, showing that these definitions are far broader than some recognize, and that they therefore classify a much larger set of weapons as AWS. I then show that these broader views of AWS have implications for what moral and legal rules we might argue should be applied to such systems. I conclude by arguing there is a greater need for precision and clarity within AWS debates, in order to ensure that researchers are discussing the same weapon systems (autonomous or otherwise) when they argue for or against particular points. The purpose of this article is not to defend any specific view of AWS, nor to further any general endorsement or objection to such systems, but rather to show the importance of argumentative clarity in this debate. Technological progress has brought about the emergence of machines that have the capacity to take human lives without human control. These represent an unprecedented threat to humankind. This paper starts from the example of chemical weapons, now banned worldwide by the Geneva protocol, to illustrate how technological development initially aimed at the benefit of humankind has, ultimately, produced what is now called the “Weaponization of Artificial Intelligence (AI)”. Autonomous Weapon Systems (AWS) fail the so-called discrimination principle, yet, the wider (...) public is largely unaware of this problem. Given that ongoing scientific research on AWS, performed in the military sector, is generally not made available to the public domain, many of the viewpoints on this subject, expressed across different media, invoke common sense rather than scientific evidence. Yet, the implications of a potential weaponization of our work as scientists, especially in the field of AI, are reaching further than some may think. The potential consequences of a deployment of AWS for citizen stakeholders are incommensurable, and it is time to raise awareness in the public domain of the kind of potential threats identified, and to encourage legal policies ensuring that these threats will not materialize. Human persons exist longer than a single moment in time; they persist through time. However, so far it has not been possible to make this natural and widespread assumption metaphysically comprehensible. The philosophical debate on personal identity is rather stuck in a dilemma: reductionist theories explain personal identity away, while non-reductionist theories fail to give any informative account at all. This chapter argues that this dilemma emerges from an underlying commitment, shared by both sides of in the debate, to an (...) ontology which that gives the priority to static unchanging things. The claim defended here is that the dilemma of personal identity can be overcome if we acknowledge the biological nature of human persons and switch to a process- ontological framework that takes process and change to be ontologically primary. Human persons are biological higher-order processes, rather than things, and their identity conditions can be scientifically investigated. (shrink)

To many, the idea of autonomous weapons systems (AWS) killing human beings is grotesque. Yet critics have had difficulty explaining why it should make a significant moral difference if a human combatant is killed by an AWS as opposed to being killed by a human combatant. The purpose of this paper is to explore the roots of various deontological concerns with AWS and to consider whether these concerns are distinct from any concerns that also apply to long- distance, human-guided (...) weaponry. We suggest that at least one major driver of the intuitive moral aversion to lethal AWS is that their use disrespects their human targets by violating the martial contract between human combatants. On our understanding of this doctrine, service personnel cede a right not to be directly targeted with lethal violence to other human agents alone. Artificial agents, of which AWS are one example, cannot understand the value of human life. A human combatant cannot transfer his privileges of targeting enemy combatants to a robot. Therefore, the human duty-holder who deploys AWS breaches the martial contract between human combatants and disrespects the targeted combatants. We consider whether this novel deontological objection to AWS forms the foundation of several other popular yet imperfect deontological objections to AWS. (shrink)

Van Rensselaer Potter (1911-2001), le biologiste à l’origine du terme « bioéthique » dans les écrits nord-américains, considère que « real bioethics falls in the context of the ideals of […] Aldo Leopold », un forestier, philosophe et poète ayant marqué le XXe siècle. Associer Leopold à Potter a pour effet de placer la bioéthique dans la famille des éthiques de l’environnement, ce qui la différencie du sens conventionnel retenu en médecine et en recherche depuis le Rapport Belmont (1979), une (...) déclaration ayant propulsé l’institutionnalisation de la bioéthique en Amérique du Nord. Cependant, diviser la bioéthique entre le médical et l’environnemental est réducteur. Potter propose au contraire une bioéthique globale s’intéressant aux enjeux situés à leur interface, dont ceux concernant la terre, la vie sauvage, la surpopulation, la consommation, etc. Cet article vise à amorcer un nouveau chantier d’analyse de la pensée de Potter en s’appuyant sur l’héritage de Leopold en biologie. Une synthèse de cette vision potterienne est proposée de manière à considérer son œuvre comme un tout cohérent s’intégrant aux grands débats qui transcendent les XXe et XXIe siècles. Sa vision apparaît comme une sagesse collective et prospective sous la forme d’une science de la survie et d’un code de bioéthique. Dépassant l’éthique de l’environnement, son association avec Leopold offre un modèle de la complexité s’imposant comme cas indissociable du contexte qui l’englobe, en améliorant nos façons d’intervenir en pratique dans un monde en constante transformation, à titre de gouvernance adaptative et de sagesse de la responsabilité. While Autonomous Weapons Systems have obvious military advantages, there are prima facie moral objections to using them. By way of general reply to these objections, I point out similarities between the structure of law and morality on the one hand and of automata on the other. I argue that these, plus the fact that automata can be designed to lack the biases and other failings of humans, require us to automate the formulation, administration, and enforcement of law as much (...) as possible, including the elements of law and morality that are operated by combatants in war. I suggest that, ethically speaking, deploying a legally competent robot in some legally regulated realm is not much different from deploying a more or less well-armed, vulnerable, obedient, or morally discerning soldier or general into battle, a police officer onto patrol, or a lawyer or judge into a trial. All feature automaticity in the sense of deputation to an agent we do not then directly control. Such relations are well understood and well-regulated in morality and law; so there is not much challenging philosophically in having robots be some of these agents — excepting the implications of the limits of robot technology at a given time for responsible deputation. I then consider this proposal in light of the differences between two conceptions of law. These are distinguished by whether each conception sees law as unambiguous rules inherently uncontroversial in each application; and I consider the prospects for robotizing law on each. Likewise for the prospects of robotizing moral theorizing and moral decision-making. Finally I identify certain elements of law and morality, noted by the philosopher Immanuel Kant, which robots can participate in only upon being able to set ends and emotionally invest in their attainment. One conclusion is that while affectless autonomous devices might be fit to rule us, they would not be fit to vote with us. For voting is a process for summing felt preferences, and affectless devices would have none to weigh into the sum. Since they don't care which outcomes obtain, they don't get to vote on which ones to bring about. (shrink)

Predictions about autonomous weapon systems are typically thought to channel fears that drove all the myths about intelligence embodied in matter. One of these is the idea that the technology can get out of control and ultimately lead to horrifi c consequences, as is the case in Mary Shelley’s classic Frankenstein. Given this, predictions about AWS are sometimes dismissed as science-fiction fear-mongering. This paper considers several analogies between AWS and other weapon systems and ultimately offers an argument that nuclear (...) class='Hi'>weapons and their effect on the development of modern asymmetrical warfare are the best analogy to the introduction of AWS. The fi nal section focuses on this analogy and offers speculations about the likely consequences of AWS being hacked. These speculations tacitly draw on myths and tropes about technology and AI from popular fi ction, such as Frankenstein, to project a convincing model of the risks and benefi ts of AWS deployment. In this chapter, we will first argue that current practices in CBE are framed within the market or economic logic and miss the normative dimension of the call for circularity. The transition to the CBE requires a fundamental reflection on the role of economic actors in the social and ecological environment with significant consequences for their business practices. Second, we will argue that the transition to the CBE requires the acknowledgement of the normative and social dimensions of this transition at (...) the meso and macro levels, and the establishment of an environmental and social logic on the micro level of business practices. Third, we will argue that the concept of responsible innovation (RI) can help to articulate the normative and social dimensions of the transition to the CBE, and enables the operationalisation of the environmental and social logic at the micro level. In this respect, RI can be understood as a driver for the transition to the CBE. (shrink)
